reading off this paper and I'm like no it is not March 9th today May 9th 2024 is it even the 9th it is right it is the nth nth correct okay um so we got that part right um and uh the way that the process works um you we will call the cases um they're not necessarily called in the order of the agenda that's been presented we try to um call for who has gotten here first and signed in um and that sort of thing so if you are present please realize we will call you it just may not be in the order that you see yourself on on the agenda um the county will go first it will present its case its Witnesses its evidence if um you will be called to the front you can cross-examine any witnesses that the county has but you wanton be permitted to present any evidence of your own until it is your turn to go once the county has closed its case it will then be your opportunity you can give any Witnesses testimony evidence that you have and I will make a decision here today as to whether there has been a violation and what um time and penalty could be imposed if you're here for the first time you stand have um and if you are found to have violated the County's code you stand to have a violation imposed of up to2 50 a day if you are here on a repeat violation you stand to have a penalty in the amount of $500 a day imposed um so we're going to go ahead and get started the will um the Simon county code chapter 40 appendix a section 105.1 description of the violation framing without the required permits this is a screenshot of the initial inspection that took place on 58 of 23 notice to the respondent went out on 59 of 23 given a compliance state of 84 of 23 follow-up site inspections you can see are the following um follow inspections via computer as well results of the inspection the violation Still Remains on the property this is a a property appraiser screen that shows that Daniel L Lucio is the owner of the property excuse me these are pictures of the violation of the framing that remains on that was taken on 58 of 24 this is a notice that was posted on the property at the front door on 426 of 24 this is photos of the unpermitted framing and notice of violation posted and taken on 59 of 23 photos of unpermitted Framing and the property of violation taken on 59 of 23 again photos of the framing that was done on 721 of 23 photos posted the final letter due to return certified mail taken on 911 23 and this is the property um the permit permitting screen that shows that no permits have been issued to correct the violation to date let's copy the permit application dated on 52223 this is a copy of the simal county chapter 40 appendix a regarding the permitting process uh recommendation based on the testimony and evidence presented in the case number 2427 cesm is determined that the respondent is the record owner of the property located at 2602 Stanford Avenue in Stanford in simal county is determined by the Property Appraiser's records in possession or control of the property and in violation of the simal county code chapter 40 appendix a section 105.1 it's further recommended that the special magistrate order the respondent to correct the violation honor before July 10th of 2024 in order to correct the violation the respondent shall obtain the required permits for the cited violation if the respondant does not comply with the order a fine of $50 will be imposed for each day the violation continues or is repeated after compliance the respondant must contact the inspector to verify compliance this concludes my case yes sir would it will be submitted if you can go ahead okay um no I I let her in what happened is I I got this property years ago and I've got multiple um permits for it and I was trying to clean up permits when this all happened uh from the previous owner and um it was for a clean room and a building the the other building that was behind there this building that um for the framing uh anyhow she was to come out and check that the building was uh that that permit was never done so she signed off on it and uh but she had put this um violation for framing which I had that was there when I got the place and I had gotten multiple permits and inspected many times before she even came out and um and then says that the framing wasn't uh inspected anyhow I got uh I got drawings architectural drawings presented on and uh it's got to go through I I've talked to everything I need to get together to get the permit for this it's just I haven't done it it's I don't use the building basically it's just sitting there and it I never even knew there was a problem she just went and looked at the a different building on the property and um and the building that the violations on has had multiple inspections nobody ever said anything before this so I was like shocked that it happened for one and if I could just go in there and sign for a Fring permit and have them come look at it I don't have a problem with them look I I invited her in to take the pictures that you see on the on the screen okay I can clear that up we did have inspections on the property not for the framing um the last inspector who was out there on the property was Austin young and he told him this framing is not permitted it needs to be per permitted which I don't know if it was him or the previous owner because there was a lot of work that was done to this building other things had been permitted the framing wasn't um he bought it when did you buy the property I bought it uh 10 years this December well then it's been in his custody then at that point in time and his possession yeah sorry to interrupt okay um Okay so you do have you seen the evidence of him moving forward with the permitting or I talked to him the first time I actually didn't even recognize you I'm sorry he does he's got a metal shop in the back where when I pulled up to the property because I was like okay this building is completely transformed there were permits for exterior work there was none for the interior work um I don't I can't tell you in the time frame in my mind when it had changed but it was very noticeable obviously there were permits for the exterior work just not for the interior work we talked about it okay when you went back a year ago uh when I originally went out to the property the first time you you just hadn't done it for well there had been in the I guess let's start with the the gentleman that came out there was a framing inspection that I had I went in to get the framing inspection for the building which I haven't closed up there was inspections on the inside of the building for the electrical AC multiple inspections which have been all signed off on and then there was another inspection for stucco and it was on two two permits and um the gentleman that signed off on the one uh it wasn't signed off it was it all worked out fine he came out oh yeah I remember he signed off on that permit and that was the one one of the two that had not been um one was for the office clean clean room in the building in the back but for framing for no for the framing was for uh there was a framing for the that for the clean office in the back which has been resolved that's all been handled but the front office I had exterior work done to the the building and I thought whenever the guy came out I opened up the whole building I wanted him to see the whole framing of the whole building and he's like I'm not here to see that I'm here to see the the the two porches on either side of the the front of the building the front and side and that's when he's like oh I'm not here to see that the um this has that you have to get another permit for this and it and but did you say that the framing was there when you bought it yeah yeah it doesn't I mean it just doesn't look very old to me yeah it's been it's that wood looks like she can attest to it she I let her in to look at it it been there over 10 years I had said the same thing but I mean it's closed up I can't I it's typically not that clean in a job when I go into an inspection um I can't verify when the framing got there when it was done I do know that it was reported in the um in the prior inspections for the outside little porch area where the trusses were that that needed to be done as well and typically if there is an electrician that goes in there he's not going to look at the framing however they should look at it and say I can't pass this till you get your framing because you've got to have them go in order okay well if if you would like you can look back and see when the electrical inspection was done and it was all permitted I did I had all new service from the pole to the entire building put in and you can look at the date and that was all inspected which one would years ago the the the electrical work that that is the electrical work that entire screen or which line 15 well they're I don't know which one it is but right after I got the building I got the electrical start so there's not a code up there that shows us which one's electrical and which okay no no those are old codes um it should be a he should have a framing on there cuz I had to go back in and read the notes and I called the inspector who did the Portico inspection with the trusses and the stucco the exterior and he did tell me he goes yeah he goes the guy said it you know he got it that way he said well I told him it needs to be on the plans as well or he's so and and I got a whole new engineered drawings I went in and everybody's been very helpful as just I got to the point it's just discouraging to be honest with you it's like I don't even use the building and it's just if I could go in and get a framing permit I would go do it right now and have them come look at it there's nothing I'm not trying to hide anything I was wanting everything looked at so if you've done that and you've gotten these the plans um is July 10th um sufficient time for you to get your permit I would like by the end of the year would I'd prefer oh goodness I well this is we're now into a year yeah I I I want you to be reasonable Oh I thought I was being reasonable six months seven months well it's been going on for since last year and it sounds to me from the testimony that you knew that the framing needed to be permanent yes okay if I could get a permit that would be great I would go pay for one now all right so what I'll I'll tell you what I'm going to go ahead and I'm going to um find that there is a the violation of seminal county code chapter 40 appendix a section 105.1 uh for failure to have a permit for um framing I'm going to order that you um have the permit um that you obtain the permit by July 10th 2024 or um a fine in the amount of $150 a day will be imposed okay could I get a little longer time than that well I asked you um what what you needed and I think you highly unreasonable and so I I and then I asked you again and you told me you said you were being reasonable I thought I was so I'm going to go ahead and I'm going to order July 10th and then if for some reason you aren't um you need to come back and ask for continuance because you're working diligently and you have done everything you need to do and it's of no fault of yours then we will absolutely consider it at that time 179 2 Longwood simal County Florida the violation charge simal county code chapter 40 appendix a section 105.1 description of the violation installation of a new sopit fascia on Building without the required permits this is a screen shot that shows the case summary of initial inspection that was done on 623 of 23 notice went out to the respondent on 712 of 23 given a compliance date and extensions you can see here go from 7 2423 to 11223 follow-up site inspections are the following that goes from uh 712 of 23 through 25824 followup inspections via computer uh results of the reinspection of violation remains on the property this is a copy of the Property Appraiser's card that shows that leet Properties Inc is the record owner of the property this is a copy of the uh received certified return receipt for notice of this hearing this is a picture of um the violation on the property that was taken on 58 of 24 and then here's one of 623 of 23 these are the photos of the notice of violation and stop work order that was posted on 712 of 23 photos again of the unpermitted FAS and offit that were taken on 822 of 23 this is screen that shows no permits applied for or issued to correct this violation at this point in time this is a copy that shows um chapter 40 in which they are in violation of the simal county chapter 40 appendix a regarding the permitting process recommendation based on the testimony and the evidence presented in this case number in 2428 cesm it's determined that the respondents are the record owner of the property located at 1055 South US Highway 1792 in Longwood in simal county is determined by the Property Appraiser's records is in possession or control of the property and in violation of Simon county code chapter 40 appendix a section 105.1 it's further recommended that the special magistrate ordered the respondent to correct the violation honor before July 10th of 2024 in order to correct the violation the respondant shall obtain the required permits for the cited violation if the respondents do not comply with the order a fine of $50 will be imposed for each day the violation continues or is repeated after compliance the respondent must take must contact the inspector to verify compliance this concludes my case would you like to submit the electronic case File to the record do you have any objection to I have any rejections for that okay it will be accepted all right um as far as I go I I have no issue with what is said there about July 10th um I do have a um build permit application so what happened was is I had the fire inspector come in also during this period and inspect the place tell me what I need to do for code for fire because it is an old wood structure um they came across some building issues and they condemned the building on me oh so the building right now is condemned I'm not allowed to be in it not allowed to do anything um and it has to do with a rotting beam in the in in the roof line um to correct that we literally have to remove the entire roof put in a new beam and rebuild it all over again so like I said um we just received our building permit application 24- 6308 um and that was done um on April 29th and the delay of all this has been because this is such a small job and I had to have a structural engineer draw the plans for it um it took me about 2 to three months to find a structural engineer and in in the process um I have Richard Richard bills um is the the drafter that was doing it and Stephen R cold is who stamped it um it took about four months to get them to actually do it because I knew I was being thrown on the back burner because it was such a small job and going into the holidays um we have everything in place and as far as my knowledge Mike S who is my contractor Ms design he has submitted for um permits regarding all these ISS issues and I'm not I'm not 100% sure he submitted it he said he'd have them in by this past week so that is where I stand right now with the property I mean I lose money every month I'm not in there it is a commercial property I'm looking forward to moving into it so um what we don't have any any record of there being an application there is the PC status is all we have there's not a permit that's issued for the violation at this point but is there what's PC status plan check it's going through plan check so when it gets entered in we have several cases to where people just get the number if they were to bring the paperwork into the counter and hand it over they wouldn't be allowed to turn in a packet without having everything there but because we do things electronically to make it easier for people it allows them to get a number and say I'm in line okay so do you have a way of knowing though whether this particular application is just for the roofer if it includes the sopit and all of that sort of I have my notes okay I speak yeah I have with me I have the um um um um the contractor telling me what the the number is I also have the stamp plans the stamp plans and I also has the contract that I signed with mik s to show that I'm in with contract with him okay the permit for 24 6308 is currently in PC status which is plan check is for structural repair only any MEPS okay your mechanical electrical and plumbing siding Roofing shall be done by others not related to this violation permit number 23 10837 currently in PC status or plan check is for install of installation and gypson board drywall wall ceiling and garage portion of the building not related to this violation there's also another one for 23172 currently on hold for electrical not related to this violation so there's several permits out there on it nothing has moved forward yet that is correct okay but nothing is related to the sofit so I and the the items that are in this violation so I just need you to know that so that if you're accepting of the July 10th date you're aware that there's another permit that you have to apply for that apply that relates to this okay I will make sure that Mel takes care of that um specifically um but like I said we have to actually literally remove the entire roof and we're also pulling the metal siding off the building and building up so it's it's a complete rebuild so we'll be removing that sofit Foria will come off and new sof s it and face that is correct if he's typically if you're pulling the roof off to do structural work you can add that on to the permit correct because you're going to need it for demo MH and then you'll need it to put it back on correct okay okay correct so just as long as they spell that out they can probably amend the permit that's there right to include correct that and and I do have it spelled out in our contract with with Ms design perect then I think that that will satisfy the county okay so um I'll go ahead and find that there is a violation of simal county code chapter 40 appendix a section 105.1 um and I will give you until September 10 or sorry July I 10 to come into compliance and if not a fine of $50 a day will be imposed um and I will let you know that I I do see that you're trying to work with the county and so that's why your fine amount is lower um continue working with the county continue communication if you did not get one of Vicki's cards get one please and if you keep up that communication that's definitely going to benefit you as far as your proceedings here go uh the the kind one question the July 10th date what is that exactly is that for completion is that that to have your permit issued okay once the permit's issued for that problem right then that should clear up that issue okay that's not a problem at all okay all right thank you for this company or not no county code chapter 40 pendex a section 105.1 description of the violation install installation of a multi-level deck without the required permits this is a copy of the screen that shows the initial inspection that was done on 81 of 23 uh notice to the respondent went out on 82 of 23 given compliance dates an extension of 81623 81823 and 926 of 23 follow-up inspections are from 9911 23 through to 58 of 24 uh also view followup and computer inspections that showed that the violation Still Remains on the property it's a copy of the um property appraisers card that shows that Richard and Patricia robino are the Property Owners it's copy of the uh notice that was handed to the homeowner rich on 426 of 24 this is a picture of the deck taken on 58 of 24 that is kind of like a wall and you see the deck as it's going down to the lake there unpermitted um multi-level deck that was taken on 81 of 23 these are photos that was posted the notice of violation due to return certified mail taken on 9911 of 23 again photos of the unpermitted multi-level deck taken on 106 of 23 these are no permits issued to correct the violations however right before I came in I looked and saw that they did apply and there is a permit in their NPC status that was applied for 4.5 hours ago um there is no paperwork in there which I've already discussed with the contractor um this is a copy of the simal county chapter 40 appendix a regarding the permitting process this is recommendation based on the testimony and the evidence presented in the case number 2430 cesm it's determined that the respondents are the record owner of the property located at 1534 Grace Lake Circle in Longwood Longwood in simal County as determined by the property proper Appraiser's records in possession or control of the property and in violation of Simon county code chapter 40 appendix a section 105.1 it's further recommended that the special magistrate order the respondent to correct the violation onor before July 10th of 20124 in order to correct the violation the respondent shall obtain the required permit for the cited violation if the respondents do not comply with the order of fine of $50 will be imposed for each day the violation continues or is repeated after compliance the respondent must also contact the inspector to verify compliance this concludes my presentation would you like to submit the owner because this is the first time I've talked to the owner um he's had issues with his father up North so he wasn't home the contractor is known through simol County so we know how to find him I gave them my card I'm not going anywhere but he's your contractor I didn't hire him so my suggestion is to stay in touch with him and to just keep me in the loop as to what's happening because I will go to bat for you if you're working with the county um 90 to 120 days is not impossible for something that's that big in his backyard that's going to take somebody to come in after the fact it's been done and pick up this work and want to do it okay so um does September 11th sound reasonable yes okay then I will go ahead and find that they're been a violation of seminal county code chapter 40 appendix a section 105.1 for failure to obtain the necessary permits I will order that you obtain the permits by September 11th and if not you will incur a fine of $50 a day again I encourage you to continue working with the county and making sure that they're fully aware even if you get to the point where you're bugging them you're calling so much that's a good thing so all right I'll get you on March 14th of 2024 and an order was issued given the responded to compliance date of May 8th of 2024 with a fine of $50 a day to acrew for each day the property is in non-compliance an Affidavit of non-compliance was filed by the inspector after reinspection on April 16th of 2024 total estimated administrative cost to process this case today totals $873 42 for both the inspector at $ 77459 and the clerk at 12759 this concludes my case Okay so the um property is in fact in um compliance right now yes ma'am okay um and there they were not out of compliance for any amount of time okay all to be submitted for the permit so it was approved though through your system just in a different department correct correct and they did go through though and follow through with all of those violation continues or is repeated after May 8th of 2024 the estimated administrative cost to processes case to date total $663 48 for both the inspector at $553 35 and the clerk at $110 13 this concludes my presentation and the case is not in compliance at this time so um we're looking to ratify our prior order of $250 a day plus these costs okay sir can you go ahead okay um I bought this property a year almost a year ago when I bought it I didn't know about this case after I bought it I received the letters and the mail I contact the the realtor that's the house he told me that uh the contractor I think they flipped the house they fixed it and then I bought it so the guy was working on getting the permits and he was on the permits but I tried to get a hold of him a bunch of times he wasn't answered so I try to look all the ways to contact at least the company um I end up talking to I think he's secretary or somebody on the office and they said now that they're working on getting this because they start the the permits but they never upload because I came to find out what was the the process because they were not answering if not I was going to take care if I was Avail like able to do it myself but they called um these uh contractors and they talked to them and they said they were going to work with me they already got paid for what I heard from the other part the sellers and stuff that they paid this guy for those permits now i' I've been talking to secretary and I had a call in like five 10 times for them to answer so and she said that they're working on those permits I talked to her this morning she said they're working on getting those permits going so miss hathway have you had any contact with the respondent um I talked to him once I want to say probably last year when he got the first notification from US um and I talked to him this morning there is a permit in there for alterations that are in plan check which means they've been sitting there since 51 of 24 they came in there is a permit 23872 for mechanical which is an AC unit that voided out due to 12-day upload period there is another permit in there for 23 8341 for mechanical AC unit voided out 12-day upload period there's a permit in there for offence 2379 83 that voided out 12 days upload period okay and then a permit for 23799 is for the windows and door replacement that remain in plan check application due to Corrections the workflow and E plan stopped due to over 180 days inactive there's also a permit for 23474 electrical sub panels and Breakers not a code violation related to this case Okay so sir the reason I'm I'm struggling here um is because of the lack of communication um and the last hearing we had where the fine was imposed no one was present for you yeah I call I'm sorry I called and asked because I was in on town I was out of town when that day happened and they told me to send an email I send an email saying that I wasn't gonna be able to be here because I was out of town I didn't receive an email from him I don't generally if there is an email that's received that actually the the county will put that in the record and they will let me know um and yeah because I called and they told me to send that email because I spoke with somebody cuz I was out and they told me no just send an email and I I did vote an email and send it I don't have do you have a copy of that email with you today me right now yeah okay but I did I don't know you did send that okay they just told me this morning she told me that she's working trying to get that um work on um for I don't know which um the contractor what permit for the permit for the windows and doors they working on all of them they said that um they were trying to put them all together but they said that it was not that they had to do separate like the fence separate and the windows and you have a you have a AC unit that needs permitted you have a fence that needs permitted and the windows need permitted yeah they she said that they're working on it like I said I bought the house and after I bought the house I got this my closing Daye was on F 522 last year so I didn't know anything about this when I bought the house if know I would have would on that or I wouldn't buy the house okay but like I told them I'm I'm trying to get it fix even if I have to do it myself but they said that they this they talk to the guys and the contractors and they said they they get it they're going to get it done so the the permits that are in the system though that are expired because for lack of of the they didn't upload or submit it did you do any of those or were you trying to get I I try to talk to this uh contractor because supposed to he got paid already for getting all these permits and everything that he did he the prior owner the prior owner okay so now they sent me a new contract because I'm the new owner of the property that I had to sign a new contract with them so they can get these result but like I said I call I'm now I'm talking to somebody on the office because the guy the contractor that the the tribut or the seller give me the guy wasn't answering the call he's always oh no I'm I'm working on it I call you right back and then never call me back or anything so I had to go different ways to try to find another person so I can talk to and they just give me the the people from The Office that's working the lady that is working on these permits okay so in a perfect world how long at this point does it take to get the permits could they be received in 30 days sure with um so is there any kind of um plans or anything like that that will have to be submitted with them well they'll have to have a survey showing where the fence is going for the the the plot itself the windows they're going to the contractor should know he's going to be required to provide the product approval forms and the information regarding the installation of those someone will have to be present for those inspections when that permit is issued um and for the other one is mechanical um yeah they can submit that as well okay so those are all really um easy submittal that don't necessarily require any major architectural work the the air conditioning will require some type of schematics with it but an air conditioning they should have that should have that okay then sir I um I appreciate that you are here today and I'm going to take that as a sign that you're working toward getting this done um so I am going to Grant you an extension um to our next meeting which would be um June 12th I'll give you an extension to come into compliance June 12 and that means that you have to obtain the per the permits for all of these things okay you need to remain in contact with with Miss Hathaway at all times making sure that she knows what you're doing um because if I see you back in 30 days and you haven't remained in contact and you haven't followed through with any of the things that you followed through with that I'm going to be a lot less understanding and more likely just to impose the fines and the costs and fees that the county is requesting okay okay can I just add for the record um Mr jimnez called in on 3:12 of 24 said that he's working out of town and will not be able to be at the hearing and wanted to know if he can postpone the hearing to another date and it was um he was clueless of the code violations as well that was on 312 at 1023 43 Ruth emailed him back um said she called Julian to let him know that the continence request must be submitted to the clerk in writing in order to be considered for review by the special magistrate I sent him an email with Alex B copied in advising him to reply all with the reason for the continuance request and that was that was it but he had given the continuance request reason in the email originally we didn't get a reply that I'm aware of no but the original email just because he didn't send it to the right place he sent he he didn't email us he called the day of but there is an email in the file as well is there yeah I I just looked at it then it would have to Ahmad Mohammad at 3 3000 East 20th Street Sanford Florida 32771 violation charged is uh simal County chapter 40 appendix a section 105.1 construction without the required permits this case was originally heard by the special Magistrate on March 14th of 2024 an order was issued given the respondent to compli state of May 8th of 2024 with a fine of 250 per day to continue to acrew for each day the violation continues or is repeated after May 8th 2024 the Affidavit of compliance was filed on April 30th of 2024 after reinspection on April 26th of 2024 the estimated administrative cost to processes case to date total $ 7343 for both the inspector at 5983 and 30 cents and the clerk at 110 um and3 this concludes my presentation okay sir ma'am would you like to add anything um so I guess my only objection is I was going to ask for some sort of reduction it was recommended that I come and talk to you about that um anything could help okay um just cuz I had to spend like $6,000 on a new AC unit in and out for my tenant um um and this is a Section 8 home so it's I don't make too much money off this property and I just had to cough up that major expense um so anything could help you know okay when this case um came were were they responsive throughout the time was there um I'm very familiar with Mr Muhammad he's got several properties that um have had issues in the past so I mean he's been in here quite a bit and worked back and forth I have many cases that a lot of times they'll end up talking to Ruth or Julie um he he was probably not as fast at this one but um it was probably a lot easier to get handle but it was finished and comp he complied and like I said I am familiar with him so the original and he I will say he does try to come in compliance put it that way okay I'm here every day that can be good or bad so my concern is that you are here every day you should know that you need permits to do things so so the so the thing is the last property it was on Markham Woods Road and I it was purchased like that with multiple permits open and I've been going back and forth for a year and a half and that's that's why we're so familiar with each other because of that property so we have a case that was I was cleaning up I clean up messes basically you know I'm not causing these messes I try not to okay so when you acquired this property did it was it in need of the permit yeah no well I wasn't told that it did have that AC unit though when I bought it like a year and a half ago two years ago so you didn't put in the AC unit without a permit you acquired the property with the AC unit your honor yes okay okay also the AC if you look at the the date of like the old AC I think it was R read like 2015 or 16 or something like that on on the numbers on it so okay all right I'm going to uh find that the property is in compliance at this time and I am not going to impose a fine um I do not want to see you back here though not having simal County Florida the violation charge simal county code chapter 40 appendix a section 105.1 description of the violation is installation of a chain link fence without the required permits this is a copy of the case summary screen that shows the initial inspection that was done on 531 of 23 notice to the respondent went out the same day given several different compliance dates um follow-up site inspections also there were several different dates there from 23 to 24 followup inspections via computer results of the inspections the violation remains on the property it's a copy of the Property Appraiser's website that shows that Maximum Auto Center Inc is the property owner this is a copy of the notice of hearing that was handed to an employee by the name of Christian on 426 of 24 this is the violation that remains on the property on 58 of 24 that is the chain link fence photos of the unpermitted chain link fence taken on 531 of 23 photos of the notice of violation posted on the property due to the return certified maale dated on 713 of 23 photos of the unpermitted chain link fin taken on 1031 of 23 no permits issued to correct the violation at this point we've got a permit in PC status however it's being held up because they are asking to combine the properties um together under one name and then later it's showing here that it's been sitting out there since 623 and the permit originally was closed due to inactivity this is a copy of the simal county chapter 40 appendix a regarding the permitting process recommendation based on the testimony and the evidence presented the case number 2429 cesm is determined that the respondents are the record owner of the property located at 125 Maran Lane Castleberry in simal County as determined by the Property Appraiser's records in possession or control of the property and in violation of simal county code chapter 40 appendix a section 105.1 it's further recommended that the special magistrate order the respondent to correct the violation honored before July 10th of 2024 in order to correct the violation the respondent shall obtain the required permit for the cited violation if the respondent does not comply with the order of fine a $50 will be imposed for each day the violation continues or is repeated after compliance the respondents must Conta the inspector to verify compliance this can go ahead sir um my understanding is is that the owners of Maximum Auto Center hired a contractor to file a uh um obtain a permit and put the fence in which was replacing an old uh dangerous rusty old thing and to their knowledge he did and my conversations with the county is that he indeed did but he pulled one I think it was either for 125 and it should have been 131 or so forth because that was done way back when it was supposed to be done he just simply put the wrong one in in that was my understanding so I went down well to this building back in October to make sure that everything was as it should be and I was informed by a lady that I could um that the owners could combine the two properties as one and therefore regardless of whether the permit was pulled for 125 or 131 because that particular fence is right in between the two properties so I filed that and as far as I understood that was the last I got or they got for um any additional information okay well the comments here that was um sent back from Angie Gates on 75 of 23 said like these are the comments combine both lots to the Property Appraiser's office is shown on the survey repeat comment 1 71 of 23 the survey shows that the lots are one the property appraisers shows that the lots are two separate Lots repeat comments again on 726 of 23 the survey shows that the lots are one property appraisers show that the lots are two separate Lots so you need to go to the property appraiser to do a lot Joiner do you all have a county process that requires lot Joiner this would be her Department that's not M so there's a little bit bigger of an issue okay let me swear you in sure Solly swear airm the testimony you're about to give to be the truth the whole truth and nothing but the truth I do okay and your name for the Megan sonori for planning um our code previously did not allow for fencing on vacant Lots the permit that this case is for is a vacant lot it is a parking lot for the subject property next door cuz it's on the property line so they're trying to secure cars so they have two properties serving a business so because they put it in between the two lots had they pulled it on the correct address we wouldn't be here so understand but I I guess I'm having a hard time agreeing that a parking lot is a vacant lot code has changed as of April 1 okay so the short answer is I don't do commercial permitting I have not read through the commercial portion of that code so I'm not going to speak on that currently if he wants to go upstairs there's actually a planner on duty that does commercial overview um upstairs right now after we're done um the lot combination could still be done if this is currently going to continue that business that could still be done those are typically done over the counter that could still be achieved um and then this would be a moot point and then they could still pull the permit and it would still be done so there's still a means to an end to solve this issue okay so having said that how long does that will it take him do you think July 10 if they got the lock say he had to get another Power attorney he came in tomorrow the lock combination he would take that lock combination to the Property Appraiser's office the same day um we contact the property appra office they send us an email saying it's done the permit that gets uploaded to the permit portal and then however long it takes commercial review 3 to 5 days for a fence I think maximum so huh yeah for commercial review typically um so I mean he could be done within a month if they have their site plan and everything done already um but I don't know if the survey needs to be redone so that would be the contingency on how long it would take them to get a survey or to redo the survey that would be the contingency and then I will tell you that his power of attorney relates to any matters of Permitting or anything whatsoever related to this these two addresses so he should be okay with this we've accepted it into the record so could we give him a copy of it so that do you have another copy of this which power of attorney yes I do okay so you may need that to bring to get this accomplished um and I I think it should be sufficient for you um but do you understand what they're telling you there are some other processes that I do but I don't I've got in my hand a lot combination zoning approval that's stamped and signed so that needs to now go to the Property Appraiser's office for it to be combined okay so it was approved but I still have to get it approved well the prop it's been approved by planning and development but it still needs to be combined by the property appraiser formalized the property appraiser is a yeah there but not even just different offices he is a separate wholly constitutional officer so it's not like the county it's just another County department and they aren't talking to one another that's it's the county has absolutely no jurisdiction over or control over anything the property appraiser does and then you would need a survey that shows them combined for your permit which you have we just need to make sure that that's there's there's yet another problem Mary and Lane sits on part of my customer's property the street actually sits on their property by six or seven feet it's not the the the the um I'm trying to trying to think here the the the survey shows where the property lines lie with a shadow of where the street is and it shows the the problem and the my understanding is is there's a man I won't even call him a gentleman because I've never heard anything but four-letter words out of his mouth but he complains and calls the county on a regular basis complaining about this property and part of the problem is is that the road isn't in the right place the road is on these people's property when you go upstairs to talk to staff you can asked to speak to someone in public works they are also on the second floor okay so you can talk to Jim Potter that would who you could talk to about the right away Jim Potter yes sir okay okay okay so I think that you're close enough they're asking you um to to get the permit for the fence by July 10th I think that that should be sufficient time for you to get the lot um joined with the property appraiser based on that zone that you have now correcting the um Road issue the rideway issue that's impeding on your client's property that that's really going to have no bearing on the permit so I suggest that you still go forward and get your permit but you can handle that separately with the county I'm sure they'll work through that with you as well um but I'm going to give you till July 10th um I'm going to find that there is a violation right now for failure to have a um permit it's a violation of chapter 40 appendix a section 105.1 of the seol county code and I'm going to give you till July 10th um if for some reason you're you're not um getting what you need please keep in communication with Vicki so that she knows if that there is a hold up for some other reason um you know we can extend that date if necessary but um I'd really like you to keep going along this process and even though the rideway is may be an issue it's separate and apart from this fence issue so I need you to stay on course with the fence um and then costs to process this case to date are $465 89 for both the inspector which is $355 76 and the clerk at $110.3 this concludes my presentation okay um so I'm first this is a this is about two different two different construction projects correct correct okay I want to address the fence first because it's just a little bit of cleaner cut discussion so I have printouts from the uh property appraiser showing the satellite images from prior to my ownership that the fence was already installed I had no idea that was unpermitted I purchased I purchased this home September 19th of 2019 and I have satellite image from 201 17 showing that the fence was already in existence um so that aspect we heard your case already and you didn't appear um I I I have re I have notes and reasons for that as well this is okay but I'm not going to hear it again so I'm I'm telling you that um the reason that we're here today is because you are still in violation and so um you did not appear for the last last hearing um and I I do not have any file notice that you notified the county to let them know um why you were not here um and so I understand you may have had a reason for that but you were not here so I cannot take testimony about the compliance issue because that case has already been decided it's um today we're here to determine whether you still are in violation or not and the county has um filed an affidavit and provided um testimony that you are still in violation today so do you have anything that you would like to um state with respect to the violation that exists so I have a contract with my contractor for the work that I I was aware of that I that I started which is the exterior door being moved um in the back now I a contract that shows you know me doing this you know correctly and I also have a notice of a commencement um that is notorized for that being completed as well do you all have a a permit in the system and I I noticed I I got this not of commencement yesterday I signed it got it notorized yesterday but I asked my contractor for the permit because I noticed there's no permit number on it um so this is That's So it's not a permit it's not even been applied for yet even I you know this is but the fact that you waited till the day before the hearing to do it when well this was given to me yesterday by my contractor Ma you didn't go see your contractor I I can't imagine that you went to see your contractor back when the order was entered um in March that's not he gave what I claiming no that's not what I'm claiming I'm I'm I'm not going put so I I was out of town for a very long time um I had somebody staying at my house that I didn't I was in it this is probably doesn't matter but I I feel the need to express why I've been absent from the situation essentially um I was in an abusive relationship and the man that I was in relationship with was refusing to leave my house I believe you actually spoke with him Vicki um and upon Him notifying me that day which was July 18th I did call you directly um um and at that time admittedly I should have I should have dealt with it then I did call you and I didn't do anything after that um but it was just kind of there was just a lot going on to um get him out of out of my home so um I didn't even become aware that there was a hearing until excuse me March 24th um okay that's when I found f it's it's okay I'm sorry it's all right just take a minute that's that's when I found the stop recorder notice okay and I have pictures of how I found it it wasn't on my door it was crumpled up i' had actually been home for like a couple weeks at that point finally to start addressing all of this um and it's just been a lot it just been a lot just trying to play ketchup after not being in my home for the better part of about a year and a half um I was staying in Tempo with my family um um so I'm I I literally jumped on his I I was already in the process of of working toward this if you look at the the contract I sign with my contractor um which was earlier in March before I even found this so I was aware that it was a problem I wasn't aware that if I just wasn't working on it because I wasn't actively doing any work to the property during this entire time frame i' I thought that like stop work order meant literally stop stop work so I I wasn't doing anything to move forward because I wasn't there okay um do have you had contact with Vicky at I only talked to her once and I admit that I'm at fault I fault for that it's just you know I just I it's been a lot okay so um what I need you to do is I need you to continue to have communication with Vicki and I need you to understand that despite the fact that the fence was installed prior to your ownership yes ma'am you're still responsible for getting a permit for it f okay so with this door permit the the other things that you're doing I need you to do the the fence as well okay so does the county have an objection to um do you think that the permits can be obtained by um July 10th if we give the she's going to have to get engineered plans because she took out a window I believe and you put in a door you there there something was moved so there's a lot of exterior stuff so she's going to have to have some type of plans submitted so now I'm so I'm I don't know i' I mean as you can see my in my permit history I have had things permitted before I'm not opposed to the permitting process like it's not something that I did with you know intention to be sneaky I just I I really didn't know that it needed to be done because of that window that's what I was told I I made a mistake um my my understanding was because the window was there and it wasn't if the window was taken out yes and just moved right under it that a permit wasn't going to be necessary so that's why it was originally started a while back okay well a permit is definitely necessary for it um Megan did you have something you want to add how would I go about approaching it if the works this contractor didn't pull permit is what you're telling me that's my understanding is Vicky just informed me that your fence is on a corner lot right so um I'm actually going to have to leave I have a personal appointment but they will give you my contact information I do the residential permit review for fences I am more than um willing to set up an appointment time with you and go over and help you work through getting your fents permit and getting you a variance whatever it is we need to do to I have my survey I don't know if that matters I have a it does you're going to need a survey so just um send me an email we'll set up a time we can even do a teams meeting it doesn't have to be in person okay and we'll we'll walk you through and and get you set up however we need to get you set up and get you whatever applications you need to get to get you through this process for the fence permit because I'm the one that handles the fence side they're going to help you get through what they need to get you through but we'll get you taken care of on the fence side okay so what am I talking about TimeWise for something like that I would say go 90 days if she's got a contractor that's willing to work with her but again she's still going to need drawings so is the contract the Ser for the fence we're talking about the fence the door the door okay the contractor did charge me for drawings and permits so I'm assuming they have them okay I'm I'm going to need 120 because we're 90 days for a variance at this point the cut off is tomorrow and she's not going to make that okay um and then biggy you believe that um the plans and everything could be drawn by and and brought in on what she is working on in just 120 days I think so if she doesn't I my suggestion would be to give her the 120 days to get the fence handled that gives her time to find somebody who's going to come in and do the work after the fact the work's been done okay um and at that point if she's not where she needs to be in 120 days you can always come in go back on the docket and ask for additional time and let her know that you'll work with me on this and and Megan so we can get you where you need to be I I'm like the work has been so I was I was told the permit was pulled back when I signed right when I signed this which was early in March this year that's and no and and I believe that to be the case and then I got this notice of commencement I noticed after I after it was signed and notorized that there was no permit number I've asked them about that this as of this morning when I was printing out this stuff to bring to to this so I don't know what the response is going to be to that I'm curious to see what it is but meanwhile they I don't know what's okay and not okay so I they they finished the work is my point they'll walk they'll walk you through that walk you through every step so inspection wise am I going to be okay like if the work's already done well don't don't worry about the inspection it's the biggest hurdle you have is getting your getting the permit okay once the permit's issued the violation goes away you're in compliance regardless of whether you pass or not okay and I assure you that you are not the first person that has done work without a permit so inspections do happen all the time after work's been done I I I do have photos of every stage of it if that helps like I I'm trying to be as probably will so let's and we'll get there but the first stage is getting the permit like Vicki said okay so I need you to remain in complete contact with Vicki and Megan through the entire process because if we're back here on September 11th or on the 12th and you've been working with respondent went out the same day given compliance dates you can see that are from 9:12 of 23 to 1113 of 23 follow-up site visits there were several of them that were out there from 23 to 24 followup um inspections via computer from 23 to 24 results the inspection violation remains on the property this is a copy of the property appraiser website that shows that Los campus D America LLC are the record owners of the property this is a copy of the received certified return receipt for the notice of this hearing this is a copy of the received certified return for notice of this here is this a on 106 of 23 it's copy of the simal county chapter 40 appendix a uh section one um appendix a regarding the permitting process recommendation based on the testimony and the evidence presented in this case number 2426 cesm is determined that the respondents are the record owners of the property located at 345 Jones Avenue and at 33640 sford Avenue in Stanford and simal County as determined by the Property Appraiser's records it's in possession and control of the property in violation of the simal county code chapter 40 appendix a section 105.1 further recommends that the special magistrate order the respondent to correct the violation honor before July 10th of 2024 in order to correct the violation the respondent shall obtain the required permits for the cited violations if the respondent does not comply with the order of f a $50 will be imposed for each day the violation continues or repeated after compliance the respondent must contact the inspector to verify compliance 2369 cesm Gerald Williams at 131 Leon Street alamont Springs Florida 32715 this is in regards to violation of chapter 40 appendix a section 105.1 construction without the required permits this case was originally heard by the special Magistrate on March 14th of 2024 and an order was issued given the respondent to compliance date of May 8th of 2024 with a fine of $50 per day to continue to acrew for each St that the violation continues or is repeated after May 8th of 2024 the total estimated administrative cost to processes case to date totals $591 56 for both the inspector and the clerk Palm Circle OVO Florida 32765 violation simal county code chapter 40 appendix a section 105.1 construction without the required permits this case was originally heard by the special Magistrate on March 14th of 2024 and an order was issued given the responded to compliance date of May 8th of 2024 with a fine of $100 a day to acrw for each day the property is in non-compliance an Affidavit of compliance was filed by the inspector on April 29th of 2024 after inspection on April 8th of 2024 the total estimated administrative cost to processes case to date totals $591 56 for both the appendix a section 105.1 construction without the required permits this case was originally heard by the special Magistrate on March 14th of 2024 an order was issued given the respondant a compliance date of May 8th of 2024 with a fine of $50 per day to continue to acrw for each day the violation continues or is repeated after May 8th of 2024 an estimated administrative cost to processes case to the responded to compliance date of May 8th of 2024 with a fine of $150 per day to continue to acrew for each day the violation continues or is repeated after May 8th of 2024 the estimated administrative cost to process this case to date totals $426 for both the inspector at 200 9249 and the clerk at $110.3 this concludes my presentation okay I'm going to find that um the respondent was
