Kaya can you lead us in the pledge God indivisible and justice for all thank you okay let's get started with our presentations let's see this evening we are lucky to have with us our County Commissioner Raquel regalato who's here to share some info with us we're happy to have you commissioner regalato anytime you're ready there go thank you it's always a pleasure to be with you thank you so much um I'm here today to talk about the initiative that we rolled out and we're so happy that you're going to be supportive um and that is our occupant uh with autism decal um so for those of you that we've talked about this before we started uh my first item as your county commissioner was an item that started training at the county level so we started training our library staff and Transit um so far we've trained over 2,200 our police officers and almost 200 I think 210 firefighters um and you know the second part of this is the decal so the decal actually we it comes with two decals it's countywide uh and the idea is to trigger the training uh and for caregivers to be able to disclose that there is an occupant uh on the premise or in the vehicle right so it's for your car uh and also for your home um and it comes with a registration so in order to get the the decal you have to go online and fill out the registration we spend a lot of time on the registration um you can register without the decal some people don't feel comfortable with the decal and we understand that the registration really is what's very important uh the registration asks you to identify if the person is verbal or non-verbal and to give specifics on that uh it also ask for a description because we we want to make sure that our First Responders know uh who is in the home that is neurod Divergent so that they can respond adequately and deescalate if necessary um and then it also has a component for a parents or caregiver contact who should be contacted if there is an issue or if there are questions and then it does provide a box at the end for a description which in the case of my children I use to describe um some of their likes and dislikes some of the things that happen when they are anxious or afraid and sort of give more detail on what would be the recommendation for deescalation if I'm not there um and what other tools I would recommend to a first responder uh if I was on site um so it's given us an opportunity you know this month you know as we've gone from Autism Awareness to autism acceptance to really talk about how we can make our community safer um for our neurode Divergent adults and you know we've talked about the arrests at the county and you know the baker acts and how we want to make sure that those are Last Resorts and that we really provide a method of deescalation but sometimes it's not necessarily the neurod Divergent person and I'll give you an example with our firefighters we did have a case where the mom was having a heart attack the firefighters came the only other person at the home was a neurod Divergent adult who was very concerned that the firefighters were taking her mom you know um and and became very agitated when that happens so that sometimes leads to something else uh so we just want to take this opportunity to talk about all the different interactions and how we want to make those as positive as possible uh and we want to ensure that our First Responders have the training and that they have some notice so that they don't have to figure it out on the spot so for the cars it's really important you know um and I would highly recommend it for the home if you're if you're registered it is going going to show up when they come to your home but I think it it also doesn't hurt to have it in your home so I want to thank you for your support you guys have been wonderful in supporting our neurodiverse you know Community uh as you know I'm the proud parent of two neurode diverent adults it's a very busy month for us we get to talk about abilities and how wonderful they are and how we want them to support them and how together we can ensure that they thrive in the Spectrum so if you have any any questions I'm happy to answer them anyway I just uh I just wanted to thank you again for all the efforts you've done here and as well uh sharing the ideas of ways that we could further support from the sensory room to uh to these decals to uh boards that we might be creating and any other ideas you have please feel free to share them you've been incredibly educational you put so much energy into this and and we really appreciate it thank you thank you and I'm super excited about the board so thank you for doing that it really provides us with a space where parents can share a lot of their ideas you know as parents of children especially in the Spectrum we have a tendency to gravitate towards the needs of our particular child uh and of their peers and this gives like a broader space so everyone can kind of talk about these things and then bring priorities to you that are actually aligned um and we want to support the the local Municipal boards at the county level and kind of share best practices so we're really excited about that we really think that it'll be transformative in terms of providing services is um at a district level because you you don't need to reinvent everything here in South Miami or in Cory Gables right you know we're all neighbors uh and I think the boards allow us the opportunity to really talk about these issues in a more comprehensive way uh and figure out where those missing pieces are and how we can work together to provide more opportunities and resources so thank you you guys have been amazing sure uh how are you commissioner regalato it's great to see you great to see you so in addition to this item and I know you're bringing awareness to this item and I know it's very close and dear to your heart but I just want to thank you for all your Global support for our city and ironically we happen to have an item on the agenda regarding City Hall so thanks for help Champion the library portion as well he'd help thank you thank you I just have one question for you because you made mention that when you have the decal it'll be registered to your home do you know if there are plans to register it with the car or the driver or something so that the police officers have that Awareness on the road right so right now we're just doing home and then that's being provided through the 911 system so that's actually going to be provided to all the municipalities and that's one of the reasons that we wanted to make the decal countywide because really it'll it'll move with the different people we don't want to limit it to just unincorporated we want everyone to feel that they can register the car is a little bit different because the car would be changing right so we've talked about the license plate but unless they're driving they could be in any car so that's kind of the where we're at with the cars that's why the decal will give you if you have if you need several decals for the cars that's fine but just in the description you can also put information on the cars um and and the person and what their behavior is if they're in a car because that sometimes plays into it also yeah this is awesome thank you so much thank you all wonderful thank you commissioner oral I appreciate it thank wonderful and then you can go on the website you register you can pick them up we're actually going to be at a bunch of farmers markets uh so if anyone wants to come get them uh they can do that I think this weekend we're at Pine Crest so thank you perfect thank you thanks okay next we have our annual comprehensive financial report with Andrew fireman I think I killed it sorry I'm I apologize in advance yes it is well good evening uh honorable vice mayor members of the commission uh for the record my name is Andrew fierman I'm a partner with Gayo fierman Y and Garcia or CFG for short and I am the partner in charge of the city's audit I'm here to provide a a brief presentation on the city annual comprehensive financial report for the fiscal year end of September 30th 2023 the first thing I'd like to point out is uh in your introductory section of the document it is broken up into various sections there's an introductory section a financial section a statistical section A compliance section I'm going to point out a couple things within each section and just paraphrase a few things as we go through um the again the first item is within the introductory section it is on page Roman numeral 7 and this here is the uh certificate of achievement for excellence and financial reporting um it's a prestigious award which is uh given from by the uh government Finance offers Association it does show here that the city did receive it for the uh annual comprehensive financial report that was submitted for the FIS C September 30th 2022 this one is has been submitted for consideration and we do expect that it will receive it once again for 2023 as it meets all of the all of the requirements going to move into the financial section now uh the first item within there which is on page one is our independent Auditors report and it's broken up into various sections the first section uh talks about what we've audited um as well as our opinion on the financial statements and that states that we have audited the accompanying financial statements of the city of South Miami Florida as of and for the fisc year in September 30th 2023 in our opinion the financial statements referred to above present fairly and all your respects the financial position of the city as of September 30th 2023 now this is an unmodified or a clean opinion and it's of course the only opinion you want in your financial statements so you do have a clean opinion on your financial statements once again this year the next section talks about what under what standards We performed our audit that states that we conducted our audit in accordance with auditing standards generally accepted in the United States of America and government auditing standards the third section gets into what management responsibilities are for the financial statements and that's states that management is responsible for the preparation and fair presentation of the financial statements the last section I'm going to point out within here is still on page one is our responsibility as Auditors and that states that our objectives are to obtain reasonable Assurance about whether the financial statements as a whole are free from material misstatement and to issue an audit report that includes our opinions now continue moving through with the the financial section and just looking at page three and basically Pages 3 through 14 this is the managements discussion analysis and if you don't read anything else in this document should definitely read this it it um it talks about the year it Compares current year to Prior year it provides explanations for those changes and it's written from Management's perspective and it has a lot of uh a lot of good uh high level comparative information as well and financial information it's like a really good executive summary of like what's with it what's in the document and you know this being you know 100 page document it's nice to in 11 pages you can see a lot of what's going on and what happened during the year and explanations for that so again a lot of good information in that section moving now to Pages um 15 through uh 22 which is the basic financial statements that includes the um the financial statements uh the government-wide financial statements for as well as the fund financial statements for the uh governmental funds as well as the the Pension funds the one thing I wanted to point out here is actually on page 17 Page 17 is the balance sheet for your governmental funds uh the first column on that page is the general fund which is the main operating fund of the city the one thing I wanted to point out there which is the third line from the bottom is the unassigned fund balance for the general fund at the end of the year was approximately 13.6 million so uh good solid uh unassigned fund balance there at yearend for the for the city so that's again on page 17 and the general fund moving past the financial statements themselves and moving to page PES 23- 44 are the notes to the basic financial statements um this includes the required disclosures which provide additional information on the city as well as the numbers that are presented within the financial statements um within here it kind of gives additional narrative information it also gives additional uh detailed amounts uh giving detail of the numbers that are within the financial statements uh it is suggested that you do read it in conjunction in conjunction with when with your reading of the financial statements because it does uh provide that additional information what comes after those notes is the is required supplementary information which includes uh required uh schedules that the governmental Accounting Standards Board requires for budgetary comparisons as well as information on the pensions the one thing I wanted to point out here is on page 45 which is the budgetary comparison schedule for the general fund so this shows um how the general funded actual versus versus budget has the original uh adopted budget as well as the uh the final amended budget and then the actual amounts compared to that final amended budget and just a couple things I wanted to point out here is about about a quarter of the way down the page you'll see total revenues uh was Final budget was approximately 21.2 million with actual being 26.2 so there was approximately a $4.9 uh million variance it was higher than um than budgeted and then coming down to expenditures which is about 3/4 of the way down the page at the uh about 21 Point uh 21.8 million in the final budget versus 19.9 actual um general fund was about 1.9 million under budget um according to this so it's it's a it's a really it's one page and it tells there's a lot of good information right there just on the general fund finally going to move back to the fourth section of the document uh Pages 90 through 100 which is the compliance section this section includes the reports that are required under um generally accepted government audience standards the rules the audit general of the of State of Florida and the federal single audit act and we are pleased to report within within these reports that we didn't identify any significant deficiencies or material weaknesses in internal control nor did our test find any instances of non-compliance that's on the financial statement side as well as on the grant side for the federal single audit so no no findings specific to uh to report to you that are reported within this um document as well so clean reports in the in the in the compliance section as well with the with the um annual comprehensive financial report you also receive a letter and it's uh the the communication still is charg with governance letter um it's all standard Communications that that that are required under our Professional Standards um talks a little bit about if there was any changes in in in accounting policy if there's any specific disclosures we'd like to point out um a couple positive things within there is that we did not uh encounter any difficulties in dealing with Management in completing and Performing our audit and um there were no disagreements with management throughout the process overall once again this year it was a smooth audit we asked for a lot of information we receive that information we go through we process that information we come back we ask more questions we ask for more information um and you know the city was up to the task once again to give us what we needed to be able to be in a position for the city to have their financial statements issued prior to 331 and get them submitted for me to be able to be here to present to you uh This Clean report tonight so um with that I just I'd like to thank uh Alfredo and Jackie the rest of the finance team as well as um the city for the cooperation assistance throughout the process um we really appreciate it uh it is a team effort to get it done and I I thank all of you as well for your uh for your trust in our firm and for the opportunity to be of service to the city um with that I'll leave it there I'll put it up to any questions that you may have at this time thank you very much thank you very much do we have any questions I just had a couple statements um looking at the report and what the city has been doing I just want to applaud the city manager the CFO and the team for what looks like a very healthy year for us um I think we're contining on the right path so I appla you guys and thank you guys for your effort appreciate it and thank you for the audit it's important that we continue to do what we need to do to continue to introduce the next item because we're excited yeah I I am I always get excited about our our staff which I refer to as our team and I know the annual audit is a very hard act to follow but this is why we're all here this evening I know and I always say this when we recognize one tonight we're going to recognize two people but it's really the whole department and our Public Works Department mudar police those are the true ambassadors it's not the commission they're the ones who interact with all of our residents and all of our visitors every day so I want I know we're going to highlight a couple people now it's welld deserved but they have incredible leadership incredible teamwork and uh this award really goes out to to all of you and I speak for the entire commission that's the only time they can do it when I tell you we love all of you and we appreciate you and thanks for all the hard work you do every day so I'm going to turn it over to our right Deputy city manager to thank you thank you commissioner appreciate uh those words and certainly uh as a service organization uh we we rely on uh those that are out there every day and they're they're the uh U set the image and the brand of the city uh with with their work and sometimes going in the extra mile a lot of things that go on notice but uh it takes a lot to to um run the operations that are that are needed of a city of even in this size so um this is a employee of the quarter for first quarter it's a a team team uh award but I'll let a deputy city manager present it as uh mentioned by commissioner leadman tonight the award goes to two amazing Public Works employees Craig Martin and Sheldon boota I'll invite them to come on up um Craig's been with the city since 2014 Craig's been with the city since 2014 he's currently a heavy equipment operator hello um and waste collection driver Sheldon's been with the city since last year and he's a waste collection driver they were both chosen as employee of the quarter this quarter because during the SOI Arts Festival they acted quickly and without hesitation when an elderly gentleman fell and injured his head so their compassion and quick action that day and every day makes us all proud to have him on the team so I'm going to invite John Ree to say a couple words and invite them to say a couple words if they would like and present them with their certificates and take some photos thank you Samantha uh good evening I'd like to thank uh these two uh outstanding employees um great employees uh and also I appreciate you helping others uh in their time thanks a lot gentlemen would you like to say anything yay what if sweet uh I just like to thank you guys you know the city of South Miami for giving us the opportunity you know to be here and I would like to thank my boss John Rees for giving me the opportunity you know to work with you guys you thank you thank you thank you very much like to say thank you as well I like to say thank you as well uh that day also we also put out a fire inside a Sunset Place in the in the trash can somebody threw a lit cigarette and was light inet up so we put that out too so much appreciated it was a that day it was a cold day oh my how about a picture with our County Commissioner that's right that's so sleepy lot of people ready okay so moving on do we have any add-on items this evening no and I don't imagine we have any Lo OB addressing the city commission or do we no do an item have it pardon me a public hearing will vice mayor you will have a a lobbyist addressing this the commission on the quasa judicial item but there's nothing to do at this point okay perfect and then do we have any changes that we need to make the agenda this evening yes ma'am um I wanted to pull consent item N1 which are the design services for improvements to Murray uh Park in and Palmer Park um there we're pursuing a grant uh which we'll probably know sometime around the summer uh that would offset some of the costs um so we're going to wait for that and and try to do those improvements uh and then we can bring back other ideas potentially but uh so consent item N1 to be pulled at this time okay thank you and then I'm wondering if we can maybe defer number eight because i' I'd like the mayor to be present for this and I also have some additional questions I think we should be reviewing maybe offline for tax options and what have you in detail vice mayor which one number eight number eight yes for the South Miami Hospital project MH we have uh is this two two readings for this or just one it's just one and and I just I feel that that it would be better to have our mayor here I know that we had had a a conversation a while back about this in particular and I just I think we should pull it and have it when he's here so that we make decisions especially that affect our tax base when we're together I think In fairness to him and then Madam vice mayor this was this was I'm sorry go ahead to cut you off this was this was noticed for uh for this actually this was deferred to this date certain okay if you were to defer it uh could you defer it to a date certain just pick pick a meeting where it should come back to okay could we do you have a suggestion can we move to the next meeting I that's what I would suggest yeah so to the May 7th meeting I'm I'm sorry sorry but before event it was our fourth annual recycling event we collected 342 pounds of recyclable Electronics so thank you to everybody who came out to that we have our Arbor Day event April 26th that's from 10: to 12: p.m. at Van Smith Parks um parks and wreck are um in collaboration with South Miami Garden Club we're going to be planting two Jamaican dogwood trees after the ceremony there's going to be like bites and refreshments so everybody's invited to come out uh May 5th we have our Cinco de barco event that's at South Miami dog park from 10: to 12:00 p.m. all dogs are invited to join the fun we have music giveaways and lots of local vendors the South Miami senior Plaza going to be hosting a Mother's Day party on Tuesday May 7th participants will have manicures a catered lunch music and Raffles for our seniors and last but not least um we have our SOI second Saturday's Night Market um that's going to be launching Mother's Day weekend May 11th so that'll be on 58th uh from 73rd to 74th Street um there's going to be lots of vendors live music art um that's 5: to 10 p.m. and will continue every second Saturday of the month we're working with the businesses to make it a destination every second Saturday so certain businesses will be offering discounts throughout the day um so everybody's invited to come out to for the first one May 11th awesome thank you very very much some comments vice mayor yes of course well luckily we have our County Commissioner here so she can help us promote those stuff out there as well this is our first major event for second first Saturdays so I'm looking forward to it I think it's a big big deal a lot of good things happening and I'm also really happy how we're collaborating with the county commissioner as well marketing wise and doing some special things so I appreciate it keep up the good work thank you sir awesome okay anything else anyway thank thank you next we're moving to the City attorney oh point of personal privilege I've been to the Cinco dearco it's actually amazing so highly recommend 10 out of 10 would recommend oh man okay moving on to the city attorney's report thank you madce mayor I heard at the last one all the dogs had to walk home oh my gosh I can't with you that was bad yeah only you goodness I don't know if I can follow that no no no it's it's all downhill from there that was rough commissioner so uh three three items uh the first regarding the city hall RFQ RFP um um that is one of the items on your agenda although the cone of silence is temporarily lifted for while you guys are discussing that item I just want to remind you that it it is reimposed as soon as that item is closed or as soon as action is taken on that island item and it will run through the RFP process so just a just a heads up about that um another thing about the city hall RFQ one of the respondents was an entity called 13th floor uh they' they've done work uh throughout Miami Dade our firm performs real estate work for for them another partner of of Lily and I and uh there's a technical conflict of interest under the bar rules but it is wable and uh Lily and I have do not represent them and do not intend to and certainly they don't do any work in in South Miami with our firm but we would ask this commission to consider waving any technical conflict of interest how would we do that uh just a motion is fine okay can sh shall we do that now so we can get it out of the way please thank can we have a motion to wave for them I move the motion I'll second well we can second together okay moving on vote V we news unexpected good news so quickly uh the the 10 property that has been such a nuisance for quite some time today we got an expart A order from the court allowing us to uh come in and Abate the nuisance so the city manager is coordinating that effort and uh we we will actually get some movement on that which so what does that mean uh Exar means it it we had tried to serve the occupant of the house for a long time it was unsuccessful uh he was very good at evading uh Service uh so we went to the court and we said we can't serve this guy uh you know but the new sense the the the violations continue so the the point of the of petitioning the court was to get get a court order to enter onto the property andate the violations so then we're literally going to go in and clean it up we have the authority yes okay and then build them what do that yeah that's the yeah we would lean the property okay perfect thank you that's it all righty Mr sorry I had a quick um City attorney what was the first um the first item again I had a question on that the so the conos silence technically would start if anything gets approved today by the commission again or is it yes right yes Yes actually it's only while you guys are talking about it the cone of silence is reimposed immediately after you speak about it okay anything else all righty moving on to public remarks I only have one name on the list this evening Mr dickward the floor is yours Dick Ward few days ago I received a phone call from uh former member of the uh planning board Lee Jacobs and as we were talking he knows how I have talked about these allegedly some proposed high-rise buildings that may go up in the city and some have already and I had come to the point that that I was about convinced 10 stories I could accept and then I saw this this monstrosity over there at the at the uh wind Dixie property it's 10 stories it's unbelievable and it's a block long it's going to be an interesting operation but you know this city is known as a city of pleasant living and I feel we have three new people sitting up there on the commission fine people but I'm concerned that our new Commissioners don't seem to be connected with the city residents as much as I think they will now through experience and I'm sure Cory can and I know that man over there leadman can tell you how many years eight 10 he's an old-timer but anyway uh it it it just concerns me that I he told me about that resolution so I got the city clerk to print it for me and it's 24 pages long and as I read that thing I kept saying to my my my mind almost started to Circle it's it was unbelievable I don't know how you people understand it all I guess the attorneys have to interpret it for you because let me tell you something I had a hard time understanding it but the one thing that Lee Jacobs and told told me is that basically there's no longer a limit on the height of a building in the city of South miam but of course I'm sure I hope it's still there I think I read it there is at least the condition of the placement of the building will require uh they won't be put into residential areas and things like that but I I want to call your attention to the fact when I came here in the early 60s Coral Gables was like this little town not many high-rises and I drive the church at Coral Gable United Methodist now and I look at those monstrosities that have gone up and they're still going up and you know the people of Gables used to fight that but they lost the battle the city of South Miami homeowners association used to fight it too they they said four stories you know development is important an control development and our homeowners association disappeared all of a sudden and and I hate to say this but I'm sort of glad they gave they gave the commission an awful hard time and I would just like to say that I hope that you as a commission will become more in tune to what this city is like and what it has been and what I hopefully will continue to be that election that you held just recently 177% of the people voted is that a good representation of what you're going to do with that money you know and I know it isn't it's not a good reput representation it's it's a little worse than what our commission races used to be before we went to November our commission races we had 20% we were lucky in November election we had I think a little over 50% and I thought that was terrific but I do appeal to you as a commission to be very cognizant of the fact that even though only 177% seem to go out and care about that issue I hope you will uh be careful and do a lot of deep consideration before you approve uh as one person said a 32 story building at uh shops of Sunset and if that were to happen I imagine all you would be impeached thank you I have some other things I'd like to talk about but I see the time's up and I I can save it until the next meeting we'll see you then thank you very much I also have Danielle Gara hi there hello how are you hello vice mayor Commissioners thank you for uh for giving me an opportunity to speak on this item uh I wanted to speak on on resolution o number five the uh Lot B um and I wrote my comments as I normally don't I speak from the cuff but on this case I wanted to be very specific um I think it's parabond in your duties as our elected officials to protect the very limited assets that belong to the city's taxpayers and ensure that we get the highest and best use further I think it's important to plan the future of our downtown holistically rather than in a hodgepodge fashion lot by lot so that we can make sure that when the entire Vision finally comes together and is developed all of its parts work together the current use of this property is a good enough Revenue generator for the city which allows for us to pause this item and bring this item back to consideration when we have a better idea of how Sunset Place and other Redevelopment Parcels in the planning Vision are more clearly defined I think the RFP is not only narrow but by requiring a hotel component but very premature from a planning perspective in it's in its proverbial cart before the horse I'm not here to criticize any specific Concepts being pitched by those who are interested in this item but rather to strongly oppose the timing and sequence of this item I think it will run counter intelligent planning for our downtown's future development I think think we should continue collecting the current Revenue until such time as the city may have item that has clear ideas of highest and best value and is part of a comprehensive plan of our downtown core with the development of this sustainable for our long-term Community goals and not just attractive for short-term development play I urge that our City commissioners take a unified unanimous decision against this item and only consider divesting of this public property asset with the concept that is the best for the taxpayers and residents of the city not exclusive for a developers interest thank you for your time thank you do we have anyone online if there's anyone on Zoom please raise your virtual hand if You' like to speak doing publica remarks I don't see okay that being said we will close public remarks I keep turning that off do we want to do commission reports discussions and remarks now or do we okay do we have a motion I move the item I'll second I thought sorry vice mayor I thought it' be interesting I thought we saw P P Garcia here before so we can get a little bit explanation of how cool the what they're doing for the can you tell us who P Garcia is he's the guy that's running the program for scholarship fund used to be our athletic director at FIU oh that's awesome is he around yes he is there you go well well thank you for pointing that out thanks it's pretty cool so I I would agree good evening uh members of the city council M vice mayor uh city manager CFO um I started this program about a year and a half ago and is to help I'm my first generation myself myself is to help first generation kids that are pel eligible uh that are at FIU uh basically I know firsthand that a lot of these kids have Financial constraints and a lot of them don't wind up finishing school because their scholarship this is not for tuition and fees this for the scholarship of fall and spring so basically what I've been able to do is get donors uh to partner up with different municipalities and I know I started this process with the mayor and then contined with the city manager and then uh with the CFO uh basically we have a donor that is willing to match your $7500 two for one so this is going to become $22,500 for residents of the city of South Miami that are first generation Ando eligible and what this does is this kind of the gap between their scholarship and FIU is very economical to go to but still there's a lot of these kids they can't even afford a gap the cap normally is about 2,000 to 2,500 a year you got an average of 11 kids that are City South Mii residents pgan eligible and first generation on an average year and basically this is going to close that Gap uh if you divide 11 by 22,500 not 7500 7500 is what you're giving but we're going to match it I got a Don that's willing to match it and I've held them on for the city of South Miami because the mayor and the city manager and everybody else told me that it takes some time but if we do this obably it's going to help the kids so I'm very grateful for you to consider this and at the end of the day I know how important These funds are for these kids to be able to graduate the first in their family because then they're looked upon by other siblings in the family and in many cases these are the only kids that have ever graduated from from college in that family so it helps the quality of life in our communities and it helps the quality of life for these kids and their families and for generations to come you want to go I I just have a question this is actually very cool I was a pel grant recipient so it's it's especially cool for me um how will we know that they're South Miami residents how will we make those connects when they apply it has to have the address of South Miami and it's got to be verified by our financial aid office on their application same application that you know they have to identify themselves as first generation and everything else but like I said over the last few years you've had an average of 11 now there's some municipalities that are doing this and they're huge and they got like 700 kids and they're putting a lot of money into this and they've gotten their own donors we've secured this donor and it's guaranteed and and I'm thrilled for these kids that's awesome Mr gcia you said it was a two for one this this time so it's 225 it's it's going to be the total award is going to be given in the fall is going to be $22,500 you're $75 plus we got a donor that's willing to give $155,000 for the city of South Miami residents that's fantastic can I apply to go back to college I'll go with you I think sh already applied I I have eligibility left I just quickly wanted to thank Mr Garcia I also wanted to thank our city manager and our uh our mayor who hopefully will'll be joining us shortly for for championing this item thank you thank you for considering this thank you very much for securing the funding for us we got to do our part so I'll move the motion okay yeah yes I already um it's already moved we so we're just voting now yes okay the city of South Florida authorizing the city manager to issue a request for proposals RFP for the development of Hometown District Lot B I move the item I'll second so we can have our discussion yes so I'm I want to discuss this item and then we can um at that point table this item so our city attorneys can do some further research regarding the regarding the lot so the item we're we're speaking about here is we have a surface parking lot which um which fronts Kashi rice those two restaurants also the the back of the house of of What will what will be the back of the house at Sunset Place and the parking garage um if you've heard our our mayor any number of times um in this commission almost every commission me he mentions that we're over parked we're looking to uh attract parking into our parking garage one of the worst uses for any um parcel especially in a commercial area is a Surface parking lot just generates a lot of uh a lot of heat I I ran for when I say heat not netive attention but in terms of temperature but um when I ran for office when I started running in in 2011 you heard someone mention I've been here for eight or 10 years I wish it was only eight or or 10 years I was uh Champion a hotel um I felt that one of the reasons was incorrect at the time I I thought we could charge a bed TX but only the county and and Miami Beach can do that but uh either way one of the great things about a hotel is people do not eat in their rooms and people frequent hotels um also frequent retailers and this city was always void of a hotel I don't know how many of you be a little more familiar with with the nature of the business but I've ever heard of a Best Western losing their flag I don't know if anyone's ever heard of that we were home to the Best Western that went South it was so bad they literally lost their flag now we have tell and I can never recall whether it's the the Travel Lodge or the roadway in but uh it's attracted a lot of attention from the county there's indent housing there was a prostitution ring there what we needed to do is we and this this commission has always said since their campaign and since they're elected that they wanted to support our our commercial area now now why is it so important to support our commercial area one thing that's never been contested is we're very fortunate South Miami the reason why we have rich city services and low taxes is because our commercial area accounts for 2third of our tax base now why everyone talks and why everyone May point to Sunset place and this is abely accurate No One hopes Sunset Place materializes more than me but if it happens you never know we're at least 5 years off so where's the stop Gap what are we doing now to help our commercial area to protect our tax base to protect our residents from increased taxes why because we have the richest service in the county for such a tiny municipality we have our own Police Department we have um the richest garbage services in the county we have curbside we have a um you the uh we have green pickup every week so that means that we're dependent on our commercial area and we've done absolutely nothing to protect that not just protect that tax base but help those businesses I don't know the last time someone walked around downtown just looked at the trees the sidewalks it's embarrassing a great metric is just look look how many closed stores there are look how many blacked out storefronts so there's no better driver and I've challenged the commission on multiple occasions to give me a better idea they have not than a hotel why no one's it's much different from an apartment building no one's eating in a hotel room that means that they'll frequent the restaurants in addition whether you're on business travel or recreational travel you're going to tend to go walk on the street explore the area and support the retailers so again since 2011 I've been Champion hotel in our city to help bring visitors to protect our tax base and and um the main reason for me bringing this this forward is that we need money here I know people going to talk about a bond but a bond is long shot in addition to we have an item on the agenda and all the other Hoops we have to jump through ultimately it's going to have to pass in a general referendum by majority and I don't know any city where the voters are going to vote to uh hope maybe come to the point we pass this year we're going to vote for increased tax so this is a way that again we can Bas we can generate money several different ways from a underutilized city asset and put it in into that area to beautify our city and protect our tax base so the person who spoke by the way who read um view is very myopic person's a developer and also very inaccurate when you're in government you're not the last in you're the first in you have to lead when you're in government you have you're you don't wait to be the last in this is much different than the private sector when the government you have to attract investment and there's there's no better way to do it so in terms of a hotel it's open to any any use it could be a hotel it could be something else people have suggested low-income housing the city is overflowing with low-income housing and we're a tiny City and that's and call it affordable but that's the last uh location for it the way this item is struck ured is it could be cond it's up to the commission it could be condos or um Ros it could be a straight condo or a condo hotel and we could keep the parking garage or not keep the parking garage but it's definitely not the best use for the city in in any way we have plenty of parking and by activating it we'll continue to generate tax revenue and we will uh put feet on the street to support our downtown which is no secret just go for a walk and you'll see how much our downtown is struggling the point where it's embarrassing and that is the most visible part of our city both for our residents and non-residents and that's what people associate with South Miami and we haven't done anything to improve it some we found 7 a half million for a park that's certainly not visible that doesn't touch all of our residents but the most important area is something that everyone in the St has agreed is our number one priority no one's done anything to find any Revenue to improve that and to to and to to execute it basic basically it's been all talk in addition and you've heard me say this many times what the Herold got right when there were six people running for office two for three seats three of them are or two of the three are are up here now they all said that improving our our commercial area was our number one priority well I'm giving you a great solution and if not if you're not in favor of it that's fine but show me another way without putting the bill on the taxpayers and again wish you luck p in the bond show me another way that you're going to get the funding to follow through on a plan that we're going to spend a million dollars on to beautify our commercial area which is long long long overdue with plac making and streetscape thank you okay so am I understanding we're going to then defer this item no I'd like to discuss it okay and just see where when is so that way when we bring it back so sorry one one thing that the U mayor brought up because he knew he was going to be late uh he has an item before the C G's commission is that apparently there are some um plat concerns about the subject lot so I want to give our our city attorneys a chance to uh to look into that but the in the interim um yeah wanted to get feedback from the commission that way we can bring back a more a more targeted more targeted item vice mayor through the to commission tell me since the commissioner brought up the comments from the May is that something we should read out loud just so the public understands what his point of view was or you can just share your your finding yeah you want me to summarize them yeah okay just regarding this yeah so the mayor was concerned about the the the platted stat the plat status of the property itself it's a portion of several Lots from an old plat there are exceptions to plating under the county code we need to run title to see if we can find uh because we you know we did a basic computer search but we could not find you know the earliest um deed uh it's quite possible that the city has owned this forever and it'll be fine under the planning but we need to confirm that he was uh there was another concern regarding the what is the alley on the south side of this that that alley is not a dedicated alley it's not set up by plat so again if we run title we'll we'll we'll find out so actually I would like to ask do uh does the commission want us to run background title on this and trying to answer these questions sorry and if I may spoke with the attorney earlier the alley is private and there's it's not contigous because the parking lot is at least a foot above right that alley right but but the the according to the Property Appraiser's website a portion of the property is on that alley so the I guess I think the mayor was concerned uh if they build to the extent of that of the property would they be blocking the alley what does that do to those to those businesses so we need to um I what what he raised was we that we should run title find out if there's any rights in that alley that the that the neighbors have and then either way this commission can determine hey we're only going to recognize up to this line you know you can't build south of that to keep that alley functional I I have a question for you this has been in play for a while so why has none of this happened before now it just feels like we pushed it back first because we said we weren't educated enough on it then we pushed it back because someone made comment that we hadn't talked to more people about it then we pushed it back again saying that we didn't have the staff capacity for it then we had two people present so this has been going on I mean I would I would say nine months eight months yeah that's and why has none of this come up or has it only not come up for us have the people that have been kind of pitching for this have they done all of this I mean is this something easily accessible do so I I can't answer that question you uh we can run title you have to order title you know from a title comp um so that's what we would do next if we if if you guys want us to do that but we had never done that up to this point um you know I think other priorities got in the way once it was pushed we focused on other priorities I want to say that I think that it would behoove us regardless of the direction that we go in that we have this done because we will continue obviously to have this conversation regardless of what will happen there are we in agreement that we should have this done absolutely yeah okay our Direction okay there you go you can say it we Josh says we should ask for a vote for direction to direct the City attorney well let's if you don't mind City vice mayor if we convin some comments I think that you're right I think we need to we need to really look into the title make sure that we can do stuff like that um you know some of the comments that were said before look we've always said we wanted to do something like that and I agree with the commissioner on you know we want to make improvements to the city uh downtown is our major Focus that's what we all ran on I think we're doing a lot of major steps to do that we've invested major dollars a lot of decision- making over the past year that we've done so this particular lot is very awkward right so you have a a behemoth and our anchor in South Miami in in in Sunset Place that's coming right and that that'll be the back end shop we have stores that are Staples there in our neighborhood that do really well in aashi rice the Tire Kingdom La Pizza and so the problem is look I I I do I do agree that that those 37 spots or whatever the number is is not going to make or break us on a parking but it does give us the opportunity opportunity to do different things in the city I'll give you an example we lack City space in in the hometown you know area right so we have this roughly I don't remember this exact size of it let's call it 20,000 Square ft of this particular property you know we we're lacking public parking a park not parking let me be specific park space in that area and I think to what we really want to do and create this atmosphere we need that right so this could be a chip that we can use in the future to negotiate to get a park somewhere in that area so that's one of the things I looked at um secondly um you know we are going to affect if we do any development there and by the way I don't want to be specific to hotel so that'll be my vote is not specific to Hotel I want to view best best best in use case of what we can do in that particular property um and I don't mind going to an R RFQ and RFP process to do that but it won't be specific on Hotel because I don't know and using my experience I wouldn't say that's probably not the best one but we can go ahead and open that up to discussion um what do you think is the best one I don't know yet there there's opportunities that we have with if you envision what our city would look like in the next seven years with the amount of units and the amount of things that's going to happen it could be office space Believe It or Not office space right now is doing horrible in the industry but there's a need for it here especially if we're going to have three or 4 thousand people coming into that area right that's I mean it's it's going to be a need and we don't have any of that anymore all right parking is going to be an issue not now not tomorrow but in three or four years it's going to be a big issue right because we don't have enough parking right now if we if the numbers that we're calculating and the vision that we have as a commission come to fruition we're going to going to have an issue so those are the items that I'm concerned about this is not a parking thing at all I mean shortterm it will be but it's really our vision for the city and I think you know commissioner Le you hit it on the spot I think us as Leaders what we're really trying to do is have a vision for the city right we plan and do things correctly right that's what we've been working on the last year is getting a zoning study so we can actually dedicate this and do this correctly so I don't mind going for an RFP just to see what we have I'm okay doing the title because we need to understand what the lot looks like but it won't be for a hotel in my opinion and we really really need to understand what's the best fit there so I'll leave it at that do you have anything to add yeah I mean I would just say it is fine to kind of move forward and explore obviously we've had conversations about this in the past talking about the zoning study coming online and certainly we're all impatient with that I you know there were long delays in that study when we first you know ordered it almost two years ago so not having it uh not having it available yet is is is a pretty major concern I am interested in highest and best use for that lot I do think that the hotel only restriction might be you know complicated with it it would have been nice for us to be able to have more conversations about it but I'm also um understanding of uh commissioner lemman as well that we that we do need to lead and we do need to um start making some changes uh and fulfilling some promises that we we've made uh to improve the downtown so I don't mind you know taking some steps in that direction I'd rather not have those restrictions in place and I'd rather uh be focused on the highest and best use and if we do put it out to RFP have it coordinate well with our study um so that it uh we don't have anything in there that is you know irresponsible okay before I make my comments do you want to say anything else I can follow you I can hour follow you okay then I'll I'll go for you can close it because it's your item for me when I look at this I I have a similar view that it should have some some Hotel component even if we don't make it all Hotel I also think it's very important while we're having conversations and it's interesting that you brought up parking because I feel that whatever goes there needs to maintain not only our parking but their parking because we keep hearing and we've discussions on so I I know most of us agree that while there's a vision of people not having cars here we have cars here and we like our cars and I don't think that we will be getting rid of them in the at the speed that paper would like to think we are and so this whether it's next year three years from now it needs to be self- sustaining plus us and that's really what I would would be interested in looking at and so when we have the conversation of what is your Utopia that is it for me and I think that we can't keep holding this up I feel like we're almost holding this hostage in some way at least in my brain because we move forward we go back we move forward we go back and while I think you know it might be that we're nervous about maybe doing it at this speed I don't what time gives us other than what we're doing with the zoning study but tell me what do you think you you were wanting to say something well I mean we also have a lot of property that we have in the city that we haven't really thought about what's the best scenario right we have the inspection sites we have lots that we have allocated either for Parks or for you know uh affordable housing we're just going through that process now to really plan this and do this correctly so I'm not saying it's not a bad idea I actually like the condo and I like you know Mr Oscar's vision of what he had for that particular property it's just when I see the vision of the city this is just again my my personal opinion it takes a lot of planning a lot of things and and I think a park is a big deal in our hometown area and we don't have allocated space for that and then we're going to have to bargain for it and I think this is a good bargaining chip just one part I mean holistically speaking if we can do an assembly of that whole Corner as the main face of our hometown which it is it would be ideal that it's something very spectacular something that's attracting people right now it's not right it's a little through Street going into a garage yeah but I think we have to also keep in mind that's going to be essentially back it's backup house for for one side but then we're going to be a condo hotel for another maybe yeah no it they're all valid points I I think it's it's very interesting so I'll let you CL thank you so probably the most important thing um which I I didn't mention but is in the item 100% of the revenue should an RFP be awarded would stay in the immediate area would be reinvested the immediate area because that area is star for investment and we had our former SI director walk in so with all due respect one of the reasons why that area is star for investment and one of the reasons why I don't know of another downtown that's as neglected in the in the county is because that area was part of the CRA so the funds were siphoned off into another into another area and that's one of the reasons why there has been money reinvested in that area again do be a favor I I really ask charge everyone with doing this walk through our commercial area and tell and look down instead of looking up or straight tell me what those sidewalks look like tell me if they're level tell me if those the appropriate tree first of all it's a hazard but um we have black olives there which we know they're beautiful trees when they're you're not your yard your neighbor's yard and they're well manicured but these aren't well manicured they can't be they're in a sidewalk sidewalks lifted also the sidewalks were done they put rock salt in them to create this now it just looks like pitting but um it's uh there's trees are dirty they clog the drains and and so forth so it look down for two reasons number one you may trip but number two look around look at the storefronts and tell me if you think that area is stared for uh some investment and tell me if you think it's our responsibility considering it's the most visible area in the city we're so proud of and the third thing is tell me if it's our responsibility to protect our tax base which we're so fortunate to have it accounts for two-thirds of our tax base with us doing nothing supported and that's not putting on this commission previous commission as well that's what I ran for and I truly believe there's no better driver than a hotel why do I like condos bu on the apartments one simple reason they generate more in taxes it's multiple folios instead of one but in terms of opening up you can open up I left it very open-ended I said we can put out the RFP with the part paring garage for the city should you want to retain that or not um in terms of a park before anyone's up here is Champion a park in our commercial area it's I know you're talking about trading doesn't usually work in such a small area you buy you sell something and buy something else but um it's definitely not the location of our park and then uh the issue with office is is just the the parking the parking requirement but um you now that we have some Direction with the commission and tell me if I'm wrong we'll bring this back as an RFP not limiting it to hotel and um the other cave has all the money whether it's a lease or purchase all the money have to be up front to be immediately reinvested in the area so does would the commission like to see RFP with a parking garage uh meaning the city would retain the whatever it is 36 37 spaces um and the first floor two of the structure or or not that's what I would want you guys what is the like what zoning are we using for this particular lot it's eight but bonus up to 14 I is that what it currently is no that's what that's what the zoning study proposed so so we currently it's very it's four stories currently it's four story yeah and then it goes 8 to 14 8 to 14 under the under uh Mr Alvarez's zoning study okay and does that count does that take into account our Municipal parking uh if you were to require the municipal parking it would be within that envelope if you again there's a lot of ifs if you were to support that you know what the recommendation in the zoning study and okay yeah and sorry two other things regarding the hotel one is used to say if you limited the guest to guest of of South Miami Hospital and um you''ll be booked year round and I said that long before for thesis open look at thesis look at the day to the dayam area they're book solid and we want visitors in our commercial area so the demand is absolutely there you know how the city's growing um we questioned this you know we have an eight room sort of you know vacation rental bed call it bedroom breakfast Things book solid and that's not I mean I know everyone would like to have a you know a more upscale product a quick question if if we're not limiting it to hotel hotel is really the only thing that could potentially also house the and the hotel is no density right that's why that's the only way it could also house the city parking nothing else could right so I don't know if we should include that and take away the restrictions because they really just by de facto restricting it to a hotel I just I don't think that we're in a position to be giving up our parking right now we we are we talk about having a Sur plus of parking but we won't if if even if we follow a smaller percentage of what we are extrapolating on with our zoning changes we won't have enough parking when you remove the people who have monthly parking passes at Sunset Place because they decide hey you know what we're knocking everything down those people are going to go somewhere they're going to come to our parking garage right now we're starting to see it during the week just with the small project of the construction workers and so I say that to to to give that up is is just detrimental to us and and I understand what you're saying by like by doing that you de facto force it to be something else I think whoever's interested in that lot would have to you know what play with that I don't think that that is a spot for any type of affordable Workforce or any of that I think it needs to be something that adds feet on the street there right and the other thing I wanted to add is like we're talking about having cash flow I mean we just did the audit report on finances our our budget is healthy with a healthy Reserve we wanted to pay for the streetscape now we could you know we have the cash for it we have you know we we've done we were catching up to what we said we were going to go do we're doing a good job of managing our money making the Investments and the revenue starting to increase so having this CR crunch of cash we don't necessarily have that now saying that that asset that we do currently have there as the parking lot can you imagine what it's going to look like after we have all the assets around it already being built up it's going to be more valuable even so more so you know and by the way did we talk about if this is an asset that we're going to lease or is this an asset that we want to sell that's optional one of the commissions input but if it's a lease need the money on the right the revenue on the front end to reinvest in the area and then we would need to go back to the residents if it's a lease right because nobody's going to build you know or at least most people wouldn't build with a 50-year lease especially a condo hotel I wouldn't imagine which boxes and in our Sunshine meeting nobody had an issue we discussed this it's on record had an issue selling that that uh parcel all five people in the commission said that well I stated that it it it's the one asset that we could sell in my opinion that it would be okay but it was still preferably to keep it so I've always been of the opinion that we keep our assets okay so where are we at Mr City attorney I I believe after this discussion I've gotten direction to uh well actually I didn't hear this part think you want me to go forward and Order title you want us to do that you want us to take another look at the RFP uh try to uh I guess incentivize front loading the money uh whatever money is put into the deal uh and commit it all for placemaking uh include a parking component on the first floor not limmit the use to a hotel um I didn't hear anything about the alley so that's an open question but well I think that's open to the title right yeah yeah I think maybe that'll be answered by that yeah and then put put in zoning of eight stories plus a bonus up to 14 stories as for the zoning study and then keep both options of lease or sale as open basically as for the proposals okay does that cover everything that we've talked about yes so you're going to you're going to take that and City Commission of the city of South Florida selecting respondents pursuance or request for qualifications RFQ number csm2 24-1 for South City Hall Redevelopment project okay city manager would you have something thank you vice mayor um as you all recall U the city issued an RFQ request for qualifications for redevelopment of this site um we ended up with five respondents um there was a committee that evaluated the proposals the the five respondents were 134 Investments LLC atler Development LLC Integra Solutions LLC RG uh LLC and Sal Michelson Architects Inc um were the proposals uh there was I believe an amendment uh by the salts melson Architects to clarify that son son and blink was the developer um on the on this on their proposal U the committee met and scored and ranked um I took the committee's work and evaluated the the proposals and what's before you is I brought forward all five respondents for your consideration um as you know we intended to decide who uh we would include in the RFP So based on your decision today depending on who you would include there would be an RFP that would be issued and those entities that were approved today would be the ones participating in that RFP um so I brought for you after reviewing the proposals in the committee's work uh felt that all five entities um have the experience and the ability to possibly carry out what we have discussed um as a development of the site and that's what's before you uh today um and based on your direction today I know the attorney uh with staff is will be working on an RFP with uh with a projected date of May 21st uh for an RFP issuance and if that's correct Mr attorney and um so this is before you to consider how many of these firms you want to include I have brought forward all five as a five firms that I believe uh can and and and have demonstrated previous experience to carry out uh such a project okay do we have comments or discussion we want to have on this maybe I'll the city of South Miami for of calling a special election to be held on August 20 2024 for the purpose of submitting to the electric a proposed amendment to subsection D1 requirements for adoption of section c ordinances of Article 2 City Commission of the city Charter as presented in a valid question to require three affirmative votes on the of the city commission to approve the issuance of bonds or borrowing money when such debt is authorized by referendum of the residents of the city and to require four affirmative votes for approval of issuance of bonds or borrowing money when such debt is not authorized by referendum of the residents of the city I I move the item second second everybody second okay considering this is Mayor Fernandez's item do we maybe want to hear from the city attorney give us a little bit of a breakdown so um Madam Vice Mayer the um this is a pretty straightforward um proposal on for a charter Amendment presently the charter requires four votes to borrow any money and then five votes if the borrowing or the bond issuance is more than 5% of the operating Revenue uh so this would change that setup what it's proposing and it would it would basically require uh four votes if there is no uh referendum associated with it if it's not a bond that that a referendum is associated with but if there is a referendum associated with then it's it would only be three votes under that scenario like every other most other resolutions why three versus four where did that number come from is that the norm is I I believe the thought was uh that if if there's a uh if there's a referendum of the public and it's supported by the public then that's essentially 10 amount to that fourth mode and is that the norm I mean in your experience there are different cities have different different requirements it's it's certainly not unheard of yeah I I I'm I I don't know about y'all I'm I'm more comfortable with four out of five because bonds usually are talking about a significant amount of money and I don't know I have time with that what we're saying is that the bond if a bond has has to go to referendum which at that type of scale it would go to referendum then you would need a three- fiz votes after it passes yeah but keeping in mind that I would say you know the referendum and I'm making this up obviously it doesn't exist you know for overall City Landscaping and blah blah blah if then we decided we wanted to spend three4 of that money on two city blocks in my neighborhood because my neighborhood is my favorite place in the whole planet then only three two more people would have to agree with that versus a super majority and that's why I asked what's the norm and it seems like it's all over the place and if what was the other one that we changed from five out of five to four out of five zoning correct yes so for me this is just as important as zoning and it's as a resident a very personal thing because if you're bonding you're you're not bonding it to some random faceless person you're bonding me I'm paying for it you're paying for it you're paying for it he's paying for it I would rather have a super majority than three out of five because we voted yes on a general thing and then we're faced with maybe a runaway train so I mean the way and correct me if I'm wrong uh City attorney but the way that it usually works if it's a a bond issuance it's going to be more than 2% of our budget right we're not going to do a bond for that we we again we see in our budget how healthy it is we can afford that if we are going to do a bond is for something big it's usually classified and and you you talk about specifically where the funds are going it's not it's not usually done I mean that'd be that would be uh not smart to do something like that um I think we've seen not smart happen but even still it still needs to go to the public right so having a three fiz is just you know making sure that we approve what the what the people really want right it has to be a majority for the people and I'm not I'm not look I don't disagree completely with what you're saying I'm just saying it's not that big of a deal like if we're going to go to a bond and the people approve it three fish should be more than enough I mean we do that for anything else and people trust their representation up here to go make the right decisions for them so I mean that's that's my I I tell you I I agree with you in general it's I think this this discussion is is an interesting one I recent history has burned me on three out of five versus four out of five we saw how easily it was to manipulate words to change something from four out of five to three out of five in the direction that that went in that I'll be interested to know uh citizen feedback when they start getting their tickets um but oh by the way we'll get that feedback down too if we put it on the referendum now this this is going for referendum I know and I don't understand why it would be in August versus in general election in November so we don't have to pay extra money that didn't that part that out of all of it was the thing I had the hardest time with I'm sorry there's primaries in in August yeah but I would say we should have it with general election the same way that we went in and said hey we're going to change how we're all you know how you're voting in general in this city it was to move our election to general election so I don't know why this would be different because this is a huge deal yeah I was I was just answering the issue of that there's a separate cost yeah there's there's a there's a primary so we're piggybacking on to that primary so it wouldn't we wouldn't be having our own election if you will so I was just answering that specific point yeah I just I think it needs to go with general election where everybody's showing up that day to vote for whatever it is so even if may text me said he's on the way oh there you go just as an update let's hurry up and vote this item oh no I mean we can talk about it until he gets here so for me the most important thing would be absolutely changing that date because I think it needs to be for everybody all over the place general election guess what and I'll I'll say this and then I'll I'll back off of this and let everybody else talk my mom lives in a smaller City and an election happened she didn't even know she was like what happened and I'm like did you not vote and then she was like I I voted you know absentee she didn't know and guess what like her there's tons of people but nobody's going to be forgetting they're voting for the president so this is an important item and I think if nothing else it needs to be where everybody's going to see it vice mayor did someone else vote for your mother by way of absentee you're so funny thank you yeah right Carmen can can I ask a question to the City attorney so um is there is there a rush for this to get onto the ballot for primary we actually so I believe uh Nikki it's it's may we have to make a decision by May 24th May 24th so this could come back the next meeting if we needed to but I don't think we need I I think we should talk about it and just get keep moving on it this isn't like this isn't if on his face it is what we just said it is we shouldn't have a problem with it right what do you mean hold on tell me no no I was just going to chime in I mean I think commissioner cay was was alluding to this but in essence what you're carrying out is the will of voter when something has gone to the voters you know you're kind of avoiding a train wreck uh to have sort of an extraordinary obstacle that comes back and now the commission actually rejects something that the voters approved so that that's why the concept of a majority obviously um with the four fists is something that did not go the way it's structured four fists is something that did not go to the voters so therefore having a higher threshold right so that's why the difference um and and and certainly a majority is not uncommon to approve something that voters have already approved um so you would be approving ballot language you would be approving projects that come back if if there is an issuance right so each time there's a project You' be approving that so um this commission would not just uh approve what the voters uh voted for and then you don't see it again obviously as each item comes back contracts and certain projects expenditures so I'm just giving background on on on three of versus four yeah the the issue why a simple majority versus versus you know super majority knowing that I think the date is even more important I might not find that as worrying if then we were doing it in November where as representative of everybody okay wait because then we were answering commissioner Kaa had said something on we interrupted you I'm sorry you you yes you I don't know if you were finished but you were done I was finished oh okay I just I I just feel that because the five out of five is something so uniquely restrictive to South Miami and we're liberalizing that um for the sake of being able to get things done and to seeing through the will of the people I just think that if we keep it at the four out of five even after F and we're just creating gridlock and we're just not executing on the mandates we've been given and it's just going to create that much more difficulty to go item by item to do that I believe that was at the heart of what um the mayor was sponsoring here and I agree with them okay I'm sorry you wanted to say something if so I'm going try to unpack this so terms of public interest U if I can just elaborate this because Public's listening so there be one person maybe your ears perked up when you heard Bond or loan as as they should that's the ultimate end goal of this this item it's absolutely it's my opinion five out of five but it's bad I'll say in my opinion it's absolutely bad policy and it should have been changed but we had never discussed the loan before and that's why this is uh that's why this is is coming up now but to for public interest uh the way this reads now is if we were to take out any loan we would need four out of five votes on the commission should that number should that amount of the loan which essentially be a bond exceed 5% of our operating budget which is a nominal amount of money our pry budget is for small city um then would have to go to referendum which means referendum a vote public vote and then we need F uh pardon me 51% or right Beyond 50% then it would come back to the commission and um and at that time it would require five votes right which even know as I Champion reducing five out of five many times you only have to hear yes once but it fail the first couple times um the city was going backwards they required five out of five unanimous vote for any um you know any increase in in density so we're able to reduce that to uh to to four to five now I have many reservations about taking on debt um we all have to be a champion of good policy right an opponent of bad policy and again in my opinion this is absolute bad policy now public understands I think we understand I just want to touch on a couple points that were brought up one is in terms of um uh the vice mayor's concern about it being four to five instead of three out of five take on debt that's a it's a much smaller amount um but so I'm saying that to you but I'm saying to the rest of the commission still a win because you're still reducing five out of five to four out of five and then if it passes on a referendum on a ballot it's you have to go with with the right the majority of the public but to your point we all know why these are on smaller elections right be honest easier to influence smaller budget right because there's a smaller turnout that's why these items appear on on primaries but when you said that it made me think of something if we're going to take out a bond which again is defined by anything more than 5% of our operating budget I think we should put this in the item I believe it should be in a November ballot in a November election because then I believe everyone I know everyone but not everyone has the opportunity to vote could they do but if it's a Republican or Democratic primary you're not of that party you'll still get noticed if there's a local item on it but your chance of voting are a lot less likely if there's one item if we're going to take on debt I and it's that will absolutely impact every taxpayer every resident I think that that should absolutely go in a November ballot I just have one correction vice mayor it only goes to a referendum if it's an obligation Bond if it's a revenue Bond it does not have to go to referendum just make sure we're clear on so an obligation Bond we're going to be a lot higher bases and so people would want to know for the public can you just clarify what each one would be or can we have the City attorney clarify what each one would be yes by Florida law a general obligation Bond requires a referendum of the voters of the residents what is a general obligation Bond it pledges the full faith in credit or the tax revenue of the city so that by law requires voter referendum a revenue bond which pledges certain income or fees that the city has does not require referendum by Florida law and currently revenue bonds right now are still five out of five revenue bonds right now if they exceed the 5% of the operating budget do require five out of five correct and if it's a revenue bond that increases over 5% do we still need uh referendum for that if it's over 5% per the charter for the charer right now no five out of five it's five out of five for any bonds that exceed 5% of the city's current operating budget under the current Charter I was asking if it's a revenue Bond over 5% does it need to go to referendum no revenue bonds do not by law need to go to referendum correct I thought that because of the structure of 5% I thought it goes over we need just verifying just making correct it's a South Miami commission approval specific requirement and just for public interest any general obligation Bond would exceed 5% of the budget that's just sure everyone knows yeah so I I would like to make an amendment that any general obligation Bond referendum would have to be on a a November ballot to incre to um so that way we have maximum participation from the very people that's going impact which are taxpayers I I agree I just don't understand how we would second it sorry sorry I I just don't understand why we would do that that when we just went through another election that we had 15% of the vote for this partic for the city hall referendum like why are we picking and choosing what if if you look at the city hall one it wasn't costing us money it's actually going to help the city right we are not paying it's a matter of debate but but you're asking why this one and not that one this one is going to cost me money out of my pocket what the other one is not going to cost me money out of my pocket it's a net benefit no matter really how you look at it to the resident because there is only a win-win on that property we don't sell it we don't nothing it's it's literally hey let us help help me help you but it's not going to cost you anything and when you are taking something and you're asking a very small population to vote on something that is going to affect your wallet individually your wallet I think that doing it when not everyone is going to vote is it's I I I I don't want to say the wrong word but it's not right to me so commissioner Kai I know you said it's it's Up For Debate I I don't think what I don't think is Up For Debate is public inclusion and public participation and I think many of us will also admit we may not be may not have been on the day as had the election not been in November the reason I championed also many times like reducing five out of five moving the no election to November was for public participation and public engagement it is no debate this is factual highest turnouts November presidential the second highest turnout is a November non-presidential and everyone was was was elected so in order to have maximum participation I'm sure everybody wants that they want as much input from the public because this is the PE these are the people that it's going impact it should be on a November election now it doesn't have to be a presidential um but we should ask for maximum participation when This concerns ultimately it's going to concern raising taxes as we've all you know discussed previously regarding this potential bond issue yeah especially if we're talking about three out of five and four out of five so we're making the change from five out of five to three out of five and four out of five which for some residents could be a big deal and then on top of that we're I think I think that's important even if nothing else is and if we then think that what happened recently wasn't the best way of doing that then we should maybe looking forward consider only putting items that need all Resident participation to November elections but this one in particular I think absolutely when you're touching my wallet I want to know that every single one of us is going to have it before us so and also this is a public hearing as well okay well this is a public public hearing item anybody in the chambers like to make comment seeing no one can anybody on Zoom like to speak on this item please raise your virtual hand okay seeing no one do we close it and then keep moving are you okay with three out of five and four five I think if we make it November I'm I'm more comfortable with that so let's start with that I made a motion I'll do it again make a motion that referendum to take on joural obligation Bond require as you know the process of a RFQ we have five respondents I named the respondence on the record and that this item uh basically had uh what I'm bringing forward is all five firms to be considered by this commission um for further direction as it relates to who would participate in the RFP um so uh at that point uh we left the item tabled and then we went to other items uh to allow uh for you to be here for for this particular item so I have you all discussed this item as well or no no there wasn't I just introduced it and then and then we tabled it and and so the clerk did you circulate the memo I I drafted last night okay so I I mean I I made my thoughts somewhat plain there I I there's there's one firm in the in the batch that I was concerned about their approach and whether it really met our Collective expectations but frankly one one more or less is not all that significant to me I don't want to belabor the point but Mr Mayor we still have plenty of time I know you're tired of speaking because you're coming from another commission meeting but the public didn't receive the memo oh it did not so so essentially you know there's there were five respondents one a slightly different orientation and composition of the team um you know I I just thought it would be who of us maybe to take some time at our next meeting and afford the respondents maybe five minutes to just share their approach with us uh and maybe we could ask a couple of questions decide whether we wanted to advance all five or maybe in my in my estimation consider removing one without getting into detail about what which part of that was if that's not something the commission wants to entertain you think it's worth our time I'm happy to accept the manager's recommendation and just move it forward yes sir um I I would be in favor of that but you know I'm the one who's always stressing urgency so I wouldn't want to delay it so two weeks to that to that point yeah we do have Representatives here so if the commission are you Mr Mayor in favor of it I know they're not no I know I I don't believe all the parties are here so I just wanted to give you know uh again I know that Mr Milo and related are here and others are represented as well I just thought we would just advise everyone and do that again my conversations with City attorney about this yesterday he indicated to me and we can confirm for the record it would not delay our preparation and advancement of the RFP so I didn't think it would cost us any time it's just a matter of deciding whether we want everyone someone won't create delays what uh what's the pleasure of the body I again Madam vice mayor do we think that doing that will shift the needle in a significant way from the top three that we have right now not not at all so no I if if that's not my opinion sorry yeah if that's I mean if we agree that that's not the case I don't know that we should go through that extra step maybe we want to have that five minutes with the top three why don't we do this why don't we just move the manager's recommendation if I can get motion to move the maners recommendation to advance all five respond MO is there a second second you have a motion by commission that all five respondents then give the entire package will be afforded the opportunity to do the RFP yes ma'am can I would you like to modify that I I I actually have a question yes please go ahead not not a modification at at I'm wondering if we something so significant that merits that time not only on the respondent's part but on our part internally because we've had conversations in the past where we've said you know doing certain things will stress our capacity here yes so would is there such a again a dramatic thing that would we think will move the needle so much that we should be asking all five of these companies to then put together a report or what have your proposal that will cost them a significant amount and so I I I'll I'll share my concern I don't want to talk about any one particular party I don't think it's fair for them and they're not here to address the concern so my thought was one one of the proposals was composed in terms of the team slightly differently very well capitalized in terms of their backers seem that they have significant development experience the difference is you know our conversation I think has contemplated a you know um a team that would kind of bring a market driven approach as opposed to a approach that was responsive to uh or more or more more in line with what would be a Civic design build project and I and I got the sense from reading the proposal that that that respondent had more of a uh Civic design build kind of approach to what they hope to execute here um and so I just wanted to make sure for the benefit of their conserving their resources as much as our time that uh that was the right fit but as to the other four I think they're all perfectly well qualified perfectly aligned with what we have been discussing for some time now uh and and I think the other firm is capable of possibly meeting what is more of a market driven approach uh it's just not the way that their their proposal was necessarily perfectly expressed if I'm if I'm trying to be a little bit Artful and diplomatic in my presentation or comments so so I I again I'm I'm fine with the motion that's been moved uh I don't think one way or the other it's going to make uh that much of a difference and and certainly they will get the RFB and can respond uh accordingly uh I I thought they were qualified will capitalize it was just a question of the approach was it was it align with our our vision as I'm trying yes commissioner leave in no problem sorry so again coming from a place of urgency but not rushed um and I I say that because this has to be right this process needs to be completed in October um will five applications right delay the process I I don't think so sir I think I think my my opinion I'll defer to the manager but Mr manager's he's recommended all five I'm assuming we feel we have the outside support and resources necessary to quickly evaluate uh all of the respond is whether it's four or five yeah I don't it's my opinion is that that um three to 5 and that Delta is not going to extend this process um um obviously it's you know that would be whether it's four or three uh one or two more proposals to review but I I I don't think that that'll extend our our process um you know it just gives us some additional death um that that um U May benefit us um having you know five firms participating I I shared in the in the mayor's uh comments in in in my review and and and looking at I know that the uh originally I was as it was pitched I mentioned earlier that the the architectural firm was listed as the firm doing you know submitting The Proposal that was amended uh recently and and that and they identified who the developer was so I felt comfortable that that all you should see all five um because I think you know collectively individually they they have the world law to to be able to at least participate in an RFP it'll be their their decision once the p is out if they want to participate they're not required to participate which you know that could happen we could have somebody decide not to participate yes Madam vice mayor you're recognized thank you I just have a question for you because I don't know this is not something I've ever done before so I'm not familiar enough is that usual is it usual when you have five respondents to ask all five of them to come back for RFP it's it's all over the board I mean it really depends you may have things that are that you have 10 respondents and and you take five of 10 uh you may have five and you take three it really depends on uh each individual responding and whether they're responsive and responsible okay so so yeah would I'd say that this magnitude of a project to have five firms competing is is is maybe um out of whack no I I don't I don't feel that way would it give us some additional um legs if you will to have five firms you know giving their ideas I I I do believe that um if I'm one of the firms i' rather have less firms I I I fully acknowledge that right uh better ratio but I but I think we may be better served um unless we feel comfortable in deciding that a one of the firms is just not uh does not bring you know the skill set and experience and capital that we think would serve us well I don't feel that way that's why I brought all five forward under section 20-8 point9 of the city's Land Development code the resolution for the development agreement is a legislative or at best a quasi legislative item it is nevertheless a public hearing um under the code in an abundance of caution in order to afford the most due process possible to all parties and without waving the city's position that the resolution on development agreement is in fact legislative in nature the city will frame tonight's discussion within the city's quasa judicial procedures with respect to uh um hearing from the applicant hearing from members of the public um and deliberating on the decision the commission may ask any questions either before or after public comment is closed following public comment the commission may deliberate on the resolution as they would on any other legislative item anyone who seeks to speak on this item uh should be given an opportunity to speak during the public comment portion of each hearing uh of this hearing if you intend to some water almost there Madam clerk Madam clerk uh can you confirm uh compliance with the notice requirements for this evening's hearing yes thank you madam Clerk now mayor vice mayor and Commissioners have any of you had any expart Communications with the applicant or any member of the public either for or against this application uh this this request commission leben no uh Madam vice mayor no commission Cory no and commission k no since the last time we spoke originally then I have to disclose I'm the only person who had communication it was on one of the provisions of the development agreement I believe we met last Tuesday Monday I can't remember thereabouts discussed uh I think one of the taxation issues that was a lingering comment on the draft agreement okay and and at the risk of being longwinded just a quick summary of will not impair my ability oh sorry it will not impair your ability to make a decision on the matter wonderful thank you may here um so just a brief recap of where we are this was really heard uh by this Commission on November 7th 2023 it was implementing a project approval from October of uh of La last year um just a brief recap of what's in the development agreement as before it ties the property development to a specific appr approved plans it includes uh number of conditions including specific architectural conditions that you all had had imposed at your um October hearing uh fully enclosing the loading zone and covering the the loading aprons and then revising the garage facade on 67 Avenue to provide similar design pattern it also includes other other uh uh Provisions that um the applicant had proposed providing for a job fair uh providing for Open Spaces to be uh always open to the public parking for 183 uh spaces provided for a development schedule as of right now I think it's it's good to knowe that they are ahead of that schedule um and then what has been added since since that time uh section 2.5 taxation which you mentioned mayor um that clarifies the property and the project is not tax exempt and should an exemption arise in the future the property owner uh would voluntarily make a contribution over the over uh the three years that that that are after that 75% of what their tax liability would have been in year 1 50% in year two and 25% in year three and then finally uh the other change this minor change section 6.1 uh is about the ability to cure if there's a a moment of default the lender had asked that they be afforded an opportunity to cure so we we included that in there great thank you for that summary um in the in the interest of time I think I think we may all be very clear we want to uh on the on the Adam today so um thank you for coming forward if we have some questions uh without objection we'll direct them to you that's okay correct thank you commissioner lean just on the clarification I know that you had specific concerns about the change in taxable status so what we've attempted to do with the modification that we discussed privately was land the plane so that we could actually have a soft Landing uh if in fact there was an adverse determination from the city's perspective we would ramp down their contribution get them back to a baseline of zero but at least over a term of a year so we could budget uh accordingly that the mayor was a pilot in his prior like exactly you're I'm I'm ready you ready okay uh any further questions comments thank you by the way can we have a motion then I'm sorry we have to have a this is a public hearing item correct okay so this is a public hearing item you have a question one question yes please go ahead man um now that you're the one that had the discussion are you comfortable with that ramping down as it relates to the Baptist Health overall discussion on the tax exempt and the partnership in the city because I know that at some point there had been a discussion on that and I don't know if we want to defer this and have that discussion or if everybody's now comfortable with that the way that it is do do you remember what I'm talking about yeah no we did and that's why when when I was advised this was coming back we arranged to sit down to talk about this to make sure that there was an understanding about how we would get them from my perspective the legislators made a determination that their activity is charitable and exempt and so you know they're making an accommodation to us because they could have certainly taken the hard position of saying if we have if there's a change in our taxable determination we want to pay zero the first year we get that determination this provides us a ramp an off-ramp so that we can budget accordingly to slowly weed off the revenues that they had been providing and get back to they can get back to a baseline of zero so you're happy with this I I am thrilled with this and I want to thank M morero and Baptist for the accommodation because all I had was wait I know something about no no it's I think it is a win for us and again it it speaks again to the quality of partner we have in in Baptist Health Systems in our community okay thank you you again to bapti I'm Happ not that was that was an excellent present in us okay uh if we can read item 12 please as I know we have uh folks here in the audience item 12 in ordinance of the May City Commission of the city of Soph FL amending section 4-6 definition hours of operation of chapter 4 alcoholic beverages of the city code of ordance to allow issuance of reval permit for extended service hour for alcoholic beverages our premises thank you for that uh Madam clerk um since this is myam Al do a very brief introduction you all recall that we were had been concerned about some of the reports we were getting about alcoholic beverage Services some of our late night establishments here in South Miami uh over the course of uh the intervening months uh we've seen a mark change in that activity uh in after consultation with the chief and the city manager in terms of code enforcement and calls for service uh the calls have have been uh di Minimus I think in the interim and so with that I wanted to uh allow the two uh establishments BTS and boogies to possibly reclaim one of their service hours for alcohol till 5:00 a.m. subject to conditions and the ability for us to uh revoke that uh that privilege again without any statutory Jeopardy and so that is essentially the ordinance that's before us today um and that is uh the best summary I can give you of The Proposal Mr City attorney did I miss anything okay uh any question questions I can answer for my colleagues here okay so we had a motion and it went through the commission how many months ago can you uh clarify that Mr City attorney nine months ago maybe longer no maybe yeah like eight seven eight months ago okay yeah so now we want to move it back an hour well let me clarify that this is not this is not moving it the whole thing back gives them the opportunity to request the FL it's like a permit process and it's a revoke it's fully revocable if if the uh I guess the the good behavior doesn't continue um and it's it with it's like a month permit that's all you get and it's fully revokable so we have to they have to apply for this every month uh no it can be extended they don't have to necessarily apply for it every month but if it gets revoked they would have to reapply okay some period of time so they would apply and then it would just ride until if or when something happened it would be subject to revocation but the extensions could happen administratively they would have to come back to us for approval correct so again the the idea here was you know we are limited and how we can respond to these conditions based on changes by the legislature but we we recognize that there's been you know better better Behavior not by The Operators I mean often patrons are the ones that get out of hand but certainly the Confluence of alcohol and and patrons uh often don't mix and so uh this is an attempt to help you know restore the business's operating hours within limits uh and uh and make sure it's it's it's it would be the equivalent of what I would call a conditional use approval on May beach for their bars and restaurants where they're always subject to the jurisdiction of the board for revocation if there are nuisance complaints and so uh given that that's been the history on occasion with a couple of these establishments that operated later into the early morning I I'm comfortable going back to 5:00 a. there's I'm not comfortable going back to 7: a.m because of the conflicts that that creates for some of the neighboring businesses and again as part of our due diligence uh the chief and the city manager did consult with some of the other are businesses including the general manager at uh Dilly Lane that had been most impacted I would say before and the report we got back was positive so I wanted to share that by way of information for all of you as well okay that's awesome so uh that's the proposal yes sir you're recognized sorry thank you mayor I'm going to support you on this item I appreciate you bringing this forward initially and um all also bringing it back but that said I just want us to be cognizant in the demographic we're looking to attract that reflects on our city just like everything else and in addition no one can tell unless they've know me for a while you know as spokesperson for the endurance Community yeah we to be very careful of what percentage of people are drinking or just hanging out I wake up before that time but um yeah yeah he does has five but how many that's when the runners and cyclists around the street Wen purging putting people on that street it's at the same time when people are getting out as opposed to an hour before look I I I'm voting for it I I recognize I mean I used to used to a long time ago get up at 3:30 in the morning for those 20 MERS you know um and live those conflicts in the Grove in particular and so you know recognize Champion recognize the risk but I think um I also don't you know to my colleagues concerns to the left I'm not in the business of targeting businesses right and so I thought this was a good accommodation of look I'm going to get a hug and everything today wow uh I thought this was a good accommodation given the response and so this is a good faith effort to get them back to their prior operating conditions uh again but subject to our ability to revoke like to do a brief introduction on the item um yeah so we had the commissioner Regal here earlier today she gave a great presentation um she's been championing a lot of the uh boards across the county on really bringing awareness to um this this specific demographic so one of the things that we struggled and I know we struggled trying to get some boards but I think this would be a good opportunity to really start getting more feedback from different folks um and uh I think this it's just a board I really want to sponsor and and uh I think it'll do for the better good thank you for that s are there any questions at the sponsor no um no questions anyone like to make any comment related to the item I we kind of did when when commissioner was here okay great I apologize for missing that presentation uh if there's a motion we'll entertain one pardon me yes sir C attorney like to add uh line 71 and 72 the composition of the board we were not sure where to take that we have that blank right now of five members uh do we do we want to have any qualifications are these are these m MERS residents of the city just right there's no me yeah I mean I don't want to specify that I mean we can look at that but I mean it's not not my opinion to go ahead and make that type of determination I think it'll limit the amount of people that we can put on there anyway so we're struggling with that so I might as well they yes sir you're sorry yeah actually there there's two things I want to suggest and I'm not trying to limit the board but maybe one seat should be a social worker psychologist psychiatrist just one of the five I don't know but you think that idea and then I'm open to it and then I don't know what the commission thinks I don't think I'm I'd be supportive of that yeah your board at all just one seat and we U we have a lot of Architects in the city and we have a lot of social workers and psychologists we know that from going door too and when I went door to door all the Architects were home 2011 but um uh the other thing is um what I was going to suggest in the in the last meeting regarding the board that commissioner Cory was champion and I think away a lot of other commissions Act is I believe if it's either your you know board you're passionate about which in this case commissioner Kai you're champion this commissioner Corey in the previous meeting you championed another board or restructuring that board I think that we should be assigned to that board and be assigned to attend those board meetings and then should there a recap um and should there be something to share with the commission the community bring that back to the uh the commission that's the way larger commissions function there's there's committees that you're assigned to I think we should take especially considering that because your baby commissioner Kai you should be the steward of this committee attend the meetings give a recap to the commission and so forth is oh I would say that I'm going to say no to that we we we're part-time we have businesses to run there's a lot of I mean that there's a lot of boards that we want to attend and understand what's going on I would love to Champion as much as I can and attend every single meeting if I can but I'm not going to promise that it's just I don't have the bandw to do that to be specific but I will I will champion and move it forward as much the best of my ability and in terms of the an amendment in terms of requiring one person to be a social so so the I think if the sponsor would like to make a motion to approve and if we get a second we can then ask him if he willing to accept the amendment as a friendly Amendment okay so is would you like to make a motion to approve the adoption of the ordinance with the amendment or no we can make it with the amendment that's fine okay so so uh the motion is to adopt the ordinance with the amendment that we have once uh that would be filled by a social please item 11 an ordinance of the mayor and City Commission of the city of South Florida comprehensively amending the city code and Land Development code to restructure the development approval process and the role of the environmental review and preservation board including renaming the board and amending its composition powers and duties and procedures thank you for that summary um Madam vice mayor this is your item would you like to introduce it sure um when I was actually watching an the Erb meeting I started seeing and while I was on the planning board I started seeing that the Erb seemed to be going out of sync with the rest of what we were doing as a city they ended up being after the commission so if we approved something they then could go back and change it up and that didn't make sense to me because if you're looking at city government we should be the top of the pyramid not the middle of the pyramid and then when I started looking into it I saw that for whatever reason um with the passing of time the Erb had kind of restructured itself based on what they thought they should be doing what they want wanted to do not what was the role of the Erb and so with the help of our city attorneys we've restructured it so that it fits in with the process that we should have in the timeline that we should have and for them to go back to what the intent of the board is to do design review and so that is what you have before you a it's been a long road but thankful to our city attorneys for managing that thank you very much thank you mam vice mayor for the introduction and for your work on the item do we have any questions of um the vice mayor uh you recognized commissioner G thank you mayor what any questions or any feedback from the from the planning board or the Erb themselves did we get any feedback Yes Yes actually uh so both boards actually had had robust discussions about this they were both actually very supportive these changes they had some suggestions that I'll I'll go over with you guys uh first the planning board the planning board uh suggestions are reflected in the ordinance that's before you in exhibit B it's in the Shaded boxes um but specifically it was to require uh a full zoning review before it ever gets to the Erb uh so that it starts the process right on the right foot okay uh the planning board had also suggested modifying the name of the board from Dr AB to just drb I thought it was to move the B from the last letter to the first letter all right with that I'm out of here that's it no I cannot with you so uh the Erb this morning again had a very robust discussion they were um I really thank them for for giving that that level of input um their the proposals that they had uh had to do with renaming you know calling the board the Architectural Review Board ARB that's so that's their suggestion um the they had a couple of other thoughts okay they agreed with having a robust zoning review before it ever gets to them um they wanted to add some criteria regarding uh utilities and utilities coordination so that they see it on the front end not not only you know I believe mayor has has a proposal to to put it on the back end which we'll hear about in a moment but um they were they were supportive of doing that on the front end uh for their so that they could benefit from that review um their concern with having the step on the back end um was this is what basically a couple of the architect said the the utilities are going to do what they're going to do right so it it it becomes very difficult to actually push back on them at that level at that point so they really that's why they were so interested in having it on the front end as early in the process as possible um and then let's see they wanted a um a signed they suggested to include a required affirmation from the applicant basically that the applica that the application include a sign statement that the applicant understands that just because they get it approved doesn't say doesn't mean that they they don't have to follow like if somebody missed something they're still responsible for meeting zoning prior to permit so a standard zoning disclaimer basically zoning Conformity disclaimer exactly exactly and then I believe there was those were the the big issues oh the other big issue the composition of the board the way it's been proposed seven members uh who reside or work in the city um the five would be appointed by the commission another two would be by by three votes of the commission and then we had a list and all all seven would come from that list they suggested and and they they uh they said that they have benefited from having lay people speak on that board they suggested having at least um uh you know two or three members from the from the general public and then the the others be Architects Landscape Architects and civil engineers specifically that's what they were in favor of so any any questions to the City attorney uh regarding the feedback yes yes Madam vice mayor I I think I'll start backwards um with trying to force certain seats onto there I think we're going to find ourselves having a problem because we might not have all of that at our disposal I think maybe a better way to tackle that if I'm not mistaken is our our building and Zoning departments have those capacities or we should in some way shape or form have that I think that when it comes to anything other than what that board is supposed to be doing which is design it needs to be something that goes to people that are paid by the city to be responsible for that when we remove the responsibility and hand it to a person as well-intentioned as they may be that is in a volunteer capacity we may confuse the applicant on what exactly they need to follow and they need to follow what building and Zoning or saying that's why they're there that's why they get paid the big bucks right so Madam vice mayor so I just want to understand what you're saying so your your position is that it should be staff that comprises the the committee I'm saying that if we find those people that's great but if we don't it should absolutely be a responsibility that building and Zoning is responsible for it shouldn't negate that responsibility like when you're saying you have you know an engineer or this or that I imagine that we must have that capacity in one way or another in our own building and zoning department yes so I I I I think I understand what you're saying I think what what the probably what I what I gathered from the city attorney's comments was that the Erb had had said you know we are volunteers essentially we do the best job we can reviewing these applications but a full zoning review and staff review should happen before it gets to us absolutely so that it's gone through that filter that's not what I'm talking about okay so but you're saying you're saying if we are unable to fill those seeds that it should be something that our staff substitutes for those me for those for those volunteer members if if our staff is responsible for looking out of at all of it before it gets to them yeah they should be able to say if we have a civil engineer if we have this that's great but we don't have to force those seats on there you know like some like on another board and I I for the life of me I I can't remember which one it says there has to be a person that's between this age and that age and they have to have you know experienced whatever circumstance so it's such a precise thing that I'm like as a city if we can find those and have them on the board that's great so and let just let me just kind of give you I I just completed one of these processes this evening after 21 months so I mean the way it works in that other jurisdiction is that there is a des um design Review Committee which is Staff it's a staff analysis right basically that preliminary zoning review with all the requisite disciplines and Miss caber used to work there so she could probably articulate this process better than I can and then it moves on to the volunteer boards right whether it's a board of Architects or a planning board or historic preservation board depending on the nature of the application so staff does inial intake gives the feedback and that informs the subsequent uh volunteer reviews I would tell you that from for money I think this should be a volunteer Board of design professionals and a com at least two lay people I think the lay people aspect given the board is not strictly an architectural board it's bit softer than what You' see in Coral Gables with a board of licensed Architects and Landscape Architects uh would be the right way to go and I think I think as it was drafted Mr C if you can correct me we have allowed ourselves the flexibility to bring people from outside the community to serve on the board to the extent we can't find a qualified City resident is that is that accurate uh yes yes correct but but they were but all members were supposed to fall into one of these categories I I would be in the camp we had this conversation when I wasn't it wasn't sure I was going to be able to get back here in time that my my preference would be to modify the language to clarify that not less than two members should be lay people not and maybe not more than three right Lay Laid people people who are not required to meet the professional qualifications that are that are listed I think two lay people add uh a common sense element to the conversation but I think we need to have it B you know the balance tip tip tip more in favor of the design and and it promotes inclusion right correct I'm a resident I want to be involved be an architect or engineer correct I agree so then I I think we're all saying kind of the same thing we are I think yeah yeah and we don't want to make it too hard knows to fill an open seat have a comment no yeah I I mean I don't completely agree with what what we're saying there I think that we wanted to the intent was for me anyway to be professional with this particular board there's volunteer boards that we have throughout the city that people can apply to if they want to help one way or another I think this particular board was intended to be a little bit well that's my thought process when we first passed this was to be a lot more professional um we've struggled but we have to put a little bit more effort and time into makeing sure that that can happen so we can get that you know um and that's on staff as well and the rest of the Comm community that we can Pro do this correctly the right way of doing it in my opinion is to have a full professional staff but if it's the nature of the commission to do that then you know that's fine too but that wasn't my intent I would say you look I'm not if it if it ended up like a board of Architects you know that are City residents and Vol or volunteers that work in the city like is the case in Coral Gables I I'm not opposed to that outcome to your point but I think maybe just allowing for the opportunity May me saying that not less than five of the seven have to be profession if it's all seven so be it there's not any lay lay member interest but at least allowing for the opportunity I think would be would certainly meet my my goals like I I'm often concerned that people who are run-of-the-mill citizens are very concerned about what's happening uh regarding the built environment and don't feel that they get an early window into projects and it does provide someone off the street kind of that that opportunity and and hopefully build confidence in the processes that we've set up that people have to follow so I just have one more [Music] question if we found ourselves unable to fill that for whatever reason and I'm I'm making this up and this board ended up with three people on it I think we need to that's not Co have it wouldn't have a CO no no I'm just saying three people to say something it doesn't end up with what we're imagining I don't know if we want to be able to have a a mechanism in place where it notifies us or notifies our director and then we have to kind of take a look at that so I I think that maybe some direction we should give after we move the item in one fashion or another is to the the manager to kind of maybe think about how we can set up some Outreach to Residents to identify candidates that have the skill sets to encourage them to apply so miss Caba did you want to address that hi there good evening development services director so we actually went through the same problem with the board of Architects and Coral Gables um there's always the question of do you have enough people that want to be there to volunteer every single week and the board meetings there for the board of Architects take pretty much all day so it was very difficult and a lot of people the people that are there like that other people don't get appointed because it is prestigious to serve on a board like that and we actually went out and did a mail out uh asking we we got a list of Architects that were registered in the City of Coral Gable since they had to be residents or have their business there and we actually reached out to all of them and asked them if they could please submit their portfolio we gave a QR code and all that and we got a tremendous amount of uh interest in that fashion you just have to really really put it out there you have to like do a mass mail out find out who lives in the city because the the the what I always heard in cables was oh we don't have enough we don't have enough Architects that live here work here we don't have enough to and it turns out that you know you can you can if you go out there and it's not just that if you happen to know a commissioner and you get no I mean we actually went out and mailed to everybody that we saw that had an address in Coral Gables and I will tell you there is a um if you have a design review board even in cor Gables we had always the issue that if you have an architect that doesn't do building bus why are they telling me what to do on my building and all that so having professionals on the board I think goes a very long way because it's tough for an architect to get design recommendations from somebody who's not an architect you know I mean opinion is one thing and you know another one is a design recommendation so I think you should definitely have a majority of professional to to your point it's tough even when it is a professional critiquing another professional so having lived that experience number of times so you know Mr Mr W and I know the better than to present in front of a board of Architects on behalf of a client you let the architect do the work so anyhow uh further questions or comments where do we land uh Madame vice mayor uh how would you like to move the item as presented or with the modifications I wonder like what what would the modifications end up being because I I think what we landed on right now is probably the only change that I think would be beneficial based on what we said and the feedback that we got if I could if I could um suggest how you would fashion the motion would be to approve with a modification that not less than five of the seven members be uh credential professionals from any of the categories listed in whatever the appropriate section is okay and then internally we will follow it up with if we do not have that if we if we have problems meeting Quorum requirements or getting the committee staff will rely on the manager and his design to kind of keep us a breast of of whatever challenges they're encountering but I think we we definitely need to follow the example of what they did in Coral Gables and proactively go out you know check who's licensed in the city and invite them to apply maybe who may have a BTR or you know register of the city for this particular discipline and encourage them to apply and then you know shake the trees a very nice invitation telling them how prestigious it was and how we wanted to see their portfolios and it it should be a lot easier here because we don't have weekly meeting it's very short the meeting's an hour an hour and a half we allow them to do it by Zoom so I mean we got to test the waters and see what's out there really I I love the idea thank you vice mayor is going to do head and WR letters again I'll when I went I say it again when I went door to door in 2011 all the Architects were home have a lot of Architects here I have one last question for the City attorney I don't want to extend the meeting any longer since I delayed it by not being here earlier um with there respect the feedback from the rpb about a backend review they they did not believe it was useful I one of the colleagues one of the questions I had of the C attorney when I reviewed the proposal was you know often from conceptual to construction documents you've then done all of your kind of utilities coordination work and often times if there's not a followup review from design professionals the tendency is to put the stuff right on the street uh and I and I would note by an example what the thing that caught my eye as I was driving around the city other day was uh the condition of a transformer box that's been cited on the southwest corner of the Avalon Bay project site right up against the sidewalk and My Hope was always that that would be inside a utility room a vault room as opposed to on the street and so I I I just wonder would it be wise for us to have a backend requirement not to revisit the architectural design of the building or the density or the program but just strictly to look at these utility coordination issues that maybe have been involved as the design has insured and you know try to encourage them to be make sure that they've been done in the most sensitive fashion to is that The Pedestrian experience is that something we would want to task our department with versus the design review board I I think this is just for large scale projects I'm not proposing this for single family projects but which which one or I think I I would want to rely because we've had such a limited experience with development this community recently I would want to rely at least initially very heavily on the board to help with that work because they have the most experience not that our staff is incapable but I think they have probably seen less you know less volume comparatively to Coral Gable's professional professional staff at this juncture maybe over time we would modify it and and bring it back to staff but I think at least initially I'd feel more comfortable if we incorporated the perspective of some licensed professionals well I think we got to remember the importance of the design review boards versus what staff does staff does based strictly on ones and zeros it's based on requirements statutes and that's their job the review boards that's what they would look at they would look at that and by the way I kind of want to question that because if I remember correctly we were very specific on where the placement of that was so maybe we can look at that but that's a side note but I agree with you mayor Madam director I need to check our zoning code but it would be something that could be added to the zoning code that as much as possible anything that doesn't have to be like sometimes certain things have to be out where they could see them like the backf prenter for fire has to be where they could see it but that it will be screened at least with Landscaping as much as possible or we'll be out of like the view from the public right away of like I love or something like that we could look to see if our zoning code has it if it doesn't then we could address it there which would put it right up in front and center for the architect and put the responsibility on them to make sure that they're complying with our code I think we should do that if we don't have that direction of the code today but I think also I just thought it would be wise to have more eyes on the larger projects for those kind of details because they do detract if it's not well if it's not well articulated well landscaped you know well placed it can substantially detract from the quality of The Pedestrian experience and so you can have a beautifully tall building but if you're seeing Transformer boxes and you know back a house you know on substantial segments of the street it's just not it's not quite as inviting so that was my only other uh but if if the again I I'll r i mean I'll defer the rpb if they didn't think that review was worthwhile Madam director if you don't think that review on the back end for coordination would be worthwhile I'm happy to abandon the idea it would really only be for the larger projects people reviewing for the board of Architects I'm fine either way so if it was to go to to a larger project where would you want to draw the threshold we we currently draw a threshold for large scale
