kind of go through the agenda for the evening we'll kind of call a meeting to order so we'll start if we can keep an eye on I'll keep an eye on our the participants too make sure we're not missing anybody that's coming in later on um so I'll keep an eye on that but couple things just you know updates from uh from my side you know to kind of get get going here um we did get the uh the web page up and running so Tom and I are in the process of finding out how we can actually edit the the web page but it's under committees and boards and under active it's Lake wola Bo in Safety Committee with kind of our our statement we kind of talked about we were still welcome to change this if we uh need to do something that way it has our email address if people want to send anybody on the committee a an email uh Tom's working on setting it up so that as emails go into the box they'll send them back all out to everybody else if you accept that confirmation that you sent out um seemed pretty simple time so thanks for doing that by the way but uh I haven't seen many emails coming in yet so yeah can I umle test runs or something make sure that it's still work it's actually working yeah is it okay to add one little thing to that yeah go ahead please um I think there might only be two more people who haven't yet um confirmed for me their forwarding address uh I'll send people a reminder email me for that I apologize fair enough okay so back to so I wanted to just give the update on we have a web page we want to get it so that we can edit it we can add attachments we can share things as we get into I'll talk about kind of the parking lot items we start thinking about you know as we progress through going through the different bylaws here and kind of getting towards the back end of that review um things that we want to recommend educationwise that'll be the place for us to post that um and start to kind of build that out for uh for the the towns folk and everybody else um I did want I did want to ask about we were due to select a couple of new meetings I mean meeting times I had 11:26 and 1127 as a potential and 1211 as maybe a follow up to that one if we want to stay on our kind of Quasi twoe Cadence um what do you guys think about that I'm fine with that and stick to the 6:30 6:30 time frame do we have a reference over the 26 or 27th I guess is the question I would I'm fine with either thank you 27th might be tough with the holiday the day after second that so 26 is looking better wedes but I wanted to at least throw it out there so one we aim for the 26 then everybody's good I'll set that up and then the 20 and then the other one would be kind of subsequently a couple weeks later 1211 everybody good with that date that works for me thank you yeah works all right so the 26 and the 11th are the winners perfect good deal there both of those what's that Mark 6:30 for the time on both of those I'll set up for 6:30 the both I'll set them up on the uh on the uh on the on towntown website can I um interrupt just briefly um I'm looking at the minutes because I thought we did one of these before so uh we scheduled one for Wednesday December 4th at 6:30 do we want to keep that and add the December 11th or um we had October 23rd November 13th and December 4th okay so we just got November 26 do we want to change it to the 26th and the 11th does that work for everybody that works better for me the fourth does not work well okay so I'll cancel I'll cancel the fourth oh yeah that might be on the calendar already too I didn't think I'll take it down no worries perfect okay fine with that yeah I have the access that's good um last couple things on my side before we go to approve the minutes then we get the public comment then we'll jump in um on our list of things we need to do kind you know finish up the byw reviews any other edit recommendations we're on bylaw six and seven the other piece that we wanted to talk about was enforcement so I think I just saw the chief joined as well so we can have some time today we'll shift our meeting to kind of get to the enforcement discussion piece I think that'll help with some of the questions that we've had um that have come up throughout the uh the last few days or the last few meetings rather so that would be good and then uh what I've been doing as well I'm just kind of trying to keep in mind we do want to get I want to get an update to the select board by mid December I plan to jump on one of their one of their meetings to kind of just let them know what we've been up to what the progress is thus far and then you know kind of where we're headed as far as some of our educational recommendations and or any changes to bylaws updates that way we'll do that as well and the only other thing that I want to just share with everybody and I'll send this I'll send this presentation over to Tom so you can include it with the minutes for the next go around but all the education topics that we've been talking about um around signage around you know stain up paddles and kayaks all the different things I've been capturing I put them I put them down so we can kind of document them and we have a a record of all the things and kind of some of the good ideas that everybody's come up with thus far so I think that would be great if we can uh we'll I'll continue to add to those we'll build those out so that when we get time to recommendation stage we have some stuff to start to work with that makes sense everybody good with that it looks great good all right so uh next on the agenda two videos that haven't been posted yet I can weigh in on this I did ask this question to our town clerk great okay thank you y so uh basically with the election and all of the duties of the clerk and the assistant clerk they're a little behind but they're working on getting everything um up to date and posted that's all I'm just make sure they were actually getting recorded thank you yep yeah when we started it today it uh it it says that we have been we are recording it the default when we actually make the web the zoom links the zoom meetings for the town the default is to record them all so everything that's happening and uh taking it one day at a time so there you go well we appreciate you hopping on yeah good stuff all right we'll move on to uh so we what we have left on our kind of our agenda looking at the the bylaws we've gone through one through five we have six and seven but I think with the uh a lot of the questions that came up were so or many questions are just concerns thoughts ideas around these the top five a lot of it came down to you know discussing a little bit around enforcement so I I kind of kind of summarize again some of the things that we've talked about um on the last several meetings about different areas and different you know concerns around enforcement you know and I I reached out to the chief so Chief thanks for jumping on the call I appreciate that and I thought we could kind of you know use the time today um in this meeting around ideas discussions around enforcement updates from your end um we have a couple of uh you know ideas of things we want to learn a little bit more about just as a a committee and then uh kind of your your take on you know how how we can enforce and you know what kind of presence you're going to have you know if there's fines are the fines who's going to you know Implement those and then how do people report if there are issues that pertain to bylaws or just you know maybe you know behavior on the lake that needs to be you know needs police intervention how do we go about doing that so that's kind of where we uh where we are so I don't know if that that helps but maybe uh anything on top of mine from you and then if not we can kind of maybe talk through a few of these then we can have people chime in on other questions that they've had along the way okay great um if we could take the questions one by one um I'll I try to absorb all of them at once uh and I have a great idea of what you're looking for but if we could kind of take them one by one I think uh the top one that most people I think are interested in is enforcement and I think the question that you're saying is um how would it be enforced or could it be enforced or all of the above I think all the above if we look at our bylaws today you know we again not having had had many issues at the lake for decades and I guess the question is you now that we've had you know an incident and you know some people have concern and just how are we how are we going to maybe uh update our enforcement or our presence or how do you think you'll how how that would next summer look to you I guess I think I just want to um start by saying um let's really um SE separate incident from accident um because in my world they are they weigh very differently accident is uh weighs a lot heavier unless it's an it it's an incident then that becomes uh something else by Nature so um yes we have not had uh any accidents um we we've had small incidents um so how are we going to enforce this well you know we could absolutely enforce the bylaws from Land um we could utilize our handheld radars and things of that nature um to be able to see how fast people are going in fact at the end of the summer um we went down there with our handheld radar to see the effectiveness for us uh by land um and how that would work um we are planning on um getting the shutesbury police boat um up and running and we plan on um getting out onto the water more um it's my understanding that probably before my time here in shutesbury the boat was on the water a little bit more um not a lot a lot is what I've heard from everyone so we plan on trying to do that and intermittently and one of the things that we say even with traffic stops in vehicles is it's called intermittent reinforcement so you don't know if we're going to be in our traffic spot or not or in a different traffic spot and hopefully the idea is is that you if you've um had to have your speed checked before it is likely because you're not sure when that might happen again that you really pay attention to the speed a little bit more um does that work all the time no it doesn't work all the time uh so uh getting out on the boat um we plan on being much more of a presence uh down at the lake um we are hopeful that uh people will stop um try I don't know how to say this uh so perfectly bear with me um taking matters into their own hands and actually calling the police department to come down and handle matters there have been people that have come forward that have told me that you know maybe there was someone at an arbnb and they weren't doing something properly so they took it upon themselves to go and speak with them and although I love uh the neighborly aspect of that sometimes it's really important just to let us know things are happening because you never know if somebody you come across is agreeable to your face and then decides look I'm going to do things the way I want to do that and without any history it's difficult for us to um sort of step in and engage it's easier once we know some history I think that how I guess that addresses one of the questions one of the questions that came up was what what is that process and at what point should we you know should should people reach out to to to you know to you to the to just you know call the one number call it you know non-emergency line what what what should be the process because that's something that we'd love to have maybe kind of like the process how we would do that on our web page later on or you know what should we how how and should we do that I think that um the one thing that I have encountered here when I've come to shsb is that people often say well we didn't want to bother you and um and we want to be bothered we want you to bother us so um I guess the the way to go about that um would be uh very there's there's varied ways to get a hold of us my officers don't typically like to sit inside the station um unless I'm making them do a report or something of that nature they're out and about so if someone calls and leaves a message on the station line it could be a day potentially two days before we get that message um and get back to you now I have um recently uh had voicemails go to my email so um if I'm not in I could potentially check those emails but it's not something that I do regularly on my day off um I handle other calls on my my day off but I'm not typically checking the voicemails so my preferred would be that if there's an incident and it's not at a level of a emergency and that is going to be relative to each person what an emergency is but if you're deeming it's necess not necessarily an emergency you're just trying to get an officer down to give some information or potentially show them you know what somebody's doing on the lake that would be the non-emergency line to dispatch which is the 413 625 8200 number and that way uh that call goes to dispatch and they can reach an officer uh if if we are on shift through our radio system through dispatch instead of having to wait for a voice mail or a phone call and then if there is an emergency and it's deemed an emergency again relative to people experiences that would be a 9911 call um you know uh the dispatch shelburn control is an incredible um system they have incredible employees there that have been working in dispatch for 20 30 years um especially shelburn control we have a large number of people that have been doing a long time and they're able to uh assist and decipher in the best way to assist the caller in the response so um even if it was you know this non-emergency line and it was deemed an emergency they could still utilize what they needed to uh in the system in order to get us there faster and potentially other um you know assets meaning Fire Department EMS Etc Great perfect the uh so we talked about kind of the uh enforcing 30 m hour spe so you you would intend to potentially do that from the boat is that the uh the idea the idea is I'd prefer that uh because it then it's much easier to you know um engage with someone um and you know ask them to stop and have a conversation kind of thing instead of recognizing What boat it is and kind of calling around to people and saying is this somebody on the lake is this somebody who's a visitor Etc um and then trying to catch up with them um later although uh it is possible but the preferred way is to try to be on the lake and enforce that again um police officers one of the standards that we have is that we must be able to estimate um not just utilize our radar as well so that's going to be a um training that the officers are very good at um already good at estimating vehicle speed on the roadway and and it it is quite a different visual on the water so it would be something that they would work on training and not just counting on their radar devices uh to work as well okay yep may I ask a question or is there a process for asking a question um one question I had is if the bylaw was changed so that there was a limit on horsepower for the lake would there be a need for present on the lake for enforcement of speed always because well uh horsepower doesn't necessarily mean what if it so if there was no horsepower um you know then somebody's paddling along I'm sure they can't go 30 miles an hour if they can I'd really like to enlist them into the Olympics um but as somebody with a motorized boat there's always the opportunity to enhance a horsepower so we actually had a discussion abouty discuss couple weeks back yeah there was no video of the YouTube so I don't really know what was discussed other than what I see for the minutes so it's I'm conjecturing um sure so was that question answered in terms of I guess you could enhance a nine horsepower to a 25 but that's um so is that what you were discussing in previous meetings well also the the idea that it's not just the horsepower but the ACT ual design of the boat the propeller that's on there's a lot of factors that go into how fast a boat goes but then also um the design of the boat uh can change how safe a boat is to go at certain speeds um and how just the you performance of the boat how one boat doing 20 miles an hour uh maybe very safe Rock Solid very in control another boat with a different design doing 20 mph uh is not as safe and not as well in control um so the horsepower itself is the only thing that determines whether or not uh a boat is safely na navigable um and again there's just a lot of different factors there um that that affect it of determin and also Mark I just wanted to say that um we also have to take keep in mind that just because there's a speed limit of 30 m an hour there's other factors uh surrounding that more than just the boat it is um conditions so in on right yeah we discussed that that too we gotta get the town and get these videos up yeah not uh you know yeah not every situation is safe to be doing the maximum limit um you know things weather the number of other people out there there are a lot of factors that into how fast you can go and what is safe um and and ultimately you know horsepower isn't the only determination of what is safe and Dave you had a question it looks like you have your hand raised here so yeah I just want to remind folks that yes I did mention the videos but we also have approved minutes of meetings so honestly if it's not in those it's not part of the discussion at this point so I would reference the Improvement it's thank you you got it thanks Dave um another question came on I'm we going to continue on the law enforcement piece if we can while we have the chief um just because I want to make sure we get through some of the questions that came up if I if I could just put it on the record then for the minutes then one of the options to bring forward to the select board would be no outboard motors and then we wouldn't have to allocate our police force funding here to be have a presence on the lake well the police department is you're not allocating from a fresh start um the police depart has always been down at the lake we've always been present on the water and there's always a need for us and and quite frankly a desire for us I have since this before this accident and um since the the building of this um you know committee I have had people reach out and say we want to see you more so um and and I think that is the um the take on the the committee as it stands right now um you know they're not trying to I I I have I have no belief that you are all trying to say you don't want us there no not at all thank you at least not at least not on my my book um I would like to talk about the EPA um one of the questions that have come up in the past you our past discussions was around what what enforceability does the EPA have there was some some discussion around they cannot enforce bylaws only state laws didn't know if you had any insight on that and then follow up to that have you had any discussion with the EPA about any potential presence they may have on the lake okay so let's get into that so the EPA EPO officers um and um uh the administrators that I have spoken to it's not that they couldn't enforce the bylaws it's that they can't uh can't um they can they are it's just overwhelming for them to do so because they take on so many towns and different towns do have different bylaws uh they choose to stick to the state regulations um they so it would be the shuberry police department that would be enforcing said bylaws um that being said the second part of the question was have I I think it was have I spoken to them and um what their presence might be yes question yes um so yearly as I talked about before I asked them to come down for um years past and uh they often say you know the Connecticut River is a and during the summer is a large presence and they need to be at that however they're recognizing that there's more action uh at Lake wola meaning more people visiting and um differing um you know reasons people want to beyond the lake which is amazing and um they have said that they are going to uh be a little bit more of a presence and they would likely come out on our boat with us uh if we let them know when we are taking it out um and they'll have my permission there'll be anou they'll have my permission that if they needed to take the boat um without one of our officers present um that we can we can definitely share that
