Good afternoon council PRESIDENT Council members, I'm young hands on the dbt manager and the Office of Financial Services. I'm here to speak on the resolution. This resolution authorizes the issuance and sale 6.5, 7, 6 million dollars in tax exempt recycling and solid place revenue bonds, the bombs to be used to purchase a facility at 60 West which will be collecting 10% of residents, a recycling and solid waste. So the this resolution actually awards the sale to Huntington Bank, which had the most advantageous offer for the city. We had an interest rate of 3.9 5% with a 20 year term. There's a clean and solid waste. Fund is a revenue credit. So this is similar to our sewer or water utilities. So they revenues are used to secure repay the loan as opposed to something like our property tax. resolution also creates a legal framework for the ability for us to issue debt for their sake and solid waste fund in the future. If we need to. And I want to thank all our partners partners in finalizing the transaction. So that would be Ballard Spahr Ehlers Huntington Bnk Dorsey and Whitney and of course, all of our city staff have worked read a lot on this transaction so that the public works. Give the council update on critical work underway regarding Suboxone and through Saint Paul Fire. So I want to welcome Assistant Chief Samson and Dr Erin Burnett to give us just a brief update on this item. Welcome. Thank you for being Council PRESIDENT Council members, thank you very much for the opportunity to provide a brief update on sub auction I'm super excited to kind of on bail some additional information. As most you recall, I believe we met end of MAY beginning of JUNE. I kind of give an update to just what we're seeing and experiencing across the entire city as far as opioid related incidences and ems specifically and how it's impacting not only the fire Department Police department, our public safety partners. Certainly our regions and hospital, local hospital partners. But I want to just take a quick second and positive and say thank you very much. Particular council, PRESIDENT Council member acre for for really driving the conversation establishing some of the relationships. And given us an opportunity to really push forward a medication that is literally going to save lives. It's my distinct pleasure to introduce DR. Erin Burnett, Dr Burnett is our medical director of the Saint Paul Fire Department also works on the region's hospital here in the city of Saint Paul, DR. That's going to speak a little bit to the background of how we got to where we are today. I'll speak to where we're at as a farce department in the deployment of spots on life-saving drug. And we look forward to the conversation. Thank you. Councilmember saw my name Erin Burnett. Thank you for giving me the chance to speak to you. So we're presenting to you today. A program that's designed to address something that we're seeing with increasing frequency on the streets of Saint Paul. And that was individuals who suffered an overdose who are treated appropriately with Narcan. But one of the side effects as Narcan is it can put you into throes of withdrawal very rapidly. And so we're in cowering people. Whose lives have been saved by Narcan. But we're now in the throes of addiction, reached and throws of withdrawal and feeling very, very uncomfortable. And we didn't have anything really to offer them at that point. Other than transport today. That's not the case. Today. We have a fire department. It's going to be able to offer initial doses. Sboxone to those patients in the streets of Saint Paul when they're at their most vulnerable at their most sick. When we can make the biggest difference and helping them to feel better. Be on this program a couple months ago in his move very fast. This was a complicated for them to get up and running. So boxing is a controlled substance. So require some coordination with the dea to staff on our ambulances. We also have a suboxone advisory committee at Regions Hospital that advise the group. It's composed of all providers from emergency medicine, ems addiction, medicine and toxicology. We're working with the group out of California that's been providing us a box on in the streets through their ambulances for a couple years now. They publish their results in a peer reviewed medical literature. So I do feel that we are still out in front of a lot of communities. We are following on the good work of some people that have done this before us. And that's one of the things that helped us got to the point we are now so quickly. So I can assure you there will be a physician. All eyes on all these cases. We will be reviewing each and every case of Suboxone administered by the fire department with our peer review committee. That again is going to be composed ems, emergency medicine, toxicology and addiction medicine providers. And with that, I had to take any questions on it. But to over the Chiefs, it's been a quick process we've done and we're very excited to get started. Thank you. Speak a little bit to where we're at as far as the department. The big thing is communication right at making sure that the information is out there for folks so that when they're encountering an individual that is either through precipitated withdrawal and is is suffering the administration or endorse me. That's trying to kick in opioid-related addiction on their own. They haven't used in approximate 12 or 18 hours, whatever it might be. And all of a sudden other started becoming really, really sick. This is a resource that's for them. We're being very methodical in. How are point that some with controlled essentially was axis medication for a couple reasons, one so that we control exactly. The information we're consistent with it. And and I will consist with how it's applied. And who receives a medication. This is an option. That's all it is. This is an option for our community where they have not had this. And the previous bill said it setting specifically in the past. They now have that now. So again, those 2 scenarios, right? Someone that receives Arkansas not feeling well, they're eligible someone that is trying to kick it on their own. And they're also eligible the other nice thing about our program in the approach that we're taking. It does not mandate any involvement engagement with law enforcement does not require or mandate transport to emergency department. This is simply a medication that we can administered, control administer directly to the individuals at the point of where they are. So from tere, we're gonna have a list resource. In past I've had some of the resources past out that's going kind of the see what the individuals themselves. So the family and friends are going to see this far as information on on the spots on itself. And then some resources that are available within the community. And then it also The leave behind tips are also in the bag with with you as well as fentanyl test strips. So for the first time, the fire department now handing fentanyl test strips and then be behind. Simply a resource for those individuals that are adamantly opposed to being transported to the hospital. We're going gauge these individuals will fall off as well. Follow up with them in the You know, we have about a 24 hour window. We're going feel ok, and then that drive is a 4 or the potential relapses is gonna be present. When that medication starts to wear off. So we certainly have devoted to transport into any hospital with within within our service area. And but again, what I really kind of want to stress is that bay, we now have additional options and resources for these individuals that are in desperate need. Again, education piece, that thing that we're doing right now is really engaging with our community partners as well as our city partners to make sure that everyone is that that is out there in the community that is impacted by this has the awareness that we now provide this as an option and that they know how to handle for the specific resources through the use of by either dispatch or directly via phone internally to hail our car, 15 car, 51 or ems, chief supervisor and coordinator as well. So I think that's kind of a quick overview of the materials. I do have some of the public face materials play on that table there. If anyone in the audience like to get eyes on those. But I think now be a good opportunity to stand for any questions. Thank you. Thanks so much to each of you for being here. And you're frontline work every single day. I see MISS Maker and then anyone else with questions can go ahead sneaker and then this can go Council PRESIDENT The question. But I just want to applaud you, chief and you, Dr Burnett and I want to thank council vice PRESIDENT Kim for her leadership on this as well. This is such a problem in our community and it's something we hear about all the time people who are struggling, people who see people who are struggling and who just want to know, that tere is a way to help in a way that is sustainable and doesn't just keep people cycling through over and over again. The same cycle, vulnerability and when we had that presentation in MAY, I remember we had somewhat of a a frustrating conversation at this table. We I think I not alone when I say left feeling sort of helpless when you told us that you were administered Narcan, sometimes twice 3 times a day to the same individual. And if they refuse transport to the hospital because after Narcan, they were in the the worst throws a withdrawal. As you said, doctor, there's nothing that we could do for them. There are a lot of ways that you could have reacted to that conversation that we had at the council table. Chief, you could have you could have been defensive about the program that you have you could have said no, it's not possible. You could have said there's not enough money. You could have said a billion other reasons why we couldn't do things differently and said what you said was, yes, let's talk about it. Let's learn. Let's see what's going on other cities. And as a result, we have this program that you stood up in a matter of months. And it's just been an absolute delight to get to see work on this. And I'm so excited for what it's going to be for our community. So just thank you for saying yes and for your creativity and your willingness to to try that tiny thanks. Thank you. As make MISS Kim. Yeah, you to have but dep gratitude for your leadership on this. And also, yeah, the leadership of your team and the staff at regions. We were very distraught when we are hearing around the fatigue and the number of times that even bringing something to the hospital. And we think about our frontline workers and the amount of calls that they're going on and how much time and attention you providing o folks and ministry narcan and that clearly a much more intentional response was needed. And so we just are so grateful for that partnership. And I think what is particularly meaningful meant to me is we had another meeting with the region's hospital director that said in a matter of years, if we don't, 2 to 3 years have a strong handle on this crisis is happening now. See, a few sites will actually be the only thing that we have in our tool kit. And that is a reality, actually, that I don't feel like we should support. We have and a very robust public health system and first responders that are equipped with the right tools and that we can lessen their fatigue on runs, but also actually pure fried the care that folks need and to get over their addiction. So I and so so grateful that you are changing that runway for us for us to continue to invest in our community. Public health and just gratitude for keeping our community safe. So thank you so much and thank you for the leadership. But the immediate response to our request, I think, was just exemplary and very much appreciated. Not just pass here and at the Dyess but all of our community members that know someone that's suffering from an addiction and particularly one like this. So thank you so much for the tension. Council PRESIDENT Council members take you for your leadership. I don't think we would be here today if wasn't for the barriers that you have a need to get us to this point into Dr Burnett and the region's team. We are extremely grateful. We have a resource for our community that is in desperate need and we have not had that before. And I'm not aware of too many other fire departments across the country are able to point this. So the stand this up is because we do is a testament to the leadership from the city as well as our medical direction partners. And we're grateful for it. I I would like the opportunity to follow up in the future. We have additional data to as far as how much ministering this, that the amazing thing to me is that a single dose of this medication could potentially save a life. And so, although our overall below, it's gonna be targeted. Ads can be methodical. And we envision that this is going to benefit the community. We're grateful for So thank you very much for your leadership and the push in the right direction. All right. Any other questions for our colleagues? Can I ask just one very 1, 0, 1, So this handout talks about keeping our fien and then the items called Suboxone and then we have naloxone. Can you help me understand what's the difference between tose 3 things? Do they all do the same thing? I just want to know on a basic low capital what's the difference? I get that from ecology So sonar blocks Toby Interceptors. So the fentanyl fentanyl, 60 opiod receptor Narcan blocks. It kicks it off. You go in withdrawal. You think about a light switch. If you're high, the lights are bright and if you're in withdrawal, their dark dark and a 2 from bright to dark immediately. And then just midstream to understand. That's because if you don't block it, your body stops functioning because it doesn't tell itself to breathe and things like that. And so the reason it's important is that it literally basically turns your. Homeostasis back on. Is that correct? Correct what your body is used to the fentanyl if you take it away instantly with dark and that's what all okay. Also like got to use homeostasis as a turn at my job. Feeling smart. Okay. Let's keep going sub out. But then what's a box on and what's now acts also buprenorphine is just the generic name for first of ocso and so Tylenol versus acetaminophen. Same So box as you can or fiend plus Narcan and it they designed it that way. So you couldn't abuse that. It just complicates things. Just think if you've been or fema's the generic of Suboxone and there was a 3rd. So tis is no accident, but is it is a lot on his darkened. The locks on it. Generic name for Narcan is the trade name. So not so really the 2 medicines were talking about you've been or thing or suboxone and the Narcan or naloxone that is so helpful. Thank you. Thank you for your life. Saving work and the pharmacology lesson. And frankly, when I got to go to so I have one of these kids and my house from, I think it's called Street works. But the outreach teams that go out and make sure people are trained in that residents understand if they have to use this and I learned a lot just from a diagram of showing the opiate receptors and what that doesn't just need to help people break the cycle could be greater. So really appreciate this update from you. We know we'll keep being involved in the conversations ahead for our role, which is funding in and supporting that work. So. But and we need to make some adjustments today based on a few policy and legal changes that have come to our attention. So I want to lay out where we're going from here. Then we'll work through it. The first is that we're going to move a version 2 that is not actually changing the policy. It is just making technical corrections that needed to be made that were found by our city attorney's office. So is anything else MISS Carter, you want to say on that or clarification, ok? So first, we're going to move version 2. Well, before we do that, we'll move urgent. You then we'll go to discussion on possible amendments. And then we will take it from there. First, I just want to thank everyone involved for all their work to bring this before us with the opportunity collect franchise fees in the winter months. We have our state legislative partners, community members, the mayor's office and their staff and our council members and their staff. I want reiterate from last week that I support passing the franchise fee agreement version and as it is, which would turn on collection of fuse for NOVEMBER and APRIL through the end of the franchise fee agreement which expires in AUGUST 2026. The estimate for how much money 2 months will generate is approximately 4.2, 5 million dollars, which is larger than the estimate that was previously provided to us and would amount to approximately $35 per year per resident. I think it is in the council's best interest in the community's interests not to leave any money on the table and pass up this opportunity. This revenue is a volatile source because it's an estimate based on energy usage. And that's kind of the reasoning behind some of those. You know, we don't know exactly how much money we can anticipate. It's based on data. It's based on the type of winters that will have. And we know that that has fluctuated significantly over time. So unlike other sources, we do not have an exact amount to anticipate, which is why I for their support collecting the funds for the months that are indicated in this version. Provide providing us with more revenue, especially with where we are at and the timeline of our budget process, which won't be complete for a few weeks provides us with the most flexibility to make pending decisions for the budget for 2025. We've always had the power to decide how this money is spent. And we still do. And I think it's important that we think about our budget revenue as a whole. We can think about funding is being directed towards additional spending or playing 2 currently proposed spending to free up general fund dollars and directing the money to our initiatives and or we can utilize the money to lower the levee. All of these options provide us with significant flexibility. Additionally, it's important to consider the time value of our money. More money now is more valuable than an equivalent amount of money later in time. And the cost of goods and services can only we can only expect that they would rise with time. And so all that to say that one of our biggest powers we have as a council is the budget authority that we have in this flexibility provides us with more power, more power to serve our communities, especially with the outlook of the higher levels of government. My goal is to maximize the power that we have as a council to deliver our shared priorities to our residents. And understand that the franchise fees, our cost to our residents and it specially it does impact our lower-income residents. There are some residents that receive assistance through our State Energy Assistance Program, which is based on their overall bill and their income. And additionally xl is rolling out a program next year to reduce bills for low income residents. So Ibelieve that with this money of the services that we can potentially provide in an equitable manner said during our folks most impacted by energy costs is of great benefit to our community and city in a way that outweighs this costs. Also make sure where where letting folks know about the bigger picture and the timeline of this franchise fee agreement. So we have a plan to turn on more months in the future. We actually currently or allowed by state law to collect money for all winter mnths. And the goal is to collect money in 2 months. This first time around in preparation to collect from or the future. So this is a critical step to move forward with collecting more months sooner than later enough already planning to spend this money towards specific services, many of which currently proposed start on climate action. These services would only become more expensive in the future ad passing up an opportunity for funds would add more time to our ability to achieve our goals at any other goals that we might have. In closing of many urgent issues that we're facing as the city. And I want to provide our council and our city with the tools and the resources to meet that need as soon as we can. And we have an opportunity before us to do that. I trust our council to be able to determine the best way to use these funds in the best interest of our residents, as well as all of the funds in our budget process. We're currently in. So I urge the council to support this franchise fee agreement and the funding it brings to the table to maximize our powers, the council to serve our residents. Thank Is toast. I just want to open up with for say, would really like to thank you to you cause for Joe's for bringing forward at the the overall proposal on it considering imposing a franchise fees for this original version. It's for APRIL and for NOVEMBER. I really appreciate you bringing it forward because and now this is something that the council can consider as a result of lot of the work that the advocates like. Leaders from using Paul and also, you know, elected officials have been working on. And so it's important for us to have this discussion. I also think it's important that it's brought forward just so that really turns on that clock for the council here to really have this and that conversation to figure out what you know, what's the future of this going to look like for us and for our residents? I want to give a shout out to my legislative aide and also the legislative aide from the Ward, 5 Office of the and City Attorney. Theresa, thank you to you our city clerk. Sherry, thank you all for apply. As you worked on, putting together the amendment language that we have in front of us. I m my proposal here are my amendment is to is to pass just the month of APRIL for additional franchise fees the added that you'll see in the packet in front of you is there's a table there. Several tables that this one is saying, yeah, look at that one and anywhere that you NOVEMBER. And the role residential franchise fees being in polls. The November is crossed. So basically we are adding a probe into it's into a franchise fees moving forward. And I just wanted share that for me. This is. I've been doing a lot of reflection over the past few weeks here. We've had this in front of us for weeks now. And I feel that our work on the council lake, it's like a roller coaster. I think some of you will know what I mean by that. Sometimes there's the calm and then sometimes er at a point where things are really tough and we have to make tough decisions, have a lot of things to to consider in a factor as we make decisions impacting the people who you represent. And sometimes some MAY feel really hard and chaotic to be honest because we're always getting new. It information every day. And there's a lot to really digest. But I feel that those moments when it feels that office, that's when we have the most growth and we also get to the most clarity on what our decision-making is. Not only on on our personal bases, but as a council to and this is one of those moments for me. It has been really tough, but I feel I just want to say, I feel really good about this amendment because one I am really pile that we I'm able to serve on a body here that Thank you deeply about cimate justice and also live in a city where so many of our residents I care about this work to and have even worked to organize amongst themselves to push for things like states taking a state statute so we can impose franchisees. That's a really big win. At the same time, there's a lot of things that weigh heavily on my mind to you, which is what I constantly hear from constituents and my word, which is that they are feeling really deeply the financial constraints of taxes, increasing fees being imposed and increasing as Just think recent cost of living overall is has been really tough for them. And that matters to me a lot because I Representative Ward where the average median income for a house with some a word. It's a little over $45,000. And when we talk about the franchise fees, there's think there's a lot of things that are really positive about it. But also the downside is that families who are most energy present are the ones who end up paying disproportionately into this pot of money. And many of those folks we know are immigrants, refugees, working class families communities of color. Which ae also folks who make up a huge part of my board as well. And so this is something that is really personal to what I said earlier. Not only do I know that this is an experience that my cousin constituents have, but it's also something really personal to me, too. And some of you have heard me say this many times, but 3 years ago when my husband and I we just got married and met her first home. We were paying in upwards of $700 a month for our heating bills during the winter time. And I think for a lot of folks were some some folks say it might be when you don't have that experience, it might be a lot easier to say. Hey, like and when we to pay more so that we can have this program. But we are living in the thick of that. It's really tough t be with I can put more on the table and so I have a you know, my mind as a as I think about just this you know what's in front of us as a whole. And I know that what we are going to be generating in terms of new revenue from APRIL is not nearly enough. The amount of money that w need to meet our climate was resiliency goals, but it is more than what we originally he would be generating. So I just wanted to highlight that the amount that we would be getting from adding APRIL. Next year from that month alone, we would be generating 2 point 2, 5, million dollars. And these are estimates. Just wanted also have 8 that the mayor's proposal on how to use up these funds. When we add up, how much would be going toward climate worker staffing for climate overall? It's a little over 12. 1.2 million dollars. So that leaves us the council having to figure out what do we wanted to with the little over 1 million dollars that we have left over and I feel strongly all of the money, from this new revenue should be going toward climate justice Ideally for me, all the money from franchise should be going to climb. It worked because we know it is folks who most energy pardon pain into that. And we need to figure out a grand plans on how to alleviate that burden. Make sure that, you know, they are able to have weatherize homes, for example, in so I just wanted to highlight that as like a side note from young like what I would like to see that new revenue be used towards Another thing I wanted to talk about is like a long-term vision because I don't think our work ends here. Like I clearly said, this isn't enough money for climate work long term. I like for us to work closely with climate partners, especially partners like we need those Saint Paul case have fuel rationing here. By the way, I know you're in the crowd. Yes. Thank you. So should here at after week. I want us to work with them because they've shared a really incredible vision to work towards a block by block transition to a chill thermal energy in our city. The funding for this work along cannot be raised by our residents, which is why I know that franchise fees won't be the resolve for all of our climate goals. And as we consider phasing in more months into our franchise fees in the future, we must also figure out a grand plan on how to make this transition happen so that we can that's position ourselves to leverage more dollars from other levels of government. Urge all of my colleagues at the table here to aprove APRIL into our franchise fees. This decision as a fair and equitable balance between putting in more revenue to fund important climate work and being responsive to the financial constraints of energy. Pardon households in our community, including those who are low-income and on a fixed income. And I also want to say thank you so much to to arrest. He's been putting in so much work into the always sending in new info to us as he's gotten that. So I really appreciate the work that you and your team are doing. Thank you MISS, seeing for those remarks. And before move to discussion. So I just want to triple check the packet that we have is your amendment and the actual tax that you're doing is you're in these tables where it lays ot the actual months were charging NOVEMBER is struck out and it's updated to say OCTOBER so that we're having it in APRIL. I really respect thoughtful process to both of you have followed and the reasons that you both laid out for where you've each landed missing, I'll be supporting your aendment today. I think it's a smart balance between our cimate goals and also what we're hearing increasingly from our residents, which is that. Taxes are and we need to be concerned about every single dollar that we're spending money to be able to show the return. And the good news here is that we are going to be able to bring in more dollars than we ever anticipated. But I don't think that we should be casual about that. Don't think we should say will bring in even more find a way to spend it. I think we really need to be responsible and show due diligence for those dollars and if we are bringing in more than we thought that we don't need both of these months right now, I also want to say I'm very concerned that as we pursue our climate goals, I want to make sure that we're all so taxing the big polluters. I think often these responsibility for climate work falls all too often individual residents and of course, applies to all of us. But we also need to be able to to really hold those 2 accounts were doing the most damage and the problem with franchise fees and adding these months is that it only adds these months for residents because commercial property owners already pay these fees. So I'm really interested in the work we can do is we renegotiate our franchise agreement with Excel and others to get more out of the largest polluters and specifically our larger commercial polluters. Ad then finally, I want to say, this council allocated a million dollars in American rescue plan funds to be used for pre weatherization of homes. Those dollars have not yet been spent for a variety of reasons. I think we absolutely need to be committed in this next budget process t ensuring that those million dollars are spent that they are combined with the power home program that we've talked about, that they go to the people who are intended to receive them at and that we don't just continue to have those funds sitting here. So I want to make sure say that on the record and I'm committed to doing that. Thank you, MISS Nick or any other discussion. I see MISS Yang and MISS Bowie. Go ahead. To nt say that You know what I've been hearing from from some of my colleagues and I share the same thought to like it's a really important for us to support climate work that is ready to be out that way. It's also successful, too. And the and you know, it sounds like we do have some proposals here that we're really there was intention put behind. Here's how much we think we can spend so that we do have a successful rollout. And so just the thinking behind this is was really intentional feel again, like we are bringing in more money. Then then than what is needed to be a tough and all of the proposed climate initiatives in front of us. Thank seeing I believe buoy is in line. And if you want to be in line, I is Johnson's after her going is. But thank you. Council PRESIDENT Has want to say thank you for everyone who's here. I really appreciate my colleagues. I feel like we have explored so many different avenues when it came to franchise fees. And we have even more avenues to explore leading into the budget. I really appreciate the level of communication. We've have had a month's ourselves. I also appreciate the organizations and community partners who showed up and let their voices be heard and advocate for climate justice. Now, that's really, really meaningful to me, particularly around how our dollars are spent and how we're held accountable to communi as well. This is also a very personal issue for me. I'm actually grew up on energy assistance programs Councilmember Jones have mentioned and both programs. I have them to be security blankets for my family and many people who are in my in my ward. The safety nets are available for families who have assistance. They have not gone away. Xcel Energy has promote it initiatives to support households. Who you know, looking who aren't able to afford their energy bills. And we already voted, you know, weeks ago on increasing the fees and and get like sometimes we get a load it with a lot of decisions, right? And like every single vote is connected to this bigger budget decision. I bowl, you know, is actually to keep the 2 months. I see this as opportunity to unlock the amounts of months. We can leverage myself personally as a council member. I really am. I prioritize the intentionality and being active proactive, an innovative and how we manage those funds. I actually have presented to my colleagues proposals on how these dollars can be spent. I was very detailed, particularly around what should go to and included implementation plan on how we can weatherize even made the effort to ensure that we have a reinvestment plan into community to where it's not just the funds goes funding salaries and more staff. But our community can actually see clear examples of the dollars going back into community to ensure bring in not only awareness but also talking about climate equity and environmental justice for my environmental justice and racial justice. Lantz my boat. Like I is more s have the unlike the 2 months. So I will not be supporting this vote. But I do plan on working with my colleagues around how we are going to adopt the budget that meets the needs of - climate advocates and communities that ae energy You know what the announcement of more money projected. We have the opportunity to find all of our collective priorities and you have heard me on the record plant times advocating for whether ward specific are, you know, for youth reparative justice. And we've heard personally haven't heard from the climate justice, but hearing from the newly appointed youth member on the Climate Justice Board. The sense of and the intention to protect the safety and preservation of our neighborhoods. That's going to require dollars going to those people to actually do that work advocates have, as for the funds to go towards these climate actions particularly in my ward, there's alot of advocacy for, you know, us to hold polluters accountable and direct investments into people in places that base environmental racism is important to me and as well residents who are impacted by the pollution alongside I-94 and other critical health conditions that exist such as the refineries that are across our city. I know in Frogtown there's a refinery that's currently under investigation. The epa investigation. But yet there isn't a bandwidth, particularly around how we invest in how you for sory repair and mediate that that situation. So I just wanted to, you know, share, I appreciate. And how everyone has been approaching this. I want to approach this in a way that actually gets resides in comes up with the plan. And and I think we have those powers and and I'm really excited for the creativity. Innovation to design that type of future and how we want to fund it. And so I will not be supporting that vote, but I will be supporting the work to come. Thank you. As Billy. I go now to MISS Johnson. Anyone else who wants to get in line. I think it's a common. You know, along this council and the leadership that we hold several of my constituents are actually in the audience today for a variety of reasons. But a lot of you have actually heard from them over the last 2 weeks as they attended public hearings. You know, I several of folks that have been pretty vocal where they stand on the issue around franchise fees, including being at every single office tower that I've had in other places to be able share some of their priorities in our community. And I honestly think that there's like a Roman. There's there's a space for being able to both support, climb, actual work to actually be innovative about the solutions to discuss how franchise fees on their place will be actually utilize. And I look forward to continuing that over the next few weeks with my council colleagues in this capacity also have within our word. You know, we have heard different presentations that of alluded to where some of the highest eviction rates are. And that's in 5, 5, 1, 0, 6, in our city, which is also in my ward. We've had individuals talk about how we have addressed climate concerns and some of the bait greatest disparities again exist and are skewed quite far on the east side of Saint Paul for a vriety of reasons. But I've also had many conversations with individuals whose lights are currently off whose places like don't currently are behind are seeking energy assistance, but it's not enough. And that is also in our constituency waste. That's also in places like in spots that I represent. That's also and live. And there's also space where like we have to have to. Those can sit those considerations when making decisions like this. And so was actually really relieved to see that even over the last few including as of early as yesterday that we are continuing to learn more about some of our project comes from this change. I think it's amazing and great that our committee members are leaving and going to the state legislature and advocating for changes that they want to see and holding us accountable to that. And that's where I appreciate the the equity lens. I think you're bringing to this that I will be supporting today when it comes to putting in a month an amendment to have it be one month and not the in part because I think that there's still going to be numbers that are coming for that. We might have multiple conversations as more revenue was discovered as the days come in as the weeks come as we head into budget cycle. And I think it's because we're still learning and still really fully adequately explaining what these numbers are. And so I think that the fiscally responsible thing to do as well. So is the thing that actually can both accomplished climate action work over the year, but also be mindful that there are people still in our city. And one o the things that excited about some of the work that excels been doing around te public utility commission and trying to make an equitable response report approaches because there is a need. There's a need for energy assistance and there's a need for continued help for our constituents. That few sometimes 100 or so I will be supporting your amendment. Councilor Yang also be, you know, just simply saying Councilmember Joe, Stand Council Jalali who are sponsoring this and Stark, who's been really adamant about these about climate action, work for city and kind of caring that space. I think that it's really important that we have advocates all spaces and bring different experiences to the table as it relates to this work. I I just want, you know, we really appreciate your leadership. And so sincerely appreciate that. But I also think that there's an opportunity here to save some folks or are already in a space that feeling every dollar we had no matter how small or minute or how. How important it is. Every dollar that individuals feel that genuinely especially o the east side like it matters that accounts. And so for that reason, I'll be supporting amendment. Comes bringing. Thank you as Johnson. We got out of his skin. I think you'll be very brief sense basically echoing a lot of what I've heard. He heard my colleagues say. I also want to lift up the equitable generation of revenue like the biggest polluters are not being tax a way that feels appropriate or fair, which is also I'm going to be supporting Amendment. And also want to emphasize that this is the start and that council is very clear on supporting and directing these dollars to climate resiliency. And I want to lift up the block by block approach feels necessary and needed and is meeting climate moment. Quite frankly, I want to extend gratitude to the 4 council members who stood with me and committed to ensuring these dollars get put towards climate. Even though the dollar amount continue to increase and change and it wasn't worth. It wasn't in spite of the trying or the ability and the great advice that we've gotten from our lawyers and who is managed to pull to get their version. 2 for us today and a matter of hours to ensure that we're passing the correct version. Stay so thank you to come. Burn acre Johnson and for helping me and guiding kind of trying to guide funds towards and dedicating them to be to meet the climate moment and also that extension of gratitude to council COUNCILMAN. We be submitting and sending us ideas with dollar amounts with departments and a plan to me just felt very reassuring. They are also deeply committed to meeting our climate crisis moment had instead we read the chapter of allegiance to gratitude invading Speaker And I'm just gonna leave us with this thought you know, if the water is meeting its responsibility to provide clean water to us and the earth and our plans in the food that we eat and same with our trees in the air. And we also have the responsibility climate in the same responsibility, an urgency that everything else in our ecosystem around us is not only responsible for doing, but it's been meeting in delivering on that moment from others. So I I I'm focused on that. The the allegiance that I'm pledging, even though we did earlier today, ready for this meeting, knows no boundaries because my allegiances with mother. And then also reiterate that I sort of started and on this with a place that I'm really proud that our council is committed to getting this ordinance done. That's wat I'm holding. We're going to turn the fees on. We're going to use those funds for climate purposes and also going look for ways to be flexible. So I just want to really thank everyone here for working through that. I had to laugh a little and he said roller coaster. I was like tell me about a but that's our work. That's our job. So I think, you know, I'm Millie out that Imy plan through the beginning has been support the ordinance as proposed. So I'll be voting no on the amendment, but a just where I'd like us to get to and then we can take a vote. I think even before the election, I had really wanted to purchase the tradeoff of the franchise fees is that, yes, you're imposing a fee on everybody. The resources are going towards the most impacted people who are experiencing those energy costs. And I think that that trade-off is defensible. When we talked about and looked at the amounts, what I asked was what is it per year? What is it per month? And so with the updated numbers, if we anticipate it's $35 a year per resident, if you calculate that out its $2.9 a month and for the trade-off to be that we have more resources to stabilize the levee, offset other costs that we don't want to hit them with on the property taxes and then also actually weatherize homes and do other climate actions that helped bring those energy costs down. To me, that's actually let's take some of those funds to actually change the status quo globally. That's I think the right trade off and why I was glad that we got to place. We could get this done I respect and I understand that this ordinance doesn't hold the biggest polluters accountable. But I also think that we need to do it within our role as a council to get revenue for climate purposes. And this is something that we can do. I think that the ordinance as it is, would help us raise more revenue. I think those funds can go further and that they would also get frankly, a lot of revenue that my constituents are not going to see into the parts of the city that need it the I I was a part of it from that place. And Ithink that that's important to drop out and i would say lastly, I remember being a counselor during the Trump administration and having the clean power plan like dismantled on the federal website and literally you go to the url and it wasn't even there. And in an environment where climate change denial is the official position now of the United States government and the White House. I think that that changed it for me to go from feeling convinced that we were on the right track doing this to feeling like the days of the inflation reduction act and billions and billions in federal funding to stabilize our city are gone for now. And that's really sobering. It's really hard. And I know we're going to govern together through a tough time. But I want to make sure that we're position to do that. Some respect against the amendment while appreciating the arguments in support of it. And frankly, the respectful discussion. I used to work for a congressman. He said we can have conflict, but it does need to be contentious. And that really stuck with me when I was a baby staffer writing memos and running around, it's bright lights and all that. And I grew up and now I'm in this job and it's a roller coaster. Thank you for modeling that. So let's go to a roll call. yeah, let's do that first. And then just to reiterate that the ordinance is laid over to NOVEMBER, 20th for final adoption. Item 2 is first reading of ordinance. 24 Dash 34 amending chapter 3.24. For the legislative code to allow to bit tobacco shop or Tobacco products. Shop licensee to relocate within a shopping center or the same personal property under certain circumstances. This item is before us for a first reading. Typically at the first reading. You have the council representing the ordinance and then the administration staff that they have worked with. We asked to see if Mr Nikolic was actually available today. And it turns out that he was not. What I'm gonna do is have missed. Just give an overview. And then it's my understanding that MR. Nikolic from Dsi who has been working with you on this is available next week to additionally field questions. So I could not turn it over to you to confirm that. But if you could just give an initial overview and then we'll take it from there on has a team is just go ahead. Great. Thank you, council just to clarify, we were told that a staff member from Guess I would attend next. Thank you for As long as it's the implementing department efficient to speak on it, that's all that was asked Absolutely. So just a little bit of an overview on this item, This ordinance is an exception to the current tobacco ordinance. It's something that our office has been discussing and are fighting with staff since AUGUST. Those conversations have included the city attorney's office dsi and our own licensing staff. The impetus for this ordinance is that Ward threes business called msp Tobacco is being asked move within. They're strip mall, which is simply Plaza on 7th Street and which it's being housed. And they're asked to do that by their landlord. This is so that the landlord can free up a larger singular vacancy at the strip mall to more easily attract a larger tenant. Simply Plaza has been a site of significant development in service to the community over the last several years. And this move would benefit the community community. And that has been communicated to us by community members as well as the Highland District Council. Tobacco licenses are attached to physical addresses and that person's or businesses, which means the act of moving just within the property where they are already located would void their tobacco license and thus msp tobacco in this case, there are 4 important pillars to this ordinance change. Number one, the tobacco retailer must have a perfect license record without any violations. Number 2, the reason for their move must be outside of their control. Number 3, the tobacco retailer will only be allowed to relocate within the parcel and which they already exist to prevent any further clustering of tobacco retailers. And 4th, the director of Dsi is required to approve each use of this exception to ensure that it is done. So in a can text really appropriate way. And as mentioned before, there will be a staff member from dia Side that will be attending next week prior the public hearing to answer any questions about the mechanical implementation of this policy within teir department. And we're here today to express our support for Saint Paul's drive-thru policy. And urge you to take the next in implementing a full ban on new drive-thru. The a full ban on a through developments throughout the city. Drive-thrus our bodies privatizing car axis of expense of other street users creating a fundamentally explosion or environment for pedestrians. Cyclists. And transit users the city starting for sustainable and committee center been spaces like same poll. This type of car centric infrastructure is incompatible with those goals as college as college students, we don't have access to cars and lucky to this court amended spaces maker, neighborhood unsafe for us. That's pedestrians. In fact, we've experienced this disregard firsthand walking past the Starbucks drive-thru on the corner of Marshall and selling. I was nearly hit by a car passing by the exit lane. This kind of close call isn't rare. And it highlights just how much drive-thrus create hazards for pedestrians. Drive-thrus are often focus on re-entering - traffic quickly and do expect or look people walking by. We believe that simple can be see the protests petitions, safety and more enjoyable watching experience and move away from a car centric. Infrastructure is Tikrit healthy ways of living for everyone in our community a full ban on new dress was would be a powerful step toward that goal. Thank you very much. Thank you. Thank you. I'm actually reading for Courtney Henry, a local McDonald's operator. So good afternoon council members. My name is Courtney Henry and I was raised Frogtown and my family has been doing business there since 1989. My father and I own and operate 7 McDonald's across Saint Paul. The big novelty own and operate our small businesses that are independent. I'm here today to express concerns to pass on to possibly banning drive-thrus for restaurants our communities want and us drive-thru with nearly 75% of our business being drive-thru. Our customers have the choice to choose drive-thru, especially in the middle of winter when they might not want other kids from the car. We also customers who might have medical needs that put them in a safer situation to go through drive-thru like during the pandemic. Well, I'm very concerned the city is considering banning new drive-thrus. I'm also concerned what will happen to existing drive stirs as we look to make improvements for safety or for a better customer experience, it's important owners have the ability to make the appropriate changes. If we have technology to make the drive through more efficient, make the drive thru more environmentally friendly are better for the neighborhood. We want to ensure that we can do that. I urge the council to amend the proposed ordinance to allow for future innovations to achieve these important goals. Lastly, we need to make sure we are preserving and expanding Saint Paul's tax base in order to pay for essential services in the city. Passing ordinances that hurt small businesses runs counter to this call encourage city council to amend the proposed right pardon to make it more workable for small businesses and residents of Saint Paul. Drivers are a drain on the urban environment and they prioritize car users over the needs of all others to contribute to the climate crisis due to increased carbon emissions. Because my office a queueing idling. Minneapolis band, new drive-thru construction in its entirety 5 years ago. And in doing so free up space for more economically productive and socially important plan Creating a better environment for those who including myself, do not own cars. For these reasons. My name is Callan, McAuliffe and the senior director of government relations at the Saint Paul Area chamber on behalf of our 1200 members and affiliates. I'm here to express our opposition to the proposed zoning amendments regarding drive Thrus. We've had many stakeholder conversations with regulated industries, but the impact this ordinance would - have the same themes have been repeated. Traffic is allowed customers to quickly access services without exiting their vehicles. This is especially important during the winter months when the weather makes walking outside hazardous customer habits have also shifted post-covid to drive through and this tight labor market drivers. A lot of business, the flexibility to serve customers while dealing with workforce shortages and public safety businesses could be forced to reduce their operating hours rather than risk the safety of their employees. Businesses factor in the ability to build and maintain a drive-thru when considering an expansion into new locations, especially as new technology allows him to become more efficient with their operations. Lack of clear, concise language relating to upgrade. Existing drive-thrus will leave businesses with outdated buildings in property values and customer experience. The Minnesota Star Tribune recently reported on the pharmacy deserts that are growing across the state. Passing policies like this could exacerbate that problem in Saint Paul. He's proposed owning amendments will likely not have the desired effect of reducing vehicle miles traveled or pollution from auto emissions. Consumers will shift to food delivery through apps are dry for taxes and existing drive-thru. The Starbucks on West 7th demonstrates how a business can success successfully. Bill, a drive-thru within the current zoning codes. They redevelop underutilized parking lot while prioritizing pedestrian safety and avoiding traffic congestion. I'm I like many students who do not own cars like her owners have many places to be. And left walking. Still feeling avenue which means constant interaction with car centric planning. And the very cautious pedestrian. Still had many near misses the intersections in driveway. Aprons. Drive-thru's or another type of infrastructure that promotes car usage which is inherently nt pedestrian. Saint Paul's, the central city and it's on a server. So I hope that it's transportation policy will not be treated as such. We're pushing and pushing for no exceptions because they don't want the city point out it. I don't want the city to promote. Outdated models are complaining. And I think that wrist recent history live its concerns about both noted exceptions. If we're worried about pharmacies and accessibility can look to covid are precedents where pharmacy workers went to the cars and the like new nasal swabs that. Other written testimony to this amendment talked about. How in in the past 50 years driving percentages have decreased by 90% for banking. And I ask why should so much space be dedicated to a small portion of population? Furthermore, the current expectations go against us in the values of the same pose, any code, 2, 1, to 2 into 3 zoning codes in their intent. Talk about pedestrian warranted legislation. Dvelopment and excluding t one. They all talk about transit or in development. I believe that at best this maintaining all drive-thru says income grew with 4 policy. But at the same time, we're always trying to balance multiple competing needs only adopt policies like this. And I will say, I frankly, was somewhat surprised to see this issue come before us when it did. It's it's not something that I hear very often from my constituents. It does not seem to be something that is a big problem in Saint Paul. And what I what I do hear from my constituents is that this is a really hard time. This is a hard economic climate and this is a hard time, especially for small businesses in a time when we really need to be supporting. Our small business is expanding our tax base, making it easier for business owners to invest in their properties rather than doing the reverse. I do think that there are. Pieces of the amendment that makes sense. I think that the emphasis on design and making sure that are protesting oriented makes a lot of sense. I also think the concern about stacking and having enough room for cars makes sense as well. But I think that amendments think this is the wrong time. And I think that they should be considered in a more holistic way. We are about to zoning study of our commercial corridors next year, which is something that all of us have prioritized and that's going to be a massive undertaking. It's going completely rethink the way that our commercial corridors are zoned and designed. Drivers are located commercial corridors. That make sense to me to lay this over until we've had time to do that. Study. And at that point, we can reconsider whether or not these amendments make sense at that time and that economic climate and with the appropriate zoning that will have have the chance to consider that time. PRESIDENT, I would actually move rather than laying over a week, which would be the normal timeline that we lay this matter over to SEPTEMBER. 3rd, 2025, I've been assured by planning and economic development department maybe a shirt is too strong of a word. But I've been told that the commercial quarter zoning study would likely wrap up by middle of next year. And that would give us time to have that done and be able to reconsider this. Thank sneakers. I'd be interested in that just because for that happens that we received from the Planning Commission. So, you know, I don't have an issue with reopening the public hearing, but think even if we don't get there that like. And I wear areas where we can actually invest into pedestrian sfety. Without having to like really bird. And I like drastically impact businesses in ways that we don't even really know. Also, my values are censored and the disability community who has shared there their have emailed me. I relate to many of those communities particularly around what this what the impact of this vote would be and many of them have expressed concerns are not in support of this change. You know, ultimately just even as parents like, don't really see a reality were they would have to take all of kids out of the car and go into a restaurant to able to food or drinks. So I think this change is necessary fr us to evaluate entirety of like our commercial corridors in our overall pedestrian safety for our city. I think this is an example of where it actually does impact our communities a little bit different and words have been some of the major drive-thrus for food think we have a coffee sop drive-thru, some of the places for food restaurant spaces a couple roads and my ward, some of which more heavily impacted during construction and the aspects of like just really being able to have business a community conversation, a pedestrian conversation. With community members without the economic impacts of our decisions are wthout something that really gives me an idea of like what this really impacts and what this says for city. If we head into a permanent ban type of situation for Peter Drive to use. For coffee shops are for restaurants. Kuz is needed to take a pause and I think really want me to encourage, you kind of a big high to support your amendment today. And I think that it's really important in the future when Wade, when we are bringing up the spaces that we also like, no matter if something is started Pre-pandemic Post-pandemic reconstruction like if something, if something that we're working on in to the staff time, mentioned council PRESIDENT Really, really thankful for the amount work that has went into it. It's my understanding that this is not something that has come like overnight that this is something that has taken many years to try to get to a place to discuss this. Now, I think the piece of that, though, is that so much has happened in that time from the minute, the initial parts of when people even to start to discuss try foods to where we are now and the cop up the public comment I've actually received from my constituents echoes that other council members have shared, you know, questions around like what makes this the most pressing thing to to handle and words like buying a lot of things we're talking about with business right now are how we continue to maintain and compete with or competitors. What 7 is on the cusp of being like being on the border of some of our bettors, including Woodbury, Maplewood Oakdale, some of what you have some stake, series of drive-thrus restaurants and coffee shops and places that genuinely are you said this is are trying to make sure that they're keeping So I do appreciate the students coming out. And some of the folks came out to vocalize their public comment today to I just want you to know that it's called always see you, folks that participating in the process. I usually do. I'm not always supportive of like extensively overs, but I think the city is going invest in some sort of if we're looking at commercial corridors for looking at ways to continue to invest in our economic development, this actually seems appropriate. So thanks for offering that amendment. I think. Honestly, I'm indifferent and whether or not offend I think it would remain what we've seen so far. But I think actually sometimes like people weigh in on the things that are most part meant to them. And I think in this capacity that's what that's my question is how apartments how important is this to our city right now? I'm not sure so thanks, Johnson. I see MISS Yang. And then I think we should move toward the But if you want to speak, you can still talk. Go ahead and see citation. My thoughts on this on the support the motion from defense attorney Kirk and feel that you laid out really well. All the reasons why. I not only with the support of the layover, but just some of the concerns I've had do want to say that when I got a briefing about the recommendations from the planning Commission, the restrictions just went away for that what I thought it would be. I see that because I know that right now we do have issues like real life examples of issues that have occurred at drive through some of them have that resolve on their own without any sort changes ordinance. But some of them still unresolved. And so I wanted to share the commitments that I have from my office, like one of the things that I hope to be what to do by the time that final comes next year is to be able bring forward amendments that do have the support of a majority of our council members that and also address the traffic issues, the traffic jams that we've seen at drive to us. And so example want to give a particular is that the Popeye's on University in Lexington? It just drives me nuts. I think that there's a lot issues to the resolve there. There's even more examples of hand. So I hope that our amendments will resolve these current issues that we have and also are going to be be advancing pedestrian safety. I think it's really important that that businesses that currently to have dry through this are able to make modifications so that the actually improve their system rather tan just, you know, being stuck in the same cycle of issues that they have right now in Seoul. These are, you things that I've heard from businesses in my area that that have drive to I also just want to highlight like something that has been. Share to and just really, super thoughtful of all time. The there's a McDonald's on Maryland clearance and my word and it they've recently shifted their operations to the drive to use only and they don't have any dine-in service at all. And I've always wondered why. And I learned that recently. It's it's really because of the issues that they've been as a result of those dining experiences. They have a lot of teen workers who have had to call paramedics on the daily because folks have experiencing overdoses inside the restaurant inside the bathrooms. And so that's also, you know, those are on the things that folks are experiencing and like that's also not a safer, dignified workplace be want to be. So that's why they really transition too. The drive-thru service as at in the way to China avoided those incidents. And so I think that there's a lot for us to really consider. And as a body, I'm hoping that we would be able to. Go through that will close again and figure out the best way forward for these types of ordinances. And just the last thing I wanted to share, too, is that I know as a as a mom, I think that the drive-thru is to provide convenience. And so if any of you hve had have had care for little kids are elderly person, maybe you are somebody disabilities are seeing yourself that you now there are just ways in which those strikes really create committee so that you don't have to get out of your own vehicle. And you know, and so I I said, are a lot of those things. Are thinking about these amendments? And I just feel that we can get to a better place that really needs the needs of our businesses, but also our residents as Thank you, MISS I guess my brief comments that will turn of mistake or to make the motion. I'll I'll reiterate that in addition to just wanting to like turn the page on the changes and I don't you know, I I'm not trying to say that by next week will have just gotten this done. But I I want there to be an amount of time to work on this with urgency. I really appreciate as Nick or that we had talked about just a short layover time. I appreciated I I would say that from my own words, perspective, the nuisance of Drive-thrus is unfortunately a daily problem. And I'm saying that from perspective of University Avenue and Snelling going directly to my ward, both of which are major thoroughfares in our city that the city does not control University Avenue county road. Starlink is just as a state trunk highway and the pedestrian experience. And each of those is unfortunately measurable in too many places. And that's because there was not enough standard around how these type of facilities could operate, the infamous car which is not in my ward, but he's like all the other side of the street where is please wards, split down the middle was huge issue of safety for my constituents and then even tried to put some limits on the Taco Bell and was very challenging to do that. So I look forward to the day where we can take this up again with renewed focus. And in the meantime, welcome the continued input from the community. I support the Aragon because I believe every single person has a right to a home that they can afford with no exceptions. About 15 years ago, I was an early career us working in nonprofits, wich lower paying jobs. And as a parent of 3 young kids, money was really tight. In fact, my family could have qualified for this type of affordable rental housing lucky for me, I had extended family support who helped me make ends meet. But I know lots of hard working folks don't have that same safety net. They deserve our investment and they deserve to be welcomed with open arms as neighbors. We need these apartments in Saint Paul today because the need is already there. This helps families in our community find stability. So I urge you council to approve the land use that will make the Aragon possible for our sample. We believe that proposed the proposed facility represents a threat to human life and quality of life. It also invites the violation of the state of Minnesota drug free Zones. I'm a longtime resident of the site and I live about 3 blocks away from the property under consideration today for a change in zoning. Address is 16. 49 Euclid Street. My wife and I have lived here for the past 31 years. Having purchased the residence from your parents who occupied it since the early 1960's. I am also an active parishioner and church trustee is pass Kobe Line Parish. The entity owns the property under consideration today. When the parish decided to shop this property about 2 years ago, we started with the basic premise. Can't we do better than a vacant lot. Sadly, that is what the property is served as with rare exceptions over the past many years, we were hopeful that someone would have a vision how to make better use of this property. I'm convinced that the proposal put frth by beacon to build 53 units of affordable housing does just that remarkably well. It far exceeds any expectations ahead at the start of this process. Based on my interactions with the staff of beacon, they have a very strong sense that they want this project to be successful, not only for their organization, but for our neighborhood and their tenants as well. The conditional use permit being applied for today is an example of their commitment. The supported support of services. Fit in visions for there. Clients will improve their likelihood both for being successful citizens and tenants. I considered a great comfort to have a roof over my head and for solid walls around me, especially during a rainstorm. Heavy winds. We're cold winter day. I would consider it a privilege to help extend that comfort that blessing to all the future residents who would occupy the building proposed baby can this project has my full support encourage you to vote in favor of the proposed zoning change. But the most troubling change has been the lack of affordable housing, a lack of opportunity for other families to thrive and grow like minded. The empty lot on White Bear Avenue is a chance to change that and make a real difference in the community that I love. We have the opportunity to transform it into affordable, stable and supportive housing for over 50 families. I cannot think of a better use for that land. The location is perfect for families for so many reasons, including it is across the street from 2 schools in a church. There is easy access to many services in shopping. It is within walking distance of Target Walgreens and restaurants. It is and bus lines. It is established community with many other families. The most important thing is that the families would have a place to call their own a place where they could feel safe and thrive. When you take away the fear and anxiety of not being able to afford rent or not knowing where your family will be able to spend the night you give families the space to heal and the strength to just succeed when parents no longer have to work 2 to 3 jobs, just to keep a roof over their children's heads when they have that breathing room, they can focus on preventing their kids is stability and care. That is so important for their development when kids can stop worrying about where they will sleep every night, they have a chance to just be kids and learn and play and grow. I firmly believe that affordable supportive housing is the best long-term solution. For those who are struggling with housing insecurity, providing that not only helps the families who need it, but it also strengthens the whole community as a member of this community. There are 3 apartment complexes, 13 76 0rd Street, one mile away has 12 units, 10 63rd Street has 12 units at one and a half miles away and 9 43rd Street is 1.7 which owns whopping 8. Also theres only one duplex on 3rd Street between 3rd between McKnight and downtown. They with said there are many. Maplewood. Okay. And only for avenue from Laura Afton to Maplewood Mall 9 miles away. There are 3 apartment complexes sign can wait for avenue with 6 units. And 1.1 mile away place, which is by the people. It's a homeless complex, 6 units, 1.4 miles, way 13. 35 Wiper Avenue, 12 units, 30 miles away. Aso 3 2 plaques. I care about increasing opportunities for individuals and families with low incomes in our city. My faith reminds me that caring for the homeless is not a fleeting act of charity. It is meant to be a sustained to practice deeply ingrained in the favor of human character and exhibited continually. So whenever possible we need to develop available land to serve the people often. This means truly affordable rental housing. This land has sat vacant on unused for many years and not in service to my community. And next far better sense his own this land for beacon to Aragon with more than 50 residential units then remain with zoning for only a few houses. Today's at today's market value rates. Most of the Aragon apartment homes will serve households with incomes less than $75,000 annually for a family of 4. This fits our and will House working families approximately one out of 4 apartments will be affordable. 2, 2, person, households with incomes at or below $29,820 annually and can serve. People exiting homelessness big and has a track record of providing quality services for these units at the Aragon. Those services will range from case management. First time homebuyer training, budgeting and financial literacy. Parenting support, homework and academic support. Families will find success in achieving housing stability. The rezoning proposed by the land owner, same school church and developer began is reasonable and appropriate for the site in the city of Saint Paul's. 24 to comprehensive plan. It indicated a need for at least 600 homes. 04:00am so also like your past your time. And I just I'm asking, kind of get to your closing argument where you want the council tank you. I'm sorry. Neither beacon or the church will reveal the sale Let's be super conservative and low ball it at 2 Million. So members of Saint Pascal's specifically mentioned their face and charity as motivation for their support. So let's also look at how the church is going to use that 2 million and the percentages I'm about to, quote, are straight from the debt. The desk, a father, Mitchell. 75% goes to housing the unhoused away. I misread that 75%. One half million goes toward paying down the parish mortgage 10%. 200 grand goes to the church maintenance, fun, 9% 180,000 goes to the archdiocese. And let's be honest. We all know part of that. A settlement money. For decades, the archdiocese protected pedophiles into lawsuits for respective 11. You are allowed to see come up just to stick to the topic at hand. So the topic at hand is this topic at hand. You but you're out. You are bringing up tertiary issues. Just stick to think thinking okay. So they were forced into Chapter 1, which means and this is the important part in 2024. Say Pascal's can sell this asset and they get to keep most of the money. 6%, 120 rangos of the land broker. Which makes me almost wsh I chosen to be a Land Rover is set to go into public education because I don't make nearly that much from teaching. And that leaves 0%, which is $0. If your math impaired 0% for the people. This project says U.S. 10 simply helping. S don't let their red hearing distract you from the facts. If you re zone this land, value will skyrocket. All dcimating neighboring property values. That means you're taking hundreds of thousands of dollars from taxpaying voters and you're using it to pay down the church's mrtgage and pay for settlements. My connection to this project was initially through our church house of Hope Presbyterian and Saint Paul and the 100 plus congregations of the Beacon Housing Collaborative. We all worked hard to get prior crossing up and running in our delighted that the east side in my neighborhood have this opportunity to make a difference by adding to the supply of affordable housing. These are my 4 reasons why Im asking for your support. This project supports both working class families and those who need. Support to get a foothold in having a stable housing in life. It is a mix of who we are as a community families, single person's kids. Their parents growing working shopping, going to school in calling their 9 home. Number 2, the location of the Aragon is ideal for many reasons. Posted needed amenities. Transportation drugstore cross groceries, cough, coffee near revitalizing Sun-ray shopping center in close to the goal line. Over time. And in the past 10 years, I have come to trust in the services and quality of the properties that beacon creates. This Aragon has carefully thought out providing housing. That is representative of who we all are and how we need to grow and thrive. Their gun will provide a great welcome to the residents. He said, well, we should have a meeting with the neighbors here because there are no neighbors at this meeting. They said, well, we need the U.S. Letter from you now because have to move urgently on this. There was discussion about that because it could turn that we weren't hearing from the neighbor right? With their insistence that they had provided the reach, the neighborhood, the neighborhood, it passed went and they used it to get the where they are today. Catches we have since found out that none of that is true. Not a benefit. There was no longer reach to the neighbors in this process. They didn't hear about And as matter of fact, residents of come in with over 100 people very concerned about project and what happened with that? What asking fr is that you delay this over until we have a chance. To meet with neighbors and the developer to try work through the issues on this site. As you all know, where average of about 100 carnations united around a vision that all have a home in service of that we own and operate 791 homes and 24 properties across the Twin Cities. Metro our portfolio serves a wide array of individuals, single adults, youth families throughout the Twin Cities. Metro area. We partner with 10 different social service agencies and those units in our portfolio that includes supportive services here, as you've heard, certainly from testimony, Aragon is proposed to be mixed income, predominantly workforce, housing with some services offered you know, a small number of the units in the building. The Aragon is fully intended to be family housing, consistent with other family housing in our portfolio, I looked over recently our most recent data we find that families in our family properties. 86% of them are - still there a year later. So there's a high level of housing stability. We track the outcomes for each of our service providers at all of our supportive housing properties. And we do put in a significant thought into how we design of the development and support ultimately the residents we serve in the developments. I think ultimately the decision before the council is a land use one and one of the key questions is is this consistent with the guidance and the comprehensive plan? I know the comp plan was for 2040 for the city of Saint Paul was just adopted a year ago. So it is new. Does provide guidance that updates. What has been the status quo for zoning and a variety of sub Friday of the districts around the city of Saint Paul. And I think this is an example of some of the new guidance sets in that comp plan. So I do appreciate Certainly that the comments as as changes is taking shape. But we ask for your approval on a rezoning proposal. Thanks so much. All right. PRESIDENT Council members of my name is Mavis Time. A budget analyst in the city's office of Financial Services. I wanted to give just a quick overview of this resolution, amending the Capital improvement budget. This resolution amends the budget. Allocate hide home. Arp Grant funds. 2.5 million dollars of those funds will be allocated to the purchase of 2.68 Marshall currently owned Catholic Charities. 3.5 million will be allocated to the renovation and rehab of that building. And the remaining I allocated at noontime first for city staff. So I was reading to the resolution for this. These are just some initial questions before we dig into Did we grant for this like it's in the cip. But is that grant actually came to the city's so we're not taking from other ci the things this is actually a grant for this purpose from the federal government that came to us. Okay. That is what I wanted to make sure I understood the resolution and then I know that this is the city action to essentially allocate this. But can you talk about the mechanics of this? Isn't we're not purchasing a building with this act. Like what are we doing and what are we not doing with this action? That would be helpful for clarification. With this action it you are amending the budget to reflect this planned spending at a later date. There will be council PRESIDENT Members. There will be an action to enter into a purchase agreement with Catholic charities and there will be additional actions. I'll turn to the So there isn't actually a purchase agreement today. This allows us to go to that conversation with appropriate funds from the federal government. Okay. That is helpful for clarification. I think questions that we got members included like, are we actually buying a building with like what are we doing? So thank you for clarifying that. And then deputy Mayor tent any other context that you want to share on how this fits into our unsheltered response or whatever else you think is important for members to know. Go ahead. Thank you. Great council PRESIDENT Council members. Thank you. I just for context. This is a portion of the full amount that we would moving. Familiar faces so the work for familiar faces actually started about a decade ago with conversations at many different tables with a lot of practitioners. Lot of community members around the gaps in services that we have in our community through those conversations, work evolved we spent in 2022, we did the work to secure 2 million dollars in a federal grant and we were awarded that in 2023. We were awarded 2 million dollars from the state for operating familiar faces. The 6 million dollars is the city's contribution to this needed programming that would allow us t for physical space where we would then be able to take the 4 million dollars in federal and state grant dollars to actually operation allies. A program called familiar faces I just for context. I want to read. This action isn't about approving familiar faces. This action is about giving us the ability to take the next steps in a long process around purchase agreement for the physical location. There is as planning process going forward and so on DECEMBER 6th, you'll have an opportunity to actually decide if the zoning and the actual use of that property is approved. So if we don't move this forward, it will just delay a lot of those. If we approve it. And not approving this action today will delay our ability to continue moving forward. I just want to read the letter because this this. Familiar faces, I know there's been a lot of questions about it. In APRIL of 2022, when we went to the federal government to solicit those - funds. Our chief Judge Castro sent letter to support this programming. And I just want to read it because it's really important to contextualize what we're trying to do with the space. He says our behavioral health system is in crisis. Community-based behavioral health services have not kept pace with increase of people suffering from mental illness and substance abuse disorders. The consequence has been that our local jails have now become a holding facility for the suffering population. In 2021. Ramsey County district judges ordered 600 it. 786 competency evaluations. So they ordered 786 competency evaluations fr defendants of those 73% were determined to not be competent to proceed with their case due to mental illness. This reflects a significant increase and incompetency findings over the past several years. Because the criminal justice system is not equipped to adequately meet te needs of these defendants. Some defendants find themselves as frequent users of the justice system. In 2019, a small number of defendants. 25. Comprised 46% of the competency evaluations ordered done by Ramsey County judges. The frequent users of our emergency in court services need to be redirected from our jails and courts and placed in a safe space where they can be provided shelter, stabilization intensive case management services fr mental health and substance ause disorders, a continuum of care and long-term affordable and sustainable housing. The city of Saint Paul and partnership with Ramsey counties heading home. Ramsey continuum of care has a vision for the safe space. The impact would reduce the drain on services from a small number of individuals resulting in long-term savings. But more importantly, providing an opportunity for dignified quality of life. Those statistics that we see just in our criminal justice system just in our courtrooms. Those are being played out in in our 9-1-1 response calls. So when we get to that point around, is this the right location? Is this the physical space that we would operate? These services I'm happy to come back and give a lot more details. But this is. A step that is many, many years in the making. And so I would just ask that approve this and and we keep the process moving. To answer questions. Thanks. Deputy mayor and because different programs have different names. So I know that there's like a familiar family's budget proposal that familiar faces to your point is specifically an existing program. That we operate for the most rsource intensive. I'm just repeating my understanding to see if I have it correct because I actually just want to make sure I understand this is. Individuals who citywide are frequent users of all the same services. So first responders, police fire Suboxone probably the people that just presented to us. It's that and this is a place to actually focus intensively on that group o people who continue to like bounce in and out in different systems so that they can get stable. And this is allocating those funds to just keep the next that moving in that process is that? Is did they describe the program correctly and is that correct? Okay. Okay. I just want to just say I appreciate the you know, looking out for grants and also the running into designing and building of familiar faces program. I truly believe that this is really thankless myself being a housing navigator and working really closely with unsheltered communities like building the relationships very essential and having a vision, particularly around how we find places for them to be stabilized is really key. And also to just, you know, all of us being good stewards of our community members wanted things that, you know, I'm kind of struggling with particularly what this phone is around the answered questions around programming costs. I know on it. 20rd, w had a presentation. It was a very condensed presentation Other partners. So we didn't get a chance to get a one-on-one. I haven't got a chance. Even meet with leadership with familiar faces. I have asked several times, you know, for the past 6 months, even have representation. I heading home Ramsey. I've talked with my Commission arena Moran. We've hosted countless or Allen to countless too 2 community conversations around what to do with our unsheltered in our communities as dealing with drug addiction, particularly around University Avenue in Rye Street, which is the heart of my ward. I just haven't came up. I don't know the level of engagement that has happened community. I can only make a judgment on that based off of the level of engagement that has happened with the council member, which I haven't had a conversation and also just, you looking into our our prior bull when we voted on the Joint Powers Agreement and it was from my understanding that it was what the the money was coming from, the o j. What contract agreement between the city and the county and the city's also going to be housing the program of Office of Neighborhood Safety. And that grant that we voted on. And, yeah, super excited that we're able to receive those awards. But and that grant the terms actually end the end MAY of 2025. So in that kind of brings questions even have enough time even issue or complete the terms and conditions of that grant so that so that money can go into programming and also just another thing. My records just kind of show that Exective Director of Summit University was not notified o this double development project, particularly around the purchasing. They were notified of the zoning modification that Catholic charities have put forth. But they were not notice and the members were not even aware about this boat that we are going to take today. So I'm really asking for the council to late this over. And it's really give me time to discuss this with my constituents. My community partners really care critically about quake and also with the ministration around this investment. I want to support supportive housing. I think this is a really amazing opportunity for us to strengthen our collaboration. So the reason for my layover is more in a spirit of giving us more time to discuss this. i'm just so we're all in the same place because there's a lot of mixed information out there. And from my and I'm just I don't see where the support is other than just the visions of the county and the city just enough. I can see where that support is. Then, you know, I can be in good faith with actually voting on it. So hearing that you had mentioned. DECEMBER 6 is the day that the vote is going to take place out of Planning Commission. Correct? Planning Commission. So depending on however, that poll resides and it could come to us and appeal. It is a possibility it could. So I'm just wondering and the possibility that is is an uphill. How would that determine our delay, this vote, particularly around a purchase agreement. Council. PRESIDENT Council member. The ation before you today is to decide whether we would be. Allocating the home Arp dollars toward the night. Your faces toward a capital purchase to advance familiar faces. We are in the process of a purchase agreement and the zoning approvals that need to happen. So if this particular space is not approved, then we would. We would maybe have to find a new location which would be challenging. But this action isn't about. This is about moving that money and saying we will use that 6 million dollars for familiar faces. So if that specific property isn't approved later, we would still be able to to advance the concept. And I guess to some of what must asked about and just for like sake of shared decision-making because this really is it is if I understand, based on going back to OCTOBER and conversations proceeding, that this would be a citywide facility like people who are in our words that are having issues, whether tere downtown or in the midway are on the east side or in Ward one where it is happening. This would be the place where they can get services. So just for sake of everyone's decision making, if I'm hearing you correctly, I want to play back what I understood the action before us today allows you to then go to that purchase agreement conversation to say these are the funds that we have authorization to buy the building. That purchase agreement would have to come back to us to be approved. So you can actually is a city entry into that transaction and finalize that without council approval. Is that correct? So that's another point which comes back to us. I think that's a new piece that I I think I understood that for similar issues, but it is helpful to have that recollection. That's important point to you said that the the owning process is happening concurrently. So is it that it's before the planning Commission right now and then the Planning Commission decides in DECEMBER or ones the Planning Commission process happening. It's happening now and I think that they extended it. They were getting additional comments from community. My understanding is they will make their determination on DECEMBER 6th. So there is community process underway at the Planning Commission and they decide on DECEMBER 6th. And so that's not coming to council. That's just. So that that process is for a conditional use permit. Yes, for the operations, the way that we would be proposing in that building. That okay. I see other thank you for want to get those facts on the record so we can make action today. But go ahead, MISS Johnson. Yeah, just a question for clarity. Just help you with. So when would we need them? The money allocated to be able to engage in the next steps, a process like what is the timeframe? I'm trying to kind of understand COUNCILMAN Roy asking fairly, we're not sure but I'm hearing Ali in for some just wondering like what is the timeframe for Like you need location. But like by wind, south of the plant emissions having different conversation that's related, but not the same one. Is this one because of the action being different on DECEMBER 6? Is this something that needs to be done before DECEMBER sakes? Is this something that like I you're commercials now that's permit like I'm just trying to gauge that. Does this to happen today is there isn't competent counsel not happening today. When is this something that would need to be done by? And then let Chris Michaels. Council PRESIDENT Council my understanding of the process is that the intention would be to enter into a purchase agreement before the end of the year. So that if all of the steps trial into place and the approvals that need to happen do happen. We would enter into a purchase agreement and sometime in the 1st quarter of 2025. And I think knowing that this allocation has been approved, positions us and allows us to enter into that purchase agreement. So if we if we lay it over, it just delays the whole process and delays are kind of funding allocation and due diligence that we're currently doing with hud. If that answers your question. Follow-up. Absolutely ok. So yes, I was tracking to the use of the last sentence and I was like, wait. So it is would potentially like so just again, the the reason. What is the reason for laying mention the hud piece, which kind of that's where are signing play in process. Yeah. Are some of my okay. But I heard from you is just there need to be part a entering into that before. Goal was to have stuff penned by the end of the year, which led me to believe we had time and then the second equipment, the second the lessons got, I got confused because you? Yeah, all attempts but are kind of expert is is here to so. So part of the due diligence associated with bringing the funding into the city, we have to go through an environmental review of the building environmental assessment. All of that kind of due diligence is in process and it's all kind of related to giving ourselves position too. Enter into the purchase agreement. So it's a very kind of rigorous timeline that we're working really hard to to meet so that we can. Enter into the purchase agreement close on the property. There's a 9 to 12 months. Construction rehab timeframe associated with the building in total be 9 to 12 months after purchase will be operational to House individuals who are identified as being familiar faces. So with that up has it MAY be asked Jessica d again to clarify or I think clarification and then we ned coalesce action. So all continue go ahead. Council, PRESIDENT Members, I'm Jessica with planning and economic development. So with respect to the hud funding. So that is our home. Our bill location of the special allocation of home money that came to the city. And 21. It also has allocation plan that's been adopted and as part of this, so we are under an allocation plan that this use fits the plan and the purchase agreement would happen at the same time as a written agreement for those funds, which would then commit the funds officially to that project. And then it starts a number of time clocks, including that the environmental review that Chris talked about relocation and things like that, that the city would take responsibility for at that time of the executed agreement. So I see question from a snake or go ahead. Thanks PRESIDENT. I think I'm just restating that Johnson's question just to make sure I understand. I understand that there are a number of steps that have to happen in order for. Familiar faces to be up and running in this location. And that the sooner that we take this action, the sooner all of those other actions can follow. But I just want to make sure we understand is there a debt, you know, air p dollars, there's a spend down date or we lose Is there some sort of external pressure such as that that mandates us taking this action today or by a certain point or is it not just I mean, it's an important question out like get going quickly. But or is it just that w just want to get going? And there's a lot of steps between now in Operation. Councilmember Neck or PRESIDENT. Yes, there is a 2029 spending deadline so we don't have a commitment deadline for these funds because it is a unique part of money. But we have to have it all fully expended by 2029. So well, that seems like a long time away. We all know that development takes quite a bit of time. So I think urgency is just to get the process going rather than to have the money spent. But there's also sorry, I understand that. But there's also a like this project has multiple pieces with public process. And so like. I don't get that we could. Just talk about this indefinitely. But then there's a whole zoning and public process lake there, there is sooner. I guess what I'm trying to articulate in real time and react a little earlier saying is like. We have to come up with something sensible today and there's there's a concurrent process happening with the community, the very public process that police asking for and that like is required by law for rezoning for this exact property and part of what is being said to the community about the city action is that we're dedicating funding and that these pieces are coming together. So like I respect that technically somewhere in a document by the law, this is like a funding source. That's federal money that's coming to us. But in practice, it is not like well, technically by 2029. So like I do think we need to hold these things together because they are related. I just I respect what you're saying. You are correct. And in practice, I actually don't think that is the case in terms of actually meeting needs of our constituents wanting to respect his bullies, desire to come to some time line here as week ahead, icy of some thoughts on that. I'm working on possible idea here, but I want to I want to like wait a minute where members are at because we do need to make a decision on Go ahead. I appreciate any of the questions that you have. I also have to and many my constituents have. The District Council has. And even though this is about just how we allocate it to the proper account like that urgency, you that within the city, you know, there needs to be urgency around showing that we are doing our due diligence. And I'm doing my due diligence, particularly around engagement around this. And also having a fuller understanding around the operations because we have, yes, the funds to be able to acquire the property to renovate the property. And this is a different item, but they're still unanswered. On answered questions particularly around. How are we going to continue funding us? Because right now we only have grant funding. So it's going to transition to like from the general fund. All of those are really big questions that I think I you know, my counsel, want to dig into. So I'm asking and also just looking to my colleagues support a layover to DECEMBER 18th. And that gives us time because I already working with our district Council, particularly around doing hosting a community engagement on the DECEMBER the week of DECEMBER. 11th, just because that is something that they have said that they never weighed in on didn't make a stand on this by DECEMBER 18th. I believe we can work with. A council members and city attorneys around. If we can put both of the items back on the table that way, we can do the technicality transferring it and then having the conversation around the item on the purchase agreement. So I have led members in line. I would say I immediately address that. And then I want to make sure people have a chance to speak. I would I personally would strongly oppose only over to that date. And the reason being what I heard just now I that in order for us to have the citywide asset we are working to in DECEMBER enter into a purchase agreement that would then come back to us. Well, there's a zoning process happening. And the issue is that we don't have business week's like the 18th is the very last meeting of the year, which means that we would fundamentally jeopardize our ability to get this asset going into the new year. So what I'm trying to get to as Billy is a happy medium between your desire to have more time with your constituents. But then actually like the business week's reality. Because in order for us to go to that transaction, we need to show that we have resources allocated. So. Having said that, I want to go make a line. I saw his Yang was waiting as Kim and then we'll come back to you to work through a solution here. But let's go to Ms Yang escape. And then I'll come back to you. Just want to make sure Iran following the wind. Go ahead. Things Council PRESIDENT. I feel that you summed up really well what i was thinking. I just want to share over like a I what's in front of us and do want to say thank you all of you on for coming presenting. It's really helpful. Just getting the information. And because I don't believe this is something that we got briefed on. And so getting thing here is really hopeful that can ask questions. I'm supportive of Ali over just because from what we heard it to me doesn't sound like any sort of. I was thinking I wasn't sure how many weeks here thinking, you know, so I was thinking if it was like a one or 2 weekly over doesn't seem like would jeopardize the project that order. But what what's chime? But we are trying to do here at all. I do feel hesitant about DECEMBER 18, just cause, you know anything that lands on the last council meeting at the years is really tough in case we need more time and then we have to wait until JANUARY. So I wouldn't want to see that happen. I would ask that you consider city. Last week's into account for nearly over, but what would be really helpful to hear from all of you would be if we do leave this over, what is a date that that you would be able to settle with in terms when we actually do the vote for us. council PRESIDENT Council members, I. Firmly in a recommendation of you not lead over, we will be back in front of you to make decisions about if this project goes forward in that location. I want to correct the record that there've been lot of community outreach that has happened. Chris Michaels has knocked neighbors doors. She's have those conversations. We've had our law enforcement partners. We've been doing that outreach. I will also just for the record this project has been a collaboration that hs been talked about for decades. So when I came into the city of Saint Paul e practitioners and people who work day in and day out with the vulnerable populations that are being served. The drumbeat that I heard from walking into heading home Ramsey is that we have a gap in services and chief Judge Castro's letter speaks directly to it. If we to the question which I appreciate about the future funding. What I would argue is if we take 25 people who make up 50% of the competency hearings that are happening. The hundreds of competency hearings that are happening. They are showing up for those competency hearings because they're committing crimes in our community. But they need services. They need stabilization to. 25 people are cycling through our court system. If we ran the numbers, Ferrari ours. If we ran the numbers in all of this other spaces, very small amount of people are making a huge impact in all of our safety spaces and we are serving them. And so I would just strongly recommend that. If this isn't the right property, we can have that cnversation. And that's the point for those other processes. But these federal dollars making the commitment that those are going to be available so we can find a location so that we can do this work. I just I really strongly encourage you to. Devon Today and I want to keep going to the I'm but so let's keep going on to the lne. That's more than a week. Just, you know, thinking of the timeline and then discuss up another item coming in front of us. I believe he also the first week of DECEMBER. Is that right? So DECEMBER 6 council member council PRESIDENT DECEMBER 6th is when the planning Commission would make their decision. I there is an appeal on either side, it would come before you. Okay. And do you have to date on when it would if there's when it would come to us? There's an appeal. That would that would be determined. Based on that decision that happens on DECEMBER 6, depending on the outcome of that either. You know, we we would bring an appeal. Or opponents. Okay. Thank Yes, I shared my thoughts, but I'm super open again. But other folks think, okay. The line can Johnson goodness, can't. It's it's actually on that. Line and wondering about. see that it is actually designated for a property in the budget. And if the zoning application is denied an appeal, the city only so many days for us to make a decision on a zoning appeal. And so I guess what I'm also wondering is like baked into yur processor. You also leaving space and tme for if an appeal alert happen, you could either fight for that property or then find another property to designate the funds to it because I a and respect to the experts in the room and respect the work. But I think that's where I feel a little like a whole is because they can see that it is designated to a property that is yet gotten the zning approval that actually needs to bild. And it's not in the context around it. Isn't there. But like I served on the committee like those are people that are not in this conversation. They don't track things over 10 years. They're just showing up and sitting down or hopefully that for their packet reading the substance but making a zoning decision based on. Is that a good fit for the neighborhood? And so that's kind of what I'm wondering. Is feel I don't mean to indicate like the cart before the horse, but I'm sort of wondering in this process, is there sace and ability in the event that this property doesn't get the zoning it needs for the appeal to happen for us to make that decision. And then additionally, if we don't improve the peel, let's say, I don't know. Then there's space and time for then you to find a another property as well. It's just like because it's all the moving parts. But I'm just sort of a little worried about that timeline in terms of. Coming back to council and council PRESIDENT Council member. Yes, we've done the best that we can to kind with those hypotheticals. What I would sy is embedded in everything you just laid out is probably why it's taken 10 years to get to this point. And it is in. Elaborate, brave enough funds to be able to. Try to solve this problem. Has been. In our community for a long time. And so yes, if if we don't move forward. So I I like to think about these is very separate processes which sometimes it's frustrating to people because they're not in the whole process, which is why I wanted to talk about this is what our plans are. This is what we want to do in that space. But to keep can at this train moving so that the next one can like stay in line. It's just really critical that we hve those paths. Yeah, I think just to follow up then. I I'm also open to a shorter Lee over but to ensure that cop like I think the intent is to not like. I think additional engagement to ensure more voices can be on board is going to be. Or just even heard if they have to But I would open to open to Lee over if it's shorter as well. Also as an assurance of hearing how much time and attention has been put into this, that that engagement peace really feels like it's being met so that when it comes back. We have the opportunity to say we listen to all the voices. Here is the we give an extra opportunity for more engagement to happen and it feels. And I'm just thinking just around just peer like partnership, a negotiation which for purchasing are seeking to purchase this from Catholic Charities or the owners. Correct. And so are you saying that if the money isn't designated, will Catholic Charities walk away like what is the what it's like? Where's Catholic Charities? Are they going to be good stewards, particularly around us, working through this process, whether it's our process are the zonings process. Have Catholic Charities made a commitment to a date that it has to be. This deadline are the oldest sell it to someone else? I'm just not sure around the nature of purchase. council PRESIDENT Council member Catholic Charities when they pt the property on sale, a did a process and we were one of 2. That submitted letters of intent. And so they had solicitation process. We went through that and that was the letter of intent. And so now we are in purchase negotiations with Catholic Charities. So that part of our time line is we do want to move us forward so that they have confidence barring any zoning and other things that we have to go through, that we do intend to forward with the purchase. So if they walked away, it would not be because of their intentions would be that we did not actually dedicate like are part of it. Okay. I is Michaels and then it goes to Johnson. And then when finally not go ahead, MISS Really? Yes, know there was not a there's not a date around the purchase agreement like they had very good says, Rick So they gave notice to occupants at the building almost a year ago. And the notification period stipulated by fund or a fund or who they currently have funding at the building. So Rick required that they gave notice to all of their residents. They've been moving individuals out of that unit that building into other housing, settings that I think they have about 30 individuals left in the building. They are expecting and appreciative of the relocation services that the city will contribute to that effort to ensure that nobody in the building ends up going back into homelessness. Our relocation services go into place until we enter into a purchase agreement. Right? So the delay of entering into a purchase agreement means that we are able to bring those relocation services to assist Catholic Charities to ensure that individuals are who are currently occupying their don't become homeless. And they are their board of directors and the timelines that we have indicated with them is that they are really needing to transition honor ship of this building within the 1st quarter of 2025. So that's kind of the timeline and the deadline that and I think they're urging say about ensuring that individuals who reside there and up and how someplace else and our relocation services through the home. Arp Grant this needed to do that. ok, so I'm I have Ms Johnson. And then I thought just as your hand up. No, okay. Never mind peripheral vision. Confusing goodness, Johnson. Okay. Thank you so much for just like answering the questions. I also. Hadn't had it directly feed on the allocation piece. But I kind of read through and that it was Morro Bay the active actually allocate resources. That, a lot of the conditions here to I'm just wondering how they could have been handled in a individual conversation prior to today. So I'm just wondering. Have there efforts to office being was located in the ward forward back and forth positions are just like direct conversations. So I really just kind of wondering if there's like communication going on because and if there was a me, I'm genuinely asking a place of like it. It informs whether or not it. Forms of my vote will be. But I'm just kind of wondering I there's been efforts made to communicate with Portland's U.S. Council PRESIDENT Council member. can. She scare how? Because? Chris Michaels, what was the date of the email? Was it OCTOBER 2rd on OCTOBER night there was an e-mail sent to war. One byte Chris Michaels offering to meet and discuss this topic okay. Thank you so much. I also think I'm a little torn up by time line like. But I I'm open kind of what the discussion is. But I ultimately I'm just kind of like. That. That's what it feels like set of a word to the to the feels like right now. Mistake or will have present. I'm just wondering if I could make a suggestion. And I know that I think there's a motion and people. I notice I share this comes. Question about the the fact that this money allocated to specific project in the financial analysis that is attached here. And that's a project that hasn't yet been through planning commission. My concerns are only technical legal. They're They're not with the program and the project which I fully support, it feels a little strange to me to be approving funding for specific projects that might go through planning commission and upon appeal to us. I wonder a little bit about cars and judicial issues. There were not allowed to take a position on something that might then come on appeal to us and voting for funding for specific projects. Seems like it's taking a position. So I'm I'm wondering if. It sounds like the goal here is just too allocate these funds use. That would be used to facility for this program and to give some assurance that that's our intent. Is there a way to do that without having the address associated with the properties that was and to build on that question that I had listening was like is the Patterson there for the procedural purpose of you being able to legally go to a real estate transaction. So if you could talk about how this matters procedurally, that would be helpful to clarify and thank you go ahead. And then I have this come in line. Council PRESIDENT Council members, we don't have the lawyer in the room that worked on that. And I think it would be a legal question for him. Council. PRESIDENT Council members. I'm hearing that there's I guess what I'm picking up is that tere's a desire to have a layover. Part of what you're hearing. From us is the many, many years of work and I would just be really candid. I'm really worried. About what is going to happen at the federal level and if there's a layover that's needed, we'll make it work. We'll figure it out. We'll figure it out. We're going to come back. We're going to work really hard to get this done. And I really hope that we can count on your support if there are meetings that we need to have, we will have those meetings. We will bring the people who have been working on this for many, many years. This really important. If you need a layover, I would just ask that you think that a short as possible. What our sidebar has been about in terms of like what an appeal could even look like within that timeline and how many council meetings we MAY even have left. And so. Similar. Similarly, where like Ike, I I also maybe would like a more direct response to lake in terms of this process and money specific to this property in this specific resolution and knowing that if the appeal comes back, like are Indicating intend too early for the council, then to like, I don't even know. But I think that's a really good question. So I'm sort of playing on that throughout that night. Wondering is then logistically speaking, not just process, but like do you have to have the address attached the dollar amount in this resolution? Like knowing that there's like there is support. I think we're very much more in the like the logistics piece of this. There's good intend for additional like time for engagement, theirs. Good intent here to be like. Making sure that we can even be supportive of. In appeal to support this project happening. Should it come back to us? So I think if we can get maybe more of a direct response, not now because it sounds like colors in the room or maybe but like is there. Can get back to us tomorrow. We're like next week. But in in which case it actually does feel on without that sort of legal guidance. And then again, recognizing what the reduction of council meetings we even have in DECEMBER recognizing that is calendar days. Regardless of what we need, I actually really would feel much more comfortable getting some sort of response on that. And so for the intent and also this getting this answer again, it will say I'm supportive of a layer layover, but also not I think too long in addition to the fact that the back end of this appeal process could be much, much warmer than nrmal I want to respect the line I am. I thought that the line was Ms, Kim and then was it coming back to you as Billy and then it was ms Toast. I. Sari and working really hard to make sure everyone can like work through this and work through this with the deputy mayor. Well, like balancing all of the things we've to balance. I want to just offer some thoughts that there hs been no discussion of a layover for 2 reasons. The one is to allow community engagement. One is to get some like factual matters. Clarified. Toward the purpose of a Dember purchase agreement which still is contingent upon council approval and like zoning and all those pieces. So like in terms of where we are in the decision-making. Now, within that. We have to deal with the realities of being able to bring this resource online. And so I'm much more amenable to a shorter Lee over in order to get the factual pieces clarified. And this is where I'll be direct with us because I want to problem solve and then I will pass it. You could your next. But I don't think it sets you up for success to say, hey, constituents like I want to do more engagement with you. In like a one or 2 week period. I think that path for you could be you need to make your voice heard of the planning Commission. You need to send me the questions that I as your COUNCILMAN Can get out of the administration. This purchase, a brief and doesn't get like approved without my vote in 4 of our members to like it comes back to me. So like I want to talk about forgiving extra time, what is it for and what can you realistically do so that you can be responsive to constituents and to that were true to the shared process? According to my ward and then the community engagement does not stop like that's the nature of the thing. But the plan being on track allows the engagement to happen better. And that is important. So I could be able to talk with deputy mayor and also Christine from familiar faces and as one also clarify the record for the OCTOBER 9th email. This was talking about going to the condition. All use permit which I'm fully aware the conditional use permit conditional or yes, conditional use permit is what think is where the engagement is happening around changing land. Use. In making those modifications and that has been engaged with our district council. But what hasn't the what hasn't thought through or talked about. And I also want to acknowledge respect, yes, the decade work this planning, this vision, assessing all around where the city can contribute, which I am in support of, you know, stopping those problems. I just think on a given the fact that these dollars. Don't have like the expiration date is in 2029, the purchase agreement. There isn't a purchase agreement they're still in negotiations so they can negotiate when that data is. And also there's zoning pale. So my suggestion because like very exhausted with this conversation. Not gonna lie is we can move it to DECEMBER 11. I think that would give me some time. I mean this, Larry, I asked for 18th cause I wanted already organizing meetings without without ministrations. And have meetings with my constituents not to tell them what to do or how I feel about it are get on record to my thoughts about it. But to at least give them transparency about this because there's another bigger conversation that's going to come before us around just the operations in the programs and we want operate operation lies. You know, and faces. But just getting that community in that area familiar with familiar faces, I'm just seeing the the snowstorm ahead. If we are really doing due diligence and really answering these questions not caught up you know, some legality. And with the amount of time we have left with the council, have a few more meetings left. I would I think my preference would be to just with how critical that this I to support the funding. And then if appeal were to comment again, I don't have like attorneys advice on this, but I would hope there's a way to mitigate that. That still keeps, you know, the council in our proper potential cause additional role unless, you know, anyone is has like a major, major concern about that. But this has been an r agenda and you've been aware of the processes in tandem. And so I would expect one of our attorneys, somebody who would have brought that to our attention if that was a concern. So Im I'm not in support of the of a layover on this item of of any kind. I'm just really concerned about the timeline. We even have left with this year and with this press as being have have an idea that end. Said it would under line someone to go to MISS Johnson them in a share. My idea that I would like to out that I would like to propose to his billion to the group based on everything we've heard so that we can. Get to a next step. Go ahead, MISS Johnson. I was not able to be at that meeting to get there to hear directly from my constituents about a matter that was really pertinent to them. My concern and my question for clarification is based off of that being that I think the intent behind the layover originally, if I'm hearing about a little boy correctly, was to be able to engage with constituents. My concern based off of that is we leave the matter open, you're But there's actually a quite unusual question and count that we're not taking here of like if there's a current thing on the agenda that you cannot engage with, is that part meant to that is this is an example where that would be in place or not. Yeah, so I understand I think I think that the critical question judicial thing and this is where I have a minute in answer to that. And then a minute. Well, first of all, started you have an answer that you want to get to that because I want I just want to know quite additional stuff is in count in this matter. And I that's my question because that was something that was an for to the point that we're all getting at and to what I'm hearing members wanting to do so I'm hearing tat. Well, first of all, let me just get for the record. No appeal has happened. So there isn't a question I to shul issue right now. So it only is lace if, for example, DECEMBER 6 taken into account and there was an appeal afterwards. Then would we? If appeal has happened as soon as that appeal comes, cause it to do is in effect. So now the piece that I heard is that members still want to iron out the the piece of does the purchase agreement become an artifact in an appeal situation that like to something I heard Ms Bowie say turn into a problem or like a public process issue. We also are talking about like running into DECEMBER timeline. I would like to propose and this doesn't preclude further conversation. I think what we should do is lay this over one. We can iron out the actual technical question around lke the legal staff and how we can interact with it. If in a week we are not prepared to move this forward, then I think we need to think about like is their next best layover date is there. But we are running into that DECEMBER runway. And I think to be set up for success. We have to send you into the purchase conversation in DECEMBER and earlier in DECEMBER versus later while saying there's a concurrent community process happening and this is where they go to talk about the rezoning and all that stuff. And that stuff is an ongoing conversation that has been going to this point and continues and that we're all going to have to deal with like I don't want to leave Ms Bowie to take these questions from her cnstituents alone. I want to be able to support her in that so that we all are saying we're in this together, whether it's an asset in downtown or in Ward 4 or in Ms Johnson, border other right. So I think what we should do is move a week to get the like actual cause. A judicial question around the the purchase agreement fgured out come back in a week and once we have that information, I think there is a group of us prepared to at least just to step one, which is allocate the money. But we would one of have with that. What's the process from here? What conversations are planned? Where can the community go if they want to interact and shouldn't all be on onyeka either like we're going to share this resource together. So I want to see if buoys amenable to that because what it does and believe the reason I'm suggesting this, it doesn't cut off a future additional action, but it does allow us to kind of move forward from today based on what we got and then we could potentially get to a clear place next week. So that's my idea. And then as I know you're in line, but also where go ahead. Fine. Because you gave a yep. Yep. Yep. And I know you're tired and we're tired. So what I'm sggesting is rather than punting this in a DECEMBER, which I worry actually like sets us up in a bad place. I think that what we should do is lay d over a week. I think we should get exact legal guidance about the quasi-judicial question of the item being in the purchase agreement and whether that sets us up at at counter odds with what we're trying to do in a week. We'll come back with that information. We will that neither advance it and go into DECEMBER and and like the subsequent community processees or we will I don't know, do something else. But if in the wek and I hate to say this out loud because I want to support it. I think we all do I mean, at a certain point council has to vote on whether they support this or not like if in the week people are there, then I guess we have to decide what we do. But it doesn't preclude us from keeping the conversation open. The reason I'm offering this in love what you propose, COUNCILMAN, is that if we push this out so far, I actually worry that like cuts off the conversation and it's like we took that time. But then it didn't matter that we took the time because it's not like workable anymore. So I'm saying rather than like plan to talk about this in 4 weeks that we come back in one week with more info and then we move together and we will and that we are prepared to support you. And like all the questions coming your way. I wasn't 3 hour meeting last week about Kimball Court like I'm there. So I don't want you to do that by yourself. But we all want to be position to make sure that the process ironed out that way. So that's if you're amenable to that. I would like to move that with you. But I think that would actually be really useful because the appeal time plus a 60 day if it applies. But it's just - starting to look at like the number of council meetings we have and then if it comes to the DECEMBER 6 planning commission, that doesn't necessarily mean it makes on the next agenda. And so like there's a lot of moving timelines that I just I think we want to be. Unclear on. And then and that's yeah. Thank you. S then we would still be position too. The outcome of that decision, right? So that would still position us to close on the property in 1st quarter of 2025. The conditional use. I mean, I'm countries that Our purchase agreement would stipulate right like passage of the conditional use permit the could. Can't close on the on the property and tell the conditional use permit passes. So the process brings it back in your lap throughout appeal process. I think like the beginning of FEBRUARY. But we confirm that up and bring that back to next week. But gives him time. So the one we'd go ahead. It would give us time.
