A lot of attention has been given to the issue of retail, cannabis, but I want to speak more to the issue of the cultivation and manufacturing that would be going Cannabis gives off an order that is sometimes described a key. The proposed ordinance suggest that orders from cultivation and manufacturing, not time. Discernible be on the property line. These are nice sounding words, but other cities have found that they difficult to enforce. One person discernment is MAY differ from another and occasional testing does not capture issues. The residents of the vicinity encounter every day. I'm aware of the environmental problems that are with the cannabis cultivation in Santa Barbara area. Residents in the area complained that the smell of pot wafting into their homes, even with their windows, closed air conditioning and has affected their health. They say it's caused their eyes to burn. Made them not seated and triggered migraine headaches. It was especially a problem for those with asthma or other medical conditions. If the inspectors come out and they failed to detect cannabis older at the property line. I understand Amber has experienced similar problems. Communities are beginning to require specific equipment such as carbon scrubbers as a condition for approval of cannabis cultivation. Thank you, sir. Case will test to see if the orders can be discerned at the property line. There has so far there's been standards of conditions that require no orders be on the property line. When I looking through the first draft section 6 65.0, 8, 1, 0 light manufacturing, which is oer 15,000 Square feet of manufacturing. There are no standards and conditions about odors. So that is my question. Why is not the larger? Facilities required to have odors only in there inside their property lines. And yes, and I like it reread are letters that we sent in. We sent into. That isn't always going to happen in that same And we also got to think about the increase isn't being That leads to a lot of damage when we're talking about particulate matter. Also talking about increase accidents, increase test for more traffic like that. And the other thing I'll just want to say, too, is that a lot of those parcels that would be lost with those commercial districts, they would include most of Celtic, most of pain, most of arcade, most of race street, almost all of grand large portions of east, 7th and West 7th. These are commercial districts that really need our support. They really need to have more businesses in those locations. But I wanted to point out that the fencing is extremely close to the side of the building. There's really no room in between that fence in the side of the building. Here's another of the property, the side of it. And these are taken. Excuse me, MAY of 24. So these were just a few mnths ago. And you can see again, there is the fencing and here which is really hard to see. But it's in your record as well that the fencing has been cut away and portion there. The most recent thing that I would bring to your attention is and it's also the record as we have what they call a form for and the form was brought forward by the fire department, too dsi and what they talk about and it is it's a property type commercial. This is a vacant commercial property. Previous Burger King that's been boarded up and fenced vagrants of cut through the fence in multiple locations that have gained access into the building via broken door on that. a slash deep corner. So when that gets submitted, there's of course, additional follow-up that happens there. My point bringing this up and having you see the pictures is that is. a little bit of an indicator of how things deteriorate over time. We have it coming in the vacant building program in 2022. 2023. It's already a candidate for removal repair just because of that. And here we are in 2024 hopefully being able to bring some things to a close. Unfortunately you can tell we have history of some difficulties. It has definitely gotten better since he's been in the river repair process. But difficulties to continue. People continue to cut through the fence. There I believe, prior to the removal some mechanical equipment, out of the kitchen area. And I believe the entire property has been stripped of all electrical wire it to te pool. So that has an impact. Wanted to give also sense of the difficulties that were acquired cause of the site. The personal immediately to the was the home of the gas station. And so think that would be working with the owner wanted the House and environmental analysis conducted a phase. One environmental analysis was done and I justified a phase 2, which brings us to sampling. That sampling indicates no further abatement action is required. It will require it. As of right now there's a summer tested test and the cold weather testing. We've got the warm weather testing done and they want to do with cold weather tests as well as I understand it. Here we are I'm looking for direction. If you want to have MAY continue working on it, they have got purchase agreement that's gone through. Many iterations while these individual complexities of them worked out between the buyer and the seller, you know, so everything who's paying for the testing house that can help them through. What's the insurance claim that look like for the wiring replacement and so on and the salt to complicate the transaction at the same time, it's been 13 months since you saw this first. So, you bring it together. This time. I think it makes sense. We have sellers here, the purchaser somehow was under the impression that the hearing was at 4 o'clock. I that We do have the interpreter present. So and I believe we have the seller's broker present. We do have some represent or the buyer's broker. Excuse me and the sellers as well. So I would say. And when did they become the legal owner who now is responsible for dealing with all this? I believe they have been the legal owner for quite a while and that this is a case where the franchise he did not own building in which is located. And if the council were to order the demolition of the building. I'm sure the buyer will back out of the sale. The seller will then be in a position of having a very vague, a vacant property subject of further deterioration and then was so the best hope for this property to be a benefit to community and the local community. As for the building to remain the sale completed and the local buyer of the property who is a local entrepreneur who ran a successful restaurant operation there. The universe, Minnesota campus wants to reinvent so that product that property want to reinvest in this property and with local ownership. But a successful business practice behind Im confident. I'm sure she's confident that she can make it success and a real benefit to the neighborhood. So we would urge the council not to order demolition to have the legislative hearing. Officer continue to work with us and put us on a short leash even shorter than we've had before. But been I think, very cooperative and tried to 2 answer every question and every quest for information by the city and its representatives to bring it into compliance to make it safe during sales process. 6 amendments have been made to the purchase agreement that shows the commitment by both the buyer and the seller to the sale of this property. This property has become a serious flight in the neighborhood has been on the vacant building program since AUGUST of 2022. 2 years now. And there have been like over dozen different work orders issued has fallen on city resources to keep this property looking like it does now, which is not great and which is attracting for their vacancies for for the vandalism and really a detriment to the neighborhood and hear about it more often than any other property. In my word from the neighbors. And I see it myself. I live in the neighborhood. So this source of some frustration to me that at this point, we still after 2 years do not have a purchase agreement and we do not have meaningful progress toward rehabilitating this building. So Ms Harman, I came here today prepared to proceed with the recommendation to raise or remove which we originally considered over a year ago. Now, I could be talked down from that if we could get some sort of nuisance abatement plan. At some indication that the rehabilitation is actually proceeding short of that. I think we just need to fish or cut bait here because this has been ongoing nuisance and I frankly don't have the same sense of the commitments to actually making progress that i hear being talked about. I don't see it. So I I would be open to your recommendations and I'd be happy to discussed with my colleagues here, too. The council came to a similar juncture with the Burger King on West 7th Street that was taking a long time, too. Get a plan in place for its rehabilitation or removal. Eventually that that building was removed the purchase or wanted to use the site, create a medical building. And that's all for seeding nicely. But there was that interim period worth deal had not yet closed. We weren't sure if the purchaser was going to want the building are not want the building and the problem was that people continue to go there to break into the building, to dump things to hang out there. And it was attractive nuisance or plain old nuisance property. So the council put into place a nuisance abatement plan. And that does include things like fencing and lighting and security system so that those could be in place too. Mitigate the likelihood of additional. happening there so that I would say you've got remove or repair. Some sort nuisance abatement plan that would buy time. For there to be a decision on remove a repair. And then you've The conditions under which. The council could say, yes, you have time and those have not been met yet. Those conditions would include closing on the building needs a new inspection report. All the electricals gone since the last inspection reports. scope of work. And evidence of financing to execute that school bus. So. So that's the package. The question my mind, how quickly can that be brought together? I know there have bids made for Trying to identify number that can be attached to the damage with all of the wearing being pulled. And a legislative hearing. I heard one was 150,000. Another was 250,000. And so that's a lot that needs to be dealt with. I did talk with the building official about. What kind costs would probably be associated with establishing electric sufficient to power waiting on the site, whether that be permanent lighting on or motion detector lighting and the security system. And that would probably be, you know, under 10,000 his thinking just just for that purpose, not we were in the building or anything else. So getting a contractor in place to do that. He was estimating contractor supplies finishing that job. That was more like a 6 week. Kind of an ever. 45 day us as opposed to fencing, which is probably more like a 30 day endeavor. So I would ask that. If you want to continue this and give the chance for either an abatement to plan to be put into place, meaning getting that fencing in that. Why are you know, they have? Lighting them. A security set up. It's a place holder. You could do. You can send it back to legislative hearing in a month. Review it for that purpose and we could send effect the fllowing week with a report on whether you have got a big play whether you don't you could do it for 6 the same kind of thing. Realistically, if the council were to go with the removal of the building. It's going to If you just 15 day order 1 days for them to take action and not and the city would have to fit it. The mc is gonna have to clear the building and the contractors can have their gift a bid for the contract or they're gonna hve a period of time which execute that. So you're really looking at couple of months anyway in that process. becomes that. 30 to 45 days is. Probably Terrible. At this juncture. Just not getting the job done. present just to clarify this woman you're talking about sending it back to legislative hearing. To develop that sense of payment plan. I would ask the council to find the nuisance abatement plan and those are my 3 suggestions for such a nuisance abatement plan. And the legislative hearing could be a place for that would be to its execution. And there could be a ripple effect on So we would be knots voting to rehabilitate and he would be staying that pending the creation and completion of a nuisance abatement plan and some sort of meaningful progress toward. Mean, I agree with you that that stays damage it's doing to the neighborhood now somewhat. What about the progress towards the actual rehabilitation? The council could. Tied to that and say if you do this, if in this period of time, we will give x number of days to bring back it completed package. So you're yourself and extensions what it would be and we would make that determination as to number of days after we reviewed Houston. Incomplete. You send it to me. I say, yes, you've got a solid nuisance abatement plan. No, you don't have anything for you personally have one. If they have one. Sees its. You have stays now to finish up the plans and all other work if they don't have one. You could be forwarded through full repair. If they have it in that same period of time package put together and they're ready to go out. Well, that's also It's that in between that. We are in the So I and not sure exactly had where the motion, but I'm comfortable with that proposal to require a nuisance abatement plan and that this compact legislative hearing and come back to us. And it's a refund. 5 weeks would be my preference can you? Portsmouth that? Yeah. And I think while we're coming up with that, I would just also to speak in support of the direction we're going I would have. Someone is not as deep in this case. I would have loved for the person who wants to come and reinvest today to have been here to present that plan to show how they're going to do that to have a game plan for the issues of that need to be remediated. And for all that to just be ready for us to go. I think we all want to see these dilapidated properties across the city turned into better use. You know that it's not our first preference to just have something to be raised and nothing there. So we also can't just indefinitely weight on the promise of that. I think we need to see a plan. I support COUNCILMAN Acre in the direction she wants to go. Whatever motion me to make for that would be willing also vote support. And I appreciate that point. Trolley and yes, I completely agree I I would prefer to have have a vibrant use there. And I grateful that there is someone who's interested in investing. But it's been 2 years. And the vast, all the electrical due to vandalism. Yeah, just a quick note. What you all are aware of vacant buildings, something new since regardless of any property losses experienced by owner. Certainly there's cost associated with that last, but there's also live. The person still in the wire can badly hurt selves. People coming into buildings who are homeless and drinking and, you perhaps starting fires to keep warm. That's that's a problem. Al of that is public nuisance that the council needs to be mindful of as well. All right. And asked the council refer this back to legislative haring on OCTOBER 22nd report to council OCTOBER 23rd. it's a hair over 5 weeks, but that's the day we have a for repair schedule. And that a nuisance abatement plan. Would include installation of black final coated fencing along the southern border of the parcel at least 20 foot set back from the northern side the sructure and the one the person boundaries to the east and West extending to at least 20 foot setback established along the fencing of the north-east got the nurse. Facing parking 20 feet from that side of the building into the parking lot. There should be fencing. Otherwise it's around. First us.
