and approve the South Lake Animal Control Officers request to purchase a shed to house larger animals with the funds in the South Animal Control gift account Miss Benny you want to come up or he just wants to either or whichever works for you sit okay all right so um I had um Mr Mrs polverari passed and quite a few people made donations on on her behalf um I think because Mr polverari built a shelter and had well had a lot to do with building the shelter that it was just kind of a nice um tribute to Mrs polverari to continue her love for animals and the reason I want to do a shed um in the size that I want to do is because we do get we almost got an Packa this close I would have taken that home I know me too um he wasn't a nice boy though I gotta say so anyway we we um we do take in we've already had goats um we take chickens and ducks and geese and turkeys and things like that putting them actually in the shelter um takes up a lot of room so I thought having a space big enough so that part of this shed could be put into a 10 by 10 stall four you know alpacas or goats or whatever happens to to come through and with over 100 almost 150 farms in the in the town it's just a matter of time before we're going to start taking in larger animals um um that have found their way around um and the other part can be used for uh West Springfield brings in chickens and ducks and geese and turkeys and such so um we've always needed a place to house those it would just kind of coincide and like I said I wanted to do it to honor bar Barbara polverari um because Mr polverari has done a tremendous amount for us um through the years and with the shelter so it would be designed so that basically mimics the other shed that we have it would look like a shed it was it would look like another shed we're going to put it out in the in the area where the dogs we have two areas for the dogs one is a direct in front of the the kennels that they can go out and play in and then the other is another fenced off area I would rather put it in the other fence toop area but I'm hoping to get the funds approved we had almost $66,000 um donated on to honor Barbara and then um we make up the rest of it in our gift account I I have no problem I I love animals and so did she you should see her farming animals up there it's pretty kind it's kind of neat she's got donkeys and alpacas and uh stuff the only thing I have PTSD from in my career is having to shoot a deer that's tough yeah you have the ground space to put that size yes yes and you'll have to get a permit for that okay I would assume it's gonna be idea gonna be on gravel I think the size gravel you need a permit correct if it's over 10 by 10 from okay all right I wanted to get the approval first before I went on that that this you might even have to go see the friendly Folks at the planning board uh oh maybe okay whatever we have to do step by step I just would like to do this for her no I think it's a great idea my 11th appearance here I kind of like it course I went to the wrong room little change since you were here a little change that's okay I was directed properly after that uh I sent the schedule it's it's almost a carbon copy of last year there were very very few changes you know we were surprised by Rugged Maniac pulling out closing the doors last year uh didn't give us time to really react but what we've done is we' put together our own program called The Wicked mutter it won't be as elaborate as as what uh they had for their fancy displays and so forth but it'll be uh I think a good event so we're putting that in the same splot slot where normally have Rugged Maniac the only other brand new event is bicycle event um John Day who originated J day has sold the company now a few years now and he's gone into the bicycle racing business so we're going to entertain doing an event with him because he's a very good organizer he builds uh a good program Safe program so we're looking forward to that you know looking at last year uh it was a good season uh we had some weather challenges uh we lost the track a few times thank goodness we had have our friends uh crestw construction as our title sponsor because they always have our back they're wonderful people I know they do a lot for the town as well uh the national went well the attendance was only slightly over the year before which was a little disappointing because we're tied in with Feld now and Feld is one of the largest entertainment groups in the world they own Disney on Ice they own Monster Jam they own all of these different U pieces and we were hoping that by Osmos in their marketing machine we would get more get more general admission in but we really didn't you know our VIPs and the upscale all sell out anyway we don't need them for that we don't have enough but and we may look at maybe adding a couple more if we can if we can find the proper spot to do it but I was a little disappointed that wasn't any better but NBC still the highest viewed in the country so they love us so we'll be back with them again uh the North awing out of West over again big hit you know everything was kind of quiet until the the two f-15s flew over and then everything got real loud it was a lot of fun I don't know if we'll have them this year though they have a an equipment change there and I don't know if they'll be ready to to come back um so the national this year will be the same timing roughly it's only one day different uh so far I'll be honest with you um little concerned the tickets sales have been a bit disappointing they're about 24 25% off of what they were last year um and we kind of anticipated this in the fall we got a lot of information from the industry people Yamaha Kawasaki um a lot of the the aftermarket people uh were predicting that it would be a slow start and it may not pick up until the second half of the year which is unfortunate because we're in the first half but um the other thing is Monster Energy which is the series title sponsor uh they are not renewing a lot of their contracts with other organizations as they come up for Renewal so they're backing off a little bit this year they're still with us I'm not sure how long that contract goes because that's the series contract that that goes through Fel um but we'll still have them but because of all of these hints uh we held all the prices for this year as they were last year we don't want to scare away any people from from uh making their uh their presence known the other thing we're facing right now is Insurance um a year ago there were 12 carriers for Motocross and Outdoor Motor motorport types of events they're down to three now and of those three two of them are reluctant to do any insurance for under 18 years old un that's significant part of my clientele so we're concerned about that by our agent who takes care of all of the national tracks assures me that we will have that taken care of I'm guessing it's going to be with the price so some of the events that we see on that calendar if they're not cash positive because of the insurance I may be calling you and telling you that they won't happen but but I have to wait we don't renew until March all the paperwork is in but I won't really know what the what the premium is going to be until March basically uh basically that's it I mean we're in good shape we're looking forward to getting back here I took a ride through there today our dog walkers are watching the place for us as they always do I love that we leave enough openings for them so that they can get the dogs through there and have a good time and they all have my number so if they see something they don't like they call me so U that's worked out very well and basically that's it I'm hoping that um you folks would be happy to approve the the calendar as I put it in there I think there are a few more in there we don't like to have to come back to you if something gets added because it's disruptive so we sometimes put in some a little bit of extra just to make sure that we don't have to do that and then we announce that we don't do it that's about it how did your unicycles go last year oh was great it was great and and we'll do it again this year uh the electric unicycles and we had some people in from California we had some from Canada uh from all over the place the one that they were doing this year we change the timing of it so it would be better positioned not to be too close to another major event on the west coast so we're hoping to get more Europeans as well it was fun I mean those guys they are such a hoot to watch I mean when you think about they're on an electric one wheeel about that tall they straddle it and they can go 50 60 miles an hour I mean the tracks that we build for them they don't go in the sand track they can't make it but um the tracks we build for them we make sure that they can't go that fast but uh man they are a hoot and some of these guys are so talented I mean one of them is so good I think I told you last year he comes to the finish line so far ahead he turns around and goes backward [Laughter] that's incredible so it's a lot of fun we're looking forward to uh that again uh a good National we have um you know the Supercross started three weeks ago um it's very interesting because we've had two brothers who have dominated for the last couple of years all of a sudden neither one of them are at the top right now and um every week it's somebody new and what's interesting is a fellow by the name of Eli Tomac who is a well-known world champion he has broken almost every record he's now 32 years old he's announced this will probably be his last year and he is one of our greatest spokespersons he's from uh Denver the Denver area and he go he is very vocal on social media about how much he loves Southwick because it's the toughest track in the world so he loves it so uh he won last week the oldest dude ever to win a Super pruss and held the Series championship going into the third week so we're hoping that that excitement continues and draws people and we fill this town with lots of money spending folks that keeps us on the MP yeah well remember the Southwick National is the only National in the world with the name of its town the only one every other one has Hangtown highp Point Red Bud none of them are named after the town that they're in pardon me buds Creek still buds Creek is not in a place called buds Creek there is no buds Creek unid Unadilla isn't even in Unadilla it's in another town so Southwick is the only one any questions any thoughts you know how I feel about St you never did like it I [Laughter] know I appreciate your time we fusion to Lake View Tavern um I'm very familiar with Shane so I don't need to ask any questions this ton of paperwork in here looks all official all good have any questions other than why do you have a driver's permit because in I'm just kidding it just struck me as as I was reading through it no problem CU he didn't have a car he didn't me a license I don't know I was injured from an accident I didn't drive for a while see there you go and you are changing the name to Lake View Tavern nobody has anything else further I don't is anything else changing with the restaurant or the the operation other than the name or it's going to be pretty much the same thing well we were adopting to certain things as we started CU we started off rough was supposed to be a soft opening and they up being full opening a lot of people so as we went went on we made changes so we're just going to adapt to those uh changes make changes to the menu do what people want because we listen to what people uh why don't you give us an update can tell us what this is um the Diversified learning experience AKA dle is um a South High School um sort of job shadow experience that the high school seniors uh a select few get to experience um they take one semester either the fall semester or the spring semester and they job shadow for about 4 months um so we last year we had uh Lucas Karen and he did a great job and then this year we have uh a young woman named Isabella Pro Yeti and she is passionate about sustainability so um we're going to have her come in between 8:30 and 10:30 a.m. Monday through Friday and she's going to uh attend as many evening meetings as she possibly can she also has um she does Sports so she's going to be doing some sport things and some I we already talked about there's a little bit of conflict um for scheduling but we're going to work that out and her I think this goes until the end of May and yeah we look forward to having her in the office good does she have duties while the the turn is with you are there duties assigned or what what are they participating in yeah um I'm a little more organized this year and I'm G to have her help me with um file organization and then if she has some extra time um she can do a project of her own choosing um something that she's passionate about last year Lucas Karen did the Shing ring Yoku um Trail he designed Ed it and that still needs to be finished but he did the majority of the work when he was um interning last year okay thank you the the is a great program um this margat that runs it out of the school does a great job um I know we've had some great interns through here through the town hall and other divisions of town over the years I think one of our newest police officers was actually an intern through dle um a few years ago that he was the intern now he's in his fto program right now right um I know at my uh my employer we've also had numerous dle students come through um some of us are back with us or are they're often into their career this is a great opportunity for someone to to learn in a business setting and then you know um while they complete their last year or second to last year school I I'm fully supportive of this program it's a great one I actually participated in this in 2003 where did you do your da experience um I did it at grineer photography studio and also um I did Administration in the dle so I worked for the the high school excellent living proof then that's great well to approve the D intern for the Conservation Commission second roll call vote jasonone I see how we doing so good Randy how are you good if you remember this is um about a month and a half ago there was a a sign hearing with the selectboard for no parking signs on South longyard Road and White Street so out of that um from the hearing we have uh about 90 signs to install so our our budget for signs our annual budget for signs was not enough to cover the cost of those new signs so I went before finance committee about a month ago and they approve the the reserve fincon reserve request and I believe needs to get I believe it needs to get your sign off as well I have no questions okay make a motion to approve the transfer the recommendation of the finance committee for the transfer of 7544 for the South longyard Road street signs second roll call vote Jason for I than I Doug mlan yes good thank you Randy next item is going to be item I to review and approve the financial proposal for Legal Services you want listen up it should say request proposals not Financial proposal but that's okay there's an RFP here um that we've drafted up just to go out and um solicit some legal services send it to bacon Wilson send it to local firms and see what we come back with we don't have um you know we have an amount that we pay them we've been with bacon wien for a long time um so just kind of going to see what's out there you and I talked about itn't to explore those options I in favor of doing an inquiry and seeing what our options are what what additional Services we might burner additional Staffing might be available she moov anything I'm not particularly in favor I think there's some challenges with the existing bacon and Wilson relationship that we need to have some attention paid to but I understand what you're trying to do here and um my my main concern is that there's long-standing litigation and other activities that are outstanding that will be very difficult to transition but I there's no no harm in asking would they transition or would they carry on what they are involved in last time we transitioned the former firm wanted nothing to do with us so they once we put the the word on the street that we were doing it they pted everything over to the uh the new firm if I recall it was a long time ago and we had had a very unsatisfactory experience with the previous firm um that caused us to actually even entertain the idea of talking to another firm we doing an RFP RFQ type situation no one will ever replace dick Buckley but unfortunately he's no longer with us so um and the day of a you know a single practitioner type Law Firm representing a town is is probably unfortunately past but um you really need the multidiscipline that comes from you know a firm that has someone with L use someone with Telecom someone with different uh all different experiences and levels of experience in different things so I get it and you know I think a lot of law firms ours included here has been struggling with you know a shortage of Associates shortage of lawyers um and a heavy litigation burden um but uh you know I understand what we're trying to do here I just I think that more effort should be paid to try to work on with what we have because there's you know it's been I want to say 15 plus years that we've been with the current I don't know exactly but it's probably more than 15 two pair I think is 30 h d pre 30 oh yeah and by the way if this is a discussion about labor law I'm completely opposed completely absolutely positively if you're talking about general counsel that's one thing but on the labor side what D pre has done for this town and and the successor folks that work for D pre you can't even put a value around anybody who touches that is um I think that's a very very slippery slope there's many many years and years of contracts and negotiations and details around that and that tribal knowledge would be lost if that transitions to another I understood this to be General 100 I I'll be I'll go on record with that 100% not in favor of entertaining the a labor portion of this at all that would be 200% I agree with you entirely on that we can make it just for General this didn't separate that or designate this was just kind it's for everything okay okay I and the other half of that and the other half of that also is involved I believe to pre also represents the town Vis AES the schools as well in those with those Union those bargaining units as well different person but same firm and there's a lot to be said for having all that under the same firm so what do you need on that I just need an approval the of an RFP to what for General councel so I'll make a motion to approve an RFP for General Legal Services excluding labor second roll call Jason I Iain item J is going to be discuss and approve the financial review of local services division of local Services is um a branch of do and they come out and do reviews of towns for free um all the time I had it done in my last two towns and we don't really have a good set of financial policies so I thought that asking DLS to come in would be prudent for them to kind of overview and give us some recommendations and so all they what they need is I reached out to Zack Blake who is the director and uh they just need a vote from the board um and then they're probably around April or May so they're out a little bit is there like a scope of service or what they do or other than that I I I read that in the agenda and I didn't quite get it so is there kind of a scope as to what they look at yeah so they'll come in an interview the entire Finance team and see what they do what Their processes are and then they'll go back to um you know their offices and write up you know recommendations of do of for the Commonwealth and you know what we could be doing more efficiently what we're doing great what we are lacking in what the recommendations are for U percentages of you know stabilization Capital stabilization different accounts if we have them that should we create them so they just come into the towns and it's literally like division of local Services they just come and help towns what was the I think it was two or three years ago it certainly wasn't five we had a um Community compact grant for a best management practice review of and it was a it was Financial in nature does anyone recall what that was for it was before my time but Marl mentioned it um and it was kind of an overview of best practices how to do this or that I don't know that it was Nitty Gritty it was I want to call it ref FL yeah so with best practice with the CCC there are different categories so you can do human resources you can do financials you can do all different um different categories that livein the town and I don't know what what you got here CCC is usually around $10,000 that you get for um for the grant um actually it could be more I did an IT one one where I got like $70,000 so it depends but um this is the rudimentary initial from DLS so um you know they work with mun IP alties every day all over the Commonwealth I've had several several trainings with them uh they're the ones who go over our financials every year and sign off for free cash and all of that that's all DLS this is something I talked to Nicole about hold on Mr D um and when she came on and I I just talked about would an audit be a good idea to I agree just to get to see where we are like she said and my understanding was they come in and they just take assessment of everything and if it's something the state provides for free why I mean why wouldn't we take advantage of that and the way the legal um landscape and Municipal landscape you know you just went to the conference things are changing all the time you know they can come in and say hey because guys could be a little bit easier done this way or that way so you know I'm all for this for that reason the timing um is it when they have a slot yeah so it's you can't schedule it for like June after I could I mean the earliest he said was April or May I just okay I because they want to wrap up the budget process in April for Maytown meeting that would probably not be the best time for us you can absolutely schedule the time and again they don't give us requirements they just give us recommendations once they see it and we can take it or leave report you take it or leave it yeah yep Mr DD yes J 258 Hill South it was brought up this weekend and one of the classes she did discuss coming out to any local town would be uh wanting yeah come and visit and go over a few things so I get that but you said our financial team what did you call it the whole Finance team so it would be assing Finance team assessing treasure collector and accounting and our office thank you yeah I mean treasure collector that could probably use a fresh look on processes and yeah so we did have mass munin come in and do some training for them they're doing great I mean I I just feel every once in a while it's just good to have that's it's free it's beneficial again you can take it or leave it you don't you know so it's just and it's not just one pocket it would be all yeah financial review yeah so yeah and Joe's right at the DLS those are all DLS people up there this weekend and um Deb wagger is the director assessment and uh you know they say it all the time call us call us you have a question call us call us so anyway this is just a formality and then you know we can schedule the time for them to come out when we close our year or anytime I just need a vote from you guys to do that they basically went into our like free cash and how most towns are aren't even up to pre CO as far as getting things in on time and where are they lacking and they didn't say Southwick but just overall if you're not the quickest person to get your stuff get cash certified you're not alone there's everyone was having an issue with it and on that note one of the questions at one of our meetings was how many death threats were there for select and we were very surprised of how many hands went so forunate aspects um anything else no okay I'll make a motion to Improvement strs looks like another one from Ry yes thank you so uh we over this past summer we we applied for a grant through the uh massachusett technology collaborative for some upgrades to uh some Hardware that is nearest end of like and uh we just got noted uh notified earlier this month that we awarded that grant for $9,975 so I'm asking for uh the board to approve the Grant and uh designate the chair to sign off on the grant paperwork so move felt strongly about that one yeah second that's on the list of things I keep you up at night so move and second it already Jason Doug Mogan emphatically yes by the way on the Triple C uh not the Cannabis Control Commission Community compact grant for those following along at home uh we got quarter million or yeah 250,000 for mun and we also had 200,000 Plus on a it infrastructure Grant probably seven or eight years ago the results can be seen in the data center at the police department so we can probably do to probably at about the time to start looking at that again so what I was thinking about with the 10,000 was the DTA so the direct local technical assistance I got it but those Triple C grants are great because that was actually part of um and I know I said I want to be home at 7:30 so I'll try to keep it brief I know but um you know that the Triple C grants was brought in with the baker Administration when in when he first came in and they were really helpful now with the one stop for growth having a you know kind of a standard window to go in and get those things but the community compact grants really set the stage for for that whole process so did we need to um uh vote to have new sign we did yes okay so we need to make a motion we did we did you did okay next item is going to be item L discuss the select board vote regarding minor equipment so last week I had um Laura come in and tell me that Randy wanted to buy a copier for $4,000 but he can't so he has to wait until town meeting um because there's not enough money and I said there's plenty of money it's just not in minor equipment it could be considered supplies and it's fine no there's a thresold of $3,000 and so I said I have to bring this up to the board it's not conducive to Everyday work when we have such limitations all I could see from the capital uh in the code was $25,000 threshold um and that's typical that's what I had in my last town that is what I had in town before and the people I was with this weekend I asked them so before it goes to Capital becomes it's $25,000 so I don't I'm not sure where she told uh Laura told me that it was a vote of the select board to go to $3,000 and I don't know how we conduct everyday business when we're going to just limit everything to $3,000 I don't know how to do that I mean we we did it for R because we were having a special town meeting but it's it's just so counterproductive and so I don't I don't know why the vote is and where it comes from I I'd like to ask that question and why we have that tiny threshold and if we can raise it because um you know I have Randy has to do Randy has a lot of work to do he has a giant department and when he can't get a copy or make a print out of a bill or something I mean it's just counterproductive for work this is the one we had entertained moving to $5,000 and we negotiated from a thousand we bargained down to three it started at one so not too long ago and and and what what did though this threshold was $1,000 for for what minor equipment minor equipment so simply minor equipment that is very discretionary right on what is actually minor equipment that's I think that was the basis for the discussion as to you get into a discussion of what's minor equipment and your definition and my definition or someone else's definition May differ on what is minor equipment um but we this was a negotiation with actually with the finance committee um I want to say it was last budget cycle or not the one before it wasn't long ago so I again I mean as we I think I I sound like a dead horse or whatever that analogy is when I don't just trying to think dead horse is pretty quiet right I would hope I'm definitely beating a dead horse um that you know I don't just it doesn't come out of my brain I I live by policy and procedure and laws and code and I'm going through and I'm going through and I just can't find it so the last thing that I saw when I was looking at the capital asset policy is assets below the capitalization threshold but considered sensitive may include radios personal computers laptop computers printers fact machines and small power tools these items shall be inventoried and controlled at the department level so so that's so then I was like oh am I going to go back and look through five years of them making a vote I don't know like maybe I could just put it on the agenda talk about it sure and see I would what we can do sorry Mr chairman go ahead I would to use an old expression drop a dime to the former CAO this is why we keep him on retainer because I think he could give you the background on how we got there to where we are and also in that definition I didn't hear copier correct so even then even if we raised it it doesn't solve ry's problem he could go byy a computer or computer with a radio but it doesn't say copier so it says May right and that's what I mean this is why when we start about Minor equipment right and it's a copy or printer right it's a whole it's an Allin one I would we can we're going to be here next week so I we can have this discussion again to its conclusion and just carry it but I would I would certainly because I know we had there was a long protracted discussion going from it was going to go from a th000 at five and it end up at three and that was a negotiated I want to call it a negotiated settlement after much debate and I believe we said if it didn't work out we would come back and address it again and here we are well here's one I'm going to kick in play Devil's Advocate so I did just was doing some numbers the inflation as we all know has gone crazy it's 19.8% over the last four years we all know the cost of doing business is more expensive um I think those old numbers based on just I mean $ thousand doll can't even buy your lawnmower we had that and we had that analogy last time last year you know and you know from my little side business and everything like that just buying an attachment for a machine as well and some of my attachments are over $5,000 um I've got a number in mind that I'd like to you know Mr Dei I did see your hand so we're gonna address it in a second um I'd like to probably talk about going up a little bit I know um there's some some concerns about um and I've heard this from my other Municipal position where you know just because people have it they're going to spend it um I don't I'd like to think that the people that we put at the heads of our department are not going to do that they're going to be smart enough because here's the thing they spend it there's something and they don't have it otherwise now they got to come in front of Mr Dei and ourselves to figure out how they're going to fund something and if you aren't managing your pro your funds properly I'm going to tell you to go pound sand so um I'd like to think this is something I definitely like to discuss and Mr DDS saw your hand rais so go ahead sure Jo dd2 5 Ro s m finance committee um it it was a th for 20 something years right yeah and iction and and we did discuss it we end up in Grand um and there's been no one in front of us last thing that in front of us that was over 3,000 was a a trailer to haul a tractor um and I think it was at 3,300 we approved it we never bought the trailer we put the money towards a bigger tractor that didn't need a trailer um and I think that worked okay but other than that no one's coming in front of us worried because you know we're hitting this limit and it's a problem and and it then it affects you and your day-to-day operations of the world um Ry think's different because it's a printer which isn't even on there but I I agree with you the copier printer is the same I absolutely agree with that um and I thought in the last time we did this you could have come in front of the finance committee to get that thousand and we've you know there was fencing for the cemetery that the numbers didn't work and we appr that and then there was a trailer for the cemetery members didn't work and we approved that so I I just think we could look into this a little deeper and maybe there's a way around this yeah and I will absolutely come back next week and I'll talk to Carl and I and it did become a problem because it came my office with Laura and we spent 20 minutes that neither of us had right uh talking about ry's quote or his his thing for $44,000 and so his printer that all s copies yeah and it's all un it's just I think it's inhibits our our work every day and we look at the warrant every single week and I look at every single page so that's another layer I can been seeing you go through it um when we make these decisions just procedurally and we vote to increase that where does that information go it's probably just in the minutes I assume it should be something to the finance office we don't really have any Finance some kind of memo at least to accounting I think everybody's aware of it I mean I think memorialize but I don't know well it shouldn't be a secret if we yeah tell the department heads you can do this it should not be a secret so something needs to follow our vote is what I'm saying and next week then we'll definitely make sure that it's known okay back then it was known because there was one particular Department that needed to go up and buy a lawnmower and that particular person I'm sure told everybody Under the Sun 3000 so I think they do know like you said the printer SL copier broke finally when he goes to buy it under under his small appliances and oops it's just not enough for what a does money we have a lot of line items a lot a lot a lot of line items yeah have enough money in that particular time where it should fall under and here we are I don't think it was done you know inflation wise or anything else know what's come in front of us in two years so I don't think that's the problem there's a problem but I don't don't think you can look at that line item and go oh my God because if it was 5,000 he still only has three in that account maybe he has three in that account I mean maybe we should look at consolidating and putting it into a different account where you can use supplies and what's minor equipment what is minor equipment versus supplies and I think this is a bigger conversation probably for for the budget season um but this was just I wasn't here Thursday and Friday so Wednesday I just said can you please put on the agenda so we can have a conversation about it because this is just wasted at least 20 minutes of all of our time and all he wants to do is buy a new copier so fair enough car oh thank honestly I had no idea this spurred my my Po request spurred this whole issue last week I haven't talked to low and Nicole about this uh but my here's where I came from I I just you know have need for printer and I I had I found money in three different line items between water sewer and Highway to you know buy a printer so I I put the PO in with those three with those three line items and I had no idea I wasn't even thinking of this you know minor equipment issue that you're talking about tonight yeah it's not on you Randy don't worry yeah no it's not on you it's just us this is where Mr D you said you know we can work something out you know this this is definitely a discussion for later where we operationally we maybe move some things around where if you got it in your budget you may necessarily don't have to ask to move it and you know I'm a big advocate of defining the terms so there's no gray less gray okay so we're table that for next week all right so that's that think we move Randy for the next one too going to discuss the project list which is item M for the mass do resilience Improvement plan from Pioneer Valley Planning Commission all right so uh Mass doot has this uh rip program which is funding uh C Replacements across the Commonwealth and so the way it's it's being implemented is it's like it's a regional application so Piner Valley planning is spearheading uh their our region in the in the valley uh and they've asked every Community to give a list of projects that are on a radar so what this list you have in front of you is a list of looks like seven different CS that are in various stages of design or construction um so did all the pvpc has asked for the slug board to uh bless this list uh as they put them into a larger Regional Grant application I have no idea how successful will be what what the chances are of success uh but these are the project that are kind of on our on our radar right now and I did have a discussion with pvpc last week they're probably going to focus on two or three of these the ones that are um in the design stages one of those designs we're talk about a little bit later tonight but that was my question okay later Governor loves Culver said so herself right so I guess we will um look to approv and approve the list you're looking for us to approve this list so we're going to defer to you and the storm water manager on your list so I'll make the agenda is going to be item end discussing I should say adjusting the CPC percentage um so I've been paying attention to everything that's been going on obviously that's I should be um and you know there's a lot of talks about taxes and and giving some relief to people um and I've been looking at different ways to do that um and one of the things I want to propose is reducing the CPC percentage down to one and a half% I did bring this to the attention of the CPC chair um and one of the other members to let them know that I was going to be talking about this um I we had our uh conference this past weekend Mr de said this has come up in the past um this is something I would like to put in front of the residents as a warrant article when it comes time for town meeting um to address it um and that's all there is to it that's where I'm going with this I know there's some concerns regarding the um the payouts I mean we'd still get one of our payouts the first one the other two the second one is not guaranteed and the third one I believe if we reduce the the percentage I don't even think we're eligible for I could be incorrect the way to interpret that perc the match you're talking about yes the match yeah from the state from the state trust fund um but I want to try and give our residents every opportunity they can to keep money in their pockets and it's a search charge I know a lot of you know it's a people call it a tax but it's a search charge and you know the numbers I punched up some numbers just to see where we're looking at I mean the average um median price of a house in Southwick as of the end of the year was 610 M 610 million $610,000 median median average price and at the end of December um it's varied right now it's 435,000 you know I talked to of the other um counselors and select board members and Mayors in other towns and when this CPA Act was put in place however many years ago which was significantly I don't know 10 15 20 $100,000 um forgiveness Rel lack better term on your search charge was for most people half their house a third of their house if not more $100,000 and I I think the average medium price of a house actually I think that's Massachusetts I'm sorry I think it was think 69,000 was the average median South is 435 that's my mistake um but you know I want it you know it's something that and I did do the research we could actually make a mo uh have a vote to bring it down only for a set amount of time too we could do one and a half percent for two years you know and then we could look at it again and have it go up or we could put right in the vote that after two years it goes back up is the $100,000 exclusion negotiable trying to go i' I've done the research on that right now there is nothing you can do what there is that I don't think a lot of people are aware of until I was really digging I didn't know I knew the $100,000 exemption is there there's four exemptions that the towns different towns didn't make let me see if I can bring it up here one of them is based on your um your income level so there's three do have that here in town and I don't I would be surprised I bet you there's a lot of people that aren't aware that they can put in for that exemption from that search age and income so let me see if I can find it I brought it up I don't know if I have right here um and did you run numbers on what the impact would be on the tax on the total tax bill the average total tax bill I didn't do a median number but I based it of I'm going to say my residents and a couple others that were a few hundred, less it's about $4 or $500 give or take um and that's $ four or $500 that can go in somebody and keep in people's pockets um I think the CPA is a great thing but I think at times we need to look at what's important and to me what's important is letting people stay in the house and saving people money uh like I said inflation 19.8% um but this is something I'd like to see end up on the the town warant what reaction did you get from shair of CC um he didn't really say much I just said this is something I'm going to be talking about I just wanted to make you for warned because I I didn't want to Blindside anybody and um didn't say much I'm sure I'm I'm going to be honest I'm sure most people that are on the CPC commission and committee are not going to want to hear this um but I just think it's something it's something that can be a discretionary item that we don't necessarily need to take all the time you know it's a beneficial thing I don't have I don't want to get rid of it in any way shape or form but I'd like to see it reduced to help you know the people in this town with everyday bills I mean it it's Costco three years ago I could go and get what I get for $125 now it's almost 300 um we all know the the cost and the increase and everything I don't need to even go over that but that's where I'm coming with this one so I wanted to bring it up for discussion and further discussion um and you know everybody can look into it and come back and we can talk about it little uh either the next meeting or the next one after that thank if anybody's got any other inut I'm love to hear you're not at this time um briefly we already went in front of town meeting at least once to attempt to reduce the CPA sear charge from three to two or three to one It Was resoundingly Defeated um I'm not afraid to get beat so you know it's there's nothing wrong with going in front of the you know one of the things you always say it pest form of democracy is 100% we have I love to put this in front of the folks I think that the better way to approach this is legislatively to implore the state or at the legislative level to raise the exemption by another $100,000 they except the first $200,000 the problem is it's not a Level Playing Field at 1% um you know the 3% communities get an outside share of the the distribution um you know CPA is a great idea when it first started it was ideally going to be a fee at the registry every time you go repord a deed they were going to take a couple of bucks you were going to get CPA money distribute it matching funds um and then the the housing market uh crashed and there was not nearly enough funds at the registry so quite a lot of the I don't know the exact number but quite a significant percentage of the CPA funding today is um income tax or tax money coming into the state being reallocated to the CPA and distributed back to communities um frankly I think that's one of the better ways of us being able to redistribute tax money rather than having it done by the folks in Boston because Lord only knows what they're going to do with it so having that money come back locally actually pays dividends and look at the number of projects that we've put in front of the CPA that would have been basically on the tax rate had we not had the CPA including you know the million plus dollars we're you know we were just looking for for for this building and and a few others um so feel free to go back at the um at the town meeting vote but I I would just have history be a guide and take a look at what that vote looked like um nearly a few years ago and so I think I I would talk to my legislative delegation to see about proposing legislation to increase the the exemption above 100,000 because you're right that the 3% or any of the exemption was based $100,000 on a house that might have been worth you know $200,000 or $300,000 now it's 100 on five I get it so that's really where you should be doing it Y in my opinion mine too so far right okay that's why I wanted to bring it up I wanted to get some discussion out there and I agree with the way you know that was one of my thought processes when I was looking at all this it's time for the state to come back and take a look at this and address it and bring it more in line with today's economy and and cost of doing business um I would love to do that you know and I definitely will reach out to uh rep Biga and Senator Mark and see if there's any interest there but as we all know the wheels of government in Boston turn very very slow um and I was just looking for something that could benefit the residents in a more immediate fashion so that's why I wanted to bring it up uh so if it's something that people don't want you know whether it goes on the warrant article then they'll definitely tell us if not then it doesn't go on that's why it's here I'm to discuss it all right next item health insurance percentage yet another thing I hear about and one of the things we talk about is recruiting and retention and keeping good people around here um as we all know we've had people leave and in some cases come back based on these percentages I know Mr talked to Mr steinhardt he's like don't touch it don't touch it you know as I said for comparison I've talked to everybody here you in my other capacity it's 2575 across the border from over there it costs from the plan that guys are paying almost $1,000 doll a month when I had a family plan over there no I'm sorry $500 a month is a thousand or more over here I'd like to do something to with that you know look at different uh High deductible plans uh options and I know naen has been looking into an awful lot of that stuff um but one of the things I hear is we need help with that you know we're one of I forget what the sheet showed one of maybe three towns in the in that are based on our demographics that that requires you know it's a 50/50 and I know in the private world it's you know it's worse in most cases but one of the things that when you come on a job like this you're willing to take a little bit less money for the benefits that come with it and I know an that's and the long-term benefits um but I I I think I'd like to start looking at doing something with that percentage or getting creative with helping out our employees as well so again and I know this has come up once every now and then but this is something I'd really like to take a good look at and not force down anyone's throat whether whatever side you're of this coin you're on um but I I brought it up because I wanted to hear from both of you and see what you guys have to say I've asked Nicole when she came on this is one of the first topics it was one of my first topics with Carl it was one of my first topics with na about creative shopping for insurance first oh absolutely um and I've offered to help with that based on my experience and I know they're working on it I don't think we can change one without working really hard at the other the plans you mean yeah oh absolutely options on the plans and and I'm not talking about necessarily miia I'm talking about on the open market well Maya they just told us their rates and their rates are going up 14.3% and and you may find something better on the Open Market Commercial Market not Municipal markets and even pooling with Granville and talland Staffing and making a bigger risk move that's that's you know that's something we could talk about you know I know disc of that's the way we always the way my accomplished it was different spouse does it with her company is that's exactly what they do if to keep people from going to the ER for a hang nail or a snipple you know an ER visits 500 bucks no I'm talking I'm talking about contribution levels and deductible levels and if if I'm a healthy person and I don't have any risk I'm going with a high deductible it's going to cost me less having choices within the planes keeps your premiums down as well well there's other things that I want to bring up you know I'm going to bring up the little bit of stuff in the old business you know s Field's got an interesting different when is the renewal on our insurance when did it Ren um we have a meeting on Wednesday so it's coming up now yeah it was around this time we knew I mean I think we it's at the annual meeting is is when Maya comes out with their insurance premiums and other insurance to too so I we hav I haven't seen oh so everybody's on that has there been any discussion with any other insurance carriers outside of that yet actual discussions not and we I guess we just thing to do is try and reach out to some of those companies and get some people in here and see there's anything we can do maybe reach like Diane said reach out to Grandville well I would start with the insurance companies first and get their appetite actually Grandville and T may not want to go in because they already said they were they they did fix their not fix they're in a little better position a little better position so they may they may not be interested but anything we can again that's why they can afford to buy our truck and fix it we can talk about that after um so again that's that is why I'm bringing this up uh again one of the things I believe in is taking care clear clear is the are residents and your employees your employees can make you make you a break you and I wanted if we can take care of people and do it without hurting us in the in a in our budget you know I would love to to help our employees as wellow these are the these are why I'm bringing these things up so there's that any any further discussion on that anybody okay yes didn't thing close they start digging a little bit deeper discuss nuisance bylaw is item P so we have been talking about this with the North Pond the whole North pound task force you know this is North pound task force thing and all this stuff this is coming here baby so um I know we just got it but I know right before this got put into the um agenda I had sent my version out um so I don't know if either of you have gotten that I know some of the issues that Mr Mulan had been concerned about I I spent a significant amount of time uh working on that nuisance bylaw to address those you sent something out to us sent it to yeah you send I sent it to the attorney you must oh okay my bad I'm sorry so it's at the attorney right now being looked at to see if the way it's worded and written is uh acceptable and then it comes back and I know we're we also I believe going to discuss yours and what you came up with the task force um I did send you the version four which was reviewed by the attorneys and I reviewed it with the chief and lieutenant and have their final input as well okay did you want to discuss it at all uh I don't know where you're going with yours I haven't seen yours I don't know if it's AAP I would like to actually marrying some of your wording and stuff Parts into it to cover it well I'm going to be honest when I read through this I think this is there's significant amount of overreach in this um I came up with a couple things that I highlighted that I I do not like at all um there it is so some of the things that I did not like there's issues with uh in my constitutional issues with the second amendment that I'm not touching those those come out or I'm not I'm not approving anything it wouldn't be you it would be the town meeting but then i' be voting no if that doesn't come over there so the other thing where's that sir um there's no page numbers on these but it would be not exactly sure section well mine are double-sided so I might not what section are you I believe it's section eight traffic where it says use of firearms weapons item F no person shall use carrier possess Firearms air rifles Springs guns bows Arrow slings or any kind of TR dice or any other weapons potentially inal to Wildlife and dangerous to human safety with the exception of to license hunters or authorize patients who may hunt and trap the sick in dangerous animals to reduce eliminate new species I am not touching a second in this is where I go with this I think what the state has done is is reprehensible with the gun laws um and I understand the thought process behind this but I I'm a you know this is why I highlighted I don't like that at all one of the other things that section eight if it is I'm not 100% sure because like I said can I see your this is your this is your most recent version okay show me like I said it's two pages so I'm not sure and there's no num so section eight trap section seven section seven oh just actually other so they got kind of taken out of context or ordered on this seven seven what subsection are you looking at F if it's seven I think it's four F okay yep you're right because number five is right underneath it so that makes a lot of sense so it be four okay so you have to read the pre subject to express written authorization and specific conditions by the governing body charged with oversight of any town of Southwick Park Beach Recreation conservation or preservation areas comma no use of firearms no person shell hunt trap blah blah blah in a park or a beach or on a beach I'm not touching in any other area where it's allowed there is absolutely no well I'm just saying prohibition this is one of these things that I have an issue with so the other one you know recreational activities s section no person shall take part in oret the playing of any game in a park Beach conservation or preservation area involving seven hold on hold on second it's a big document seven what it' be seven b b so you're sitting that any game in a park Beach conservation or preservation area involving horseshoes golf Arrow Stones flying disc balls or other propelled objects in such in areas that may be set apart for such activities so are you saying that you can't play Frisbee on the beach or throw a ball on the beach or again this is where I think only an areas that are set apart for that and if it's within the rules of that Beach it is allowed it is subject to I understand where you're coming from the property and this is to further Define because I like definition passive versus active recreation in appropriate approved areas it needs work because I see he's not wrong but it I understand what you're trying to do but it doesn't do it the way it's written and I'm not trying to promote mine my my public Nuance but that's why it's going to the I hadn't seen this before I even sent yours out or I think mine this is very in-depth I think don't take this the wrong way almost too depth you know what other sections did you have an issue with I haven't gotten that far yet Diane I've got more I want to read and and listen specific it needs more discussion oh it needs more discussion um I would like the chief to weigh in if you approve if he right now on how he views this particular proposed diog Chief any inut or the lieutenant next to him just input General yeah we can hear you or stand up whatever you want to do fine Lieutenant you can join us if you like you participated in this in general like I said I understand the reasoning behind the way things are why they're put in there but I don't necessarily agree with them now which one are we talking about right in general in general in general which the depth of the bylaw and it's we're talking about the bylaw we're not talking about this nuisance thing no we're not talk about my thing yet the task force proposed by my thing hasn't come back yet for any sort of approval or okay determin definition clearly defined I I'm going to speak as the task force at the moment and the chief was on it the fire chief was on it one of the biggest concerns they had was lack of enforceability because things were not clearly defined clearly defined as prohibited activities well that's I don't want to put words in their mouth but when we talked about this this past week um they felt this certainly helped them enforce Our Town Council felt this lets them enforce at the time all of this came up it was my suggestion that we actually put something into a bylaw rather than trying to operate solely on Mass General law okay obviously you know your nuisance bylaw this was a vehicle to do that oh yeah to take away having to go to court having to go through that whole process get stuff thrown out I brought for enforceability purposes obviously it's easier as you know to issue a civil um civil byla that's not gonna help me fine so lot lot easier obviously to go out and issue a bylaw to issue one of those though we have to have rules and regulations obviously to enforce and obviously this has more specificity in it than probably some of you guys are looking for um the issues we had in the past last year were you know your signage down there says one thing the internet says something different so we go down there and say picnicking is not on the sign but it's on something else obviously we're having problems fine problems enforcing those things my voice is actually coming back now it's good so that was part of the reason why I had asked that we go into a bylaw for this and in addition to that I didn't think it was appropriate just to include the North Pond property we have other properties in town obviously that this would be beneficial to um Wally Park some of the other uh you know the gorge is another The Gorge sanowski is property stuff stuff of that nature so that's sort of how we arrived where we are as far as some of the spe specificity you know that came in through the the North Pond uh task force and legal council actually increased the word count yes yes and further defined a couple of things well it's been my understanding anyway since and I want those rules posted up at all these areas but the you know the way I just did my bylaw it says within the town of South and certain things are specified um I I'll wait till it's done then we'll talk about I know the draft I've seen thus far obviously referred to private property which is the major major concern my draft hasn't actually gone out anybody but in the call and that was my mistake she did ask if I wanted to send it to councel so that's why nobody else has seen it but I know Mr Mullan had some issues with private property and how you address some of those things but I know when we had some discussions about the the parking area over there you know I did see some wording in there but it it only in my opinion the the blanket the way and it's not mine over yours I like everything that's in not everything's in there take that back I like a lot that's in there but I think a lot of it just should be based on posting those rules with a little less in-depth I mean there's something like the horse can't walk through a stream and make the water dirty I mean there's some stuff in there that in I I understand Conservation Area where it is not allowed and all of those preambles are if the custodian of the property allows I just think there's some significant overreach in the ways you in that's my opinion um and that's why I want I just wanted to talk about it I wanted to bring up my concerns and then when we get my version of a nuisance just a plal nuisance bylaw back in we you know maybe we can merge the two even more which you said was already Mass General law some of some of it is the Nu the disorderly house that we talked about is a lot of what that nuisance bylaw is yeah that was tailored more like I said for my position for the college yeah because of issues the way I mean Nicole saw I completely took a lot of that private property specificity and defined it clearly as well as the public property because one of the issues that that came up during these discussions about parking signs and whatever is you know there's a few things that are in there and I'm not going to nitpick right now this is all open more for more discussion you know it labels certain areas but you get outside those areas that and it's still affiliated with the problem and you you know under that you can't do much with it I mean you can still do disorderly conduct you still do serving the peace but I want more of that ability to to issue of civil citation you know rather than time you know we know how you do these disorderly conducts disturbing the peace what happens they go to the court and they basically laugh at you and say yeah we're not going to do it all this up for a show cause hearing unless there's a pattern um so you haven't finished reading this version four every single word I can say no how how there was just a few things that stuck out to me that like I said were glaring to me that are are when that happens I just ask that you go back I saw Thee I saw what you're saying I just I don't like that wording whether there's a preamble or not that's all I'm trying to say and I and I just think like Mr movan said it it needs some work and let's not forget the reason that this even came out was because of the issues that happened and it was a task force that was asked to address how to handle those that's what this expects to do I get agreed but I think just reading this again and I'll take take it in the totality at no time at all was and and please don't laugh because I mean this it's a slight exaggeration but at no time did a horse going into a spring or stream have anything to do with a brawl at North Punk correct right so I think that's where we need to get that figured out or you know uh father and their daughter are playing catch on the beach technically according to the way this reads you can't do that because it's not in a designated you know it says where did it say whatever yeah in such or other propelled objects except in areas that be set apart for such activities well I mean if you're talking about a law where you're going to give the police the ability to that the ability and or the option to enforce right you have to be careful with that power the power that you grant and the necessity of say I get it and and and so I I get it I don't I don't want to go off on a big tangent here I just think that we have to take a look at some of that like there's places where you should you know you should be doing this and there's places where you shouldn't you should not be having volleyball at the North Pond Conservation area but if they if somebody stands up volleyball thing somewhere that's not a volleyball court at Wally Park that is not a ticketable offense that's and it's not clear to me from reading this that that's the case so you just have that's where we have to be careful with how you do this that's all okay further discussion okay those are the things I wanted to bring up on that it we'll be provided with that other draft yeah I I that like I said that was my mistake I thought ask Nicole to disperse it but it was only the Town Council so far and then when it's done and again it's more if more blankets some of the other issues that sometimes come up with the no problems with noise um it even allows the whole thing with the Airbnb the way I've written my nuisance bylaw it would also allow us to do more there rather than I did not one of those was more appropriate to to that situation and and maybe these two two different Standalone things which actually complement each other you know but obviously one of the biggest problems we had everywhere we you know we didn't have specific rules up and we only had a little bit that's the most important thing and then like you said it's a lot easier to enforce stuff because you know I one of the things I learned when I I got on this board is you know Celtic being an exclusionary rule technically if it's not listed you can't do it but then people like well how the hell am I supposed to Zing zoning is it just the zoning zoning yes all right but still again people if it's not specifically it's also for B enforcement if we don't tell them it's illegal they can't go arrest somebody for doing something the opposite that's the opposite Right Noor follow me if zoning if our zoning doesn't say you can do something you can't not saying that you're well he's talking about when what you just said is the is the opposite I just want to make sure that we're the same page here if if it doesn't say you can do something doesn't mean you can right so theirs are more like you can't or shouldn't right that you cannot exceed the speed limit if you do you're going to get a visit by earning right in in but in in zoning if it says you can't you know if it says you can do this then you can do it if it doesn't you can't it's it it's not a subtle difference it's a huge difference this this is making things you know enforcable by ticket or civil infraction or or or even a criminal infraction however you want to look at this right but it's this is delineating what you can and cannot do or specifically what you should not do those specific areas I understand not across town no I get it no to your point but okay yes you're right in that regard not on the no no no I get it right and my my interpretation leave SCH rules incorrect I didn't no that's all good I just want to make sure we're all talking about the same thing so you know it doesn't appointing Diane J great unfortunately this wasn't um advertised as a joint meeting so we will not be making a full it is it is a joint appointment according to the law that we were reviewing today is it not Diane um I don't know if that means a joint meeting or we have to do it separately because we didn't make this a joint meeting no I thought I looked at the law and I don't think I didn't think that it was a joint like you had to do it together think this appointing the um appointing the associate ass but to fill a vacancy is not a vacancy occurring otherwise than by expiration of terms shall be filled for the unexpired term in a city in the same manner as an original appointment and in a town if the members of the board are appointed in the same manner as the original appointment if the members of a planning board are elected any unexpired term shall be filled by appointment by the board of Selectmen and the remainder of the members of the planning board until the next annual election at which time such office shall be filed by election for the remainder of the unexpired term right but do we have to do it joint doesn't to be together it doesn't have to be together but we're not going to be done with the process tonight because this isn't a joint meeting between so I'm not voting tonight I'm just here to make sure that it happens because we will still be you can do we will not be voting on anything this coming Tuesday because she will not be fully appointed up at that time but if you appoint her at the first order of business right she would need to be sworn in so I'm not going to ask our town clerk to come in at 7 o'clock for that not when we don't have anything that has to be voted on at next meeting but it's um going forward we really need to put out a request for volunteers to come before you to be appointed up um we can operate to a certain degree with four members but it will be quite difficult going forward if one is missing if one is missing we all are familiar with the Mullen rule which allows you to watch the recorded meeting minutes and vote on an item from that meeting but you can only do it once and sometimes we have uh public hearings that last for months if not years so we don't want to be running that a foul and having to restart public hearings if we don't have to so I would just ask that you guys make this appointment tonight as well as I don't know if there's something that we can put together on our social media page and put out some so that people in town are aware that we are looking for help and assistance on the planning board because we don't just need this person we also need an associate member and the cliff Clark from the newspaper is usually very helpful with that as well I yeah it's great I'm you know Cliff is great for getting information out there but I do also would like for it to be officially requested by the select board so that it is serious and it can be taken and we're not um running the risk of having openings for a long period of time as through other appointment processes agreed and Diane is here online we would be asking for her to be appointed up into the vacancy left by Mr Sutton she is willing to do the process in the coming months to run for election this may and understands that she would have to rerun at the end of that term which would be four years from now as opposed to the five-year term that Mr DH is leaving open so that just needs to be tracked so that when election time comes up everybody knows when their term expires that be on the ballot which one she was yeah that would be on the ballot that's our intention but when it comes to you guys looking for people to come in and join us they ought to know what position they're looking to go into correct yeah correct yeah I don't think we really need to go into any discussion uh does Diane have anything she wants to say on her behalf um I'm just go ahead thank you I'm excited um I think this past year has been um a great learning experience I am um very proud to be a part of the board so I would U very much appreciate an appointment as a full member thank you I am happy with Diane's attendance and her attention to the issues um she has been very thoughtful I know she has asked kind of in-depth questions in reviewing what bylaws you're discussing or what even in your decisions and looking at particular line items and I'm trying to look at Diane and to her as well um so I've I've been happy with what I've seen there she also attended last year citizen uh planner training collaboration and did the required um courses there so she's doing the work on the back end as well anything from you no thank you for the point about I didn't know that there was a joint appoint thanks for doing the research I I will thank my prior chairman for assisting me on that and making sure I had all the correct legal things going forward I there will not be any balls dropped as far as to be confused with this one so we got uh two Grandin Awards this funding cycle uh for two cover designs and pering U this one on uh pearlbrook for $150,000 make ation J to um what do we have to do to have the chair sign the grant approve and assign the grant Brook CL replacement yes that's at Ving that's at Vining Hill right Ving Hill and correct motion second roll call vote Jason per I thank that haven't been able to download all the different Workshop stuff that I want to go over um I wanted to ask Mr MN here your understanding on the accessory drawing units the way I read that and the way they presented it was if you're in a residential area and you need a special permit you've got to justify asking for a special permit yeah they they're going to allow it by right by right and the town can impose certain unreasonable conditions and the state and will have the greater power to decide if your your thoughts are what are reasonable or reasonable so that's the only one I really wanted to address because I know the planning board has been talking about it and I saw some U comments on social media people were talking about it so I just mentioned you know planning board's been looking at this go back and watch the meeting and you can get some more information so the only thing they did that on Tuesday yeah y presented the first draft which was pretty complete well but what was interesting like I said Mr M said some of that stuff that they already talked about if it's unreasonable and it's going to limit things too much it's you know typical State stuff sorry we're going to to Trump you um so that was really it for new business that I had none for me uh South Land Trust townwide cleanup April 26 Mark mark your calendars they're going to do that again this year um I talked to Mr ma Williams and he asked me to publicize the fact that they're doing that again so people slow down out on the roads on April 26th and hopefully um I can guarantee it's going to rain on April 26 judging by last year it was yep in half the town it was beautiful in half the town and pouring at the South End um and then also I read in the paper and there was a release and I think that this is a a very important thing for the town um because it was a request of the uh I had made to the economic development um committee and so I'll I'll reemphasize that request again that Jordan's healthc care is closing um and that I think when Dr I don't remember what it was called I call it Dr King's office but when that practice left um a few years ago and that building was vacant for a few years before Jordans went in there um that probably would have been the first time in the 250 year history of the town of Southwick that there was no doctor in the town of Southwick um so the loss of Jordan's Healthcare whether you were or weren't a patient there um is significant to the town as far as you know where you have to travel to go to you know for Health Care uh whether it's to an adjacent Town adjacent state or or worse if you're you know have to go to the emergency room as we talked during some of our insurance discussions earlier um to me it kind of boggles my mind that you can be next door to a thousand people that Pati are patients or consumers of Healthcare on above the average line more than likely yet that medical practice hasn't been able to find its footing so uh I would implore us as the appointing authority to the economic development commission um to implore them if they're going to be advocates for businesses wanting to locate in the town of Southwick uh get us a doctor you know there's one in Granby there's one in Westfield but yeah there certainly seems like there'd be a need um Andor you know a and and you know I talked to my GP about this you know why there's a shortage of doctors especially general practitioners and a lot of it has to do with shortages of internship or whatever you call that residency programs at Major hospitals that slows the production if you will of uh GPS and then all the other medical students want to go into a higher paying Specialties than GP but um you know certainly towns like us and you know towns west of us that used to come into uh Southwick for the doctor I think that that's a significant deficit that we need to address and we already have you know there is a standing facility that's in pretty good shape for that use that's it for me thank you so now we're on to Old business only I'm sorry so the only thing I have for old business is um myself and Nicole I went went over and the lp P problem is should be solved um they they had been advised they are not getting a member on the concom and they're going to have a strongly aison that can have full discussion and input but just no vote um and we're just waiting for the the the proper legal yep forms to come from them Tom from that buy um so that was like my that was my big one and I don't think I really have anything else as far as that goes but we got a couple things we got to deal with so I got one brief one on the master plan implementation committee um on the charge that we had approved jointly with the planning board um I do have one typo uh but the chair of the mic brought this to my attention uh we say facilitate the identification and prioritization of common master plan strategies across the various lead and supporting parties which if you approve should say actions not strategies the strategies are by chapter you know the strategies are by chapter and then all the actions are where all of the parties are participating to make those strategies come true um so that that looks like a scribner's error this line this word would change to actions from strategies I couldn't make that unilaterally so haven't used scrib since the last time there was no doctor in the town of soua so if you appr so I'll make a motion to make that one change the the typo on the word and change strategies to actions motion Jason I Dan I sure and the top and the bottom 15 and if you fill that out and send it back to me I'll accumulate the data and then I'll get it back to you so you can prioritize that and then we'll take the middle section whatever that is I think that's I think that's a great approach I think it's the 18 I think you can handle if you want to second I can do the work if you want to do top and bottom 10 but I think 18 you probably can do I think that's reasonable other than that we're off and running and creating a lot of activity yeah who's doing the zoom for your meetings somebody forgot to turn the camera on first one or apparently and the second one the camera so uh as the appointing authority for for that um I've always been a big proponent of hybrid meetings and a that but part of the benefit of having the hybrid meetings and this type of stuff is the recordings that people can watch them on YouTube the day after the week after or a year after um and I think that a lot is lost in context when you don't have the video so um if there's any member of your board or there's or a majority vote of your board to not videotape that I'd love to come to the meeting and make the argument of why they should do it um there was also discussion at MMA this just this past week about finally passing legislation to um permanently make um remote participation um permanent in the Commonwealth yeah and but uh I will say that even if we can't have remote participation that so you had to be here to be a a an active member of a border commission I would still have this so that folks could tune in remotely to take the meeting in under the open meeting law and then preserve the recording to present it on YouTube it's just good transparency I totally believe in that I apologize I just learned okay um yes s not as well Mr chairman is there an update from Miss fil on what we had asked to be done before this meeting Miss come on up to so the first week I have to apologize I I did reach out to a few fence companies but my father was in the hospital with Co so I was dealing with that but um I finally set it on Hastings which I didn't want to because they're super expensive but they're coming out um I put a deposit down with them and actually they don't I can show you the email they don't have an actual date because they don't do that it's like one to two weeks out and we'll let you know when it gets closer kind of thing CU I got to order the parts and everything um minimum amount is $400 and he flat out told me at my house that this isn't going to cost anywhere near $400 but that's the minimum they charge so I have the invoice I have the payment and he actually while I was here sent me an email saying that he I was just reading it while I was waiting which I think it's a good idea and just to just to be clear he said that what I did looks good but I said just do it because I don't I just want to be done with this I don't want to deal with this anymore I'm tired and stressed and um he said we have a vet a veteran excuse me a veterinarian installer who has a lot of experience who wants to be able to come out and look at the site I would like to send him there tomorrow just to be able to give a second opinion no cost for you to have him come out there and look at it he won't be doing any work tomorrow or is planning to but if you're okay with it a free second opinion then I'll have uh the installer come tomorrow too so I thought that was a good option as well so it's all booked up just waiting for them to tell me when they're going to send them out and what is it they're going to do I don't know yet I have no idea okay well there's nothing to inspect correct I mean she did inspect the latches which is what the auto lock which is what you guys wanted and they were working properly when she saw them so I mean and he did say that what was on there now is working he you know we looked at it together add something they're gonna com I don't know what they're going to do I put the tension rod on which was not required and I put the latch that you guys saw the last time around and he's just going to order parts that are specific for that fence that will do the auto locking and the auto closure I said just do it just get it done on both gates I can pull up the here's the $200 deposit I had to put a $200 deposit down for them to book it and here's the invoice so he looked up both that fence that side and that side replace gate hinges and latches for single Double Gates with new hardware all right so they're going to put new they're just gonna replace everything I did they're probably going to take off and do whatever they do have the dogs been out the dogs have not gotten loose now and I I just want to reiterate again that this isn't about the Doberman this is about the little one and to be honest with you the little one jumps the fence he's not going to learn to open the gate he's just gonna jump it so he's been on his lead since the first time you told me to put him on his lead once this Hardware is on he still needs to be on the lead absolutely he's been on the lead and he's staying on the lead yes I understand that he well that's why I'm I'm saying to you the gate lock isn't going to do anything with him because he jumps the gate he doesn't open the gate he jumps the gate so he is on the lead he's staying on the lead and he has his Wireless there's also a wireless fence that's installed as well so I have a a fence company coming out I got a vet coming out I got a wireless fence I got a lead outside of that I don't know what else can I ask what veterinarian you have coming out I don't know I just I just read to you exactly what the guy sent me I just read exactly what he sent to me interested to know what veterinarian has the time to come out you can read it yourself I think he a veteran veterinarian I didn't think it would maybe maybe I heard it or why okay well regardless there's a second opinion coming in what anything I just want to reiterate that the actual fact that of the reason that we are here in the first place and that is because due to miss fil's lack of um complying with any of the Town ordinances state laws anything like that her dogs terrorized a bunch of preschoolers and not fact is um not only did they terrorize these preschoolers they terrorized this woman who was taking care of these PR and for some reason we've gotten on to this tangent of being having offense be more important than accepting responsibility for the fact that her dogs have taken off and terrorize these kids along with and I basically talked to as a matter of fact I ran it to somebody else today who has had experiences with these dogs another neighbor has had experiences with these dogs and it's not just one it wasn't the first time right it's not the it's not just one dog it's both dogs can I start recording this now excuse me I just want to make sure that has happened since that it has not happened that we know of since okay that has been reported since um has happened I don't know the last time we were there the Dober came right up to the fence there was no there was a track that the Doberman made from the fence the Doberman is allowed to go to the fence Excuse Me Miss Fel the Doberman had a track that went all the way down and all the way up to the fence there's nothing preventing that dopman from jumping the fence climbing the fence doing whatever um but like I said I just I wanted to to Circle back to the actual reason why we're why we're all having this that we have dealt with this since March of last year Miss fedel has had more than ample opport unities to either um plea out on her tickets or pay her tickets but again it's just been a complete you know disregard still over right now they still haven't been paid they still haven't been addressed they still haven't been appealed nothing so on the letter that we had um under the conditions and I do realize it's gotten to this point but on the letter that we had according to with the the conditions of compliance was that if she did not we take dogs I have no problem taking the dogs until this fencing thing is done I am really tired of coming here every month every you know however many times we have to come here if it if it comes down to it where you know if you put the fence and we won't make you pay your fines that's been ignored because the fence is not in there yet so at this point what option do you see there there's nothing that is not going to keep dragging this thing out um we had it in the letter that said if you do not comply ACO has the option of taking your dogs until such time as the fencing is up be saying it's going to be like two weeks awesome but again it's up to you but I'm at the point right now this is insane how many times are we going to drag this out in that First Agreement right weren't both dogs supposed to be on leads yes yes electric fence and lead and CER can I no now we're done far that has not happened we went out your admission that has not happened we went out the do was running around I don't know what else to do because obviously there is no respect for what you are asking her to do I tend to agree with you and there there's no acceptance of responsibility no there is none I'll do whatever you tell me but there's no acceptance of responsibility it's not my fault somebody didn't help me do this somebody didn't do this for me no it is not up to me as an ACO to fix her fense and and this isn't about you and hers responsibility of what could happen if those dogs get out right we've already seen preschoolers terrorized and if that was my kid I would own her house I would have her paycheck if that was my child or your child that was terrorized by these dogs I would own the house so how how do we put an end to this how does this conclude spe yes just can we get a lead for the dou okay can can I talk now because just ask your question the the lead for the dobern was talked about in this meeting and it was agreed that that was not a good idea because someone here said that the leads would get twisted I never it was never agreed that both dogs would be on the lead I believe that was in the letter we talked about it it was not in the letter what was talked about was that the Doberman has the wireless and the wireless I can only adjust it so much because my neighbor has the same one it's a wireless fence when the I don't know what they call it when that that barrier crosses it knocks each other out so in order for me I had to walk around my house putting it in different places so that it didn't affect his I called the company there's no way to like go around it or reprogram it so it's on a different channel the only way I could get it was that so it's halfway through my yard I have video of me with the collar in my hand where it goes off halfway through the front yard so even if she got over the fence she's going to get hit with the electric as an after in the middle of the front yard I can't get it I'm going to have this dog in a space this big to get her not near that fence and she didn't jump the fence and as far as terrorizing the kids that is not what happened there was one child there and I did take responsibility I talked to the woman we talked outside here I apologize I offered to pay vet bills you are after me and not for nothing when I come in here and you're joking with her and laughing with him it's very unprofessional and it's very biased because it's like I feel like the whole town is against me I did what you told me to do I she called me asked me I told her what was going on with the original Hardware like I said the last time we were here and she said nothing she said okay I got a letter to come back I called and either talked to I'm sorry I get Nicole and naen mixed up I talked to somebody and said listen I can't make it this day what day can I come come Tuesday I came Tuesday I told you all about that I called immediately I probably still have it in my phone left a message and said look I'm here someone must have gave me the wrong date I'm sorry I don't this I've never been to a board meeting in my life I've learned more in the last how many months about how this stuff works came here on a Tuesday it was the wrong day didn't never heard back from anybody the the next thing I know I have a a police officer calling me telling me that the that he doesn't want to send the fines to court that he doesn't want to go there and suggested that I I reach out to the board which is what I did via email and see what I could do and that's what I did I don't know I I don't I mean okay everybody I've talked pretty much hurt both sides so I I've listen to both sides I'm not inclined to take anybody's dog away if there had been another issue I probably would have leaned that way me personally I'm not inclined to take anybody's dogs away I'm not that's I could I I personally can't do that to somebody um if I guess that's why I asked if there had been an additional incident um well whatever you guys decide is okay but I'm going to tell you right now I take great offense the fact that I came in and said hello Dory I also shook Mr de's hand when I came in and Mr Johnson's hand was here last time it was last talking about chickens and Miss enough so when when I come in here 10 minutes before the meeting I'm preparing for a meeting and we get down here it's all business right we didn't joke about any of this this is not a laughing matter you've been the one that's been completely irresponsible as a dog owner and why we've been here at least the third time you can shake your head all you want you were I I took all of the abuse from these guys and the ACL and the cops for being so lenient the last time and I said oh she means well we'll let her come back oh we're not even going to meet for two weeks so we got three weeks to get this done and then I don't know what day it was Wednesday or Thursday we get the another song and dance of why what we had asked to be done should have been done in a week wasn't done in three so I'll leave it to these two folks to decide what's going to happen from here because apparently whatever I say doesn't doesn't resonate with you other than the fact that I said hello to our ACO and the other folks in this room who I've been working with or known or been friends with for I don't know past 15 or 20 years can I say something by all means it's intimidating for me to come in to feel like I'm against like I have everybody against me and when there's joking and laughing with her who I I don't know how anybody here I don't know how anybody here doesn't think that she has it out for me because everybody I talked to can't believe that this is still going on can't believe that all the steps that I did do that nobody's recognizing that I did is just being thrown out the window because it's not exactly what was what was asked of me because it didn't work it didn't work and you asked me if I came up with any issues to let you guys know over the three weeks which I did my father was in the hospital for a week he's 78 years old with Co I was dealing with that and I was waiting for this woman to get back to me we are playing phone tag which I have it's like it's not excuses it's reality let me make a correction nen did show me the original letter both dogs were to have the electric electric collar correct and the one was to stay on the lead correct and when I went out so the issues are the fencing needs to be secured they need to remain on the remote cers and the lead even when the fencing is secur and the fines need to be paid do I have the option to take the fines to court you don't pay them they will be I will do that then I will do that and I will get I'm going to look into a lawyer I I I can't do this anymore I feel attacked my anxi I'm shaking my anxiety level is through the roof I feel like everything I'm doing I've whatever I I'm I'm I I can't keep doing this like I can't I I don't know what else to do and then to come in here and you threaten that you're my dogs are going to get taken from me I I my my door woman cannot even enjoy her yard taking the dog I don't remember seeing that at all I think that was part of the discussion as an option right and it was on it was on the in the right it might have been in the like about right worst case scenario type situation I'm done M Fel has proposed to acquire council at the next meeting if we continue this we shall have councel we're done I'm done on this issue say that should the provisions of this decision be violated the Animal control officer reserves the right to take the offending dogs into immediate custody until such time as an appearance before the Southwick select board can be held all impound all impound boarding fees shall be the responsibility of Miss FAL these ordered measures must be implemented to dispose of the matter and this um order was issued on August 26th so it's been five five months now so an option is to take the dogs until the fences are secured because nothing my opinion on I'm not going to take anybody's dos there's going to be another reason in two weeks when she comes here again that it's not done either the fence company didn't come out or they don't have the parts and what happens we just keep pushing this off that's why I asked if there had been another incident if there had been another incident this to me this would be cut and guy I'm not taking anybody's off if this if this was a I have a question why is it in there that I have reserved the right to do that you still have the right to do that okay but I'm not going to do it I think we're done she's she she's threat she's not threatened she's promised to retain counsel at which point we should have council president any fut and you know whatever the board's decision from there should be in writing and and delivered via service to miss F she's proven that she's not going to do what she said she was going to do and I did what you asked me to do done next time we meet we'll be in front of council probably in am are my dogs getting taken I'm Sor I'm not t she's free to leave she can go can can I ask a question does the ACO have the authority without our say so to retain those dogs um I would have to look at that I don't think so and I think she I don't think she has the right to go on on private property to take a dog if they're doing what they said they were going to do within the confines of what we've all agreed to so far I'm not a proponent of taking Miss fil's dogs you know and I've said this a hundred times I'll say it one more time for everybody who's listening EV the worst part about being a selectman is a dog hearing is a dog hearing the absolute worst and and I've seen photos and videos of dogs absolutely mauling other dogs and people right and 100% of the time it's the owner's fault this is all your fault okay step up and get it done I I did nothing's happened since then we're done for tonight we're donee thank you all set all set thank you s's job description and posting it's just a placeholder we don't don't have anything going on any other old business n um we are interviewing now for the clerk in the town clerk's office the clerk in
