taking time out of your evening beautiful day um I would like to uh get a motion to adopt tonight's agenda please second any discussion on tonight's agenda okay all in favor of adopting the agenda as is say I we'll move on to the consent agenda do I have a motion on a second please any discussion on questions just have a couple of comments just kind of for updates um projecting balance at your end right now is about 232,000 um that doesn't include some unanticipated Revenue think we're going to see from for the second half Ms um but uh somewhat concerning we below the 30 that would leave us below the 30% policy 27% it's not a perfect we don't knowly expens just wanted to mention and uh the first half revenues were about $39,000 that's second payment don't know so that's the good and the bad thank be especially important going our Bud process do we remember I think we are at 290,000 after the audit so this would be un united estimated estim so we might be close that thank you U just a couple comments um I see the um the loans went out for the uh small was it small business right um I see capital outlay for account description is that what they were coming out of or they coming out of the revolving Loan Fund or how does that work yeah it came out of the revolving Loan Fund think that was the only expense we do there's an account for there's for expens when we do a dispersement got it thank you um's ERS and Associates uh 2500 draft a TI report theend that's basically it yes they um submitted that report to the county for us very involved so we have that for us how many of those do we have just in my limited experience I only one okay I believe she's right um I don't see anything else um oh I did see that the um the utility funds are coming in you know from payments and stuff so that was that was good to see that's all I have thank you anything no all right we move for to the vote to approve the consent agenda all in favor of approving the consent agenda please say I and that moves us to public forum Dave you'd like to come on up and chat we'll ask you to speak into the microphone just for record pures hello I'm here on behalf of um the Bruce house um it's a historic property uh 1850 uh 3 and we just want to know what community would like to see happen with the house as far as like Museum um there were a couple other buildings a kitchen um open to the possibility of maybe opening that up to the community it work um there was also a guest cabin that was brought up to the top of the hill that a residents now so there we have a lot of possibilities and options we just kind of we had uh the board over from the Historic Society they did do an article on some of the artifacts that we have from the Roose family so we think it's pretty important to the town and we want to keep it as best shape we can we're uh looking into some Mason work any suggestions or recommendations uh would be appreciated and then also uh we have a consultation coming up on Friday to get a mountain and uh like a fireplace like a gas outdoor Taylor Falls doesn't have any HS that you really see so we're right on a corner property if the artist could build it that could be something that people walking by would see I hope it wouldn't distract traffic but um you know we're just open to the possibility we have a lot of stuff we have a lot of work um we got a citation for the grass being we really um were trying to let the natural flowers grow so there was a little discrepancy in St Paul they're letting grass grow like this tall that's uh wheat there's different kinds of indigenous grass apparently in Flora Engles Wilder's time grass was 3T tall elmondo rode his horse and that's what grass was so we're trying to put plantain in um it was a native like herb or plant it's a root um it's safe for children to put on mosquito bites if you get any swelling it's natural you put the leaf on I mean that's what the natives use so we have it growing and that's what we were trying to do is expose that that'll only grow this tall so it's not going to be needed to really be watered or maintained and it's natural and I imagine I don't know about animals but their paws probably it's if it's soothing for our skin I'm sure it's animal friendly but um so basically I think I covered everything we are working on trying to refurbish the house the yard and basically uh we'd like to not really open the main house up to the public but we're I guess open for events shoot Oscar Bruce's uh portrait was done in the library that's in the Smithsonian you know does anybody that going to school or have an interested children you know I know they have the one room Schoolhouse and they do that uh we just like to you know work together whatever we can do we'd like to help all right well thank you much thank you and and if anybody would like to see the BR house sometime just contact us we would like to you know we're open to any suggestions just to keep it up you know I mean it's done the appear longer than us but all right thank you just a question have you talked to anybody at the Heritage preservation well we're trying to link with the St PA because it's really through the St so the this the Taylor Falls orago County doesn't really have the means to do what we need and the fome house doesn't really support another house to be like a open like for that but I think with like recordings and stuff like we're finding all kinds of music that Oscar Bruce uh wrote we found name books that child Bruce had from translation of monies um there's a lot of art like really far like artifacts and and uh I mean I think that the city should you know and even some of it probably hear in the archives some of it probably should go here and some of it we're in discussions with the Historical Society because they would like some of the stuff so we just want to make sure that we preserve it Toby has the most history from his parents and his dad I mean well that's another thing history wise the house that refurbished it was Air Force um secret missions and then his wife was from Denmark and her family was German so some of the fur is even older than the house itself so and John's father was a metal worker and he wrote books at at the library Congress so I think we have some valuable stuff for the city the history and for the future because the History built what's now and what's going to be for the future you know and how it mixes but I mean so many people are really interested in like the immigration and how it worked well our house was they had a m live there they they brought people in and set up Farms I mean I don't even understand all of it but it really is how this community got to where it is today you know so I'm glad you guys are here doing you know I don't understand each and every job but I appreciate it and I just you know really think that we have a gem for the community and we have to preserve it so that's my appeal or my new it I hope I was clear I mean oh yeah again could you leave contact information oh yeah with us or with the city maybe City staff and then have you been work um with f candidate yeah she wrote an article in the I think yeah okay so okay well yeah we'll keep going how often do you guys meet every month or two two meetings a month twice a month oh okay well if you know we'll come back or whatever or try to work on projects or if other departments or Parks and Recreations you know we to whatever you guys think would think get the best okay does anybody else like to speak I only got one sheet turned in okay we'll move on to Old business then uh number one is the utility rate study and results and Tim I'll let you take it from minut all right thank you um a while back uh Council approved the issuance of an RFP uh to get proposals on um a raate assessment for our Enterprise funds storm sewer um water and sanitary sewer and uh those uh proposals came back um Kevin Lee and I have reviewed them um what you have in front of you and there's a couple copies at the back table as well of a spreadsheet that's just kind of a summary and and decision Matrix that we use to make a recommendation the recommendations went out to ABDO Bolton and M and Erics norstar um the quality of the proposals were all very good I I we scored uh ER and norstar at three because they actually into our whole reports and added that into their proposal so I pretty impressed with that qualifications they're all very well qualified would you sent them an RFP in the first place but just to document that I'll have very good relative experience that work with a number of communities locally Statewide regionally National um they provided two of the three provided a schedule and I'll talk about that in a second and then we cost as well um so on the schedule didn't include a schedule so our assumption was that what we provided them as estimated schedule or an agreement with um and uh the cost um really is relative to one another um Ericson came in low so they got the highest score and um came in in the middle and came in at the highest um I believe um part of the rationale for the difference in cost why ear is so low um they um I believe their overhead little less what you have large fir um they've done this kind of work for a long time they grew up in engineering and City uh operations um very with it we have a nice list of references and a portfolio work so we felt comfortable recommending actually ER to do the work so I could entertain any questions you might have well as I was reading through the proposals you know I was leaning towards you know because of their familiarity with the city and saw the proposal put the braks on and I was curious as to how they could come in basically Happ to but to were proposing and um so your explanation clears a lot of that up and you know can't beat that price and they had the experience so I would go with there also because you know maybe they're putting some fresh eyes help to put some fresh eyes on on City and yeah your last comment we talked about that too thought it might be good to have somebody weour that unless reest yeah no I looking looking through them they're all they're all good but with um a better price figured that would be the way to go thank you um I'm going to be in I'm going to be in opposition to this no matter what one which one we go with at this point um first of all I want to thank Uh Kevin and City staff for the work on the RFP I I know those aren't easy there's probably a template to help out with um but um I'm sure that I'm sure that was a lot of work and I do appreciate your work and and they were following council's requests to do that RFP so thank you for following through on that I have um I guess I have some questions on what what are they doing um what is being done here from what I understand it's studying the utility rates correct it's analysis of the utility rates so current they're assessing the the systems as well and it's a fiveyear look forward to see what projected needs there might be and how we might be able to adjust our R to accommodate like we've been talking about numb St but there's some pretty major prev mement that needs to be done ATS and believe that was like 25 Grand piece yeah um we've got a World War II era um holding tank here that um we will have assess but you what if we need to replace that so at the end of the day we'll get a report that projects what our rides will need to be to accomodate current and future needs of um the entprise funds um so there's a lot of work that goes into just assessing current rates other competitive rates too I we don't want to be so far on the ballpark that you look like I think North Branch is just kind of ridiculous at high rates but we need to the Enterprise funds need to be supported by the revenues in and the system we don't have a capital plan today um I don't know when the last time the rates were adjusted we did last year but before that um Elizabeth was able to find a a 204 report um so we're going to SC through that as well that'll be a good hisorical document that was 10 years ago I'm not sure the rates were adjusted since 10 years ago right and our fund Balan especially water is um dangerously low um that's even without doing preven or so what would this come out of this $26,000 well my recommendation would be um just to split it probably I have we can split it however we want but it would come from those three Enterprise funds um easiest thing to do would be 5050 there's not going to be a lot of work in the store think no it's mostly the water and the yes I don't know if it's even worth charging that so I would say a 50/50 split between the water and the sewer price funds um so it be about 7 Grand P um sewer fun is healthier than water fun Al not gr um and from that they'll be able to determine what rates we should be get recomendations for us then to to go to council discuss and however we feel necessary and I I do believe the mayor I think it was mayor that made some calls to other other cities for schedule information I mean is this wouldn't this something we could do as well uh on utility rates and consult with other cities and see where they're at now I understand the maintenance portion and the replacement is a different issue but I mean a part of this is to make sure that um our citizens are fairly assessed I would I would assume that's part of part of the that's our goal is to make sure they're fairly assessed for the services they're getting um and I I guess I'm just I'm more on the side that I think this is something um we could do on our own we could do inside or do some research on our own without uh passing this cost on to the res and on your comment last year I did um before when we decided to increase rates I pull I don't know five maybe six local and they were all over the from Branch charging 10 bucks for water charging and they were all in the middle so there wasn't any real Target you go that's where we want to be and we don't know what we don't know that's kind of the scary thing we don't know what's coming up what we should be doing and what we should have been doing 8 years ago these Wells are one is pass through and one is do and a third will be coming so um it's my belief and I've worked um my in my work life I was in in charge of um infrastructure capital and um this is exactly that kind of U study whatever you want to call it investigation that we would do to assess the future needs of all infrastructure related um and that's what we make our decisions on was wasn't guing what about estimates at a workshop what about estimates for the for the capital that needs to be done and Replacements and and then and then we just do a workshop in house with the data that's been collected from other states again all we're seeing are rates we don't know what they're funding why their rates are what they are um they for all I know North Branch has done everything we want to do and that's where the race need to be that's what we assume right right we don't know and yeah and I think the residents are making that assumption too or an assumption that we are we're being fiscally responsible with with their money um that's that's what we should be doing I I did look at this um and mink section F I'm not sure what page it would be on in the new uh agenda packet but they they say operation Operation and maintenance expenses for the water sanitary and storm utility will be projected based on historical Trends and budgeting information provided by the city do we have this information do we have any budgeting information we have we have revenues we um expense historical expenses um we have some ideas on what needs to be done in the future but we don't have all information yeah so that that could if we don't have it all that could skew the skew the results I mean we just have some information is that going to be enough for that well we'll find out well after we spend the $26,000 right well it's not 26 it's 13 well for that I'm reading both make it this right um is is this in banion this information or where do we have this budgeting just I think it's abandon I'm not sure how the utility BL works exactly there's a separate module but but yeah I think the bills all come out okay the budgeting I'm not sure all the reports because that's where we traes okay and and we go back back we go back 3 years easily I think I think we have access to data older than that but it's a little more but if we go back three years that won't account for the major expenses um the capital expenses need to be made correct well that now have to be need to be made are in the future right so that's what we be identifying interrup these fund balances are Curr 6,000 yes pretty solid yes but I will talk also to the fact that over the city sewer L and once that was completed supposed to last so those should be in pretty good shap anticipated maor exp there are some lines that wen't we got the line coming up fail some work um my gu the work will be I think that's where we the least amount of investment thank thank you I I I I guess I haven't changed my position at this point but thank you for that information I think that's something that does need to be taken into account this the capital improvs that need to be made um when I look at this I guess I'm just looking at um we're paying another Corporation $26,000 to come back to us and tell us how much we should be charging our citizens well correction just just to correct you again my our recommendation is not um full oh I understand I'm you know I agree with all because I read the um Eric nor you exactly right and the nice thing that they did is some of the stuff that we could be doing on our own the first thing they did is they grabbed our audit from 2023 and their fund out I mean that's great that I mean they were really small town center and they and they made a point of that um which I'll say was part of the reason that us to make a recation actually have a rate assessment because we realized our balances in the funds were they should be right they should be at 30 or ideally 50% of operating they're not there um so yeah I guess that's that's kind of my position right now is if we're looking at we're looking at um fairly assessing these fees for for the future and and for uh for our citizens and I just I think the if we're really going to beir there um I think we should we should really do some some more internal work um getting some estimates and and possibly doing a workshop on it just because of our fiscal situation where we're at at this point and I understand that's you know we're we're in trouble with some of these fund balances right and and now we're going to spend another even $113,000 to find out how much trouble we're in and how we're going to get out of it and I'm just not sure that's that's really um fair to the taxpayers at this point um to pay somebody else to do something that I think internally um we could we could do on our own at least get a little at least get a a a good assessment of of where we are without paying you know spending the taxpayers money to figure out how to charge them fees just a couple of comments to couple things you noted um you mentioned Fair rate um I want I we do want to make sure it's fair but we also need to measure if we decide on our first meeting in January to raise rates why are we raising rates I don't have an answer that I have a feeling but it's anecdotal at best right but and all we're saying tonight to pay somebody else $113,000 to give us those answers expert job has been work other cities that could be that could be no it is it's true well I know that I know that but it just sounds like we're taking this this decision making process out of out of the people's hands and we're just you know turning it we're just turning it over to somebody else because they know more however I do have to say um like I said the Eric and Northstar was if I were if I were going to vote in favor of this that would be the ones we would go with without doubt but I'm just not sure in a position to to do this at this point um but I I do appreciate certainly the RP out we doing anyway of the calls you did make Tim to the other cities I think that's uh that's kind of a template certainly what we could do in the future I think um Kevin probably has some good information I'm sure lead us too on on what some of these things would cost we already know how much how many years out we are before they definitely have to be replaced um and I I just think that's I think that's something we can do ourselves and more be more directly responsible to the people instead of just spending their money and giving it to another Corporation to make his decisions so but that's just my position thank you appreciate your com thanks um I agree with you when I looked through them I thought oh my gosh where is 26,000 24,000 and then I was like why are they so L it caught me right away went through the second time um Eric norstar I looked them up I mean because I didn't I'm like wow we have something to do for name right um I agree with you Troy were you know the cost of we keep on spending money and money and money but we also are raising things and I feel like even me going and getting four uh fee schedules from different cities to north to south I'm looking and I'm just averaging out I don't have a reason why I'm averaging it out I don't know where the money's going I mean if I raise the fee schedule again and we're going to raise taxes again we're not telling them why we're doing it and I think that's important so I guess in my mind using a company that's why I would do it because they're going to tell me what we're doing I mean our wells scared me after we've had this conversation during our budget meetings knowing need to be cleaned we haven't been cleaning them on a regular schedule for a while um and we're getting back on track now which is wonderful but if something goes bad really quickly and we don't we're not probably saving money we need to I don't want to raise anything to be honest with you but uh I sure don't want to just guess and I don't know anything about sewer I don't know anything about water so for me to be at that Workshop I would sit and listen to everybody but I want somebody needing it that understands it all um I'll learn I I if it would save money I would go jump in that tank and scuba dive and clean it too but I mean I don't do that for a living so I mean so but I bet we could have people pay to watch that thank you mayor I appreciate that and I think what you've done basically is you've laid out some of the Investments that we might have to make and I and I think we can you know I guess that that's my point is we already know what's coming up um we've got a good idea what that might cost and we can basically tell the people this is what we're doing this is why we're doing it um because we know these are expenses are are coming up and and just not pay another institution to do it just you know just make those decisions as as representatives of the people that are that elected us to to do do that well I I would I know water sewer pretty well Lee does pretty well Kevin does pretty well I don't think any of us consider ourselves experts and talking with our the liaison and public works it was pretty clear that we needed some help anything else thank you thank you all anything else okay um well I'm going to call for a vote here um see how they want me to read this I know they want me to read it just the way it's written so um I'll need a motion in a second to approve denight or table uh to award the utility rate study to um ericon norstar please I'll second discussion sorry reading it out so that it's all recorded um all right uh no other discussion all in favor uh say I I I I oppose than thank you for a good discussion thank you we'll move on to number two adoption of zoning and subdivision and I let you take it from here thank you okay so I've been working with bolon M and assembling the zoning ordinance so it's just the zoning and self division ordinance not the rest of code essentially what they've done is gone back and gave them every single in every box that I could find we went through um resolutions paper files holders and assembled it and what they thought was the most accurate ordinance and going to adopt that as a pool so there's that and then they made minor Corrections formatting spelling grammar um and some just general housekeeping so sometimes you might find like a a statement that just didn't fit was it had spot below it so what we did was we made those kind of changes but they're not fundamental changes we're not changing what the rules are necessarily um so Planning Commission had public hearing um there wasn't much public comment um we had one and that's in the in the memo there um all proper notifications were sent out so um at the public hearing uh Planning Commission recommended the drafted zoning ordinance at that time um except we did have to revert the shortterm rentals that were proposed to be pered use at the time that were AAL use to begin with because the Planning Commission was working on a short-term rental licing ordinance so we were kind of projecting that to be going through the same time so we made that switch but Planning Commission decided push me the short term to licing coordinance to table that so what I did was I took that drafted and I reverted everything back to but kept the rest of the proposed so again it doesn't really change itally but I did not add backf knowing that are going to be coming back soon and they w Really applicable and can also on inial use permit still is be inial use permit so um again not fundamentally changing everything but it's not the exact same language that was in the previous ordinance um after the Planning Commission meeting I know there just a few other um topics that came up um one is uh crypto mining data centers artificial intelligence centers I you know gave a good description in the memo again and this isn't since it's an emerging land use those are opportunities for people to kind of create be the so there's where you know we think it falls in thein changing things but we just wanted to clarify that they're not aot Zing districts storage and shipping containers zoning can be kind of own language times and if you look accessory buildings and sters are typically treated in zon thetion is I no they're not allowed um but if an average person reads the ordinance they like doesn't say they're not allowed but it's kind ofation so um just kind of so I added that as well because I believe that is the intention of rein so again not a fundamental change just a clarification um and also backyard chickens when um the city adopted a chicken ordinance in 2014 they added a separate orance in city code but didn't adjust the zoning or to match their intention of the chicken or so technically for the zoning or stilled but for the city chicken or allow so I just the chicken or put those zoning in the zoning just so they're driving again not fundamental change just location um and then the fee schedule um we did within the orance and instead ofing thees and the system to C will change this so it's not so much work when you guys do your organizational meeting um what was done is like at the end of they those applicable fees for the section and and then would have organization meeting up schedule but not go back every up so um it makes sense to just every section refer it to the official Fe schedule so that's what we're doing now and in doing that we noticed that the park dedication fees were not official schedule so just add add there so um my recommendation is for city council to approve the attached resolution 2409 0 the replacement of the city zing and subdivision ordinance with the attached ordinance number 20249 and exhibit a zingis the official and add that add just that and then two the resolution 2491 a summary of the publication of an ordinance establishing a zoning and subdivision regation in the city to Falls and um so that item is so that we can publish it's a summary so we like to publish the whole stack which I think we budgeted for so we're saving money you guys okay so that is what that item number two is for in the memo and then three approve the addition of the below parted dedication fees to the official City to small Fe schedu as I just described so we've got three motion needed there if you guys could when you decide if you decide do you have any questions I have a couple just just real quick can you go over that again section two I noticed because I did have a question about publishing um publishing the notice for the hearing and I'm not sure if you covered that or not oh the hearing yeah yes so the hearing the hearing was the 26th yep the public hearing was on the 26 so that notice was posted 10 days I can p the calendar there well it says U on this it says both draft ordinances will be available on the city Taylor Fall's website by August 22nd so that's 8 days right between between the posting of the ordinances and the actual hearing and then I'm wondering about the notice itself that so there's like the contents and then the notice that will be the notice that will the notice that will be was Sor I put the memal no I just want to make sure that people have had an opportunity to yeah so it was well you could look at it four five 10 so that would have been published in the newspaper on August 15th so I would have gotten it to the 12 and published in the 15 15th and then I also posted it at the post office and on our and on our website so you the notice went into Shaga County into the the newspaper on August 15th so that's the publication that's in correct yeah that's the that's the minimum required no right right and that thens it to to the website okay yeah that's I I just I saw the um the statute here on on the requirement when the amendment involves changes which isor when an amendment this is U statute 462 357 from the state of Minnesota when an amendment involves changes in District boundaries affecting an area of 5 Acres a similar notice shall be mailed a notice of the time place and purpose of the hearing shall be published in the official news paper of the municipality at least 10 days prior to the day of here so that was my question that's why make sure that's exactly what we did and I just have a couple more comments is that okay thank you for bringing the par p and the trail fees in um bringing them forward um making them visible I know there's that's that's actually a lot of it's a lot of money but I think we as a council um have a responsibility to collect the fees when we can when we're supposed to um and that eases the pressure on all the all the taxpayers that are involved uh my other question would be on your memo it's page page 25 I'll read it it's on the chicken orance back aard chickens and uh the city adopted a backyard chicken Ordnance section 348 outside of the zoning ordinance in 2014 when this change was made the zoning ordinance was not updated so you go down a little further and then then you say so to coincide with the zoning District described in the backyard chicken ordinance I recommend adding backyard chickens as an accessory accessory use in the rural Countryside rural transitional and small town zoning districts again the allowed uses within the Heritage preservation overlay District are those of an underlying zoning District so backyard chicken shall not be added in the Heritage preservation zoning District section and that is they will not be added in that section because there's an underlying zoning District correct correct and what is that well depends on the property so if you if you go to it's more clear now on our official M um so an overlay means there's a zoning District that exists below it and that can change from property to property so if you look at our map um you'll see in uh the angel Hill area some of it there's just a sliver of it just a few properties that are actually Z St Cy River one or two whatever the one is um and then the rest of it is own small town underneath okay so in the orance where it says you can add it so where the intention of the ordinance as it was written is for B air chickens to be allowed only in small town Zing district and the um the rural ones that doesn't include the same for rer district right so you can't add and it would just complicate the ordinance because that's just how the overlay works it automatically defers to the underlying zoning District so there's some properties that are Zone sty and there's some that are Zone small town so the ones that are zoned small town can have chickens the ones that are Zone St Croy cannot right so that's why you can't add that language specifically to the Heritage preservation overlay right so just more of like a mechanics thing works yeah and I guess at the first time reading this I'm going oh my gosh anybody on you know in Heritage preservation is not allowed to have chickens and that's not the case the case is the reality is because Heritage preservation is an overlay or at least Ang Hill is an overlay you know as long as it's overlaying a small town District correct and it's not a problem yeah and then as you could see like the progression of the zoning map and this is why it's important to properly update your Maps too so we had a 2008 map and then we had a 2011 map and it looks like they divided out and added the preservation overlay in it yeah which kind of like visually erased the um the the base zoning District so I took a highlighter and colored her back in yeah um until we get a nice official map that looks a a little more professional just so that it shows those those Bas zoning districts under the over right I I guess yeah and that's fine I just you can see where when you added the emphasis on not being inherited preservation somebody can go wellit minut right right but the reality is because it because it's an overlay and um people might be in the small town Z District it's it's not an issue right okay thank you pleas well that looks good okay thanks for all the work thanks for hiring a lot of it out I do want to thank you for taking on the rest of it though because I I don't know if we've spoke about this but Bol mink exhausted what they allowed for hours um and so they were supposed to come part of their and that's where it was kind of scary with this one like can they just not show up or not finish um I don't agree with them that you know if you bid out a thing you bit out a Thing If you go over it's your your fault well they they weren't going to rectify that so I appreciate taking on the rest of it putting more work under desk than you thank you anything else good job all the way around I agree but I do have a couple questions just one is for my own make sure I got this right so no substan changes were made that would require a whole different process that'd be like the next step correct if we wanted to change an ordinance go through if we didn't think it fit we'd have to go through it so when we're making these changes I did ask Jenny about it because in the name of transparency I don't want people because it is language change but again not not fundamentally um but no this would be an opportunity she said we could put things in there but you want to point them out but I wanted to stick with the objective of of it because I know we need a lot more adjustments um you know we could have you know done you know oh I want to change this or I want to change that but just once at a time keep things very close to what they're supposed to be keep things going with the intent of the existing organs what's the objective this gets us back so we're not trying to sneak there a lot of talk you know we're not trying to sneak any any new contents really in and any changes that were not you know to the tea are specifically pointed out in memo so thank you just to be transparent and does this complete the work with Bolton and make okay um and then just from education so a sum a summary posted um or public notice the summary is adequate as long as you have the documents available for the public whether they be hard copy electronic correct that's my understanding then we have the record of what's passed so I think that'd be a better question for Fritz but that is correct specifically allowed in the statute as long as you have a place for them to go and normally that's that's while somebody does come read the code but uh that's that's correct cool again Mr Mayor yes u i I do want to just reflect as an observer and an advisor to the city legal adviser this was an excellent job um and you know to answer some of the questions you had about while Kem at basically you recodified and modernized this part of your code and it is much much easier to defend this kind of code um if it gets challenged for some reason it's much much easier to amend techic of this kind of code if you've got everything in uh in its proper place and I I'd have to say that they this is an excellent job and very impressive U I must say for just the effort and everything that went into it so U I did want to observe that so that you understand that this is really kind of a big deal if you hav appreciate it I get the sense that you do and and it is an excellent job I have reviewed it it is an excellent job it's fine I I have nothing to remark on in terms of its format I'm just going to add um because it wasn't my recommendation I think I have it somewhere in my memo but our variance process in our previous ordinance um was not up to State Statute and language Fritz that we couldn't legally follow like if somebody applied for variant you know last month or whatever I couldn't follow our ordinance process I had to dig around in State Statute I have to figure out how to do it because our process was essentially like illegal so one of the major changes that they did make is they updated the variance section to State Statute that was a significant change as well well I would say it is a a meaningful change I can say something but it's not a huge change so it's something that you wouldn't have practiced and if we've been advising you as to what to do or not to do we would have had you follow the stat anyway so a difference there's some differences in definition in terms of what's allowed it's a little bit more flexible I would say now than it used to be um but it is would be viewed as a minor change and this is actually probably the change most cities have had to makees years so just to clarify too I know we're going to vote here for a second but moving forward now we if we adopt this tonight then zoing and planning can start going through it and that's what you want to do with them in case we need to make changes add or whatever that's that be the next process fundamental changes on how you know I don't want to look at ACC buildings but they essentially want to go through chapter by chapter and just update section it's good to do that rou you know routinely um especially with emerging land uses things change over time and I'm sorry if I don't have the word um there's somebody if let's say they're in violation of this now like and they have been how how do we adjust that I mean how do we how do we work with somebody who's in violation of this code now the way it stands how do how do we apply retroactively do we apply that how does that work well in theory it's not different but it it it depends on the violation when yeah let's take containers like uh truck trailer containers let's take that for example yep so that example specifically those were never allowed in the first place we're just pulling that into a language that's more clear for the average person to to understand so for that we didn't we didn't change so but it kind of goes back to um how long has it been there were they when they did it were they in violation of the rules at the time so do we have to go back rules at the time and then there's like the 10 year mark If like somebody put a structure there and it was there for 10 years then we follow a different set of rules that's like non-conforming so I guess it's uh it the answer is it depends on the situation on the violation specifically if I can follow that it's kind of a technical question and and a city code at its heart is the accumulation of all the ordinances onic specific points and a code becomes sort of its own entity after two after two years in place when these amendments are in place that question no longer can be asked that question it is is presumptively the law in the city or the code in the city that goes backwards and forwards uh at that point but the underlying premise of the code are those ordinances so if you were to get an enforcement question let say right now and somebody got a clever lawyer and they said oh wait a minute you just pass that itn't it doesn't really apply oh yes it does the ordinance number of the prohibition was from this time and that's the underlying source for the code so you there's no lapse here I guess is the point I think that was your question yeah yeah yeah did they help yeah yeah that's good and and that kind of goes back to record keeping too because even within that two years which I didn't know about thank you wel you we you know you need to maintain the record of your amendments and changes and we'll be doing that moving forward well it's one of the reasons Mr Mayor again if I can it's one of the reasons why codification is so important because it creates a presumptive document that is in this day and age easy to put in an electronic electronic format that anybody can get at as opposed to having like it was when I started there were cities that that you had to go in and actually weed through all of them you know and if you had a a good administrative staff they had it all nicely organized but you were still weeding through all of the different ordinances that's the whole idea behind modification and having that structure in place and then going back and and going okay okay uh Tim will speak to us about the three locations of sidewalk repair yep um Kevin included an Nar in the packet um there's just a number of kind of routine maintenance replacement uh in the city and then we had one issue down in the Riverwalk area where we think there's an underlying issue with the storm sewer that's causing some erosion underneath which caused the sidewalk to collapse um so that's why Kevin is recommending that um we approve these with funding to come out two separate buckets one is the for the kind of routine stuff is the um sidewalk replacement fund that we have in public works the other would be coming from the um storm sewer Enterprise fund um and the intent is to work with the contractor when they come here and remove we can investigate and make any repairs at that time um so if there are any repairs that are needed we won't know until then um and uh so I'm not sure what we want to do to allow Kevin to give the authorization and proceed with repair because it can't sit there undone um it's going to have to be corrected uh immediately which one is that we have two estimates here right two yeah um which one is the the storm water fund item the collapse sidewalk is the 2850 okay and uh just the routine stuff um that is 1450 that the 2850 is the one that we are looking to give them more wiggle room in because we don't know if they're going to find on okay correct he showed me pictures if you guys haven't gotten to see him I mean there's a hole so we know water is going under and it's probably washing everything out down there but until they lift it up they don't know what they're going to see and I know he put did he put a rock they put rock or something in front of to keep stabilize to stabilize yeah um it's storm I I don't think it'd be an enormous sum but I would say give them leeway up to 5,000 it would be a different contractor well I guess it depends it could be the same contractor but you might have to call in someone else to do the work but um I would say give him not to exceed $5,000 that's what I was thinking the storm water fund is in pretty healthy shape um put it away but I think there's $40,000 in the storm water fund okay almost 30 okay so we're we're we're tying the two together is that what you're saying when you talk about the five not to exceed 5,000 for the just the um second one okay cuz we all right so so the first one is just maintenance right okay the second one is exploratory yeah we would approve the 1450 for the routine and then we approve not exceed 5,000 for the storm damage storm water damaged U component of the side lock and the river lock I guess I'm just kind of hesitant to change the amount that's here in the packet when we have 2850 listed that's a that's well that will be the sidewalk cost okay then there but if they find that there is a breach in the storm water um system there they're going to have to replace that or the same thing will happen again so that would that's the additional fund for help I understand no thank you yep do we know I mean are they going to get to work at this right away or it sounded like it yeah so if you wanted to wait we can have a special meeting and come back after they find that's up we could do that which if it exceeds the 5,000 we would have to right right um well I think we should go ahead with this with the reasonable amount of not to exceed $5,000 because we have to fix the sidewalks you know don't want anybody to get hurt and the other sidewalk is you know yearly replacement U issues so um I would be in favor of doing all of this work and the five and not to exceed the $5,000 on the um the vote to a side one so I can make a motion um that we approve uh funds in the amount of 14 $1450 uh to go towards sidewalk repairs and that would be out of the Public Works sidewalk replacement fund um and then an additional fund of uh not to exceed $5,000 for the the uh Riverwalk sidewalk repair and but in the following section it says to attach a copy of one of the following showing proof of nonprofit status and none of those boxes are checked and I didn't see a form so on file or already or if we need to get that and conditionally approve this upon receipt of sure my understanding of that is that those and when I had sent these in in the past that I sent them all together but they do go the that we were really really high um it was $44 I believe um for p license for the weekend and um Diane went out and I for some reason I thought it was going to be in the packet but it's not she did send me information from three um three or four cities around here what there and I'll send that to Sher she can set it out um of what their licenses are everything was right around5 to $25 for their Farmers Market um and that covered everybody um it wasn't they didn't break it down so some of the Farmers Market see that the advertisement for this next one they're trying to get a few local people L food trucks to attend I think they had corn the last one and they've kind of wanted us just to lump that event under the farmers market fee uh but they thought $44 for a 5 hour event or 4our event was a little seed compared to what other um and I know m l charges nothing it's the gas station that puts it on um and she she said that so she didn't call the gas station charge anything um but um I'm just trying to remember the entire email so I apologize it should have been in here I must have dropped the ball on that but she wants us to see if we would go down to 25 is really what they were asking or less so what are we charging now um we have okay so that's a good one the first one we didn't do anything because it was a City Event during Wan days so we did not have to charge anybody anything we found that information um the second one I opened my mouth at the first one um and said I'm I'm so glad it's going really well um don't worry about it we'll wave the feet and I did that so I got us into the last one that just happened I opened my mouth and I said they should have because we're starting it up in my mind I ticket business is we're starting something new um so I didn't I to pay and I guess she did ask the people that have been coming and they said they wouldn't come for $44 right and I get it I mean we we're new right we're not packing it in yet so I mean so this is Herve vend this would per and so we haven't charged any enough right right so now we're getting ready to coming up in two weeks um if I if I may I'm really excited about this and I I I kind of agree with you U let's get this thing rolling and my next question was going to be when would this be effective and I I don't have a problem with just waiting until next year um what we got two more maybe and I know they're really excited about it it's really out and um and I think there's some big plans for October um so I I think we just go out with a big event at the end of the year and then we make a decision on the amount and you know you waving the amount for the next two events or leing at well we could just send the mayor down he can just wave technically we have so we have to agree to wave fees for 2024 um yes I guess that's what I would be in favor of at this point waving the Fe for the rest of this year the next two events we don't see anything in November and quite sure so so we talked about um I think a one presentation that um optional rain location would be the community center would recharge the would we wave the community center fee if it was available and just charge the farmer market Fe or how would that work it's a res that rents cleaning yeah and if they P them all in there October October definitely could be a mov location Ava a good ide we do something here's why don't we charge $25 the rest of the year day so $50 to the farmers market so they can collect donations from all the vendors and they can give us $25 and then a new feed we not yeah I guess my point is we're not losing any money right now we're we're gaining um we're gaining an attraction we're gaining an event we're creating an event for next year and I think I think that should be our focus at this point and just uh just use 2024 as as uh as a springboard to hopefully something that's will be stable and and and bring Revenue but that will be next year well we have decided to wave fees so that would so they were they just have to get together we just if you move into the community this is what and I'm sure they all we do have those e there too so but yeah well you know rain you have to have if they're all set up and then it starts to yeah you know and you make a good point L because they're really they're ready for inclimate WEA when they come I mean canopies sandbags they know what they're doing so just they're going to take a hit just let them know it's Avail it I mean that's not our decision okay so do we want to postpone changing the fee until next year do worry their game um where these kids look up to them and I hope somebody from the Vikings is listening cuz I find it you know I know they have cleaning and stuff but it's not everybody that wants to see their kids play have to pay $25 okay so but I want to do we we talk a lot about how we lost our identity as a community when we lost our high school was before my time I was in Middle School when you guys lost your high school here but um I I see that and I think this I've been in my mind trying to figure out how we can get more involved with with shes um so I thought I would ask you guys if we could make it a donation I'm not asking for a full donation the charitable gambling on this because it does deal with the children um if we write the check out the shago L uh you Football Association um and it might help some of the other teams out there that have not raised the money or funds and if they do they can keep it and help those teams next year and so on so I'm asking for your thoughts we can we open a motion yeah do you want me to I'll make a m some us on here um I make a motion uh that we donate the dollar amount just s Lakes Youth Association to play at USB Stadium do I have a second I'll second you a question yeah what what's the fund and balance in that there is 22,45 no13 your brainstorm I why I don't play poker um um well Mr I think if you're taking that from from CH gambling proceeds that isn't allow expenditure that the wheels turning that was the noise you were hearing is that normally an expenditure like that is not appropriate for chair chair chair for organization so the question got answered as an appropriate expenditure f as long as it benefits Community MERS so the the issue I have with there are a couple issues that that I have with it it it opens the door to other organizations ask for we've got L we've got the lak Hockey Association there's probably tennis organization a basketball organiz I go down the band organization I think we're really ourselves up to it and appreciate the fact that your child plays on that I support this all these groups I just don't think it's our place to give money to when they have other apparatuses to fund raise um and and my major concern is what's next and where we it end um how Qui we say no to the next the funs are there um thank you mayor for bringing this for giving us this opportunity I uh I guess I see Community invol we talked a little bit about PR improving our PR public relations um in the community and in the river valley in the Long Highway 8 and I just um on this particular one I don't see how that does it um for Community involvement happens in the community itself um and and the first thing when you brought this up I I just was thinking about how much football players make you know that's like the first thing that came out of mind wow this is um so at at this point I guess I I I would not be in in favor of this [Music] um I I would like us to to focus more on the discussion we just had on the farmers market um and local events um we talked about the fire departments and working El and um shaper Township and different things like that and I guess that's just a a better I see that as a better focus for us at this time very well just from a realistic point of view it does open set of presence for all the other groups to come you know who do you say no to who do you say yes to so difficult it is as it is to not support the Youth of the community I have to say no to this yeah it's always a tough deal um I've seen I've seen her that that happens where once once you get into it then it's everybody have pass okay sounds good well I won't even move for voting on that um but I didn't do diligence I need to ask um below number would be Cho County Historical Society you guys at the last minute got this given to you this is the letter that came to came to Sher came to me um they're asking for $1,000 depending on our population and they said this city the size of size of T balls was correct and so I'm going to tie C into this dude just as a discussion purpose I thought to myself well if we donate if we to the company Historical Society we better sure donate to our own and so I put that one down there they did not come to me and asked but I put it down there just because does has the Sho County Historical Society told us why what they're going to do with this or U is it okay we continue to expand our Community Partners and history initiative goal is to bring unique stories cities restore maintain store Gard bags and community events we could give that money any time so if we T this and learn more about it yeah most y I mean I just know they they sent this to me and I was like put it on here just because otherwise I would for just throw this out uh if we make a decision then I have about 500 for each what 500 for shago County and 500 for the Tor fall Historical Society can I ask pleas maybe FR is because I don't know the specifics of the Jal gambling is this something that could go it's another nonprofit right right gambling funds could go to this yeah I mean you're leaping both feet into the gray area of the Walk is what it is I mean it's not clear but is everything I've seen and read says that this is the sort of thing that would beow it's Community activity or Community organization and you'd be using that benefit the members or the citizens or public in the city they pretty squarely falls in the helps if there's an ask but it's not necessary generally speaking that's the paper you know ask given open Forum the open Forum was saying it's that's something that really does benefit the city and the community as a whole um I just don't know enough about their funding and what they do and you know does the J County contri Tor Falls state I I don't know any of that well let me again get to my point if they're not asking for it where it get kind of interesting is if at some point there's ever an audit and the money goes there and there was no ask for it how do you find you know how do you trace it Mone so um even just a kick under the table and general phone call you guys want to ask for it you know we're having this conversation take care so maybe we table this do more research and talk about it next Mr I I would recommend that to be a good idea circumstances I will make the motion to table um this discussion on donations to shago County Historical Society and the Taylor's fall Historical Society to our an upcoming meeting second any other discussion well know I just go back to what we talked about with the U youth football you know we donate to sh County Historical Society that's that's a big bite, doll you know who's who's next but with the Taylor for Historical Society maybe we look after our own and have that discussion when we bring this back to the next um no I'm good okay all right it might even be worthwhile to have a representative come yeah tell us what you do kind anything else all right all in favor of tabling the donation to both historical societies say hi all right um any Council reports anybody have anything for us well on the Park and Recreation the last meeting we uh had more discussion on the downtown bulletin board uh to see about you know Contracting out to having it refurbished and upgraded give it a facelift and the conversation centered around the the cabinet shop down here um in the old paychecks building but two attempts to contact them and there's never anybody there so I did speak with Johnny Lair who was doing the lift station he said he'd take a look and and get us a u a proposal to what it might cost to fix it and then we also had conversation about Cherry Hill Park and getting additional landscape matting and mulch uh we did agree to um not spend in excess of $1,000 for for those two repairs so and Kevin is heading that up Kevin so I do believe that brings us up to date um no um Farmers Market on Sunday if anybody can make it know do out Sher you had something that you wanted me to remind you to say I don't remember um the uh I'm sorry uh Michelle and I are are getting a bank card it's actually going to be a debit card we are only requesting one um and I will be the overseer of the card Michelle said I don't want to be handling the account as well as the cards that will be my responsibility uh to be used for um you know miscellaneous items that staff may be reimburse for it's just easier the limit on the card I don't we don't know yet U we just received the paperwork on that U but I certainly can get get that from you from them is deit we are getting a debit so it goes right right into the account I guess it's up to the council if you know we already have limits on expenditures don't we li just just update so would we use that for registration for our trainings and yes those sorts of things hotel reservations U coffee you know supplies for elections things I run to Walmart for for that those kind of things so when we approved the fire department to go to a training we could use that card to do their registration if they want to yeah we don't usually see their registrations but that might be something we can change right easier sh doing reimbursements what have you been doing now reimbursing with checks and so sometimes you have to wait weeks and your credit card might come due in between there and so it it's would just be ideal and what about online banking are we waiting for them to send a statement and and then we get the check to them on time to pay off the balance how is that
