all right go on call our meeting to order this is a work session of the mayor and bur Council the bur of Seaside Park County botion state of New Jersey held on Thursday February 1st 2024 at 7 P.M pursuant to the provisions of New Jersey's open public meetings act adequate notice of this meeting was properly provided by transmitting the notice of meeting for publication in the asur Park Press and the Star Ledger on January 5th 2024 no of the meeting and the governing body also has been posted in the corridor of the municipal building and in the office of the municipal clerk roll call council member amille here council member condos here council member Connor here council member CRA yes council member Renda yes council president will here mayor Pearson here thank you the first item on the agenda is a public hearing of the Seaside Park bur of Seaside Park development green an funding application it's listed on the regular meeting agenda as resolution 22473 for consideration uh later this meeting uh I'll re read a brief uh introductory statement uh and that indicates as follows that Seaside Park is preparing a Grant application currently to improve the softball field and the associated amenities at the 13th Avenue ballpark tennis cour uh basketball court fa facility and playground the MJ D Green Acres Grant application is for Park development if approved it will allow for the improvements of drainage on the field New infield Outfield materials concrete replacement around the dugouts and bleachers and the replacement of the fence around the field as required by Green Acres process we are holding this public hearing tonight as advertised in the local newspapers of circulation and and as included on Seaside Park's website to advise the public that the grant is being submitted our consultant tnm Associates is here and will now present the park improvements and answer questions at the end of the presentation as required by the Green Acres Program we also have the municipal clerk naturally here this evening to document this this meeting which is required for Grant application submittal uh on February 7th 2024 and we welcome the individual Consultants from tnm here this evening headed up by a team by Steve shriber uh to whom I will now turn over the floor Mr sh of council how are you tonight how's everybody doing I'm ass um er will for in the presentation that talks about the environmental impact assessment the site and the g will give a reation of the application SM on behalf of the so as the mayor had read the intention is to improve the existing softball field that's located on 13 between 13 to 14th AV as anyone would know that's been there in recent years it's been around since the late 1980s early 1990s it's got some maintenance issues with the INF field it has fors rage and um It's relatively just old and we want to upgrade it and we're taking opportunity to apply to Green Acres and it's actually a low interest loan it's not a grant um but we're going to be applying for the grant to get the cost they cover the improvements that were proposing for the so here's a site location map it's located as I said between 13th and 14th Avenue uh just west barate Avenue and we'll be concentrating strictly on the softball field the tennis courts pickle ball courts uh they're not going to be impacted the uh playground is just recently upgraded through an anonymous donation that was probably done in last couple months July July and we also added Sports lighting as well uh you replace the lights that were there with new lights all the new lights are uh are usable through an app on the phone so they they can be operated from anywhere so here are some of the photos of the existing conditions of the of the uh softball field as you can see there's always an issue with sto ponding in the uh in the in the infield uh it's really not graded properly to get the water off the infield a lot of the water travels around the back stop goes into the Dugout areas and ends up in the street around the tennis SCH so we're proposing to create improvements that will raise the field to get the grades to push the water out into the Outfield but in doing that we're going to have to put some sort of retaining wall behind the infield C into a clay mix so that we can raise it up enough to get positive pit and we're also going to uh basically remove all the grass all all the all the infield mix uh and regrade it and put under drains in in the Outfield to help drain the field so here's just an objective of what we're trying to do here but said we're going to replace the infield and Outfield uh all the new Bas we have new bases we'll have new batter boxes uh dugouts uh the bleachers will probably remain but we're probably going to have to remove them remove them for a short period of time to fix the con underneath it uh like I said we're going to install drainage improvements in the Outfield the existing irrigation systems will be removed and replaced uh prior to putting down that the seed and top soil um and also all the fening is going to be replaced we're going to have new foul Poes uh right now the fencing varies from 8 to 12 ft in height we're going to make the entire burer of the field have a having 12 High you can't really see that but that's a concept plan it's actually all the proposed improvements are over on are we have it here on the we can just me this year we leave tonight um if anyone wants to look at if you have any questions when we call with our presentation we can answer those as well I know this is hard to see too didn't expect it to come out that way and here is a cost estimate based on the concept plan as you can see the cost and the concept plan I should know it's just that a coner plan it's not a final design it's a plan that we put forth to the bar uh to develop a process and develop a scope of work and based on that new scope of work we're proposing a construction cost estimat it's just under $700,000 and all these costs are generated from previous projects that we've done in the area of similar nature that's that's is my part of presentation with regard to the proposed Improvement Eric is going to talk about the Environmental impact assessment which is part of the package for hi everyone I am the environmental gr manager at C and Associates um I'm also the person who's prair the environmental impact assessment um so I'm kind of just going to give a general overview of our findings um as expected you know the property has been developed for many decades so um we didn't expect many um environmental constraints going on at the park um but I first I visited the site at the beginning of January um those pictures that I took was right after a storm um and I was going to the site to kind of look for any natural features any Wetlands streams forested areas any habitats that were worth um noting and um as anticipated we did not find any um worth noting um obviously there is flooding so we are addressing that with with regrading the build and um and uh replacing some of the the broken concrete um and then back in the office what I do is I do desktop research um I look at all D um GIS data um looking at threat and dangered species um blood planes coastal zones any contaminated sites historic properties um and the list goes on and on um and again we did not find any any enir enal constraints of worth noting um if you want to go to the next slide um so the site is located within the cap Zone um as many of you probably are aware of the CAA um zone They regulate um development um uh regulat of the postal Zone management Bo so the D um has the authority over the development um this project since it doesn't incorporate any new parking um any um we're not enlarging the F of disturbance there's no new imper Surface there's no impacts to habitats um the project would be exempt from the coastal zone management rules and a c per would not be required the site is also located within the fal flood elevation um as also expected so um typically projects that involve any above grade improvements increased in imperious surface um if we impact a stream or a riparian Zone the New Jersey DP would regulate any development under um a flood Hazard area project this project would be exempt from the flood H area um Control Act rules because we are not incorporating or proposing any large new above ground disturbances so um again that's another permit that would not be required um the only permit that would be required a slow erosion s in the control permit which once this project goes through from you know to fruition in and and occurs we would submit a um a permit application to the Ocean County Soil Conservation District um so that's pretty much it there's you know um just a kind of very brief overview of our environmental report which we've provided it's on the municipal website if anybody wants to take a more in- depth look of our findings um and this is just a a photo of the FEA flood map and also very not very easy to read but um this shows the site um obviously in relation to where it is to the bay and it's in the in the flood zone thank you so I'll stand for everyone too hi everyone Gail laala um grants manager so um as we mentioned this is a Green Acres Program specifically for standard Park development since Seaside Park uh Falls within the eligibility for having 100% um of a loan for this particular uh program category for development um so this application process required a meaningful and robust stakeholder engagement process as well as the public hearing tonight so we decided to circulate a flyer and a survey um so tonight we're going to be soliciting feedback if you have any questions or comments or are in support of this application would be very meaningful I'll go to the next slide to show the survey that was circulated on the bough website as well as social media we've obtained at least 303 comprehensive responses so far which were great which gave feedback um from entities such as the league itself from um those that use the park often and um we are going to keep that feedback in mind as we're rounding out this application process which is due on February 7th so we're actually uh about two business days away from hting the send button um so we'll include a summary of all the feedback um and it was very important for D once again to have input early on in a variety of ways through focus groups we have a lovely letter from the leag commissioner we've received other letters that will go to the njd so next slide we would like to now open the meeting for public comment it would great if if you have feedback or comments if you can keep it kindly to five minutes and then we can respond to those questions accordingly thank you and if uh in compliance with the open public meetings act if anyone has questions or comments if you could give your name and address into the record clearly yes sir hi my name is George Russo 202 10th Avenue Seaside Park my question is why do we need a softball field if the town people don't use it look around our town is aging why don't we make the town bot you ball or shoes whatever four days this month I couldn't leave my house for flooding and you guys are worried about puddles on a softball field I'm sorry we're still going to have to pay down $600,000 on top of all the money that we spent buying land our taxes are going to go through the roof I don't hear any ways that we're going to pay off this all right we're not going to be able to raise the money by telling the softball people that they have to pay more and if for people that don't even live in this town why do we need it the town is changing why can't the park change to accomplish that I mean 4 days I couldn't leave my house because of flooding on 10th Avenue when I live three houses away from the bank and you worried about PS what is your plan for paying this debt down it's not a grant it's a loan we're sanctioning us with a lot of extra debt we don't need for people that aren't even from the town that are going to be using it so why that's all I want to know from the commission why are we spending this money because we use that softball fields times change we need to change I'm all right unless you come up with wait for us to pay for this without without raising our taxes I'm totally against it and I'm sure most of the town would be too none of you probably live where you get stuck in your house for 4 days because of flooding and you wor about on the field thank you sir thank you any other questions or comments yes sir uh know 59th Avenue uh just I have two questions what is AA what that F what does that mean eight oh eight it's a FL elevation and what is that it's the elevation that uh above SE level that that that is a sign to that h means H H so you have to bring the field down no no I'm not bring the F it's just that if there was a structure or something like that that was impacted by flood insurance or something like that it's a field they're not raising the field if ra is going to change all that much it's going to basically stay the same we are going to raise it a little bit just to get positive on thei and get the water towards the out right now just just op in but yellow really is project okay and uh the second question is uh do we have a an idea of what's the payout time frame for this uh this loan or we don't know yet I think it's 20 2% yeah 2% of 20 any other yes Shirley Shirley CLE 700 North bab Avenue I mean started out saying Grant and then we went into alone there is no grant for this not for the no yeah so the best eligibility that cide park has because it's a standard municipality it falls under a category where it doesn't have an overburden Community census track Seaside Heights does um so we're making the argument that at best they can obtain the loan but we are monitoring if um there's availability for the Green Acres grant program that this could roll into the Green Acres Grant so the in terms of the low hanging fruit we're starting out with a loan but we're actively looking for other sources because there are other matching programs such as the DCA local Recreation Improvement grant program and this and the standard Park development Green Acres Grant so the public hearing tonight is to be able to at least go for the first step which is to see the viability of obtaining the loan and then start the process to see if there's other available funding that green makers will make it available too so this is an annual program with some other layers where there's other categories such as Jake law for inclusive playgrounds um um Urban Parks so Seaside Heights might be able to qualify for the urban Parks program so this is a specific subcategory of the overarching NG JP program so I'm available for any B questions about the um various Municipal um s action my other comment to I guess it would be mayor and council is you know we need our Boardwalk to be done oh that's a slow project all of a sudden this comes poof we want to do this and and then everything rolls we need that Boardwalk done we also need that a project done I don't see putting money into this type of loan when there are things that I think have priorities in this town thank you actually Steve were off point but you your involved so fortunately I was also the grant writer we this public hearing is solely dedicated to the Green Acres application so that we can submit for this program so this is as an aside uh fortunately Seaside Park submitted an application to the New Jersey dc8 uh for the um Boardwalk revitalization program there was a yeah revitalization program awards are supposed to be announced at least early February this is arpa funding that has to be used by 2026 so I hope that you participated in that public comment period that we did have for um that application process but if You' like to show your support this is an active application that's under review for the reev revitalization and upgrades of how many well we tentatively we put in for the enre L right but we're really concentrating on Fifth to it's 100 million uh minimum of Grants allocated to New Jersey for Coastal municipalities that looking at so we we actually put in an application or like like I said this public hearing isn't really geared towards the borderl but we put an application in to cover the entire length with the hopes that we get if we don't get it then we'll concentrate on if we get anything then we'll concentrate on whatever that cost can can uh cover yes so yes sir not to fill new F 68 to catue that gentlemen hit it right on the head thank you you hit it right on the head great if it's a gr but then keep in mind the town like this gentleman Saidi cour something more in keeping with the demographics of our town to be foolish to go into a loan when we're sitting on close to $6 million in property that we own that can't be taxed in the next 5 years come on let's wake up and make good economic decisions for the taxpayers of Seaside Park 481 avue two things number one if there's the possibility of the grant why are we not going for that first should just answer that in sucession yeah yes so the first eligibility so this resolution that this public hearing was signed off by ngd's program contacts so we've confirmed that Seaside Park is eligible we don't want to shoot ourselves in the foot by going after a different category that they're not falling under so unfortunately Seaside Park is nothing is considered a standard municipality um so that is why this is the first available pot of money um they have a process called a rollover supplemental funding um where if there is availability for the grant then we will explore that rout as well but right now this is the um first available program that has been offered for standard municipalities s Seaside par well I hate to say it but if the field have been like this for so long why not why not just wait for when and try for the grant I'm I I can't see going for a loan no matter how low the interest no matter how long the pay out well we've got these other more much more in my opinion issues would affect more people in the town than the baseball field now I don't know have we ever seen figures as to how many people use that field and how many of them are residents as opposed to how many people use the boardwalk and how many of those are residents we have the stats on and and I know it's not ger to this discussion but my question is when was there the public hearing about the board yeah one more thing I'm sorry if we have to be recognized Sir Mr Sher on the board may not be done question e may not be done no I just on the board one was there a public hearing yeah we had resolution to pursue fund to the program at CCA have a public was requ it wasn't on that particular that's a grant that's an outright Grant yeah that's true that was a Grant application we did have a lot of discussion about that at Council where originally we were only going for part of it I think and then there was a lot of feedback saying why go for part asked for the whole thing and see what get which is what we revised based on feedback from the public while we were still in that planning process we're still waiting to hear I mean they were they were supposed to announce that program at the end of the year but like everything else push back like end of year January mentioned that there was a public hearing and I didn't think you cleared it up public heing yes sir yes sir yes sir sorry um if we get the loan we're not going to get the grant because they're going to say you already have it funded in my opinion okay it's just we're borrowing money we don't need to borrow for some for people that aren't even from our town look our demographic we're an aging population why do we need a softball field we don't have a little league team we have towns from outside coming I watched those games I live two block three blocks from there and everybody's from out of town that comes there I'm sorry I just to spend this type of money and burden our taxpayers with it it's not fair to the taxpayer and I don't know why we can't see that so Jo Joe URS 137 10th Avenue I have one question but I guess it's for you how much water accumulates on that field oh I a lot of it a lot of it accumulates into infield a lot EXC use the word a lot a lot of water this town a portion of this town flights the water every week what are you going to do with this water that's a lot of water where you going to pump it where are you going to push it where's it going to go is it coming to my house no I mean it's it's not it's not that kind of water amount of water I mean the field itself if you look at the pict pictur that we have the infield holds water I mean that's what I mean by a lot of water I it shouldn't have any water on it it's gred properly but do you intend to gr it in now what's going to happen that we'll put underd drains in the Outfield that will that will bring the water down into the soil believe it or not there's a pretty decent separation in in the field between the water table and the bottom of the the the grass he just did the playground the playground we put 100 GS in and it's been working fine so none of the water will wind up on the street no not the intention well I mean it I mean typically it's going to be percolated within the grass so you don't get a lot of run off from from Fields okay so we won't be seeing any water on our street since we we have no way to take it from our street the public Street to the B we don't have a way of doing that so if you if you add 300 gallons of water there 300 more gallons water in front of somebody's house well like I said the attempt is to bring the water below the soil bring and percolate into the ground and the intend is not to push it down the street you can't do it anyhow because the grades the field is surrounded by existing pavement that have grades assigned to it that those grades prohibit us from doing too much anyhow it would do gred enough to get the water to go from the infield to the Outfield then the attempt would be to percolate the storm water in the Outfield through the grass into under under line perate PL what is the No when we did the playground believe it or not it's it was a couple feet below the top of the playground so the under drain is going to be it's either going to be a 4in diam under drain or they actually sell under drains that are basically like mats they're flat so we don't need we just need a little separation between the bottom of the recharge system and the uh water table and again we haven't dived deep into the design yet this is still a conceptual but we do know that by what we do with the playground that the ability to perate water is there I don't do with the but I don't want more water at my house I mean I had the water pass my house up my driveway across my sidewalk and then up the regular driveway 31 times since Say Never Happened more than three times before this you're talking about a lot of water here in this St yeah and anybody wants me give me more I don't think they're doing me a favor well I think what happens go higher than this what happens now too the in field itself because of the way it's creaded a lot of the water travels around the the fence behind the dugouts into the tennis court some of it washes into the street now we're trying to raise it it on thei so it percolates into the they're trying to prevent it from going into the streets cuz the streets get a lot of the infield there's a lot of the things from the street for a heavy storm so we're trying to prevent that push it to the Outfield which when it was originally built it did do that it just over time it's settled the grass is grown and it just it doesn't work the way it did initially so we're trying to get it back to uh to make it work and push the water into the AL prevent it for going into the street they think that's work out the Jack is in the mail right I've done Advantage a long time this it's not a lot of water especially if you per in glass yeah and there is separation yes sir Scher 207 how much revenue does the Le generate on an annual basis and first question that I it's probably insignificant I would say yeah they pay us a use of facilities application fee it's insignificant I would say all right then not just I redundant but I would object to the program based on the fact that it's a poor use of the town's resources because really amounts of just subsidizing the leure activities of non Seaside Park res not all non residents they're all yeah they're all not nonresidents yeah I mean I I appreciate the people back and I think it's good that we're having this um but I think to say that the demographics the build in town that uses it is not necessarily an accurate statement because there are a lot of people who participate in those leads that live here and I do agree with you about the changing demographics certainly and especially in the off seon but in the summer when it is used our demographics are very different than they are on a yearr round basis so I think we need to acknowledge that that we're not just a winter town that we bring in residents renters visitors all summer long so you need to have something I'm not saying that some of the other ideas are potentially good things that you'd want to have in a town as well but I don't think that it's not used by that field is not necessarily only just used for baseball and softball I see people playing the cross I see people playing football I see people using that field for a lot of different reasons I I te agre more I I live a half block up in the field I've seen quite a bit every day every afternoon every evening all year long and I me for decades through the field it's not just the the sofball Le it's used for a lot of things Thanksgiving time people having crush football games down there over the years including my family so it's a lot more than just the softball youn else yes sir I'm Tom Joseph 704 South Bay View Avenue I look at this plan and if this was a grant i' look at this and go this is really a great plan and you're doing a fine job to building a much improved ball field if it's a loan if this were my land and I was planning it and I said okay somebody's going to give me the money then I'd make an a one plan but if somebody was going to tell me I have to borrow the money to do this I'm going to go what's the least I can get away with doing this this is not that plan and my recommendation to the council is unless this is a grant you're applying for send them back to the drawing board and bring us a $100,000 plan to fix the drainage enough so that the fields are usable and beyond that I think it's a waste of money thank you any other yes June J C 114h you mentioned that there were responses to the uh uh questionnaire can you tell us what the responses were this the surve still open Sur still open and it's difficult to find um and while I just pull up the the summary of responses um the grant period the the prant period um should make announcements in July of 2024 at that point that's when municipalities and counties usually make the determination if there's a go-ahead green light to um enter into an agreement with d so this is um a nonbinding process in the same way this is a first step in order to ascertain if D will provide funding so it's not based upon an individual opinion it's dependent upon the department and we had this resolution certified by Bruce beckoff at D to determine eligibility and that this was the best pathway forward so um if we can help anyone with filling out the survey if they'd be interested we can also um share how to input the QR code or to go to the website link tonight um since it is still live it's on the website was also posted on the Seaside Park social media pages and it's also in okay so they're about 33 open responses to question 10 um some of the comments don't pertain to the project itself some are burough specific um it's a flooding so I could just summarize um I'm not sure if I'm getting your question you you wanted to see what some examples 33 people or 33 resp responses were they positive or were they negative did they have that's what I'm looking for many people that I know had no idea about this until we looked at the agenda so I'm thinking that maybe in not enough time or not enough people have been notified about this and I want to know if the people that see fill it out um there wasn't a necessary qualitative for or against uh there are about 10 questions that were specific to finding out is the is the um survey respondent from the buau or where are they from we asked for name contact information how gener how how frequently do you use the facility do you use the fields um I just have a summary of the open-ended responses um so for instance um better playground for kids um are the people using the field from Seaside Park if they aren't are they paying for the use so some of them were questions um I think a skate park would be another great addition alongside the fields imprisonment um adding more netting once is not enough to stop the Home Run bows I like to volunteer here and help any way I can pickle ball Courts at some point in time um so I can keep going I think some of the respondents might actually be here tonight so for against it's not a survey for for against it's so that we can get a comprehensive view for making modifications for the program because I think this feedback is also important not just for this program but because there are other recreational Grant programs that are underway that we only talked about one other the board walk r ation so for us it's not about yes or no it's so we can absolutely get a comprehensive view for does it work within the scope thank you yes yes 20710 I can't find this so I don't know how we were supposed to get this and so somebody I'm I'm on the website I I go on all the time to read the news and check things I don't know how people got this I see on there right now either it was on there it was on social media right I me I I see the thing that says we're applying for the you see the links to the concept plan that's what I'm seeing on there now as well as it was posted on January 19th was when we activ start the last posting I see is January 17th when we found out about this meeting and what it was about I haven't seen anything else I mean I I rely on this website for any information about Sude Park I don't go into other websites about Sude Park so I'm just curious because I would like to comment and I this was available you're saying we have two days two days no I was exaggerating that we have two business days that we're on our end compiling all of the application pieces so that the buau has time to review um and make edits the do February February 7 at 5 pm to I think the point is uh has been made that it ought to be emphasized on the record we always look to roll over if we have loans such as this if there's eligibility for a Green Acres Grant or conceivably a blue Acres Grant I don't think it's going to meet any change in the blue Acres but possible we would try to convert any and all such loans into grants that that's a given in our policiy here so that's the fact that the best chance of receiving funding right now happens to be a loan doesn't preclude or stop us from converting it to a grant and I think there's another Point made and I support the concept of looking for ball for example other activities uh the fact that this particular application doesn't include a bot ball court per se doesn't mean we're not actively looking for sites for bot ball uh there's a been a working group for example coordinating some cooperation with the school board uh We've run into a a blip on their end temporarily uh I don't know in terms of the structure upgrades in the building uh but one of our proposals is indeed to have a joint shared services with the school board and Bach PA is is clearly one of the Prime sites in fact we've got some plans on that so but anybody new no Dennis who knew our fire team denn V the same comments over over again I grew up playing the field with your son and Jerry's son I mean it kept us out of streets kept us out of trouble kept us from using drugs the people that live in town are here right now the people that com in the summertime is a demographic there our kids that come here and their parents do pay taxes here so you have to consider them also one more thing also this gentl made a comment about the FL the streets uh I was out during the last we uh the left field post there's a gate there and there was a river pouring out of there during the St withy hard so that field is not taking any water right now it's running off from the street so if that is concern sounds like that should be conc long yeah the attempt is to push it to the Outfield and get it the perk like it's supposed to prevent it from getting to the streets I I just think get the St you can apply for a loan and then you can apply for a grant is that how that kind of works that's the the current strategy right now so if we apply for the thing get it we don't have to do anything in that ball field right then and there can we wait until we see if we get the grant so yeah the announcements are going to be made July of 2024 is the best guess from d That's the anticipated schedule uh so at that point in time the governing body would then review the grant or loan agreement to see what is the um eligible allocation that they that Grant doesn't interfere with the board no it's totally so if we get the grant then that's great no I'm saying if we get the grant that's great if we don't if we only have the loan then perhaps we need to look at this again and see about scaling back waiting another year till we gets yes is the field in such bad shape that people can't go and enjoy it and have a wonderful time doesn't look like it I mean is it that necessary that it has to be redone sure it will look beautiful the fence you know fence was kind of crappy looking right now I walked by it today you know it looked fine I couldn't walk past 14 in Bay because it was flooded there are bigger problems I think that bad that people can't play and enjoy the game my understanding is that the maintenance to just get the water off the field after it rains it takes a lot of in the summer yeah there's a problem in the summer they post on probably 15 games this summer George said we couldn't get out of our house 4 days and I think he was wrong I think it was more than four days that we couldn't even drive our cars out of our I I live on 11 almost across from you on 10th and I had to use a 2x8 to get into my truck I had to park my car blocked half away I look at 11th and there's no flooding I'm like well it's it's it's way bad I think we have to also I mean I I'm kind of lean where you got talking about the loan versus grants and I just want to make sure we're clear so we don't walk away people saying they heard something that I'm not clear I'm understanding either this application that we're putting in now will enable us to find out if we're even eligible for this loan the same application is not being placed in for the grants but I thought you said earlier that our municipality is not eligible at time for a grant for this type of project is that not correct that's correct okay so to Shirley's point I think we just have to be clear because I want people say well you said on that meeting that this was the case we're applying right now for this D loan for this project we get to decide after that decision's made if we're eligible if we decide to proceed with it correct correct if we don't proceed the only way you'd apply for a grant is if there was still grant money left that other municipalities who were eligible did not receive and some reason there's a bucket of money left which never happens okay so that's really the case so just don't walk out saying well you said there was your we're not applying for a grant for this that's I mean I think you have to be very explicit that's true correct I want to make sure I understood yeah and the other thing I guess my other comment to the flooding in the town I think we all emphasize whether we live on the bay or not that it's bad I'm just not sure that the activities that we're talking about are mutually exclusive because you can't apply for a d loan for $700,000 or whatever the number might be hopefully less that's going to solve our bayr problems so those are separate issues so the money really even if you don't borrow it it's not like you have this money that's going to become available to solve our B front so I mean you can't solve it with this project just my opinion yeah it's the intent of the program is not for flood medication so I mean I think we all Ed that is a higher priority no one's saying that that's not a priority Mike again 59 uh if this uh Council approves this uh to proceed with the loan application uh I just would like to know if you have any kind of a time frame as to when you might get approval and when you might decide to initiate July the point the progress starting is there any way to have time frames on loans and initiation of the project honorable stapo yes hi again um it's a two-year time frame to spend down the money um D doesn't necessarily hold you to that two two-year time frame for complete project execution but but there is leeway time between the grant agreement and between the execution of signing it so there is usually time to review before a project is initiated to then go into we didn't put the schedule up on this unfortunately sorry but um usually we anticipate 3 to six months between bid and construction uh and depending on um maneuvering around the league schedule and any other user groups to make sure it makes sense we haven't dogged that deep yet you know we haven't looked at a construction schedule any of that because we're still in the process of trying to get the funding and then again the designs out 100% complete either we can't take these and go out the b this is a concept I hope they answer but the loan the award of the loan is announced in July so let's say we apply for this for this loan and in July they they agree that we're eligible for it we're not obligated we can still look at it and do what we want to do exactly and how many years do we have beyond that in order to U complete the project with extensions of course their recommendation is the end of 2026 for the life cycle for project that's their General recommendation but often extensions are easily are fairly yeah we seen extensions absolutely the only complication we've seen is if the funding source is AR the American Rescue plan act um because there's a Time clock for any federal funding that was received from that Co year8 um thank you junor for clarifying I have one other point to clarify okay let's say apply for the loan we find out we're eligible for the law when would we find out we'd be eligible for grant money that you you have to accept the and do the loan and then you're eligible or can you when would be when would we find out if we're eligible for the grant that is a to be determined um so these programs some of the programs have had new development nuances to the program this is uh usually on an annual cycle so if there's a new grant funding round it will most likely be that fourth quarter of so it'll be around that um August September time frame because that's when we found out um this round was was made available if they come back and say yes you can have the loan how long do we have to say yes we'll take it no we will you stupid stupid theoretically it could be within 6 months um there really is not a specific time clock that I'm aware of for except the grant agreement agreement that if we apply for the loan and we're granted the loan we don't necessarily have to take the loan until we find out if we're eligible for a grant those are two separate processes though I think you're merging them I think we're creating a slippery slope of Mis communication that's possible what I'd like to suggest the counil consider if you want to go ahead and apply for the the loan that's one thing but I think before anything is accepted I think there ought to be a um another more publicized public forum um to get maybe a better beat on how the how the community feels I mean it's a pretty small group out of out of the community now granted you may want to think it's a representative group I don't know because I don't deal with surveys or any of those kind of things but I I really think In fairness to the council and fairness to the residents I think there needs to be more dis discussion about this thank you yes sir anything new yeah I still haven't heard why we need to upgrade this field for less than 1% of the population that uses a and the other thing is if we get the loan how are we going to repay it without raising taxes that's all I want to know all right because if we don't get the gr and we get the loan and we go ahead with it we still have to repay almost $700 ,000 yes sir Tom Joseph again I guess what I've heard in all of this is we can apply for a loan has absolutely nothing to do with any Grant therefore if what we're saying is let's do this and maybe we'll get a grant let's wait till there's a grant around and then let's go after the grant this to me is a nonstarter we shouldn't borrow the money to do this project if we can get a gr wonderful I'm all all in favor of it but this seems to me unless we really have all agreed we want to borrow the money to do this he a waste of time and I don't understand why we're spending so much time on it in that concept and it made me really nervous when our mayor here in discussing this acts like going to borrow money is a source of funds it's a source of a loan and that in my view is not the way we should be fixing this problem again unless we're going to make some small modifications allocate some money to go into the infield where the puddles tend to form and add a little more sand so that it tends to drain off the infield and then be done until we can find a grant to do this properly but just because we've started down this path it makes no sense to me that we have to go for it thank you thank you yes sir Dr new for 68 deor Avenue and if we do pursue a grant can our consultant come up with Alternatives yeah that's what we're actively doing so other than a baseball field discuss has different or alternative uses and I think our consultant should be able to present that because that's what it's all is made to do not so to reiterate tonight is only for for responding to the ability to it's an enabling resolution to initiate the application process to D so the choice is to either apply or Not Apply so Joe one more comment Joe 137 how many of the responses to that in Jus 33 you talking Ian 33 people the M well obviously it's not something that everybody got an opportunity to look at okay I if you born in 1942 the chances of you even knowing what that thing is the might be found are swi separation between where we show water and the bottom of the playground theground itself is about not really I think you know if 14th Avenue even when it's high TI musle around here that two foot is engineering groups tend to uh want to be very complete very thorough and you really want to make something that the town can be ultimately very proud of but in most cases that creates a situation where Engineers present a Cadillac and maybe uh we can uh re-evaluate this and come up with a forward well again this is a concept and that the point of this meeting is to get this kind of input so I mean if the mayor and Council wants to scale it back I mean this is what we started with I mean you know it could it could be scaled back you know this is a concept it's not it's not ready for B it's there I don't like to be this close to than you very the next items are on the agenda are for informational purposes there's discussion of an outstanding esro agreement with potential $3,000 contribution to MJG approved project public access to the Bayfront on O Street and I had received this uh correspondence and I wanted the council to be aware of it uh and it involved uh a permitting issue that dates all the way back to it looks like 2017 in 2018 and the former homeowner through the attorney was required to uh post an esro with the DP to be utilized for uh Public Access uh in conjunction with cooperation the B sead Park and the first proposal entailed ocean public access the properties located on the Bayfront and the D wanted a Bayfront project and the attorney is frustrated uh because now it's going on 5 and a half years later and the D has not acted on this so the money still sits so perhaps maybe Public Works in conjunction with the administrator we can look at something that makes sense that might uh pass muster with the DP and and cause them to take some action uh it's money for the town it's $3,000 to a project that the town uh should have in terms of anything arguably relevant to Public Access and this is geared apparently toward one of the GP officials uh Bayfront Public Access so I don't know if anyone uh had a chance that's really for committee to see the long escrow agreement that was required construction the other item is on the agenda and I I just wanted everyone to see some uh articles that had appeared in the beach paper and uh sub quent and actually ironically we had a we have a very active ocean Barrier Island mayor's association with the nine towns that border on the the bay and uh the last two meetings were being held in bad and you really you couldn't get to the B to the barel hall because of the the flooding that had occurred and it showed some of the uh water the levels of water suffered by all the towns and of course Seaside Park um and I uh promised the chair of our uh advisory committee to uh bring this up this evening too uh I had brought on the floor before the beach mares and uh they've agreed to move on it now with a joint application of all nine towns together and we obviously have a lot of different kinds of towns uh people of different uh populations different uh political backgrounds different entities and emphasis but we've all had a common uh ever escalating problem associated with P front flooding um one of the points that I have made for the last two years that they've now latched on to and those of us remember the uh unfortunate aftermath of Sandy and one of the promises made at the state level entailed the state uh collecting all the portions of homes the refrigerators all the refu that was in the bay and barges and doing that and conjunction with dredging of the channel for boat traffic and uh all the towns uh had some optimism that we would be entitled to some of that what was described as clean sand uh in the project um that is going to be for for whatever reason the state of New Jersey never did the dredging of the channel the boat channels it never happened and uh every Beach May that was there those that have been in office for many years and those that have lived on their particular towns of they had Ming brick was there all the towns and uh everyone remarked that obviously with the uh sea level rise with the uh New Jersey land mass sinking and all the other problems uh after Sandy it's become greatly exacerbated it's gotten much worse in the bay uh and one of the areas that we are focusing on is some a joint uh bay front application for every town all together and a resiliency Grant and there's monies that that's what we're we're having a presentation at the next meeting and one of the other aspects we're going to do it on various levels and one of them is to ask that the uh state in conjunction with the uh Federal officials conduct that promised dredging and that we would be entitled to some of the sand apparently the last dredging that ever happened uh in the channel and those bill that know some fishing background I think it goes back to the very early 50s uh very early 60s late 50s but no one uh pinpointed at that point but there's an engineering firm I think that's going to present a a proposal as a consultant so I wanted everyone to have these articles and we have our upcoming meeting uh with the befront Mayors and the uh Barrier Island mayor so that's something that we're going to be moving ahead on the next item on the work session is discussion it's followup there was a great deal of discussion previously as to uh the 1993 used uh pumper of the fire department uh and that had gone out on municial bid and no bids were received we had a a minimum of 10,000 is my understanding uh subsequent there to we determined uh to attempt a sale and uh I can turn the floor over and Karen has background we have some materials here on the agenda and we have been approached by uh another fire department and another municipality that uh wants our uh wants the pumper uh unfortunately we do not have the garage space in the public works garage we don't have any garage space in the fire department's garage because they have the working trucks there uh and that has caused some potential diminution in the value of this pumper sitting outside especially during the last cold front uh causing a greater degree of leaks and damage uh than had happened before any input you some to our charting we can have a buyer and and who we also welcome here this evening uh Chief Vincent uh is here Dennis vincon of the bar Department uh and he has uh provided us a lot of this literature background and uh through his help I know uh they have had the U one company who is interested if we would be interested in uh and selling to them uh the used pumper uh I don't know ten if you want to come up and share any uh Jen Vin Department um before I speak uh I just wanted to see where we left off with the uh uh bidding on it because I think uh there information here and then maybe some information on the LA I don't know if it was the same CH you just let me know before I speak what the minimum B was what it needed to reach so and then we also exp what we were hoping to get so I think I have some too so if you can just by that for so when it was initially on municip bit I believe that the reserve was $30,000 and we received no bids and it hasn't been on municip a second time because we pulled it back because this this buyer got in the middle um and at the time when we were going to put it on munici bid we were going to put a minimum bid of $10,000 on um but when people did on minus you don't necessarily have to take their offer and I think I believe the thought behind that then that $10,000 came from the fire department that's that's what bid did come from um 10,000 was the minimum we we have accepted $1,000 me I'm ask ask we would we require you if someone did place 10,000 no okay um and I I believe my understanding of setting the Reserve at that price was an effort to to drive up the bid to finally get people to bid and then get someone to bid a little higher and a little higher and a little higher all right um from laa to article I was contacted by another Fire Company in the state New Jersey um they are waiting for two new engines for which are two years out um they would use as Reserve piece with theh they were to use it for 2 years um they I guess in G State this time um the article with the $10,000 of this their interest and they contacted me um I spoke to the chief he came down I brought the engine to the firehouse and we looked over it he came down with one of his uh employees I think he was a mechanic and went over some deficiencies in the TRU unfortunately from sitting outside it has received some damage there some water leaking in the roof uh the the windows are Mal leaking um there's an aftermarket fuel uh cooler on it it doesn't have drain on it and it did crack um there's a snap spring in the driver side rear and the fuel tank is hanging on by some right now so um it's all sitting outside a lot of that going from sitting outside um I'd like to see the sell it and and make money on it um I do believe we listed for 10,000 they' be interested in it um to move forward with that they need the council to approve that and make some kind of listing some thisit and they would purchase it as is um and they were still interested the $110,000 month after seeing all the deficiencies they had um there was also cracks in gaes on the pum PS and uh there order in the gauges inside the um this truck has set outside before we never had these phones before um but the mayor said we don't have any St inside unfortunately um this time it's it is deteriorating keep deteriorating um you it's up to you guys your asset um but we deal some interested and they are with the other truck that there another truck that I found online it was one year older and it had much more uh mileage on it but um it was running there no no issues with it and uh it's sold for 5700 um I believe uh some um myself and car looked at had sold from 20 25,000 correct um those I couldn't see when they sold I believe they were sold in the last 2 years um I think the prices were a lot higher now the factories are reopening and uh we new Pro trucks are getting out the market isn't what it used to be um just from what I'm looking at pretty wrong but um so this so the statute provides that uh when you put something out the bid on personal property from a municipality the statute says if no bids are received the property May then be sold at private sale without further publication or notice um but in no event less than fair value and the statute to fair value and I'm quoting estimated fair value means the market value of the property between a willing seller and a willing buyer it's that simple so everything sounds tonight and tell them send a check for 10 now because no one bid on it and uh fortunately the state statute allows us once we receive no bids to do a private sale without having to go back out it and publish it it would have been really nice to get $30,000 this time um I was I was and we were both very hopeful um you know we SP a lot of money in that truck every single year keep the operation know one year the brakes next year tires it's 31 years old so the issues that has had sitting outside for the last month or so I think only we did inside for a while our ladder Tru out so it could have been outside for the last 3 or 4 months it's only been outside for little over a month don't go into sales Dennis at the sale Dennis is this is this I is buy beware okay as it drops the the next day too bad right okay and you would you would in your expertise would agree that at this point it's it's an estimated fair value what the Willing buyer is willing to pay and yeah okay so you can you can approve that without a resolution resolution to agree to do the sale to I would have to probably authorize a private sale $1,000 clear we're not because what it is pretty much what we have copy and for sale for ,000 we don't want to put it back on think we're ready to do a private sale he said that the information on oh yeah yeah yeah yeah can let them know it would be a private sale we can let them put it back on and put the 10 and then you know whatever happens happens okay to auth a private sing out to $10,000 pursuing to the statute sure that Asal it uh my understanding with the that it is not up to current standards and code so that would be the buyer's responsibility I understand because of the backlog the supply issues that that that town and all of them are facing a two-year backup and delay just like we had when the our truck was ordered Denis last we uh had so if the council is so inclined that would be resolution 22483 to be brought up at the regular meeting as is clause for a buyer at $10,000 pper truck would be private sale $10,000 as is that's what they call it a private okay anything else on Council on that particular no thank you Den than thank you Chief okay chief thank you the next uh item is discussion of utilizing track the printer uh to print and mail water bills that particular uh entity is utilized by several other municipalities and the uh arguments presented would be the savings of labor cost in particular So So currently we we um print we fold we mail the water bills from the hall takes it takes a lot of um labor hours as the as the mayor said so by using this Mailing Service Tre with right in Tomer um they would they would do all that course us and postages postage we paying that either way uh but the big savings would come in labor hours um in bral which you were very um Whitely staffed in brohall and so anywhere we can save some time human energy the better there's some samples of what the new water bill would look like in your packet um and it has all the same information that's that's on our current water bills we can change this a little bit um it does have a an area for special message so we can we can put out any type of uh extra information that you know we'd like to make folks aware of when these bats go out once a quarter like uh counseling Tay we talked about at the last meeting you know urging people to sign up for the reverse 911 um so we can put special messages on this as well and there' be a a small cost savings as well um something I wanted to bring it up at this meeting because what bills will be going out in the next couple of weeks and if we continue to do it the way we used to do it we're going to have to buy more forms um so if uh we forms we trct right correct way that number that number to 3300 or whatever it was for how many uh how many bills was that for is that for every time you send them out that price whatever 3366 2100 bills yeah this is based on the approximately 2100 bills that we sent out for so that's every every quarter it cost us $3,300 doll basically okay cont I don't think we have to sign a contract well there already a vendor because that annual um storm water letter that Eric sends out we do that through trk he just sends them the file they do all that they fold it they mail it they put it in envelopes any other questions from Council on that particular issue do we want to yeah I think it's a good idea proceed absolutely I think it's a Karen do they still come like that like today we get them there that holding you know car your preparation find somebody open for you the same typers in envelope with an envelope to send back an envelope to send back on doesn't come that way doesn't come with an envelope to send back a lot of people pay their B bills online okay but uh it will be a folded piece of paper in an envelope going out to the residents okay we just looking for different ways to some process Improvement for things that we can do so we're looking at everything think there something worked 10 years ago it might not work today and we're just trying to look at everything okay I think it's a good all right so I think we should authorize it yes yeah I think it's fine good thank you set on the next item revisiting uh an issue that had been the subject matter prior discussion uh and that is returning Second Avenue to become a one-way Street and uh the issue entails the what had been commented upon for members of the public as especially narrow and thereby uh potentially hazardous in terms of the summer months U there are even some requests that if be summer only but we don't have any other streets that are summer only so that that might create a difficulty or potential danger if someone's used to a particular traffic pattern and it changes right after summer so I I don't know that that is necessarily part of it but there had been a request and I know that went to committee uh last year um I don't know that we've gone the next step and that would be really looking at the uh input whatever is necessary through Public Works and the engineer I don't know I don't think we want the next step we discussed it people commented on it well I think we got feedback from a lot of Neighbors on second ad wanting to go back to we didn't actually you know get you said do anything research on it in the summertime it is quite bad no doubt about that so so I can chime in on a little bit of research if you want to call it that because when when the mayor and I were out about Second Avenue in um know going canas and talking to people in in September and October uh everybody that we had talked to there uh brought that up as something for us to look at uh quite frankly immediately and they asked us they they been plead with Mo to try to make it a a oneway street again due to the factors that they describ to us uh their cars being Sid swiped mirrors being taken off uh obviously two cars can't go back and forth there you got to pull into a driveway orink par where to move so it's it's not really a great situation and all the residents on that street I can't put everybody we talked to which is quite good there if you remember uh brought that up to it's pretty ad that they would like to see it changed to the one way again it's a safe thing it it is bit no I've seen it I mean when I go down that street I look to see if there's any cars coming if there is like I don't I don't know why they changed it back you used it was at one time two way and went a oneway street and it changed it back I think the last had to check to see I guess what the ordinance is for what we had to do to change I think there was also discussion about which way you want to go 20 2009 and then two way in 2016 I know but it's like which direction are you proposing that it goes east or west no no it would be the would go you would have to go from uh ocean have to go west like that it's like yes solution yeah yeah just Mr Mayor well it is a local Road and it's not uh proposing to change anything on the state highway or a county road so uh we have the authority do this ordance change correct correct so my uh understanding we can refer to Steve to put together a draft of of changing there there was a package of materials that was available I guess in late summer we had some of the history of it and it showed the public comments that happened that were reflected in the minutes so that that showed some of the history and the the residents were by and large very supportive back then more or less of having it one way and uh I don't know the resistance we heard bearing accounts of where the resistance came from I don't know we any resistance I think so we want to refer that to Steve's office to look at the ordinance okay I support that Val yeah anything else from Council on that one no the next item is discussion of a shared service agreement with Manchester Township for use of the shooting range it's listed as resolution 22474 uh for consideration and the regular meeting this evening and that's of course utilized to make sure that uh the uh officers continue to be qualified and upgrade uh and comply with the various regulations is there any significant changes from prior we've had that for many years in the past I don't know if there's any no I think it's a necessity changes that paid for the day $100 yeah for the whole thing and the next is also shared service agreement with Ocean County for the prosecutors program that's listed 22475 also on the regular meeting agenda and that too has been in place for many years and that entails the uh various training the f program in particular to assist officers paid for and has all the agreements as have been in effect for many years on a yearly basis and in our officers are paid by money from the prosecutor's office and not out of our dime on our dime so it's also a good thing and hopefully they don't have such a tragedy but that training is necessary the next is a renewal of a shared service agreement that's also been in uh place for many years with Ocean County for the pumpout boat uh that's 22476 on the regular meeting agenda as well as Seaside Park was the uh original sponsor of the pump out boat in Barnette Bay uh for many years and the original boat actually was just retired and that boat was uh named Seaside Park School elementary school children had a naming contest it was in all the papers and uh uh they participated the winner was chosen and that's how that boote uh got its name the name's coming back Circle 2.0 it is coming back as well with vote this year a little credit maybe to a certain company but it was a circle of life was the winning draw and name and now it'll be Circle of Life 2.0 Junior that's C too the only difference in this uh agreement and in past Year's is the number of vessels that that uh C Park will be operating so in 2021 which was circle of life I'm sorry 2022 which was circle of life's last year seide Park operated two full-time boats and one part-time boat in 2023 circle of life was uh retired because it was uh just no longer serviceable so we operated two boats full-time in 2023 um in 2024 the county has asked us to oper at three full-time boats and one part-time boat um so one of the uh the two full times that we always operate a water war and pollution pollution solution Circle of Life 2.0 is coming back as a brand new boat with the county is purchasing and then uh there's a third vote that the Tuckerton seport was unable to staff the last couple of years the waste Watcher so that'll be our part-time vote and so the the county Grant covers uh $220,000 per vessel full-time vessel $10,000 for the part-time vessel so the entire Grant amount is $70,000 just my gation what what what other towns do this uh there are boats that come out of brick and Tuckerton tuckeron Seaside Park correct at Seaside Park over the past couple of years that I've been involved with this they they do the Yen share sh okay anything else from Council on that one I have one com WR question there was I never seen this before there's a maintenance checklist yeah that's uh that I think is new no they do that every year maybe it wasn't part of the last couple packages but they a maintenance checklist every year I was just curious who's like responsible for who's the but I mean who who who does it who does who does who who verifies that theck oh the captains do the captain's yeah okay so they so each one is responsible for their own checklist correct okay anything else from Council on that one if not item G is discussion of a proposal it's dated December 22nd submitted by Remington Vernick Engineers for hmgp phase one it's a change of scope concerning Bayfront wave energy dissipation project that too is listed as a resolution on the agenda for consideration number 22481 and that entails a phase in where the phase one including the uh change of scope itself as required by the Army Corps of Engineers concerning the Sab mitigation component of the uh one particular project for the bont and that fees not to exceed or references $118,000 for design and bid document operations just I just hope the redesign does not affect change the effectiveness of the uh wave energy dissipation that's been the issue with the uh various entities and agencies involved I mean they want to save some of the sav but at what cost to us mayor this was all based on the me that you guys had with the I guess the different parties back in December yeah that was uh the most recent uh meeting it was a zoom platform meeting with the various individuals there have been subsequent meetings with the Army Corps as well and so did this include the people that we approved the last time that we said we're going to help participate I mean I'm seeing notes there it says with Stockton University so those are the ones that we said yes the last time and professor bolog as well yeah and he's actually commented on this proposal on uh West Stockton was January 17th was our last meeting on the session so you 10 those yeah the uh issue you correctly framed is one of the uh were deemed to have actually been given an award of the money albe it that has not yet been formalized um through FEMA but the issue is just as councilman crab framed it uh if the changes now suggested by the Army Corps minimize the effectiveness of the wave attenuation portion FEMA will not don't P the money so that's again the two agencies involved not coordinating with one another so Stockton is doing the computations the research uh as to that portion because that's FEMA Focus would that be a non-start of though I mean you shouldn't make a proposal that you know is going to get denied by the other party right is stock is supposed to be that they have to give us the computations it yes sir is a very low number then I believe the uh the Army Core should fall in the line hope and now we have and the logic doesn't always apply it seems but you would think it would be a nonstarter to propose something that you know the other entities yes but that's how it should prove find a midle ground guess yeah you have to do logic follows that way okay any other questions comments on that issue from Council no since that work has already been U has been ongoing we need to defund that phase one but not phase two which is the design all right this is just the U change in scope application that's what sea suggested the best chance of of their Award of money but again it's contingent on the wave attenuation portion of the project anything else from Council any other may just like do a followup on 14th Avenue um I ask Karen we discuss the project on 14th Avenue apparently there's a hold up with capital response review for that thailands instrument I that's why there's a delay so we have the D permit but it says for the D permit is you have to apply for a TI instrument within 90 days of issuance of the permit which was in the middle of December uh CMA is working with d to D has not even determined yet if we need how does that drive with the 21,000 in the resolution 333 in December um that was awarded to the Toral Society because that talks about design revision and tonight's resolution talks about design is that 18,000 part of this 21,000 are two separate two separate things okay well they're not they're two separate en but it's the same change okay same project I'm going to ask I don't want to beg but I'm going to ask the council to please consider having a public meeting about day the the people that get flooded over and over and over again we all know are frustrated beyond belief and I can totally understand that I mean one of these past storms the water was up the middle of the central block of 11th Avenue I've never seen the water up there it was one and a half blocks from the B um people don't know they know less than I know and I feel like I don't know everything um so that leads to a lot of comments criticisms rumors um and that's not helping anything at all um so I think if you were to have a public meeting I don't know what ever happened to that advisory committee we haven't heard anything from them in a year and a half um that present somehow in some logical simpl to understand way as to where we are in the bay project um because right now in the public public eye people don't see any kind of coherent plan because they don't have enough information and the information you know like this I mean December it's this and now it's this and I don't know how it goes together um so I'm wondering if you might possibly consider that I think it would be helpful very helpful for the residents and I think it would also be helpful um to you people who continually have to field the rumors and the criticisms and the lack of knowledge and and all that goes on Westerly WS please do something thank you when you when you say a wall what what you're advocating you believe a wall on I at the end of the at the other end of Bay Avenue you install the wall by the marina which where are you H about a foot high we we did not install that well somebody it's helped a little and I'm not saying it's going to fix the problem but maybe instead of 4 of being stuck in my house it be one or two because I'm just watching the wind blowing there's nothing stopping the water from coming over some of it comes up we the se but we're doing nothing I mean some people are going to complain they can't put their kayaks in they can lift it up over a foot it's just very frustrating to be stuck and live on that part of town and not be able to leave their house and God that crash onto the baby lab and what if I were to tell you that one of our taxpayers why know personally went to high school and knows very well the director of the army cor Engineers haven't talked to can someone can the leadership of our town talk to this local Citizen and say can you reach out to the director of the Army Corps of Engineers and try to bring him here and try to facilitate some what is the change of scope that's that they have to do uh I mean you say change of scope what part of the project now is having to get changed like what are they doing several aspects of it they pitch the height somewhat mostly the proposal seeks to take away a whole row of Hesco baskets to be all the volunteers are proposed to be filling with the oyster spat hopefully for the oysters to grow uh and they're proposing the Army Court to take one whole row away I think they were also cutting back on the uh toe of the uh of of the sand at the at the edge of the bay screwing up the design and they uh wrongfully asked for monitoring in terms of sand uh I a promise a representation which we've made for many many years that we would do that I wish they'd come sit at my house sometime when we're going through you I had the waves hitting the house pictures one of the frustrating aspects the Army Corps was actually here that we walked the site with them in the water at a summer walking meeting with Dr Farrell who's a national expert walking out there man who was shortly to turn 80 years old he's still very active very vibrant and walked the water with to literally point out to them there is no Eel Grass in this area literally and they acknowledged and agreed to that so have we solved that problem no that's the Army Court of Engineers no and I know the last meeting I guess it was J said you know right people I think you guys have a better way of getting a list of all different people in the state that residents could right and if there's any way you could possibly make up a list run off 100 copies I'll take them and start hand them out put them here so people can hand them out put it you know and people will write it's hard for a lot of people to go in and try to figure pursuing the grant you know what we submitted the application I'm sorry we're submitting the application it's an application for a loan or a grant oh it's a and we have the option of taking that off at some point right if we so desire you don't even know if you're getting it yet you have to apply to see if we're even eligible to receive it then we have to have to accept it but in light of the public comments what's your position with regard to how you're moving forward with they voted they voted to apply for the law okay and then they'll go from there if they're successful then the next step is to see if they want to proceed with the project the one that's presented or something else and at this point according to the information we have we don't qualify for the grant right now but you heard that the public I think I think the May small group that was here said they're not really for along you heard that well that was for whoever was here and gave their testimony and that was their opinion okay well I hope you heard their opinion thank you any other public comments on the any resolution yes sir to Joseph 704 South Bay View Avenue if the bay don't rise which it does a lot but Mr zarski just said is you guys have already voted for this proposal which isn't true it hasn't happened yet it may happen in a few minutes but I don't believe sir you mis quoted me I said they applied for the loan I'm sorry I heard you I'm not going to argue with any project fine no one anyone approv the project all I said is repeated what they said is they appli for a loan that's what the process is allowing us to you're doing everything in the past tense they have not applied for the loan yet they have not voted on the resolution why are you saying they have they authorized the application for the loan in what resolution 2473 the resolution that has not been voted on yet my concern is the attitude you display tells me that the public hearing was an absolute waste of time and I find that disturbing if you were interested in public comment you'd have some mechanism for taking the feedback from that comment and doing something with it but instead what I hear is it's a forone conclusion and you don't really care what the public has to say about it and yes the people that are here are only a subset of the public they're the ones that are interested enough to come here and participate and I just I I find this extremely discouraging nobody said that we were ignoring the the public what we said was we would apply and if we are granted the loan or whatever then we would have a public meeting and discuss it nobody's disregarding anybody's comments and don't Mis categorize it in Attack the attorney say the it isn't done until you vote on on it therefore all of you acting like it's a done deal demonstrates that it was always a done deal from the first moment and the public hearing was a waste of time I it's not a fair statement I guess I'd like to respond I think I mean I don't want to speak for you know Mr zabari I think you know we went right from reading the resolutions to asking for public comment on them without doing the vote yet so assuming that we vote Yes that that is correct and I believe I mean I don't know if people are vote I'm going to vote Yes to proceed because it's the only mechanism right now to even keep such a project alive and we heard tonight that we won't know until July if we're even eligible to receive the 2% loan so at that point in time or between now and then we' have to decide that's something you want to do I also heard that we had six months to make that decision and that you had two years in which to use it so I think that's a pretty big window to get additional input and to digest everything we heard and whether like it or not is irrelevant I mean it's that's kind of where we stand and I think another important point is made that our town is distinguished from many other towns in fact most other towns allow public comments on resolutions it's not required by any New Jersey statute many towns you see have a which have been opened sometimes to criticism as a rubber stand process and they approve all such resolutions as a consent agenda without any public comment I have followed a tradition here from the past mayor going back to the Mayors before that we have allowed public comments on resolutions and hopefully we'll continue to do so and that in and of itself proves that we welcome public comments and this is one of the many examples any other comments on any resolutions if not we'll close the public hearing I we need a resolution to to U send out the bills through that track thing or no we don't no approve if I hear a resolution from the council resolution second motion by council member we talked about Airbnb uh I know Asbury and a lot of the other um towns Shore towns regulate Airbnb and I was wondering if Seaside Park Council has thought any more about um regulating airb or if there's been any working sessions or discussions about it we have we have not actually last after the co crisis we actually had in place a ordinance prohibiting uh airbnbs but it had a sunset Clause as to a lot of towns it it expired after that initial period I think it was 90 days I don't know that was Ste it was uh and thereafter we brought it up we had some difference of opinion from the audience but uh but we definitely have a sample group of ordinances is uh I think one of the issues that we were discussing was should it be uh prohibited less than a two week time period should it be one week one week yeah three weeks that that was I think M Street was experiencing they were doing it like daily like they were having people rotate in and out um and I'm on stock well I'm on the Cross Street Stockton and we have a few that Airbnb and they're definitely under 25 uh they're partying they come in for the weekend and then they roll out so that's definitely a concern for us one other um topic that we have concerned would you think before I'm sorry I'm interrupting you what what is your gut reaction what might be fair two week one week what three days four days I well I think you know I think if you look at some of the other short Town's uh ordinances most of them are a week a minimum of a we Pleasant beaches a week seven days so I think you know looking at what the other short towns are doing and try to mirror that that I know um Ocean Terrace um they have a few um that Airbnb and they follow their guidelines I was just talking to the owner there to understand um and they haven't had any trouble because they regulate and they see nobody under 25 can rent and so I think if we put those guidelines in place um that's a great start and if we mirror what coin is doing and what Asbury is doing you know you don't have to recreate the wheel they've already got it in place and it works um another reason why I bring that up is um 180 1805 1805 on the boulevard um it was listed for 1.6 million to sell uh then it dropped to 1.3 and it actually sold for 640 the dirt's worth more than 640 right 640,000 yes yes what's the trash man um 180 what it's 1805 it's called the park house the park park house the park house so Dr U Dr Frank Mr Frank they put him in the home and you know he's got Section 8 back there but his his family I we think the son-in-law bought the house whatever um but we hear they're putting a rehab in it um rehab being a sober house and has anybody heard of sober houses yeah sober houses are popping up all over the place my brother's a councilman in Kenan and they have kinan has a ton of money not that Seaside Park doesn't but you know Kenan and he as the council because these sober houses they um the federal statute for dis the Disability Act supersedes what the Town Council has they can't get rid of the sober house and these people have hired lawyers and this and that we've heard that they're putting a sober house there that's in my backyard um and you know we're close enough to the heights that we already have enough RI raft um so I don't know if anybody's heard anything you already have a what I didn't hear um we're close enough to Seaside Heights because I'm on Stockton that we already have enough kind of you know interesting sketchy clientel around town you know but um we're really concerned about that property because they already had Section 8 they're already house for section 8 um and with Mr Frank gone and the son-in-law there it's gotten to be like crazy through the planning board they don't have to go to the I I think the point you ought to be emphasized and maybe you'd be surprised there are some that come to our meeting and criticize the B Seaside Park for listening to the people and taking steps to address just what you've described the federal law does supersede a local Z excuse me Mr Mayor I think it's worth emphasizing on the record Mr Mayor excuse me if she's saying if we pass an ordinance no I never heard no so house then that would supersede the threat of law because is it a law already in there saying you can't do it well from my understanding again my brother's a councilman and the the kinan council tried to get the sober house at but a fact after the fact right that's different right you're right um and so how you're saying let's let's do it before so we put that ordinance in town no sober housee so the federal government can't come in and can any they they doesn't matter they they've been popping up all over New Jersey they get $1,000 a day per per patient in there they can put two people per room and they make $1,000 a day these people that are driving these sober house wof has a bunch kenon now has two or three you know and now we're hearing I mean the park that the house there probably is a per perfect place for it he's already putting in washer and dryers which is a requirement for them so because they're supposed to be you know acclimating back into society and stuff so I'm pretty confident that's coming in but you know I don't know what they have to do I I guess they don't have to do a permit or whatever but I thought it was worth um bringing toward you know bring it forth to the council to see you know is there anything we can do um you know we're concerned 1805 Central Avenue yes Boulevard it's on the bouard so I I've actually had uh one resident call my office with the same concerns he's my neighbor yeah okay yeah um and and Mr zorski wouldn't that require them to get a mertile life currently it's a rooming house I guess it's a multif family living rental units rental units and he's got section eight back would it require them to get a I don't know I have I have to check our ordinance on on mertile I'm not sure yeah there's a bunch in eaten town I'm looking on the website now then we can't stop he's on the Boulevard and I think he's he zoned as commercial right because he's on the boulev I think I think right to be concerned yeah and I believe this governing body has addressed those kinds of problems in the past very fairly very aggressively and perhaps that can happen again thank you try
