one Hur and puppy so I appreciate everyone's flexibility this evening uh all right why don't we take a look let's see Jessica and I attended uh an in-person meeting of the PIR value Planning Commission just a couple weeks back uh I would say the overall theme uh revolved around we're going to call it the Effectiveness um of planning strategy and the allocation of funds for these purposes how it Ripples reverberates and creates growth and opportunity in the community and if Mrs thoron wishes to say anything further about that she's welcome to do so hear nothing all right uh I did uh attend uh meeting um with the folks uh from Verizon in Bon Wilson alongside Mr Spa to explore and clarify some of their thoughts um regarding the proposed settlement option um over at Feeding Hills Road um we have yet to uh if we conclude that discussion there's a few questions that Town Council has related to that item I met with Joe walls last week uh as a bit of a followup to his meeting with the planning board um and where we left off he was exploring a couple of different ideas trying to figure out okay can I move uh the residential units into some of the other buildings on site understanding that the residential component was important um in the rendering of that original decision uh he's still exploring a couple of different ideas um but one of the ideas that I think he might run by the planning board would be uh the construction of a standalone Residential Building um in rear acreage of the property so we'll see what comes back uh on that um U and what his thoughts are I also met with Dan and Nancy kotowitz last week they run the Shaker Farms uh Earth excavation area north of Tilcon parcel on Hudson Drive um I think they're looking to optimize if you will uh some grading out there some excavation opportunities uh I let them know that I think their best path forward would be to start uh with a renewal of their permit and to do this uh this fall and um and then come in with a modification so we can look at those areas and and look at a little bit greater detail uh I've also had a bit of Correspondence um going back and forth related to Noble Ste planning board members may recall that I'm scheduled uh to be meeting with Mr salt marsh and Randy Brown as we work to develop um a schedule of values for the remaining work out there uh essentially we are reevaluating the um the bond that's uh held in the project U so we're going to be digging deeper into that on November 12th uh but more as well as pressing to the over the past couple weeks has been a question about where drain was run near a tree uh he agreed to remove a tree um there's a question about a basin that's may not entirely be within an easement area that was raised by a homeowner um this is all moving on our feet but I think the planning board members understand that um a lot of clarity on this comes from the asil plan and uh that gets produced and uh if there's something we can do in the interim uh if there uh if there's some survey data that indicates it being in the wrong position well then we can try to um get that correction implemented uh sooner uh he's also installing sidewalks right now um and in a section of the road that I would say is a little bit tricky if you the town's standard sidewalk detail essentially drains the sidewalks and the tree belt into the roadway and so uh that scenario when you have a house that Lies Beneath the grade um of the roadway means that you know your front yard is going to be sloping down so he's got some uh I guess a coordination work to do with homeowners out there uh but we'll be reporting more on that um certainly at the next meeting that's about all I have to say about that all right uh 705 public what how to go forward yeah I think so Mark if you have a some en you want to share with the board well I have a landscape supply and the property now which you know keep supplies in there and this gentleman here would like to do a Power coding business out of the building okay um should be over the Wellhead and so uh we just need to check what do you know what the special permit have you looked at the special permit language for what the okay so we have to look at what the special permit allows um for it doesn't mean that it it it you know you wouldn't be able to run your business there as well it's just a question of whether the permit needs to be modified in any way to allow for your particular business uh to be run there um you know at a minimum that is over the well head um there are going to be precautions for that and we have to sort of figure out you know what exactly is being done and know what protections need to be done for that yeah with this process it would be all indoors everything will be contained uh so there's there's the media that's being used is a blast material it's in a cont u in a in a booth or yeah blast cabinet so everything it's got Hep filters and everything so the media contain the matter SP and then for the powder coating itself there is a i there's a dust collector that collects all the dust that'll be generated during the application and then the other thing is there's there's an oven involved so your powder coat the the component and it goes right into an oven so everything would be contained into the building itself so nothing outside of the building will be Expos the materials won't be exposed to the outside um I did look into the powder itself that the there was the MSD sheet it says it's not classified as hazards to the equatic environment So based on the well concern that you had would you call it the the so if there was any sort of it did state that okay so my um my guest so will will look into it more and figure out exactly the process the process is likely to um submit an application for modification to the special permit you know my suggestion would be to add on that use to the use that's there right assuming the use is sort of for for storage or for landscaping whatever the usage is so that you can retain that later on if you choose to continue that use there um you may want to add that use into it into the modification and you know so you'd have to do an application for that um you can reach out to the town planner they can walk you through um that that process um but let's just first confirm that what you know that that is the right process that is likely what you're going to have to do given that you know it's it's a bit of a distinction between the types of uses um and just to make sure that there's Protections in place but um that would be the process it's pretty straightforward um you know there's nothing that jumps out to me at least that is I've been few of these places customers and they're they're all self-contained and they're they're pretty pretty neat yeah so I mean it's not you know there's not U issues with needing oil separators or anything like that into the into the property that kind of stuff so um so we'll be in you know I'll have uh John has your information so he can reach out let you know um what the permit says now what you may need to do and then sort of walk you through that process um it's usually you know you have to application comes in it's got to put on for a hearing um takes you have to have a advertising for a couple weeks so it takes you know probably a a month to get it on for a hearing and finish okay that's in something you know unique popping up but it doesn't sound like there's anything that's going to pop up okay all right and address if you Ken iglon 141 Kuman road southw so what do you got for us um well as I'm supposed to do according to the Border conditions or whatever procedural thing I'm supposed to come forward to you um somewhere around uh the end of the season after uh after the Marina season is over to talk about how uh how everything on the property had gone um the restaurant didn't open up until mid June and U they're still in a big learning curve so um all I can say is that they're still a tenant and uh and they're going to they're going to keep trying they're going to keep going they're going to make a lot of changes uh the marina was fine this year again it was the second year um uh the this year last year I was able to rent 18 slips to the two closest to destroy line I was not able to rent this year I was only able to rent 17 um I don't know if the water well was lower or whatever or the weeds were were bigger um and uh should somebody took over one of the one of the spots and literally jumped out of his boat every time jumped into his boat whatever uh there were no Comm uh mechanical problems with either one the properties everything was working fine the parking for the restaurant um had two overcrowded times uh Fourth of July being one of them July the 20th when they had a band was another uh when cars were parked on Beach Road on the on the tree belt of Kuman Road and that type of thing um the the police were called out the police came and told everybody they'd be ticketed if they didn't move their cars um I spoke with Chief uh banish and got history a little bit nobody was ticketed on Fourth of July there was one person ticketed on um on the weekend of July 20th maybe the person could find the person or whatever but they they never moved their cars but there were never any other times that there were problems um we internally um there were problems which I I plan to correct or try to correct there was an overflow of the restaurant Parkers into the 10 specified uh Marina spots and uh I got several phone calls from my renters about that and next year we're going to have a a sticker to put on the car so that they can identify and the restaurant people can identify Who belongs there who doesn't belong there and immediately have tell that person they've got to move and for whatever reason um [Music] um oh along the ticketed area was on Beach Road in front of my property and I want I spoke with uh with both Ry Brown today and I spoke with uh with Chief Bish as well there is a this is this is what the parking lot looks like this is Beach Road I'm sorry okay all right there are no signs saying no parking anywhere along this area um I grabbed right so nowhere along this area when they come out of my parking lot out this way right here because they don't find any parking inside of here and they come out here the only way they can go is right because big oneway sign right here they've been parking right along here there are no signs along here that say no parking there is a sign and I have pictures with him there is a sign here right at the property line of the neighbor pering that says no parking there is a sign further back that says no parking here to the end of the road and there's another sign there it says no parking then you get back into the area of the um of the town beach so I asked today who would be responsible and if it was possible to put some no parking signs along this this stretch of thing because you know I'm not a legal person by any means but nowhere does it say to anybody coming out of here would never know there's no parking there is there anything that prevents you from putting that's what I'm I'm I threw all that out to both the police and the the um and the DPW today um well this is this is a picture here this is pretty poor but I little great I'm I'm at the beginning of the coming from the beach and there is one sign here and it says no parking here to Corner that's all the way back at from the end of the beach area I mean way back here then there's another sign right after that sign that says no parking and another one that says no parking but it's only like right there in those areas I go to the next like here is a sign that's at the house before me and there's no more signs until you get to there's my there's the property there's a sign right there and the exit coming out of my property is here so they're coming out they don't see any no parking signs if you look all the way along that old fence there are no signs that say no parking now I'm not saying that they should be parking there we know that it's we shouldn't park there but I mean if I was somebody who was ticketed i' I think I'd have case yeah no I mean I so so I'm what I'm saying is in terms of that parking not a huge deal it only happened those two times but if I've got to put some signs up there if I'm able to I don't want to put signs up there that I'm not allowed to that's fair I mean I think at a minimum now at a minimum you could probably put a sign at the exit there that sort of is not sort of like a formal no parking sign but just says you know information no on street parking yeah I me you know just for your for your patrons you may be ticketed if you par on beach roers you know something like that I don't see that being a problem but it's probably better I think if if the if police DW have no problem with putting the fence or whatever I think on the fence be I think two or three because there's probably room for three cars along the fence if they were to park that way maybe four but if you put three signs one at the end one at the beginning one in the middle I think the point will be pretty well made and I'm happy to do that I just need somebody to give me the permission to do it I'm waiting for both Randy and U and vanish to to let me know that um the as I mentioned the marina docks rented the 17 people the the trans transient docks um as you know were were reduced from 20 that you approved to 16 for the select board which is up for review now as well um they they had never full they were never full there were 16 spots over there and never were they ever filled up even on Fourth of July um the the restaurant people tell me that the most that were ever there were eight boats they they kind of I asked them to keep track and I every time I looked and I was there you know I'd see five or three or two but they're saying eight was the most that they ever had there on the whole 16 is that in part at least a product of the restaurants you know not still having a bunch of problems with it this year well even even the busiest day that they had on Fourth of July it wasn't full and I was there that day and I was there when the police told them they'll take to move the cars and all that stuff as well but um yeah it wasn't full in 4th of July either and um um okay that kind of covers the what I think in my opinion that covers what we what the report you kind of wanted to hear about I believe about how the restaurant's doing how how is the uh the marina doing parking problems or concerns before you switch GE let me just see one if the board has any questions I have two things but anybody at the board have any questions for Ken about you what he said or those type of topics well some here park I problem you know whom are you or police or Public Works parking issue on Beach Road yeah I just think a sign should be be helpful I I think this is good information to have I still think it's probably an incomplete snapshot based upon the timing of the opening of the restaurants and also just the as you acknowledge in exactly have the greatest or first reception um and haven't exactly fallen into I think the steam of what we want them to do long term yeah Mr DH um my question was about the July 20th you said that there was a Dand yes and that's what sort of caused the par um is that that didn't need any kind of approvals or anything that was just their your decision to sort of remain there that day well they they had entertainment every weekend okay there was always there was entertainment um I want to think even Thursday nights Thursday Friday Saturday day and night Sunday day and night it's just that um they learned they learned two things from what I understand from talking to Damian um one that they don't need to bring in a $1,500 band it's costing them money and they're not going to get any more PE anymore paying customers so to speak uh brings in maybe the wrong crowd you know was very loud very expensive and it was a band that some bikers wanted to come to you know a lot of strangers following if you will that won't be a problem going forward uh we there are two bands that they they say to me they won't be inviting back was one of those that July 20th it was I don't I don't remember the name of that band but I know that Shovelhead was the other one that is a great band just it's not for it's not for that location it's not it's not for a family type thing um okay and so you attribute it more to the particular band or you know that day more because you were having bands on a regular basis it simply was that particular day that particular band way way too many strange people showed up and then the first one was Fourth of July which busy busy life day yeah and we all knew that we knew that was going to happen the place could have been the worst place in the world to go to and it almost was and they still would be there people would still be there any um anything else on the board you were going to switch topics okay um it may have been it may have been earlier earlier in this year or maybe end of last year I don't recall I was here at a meeting and I I made a a request and the request um was met with a reply saying that you know I needed to go through a lot of certain procedures and you have to put in the paper and do different things let me throw that out again um as I mentioned we could I could only rent 17 out of the 20 slips I'm proposing and asking for for permission to move four rental slips over to the transient slips we don't we're not using these are the rental slips this this right here according to LC should be have three feet of water right here according to these numbers there this is and it's maybe 18 inches maybe so I like to take these four slips that are supposed to be on the rmle things and move them over to here 1 two 3 four it doesn't it doesn't hinder anything because people are still who are renting here are still coming in here and instead of going to the left they're coming to the right and over to here um when people come to the restaurant it's always that they seem to you know go on the end or maybe catch this outside one but most of them are right here anyway so the these are not four that are typically being used by the transing people it would allow me to move to get my 20 rental which on a cash flow basis is important to me um the chapter 91 license has no has no bearing on it in terms of they don't care if all of these were rental this strictly was something that came from the planning board I understand the number 20 is is a fixed number so long as the restaurant is open because it's based upon parking and that thing but here I'm just asking that um um and I and I will mention in addition to that I don't want you to think for a minute that I'm trying to take away transient spaces that the restaurant May someday need in addition to that I will I'm I'm planning to go to the select board and I've already spoken with the Harbor Master and um he concurs with me that um there have been no navigational problems coming out of the Culvert you have to understand this is not here on in in reality this is not here right this this end thing with these two I want to put that back there where where it was originally approved where it was eliminated because they were concerned about a navigation problem coming through um from the covert and want to put this back on here isn't it there um because Lake management didn't want it there and they wouldn't and they were they did as a matter of fact um can remember the word they completely stopped the chapter 91 approval wait so it so then is that not there based on some agreement or some order that is yes from what part of the 9 not part of the chapter 91 no it's part of an agreement relative to the site approval um if you were to [Music] read read the bottom and two that's what was um filed from the S board down the very very bottom oh this was in in settlement of the appeal to they right their their appeal the appeal was actually about things that we had never even discussed they just filed the appeal not even about anything we said yes yes yes or no no no to that's I mean all that not our issue exactly I just want to point out that that to you that my plan is to be able to get this approved so that I'm not going to lose these four spots that I was I was still again have this four spots one two three four if what I mean my initial reaction is TW full one is it probably seems generally fine to me I'm not sure I have a huge personally huge objection to it that said this was such a contested issue that I think it has to have a public hearing about it it has to be a modification to um to the permit right I mean it just it was such an issue about which ones are going to be the rented which ones are going to be the transient where and this I mean so and they wanted these to be the rental and needed to be the trans I understand but you know to be fair to everybody I don't know enough about the the sort of Ingress and erress and all this stuff I just don't and so I it became enough of an issue that I think the request that you have in my mind open but the request that you have to me isn't unreasonable but I think it probably needs to be done through a public hearing process and I thought the same thing that's why when you when you like turned me down and said it needed to go into a public thing the first time I asked I ignored it to this time you know and knew that there was nothing that I could do through the summer without some without another Year's worth of history or something to be able to back it up and discuss it so I mean now we've got from now until May yeah and and and I think I'm I'm picking the perfect time and I'm hoping that we follow the right procedures and hopeing at the same time I'll be able to do something over here you know and maybe everybody will be happy but um yeah and you can talk to John I mean I think it just needs to come in as modification to the special Department um again seems not not all that unreasonable but I would like to hear what Lake management and um Harbor Master and those folks have to say about it just because they didn't observe any problems this summer doesn't mean that if you all of a sudden bump it out another 102 feet that there isn't then going to be that's not not that's that's for Lake management to comment on though if we open up a special permit hearing to and that's what we're looking to change on there is to move slips or extend them further out into the no so no but but it's a it's a I think it brings up a good point which is I think from a order standpoint you should probably deal with the select board first figure out whether that is going to be the way extended the way it is on the site plan once that is sort of set one way or the other then come to us with the requests to modify that and we will know what it's going to exist right and then the other boards can have the opportunity to sort of comment on what's going to actually exist versus doing ours first not knowing whether that's going to be extended or not right it just makes it a little bit cleaner P I'm not sure it's an issue I I don't think it is but it rather than have a discussion and have an unknown that may come back and bite you I think having something okay I mean I don't think one had anything to do with the other I was just trying to be very open about what I was planning to do but that's fine but but here's what I I'm not sure one has anything to do with the other that's what but having sat through all those hearings the idea that someone would say well oh no you're going to try to do this and you're going to try to do this and then they're going to push back on one that you're trying to do because you're trying to do multiple things at the same time and who knows whether it's going to happen to me it's cleaner if we just have this is okay this is done this is what it's going to be it's either going to be there or it's not going to be there then you come here and you say this is what I want to do step one step and they're very separate right and so it doesn't create this so push that that would be my suggestion you can do whatever you wish I'm just that was that's my suggest obviously I got to take you suggestion because if I show up here and want to do you first you're going to say I'm not going to no I'm honestly not going to say that this is more for the push back that you may get I I think from a strategic standpoint you may want to have this stuck in a row before you come over to us but I leave it to you you said talk to John about a modification to what to the special well whatever we titled that I don't you know whatever's on the front page well well um so you have multiple so you just want a modation to that do that's that's what you'd be looking for okay John yeah first then you come back to us and saying okay this has been approved this has been approved this has been approved now it's on your door you can shut down there that's what I got pointed that's what I had for you as well okay we're good we're good you have a good evening um there were no there were no feedback when I run on my report more than my questions great no it's I think it you know I think next year will be sort of a a better year to figure out whether um I think you have to come back two consecutive years the applicant is required to attend a plany board meeting in the month of November after each boating season as measured May 15th October 15th for the first two consecutive years of marine operation a full site modific well the Marine has been operational for two years with theant but with the restaurant it hasn't been fully operational because the transient docks haven't been fully I don't mind coming back next year I'm just saying that that's not what it says but that's our various yeah we talked about it last year too where we specifically said like oh well you're coming into us at the right time but you don't have really any information to present to us so it's not two years of a season's worth of information yeah so let me say this the way I read this um for the first two consecutive years of Marina operation to review and discuss the observed site circulation and general operation of the facility inclusive of the restaurant car use and the accessory Marina use so it was intended to look at both those uses so my reading of that would be that I I think this year is fine even though things didn't go entirely smoothly with the restaurant I think it gave some feedback as to the two of those things together I think having one more year coming to sort of see it in um hopefully for your sake and for their sake smoother operations um just hope we're still there would be useful so same all season I'm sorry the rest stay open year round that is their present inent and but only be open like Friday Saturday Sunday not Tuesday Wednesday Thursday that's it's just a money loser when you do that it's not it's not know well known enough yet to have people saying oh how come you not open on Tuesday the food's not that good you know whatever thank you thank you thank you very nice job no name no my name is samtha I know that I I met you this morning all right so um what's all the pH stuff I will leave this can we just literally say that email was too much for it to be before us come back when it's better yeah it's all I really have to say about the matter a long way to go that covers it John what why don't you start us off with whatever you feel like offering to the board and then we'll kind of go from there sure um it's fair to say that there that A lot's been lost to staff changes and this ends of time uh for stare drive and do it Circle um you know there's a reason why it uh why I'm going to say at least individuals some individuals never saw thought um acceptance and here we are 30 some odd years later and now it's you there are remaining issues out there there's problems with uh areas of Paving there's a problem with missing drain easements and uh drainage that has been modified um it's it's not clean let me put it that way having said all that let me throw out there's another issue out there uh there's a fire protection sistern that's dared Drive um that did not make my list or Randy's list right there but in chatting with uh the fire chief he he brought that up that before the management and maintenance of that is uh has not yet been determined so uh there are liabilities that um would be taken on by the town [Music] in pursuing Street acceptance so I guess if I go back to my previous note right there when I started to say uh keeping all that in mind um I was chatting with uh Nicole Barker and you perhaps there should be an expectation I don't know um by residents out there that after 30 some odd years the street would be um accepted um I don't know exactly where that lands how that lands uh but I suppose these are all factors to consider so if if there were to be a positive recommendation from the planning board perhaps it could be um it could make reference to those ongoing liabilities or maybe those liabilities have to be resolved first maybe the the town should be trying to secure funds uh to fix the drainage issues out there um before you enter into some sort of U you know acceptance scenario I people on the street realize it's never been accepted some do uh this current uh petition uh was from a miss neton um and I think she had done so in years prior um in the earlier in the 2000s uh I think this tends to come around every once and again and ultimately you know there's an assessment okay what's missing okay what's it going to cost and couldn't exactly say why things haven't moved um since those points but there's certainly remaining issues out there I guess the question in my mind right is obviously the town plows yes um are they doing anything else out there currently says street sweeping and patching potholes over the years the town has you just beat me to it that's right so I mean they I guess basic right I mean and really would there be so many if it wasn't only still only two inches of pavment well I mean none of that has to be done by the time right mean literally none of there's probably a better argument that the um snow removal has to be done um just because they've done it for every but putting that aside there's no reason why they have to fix potholes or do any of that on an unacceptable so um I mean I It just strikes me that there's probably a way to get all the buyin get the stuff done that you know can be yeah you would need to have resident approval or you know things like that for because there's a few things on there don't you think the res CER attorney would have pred that it was not a approved rule what the closing you can turn actually to this homeor well but I mean how many I can't count on both hands the number of unaccepted roads that we I mean these things have fallen through the cracks right I mean we've been trying to go through all these things there's so many of them I mean um but I'm just looking right I mean you need the storm water Ean on lot 20 um and figure out how you're going to play around with that well whoever owns lot funny to probably not have a huge problem with that if the idea is this is going to allow them to have repa streets and things like that right that they may need over so I would hope that that conversation can be had and some of those things like not 20 dealt with it's going to take some money from the town without a question to do some of this it's not going to be paid by the residents for you know bigger things but at least having the Buy in of allowing a new deed to be filed with an e or having you know monuments put out there having you know know what else I can't remember anything else but I mean stuff like that where you know there's probably not a right to go out there and redo a deed and have an easement right but you should have a buy in if it's going to mean that they're going to have their Street M and the option is to not maintain it but if you give them everything just maintain the whole thing the entire time what's the why am I giving you anything right um so I mean hopefully that just I think that those discussions have to be had I think there has to be a better sense of what the drainage issue is and how that's going to get fixed and the cost and what that be before we're going down to far down this road um how are these things slide through the system without somebody pick them up on that's prob too well this I mean well read The Narrative somebody did pick up on it in the early 2000s and then when the B the bill became too big they just walked away from it and in the interim for the past 20 years the Street's been getting plowed the Street's been getting patched and nobody else seems to have a problem with it until the errant neighbor calls and says hey water's coming into my property and oh now all of a sudden oh there's all these stuff that needs to get fixed and I think it's a question of um I think there's a again this it's going to go into redoing um you know some of the bylaws but I mean I think you have to a have a third party monitor who's there during these processes and you know being able to actively check and make sure that things are being done the right way so that there's not these problems later on you have to um make sure that things like as builts and all the stuff that needs to be filed eement all that stuff is actually getting done and filed and you have to make sure that no bond is being released before any of that gets done and that's been the problem is that you know things bond gets released too quickly because there's always a lot of pressure to release bond in the end and and the sort of broadness of what you should probably look at is not being looked at so we got to just be there got to be a process put say you're not getting any you know outside of the $10,400 worth of paperwork how much is the build to put that street on books to be done do we have a value is what it would cost to get figure out that Dage I me the biggest issue seems to be that Dage issue Dage is that's got to get fig out it'll be quite a bit and there there's nothing in the kitty that'll cover that from any of the uh Holdings no got released in a priation it's going to be on the town to do it this could be hundreds of thousands I would hope not but it could be right but I would hope not why does it need to be it is it is a municipality one it's um it doesn't right I mean Tech it's not our problem but in real life correct might $50,000 to fix this problem you come into the town you pay your taxes you are a good Community member and you know but your lawyer didn't do his homework yes and there's there's something to be said that you know you bought a property without doing your homework as well right um but in reality who's asking about whether a Street's accepted whether they are looking at this thing so right you want you want to have a town where people believe that they're going to get the services that they expect in the town unless it is just abundantly clear that this private like the ranch right I mean that is sorry we can talk about that but as far as just the maintenance going down that's a different issue Sou see that we we do vict well Rob the one right before conect I that's another disaster we had I mean like I said more than two hands count these things I mean the one neighborhood I lived in they had to spend a whole ton of money to fix up the dra the uh the drainage there right next to one I mean that's they 6% of the town's income tax so but I think it this this particular issue is quite complicated there's I because there's two drainage issues there's stuff coming out of Lot 24 that are going on to town owned property and then you have the difference the lot 20 which apparently received a condition order that they were supposed to do to fix this problem back in the 2000s and we don't even know if they did it or not so I mean it's this shouldn't be us on their cies after you do the break you know it's not the homeowner I mean the homeowner didn't do anything really wrong except for lot 20 depending on if they owned it at this time or not I suspect that was on the developer not could be I don't know the answer but if it is the same home home that's a different question but I suspect that there's going to be no one you can really say they they're the pad person and they should pay for it it's just the question of trying to work through it best way to at this not be an issue R that's what we've had to do on a number the road's not going anywhere it's here to stay we got we got to figure out something we're going to end up with that road at some point no correct better fix it now than get over it so but we do need more information so we'll just keep that on and kind of follow it right wrong or indifference still one of our road yep okay um John do we need to do anything of any degree of formality I mean I think we need more info I supp that's a recommendation but so I think there's another layer of information um I do want to understand better what the fire department is doing today if they're doing anything regarding that sistern um I uh also I've located the file number for a conservation Amendment but I haven't had a chance to sit down with Sabrina just yet and figure out what that was and that's specific to the lot 2021 drainage issue um that's going to at least begin to paint a picture of uh what needs to change and hopefully it's uh closer to the more affordable side um as you alluded to earlier if the matter is just going in and making it the way it was approved back in the early 90s uh so in any event yes uh some more information let me dig around a little bit uh I do appreciate uh the board's observation that the road's not going anywhere so we'll try to figure out what this really means okay yeah did they have sidewalks there no they don't I don't believe so side street off of that street well you got those squares they make on the sidewalks when they put the sidewalks in we could like sell advertising space to pay for this stuff but there is the side street off of that street build W barbecue the wood drivers or something like that Circle yeah put down put down decal bills Barbecue on the Square WR that out and you can pay for the sh this the same issue that FKS over at Meadow right they this was this was all goes back to that development that they wanted to put on them on Dave gun's property right all right going up between her Ranch and um you know like where his property is I forget there's a little dirt road it's got a name or something but the one that goes up there um that actually got approved got appealed went through land Court uh it was Ralph Pama who had it and and that was sort of the issue that were causing all the push back from seret and Meadow and do it is they didn't want to have that anything potentially tied in their that way they so um I would hope that that I mean that has been dead and Par TR probably at least 10 years now that project I mean it's not going anywhere any gave over um so I don't think that's going so hopefully they'll do more receptiveness to this piece of land was origin owned by Sarah Sarah people sah as his [Music] grandfather all right well [Music] um operations and maintenance plan they do not have one yet here's the so you bring up a couple good point right we don't have detail shown on the plans to be approved by the planning board and we don't have a long-term operations maintenance plan um there should be a design this is all stuff that gets punted off right when uh we're not just tripping the thresholds okay we got to do later um so I don't mind modifying the message here maybe it is just that first piece right there and I delete the rest no I think you can I think you can leave 10 the way it is and just delete three right yeah I staff comments anyone I'm G to throw one out there if you guys don't mind okay there's gonna be two uh the current aim is to open a public Hearing in December for the accessory dwelling unit bylaw element that we discussed at the last meeting um the state law is effective in the m in mid February and so the hopeful aim and maybe it's a moonshot is to open the public hearing I've been trying to get attorney beglane to uh give some critical review to what we have so we can go in with the some of his input uh fire that back to the select board and if they can um essentially approve that as a warrant article for the annual town meeting prior to that February date then uh what we have on the books would be binding upon any application that came in assuming it was approved in May uh so I just wanted to share that with the board that'll be coming up um I welcome any why would that be binding so it's one method of uh it's one strategy towards a zoning freeze although in this case it would be a freeze with a modification right um so if the warrant article for uh zoning bylaw is um authorized by the select board that um that ends up being the Milestone the let way if a if an application came in May uh excuse me uh March first right um then uh even though the annual town meeting hadn't yet taken place uh the elements of that worn article would be binding upon that applicant if it gets approved in May is there a problem um with time between when we do that and the annual town meeting don't we have a time frame that we have to get that um we can't get it to them before or some or something I forget what it is right isn't there some yes I can't remember what and I'm not explaining it in any way that's coherent but you're right there's uh there's I think we're running up against those that like like 90 days right or something like that don't don't beat me to the punch you're right I I agree it's 90 and I may have gotten a bum steer from attorney beglan because I think you're right if you close that uh public hearing Beyond 90 days I think that jams things up yeah I mean it could be close right but we just got to keep an eye on that no this has been for the critical eye is appreciated let me uh if you will we'll do a little game theory on that exercise and make sure that attorney agrees with but that's it's his opinion that if we maybe it's not so much our granting of it but it is the a recommendation of it but it is the select board approving it for a warrant article that sort of creates are freeze yeah that's right okay I wish I heard that I mean we've done it sounds very familiar to something recently learned at one of my trainings where there this is a methodology to put a kind of a freeze so that you don't have a hundred people coming in and making the application for adus before the town has a chance to get their bylaw on the book so that I don't know that we have all the details right but it does sound a real thing I like
