00:00:26.480 --> 00:02:18.680
Hey, Hey, hey, hey. Hey, hey, Hey, hey, hey. Hey,

2
00:02:22.400 --> 00:03:37.920
Hey, hey, hey. Hey. everybody and welcome to the August 4th meeting of the Temple Terrace City Council. I will call the meeting to order and ask uh well, first of all, I'd like to remind everybody since we have

3
00:03:37.920 --> 00:03:53.760
such a big crowd to please silence your cell phones. Says up here electronic devices, but I don't know what you're carrying with you these days besides cell phones. If you still have a beeper, you can leave that beep. That'd be fun for everybody. So, um, if you would

4
00:03:53.760 --> 00:04:12.720
please stand and join me in the invocation and the pledge. Lord, as we begin our meeting tonight, we pray for wisdom and compassion as we strive for the common good of our city and its residents. We thank you for your many blessings and pray for peace and unity within our

5
00:04:12.720 --> 00:04:27.759
country. We pray for all of our employees and especially for the family of Kevin Woodard. May you grant them peace and comfort as they continue to mourn his passing. >> Amen. >> Pledge allegiance to the flag of the

6
00:04:27.759 --> 00:04:45.520
United States of America and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all. Okay. And just a uh little public service

7
00:04:45.520 --> 00:05:00.400
announcement here. Our next council meeting would normally be on Tuesday, August the 18th. However, as I hope you all know, that is the night of the election or the day of the election, August 18th. And so, by our city's

8
00:05:00.400 --> 00:05:18.080
charter, um our council meeting we will be held on the Monday before that date. So that is Monday, August 17th. Still everything's the same 6:00 still in here, but it's Monday instead of Tuesday and that only happens on um

9
00:05:18.080 --> 00:05:34.080
election years. Okay? So just please make a note of that. Um, for those of you who may not visit our council meetings very often, we have a tradition here whereby we begin with a fun or historic or interesting fact about our

10
00:05:34.080 --> 00:05:49.360
city or our community or the region and that duty rotates up and down the deis and tonight it falls on our vice mayor uh James Chambers. So James, >> thank you mayor. Okay, this topic has been touched on um before at least a

11
00:05:49.360 --> 00:06:05.919
year ago, but I want to the first part I want to bring up again. It's about the community gardens we have in the uh city of Temple Terrace. There are three separate garden areas in Temple Terrace. They're all run by a volunteer organization, the Temple Terrace Community Gardens.

12
00:06:05.919 --> 00:06:22.240
Um they're volunteer group. The first location was at and still is at River Hills Park. At that time, a group of our residents was helping uh River Hills Elementary School that wanted to start a garden directly adjacent to the cafeteria and they helped. They saw a

13
00:06:22.240 --> 00:06:39.280
benefit of that and started thinking about having an area of for themselves to have uh anyone other than school children um have a garden area. So, uh, they approached the city and on February 7th of 2012, city council passed

14
00:06:39.280 --> 00:06:56.240
resolution 16-12 allowing the group to use an area of land at River Hills Park and that was location number one. Then the second location is a garden area at Greco Middle School. The school board authorized the use of that property along with an agreement with the city uh

15
00:06:56.240 --> 00:07:12.560
in 2013. So, that was the second area and that's still going strong. Uh the third location was uh near Lynwood Park and that was uh approved in 2016. So those are three gardening locations. They're all some of them are the same.

16
00:07:12.560 --> 00:07:29.039
There's some are a little different. Um I can tell you about the Greco one because my wife has a plot so I know more about that one. Uh the the plots are 8 ft, excuse me, 4T by 10 ft. It's $20 to be a member of their uh volunteer

17
00:07:29.039 --> 00:07:46.160
group and it's $40 a year to use the garden and that includes the water and irrigation and it's maintained up by the group. So those are the three current ones. Now people think that River Hills was the very first garden plot in Tubble Terrace and that is not true. So, I've

18
00:07:46.160 --> 00:08:01.280
done some research and uh I would guess, but I don't know for sure that during World War II there must have been some victory gardens in the city, but I don't know that for a fact. But I do know that there was one city authorized garden

19
00:08:01.280 --> 00:08:17.759
area before that and that was uh in the 1970s and that was down at B station which is our sewage pumping station that uh it's about the very southern part of Temple Terrace where West and East River meet.

20
00:08:17.759 --> 00:08:35.519
That facility we had eight plots and they were 10 by 50 in size. And I know this because I was starting in the recck department and I worked at the tennis courts and apparently when you did that that meant you also had the garden plots in the south part of the city. So uh I

21
00:08:35.519 --> 00:08:51.200
managed that and it cost $10 a year for those plots. So I say that because I know there was a a garden before that and the only thing I know that is in the records and it's not really ours was there was a channel 13 story. One of the

22
00:08:51.200 --> 00:09:07.440
very first stories Lloyd Sour did, he just retired last year with channel 13, but he did a story on the community gardens and it was my first interview on TV. Um, and so I was scared to death kind of like I am right now. But anyway, all right. So now that's that's the

23
00:09:07.440 --> 00:09:24.080
story of the first I know garden plot, city sponsored plot, but now I always like to make this somewhat a story and about me. So, it involves me, not about me. So, the garden plot people, the renters, they

24
00:09:24.080 --> 00:09:39.200
decided they wanted uh more organic fertilizer. So, they all chipped in and and made a deal with a chicken farmer in Brandon for a load of chicken manure. Okay. At this time, highway 60 was

25
00:09:39.200 --> 00:09:55.200
two-lane. Brandon almost didn't exist. More more cattle in chicken farms than anything. uh Interstate 75 didn't exist. So to get there, you had to go down 301 and then turn east on uh 60. So the assistant director of the rec

26
00:09:55.200 --> 00:10:10.480
center at that time was a man named Jim Adamson, and he drove a truck. It was a Ford Ron uh Rancherero, if you know what those vehicles are. And its nickname was the Ronerro because it was terrible. It didn't run very well, but it was the

27
00:10:10.480 --> 00:10:26.959
vehicle we had. Uh we didn't have a great finance department back then that kept us up in vehicles. So, thank you. But anyway, so uh Jim drove and I rode with him to this chicken farmer uh out there and the front end loader came with this load of chicken manure and put it

28
00:10:26.959 --> 00:10:42.240
in the back of the r uh rancherero which you know is not a really good truck. It's more of a vehicle than a car than a truck so it can't carry much. And it went right to the axle. It was so heavy. So now, if you can imagine, we're driving very slow because when Jim tried

29
00:10:42.240 --> 00:10:57.519
to turn, the front wheels were barely making contact. So to turn, if you turned right, the thing would kind of bounce and grab and kind of just turn like that. So we're going really, really slow. We're now on 301 heading north

30
00:10:57.519 --> 00:11:15.200
towards uh the city. And a semi or big truck, again, 301 was two lane, blew by us. The wind got under the truck and picked the hood up and wrapped it around the windshield. We couldn't get it back down. So, I had

31
00:11:15.200 --> 00:11:31.440
to walk I don't know how far to find a gas station with a pay phone. Cell phones didn't exist to call. I had to call public works and tell them that we're on the side of the road with a load of chicken manure with the roof wrapped around the windshield. So, that's just a I thought a humor story

32
00:11:31.440 --> 00:11:49.440
about the first garden plots in Temple Terrace. So anyway, >> so somewhere on the side of 301 in the ditch is a stealer of of for grander with chicken >> probably. Yes. I don't I really don't know how they got it back. I had to

33
00:11:49.440 --> 00:12:04.160
leave. >> You can't the these are these are the best stories. These are really these are better than what we can find online. So thank you very much. So, uh, the next item is always a pleasure and this is the employee of the month and I'd like to recognize the employee of the month

34
00:12:04.160 --> 00:12:24.000
and call Michael Fabborg to the podium. And so, um, while he's coming up in in full disclosure, yes, uh, Mike is a friend of mine. However, I had nothing to do with his selection. Um, I hesitate to say that because I was going to hold it over his head, but I really didn't

35
00:12:24.000 --> 00:12:40.240
have anything to do with your selection. So, um, Michael Fabborg is recognized as the employee of the month for the month of June. Uh, Mike is an exemplary employee who consistently demonstrates professionalism, dependability, and strong leadership. He communicates

36
00:12:40.240 --> 00:12:56.480
clearly and directly with staff and is highly regarded for his organizational skills, attention to detail, punctuality, and commitment to completing every task to the highest standard. He is someone his colleagues can rely on at any time, day, or night. and he consistently goes above and

37
00:12:56.480 --> 00:13:14.240
beyond to ensure that the job gets done. During Hurricane Milton, uh Mike demonstrated remarkable calmness and professionalism under challenging circumstances. His dedication and teamwork were especially evident during the long and demanding cleanup efforts that followed the storm.

38
00:13:14.240 --> 00:13:30.720
And that doesn't tell half the story there. I'm going to have to come back to that one. uh as a maintenance attendant for Michael is highly knowledgeable and takes the initiative to share his expertise with his co-workers. His willingness to support and mentor others contributes significantly to the

39
00:13:30.720 --> 00:13:47.040
efficiency and effectiveness of the public works team. He's a hardworking and dedicated employee who consistently encourages those around him and contributes to a positive workplace environment. He's a natural leader and a tremendous team player. His dedication, knowledge,

40
00:13:47.040 --> 00:14:02.399
work ethic, and positive attitude make him a valuable asset to public works. The department is stronger, more efficient, and a better place because of Michael Fabber. Congratulations to Michael for being selected as the June employee of Vermont. And so I do have to

41
00:14:02.399 --> 00:14:18.480
tell you before you applaud a little bit, they they give me a script. I could sometimes I know the person real enough that I could do this probably just ad lib. But um the story about Hurricane Milton and we have some other people involved in this too that may not be

42
00:14:18.480 --> 00:14:35.120
employee of the month but it's to their credit also. Um you got to remember we had two hurricanes and they were two weeks apart. And so these public works folks, they don't just respond to the hurricane. There's the week or week and a half leading up to the hurricane where

43
00:14:35.120 --> 00:14:52.399
they're going around securing everything, getting all the trash cans picked up, emptying everything, you know, picking up loose stuff, making sure everything. So, for a week or week and a half before a storm, they're out there at all hours of the day and night. Then there's actually a storm, which is

44
00:14:52.399 --> 00:15:08.800
probably the quietest quietest part because there's nothing to do. As soon as that storm passes, they're out on the street and they start and it's non-stop day and night. I don't know how many hours a day they put in, but but it's non-stop. And this goes on for a long

45
00:15:08.800 --> 00:15:23.839
period of time. Well, two hurricanes in a row. So, the first one we largely were able to get past, but then they had to go put all that stuff back that they picked up only to go out the next day and pick it all back up again because

46
00:15:23.839 --> 00:15:40.720
another hurricane is coming. And so, um, when I first got to know Mike was after Hurricane Milton and I think we were cutting trees or filling sandbags or something and these guys remember that. and and uh I won't go into his background because I

47
00:15:40.720 --> 00:15:56.240
don't know what he wants me to tell you and what what he doesn't but he is uh absolutely a leader. Um took charge. These guys were going on running on empty, no gas in a tank. They've been working like crazy hours. Um and Mike

48
00:15:56.240 --> 00:16:12.639
just like he's like this. I don't think his pulse gets above 70 no matter what. So um anyhow, thank you for your service. I'm glad to see you here. Um, I see you got a haircut for the occasion. >> I made a speech, but um, you know, when

49
00:16:12.639 --> 00:16:28.880
you for me to stand up here and you look at it from the 10,000 foot level, um, I'm the one being recognized. Obviously, um, I cannot be up here because when you get on the ground level and you open the hood, um, you see all the moving parts

50
00:16:28.880 --> 00:16:44.240
that that come with this. I don't think I've been in any position where uh there isn't one section of the city that hasn't been involved. Um utilities, uh obviously streets and

51
00:16:44.240 --> 00:17:00.000
grounds are are always together. Um the police department, the fire department, um the sewer department, everybody is is a team when you open the hood at the ground level. Um, so

52
00:17:00.000 --> 00:17:17.520
it I'm privileged to be up here in front of you guys to represent them. Um, and and I thank everybody for giving me this um this privilege to be up here um and represent the city and represent everything that public works stands for.

53
00:17:17.520 --> 00:18:09.679
>> Okay. Well, thank you for all your work. We'll call your wife. >> All right, Mrs. Mrs. Mike, come on up. I did not. No, this is a >> surprise. >> All right, let's get your team up. Come

54
00:18:09.679 --> 00:18:33.080
on, guys. Come on. One, you hold this. That's yours. might not. >> That's okay. >> I haven't still see. >> Okay, you're good.

55
00:18:34.880 --> 00:19:12.400
>> Oh, thank you. Okay. One, two, three. Thanks, Okay. Uh, next item of business is consideration of the minutes from our July 7th council meeting. Uh, is there a motion to approve the minutes? >> Some move.

56
00:19:12.400 --> 00:19:29.600
>> A second. Motion to second. Discussion or corrections to the minutes? If not, all those in favor say I. >> I. >> I. Opposed? No. Nays. Minutes are adopted. >> Persons wishing to be heard on items not listed on the agenda or items on the consent agenda. Uh requests to address

57
00:19:29.600 --> 00:19:44.480
the mayor and council are on the little table in the back of the room. Uh if you'd like to address the council and haven't filled one out already, there's time. Please complete it and give it to the city clerk to my left. Uh we have a 30-minute time limit at

58
00:19:44.480 --> 00:20:00.240
this portion of the meeting which we rarely exceed. If we do uh we discontinue the public comment section of the meeting and we pick that back up at the end of the meeting. That's to enable us to get through the agenda. Uh that rarely happens, but I like to read

59
00:20:00.240 --> 00:20:17.039
that in case it does. Uh there's a threeminut time limit imposed on all speakers. We ask that you come to the podium, state your name and city of residence. you can't stand in your seat and shout out unfortunately. Uh during public comment, I do like to assure everybody that their staff and the count

60
00:20:17.039 --> 00:20:32.080
and the elected officials do take your items seriously and we do follow up although it probably will not be in the meeting tonight. Um we generally ask the staff to circle back with us and and circle back to you and discuss the situation and then let us know the

61
00:20:32.080 --> 00:20:52.640
outcome. So we do uh follow up on these. So I have a number of requests to speak. The first one is Mr. Lo, good evening, sir. >> Good evening. >> Uh, Charles Lo Terrace Park. And first of all, it's nice to see so many people here tonight. And secondly, I wanted to

62
00:20:52.640 --> 00:21:07.840
announce that the library sale was $1,478. So, uh, so realize that it is going pretty well. There are two other items I wanted today. I turned 75, which is why I have this little thing with me tonight.

63
00:21:07.840 --> 00:21:23.600
>> Congratulations. >> And um I bought not just to show it off, but to uh make a couple of points with it. Uh number one, that in turning 75, I've not used uh my Medicare benefits for the 10 years that I've had them. I

64
00:21:23.600 --> 00:21:40.400
see no purpose in doing it. I see this is money going to our younger generations who I will be talking about when it comes to property tax reform. Um uh we do have to think about our younger generations when it comes to local government.

65
00:21:40.400 --> 00:21:55.600
Uh I tend to come to a very simple conclusion that a no vote on the property tax reform is a yes vote for our younger generations. No, especially the zoomers. Why is that? because of the fact that uh our younger generations

66
00:21:55.600 --> 00:22:13.200
will be most affected by uh by being the hired or laid off or something like that. And also that uh they will uh need the social services to get started in life more than other more than other people might who are more established.

67
00:22:13.200 --> 00:22:28.400
And I think it's a very important principle. this nation uh a month ago uh turned 250 and if we want 250 more years we got to start thinking about our younger generations and dealing with our younger generations.

68
00:22:28.400 --> 00:22:45.600
Uh if another thing is that I noticed this very significant legal change within the ballot uh when I last looked at it a couple of times and I recall that when the tax uh when the all transit tax was occurring it cost the

69
00:22:45.600 --> 00:23:00.880
taxpayers a quarter of a billion dollars that's with a B not an M a quart of a billion dollars to deal with the legal fees and I think to myself gee I wonder how much it's going to cost uh if they have to just to clarify what it is that

70
00:23:00.880 --> 00:23:16.720
they want on the ballot. Uh I'm not even sure because it's tremendous difference in the wording from what I could tell. I'm not even a lawyer. Uh so I do think I do feel that people need uh help but I do think that they'd

71
00:23:16.720 --> 00:23:33.039
be better off to do it within their local government that they come to the meetings be active and you know and you might be surprised when I heard July 28th a few things that kind of surprised me on how well you all do for yourselves on dealing with the

72
00:23:33.039 --> 00:23:50.640
budget on the second reading on it. Anyway, I think that's pretty much what I have to say for now and um thank you all and good evening, >> Mr. Loir. Happy birthday, >> Annette Renie. Yes, give him a round of applause. It's his 75th birthday. We can

73
00:23:50.640 --> 00:24:17.520
do better than that. >> All right. I didn't want to take that out of your three minutes. So, Annette Renie Annette Renie, um, Temple Terrace. I'm here to discuss Christmas. I know that when I moved here

74
00:24:17.520 --> 00:24:33.360
in the late 80s, the 56th Street corridor was Americanized and it had shops and restaurants of American style. And the first Christmas was beautiful.

75
00:24:33.360 --> 00:24:49.520
All the 56th Street was decorated. Now, I know you've come to a decision to decorate the redevelopment, but that's apartments and grocery stores. Is there any way we can go

76
00:24:49.520 --> 00:25:04.400
backwards and use those decorations to decorate 56 Street, which is from Fowler up? I mean, that's our main street and

77
00:25:04.400 --> 00:25:21.440
to not decorate that to me is not fair. Thank you. >> Thank you, Mr. Renie. Lucas Hutchkins. And then as you make your way to the podium is Angel Haya. Is that am I saying that correctly? You, Mr. Hya? >> Ha.

78
00:25:21.440 --> 00:25:37.760
>> Hia. Are you donating your time to Mr. Hutchkins? >> Yes, sir. You do realize that that will preclude you from taking time to address the council. >> I can only hope. >> Okay. All right. In that case, Mr. Hutchkins, uh, Madame Clerk, that means four minutes. And Okay. Very good. Mr.

79
00:25:37.760 --> 00:25:54.080
Hutchkins, you have four minutes. >> My name is Lucas Hutchkins and I live in the Riverrun subdivision. And if many people know me as Mr. Christmas, I take Christmas very seriously. We have 142 days until Christmas. And my biggest thing is is that worries me is that I'm

80
00:25:54.080 --> 00:26:09.919
happy that you guys have finally considered bringing some decorations to Temple Terrace by putting it in the redevelopment. But that that's really it's like tacky because the development is such a disaster. I mean, we want to see the decorations as we're driving through. We want to be like Plant City. Plant City, they decorate the main

81
00:26:09.919 --> 00:26:27.039
streets. It's beautiful and people come to see it. We want people to come to Temple Terrace to see our amazing city, but it's not amazing if we're not decorating our main street. 56th Street is where the decorations need to be going down 56th Street and Bush Boulevard and Bullard. I know that we can't put them on the Tiko poles, but we

82
00:26:27.039 --> 00:26:42.640
can put them on the black poles, but some of them have outlets, some of them don't have outlets, so that's something the public works need to take care of. We need to have outlets put on the pole so we can put the decorations there. They need to be seen when people are coming through. You know, Christmas brings the community together. You know, it's not just a holiday. It's a fun

83
00:26:42.640 --> 00:26:58.320
thing. People like to come and look at Christmas lights. I I do the big Mecca display in the Riverrun subdivision, the Temple Terrace light show. And I take it very seriously every year. People, thousands of people come through every year to see the display and and it's joyful. Everybody has so much fun to see the Christmas lights. We hand out hot

84
00:26:58.320 --> 00:27:14.400
chocolate. We give out cookies and it's a big thing of the city and that's what I want to see the city do. I shouldn't be doing all the work. The city needs to be doing something. Yes, we have the winter wonderland, but that's one day and it really is kind of just a let down. It's very disappointment. It's the same thing every single year. There needs to be change. We need to have

85
00:27:14.400 --> 00:27:29.279
something to bring people in. I mean, I've been to the winter wonderland every year and it's it's really a let down, you know. The Christmas tree is pretty sad, you know. And then the Christmas tree inside city hall is the most saddest tree. It looks like somebody pulled it out of the dumpster. I mean, it's sad, you know. It's We have to put

86
00:27:29.279 --> 00:27:44.799
infamous into we have to care as a city. We want to bring people here. We want to bring restaurants. We want to bring shops, but you have to have something for those people to come to. I mean, the city is very depressing a lot of the time. You know, it's I want to see change. It's sad to see what the city looks like. It never was like this. I

87
00:27:44.799 --> 00:28:01.360
mean, I've been here for 20 years and it gets worse every year, you know, and I and it's sad that we have to go outside of Temple Terrace to go see the Christmas lights and see different things and and do community events. I mean, you guys need to go to Plant City and see what Plant City does there. They're another small town and they make

88
00:28:01.360 --> 00:28:17.600
us look embarrassed. I mean, we we are nothing like them. I mean, they do so much. They have a Christmas parade and everybody gets out and has a blast. We don't do that kind of stuff here. We're afraid to use the word Christmas into terroris and I think it's the most ridiculous thing. It's Christmas. You don't have to bring religion into Christmas, but you can just celebrate

89
00:28:17.600 --> 00:28:32.399
Christmas. I mean, we have to change the name for everything because we're so afraid to use that word. I'm not afraid of Christmas. Christmas is Christmas. It's a time to bring joy to the community. And it doesn't have to be about religion, you know, and then yeah, it just we need to do the more decorations and and we need to put it

90
00:28:32.399 --> 00:28:48.080
together. I mean, the tree in in city hall was just sad. I mean, it wasn't even decorated. I mean, there's just no plan to anything. I mean, and then the Christmas tree over in the park was there was like three little bals on it and a few little pieces of tinsel. I mean, a blind person could have done

91
00:28:48.080 --> 00:29:04.720
better. I mean, it's sad. It's like we have the decorations and if we don't, we have the money to get the decorations. I mean, Temple Terrace has the money and I think $50,000 spending on the Christmas thing is pretty sad. I mean, the city can the city has more money than that to spend. I mean, we pay the property taxes that we're paying in Triple Terrace. I

92
00:29:04.720 --> 00:29:20.960
mean, they've gone up way significantly over the years. I know my property taxes have gone through the roof because I refinanced at my house and my house is worth way more than it was. So, the city's bringing in the revenue. We've got the revenue from Amazon when, you know, they give us all that money and then from the VA. I mean, we've got and all the Horton houses that were built,

93
00:29:20.960 --> 00:29:36.000
we've got tax revenue coming in. We can spend some money on some Christmas decorations and bring some joy to the city. So, the money is not the issue. And yes, we have the black poles. I know the Tiko thing has always been an issue where we can't put things on the Tikico poles. Well, we have the city black poles. So, we can put the decorations

94
00:29:36.000 --> 00:29:53.279
down a majority of 56th Street and some of Bush Boulevard and some of Bullard. Those black poles are there. I just don't think it's a good idea to put these decorations inside the in the downtown. I want to see it throughout the whole city. So, thank you, Alakasi.

95
00:29:53.279 --> 00:30:18.320
Cassie Good evening, mayor, city council members. I'm Alec Cassie and I'm have I've had the privilege of serving the residents of Temple Terrace as a firefighter for six years. I also have the honor of serving as a vice president of the Temple Terrace Professional

96
00:30:18.320 --> 00:30:34.320
Firefighters, IFFF Local 2160. I'm here tonight to explain why the firefighters who serve this community support the 2026 general obligation public safety bond. When most people hear the words new fire station,

97
00:30:34.320 --> 00:30:49.919
it's easy to think of just another municipal building. But a fire station is much more than that. It's where firefighters and paramedics plan, prepare, and stand ready for every hour of every day to serve our neighbors when they need us most.

98
00:30:49.919 --> 00:31:05.600
It's where life-saving equipment is maintained and ready to respond at a moment's notice. It's where school children visit on field trips, neighbors stop by to have their blood pressure checked, and families get to know the firefighters who serve their community.

99
00:31:05.600 --> 00:31:21.200
Most importantly, it's where firefighters respond from when your family calls 911. The 2026 bond isn't simply about constructing another building. It's about expanding Temple Terrace's ability to protect the people who call this city home.

100
00:31:21.200 --> 00:31:37.600
Today, there are parts of Temple Terrace where the uh emergency crews have farther to travel. In the area where fire station 3 is response times are 8 minutes and 29 seconds 90% of the time. The purpose of a third fire station

101
00:31:37.600 --> 00:31:53.840
isn't to give firefighters another building. It's to place emergency resources closer to the people who need them. and strengthen emergency coverage across the entire city. As firefighters, we've seen firsthand that oftent times seconds can make the difference between

102
00:31:53.840 --> 00:32:10.960
life and death. Whether it's a house fire, a cardiac arrest, or another life-threatening emergency, getting the right people and equipment to the right place at the right time matters. That's why we believe investing in emergency response infrastructure is

103
00:32:10.960 --> 00:32:27.440
really an investment in the safety of the community. The firefighters of Temple Terrace aren't supporting this bond because it's about us. We're supporting it because it's about the families who serve who we serve every day and the communities we took an oath to protect. Every resident will make their own

104
00:32:27.440 --> 00:32:43.360
decision on August 18th, and we respect that. We simply wanted to share the perspective of the men and women who answer the calls, respond to emergencies, and proudly serve the city every day. We're asking residents to vote yes for a safer temple Terrace. Thank you.

105
00:32:43.360 --> 00:33:01.039
Thank you, Mr. Hass. Ranell Mallister. Ranel Mallister. >> Good. Good evening. >> Giving him a handshake there. >> Hi. Uh, Denell Mallister, Temple Terrace. Um, I have three quick points.

106
00:33:01.039 --> 00:33:17.440
One, uh, is America 250. So, this year we observe the 250th anniversary of the Declaration of Independence. And um I just would like us to see some kind of recognition for that. Uh whether

107
00:33:17.440 --> 00:33:35.360
it be a resolution or maybe some banners uh with flags, patriotic. I was in Brooksville recently and they had some really wonderful America 250 decorations. Just some little banners. Be great if we could at least put that up by Veterans Day.

108
00:33:35.360 --> 00:33:52.320
Number two, um I'd just like to say thank you to all the city um staff that were involved in the parade for Independence Day. It was hot, but it was a great parade and I know it's a lot of effort on behalf of the the staff and I

109
00:33:52.320 --> 00:34:08.240
just like to thank you all for continuing that tradition and uh pulling it off in the heat. And on that note, I would just like to say I it really hurt me to see the uh police out in black uniforms. I just know it had to be really really really really really

110
00:34:08.240 --> 00:34:25.359
hot for them. I don't know if anybody's ever said that before. I see some people looking towards the back. Um I'd be happy to chip in if you considered going to a light blue shirt at least. You know, I' I'd chip in on that. All right. And then I'd just like to add my

111
00:34:25.359 --> 00:34:40.879
um comment about uh yes uh Christmas decorations. Um I when I moved here 20 years ago, that was something that was really appealing and attractive to us. And it's really sad that we have have had nothing. So I'd really like us to get

112
00:34:40.879 --> 00:34:56.320
back to that. And I do agree with the the folks who said that just in the um plaza is is really not what we're looking what what I'm what I would like to see. And thank you to each of you for your service. Thank you, Mr. Mayor. Thank you, Vice Mayor and members. And

113
00:34:56.320 --> 00:35:19.200
you, sir. Thank you, >> Miss Mallister. Karen Mahowski. >> Good evening. >> Evening. Uh Karen Maholski, Temple Terrace. Um I'm just making a comment and give additional information. And um Councilwoman Fernandez made a really

114
00:35:19.200 --> 00:35:35.200
good point during the July 6 uh budget workshop. And what it was about was about the firefighters um um it's called uh something out gear um that has PAS in it. And my job uh I'm a support chemist and I uh work for a

115
00:35:35.200 --> 00:35:51.920
company that we actually test for PAS. So I'm very familiar with this, been doing it for 10 years. And I would just urge that when you are making budget considerations that PAS PFAS is just one compound and there are many

116
00:35:51.920 --> 00:36:07.040
derivatives hundreds of them probably even now thousands of them that are regulated. This is a new chemical. The government just isn't quite there. So, I would really recommend that not just taking a marketing label that when you

117
00:36:07.040 --> 00:36:24.800
are choosing uh equipment that it is third-party tested and when you're looking at thirdparty testing, you're making sure that that third party isn't being financially supported by the company who manufactures it. Nonprofits are also a great resource for um this

118
00:36:24.800 --> 00:36:40.079
testing. Um, and then continuing on the PAS and our water, I I um have had candidates reach out to me and may ask, "Hey, what is going on at Temple Terrace? I heard your water can't be, you know, isn't good. It's not safe."

119
00:36:40.079 --> 00:36:57.839
And I clarify and say, "No, it is that our water is safe to drink. It meets the EPA regulations. And if anyone might be a bit concerned, you can get a Brida filter with the elite a Brida filter with the elite

120
00:36:57.839 --> 00:37:13.440
filter that will take 98.4% of your PAS out. Again, it's just going to be the PFAS. There's so many others. But again, the amount in our water is extremely low. Very, very extremely low

121
00:37:13.440 --> 00:37:31.040
as a pair compared to say New Jersey, Pennsylvania. It is really minute. And if you evaluate where you can have PAS come and contact you, food from China is in the hundreds of thousands. That right

122
00:37:31.040 --> 00:37:48.240
there I would be concerned of. I personally don't eat that. Um, so I really would like the clarification. I'm not sure if the city can do anything, but it seems that our our neighbors and our community still doesn't believe that our water is safe, and it is. as

123
00:37:48.240 --> 00:38:03.280
compared to it is very convenient to have bottled water. Bottled water is regulated by the FDA. The FDA has no requirements for any of these chemicals. No testing, no requirements. It is

124
00:38:03.280 --> 00:38:20.480
different. Your EPA regulated water is much safer. Thank you. >> Thank you, Scott Brooks. >> Scott, I'm sorry. I'm calling the next speaker. >> Oh, >> Scott Brooks. And while Mr. Brooks makes his way to the podium. This is the last request I have from the public

125
00:38:20.480 --> 00:38:37.359
currently. If you'd like to address the council, now would be a great time to go fill out that form and bring it to the city clerk. >> I just wanted to take a moment. I'm police officer here. I've been here for 17 years and just want to take a moment and say thank you to the mayor and the

126
00:38:37.359 --> 00:38:53.760
uh city council for your recognition and our new contract upcoming in that vote coming up. So, just want to take a minute as a representative of our union, Fraternal Order Police, just to say thank you very much. That's it. >> Thank you, Mr. Brooks. Are there other members of the public who wish to

127
00:38:53.760 --> 00:39:10.480
address the council at this time? I don't see anybody running towards the table, so I'm going to take that as a no. Okay, very good. Uh, next up is a consent agenda. Council, is there a motion to approve the consent agenda? >> Move to approve.

128
00:39:10.480 --> 00:39:26.400
>> Second. All those in favor say I. >> I opposed. No naysay. The consent agenda consent agenda is adopted. >> Uh next item is a public hearing and second reading of ordinance 1597

129
00:39:26.400 --> 00:39:43.280
amending section 1-103 the definition section. section 1-104, the enforcement procedure section, and 1-105, the schedule of violation and penalties. I will open the public hearing, and our

130
00:39:43.280 --> 00:40:12.320
code compliance director, Jack Shanks, is here to explain. >> It I know technical stuff. I get it. All right. Uh, good evening, mayor, council members. Jack Shanks, code compliance. >> The item before you tonight is a

131
00:40:12.320 --> 00:40:28.720
proposed amendment to chapter one of the city code that would update verbiage, add applicable code sections to the table of class 2 violations, and establish a new class 4 violation category within our existing civil citation framework. I want to begin by emphasizing one key point that this amendment is not intended to generate

132
00:40:28.720 --> 00:40:45.040
revenue. The purpose of this update is to improve citywide adherence to codes that already exist and are already enforceable today. What this amendment does is allow certain repeatable violations to be addressed more effectively and more immediately through civil citation rather than relying

133
00:40:45.040 --> 00:41:06.640
solely on longer notice driven enforcement processes. The first change we've made is to provide the definition of of itinerant or transient in nature in section 1-103 which reads temporary mobile or impermanent infractions or activities

134
00:41:06.640 --> 00:41:25.599
that can move locations exist for a short duration or are capable of being remedied and then repeated on the same day. The definition provides a clear-cut meaning to reduce the chances of misinterpretation by staff or residents now or in the future. The phrase is inserted into section

135
00:41:25.599 --> 00:41:40.960
1-104 subsection D. This allows for the inclusion of violations that could be complied with and then recur quickly. It includes violations such as yard parking or commercial vehicles in residential areas as well as certain violations relating to the short-term rental program where the renters change

136
00:41:40.960 --> 00:41:59.119
frequently. We have incorporated the addition of subsection L into section 1-104. This new subsection introduces an escalation procedure for certain code sections identified in section 1-105's schedule of violations. To best explain

137
00:41:59.119 --> 00:42:15.359
this existing and new procedure, I'll run through the standard escalation process first. In keeping with our already established enforcement process, any courtesy notice or citation will be directed to the property owner against the property. An

138
00:42:15.359 --> 00:42:31.920
initial violation with few exceptions will result in a courtesy notice with a reasonable correction period as well as an attempt at direct contact from the code compliance team to determine if assistance is needed. If non-compliance is exhibited or if the violation results in initial compliance followed by a

139
00:42:31.920 --> 00:42:48.560
pattern of non-compliance, escalation to citation will then commence. Following the issuance of a courtesy notice and a correction period, a first citation will be issued which is designed to serve as a meaningful prompt for compliance while still allowing the responsible party an opportunity to correct the issue. The

140
00:42:48.560 --> 00:43:03.599
higher fine for repeat offenses reflects the fact that continued non-compliance occurs after notice and enforcement action has already taken place. This approach aligns with the city's graduated enforcement philosophy by distinguishing between initial violations and repeated disregard of the

141
00:43:03.599 --> 00:43:20.400
code and by encouraging long-term compliance rather than repeated corrective cycles. If compliance is achieved, no further fines are imposed. Now, the supplemental escalation process. We have reinvisioned the standard escalation process to allow

142
00:43:20.400 --> 00:43:36.960
additional time for certain violations. As I alluded to earlier, this provides more opportunity for initial correction while still allowing for more effective long-term results. As in both the standard escalation and current enforcement board processes, a courtesy notice will be uh will be provided to a

143
00:43:36.960 --> 00:43:53.280
property owner noting the violation and will then be accompanied by an appropriate correction period. Whereas in the standard process, a citation would be issued. In the supplemental process, an initial vi notice of violation would be issued that would also have an appropriate correction period.

144
00:43:53.280 --> 00:44:09.440
If still not corrected, a final notice of violation with an accompany correction period would be issued. Following continued non-compliance, we would have exhausted all low-level methods of achieving compliance and a citation would then be issued. To reiterate, the overall intention is to

145
00:44:09.440 --> 00:44:26.800
avoid reaching the citation level, thereby achieving voluntary compliance at the lowest level possible. The overwhelming majority of our residents do comply voluntarily. Our co-mpliance officers are authorized to issue citations only for those violations specifically listed in the

146
00:44:26.800 --> 00:44:42.800
schedule of violations and penalties. The violations proposed for inclusion under class 2 and the new class 4, as you see here, are all existing code provisions. nothing new is being prohibited. The challenge we encounter with these types of violations is that most are easily repeatable and under our

147
00:44:42.800 --> 00:44:58.079
current enforcement structure, there is little immediate incentive for sustained compliance. This becomes an irritant for neighbors and businesses who abide by the city's code yet witness a drawn out compliance process for violators, which in the case of the code sections proposed this evening, should have

148
00:44:58.079 --> 00:45:13.359
achieved the compliance immediately. You'll note that several code sections have asterisks. These are the codes that will receive the supplemental enforcement escalation that includes the courtesy notice, notice of violation, and final notice of violation. In practice, we often see the same

149
00:45:13.359 --> 00:45:30.480
violations uh violation types recur after temporary correction, which creates ongoing neighborhood impacts and increased staff time without achieving long-term resolution. This ordinance update is intended to change that dynamic. By allowing civil citations for these specific violations,

150
00:45:30.480 --> 00:45:46.640
the city can encourage quicker and more consistent compliance, reduce repeat violations, and ultimately reduce the need for prolonged enforcement cases. The goal is behavioral correction, not punishment. And the intent is not to issue citations indiscriminately, but to provide officers with an additional tool

151
00:45:46.640 --> 00:46:04.880
when voluntary compliance has proven ineffective or when immediate uh correction is necessary. This is a breakdown of all the municipal code enforcement board cases for the past year. What you see here includes only the violation types that were presented to the MCB over 13 months.

152
00:46:04.880 --> 00:46:19.680
There were well over 4,000 cases created in the same time frame, but these 129 cases were the ones that actually required MCEB attention. As an example, please look at the very first violation type on the chart, grass, weeds, underbrush. You can see that over the

153
00:46:19.680 --> 00:46:37.040
span there were 661 total cases. Out of those cases, 653 complied at either the courtesy notice or notice of violation. Eight out of those 661 cases received notice of hearing and were subsequent subsequently presented to the board.

154
00:46:37.040 --> 00:46:53.440
For the ease of viewing, I've placed the violation types where we've introduced in this ordinance for citation at the top. Those with the asterisks are the ones with the supplemental escalation process requirement. In these code sections or if these code sections had received citations, a total

155
00:46:53.440 --> 00:47:09.359
of 52 cases would have been removed from the MCEB. It is also very likely with the knowledge of facing a citation, a good number of these would have complied voluntarily instead of requiring a citation being issued, which is actually the goal. Removing those cases, there still would

156
00:47:09.359 --> 00:47:24.640
have been 77 cases for the board to have heard. So over the 13 months, that would have been approximately six cases per month being presented. In summary, this ordinance strengthens our ability to enforce the codes already on the books, improves compliance outcomes, and supports neighborhood

157
00:47:24.640 --> 00:47:41.280
stability without expanding regulation or creating new prohibitions. Uh, staff recommends approval. Happy to answer any questions. >> Thank you, Mr. Shanks. Are there members of the public who wish to comment on this item? >> Seeing none, council member questions.

158
00:47:41.280 --> 00:47:57.280
Council member Kravitz, >> thank you for the presentation. I appreciate uh it's nicely put together. Um I have one question which is regarding the written policy about the escalation process. >> Yes, >> this came up um previously and uh will

159
00:47:57.280 --> 00:48:13.520
that be circulated to city council or posted online so that the public can look at it when it's ready? >> We can absolutely do that. Um I have a draft here. Um it's pretty good. Okay. >> Uh once once uh everything is approved, I'll I'll circulate it through and we can get it out to everybody. >> Thank you. That was my question. and I

160
00:48:13.520 --> 00:48:27.920
appreciate that you >> I just had one minor question and then I'm not trying to slice and dice and rearse it but class two which is worse class two or class 4 >> well class two is uh it escalates so the

161
00:48:27.920 --> 00:48:44.319
class two are are lesser fines >> okay okay to class 4 in my mind based upon the the penalties was uh more of a serious infraction more concern just curious why was the swimming pools put as a class for >> I'm sorry. Why?

162
00:48:44.319 --> 00:49:00.559
>> Swimming pool violations are put as a class 4 >> because there it's it's important. It's something that can be impacted immediately. Um we we drive up to a house and uh that the fence is knocked down. That's something we need to impact very very quickly to the safety for children.

163
00:49:00.559 --> 00:49:16.640
>> Agreed. But isn't isn't a four more serious than than a two? >> Oh, I apologize. Um no, the reason that it's it's a two is due to the fine amount. Typically, when we run into uh the swimming pools, um it's not something that is going to uh somebody's

164
00:49:16.640 --> 00:49:31.839
done on purpose. It's something that has happened. Okay? And we need them to respond quickly. Okay. Um typically, we're going to run into a situation where we give them the uh the notice of violation or the courtesy notice in that regard and it's going to be fixed immediately anyway. >> I know there's only three. I was It's just a curious question. Okay, I'm fine.

165
00:49:31.839 --> 00:49:48.720
I'm good. >> Council member Fernandez, >> I I have one. So, pick a really transient violate. Let's um yard parking. Let's just say yard parking can be fixed in 30 seconds. You

166
00:49:48.720 --> 00:50:04.319
go out, move your car, >> right? >> Um so, let's just say somebody is parking in their yard and they you go knock on the door and tell them, "Hey, you're parked in your yard. You got to move your car." They move the car. Okay.

167
00:50:04.319 --> 00:50:20.880
Walk me through what happens. They park in the yard every day. So, tell me the enforcement process. I mean, when do they get warned? At what point do you go up and give them a citation? I mean, tell walk me through the steps of how

168
00:50:20.880 --> 00:50:36.559
you would escalate that. >> Sure. So, for a yard parking, for example, uh we would approach the property just like we do now. We would uh knock on door, make a phone call, try to get hold of them somehow. If we can't make contact, we're going to leave a door hanger that states this is a

169
00:50:36.559 --> 00:50:52.800
courtesy notice. That is the warning. That is the courtesy notice. From there, they're going to have a period of time, typically 7 to 10 days. Um, now, we want that to happen very, very quickly, obviously, immediately. And that's we're going to put we're going to put, please fix this immediately. Past that 7 to 10 days, it's going to move, it's going to

170
00:50:52.800 --> 00:51:08.720
escalate to the notice of violation. That's where the enforcement escalates. They're going to get another 7 to 10 days for that. Once that occurs uh and they they don't comply, they'll receive the citation. Now, following the citation, should they still not comply, we move to a second citation and a third

171
00:51:08.720 --> 00:51:25.440
citation and it's subsequent after that. >> Okay? So, that would turns out this is a good example because suppose you go up, you leave the door hanger, they move the car, two days later they put the car back, which is what we're trying to

172
00:51:25.440 --> 00:51:42.000
address, >> correct? Two days later, they put the car back. What happens then? Because the first violation was cured. This is now a new violation. How do we deal with this? >> It's the same violation. >> It's the same violation. >> It's the same violation. So, they would receive the uh the courtesy notice.

173
00:51:42.000 --> 00:51:58.160
They're they are told uh you cannot park here. This is why you cannot park here. Here's the the code that that specifies this. Um and they're given the education right there on the spot. Now, there are going to be extended wing services where somebody is parking there for a reason.

174
00:51:58.160 --> 00:52:14.240
Um, maybe temporarily they have to get something into the house. Not a problem. Just move it when you're finished. >> Sticking with the person that's going to that's playing games with the system like I'm going to move the car, put it back, move the car, put it >> to that's a violation. The violation is parking in your yard. So, we give them

175
00:52:14.240 --> 00:52:29.520
the courtesy notice. Two days later, they park in the grass again. A week later, they park in the grass again. Now, they get a notice of violation. So the escalation moves like that. So what eventually they're going to start getting the the actual citations. >> And is there a point in this process

176
00:52:29.520 --> 00:52:46.160
where there's no more notices? They get your first action is okay, this person gets a citation at any point now. >> Once a violation occurs, they have five years. There's a 5-year period once that violation occurs that they cannot recur

177
00:52:46.160 --> 00:53:01.359
that again. That's that's standard right now. So, it's all right. I got you. Thank you, council members. Other questions? Okay. Thank you. If there are no other questions, I'll close the public hearing and ask the clerk to read the title of

178
00:53:01.359 --> 00:53:21.599
the ordinance. An ordinance of the city council of Temple Terrace, Florida, amending the City of Temple Terrace Code of Ordinances, Chapter 1, General Provisions, Article 2, Code Enforcement, Division 3, Supplemental Enforcement

179
00:53:21.599 --> 00:53:39.280
Procedures by amending Section 1-103 by amending section 1-104D by creating section 1-104 L by amending amending section 1-105B

180
00:53:39.280 --> 00:53:56.480
and by creating section 1-105D providing for severability providing for conflicts providing for inclusion in the temple terrace code of ordinances providing an effective date. >> Thank you madam clerk. Is there a motion

181
00:53:56.480 --> 00:54:14.000
to approve on second reading? >> Move to approve on second reading ordinance 1597. Amending section 1-103 definition section 1-104 enforcement procedures and 1-105

182
00:54:14.000 --> 00:54:31.040
schedule of violations and penalties. >> Second motion and a second discussion of the motion. Council member Kravitz >> just do have one comment on it. Um in a few minutes we're going to be addressing commercial vehicles. That's part of this ordinance that we're voting on right

183
00:54:31.040 --> 00:54:46.800
now. When we approve this, we're about to go and amend it again potentially. And um I think we will have some discussion about the um number and size of commercial vehicles that's being proposed that might be permitted uh in

184
00:54:46.800 --> 00:55:04.559
people's uh driveways uh going forward. So uh when we vote yes on this, it's on a classification of weight that's much lower than the one that's going to be up for discussion shortly. So, I just want to mention that so that everyone is

185
00:55:04.559 --> 00:55:20.240
aware of this fact and then as we go to discuss the other one, we can be aware that we're passing a a code revision right now that we're about to amend. So, I I do like this revision and I think it's a good step forward and I think that a lot of these transient ordinances

186
00:55:20.240 --> 00:55:36.400
have been troublesome. So, it's good that we're getting to grips with that and I I do look forward to receiving the uh uh the staff policy about the escalation process and that for that to be made public because in the past um that's always been a bit of a contentious point for many residents

187
00:55:36.400 --> 00:55:52.000
about who gets what level of warning and who might get more or less uh leeway. So, having that all public and transparent is a really positive step. And I just want to commend code enforcement um and director Shanks for their effort in that direction and

188
00:55:52.000 --> 00:56:07.280
making sure that everyone plays by the same rules here. So, thank you. I yield. >> Other comments on the motion? Mr. Shanks, would you clarify something for us, please? I cuz I have a different understanding and I don't know if I'm

189
00:56:07.280 --> 00:56:24.720
if we amend the commercial vehicle ordinance which we are as council member Kravitz pointed out we're contemplating soon. I don't the way I understood the presentation this would not need to be amended because this would just deal

190
00:56:24.720 --> 00:56:41.440
with enforcement of violations >> of that code. >> Correct. So, this wouldn't be amended if we amend that. >> No, because the the code number isn't changing. The the code is the code um that number is in um the ordinance I just presented. Uh the number's not

191
00:56:41.440 --> 00:56:58.079
changing. So, whatever is in the the new uh amendment for the commercial vehicles is what we're going to be enforcing regardless. >> Okay. Okay. Because I mean the point is well taken. I don't want to do this if we're going to come right come right back to it. That's

192
00:56:58.079 --> 00:57:13.040
>> right. There there's been no changes to this. >> Okay, very good. Other discussion of the motion? Council member Kravitz, >> just briefly clarify. I I wasn't saying that we're going to amend this section. I was saying this the section that this section refers to is what we're about to amend. So, it'll have sort of an

193
00:57:13.040 --> 00:57:27.920
amplifying effect if we then go and change the provision that the penalties apply to. That was all. >> Okay. All those in favor say I. >> I. >> Opposed? No. Nays. Uh ordinance is adopted on second reading. Thank you,

194
00:57:27.920 --> 00:57:43.040
Mr. Shanks. So, next item is a public hearing and second reading of ordinance 1598, creating code chapter 20, article 4, speed zone enforcement program. And I'll open the public hearing. We have two presenters. Our deputy city attorney

195
00:57:43.040 --> 00:58:00.480
Nicole Donnell and oh, it changed up on me. It's the police chief is going to join her tonight. Okay. And police chief Staley. Good evening. >> Good evening, Mayor, city council members. Tonight we are bringing a proposed ordinance before you for a second time. This ordinance allows for

196
00:58:00.480 --> 00:58:15.599
the use and implementation of speed detection systems within school zones here in Temple Terrace. The ordinance is titled School Speed Zone Enforcement Program and Speed Detection Systems. Florida statute section 316.1896

197
00:58:15.599 --> 00:58:31.920
authorizes local governments to use speed detection systems to enforce speed limits in school zones during specified hours. specifically when school is in session. This statute also authorizes the city to issue notices of violation when a person drives at a greater speed than that

198
00:58:31.920 --> 00:58:47.359
which is posted in a school zone. Chapter 316 of Florida statute requires a traffic study to be conducted where a speed detection system is being considered and proposed. Resulting data must be considered before a speed detection system can be implemented. A

199
00:58:47.359 --> 00:59:03.200
traffic study was conducted in February of this year and data shows there is a heightened safety risk in five specific school zones within Temple Terrace. Those five schools are Greco Middle School, Woodmont Charter School, Temple Terrace Elementary School, Lewis

200
00:59:03.200 --> 00:59:18.720
Elementary School, and River Hills Elementary Magnet School. The police department has determined that implementing speed detection systems in these five school zones are in the best interest of the city. Chapter 316 allows a local hearing officer to conduct

201
00:59:18.720 --> 00:59:36.079
hearings on violations that are issued. The local hearing officer will be a licensed Florida attorney. Assuming this ordinance passes, the local hearing officer will be compensated on a flat fee basis from the violations that are assessed. Money is paid from the violations. The ordinance before you is

202
00:59:36.079 --> 00:59:51.920
modeled after surrounding cities including the city of Tampa and Hillsboro County. By having the speed detection system ordinance in our city code, the police department will effectively enforce the speed enforcement in those five school zones. I will be here for questions and I will

203
00:59:51.920 --> 01:00:09.280
turn it over to Chief Staley who will also be able to provide additional information on implementation. Let's >> go now. Chief, good evening. Since the last county city council meeting, staff has evaluated the concerns raised by the mayor and raised by uh council member Fernandez. Um staff

204
01:00:09.280 --> 01:00:25.760
originally planned to use the piggyback purchasing process uh which would have been an acceptable procurement process. However, the requested changes uh that were recommended represent a significant departure from the plant plantation agreement. Um that as a result staff can no longer use this agreement for this

205
01:00:25.760 --> 01:00:42.079
project. Staff will instead issue a request for proposals to develop a contract that addresses the concern raised by council and the city's requirements for the project. This will address all of the concerns regarding data sharing uh data deletion everything that we talked about in the last uh

206
01:00:42.079 --> 01:00:57.440
council meeting. So all of your concerns will be address will be addressed. Um we recommend that you approve and uh implement uh the ordinance and this will result in us publishing the RFP which

207
01:00:57.440 --> 01:01:13.599
will be posted for 30 to 60 days and we will evaluate all the companies that make presentations. >> Thank you chief. Are there members of the public who wish to comment on this item? Okay, seeing none, council member questions. Start down this. Council

208
01:01:13.599 --> 01:01:30.559
member Fernandez. >> So, I have a couple questions. Um, the first being the school zone markings or the delineation that identify the time when a school zone is active. Um, who

209
01:01:30.559 --> 01:01:46.480
who manages those markings? Because I mean I I obviously still know when school starts. However, a few years from now when I really am disconnected from school, there's a lot of people driving around that have no connection

210
01:01:46.480 --> 01:02:01.200
to a school. They don't have any idea what time school zones are u active. Who's going to maintain that information to make sure that it is well marked and well noticed to drivers?

211
01:02:01.200 --> 01:02:17.440
>> Absolutely. So, uh, great question. The signage that's out there now will be replaced with new signage that indicates that there's speed zone, uh, cameras in in use. When and when that does happen, it will be updated and have proper uh, flashing so that way they they know what what times are being enforced.

212
01:02:17.440 --> 01:02:32.640
>> So, who's going to actually control the flashing the time? >> The company that installs the the actual flashing light. So, whatever company we do choose will be responsible for maintaining the the signage. >> Okay. So um what about and we we talked

213
01:02:32.640 --> 01:02:49.359
about this at the last meeting and it was that for city of Temple Terrace was planning our enforcement would be only operational during the times of active school zone the flashing light times

214
01:02:49.359 --> 01:03:04.480
>> right >> um and I wondered at that time if it's possible for that to actually be written into the ordinance versus being a policy. I didn't see it actually in that that I didn't see that verbiage actually

215
01:03:04.480 --> 01:03:22.559
in the ordinance. And my concern is that over time these can grow. And if we're looking to create safety and change behavior during specific school zone active times,

216
01:03:22.559 --> 01:03:39.280
I want to make sure that it doesn't accidentally grow and change. And if it's in the ordinance itself, it would have to come in front of city council for the times to be changed. >> Right? So, it doesn't mention the

217
01:03:39.280 --> 01:03:56.160
specific times in the ordinance. But what it does say is that 30 minutes prior to breakfast and then 30 minutes after the start of school is when that morning is enforced. Also, in the evening or in the after after school, it would be 30 minutes prior to dismissal and 30 minutes after dismissal. So, we

218
01:03:56.160 --> 01:04:11.359
could call out the times individually, but >> No, I wasn't. I I just was wanting to make sure that that is actually part of the ordinance itself and not part of the policies or or the and I and I just

219
01:04:11.359 --> 01:04:31.280
didn't see the 30 minutes after school started. So, okay. Um, that is I think all I wanted to ask. >> Yes, mirror. Thank you. Um, and the last meeting you walked us through this, but I'd like to do it again. So, someone's

220
01:04:31.280 --> 01:04:46.480
going too fast during school zone time and the camera records their license and everything. And does it take a picture of the driver also or just it goes with the car? >> Just the rear of the vehicle. >> Okay. So, the citation will go to the owner of the car. Okay. So, that

221
01:04:46.480 --> 01:05:04.400
happens. and one of our officers, will they look at every violation that comes in, looks at the camera picture and everything? >> Yes, sir. >> Is there any verification to make sure that even though the let's say the thing flashing light was mistimed or schools

222
01:05:04.400 --> 01:05:20.720
closed that day for whatever reason that uh they verify the days and the times. >> Yes. As part of the workflow, that's one of the responsibilities of the officers. They verify that the day that the that the school is in session, they verify the times that were uh designated for that day before the prior to issuing any citation.

223
01:05:20.720 --> 01:05:35.920
>> Okay. Thank you. That's all I have. Council >> me. >> Yeah. Um you answered the question about who be who who actually do be doing the monitoring. That'll be part of the RFP. I'm sure >> you know for for the individual companies. But then what about the data

224
01:05:35.920 --> 01:05:52.640
retention? So the data retention uh as of right now uh we're writing the RFP uh that that it will clearly establish the data retention period and require a permanent deletion of all data once the period expires. Uh the vendor will also provide a survey and evaluation of the process and measure the program's

225
01:05:52.640 --> 01:06:09.359
effectiveness at 6 months, one year and annually thereafter. So um the the data retention that we set is what what the company has to follow. >> Okay. And the only other thing was setting the times for the uh when when the cameras will be active. I'm glad you're putting it I'm glad you worded it

226
01:06:09.359 --> 01:06:24.319
the way it was worded in the ordinance because they change bell schedules all the time. Every couple years are changing around. So we'd be re we'd be amending that ordinance into adnauseium going forward. So okay, good. I'm okay with it. >> Council member Kitz.

227
01:06:24.319 --> 01:06:41.359
>> Yeah. Thank you. Actually a question for the deputy city attorney. Thank you very much for the introduction. I appreciate that. Uh well laid out the statutes. I I found it and I checked and I just wanted to ask where in the ordinance I I I just cannot find

228
01:06:41.359 --> 01:06:59.920
it unless you mean is is it section 20-69 um and then it sorry it's um 2069 and then there's one down here where it references the Florida statute uh B or is it um had it here a minute ago but where is

229
01:06:59.920 --> 01:07:16.720
the speed speed limitation uh the the timing I cannot find it in this ordinance at When you say the timing, are you talking about the >> the enforcement windows? Yeah. >> Okay. The so the enforcement windows as chief mentioned um we are allowed to enforce according to the statute there's that 30 minutes before and after

230
01:07:16.720 --> 01:07:31.599
breakfast and then school as well. It is not specifically stated in the ordinance. If you all would like it to be in there expressly then that's an option. Um but I believe city manager has comment. >> I don't want to take away from your time. I just had wanted to clarify a little bit pick up on what this

231
01:07:31.599 --> 01:07:47.760
>> Go ahead. Yeah. So, we were just looking forward to So, that was a little bit of a just a miscommunication. So, we don't find it in the ordinance either, but I understand the deputy city attorney says it's in the in the the foundational statute, but I do want to state I understand the council member's concern,

232
01:07:47.760 --> 01:08:03.039
but I would would also say that the the contract where we would put that type of language would be in the contract that of whatever provider is going to come before you and whatever provider is going to come before future, let's say, a future contract with a future city council. they would have the ability

233
01:08:03.039 --> 01:08:18.719
written into the contract to change times, things like that if you didn't feel comfortable, whatever. That that's that would be our expectation that we write that into the contract. And you're saying yes, right? Confirming that for the record. Yes. >> So, and in fact, we'd probably put that in the RFP that we'd have our requirements would be that we would

234
01:08:18.719 --> 01:08:34.239
control the times and that would be delineated in the contract. I think and I I I get where you're coming from. So, I'm going to say just generally speaking, we typically would recommend that the ordinance be a little bit more flexible >> so that you don't have to amend the ordinance

235
01:08:34.239 --> 01:08:49.359
on a frequent basis if things change, contracts change. Well, a contract's much easier to amend because it comes up for renewal and things like that rather than the ordinance. Uh, but of course that is up to the will of the council. >> I mean, I understand the necessity in keeping statutes applicable to a large

236
01:08:49.359 --> 01:09:06.159
number of cases. Um my uh concern about this is that um at least three people up on the days have said that they believe that the language is in the statute and it was mentioned today in the minutes uh the mayor also said uh noted that this

237
01:09:06.159 --> 01:09:23.040
language is in the ordinance but it isn't. So um I I don't know uh if I like that and there seems to be a lot of ambiguity about it. So my inclination right now would be to ask staff to go back and simply incorporate the Florida statute by reference. You can simply

238
01:09:23.040 --> 01:09:40.080
make a reference somewhere in this ordinance to section 31618961A and then that would address the problem that uh several of us have raised. So that would be my recommendation and I'm happy to make a motion to that effect unless someone else has a better idea

239
01:09:40.080 --> 01:09:55.920
about how to address this. I'm not sure if just having it in the contract that we ultimately get is going to be uh enough for us to rely on legally, especially for our uh residents because the residents are going to chiefly be subject to the statute. The contract is

240
01:09:55.920 --> 01:10:14.400
between the city and the provider. So, um I'm happy to make the motion unless someone else would like to. Otherwise, uh I'll go for it. So, uh, I would like to amend this ordinance 1598 by instructing staff to add a new sentence to section 20-71

241
01:10:14.400 --> 01:10:31.120
to incorporate the Florida statute governing enforcement windows by reference. >> Mayor, I still had questions. >> Yeah, I I do too. >> Oh, well, there's a motion. Happy to withdraw it until we've all had our chance to ask questions. >> So, motion's withdrawn. I'll come back

242
01:10:31.120 --> 01:10:47.120
to it later. >> Do you have any further questions? >> I don't yield the floor. Council member Chambers. Right. So, uh you just heard that dialogue. If we uh address in the ordinance the uh statute in the ordinance, does that uh preclude you

243
01:10:47.120 --> 01:11:02.400
from uh doing anything later down the road like you were talking about? if we put the statute number in the ordinance and not the times in the ordinance. I'm asking anybody, but that's what council member Kravitz was wanting

244
01:11:02.400 --> 01:11:18.400
to put the statute number in the ordinance, not the times in the ordinance because if you do that then yes, you have to come back every time you the times change. So would that somebody >> somebody think

245
01:11:18.400 --> 01:11:35.520
>> um so if we the statute 316.1896 is referenced in the ordinance a few times but not the specific subsection that Councilman Kravis is referencing. So we can put that in the uh ordinance specifically as a reference that's being recommended if that's what you all would

246
01:11:35.520 --> 01:11:52.800
like. And would that hinder you hinder us any way or future councils? >> No, it would not. >> Thank you. Can we get all the way up and down the days of questions? I think we did. So, I I have a question for Council

247
01:11:52.800 --> 01:12:09.360
Member Kravitz. If just to I'm not opposed to the intent of your motion. I just have a question about it. So, I'm looking at page four of the ordinance, which is section 20-69. And the the last paragraph on there is G

248
01:12:09.360 --> 01:12:27.040
and it's uniform traffic citation means the citation issued to the registered owner of a vehicle for a school zone speed infraction in the form and including the contents prescribed by sections 3161896 and 31650.

249
01:12:27.040 --> 01:12:44.080
Um, I I'm not opposed to clarifying further that we don't want these cameras being used to enforce speed outside of the school zone times, but I'm is that what that says or are we

250
01:12:44.080 --> 01:13:06.159
I mean I I don't guess it'd be any harm in adding another section, but is that what that intent of that paragraph is? there is no harm in adding the additional like you mentioned. Um I

251
01:13:06.159 --> 01:13:21.760
don't want to say yes because this is also in our definitions section and not in the substantive language of the ordinance itself. So >> like I mentioned 316.1896 is referenced a few times in the ordinance but not that specific

252
01:13:21.760 --> 01:13:36.400
subsection. Okay. So, are there further questions? Council member Fernandez. So I just I want to clarify where where my question was coming from and that is at the last meeting it it what I heard and what I

253
01:13:36.400 --> 01:13:51.920
understood is that the state statute allows for speed enforcement in school zones anytime school is in session not just during the active school

254
01:13:51.920 --> 01:14:09.199
arrival and departure times. Is that not allowed by statute? I mean, did I know that you said that we were only going to enforce it during specific school arrival and departure times, but I thought that I understood that it

255
01:14:09.199 --> 01:14:26.719
could be enforced throughout the day. And that is one of my concerns is that I didn't want it throughout the school day. >> So, I think we're confusing two issues. There's there's the school zone enforcement, but there's also the speed enforcement. So what the other jurisdictions were doing were outside of

256
01:14:26.719 --> 01:14:41.280
school zone enforcement, if they went over the let's say it's 25 miles per hour, they were enforcing those violations. We're only enforcing the school zone violations which are 30 minutes prior to breakfast, 30 minutes after uh going to school, 30 minutes prior to dismissal, 30 minutes after dismissal.

257
01:14:41.280 --> 01:14:58.159
>> Okay. So my So then what I'm asking is a way that it's clarified. I I am not asking you to be clear to put 7:15 to 7:45 Lewis Elementary School Zone. I I know that they change uh arrival and

258
01:14:58.159 --> 01:15:14.560
departure times every year. I want us to be able to delineate the time period, describe the time period that we would be using this for enforcement. meaning that the 30 minutes

259
01:15:14.560 --> 01:15:31.760
before the 30 minutes after breakfast, whatever that that description is, that's clearly delineated to the arrival and departure times for for the school zone, not and so because my concern is

260
01:15:31.760 --> 01:15:49.280
mission creep and that it gets so I'm just concerned about it in general being used for more than the originally stated purpose and I that's what I want to make sure. So that was that's where my

261
01:15:49.280 --> 01:16:05.760
question is. That's what I wanted to clarify and that's what I would like to see in the language. >> Council member Kravitz's motion will cover all of that when he gets to that. >> Yes. But I just wanted to clarify why I was asking >> the section that he proposes to add will cover that.

262
01:16:05.760 --> 01:16:20.719
>> Yes, >> Mr. Mueller. I just say if we are going to add that in and want that actually in the language of this ordinance, my recommendation would be tonight would then be again another first reading and then we would have second reading again

263
01:16:20.719 --> 01:16:37.600
in two weeks. Reason being this is a penal type of uh ordinance that we're doing. People are going to be penalized by it. I'd rather not have any procedural issue that might uh nullify it. So I think in an abundance of caution if we put that language in first

264
01:16:37.600 --> 01:16:53.440
reading again tonight and then second reading with the new language again. >> Okay. Any further questions? Council member Kravitz. >> Council member Fernandez, do you want to have that motion? >> Well, it's not time for a motion yet. We're in the middle of a hearing. We

265
01:16:53.440 --> 01:17:10.760
have to go through a few steps, but >> Sure. >> Um if there are no other questions, we'll go through those steps real quick and then we'll entertain a motion. Any more questions? Okay. If there are no further questions, I'll close the public hearing and ask the clerk to read the title of the ordinance.

266
01:17:11.920 --> 01:17:27.920
An ordinance of the city council of Temple Terrace, Florida, creating the city of Temple Terrace Code of ordinances, chapter 20, article 4, titled School Speed Zone Enforcement Program and Speed Detection Systems,

267
01:17:27.920 --> 01:17:43.679
providing for use of speed detection systems in accordance with state law, providing for definitions, providing for use of local hearing officer, providing for the designation of school speed, detection zone, providing for

268
01:17:43.679 --> 01:18:00.320
severability, providing for conflicts with state law, providing for codification, directing that the ordinance be filed with the department of state, providing for correction of scrier's errors, providing for conflicts, providing an

269
01:18:00.320 --> 01:18:15.600
effective date. >> Thank you, Madam Clerk. And just I think everybody heard but just to for whoever makes the motion that if we if it's our intent to add that language we the motion also needs to include the direction that it be brought back for

270
01:18:15.600 --> 01:18:31.920
first reading to council. >> Correction that tonight would be first reading that if we make the motion it would be first reading tonight and when we bring it back in two weeks we'll have second. >> Okay. I didn't understand that. That's what you said but okay that's fine. So that language would need to be in a

271
01:18:31.920 --> 01:18:51.120
motion. Okay. So we had all this discussion. Are we going to have a motion? >> Well, right now we don't even have a motion to adopt. So that's what >> that's what I'm asking for. >> Wow. Okay.

272
01:18:51.120 --> 01:19:07.440
>> Uh we we need a motion if we want to add we can do a number of things here. We can make a motion to approve it as it is, bring it back and approve it on second reading. If we desire to, and I think it's probably a great idea to make

273
01:19:07.440 --> 01:19:23.280
a motion to add language to clarify that we want this only during school zone times, then we can add that bullet to the ordinance and direct that it be brought back for second reading. We can do that or we can disapprove it on second reading. I don't know what else

274
01:19:23.280 --> 01:19:40.159
we could do. >> Okay. So, let me try this. >> Okay. >> All right. So, uh, move to approve on first reading of ordinance 1598, creating code chapter 20, article 4, school speed zone enforcement

275
01:19:40.159 --> 01:19:57.679
program, adding and I don't know the numbers. >> Sorry, this the language that they'll put in. >> Adding the language that will be put in that we just discussed. Is that okay? >> Adding that it will only be enforced during times.

276
01:19:57.679 --> 01:20:14.960
Okay. Adding only I'm not sure that's my intent to add this. Well, to add the the chap add the U section that we were just talking about that clarifies those times but not adding. >> Does that make sense? Anybody?

277
01:20:14.960 --> 01:20:31.360
>> It would be section 316 1895. 316 >> 1895 >> 1895 >> adding section 316 1896 >> 90

278
01:20:31.360 --> 01:20:48.080
1895 talks about the 30 minutes prior to breakfast time. Um >> I don't think so. >> I have it in front of me right here. Um, according to 3161895

279
01:20:48.080 --> 01:21:04.400
paragraph five, it says a school speed zone limit may not be less than 15 miles per hour except by local regulation. No school zone speed limit shall be more than 20 mph in an urbanized area. Such speed

280
01:21:04.400 --> 01:21:21.920
limit may be enforced only during those times 30 minutes before, during, and 30 minutes after the periods of time where pupils are arriving at regularly scheduled breakfast program or regularly scheduled school session and leaving a regularly scheduled school session.

281
01:21:21.920 --> 01:21:39.360
>> That's 1895 city attorney. The section that we're adding is the one relating to breakfast program and so forth and that is in 3161896. So there might be additional language about arrival and departure and so forth in the provision that you've cited, but

282
01:21:39.360 --> 01:21:55.280
the specific topic that we've been addressing, which is the breakfast stuff, the starting of the school session, and the um 30 minutes and 30 uh 30 minutes before and after the regular end of the school session that is in 3161896.

283
01:21:55.280 --> 01:22:08.880
Okay. Promise. >> Well, we'll make sure that it's clarified that >> I can pass my computer around. You can read it if you want. Could can I make a sharp please suggestion to council? I >> also the deputy city attorney I believe

284
01:22:08.880 --> 01:22:26.639
referenced that statute too. So >> I think we all have the same intent here and we're getting wrapped around the axle on stuff. I think all we're trying to do is to put a a statement in the ordinance that says we only want to use

285
01:22:26.639 --> 01:22:43.360
these citations during school zone times. >> Yeah. >> I I don't know that it's crucial that we I mean school zone times. If the beacon is flashing, that's it. I think we're overthinking

286
01:22:43.360 --> 01:22:59.280
this a little bit. I mean, I I I think our intent is that we don't want to do what everybody what not everybody what other cities have done is, you know, okay, the speed limit goes from 15 to 25 and they're still running the cameras. We don't want that. We just want this

287
01:22:59.280 --> 01:23:15.440
during school zone hours. Can't we just make a motion to approve on first reading >> this with the addition of a sentence that says we only want this done during school zone hours? Let them They'll put that in there. It's a simple sentence and then direct them to bring it back

288
01:23:15.440 --> 01:23:30.480
for second reading. It's really I think we're >> getting two. >> Okay. >> Um I think the intent we all agree on. >> Say incorporate the relevant Florida statutes by There you go. >> Okay. Well, then we'll argue over which is the relevant Florida statutes. >> That's what we've been doing for the

289
01:23:30.480 --> 01:23:44.639
last five minutes here. So >> I know. I thought you were going to make a motion. >> I'm trying to >> You made a good motion. I wish you'd just make it again. >> I'm happy to do it. >> Okay. >> Motion motion in the process. Well, we I don't think you ever finished the motion.

290
01:23:44.639 --> 01:24:01.760
>> I I have no clue what I did. So, um So, I will withdraw whatever I did. >> Okay. Would Would you like I think what you started out to do the beginning was good. >> I'm happy to do it. Okay. I'm going to do this uh as simply as I can. So, I'll

291
01:24:01.760 --> 01:24:20.560
move to adopt uh agenda item 12B with the instruction to staff that the relevant Florida statutes regarding um uh timing windows for enforcement in school zones uh be incorporated by reference into the ordinance.

292
01:24:20.560 --> 01:24:37.040
>> Second. >> Okay. I think we need to tell them to bring it back for second reading though. Do you mind doing adding that? >> Uh and to bring it back for a second reading at the appropriate time. >> Good. Thank you. second. >> Yes, >> we'll need a date certain on the second reading, which would probably be the August 17th.

293
01:24:37.040 --> 01:24:52.000
>> Why? >> On August 17th. >> Why is that? >> Because PE we're on the record and we're want people to know when second reading is going to be, not we can't use that at the appropriate time. We should use the date. >> Did this make it onto the agenda with a

294
01:24:52.000 --> 01:25:08.000
date certain attached? >> I believe that it did. Let's see. >> Yeah. Mhm. >> This was made specific for all >> second reading always includes a date. >> All right. Well, >> all right. When do you want it back

295
01:25:08.000 --> 01:25:25.520
then, staff? How much do you need time? >> We can have it back the 17th. >> The 18th. >> 17th. >> 17th. And to to submit it for a second reading on the 17th, then I'll amend it. Okay. >> Second. Motion. Second. Discussion of the motion. If not, all those in favor

296
01:25:25.520 --> 01:25:42.239
say I. I >> opposed. No nays. >> Me. I'm no >> one. No. Okay. So, ordinance 1598 creating code chapter 20 article 4 regarding speed zone enforcement is approved now on first reading and will

297
01:25:42.239 --> 01:25:59.520
appear for second reading and public hearing on August the 17th. Okay. Thank you, councel. Next item is a public hearing and first reading of an ordinance amending land development code sections 12-40 and 12-81 reasonable accommodation

298
01:25:59.520 --> 01:26:15.040
procedure for recovery residences. I will open the public hearing and senior planner Alyssa Livingstone will explain. Good evening. >> Good evening Mayor and council members. May I have a couple of minutes? The laptop closed.

299
01:26:15.040 --> 01:27:15.520
Oh, >> nobody seems to be coming to your rescue. Here we go. >> Awesome. >> There we go. 261. This is a new one, right? Good evening, mayor and council members.

300
01:27:15.520 --> 01:27:34.239
I'm Alyssa Livingstone, senior planner. I'm here to present proposed text amendments to the city's land development code. These updates focus on section 1240 definitions and section 1281

301
01:27:34.239 --> 01:27:50.159
reasonable accommodation procedures to ensure compliance with 2026 Florida statutes regarding the review and approval process for certified recovery residences.

302
01:27:50.159 --> 01:28:10.800
Additionally, please note that the Hillsboro County City County Planning Commission officially approved these text amendments on June 8th, 2026. These proposed amendments do not

303
01:28:10.800 --> 01:28:27.440
introduce a brand new code requirement as the city's reasonable accommodation procedures were originally adopted on July 18th, 2017 to comply with state and

304
01:28:27.440 --> 01:28:45.360
federal housing mandates. These amendments clarify and update our existing policies and procedures for reviewing and processing reasonable accommodation request to align with the

305
01:28:45.360 --> 01:29:03.760
updated 2026 Florida statutes. If approved, this text amendment will adopt the statewide definition of certified

306
01:29:03.760 --> 01:29:25.520
recovery residences. The proposed amendment to section 1281, reasonable accommodation procedures, implements the requirements of section 397.487 487

307
01:29:25.520 --> 01:29:43.120
of the Florida statutes by establishing a process for requesting reasonable accommodations from any land development code regulation that may prohibit the establishment of a certified recovery

308
01:29:43.120 --> 01:30:00.960
residence. In this section, a disabled individual is defined as someone who qualifies as disabled or handicapped under the FHA andor ADA and has a disability

309
01:30:00.960 --> 01:30:19.840
as defined by section 760.22 of the Florida statutes. These individuals may request reasonable accommodations regarding the city's LDC and procedures as provided by the

310
01:30:19.840 --> 01:30:41.199
federal fair housing act and title two of the Americans with Disabilities Act. Staff recommends approval of the proposed amendments on first reading and public hearing. Second reading and

311
01:30:41.199 --> 01:30:58.280
public hearing is scheduled for Monday, August 17th, 2026. Thank you. >> Thank you, Miss Livingstone. Are there members of the public who wish to comment on this item? Seeing none, council member questions.

312
01:30:58.960 --> 01:31:13.120
Questions? Any questions? Council member Fernandez. >> I I do. So, but what I'm what I've read and what you've explained is that basically this is a change that the city

313
01:31:13.120 --> 01:31:29.280
is required to make in order to be in compliance with state statutes. Is that correct? >> That's correct, Council Member Bernandez. >> Okay. So, I guess I and I'm I guess I'm not really understanding what the purpose is behind this because

314
01:31:29.280 --> 01:31:47.040
we already have um codes that require um you know if somebody comes needs to update their housing to be ADA compliant or something that that's if that's all permissible already. So, what like what

315
01:31:47.040 --> 01:32:03.600
is so different about this that we need to make a change? Okay. So this these proposed amendments they actually one the first part of it is that it adopts the statewide definition of certified recovery residences. So previously in

316
01:32:03.600 --> 01:32:20.400
our well I would say currently in our LDC there's no outline definition of certified recovery residence and also there's an um a a streamline process which is established with review time. So we actually the community development

317
01:32:20.400 --> 01:32:38.000
department or staff we actually have set review times and I could explain it if you like me to. >> Well so um those weren't clear in our LDC. >> Okay. So this is basically that if a an

318
01:32:38.000 --> 01:32:54.880
organization purchases a residential home and they want to make it a certified recovery residential location. Um that's that is already allowed under uh federal fair fair

319
01:32:54.880 --> 01:33:10.800
housing requirements all of that. So that existed but we didn't have a good definition of what that uh to describe that type of unit. >> All right. >> Okay. And why would we and so I just

320
01:33:10.800 --> 01:33:25.760
want to for anybody who's listening I just want to you know so that they can hear. So, why would we need to have uh more updated description? Because we already do have um in our codes the

321
01:33:25.760 --> 01:33:41.840
timelines for somebody coming in front of us to modify their home to be ADA compliant. >> All right. So, what this amendment does is that it's it it provides it provides more of a clear outline. So, I could

322
01:33:41.840 --> 01:33:56.719
explain it if you'd like some more clarification. >> Yeah. If you have a short okay explanation. Yes. >> All right. So to ensure administrative accountability, the community development staff will date stamp completed applications upon receipt. The

323
01:33:56.719 --> 01:34:13.760
city manager or their design may request additional information within 30 days of the initial filing. The applicant then has 30 days to provide the requested documentation. Once an application is deemed complete,

324
01:34:13.760 --> 01:34:30.639
the city has 60 days to issue a final determination. If a request is denied, the city must provide evidence-based reasons for the denial, identifying specific deficiencies or actions required for reconsideration.

325
01:34:30.639 --> 01:34:46.960
To ensure predictable timelines, the code establishes the 60-day review period as a firm deadline. and failure to meet this deadline results in a deemed approved status unless a written extension is mutually agreed on by both a part by both parties.

326
01:34:46.960 --> 01:35:03.600
>> Thank you. >> Good evening, council. Greg Paulie, director of community development. Um I just wanted to make sure that we're all talking the same language here. This has nothing to do with um requirements to

327
01:35:03.600 --> 01:35:18.719
make your home ADA compliant. This has everything to do with state mandate requiring the city to provide relief from traditional land development codes, zoning regulations, and things of that

328
01:35:18.719 --> 01:35:35.679
nature that benefit someone who needs that relief. Specifically, in this case, they've made recovery residences part of that group that would be eligible for this type of relief. So, I think we may

329
01:35:35.679 --> 01:35:51.920
have been talking two different languages there at one point and I just want everybody to be on the same page. This tonight's amendment only addresses a standardized definition for uh recovery resence residences throughout

330
01:35:51.920 --> 01:36:08.480
the state that is adopted by the state and imposed on the communities through mandate and also the application and review process. It formalizes the application and review process which includes the timelines that Miss Livingstone was just discussing.

331
01:36:08.480 --> 01:36:24.639
>> Thank you. >> Vice Mayor, one question. Council member Scher, >> can you better define a recovery um residence? >> Um the reference traditionally that is used here is it means she's got the

332
01:36:24.639 --> 01:36:39.760
definition right here. It says a uh means a residential dwelling unit or other form of group housing that is offered or advertised through any means including oral, written, electronic and printed uh means as a residence that provides peer support, alcohol-f free

333
01:36:39.760 --> 01:36:55.440
and drug-free living environment. >> Okay. So, we're talking about a rehab facility. >> We're talking we're talking about specifically alcohol uh recovery and drug recovery. >> Okay. like the like the residence we had or the building that was done on uh uh

334
01:36:55.440 --> 01:37:11.679
South River Hills. >> Okay. Yes, sir. All right. That's I thought cuz it's now we're getting a little I was getting a little confused with what you were saying because that's not as I understood it. Okay. All right. Back to where I was. All right. >> Thank you, Council Member Kravitz. >> Thank you. I have a very narrow

335
01:37:11.679 --> 01:37:29.199
question. This is about section 1281E4 in this uh ordinance and it says if a final written application is not issued within 60 days dot dot dot then it's deemed approved. So my question to you is do you have administratively

336
01:37:29.199 --> 01:37:45.520
something set up to track and the aging on these applications so that that never happens? We do have uh tracking in our permitting office now. Um it's a very manual process. This process will be um

337
01:37:45.520 --> 01:38:02.480
elevated quite uh advanced quite a bit more when we get our new system online. It is manual. And in addition to this, we have to track aging on pretty much everything we touch nowadays um based on a lot of other legislative amendments

338
01:38:02.480 --> 01:38:18.000
that have just gone into effect at the first of last month. So to answer your question is yes, we do. Is it a perfect scenario? No, it's not. Um, there are clauses within the language that allows for a mutual agreed upon extension. If

339
01:38:18.000 --> 01:38:34.320
there is something that comes up that is just not clear if it qualifies, that would require extending that 60 days longer. >> Okay. Well, I'm happy to hear that and I'm just going to pass this along as encouragement. You know, I would I would make sure that these get tracked somehow

340
01:38:34.320 --> 01:38:51.199
automatically and that at certain stages in the process, there are automatic warnings that go out so that there's no risk that one of these is approved without the proper review on our end to see what we can do and whether it can be made to fit it better with whatever other plans and concepts we may want.

341
01:38:51.199 --> 01:39:08.400
>> Absolutely. >> So, that's all. I'll yield my time. Thank you. >> Are there other questions? If there are no other questions, I'll close the public hearing and ask the clerk to read the title of the ordinance. An ordinance of the city of Temple Terrace, Florida, amending the Temple

342
01:39:08.400 --> 01:39:24.000
Terrace Land Development Code as amended by amending sections 12-40 definitions 12-81 reasonable accommodation procedures, providing for cotification, providing for severability, providing

343
01:39:24.000 --> 01:39:41.280
for correction of typographical errors, repealing all ordinances or parts of ordinance and conflict here with providing an effective date. Thank you, Madam Clerk. Is there a motion? >> Move to approve ordinance on first reading amending land development code

344
01:39:41.280 --> 01:39:58.800
uh section 12-40 definitions of 12-81 reasonable accommodation procedures for recovery residences and to schedule second public hearing for the second reading on August 17th, 2026. >> Second motion and a second discussion of the motion.

345
01:39:58.800 --> 01:40:13.840
>> Good. Thank you. All those in favor say I. >> I. >> I. opposed nays. The ordinance is appear is passed on first reading and will appear for second reading in public hearing on Monday, August the 17th, 2026. Remember, this is

346
01:40:13.840 --> 01:40:31.840
Monday, not a regular Tuesday night. So, good. Um, next item is a public hearing and first reading of an ordinance amending land development code sections 12-40 and 12-922, commercial vehicle restrictions in residential districts. I will open the

347
01:40:31.840 --> 01:40:47.440
public hearing and our senior planner, Alyssa Living. Well, no, I see we changed up again. This is twice you guys. You're just trying to keep me on my toes. So, our community development director, Greg Paulie, is here to explain. Keeping you on your toes tonight, Mr.

348
01:40:47.440 --> 01:41:02.719
Mayor. Once again, good evening, uh, mayor and council. Greg Paulie, your director of community development. I'm here tonight to present for you a land development code text amendment uh number LDC2503

349
01:41:02.719 --> 01:41:20.560
pertaining to the uh commercial vehicles restrictions in residential districts. The purpose of this amendment is to address existing code text that is somewhat ambiguous,

350
01:41:20.560 --> 01:41:38.320
outdated, and difficult to enforce. The goal is to establish clear and objective uh standards for restricting certain commercial vehicles in residential districts. Um the current text provides for two existing reasonable exceptions. The

351
01:41:38.320 --> 01:41:55.440
proposed amendment restates these same exceptions as well as adds two additional reasonable exceptions to provide allowances for residents who drive company vehicles and unmodified pickup trucks for work purposes.

352
01:41:55.440 --> 01:42:11.360
As you may recall, most of you may recall, we discussed this in great detail at the land development workshop early last year. Um at that time I shared with you uh various uh examples of code from neighboring jurisdictions and also a few from other jurisdictions

353
01:42:11.360 --> 01:42:28.159
in South Florida. Um I also introduced during that workshop the concept of utilizing gross vehicle weight rating uh as set by the Federal Highway Administration um as a baseline for categorizing various vehicle types. Feedback from

354
01:42:28.159 --> 01:42:46.480
that workshop was ultimately utilized to prepare tonight's amendment. The amendment uh has this amendment has been developed in collaboration with uh Mr. Jack Shanks uh code compliance department to ensure clear standards

355
01:42:46.480 --> 01:43:02.080
that are easy to understand and enforce. The amendment was also presented to the planning commission by Miss Livingstone earlier this year and it was approved by the planning commission. The scope of tonight's amendment

356
01:43:02.080 --> 01:43:16.800
includes edits to the definitions in section 1240, specifically the definition of commercial vehicle and also a rewrite of compliance standards found in section 12-922. The full redline edit version is

357
01:43:16.800 --> 01:43:36.560
available in your agenda packages. Here's a quick look at the two definitions. The top one being the current existing um you can see there a self-propelled or towed vehicle used in commerce to transport passengers other than the driver or cargo. And the

358
01:43:36.560 --> 01:43:53.199
proposed uh definition a bit more robust. Um a motorized vehicle or trailer that is designed, used or intended for the transportation of goods, equipment or passengers for commercial purposes, financial gain or as part of a service for hire a

359
01:43:53.199 --> 01:44:14.239
business, an enterprise or not for profit. Here's a simplified version of the same table I showed you at the workshop. Um, this is the uh gross vehicle weight rating table. Now, you'll see that this has

360
01:44:14.239 --> 01:44:30.080
been tailored down only for the first four class levels. Anything at four or above would not be permitted under this ordinance. The vehicles are simply too big. Um, so we'll focus mostly on uh 1, two, and three.

361
01:44:30.080 --> 01:44:47.520
Um, as a reminder, uh, the gross vehicle weight rating, GVWR, represents the maximum total weight in pounds that a vehicle can safely handle. And that number includes the drive weight of the vehicle, the weight of the passengers on board, the weight of the fuel cargo, and

362
01:44:47.520 --> 01:45:04.080
even the trailer hitch tongue weight is included in that number. Here you will see that uh under class one um that is 0 to 6,000 lbs. These are most of your um passenger vehicles, your light trucks,

363
01:45:04.080 --> 01:45:20.000
and things of that nature. Under class 2, this jumps from 6,01 to 10,000 lbs. These are your full size pickup trucks, vans, and things of that traditional size. Um, class three moves up the step even

364
01:45:20.000 --> 01:45:36.239
further. These are your pickup trucks and vans that most of us are familiar with and marketed as superduty, heavyduty, um, things of that nature. Um, and again, these are pickup truck class or van class vehicles. These are not the

365
01:45:36.239 --> 01:45:52.639
giant heavyduty commercial trucks. Um, these are often labeled by manufacturers F-250, F-350, uh, 2500, 3500, things of that nature. Um, anything above that 350 class range is going to, uh, jump

366
01:45:52.639 --> 01:46:10.960
beyond, uh, what this category will allow. And again, I don't think I mentioned the the number there, but it's 10,0001 all the way up to 14,000 lbs. And then, as I mentioned previously, once you get into that fourth layer there, you'll notice

367
01:46:10.960 --> 01:46:32.480
it says four four plus because there are several layers beyond this. Um, and those are vehicles that are substantially larger with a GVWR uh 14,01 and greater pounds. The amendment identifies the applicable

368
01:46:32.480 --> 01:46:54.239
zoning districts. It actually calls them out individually and identifies them single family residential, multif family residential and plan development districts that are limited to residential dwellings. The general prohibitions

369
01:46:54.239 --> 01:47:11.440
uh this uh section has also been restated to include uh the five items that you see listed here. The amendment addresses general prohibitions based on gross vehicle weight rating classification, use type, and/or modification. Um, they include motorized

370
01:47:11.440 --> 01:47:29.360
commercial vehicles with a class 3 vehicle weight rating or greater and trailers defined as commercial vehicles pursuant to section 12-40 uh as amended. Next one is commercial vehicles regardless of weight classification

371
01:47:29.360 --> 01:47:45.840
modified with equipment racks, service beds, and other service equipment mounted to the exterior or the open bed area of the vehicle. Next, we have box trucks, step vans, walk-in uh vans, panel trucks, food trucks, and similar vehicles.

372
01:47:45.840 --> 01:48:03.239
Below that, we have tow trucks, boom trucks, crane trucks, bucket trucks, and similar vehicles. And then finally we have motorized u heavy equipment used for earth moving land killing and construction farming construction or farming

373
01:48:03.520 --> 01:48:19.199
reasonable exceptions as I opened I mentioned that there are two existing exceptions and they are here on the screen. Um the first one is an exception for vehicles that are stopped or parked on temporary bases and actively loading,

374
01:48:19.199 --> 01:48:35.199
unloading or providing services for hire in the immediate area. And the next one also restated from existing texts within the code. The commercial vehicle is fully enclosed in a garage or similar structure and situation and situation is

375
01:48:35.199 --> 01:48:50.480
approved by the city council after notification is given to adjacent residents and a public hearing is held. That would be a conditional use uh scenario. It doesn't actually use the word conditional use within the code, but when you look at what they're

376
01:48:50.480 --> 01:49:06.400
requiring, it would be a conditional use for that particular parcel. After that, we have the two additional reasonable exceptions that are being proposed for you tonight. Um, the first one is the

377
01:49:06.400 --> 01:49:23.040
commercial vehicle is a class 3 pickup truck or cargo van parked on a lot within a residential zoning district and is not modified with equipment racks, service beds, or other surface equipment mounted to the exterior or open bed area of the vehicle. And only two such of

378
01:49:23.040 --> 01:49:39.760
these vehicles would be permitted at any given residential lot. And finally, the last one. Um, you some of you may recall that we did discuss this at the LDC. This one allows for out exterior

379
01:49:39.760 --> 01:49:57.119
markings to be visible and doesn't disqualify a vehicle just because it has um the name of a company or some type of an advertisement on the exterior of the vehicle. And now I'd like to share with you a couple of examples and kind of walk you

380
01:49:57.119 --> 01:50:13.679
through them a little bit. Um the top one here you see a relatively small passenger vehicle uh with a GVWR of class one, meaning it's less than 6,000 lbs total gross vehicle weight rating. And you see business markings, but in

381
01:50:13.679 --> 01:50:29.679
this scenario, it would qualify as an approved vehicle to be parked in a resident's driveway. The next one down, um, you see a slightly larger vehicle. This is a full-size pickup truck. It falls into the class 2 GVWR rating and

382
01:50:29.679 --> 01:50:49.760
it also has business markings displayed. Also would be approved to be parked in your neighbor's driveway. This one, you're starting to see a little bit of scenario here where the vehicle weight rating is approved. However, the use type is not approved

383
01:50:49.760 --> 01:51:07.280
based on modification. Um, the first one is a class 2 full-size pickup truck, but it has uh equipment mounted and installed in the open bed area that would disqualify it uh due to the boom lift. And then the one below that, also

384
01:51:07.280 --> 01:51:24.159
a class 2 pickup truck chassis that's been upfitted with a service bed and uh various equipment uh mounted in the rear of that vehicle. So again, the vehicle weight rating class would be okay if the

385
01:51:24.159 --> 01:51:43.520
vehicle had not been modified. In this scenario, because it is modified, it would not be allowed to occupy your neighbor's driveway. Uh, this one disqualifies. The first one here is disqualified based on class rating. That would be the equivalent of

386
01:51:43.520 --> 01:52:00.639
uh an F450 or a 4500 series or a larger flatbed work truck, it would not be allowed. It's simply too big of a vehicle. The one below that, had it not been fully modified, it may be eligible for

387
01:52:00.639 --> 01:52:20.800
an exception. However, the commercial modification here uh of the uh wraparound racks has disqualified it from that exception. The top truck here actually does qualify for that exception. It has not been

388
01:52:20.800 --> 01:52:37.280
upfitted with a service bed. It has not been upfitted with a boom, a crane, or anything of that nature. Therefore, when you look at it, you clearly see a large vehicle, but it's not completely converted into an obvious

389
01:52:37.280 --> 01:52:53.199
work truck. Um, it's a vehicle that, you know, you or I may drive, even though we have a a liking for a large pickup truck, because it's not upfitted with some of these other restrictions, it would be allowed to sit in your neighbor's driveway.

390
01:52:53.199 --> 01:53:10.639
The one below that is a very similar chassis body size. However, it has been upfitted. It does not qualify for the class 3 exception. And for that reason, um it would not uh be allowed to be to

391
01:53:10.639 --> 01:53:28.560
be parked in your neighbor's driveway. None of these would be allowed to be parked in your neighbor's driveway. um food truck, box truck, and again keep in mind box trucks come in all shapes and sizes. Um step vans, panel trucks, and things of that nature. So these

392
01:53:28.560 --> 01:53:47.040
would all be uh considered a violation under the amendment. And with that, I thank you for your time and consideration of this. Um, I would uh re I would like to ask that uh council consider approving this tonight

393
01:53:47.040 --> 01:54:04.760
on its first reading and if approved, it will be brought back for a second reading on Monday, August 17th. And with that, I will be happy to entertain any questions you may have. >> Thank you, Mr. Paulie. Are there members of the public who wish to comment on this item?

394
01:54:05.040 --> 01:54:21.280
>> Council member questions. We'll start at this end this time. Council member, >> thank you, Mr. I know this was you had to digest and recalculate and recalibrate everything that we had in in in the in the uh uh the regulations.

395
01:54:21.280 --> 01:54:39.119
Now this you you put in there that it's got to be motorized. So any trailers that are being hauled by any any of these vehicles excluded. Correct. any the exceptions >> yes >> are based on motorized vehicle the

396
01:54:39.119 --> 01:54:58.320
trailers are disqualified based on the commercial use. >> Okay. All right. So the next question to that is what is going to be the enforcement policy or the enforcement procedure? >> As I said we uh we worked on this

397
01:54:58.320 --> 01:55:14.159
together and I'd like to invite Mr. Shanks up to talk about enforcement. >> Good evening. Uh the enforcement procedure would be just like it is right now. Um well, like it like it will be shortly uh now that we've adopted citations. So, it's going to be just

398
01:55:14.159 --> 01:55:29.840
like that. We would go with a courtesy notice. We would uh move forward with notice of violation and then escalate from there. Um yeah, that's it. >> It'll be so as spelled out earlier tonight, it's going to be >> correct. Okay. All right. That's all I

399
01:55:29.840 --> 01:55:46.880
have. Any questions? >> I do. Yeah. Um, so from your understanding, um, what is the legislative intent behind this ordinance? Um, specifically, I'm trying

400
01:55:46.880 --> 01:56:02.800
to figure out is the intent to allow more commercial activity or is it to allow less? because it seems to be moving in cross purposes and I'll I'll get to that. >> It addresses two concern, three

401
01:56:02.800 --> 01:56:20.719
concerns. Um, one is ambiguity within the existing code that in some cases is very difficult to enforce. And again, I'm not the enforcement guy, but I've worked with Mr. Shanks on this all the way through.

402
01:56:20.719 --> 01:56:36.880
As far as the actual allowances for vehicles, it actually lightens uh the rains a little bit, loosens the resins a little bit. Um but I think it does it in a way that best serves our community. Um

403
01:56:36.880 --> 01:56:53.040
in today's world a u there are many people that drive a company car home and that company car may say ABC company clearly right on the side and it may be registered to the company under a

404
01:56:53.040 --> 01:57:10.239
current existing language that is a commercial vehicle under this provision. It loosens the resins and allows that vehicle provided it meets these other standards to exist in your neighbor's driveway. So, it actually does both.

405
01:57:10.239 --> 01:57:24.560
>> I mean, I completely agree about the existing statute being uh difficult and this is a big step forward. It's a lot clearer. Um that being said, um

406
01:57:24.560 --> 01:57:40.000
removing the issue with stickered vehicles, that seems completely fine. But on the other hand, what we have here in section D2 is that any modification of the vehicle will

407
01:57:40.000 --> 01:57:57.040
render it uh impermissible. But on the other hand, we're allowing much heavier vehicles from what my reading is. I mean admittedly the old statute at 1 ton is almost like prohibiting a corolla right so I don't know if that is the benchmark

408
01:57:57.040 --> 01:58:12.639
but then going all the way up to 14,000 pounds uh that is a big leap so we have a situation where we're going to have two commercial I'll get to the question in a minute I'm sorry we're we have a situation where we're going to get to two commercial vehicles

409
01:58:12.639 --> 01:58:28.639
but they cannot be modified but they can be really heavy and they can have a company marking So, I'm envisioning a situation where we have a typical tradey who has like an F-150 and they've modified it in the back a little bit so that they can mount

410
01:58:28.639 --> 01:58:45.520
up some of their tools and that is not allowed. But you can have a Ram 3500 twice in your driveway. And I'd like to know what you think about that. the addition of um a toolbox in the back

411
01:58:45.520 --> 01:59:03.040
of the truck would not disqualify it. Um the we're talking about um service beds and things of that nature. We're talking about significant modifications. Um, at the end of the day, uh, some of the basic logic that went into this was

412
01:59:03.040 --> 01:59:17.440
if you if you look at your neighbor's driveway and you see a big pickup truck and it looks like a big pickup truck, that's a personally owned maybe he's a small business owner. Maybe he's got his handyman business on the side, but it's

413
01:59:17.440 --> 01:59:34.960
not um obtrusive with this heavy equipment, this these boom lifts, these bucket lifts, and these other devices uh than just a toolbox mounted in the back. I think most people would absolutely have

414
01:59:34.960 --> 01:59:51.360
no issue with that whatsoever. Um, but when you get into these much heavier uh commercial type upfits and upgrades is when that that vision of my neighbor's big pickup truck versus, oh, now we've got a huge work truck next door. There's

415
01:59:51.360 --> 02:00:08.159
a there's a transition that happens there. And the idea here is to allow people who drive a larger vehicle. Could I could I bring the slide back up, Brian, please? someone who drives the the bottom right

416
02:00:08.159 --> 02:00:24.159
vehicle that is just so everyone understands that's not a margin vehicle that is absolutely at the top end of the class 3 scale. So you absolutely would not see something heavier or larger than something similar to what you have on

417
02:00:24.159 --> 02:00:41.040
screen now. Um and many people have those in their driveways already. They have them in their drive. People drive large trucks. Um, but the idea is is that we're not disqualifying it just at that class. Now, if you go above that class, we

418
02:00:41.040 --> 02:00:57.760
would disqualify it, but just at that class, we're not disqualifying it. But if you take that and upfit that to a commercial upfitting with a service bed or some other type of uh rig or boom or

419
02:00:57.760 --> 02:01:15.119
crane, then that would disqualify it. I mean, I I think I find your vision pretty coherent, but I'm just not seeing it in the statute, and that's my issue because if you look at D2, it says or

420
02:01:15.119 --> 02:01:29.599
other service equipment mounted to the exterior or open bed of the vehicle. So, I mean, that would include a toolbox if we're reading it as it's written, >> wouldn't it? Well, I think if you if you

421
02:01:29.599 --> 02:01:45.520
default back to um the general prohibitions where it talks about uh the disqualifying uh items, I think you get a better feel for what we're talking about there. We're talking about the, you know, the large commercial uh racks,

422
02:01:45.520 --> 02:02:02.000
the service beds, other service equipment that's mounted. Um this is not either through my interpretation or Mr. Shanks interpretation is is intended to disqualify a vehicle based on a toolbox. >> Sure. >> It's it's just simply not

423
02:02:02.000 --> 02:02:18.560
>> right. But if if you have like a typical modification to the back to the truck bed where you have like a mount for a couple of weed whackers or something like that, you're immediately in it. Even if it's a smaller vehicle. >> Um

424
02:02:18.560 --> 02:02:36.239
okay. Uh so my other question is why two, why not one? Um, I'll have to defer to Mr. Shanks again because that actually was his input. Okay. U, it has to do with enforcability. Uh, he asked the question about why two and not one.

425
02:02:36.239 --> 02:02:52.560
>> So, we have, uh, residents right now, um, that have two large vehicles. Uh, they can maneuver them through their driveway, they can move them around. Uh, one, I mean, we I don't I don't think

426
02:02:52.560 --> 02:03:09.440
it's it would be fair to tell somebody they can't have a a a another vehicle. Like, I like Jeeps, you know? Um, I would love for my wife to have a Jeep. She doesn't want one. But if I drove an F250 and she wanted a big truck, too, she should be able to have one, right? Especially if it fits in my driveway.

427
02:03:09.440 --> 02:03:23.440
Now, if it doesn't fit in my driveway and I have to keep that somewhere else, like let's say I have a boat, you know, I I can't keep a boat in my driveway. I can't keep one on the road either. Um, we have to we have to draw the line somewhere. So, two would fit a family

428
02:03:23.440 --> 02:03:41.840
pretty well um within our area given that the neighborhoods that we have in the um the types of vehicles that we already have existing um in Temple Terrace. Um I think one might just be a little overkill. >> Okay. So, I hear you. And I I did look

429
02:03:41.840 --> 02:03:57.360
up whether there is actually a chassis size difference between like an F250 and an F350. And apparently, unless you have the F350 with the four wheels in the back, the chassis are the same, but if you

430
02:03:57.360 --> 02:04:13.840
have the one with the four wheels in the back, that one is wider. Um, and we all know that the roads in Temple Terrace are not the world's biggest, widest roads. So, is there going to be a requirement that these very large

431
02:04:13.840 --> 02:04:30.880
vehicles are off street parking? >> As of right now, I don't believe that's going to be the case >> there. It's not in the code, but no, >> street parking would be permitted only where street parking is permitted, >> right? And and and that's that's as as things are right now. Uh

432
02:04:30.880 --> 02:04:47.360
uh to my point earlier that we already have vehicles like that now. Um we have a few neighborhoods that are very very small. Parking is very very tight and these vehicles uh are conducive to that neighborhood. Um but it does take cooperation obviously from neighbors

433
02:04:47.360 --> 02:05:02.960
getting along. Um and uh we we've had one or two instances where we had to get involved and figure figure that out and we've we've been able to. Um, but you know, people like big vehicles and they should be able to have them. Uh, they

434
02:05:02.960 --> 02:05:17.360
just shouldn't have too many of them on site. Nobody's saying they can't have four, but if you want to have two of them at home, great. The other two probably need to go to a storage just like a boat. >> Okay, but hear me out. >> Okay, >> if they're parked on the street, they're

435
02:05:17.360 --> 02:05:34.480
not strictly on site, are they? >> Well, they're still at at the property. They're still at the residence. >> Okay. Well, so when you and your wife have parked your extra wide F350s in the road, I'll know

436
02:05:34.480 --> 02:06:09.760
who to complain to, right? Okay, I yield. Pardon the rhetoric. >> Understand? >> Yes. >> May May I respond to that, please? Um, the the the way the code is written specifically is per lot. So, if it's not

437
02:06:09.760 --> 02:06:27.239
if it's not if it's street parking, then it's already causing an issue because this requires that they be uh within the lot. >> Where's that? >> I'm looking at the

438
02:06:29.599 --> 02:06:46.880
section D2 talking about per lot. Okay. But there's no Yeah, that just says that it's permissible if it's on the lot, but there's nothing prohibiting it from being on the street. You can park. >> Okay, I see your point. >> Yeah, it's allowed. You can park your vehicle on the street,

439
02:06:46.880 --> 02:07:01.679
>> right? I mean, >> correct. >> Okay. >> I think they still might get a visit. >> We we would pay a visit if if if there was an obstruction. Um >> regular traffic laws, you have to park so far away from the uh the side of the, you know, within 12 inches of the curb

440
02:07:01.679 --> 02:07:17.440
facing the right direction. Um and other vehicles just like any other parking area are going to have to position themselves so they're you know safety vehicles can get through. Uh we we do address those situations now um with large and small vehicles um very very

441
02:07:17.440 --> 02:07:34.920
seldom u but if they are parked in the street they they're going to have to position themselves where they're not going to interfere with other vehicles and they typically don't because those vehicles are very expensive and they don't want to get hit or scratched. Most of the time we do see them in the driveways.

442
02:07:36.000 --> 02:07:53.040
>> Mr. Mayor, may >> city manager. >> Thank you. Just one thing the city attorney and I just were just noticing here there is a provision in the ordinance that's up for your review. Uh 12-922 subsection C

443
02:07:53.040 --> 02:08:07.280
uh where it does state general prohibition aside from approved exceptions included in this section. And the following vehicles are prohibited from parking in any residential zoning district and it says street or lot. So they would be in effect prohibited also on the street. I also checked with with

444
02:08:07.280 --> 02:08:23.920
Chief Staley um that if you had a a vehicle now you could have a large vehicle parked on the street but if it impedes the circulation of traffic it would the officer not police officer driving by could deem it to be in violation. not because of this, but just because of other traffic laws and could

445
02:08:23.920 --> 02:08:39.119
ticket the the vehicle or have the vehicle towed, for example, if it if you couldn't get a an ambulance down the street because of this vehicle was so wide or just parked in such a way that it was not allowing cars to travel freely. U so there there's some controls there as well.

446
02:08:39.119 --> 02:08:55.199
>> I real briefly just like if if it's a street legal vehicle, it's probably hard to argue that it's blocking traffic in that way because otherwise it wouldn't be street legal, I would imagine. And then the other thing is, you know, the C section that you cited here, street or lot agreed, but then the same exceptions in D apply. So it's still permissible to

447
02:08:55.199 --> 02:09:11.199
park it on the street as as as it is on the lot. So there's no there's no stricter rule for the street is all I'm saying from what I can tell. >> So you're correct. Yeah. Okay, that's all I yield. >> Commissioner, thank you. Um, and this

448
02:09:11.199 --> 02:09:26.560
isn't an I got you, but it's a question. So in your ordinance you uh specify commercial trailers. So a open yard trailer with mowers and use for a business to mow yards. That's not allowed. >> It's not allowed. >> What if it's the same trailer with a a

449
02:09:26.560 --> 02:09:44.239
man's son's go-kart for use for a hobby? >> I believe that would be allowed if it's not used for commercial purposes. >> Again, >> what's that a difference in a boat other than it's in the uh ordinance? I'm sorry. What was the question?

450
02:09:44.239 --> 02:09:59.920
>> A a yard trailer with mowers is not allowed. What about a yard trailer with a go-kart used as a hobby? >> Correct. A utility trailer is what we refer that to. Um utility trailers are allowed. They just have to be stored um on the side of the home in the rear of

451
02:09:59.920 --> 02:10:17.440
the home, not closer than 5t from the the the edge. >> So, your commercial trailer with your mowers could not be in your side or sideyard. >> Correct. Okay, that's the difference between commercial and and yes, hobby. >> Okay, thank you

452
02:10:17.440 --> 02:10:34.560
Fernandez. >> No, >> I don't really have any questions. I have comments, but no questions. Are we any other questions? Council member. >> Okay, if there are no further questions, I will close the public hearing and ask the clerk to read the title of the

453
02:10:34.560 --> 02:10:54.079
ordinance. An ordinance of the city of Temple Terrace, Florida, amending the Temple Terrace Land Development Code as amended by amending sections 12-40 definitions 12-922 commercial vehicle restrictions

454
02:10:54.079 --> 02:11:09.520
in residential districts, providing for cottification, providing for severability, providing for correction of typographical errors, repealing all ordinances or parts of ordinances, in conflict here with providing an

455
02:11:09.520 --> 02:11:24.880
effective date. >> Thank you, Madame Clerk. Is there a motion, councelor? >> Oh, go ahead. >> Oh, okay. Um, move to approve on first reading of an ordinance amending land development code sections 12-40

456
02:11:24.880 --> 02:11:41.280
definitions and 12-922 commercial vehicle uh registrations uh restrictions in residential districts. Uh and the second reading to be on August 17th meeting. >> Second. >> Motion second. Discussion of the motion.

457
02:11:41.280 --> 02:11:59.360
Council member Kravitz. I'm very split on this because it does clean up the previous ordinance. I think that's a good step forward. I like the schedule where it shows all of the different weight classifications. where I think it does go too far is um

458
02:11:59.360 --> 02:12:16.239
allowing these vehicles which can be enormous to be parked uh on the street. So I think of all the things that I've heard today that is the one that I think has the most potential for trouble because also then you don't know who they belong to.

459
02:12:16.239 --> 02:12:33.920
So you might not know that someone has more than two. Um, I hear the point raised by uh, Director Shanks about how some families might need two extremely large trucks plus a third vehicle. Uh, I it's, you

460
02:12:33.920 --> 02:12:51.760
know, anything is possible. Um, and I also think I was much less favorable toward extending this to class 3 before I looked into class 3 vehicles. And it does turn out that most of them are roughly the similar size except again for the extra wide ones.

461
02:12:51.760 --> 02:13:08.719
So personally I would like to amend this. I'm not to to adjust this statute so that it will require the people who have these commercial vehicles to park them on their own property rather than using

462
02:13:08.719 --> 02:13:25.199
city-owned property to park the vehicles on. So that that is something I think would be a really positive change here because otherwise we're offering up our streets to these very heavy vehicles. Um they're going to be making traffic difficult to navigate. The roads are already tight. Um if people want to have

463
02:13:25.199 --> 02:13:43.520
vehicles like that, why not require them to put them on their property so that other people are not affected by it quite as much? That would be my ask. Does anyone have any thoughts on that? I I do since you asked. Um

464
02:13:43.520 --> 02:13:58.960
F350s, the doulies or equivalent to F350s, but the doulies are allowed now. >> Yeah. >> These aren't this isn't something that we're like after this passes they're going to be allowed. They're allowed now. Y

465
02:13:58.960 --> 02:14:16.800
>> if this street parking was a significant problem that wasn't being addressed by state statute which already regulates blocking of traffic and obstructing I think somebody should have told us that that that's a problem but I mean um

466
02:14:16.800 --> 02:14:35.280
this isn't I I would I probably be sympathetic to this if we were loosening up things to allow doulies that weren't currently allowed, then I would I would say, "Yeah, that could be a problem. Maybe we should look at that." But this

467
02:14:35.280 --> 02:14:53.040
isn't loosening up any restrictions that don't already. This is the current status that's been this way forever. So, um I think if it could it become a problem? Yes. If it does, um, I think

468
02:14:53.040 --> 02:15:08.320
somebody should bring it to our attention that, hey, we're having, it would be the police would be the ones enforcing that and they would say, okay, we need to do something because we have these duelies parking on the street and they're blocking garbage trucks or fire trucks or whatever the case may be. Um,

469
02:15:08.320 --> 02:15:23.440
I I would be open to that if the problem manifest itself, but we're not changing we're not loosening the restrictions on the doulies now. So that would be my two cents on that. But you still haven't

470
02:15:23.440 --> 02:15:40.000
>> Yeah, I I agree with that. Uh the only part where I think we might be loosening it is um previously if you had a commercial vehicle that had branding on it, for example, like if a fleet it's a fleet vehicle essentially, you could have a situation where you have multiple fleet vehicles now on the road. Um that

471
02:15:40.000 --> 02:15:55.199
is where it's being loosened from my perspective. I I agree with everything else that you said. Yeah, I I >> I don't want to take my turn coming. >> Yeah, go ahead. I >> I don't I don't Yes. What you're saying could

472
02:15:55.199 --> 02:16:10.560
potentially become a problem and I think if it does, we need to look at some of that. If that if that comes out, and it could, then I think we need to go back and take a look. Um yeah. Anyway, I I don't want to jump on my term. No, city manager,

473
02:16:10.560 --> 02:16:26.400
>> I apologize for interjecting here, but we're we're still trying to talk. I think I think there may be a clause in here that addresses your concern, Council Member Kravis, and you could read it obviously, and if you think differently, let me know. Um, so under uh section 92-922

474
02:16:26.400 --> 02:16:43.359
again going subsection D. Uh, and if you go to subsection D, basically, it says exceptions, parking a commercial vehicle in a residential zoning district lot is permitted pursuant to the following exceptions. And if you go to D2, it says that the exception would be

475
02:16:43.359 --> 02:16:59.679
commercial vehicle is a class 3 pickup truck or cargo van parked on a lot within a residential zoning district and is not modified with equipment racks, service beds, or other service equipment mounted to the exterior open bed area. Only two such class 3 vehicles per lot are permitted. So, we're just reading

476
02:16:59.679 --> 02:17:16.240
that as doesn't say street. So, in this case, it would be the requirement be that they have to be on the lot. Um, I'm not sure if that satisfies your concern, but that that would seem to kind of point in that direction. >> It's not it's interesting because it's it's more

477
02:17:16.240 --> 02:17:34.000
specific than the D. The D says you have these exceptions that apply to the street or the lot. And then in subsection two, it narrows it to on a lot. So then I guess you have a little bit of a contradiction there, but maybe it's just a more specific statute. So I I wonder how that would be applied in

478
02:17:34.000 --> 02:17:51.200
this case. Yeah, I yield. Yeah. Um, vice mayor comments. So, I'm comfortable with the way it's written because right now if it's a even if it's a Ford Escort or a big truck if there's

479
02:17:51.200 --> 02:18:10.319
uh any reason to u impede a garbage truck or firet truck or any of that, we have laws in that. So, that can be addressed now. So, that's just my opinion. comments. >> I I do have one. I have something that I

480
02:18:10.319 --> 02:18:27.280
although I share some of Council Member Kravitz's concerns that may manifest, but I I do have a concern. I don't This is not enough of a concern for me to vote no on this. We've come so far on this and this has been a sticky one. I

481
02:18:27.280 --> 02:18:41.599
mean this has been a year and a half since we had our workshop and I'm happy to get where we are but I do want to keep an eye on this and that is only two such class three vehicles per lot are

482
02:18:41.599 --> 02:18:58.479
permitted. Now if you got dies, okay, but we have some lots in Tumble Terrace in the neighborhood I live in. We have big lots. I mean we have some people have driveways you can fit 15 cars in their driveway. I mean, they're big.

483
02:18:58.479 --> 02:19:15.920
F-250s are class 3 vehicles. F-250s are a common family car these days. There's people have F250s all over the place that don't use them for commercial purposes. They jack them up. They look cool. They drive around. I mean, F250s are everywhere. I challenge you to go

484
02:19:15.920 --> 02:19:32.479
out to Publix and you count three of them in there at any given time. They're they're a very here's my college word, a ubiquitous, right? vehicle. And to say you can only have two of these seems a little

485
02:19:32.479 --> 02:19:49.200
arbitrary. Um, suppose that I drive a 3/4 what used to be a 3/4 ton truck, which I did. Suppose that my wife has one, too, and then my son has one. If they fit in the driveway,

486
02:19:49.200 --> 02:20:05.760
what's the big difference? If somebody's got an F-150, they can have four of them. But if they have an F250, they're only allowed two. It seems like there would be a better way to get at what we're trying to get at. Okay, if you have X number of them or you don't have a

487
02:20:05.760 --> 02:20:22.399
place to park them, like I think that's kind of what where Council Member Kravitz's logic is going. And I tend to agree with that track. It just seems a little arbitrary and I can't I'm not real comfortable with I'm not like I said not enough to scrap the

488
02:20:22.399 --> 02:20:36.080
whole ordinance, but I'm going to keep an eye on that one because if if we start see and I don't know, maybe there's nobody in the city that's got three F250s. It could be. But if we start seeing this,

489
02:20:36.080 --> 02:20:52.479
I I think we might need to tweak this in that area. Um because I mean we start citing people because they've got three F250s and they're all fitting in their driveway. I don't know what we're doing to the public. I mean what are we gaining for

490
02:20:52.479 --> 02:21:06.960
the greater good here? That doesn't make any sense to me. So anyway, I think you get the point, but okay. Other comments on the motion? Council member, did you have something? I mean, I I think it would not be unreasonable to say you have a higher limit if you park them on

491
02:21:06.960 --> 02:21:22.319
your lot and then we remove the ability to park them on the road. >> Yeah. But I I would I don't want to do that because this thing's been through a year and a half to through the planning commission to get I don't want to have to start this all over again and go back to the

492
02:21:22.319 --> 02:21:36.880
planning commission. This is this is taking I mean, if these problems manifest, then I'd say, yeah, we need to to do something. But um I don't want to in my mind anyway, I don't know what your feelings are, but I don't want perfection to stand in the

493
02:21:36.880 --> 02:21:55.040
way of good. And I is it perfect? No. There's probably another area too that I could talk about, but I think it's a good example of letting perfect stand in the way of good in my mind. >> Okay, ready to vote?

494
02:21:55.040 --> 02:22:11.200
>> All those in favor say I. >> I opposed. No nays. The ordinance is approved on first reading a Manning. Uh I don't have to say all that. And will appear for second public hearing and second reading on Monday, August the 17th. Okay. Very

495
02:22:11.200 --> 02:22:27.280
good. Next item. Public hearing and first reading of we ready to you want to push through or do you guys want a fivem minute break? This seems a place to take a break unless you want to push through. I'm good. >> We're good.

496
02:22:27.280 --> 02:22:44.080
>> Okay. Okay, we're keep going. They want a break. They're leaving us. Public hearing and first reading of an ordinance amending code section 12-834 drainage systems. I'll open the public hearing. Public works director Jason Warren Felds has got his tie on. This is

497
02:22:44.080 --> 02:23:07.359
going to be expensive and he is here to present. >> Asking for a time >> tonight throwing you off. >> No money. All right. Mayor, council members before you denies proposed amendments to section 12834 of the land development

498
02:23:07.359 --> 02:23:24.080
code regarding drainage systems. Over the years, staff have reviewed numerous development applications and drainage reports. During those reviews, we found that while the existing code provides general requirements, it lacks many of the engineering details now that is now considered standard practice. These

499
02:23:24.080 --> 02:23:39.359
revisions do not fundamentally change our stormwater policy. Instead, they clarify expectations for design professionals and strengthen the tech technical requirements needed to demonstrate that proposed systems will perform as intended.

500
02:23:39.359 --> 02:23:59.439
And let's see here. So the key code revisions are requires basin maps, flow paths, dynamic modeling and clarified rainfall data. Clarifies design storms, FDOT street capacity plan details and conflict manhole assurances.

501
02:23:59.439 --> 02:24:15.359
It establishes utility separation, pipe materials and roadway separation, outfall, flood plane, pond recovery and infiltration and under drain requirements. In summary, revisions turn common engineering expectations into code requirements. The amendment improves

502
02:24:15.359 --> 02:24:31.439
consistency during design review and construction. These updates strengthen reasonable assurance for storm water performance and protection from the public infrastructure for the public infrastructure. Um, all right. These proposed amendments have been reviewed and approved by Hillsboro County Planning Commission. Uh

503
02:24:31.439 --> 02:24:47.680
ultimately these pro revisions provide greater confidence that new development will properly manage storm water, help keep water within a roadway drainage system and better protect both public and private infrastructure and adjacent properties. Staff recommends approval of the ordinance on first reading and

504
02:24:47.680 --> 02:25:02.640
scheduling the second reading as presented. >> Thank you, Mr. Warren Felts. Are there members of the public who wish to comment on this item? Council members questions. We'll start down at this side. Council member Fernandez. So, just to for the

505
02:25:02.640 --> 02:25:20.240
information of the the watching public, this it what you we're doing with this amendment is clarifying what somebody who's going to propose a building or a development needs to present as part of their documents for city for permitting

506
02:25:20.240 --> 02:25:35.920
and um review of their project. >> Correct. Yeah. It's it's to enhance our standards. This will enhance our code standards for engineering to review them to meet the current guidelines that we use. We just don't have it codified in the code.

507
02:25:35.920 --> 02:25:50.240
>> Okay. So, um, this is this is if somebody wants to build a project or develop a an undeveloped property or or even redevelop a property, they already are required to show how they're going

508
02:25:50.240 --> 02:26:07.920
to handle um either retaining or the um treatment or just how they're going to handle all the storm water that's going to hit that property. But because this is a lot more detailed about what they need to turn in than they've previously

509
02:26:07.920 --> 02:26:23.920
been doing. >> Correct. >> Is this consistent with what other jurisdictions are also requiring now? >> So we currently use neighboring jurisdictions as a model, but we do not have it in our code as clear as it is presented. >> Okay. And this doesn't necessarily

510
02:26:23.920 --> 02:26:40.880
change what a developer would need to do or somebody who's building would need to do because they are required to do the engineering to show how they would handle storm water. Is that correct? >> Correct. This gives us a greater leverage because it'll be codified in

511
02:26:40.880 --> 02:26:57.280
our code to apply them evenly as we would do the reviews. >> All right. Thank you, >> Vice Mayor. All right. Council member SH. So the thought process and the analysis that went into making these changes, this was

512
02:26:57.280 --> 02:27:13.040
based upon cannibalizing other jurisdictions what they've done or was this or did we set about and say okay engineering what have you done? What what what needs to be done? um what what level of detail did we utilize in in

513
02:27:13.040 --> 02:27:30.000
developing this going forward beyond the uh the the the uh planning commission the the >> So it's it's the current common guidelines and practices is what was the main driver plus our neighbors around us are utilizing the same standards we just did not have it again codified in our

514
02:27:30.000 --> 02:27:44.479
ordinances to make it applicable as strong as we need it to be. Okay >> member Kitz. >> Hi thanks just a couple questions. One of them is um uh there's a Florida state statute now that states any work under

515
02:27:44.479 --> 02:28:02.080
$7,500 is permit free. Um this is really broadly written. So I'm wondering if there is sort of like minor driveway work that's being done. Is this now we're going to require a permit from the homeowner? >> Is that for the next one or is that for the storm water one?

516
02:28:02.080 --> 02:28:19.600
>> Um oh that's the general item. Sorry. Um that is for the next one. I do apologize. Yeah, sorry about that. I got a little bit ahead of myself. Thank you very much. I withdraw the question. I have no further questions. Thank you. >> No other no other question. >> No, wrong wrong item. Pardon. >> Real quick, what was the genesis of

517
02:28:19.600 --> 02:28:36.080
this? Is this a proactive thing? Did something come our way to cause us to do this or would did this happen proactively in our staff? >> Yes. So this is and and as it's you know known our engineering team has evolved

518
02:28:36.080 --> 02:28:52.800
and this is you know seeing what the challenges were getting up to where we're at and then knowing that what's coming down the road. So it's a little bit of both. We've seen some challenges. We've had some you there's been meetings where sta or residents are concerned about storm water runoff and how we apply the standards and what we're doing

519
02:28:52.800 --> 02:29:10.399
to prevent you know issues. Well, this helps us when we go to those conversations and to those meetings say these are our codes now. This is the guidelines we're following. These are the expectations we want you to follow. So, >> okay, >> it it's a little of both. >> Thank you. >> Any other questions?

520
02:29:10.399 --> 02:29:28.080
>> Not I'll close the public hearing and ask the clerk to read the title of the ordinance. An ordinance of the city of Temple Terrace, Florida, amending section 12-834 of the city code of ordinances providing for clarification of standards for

521
02:29:28.080 --> 02:29:43.680
drainage systems. Revising the text to ensure adequate storm water collection, conveyance, and long-term performance within the roadway system. Strengthening technical subtle requirements.

522
02:29:43.680 --> 02:30:02.560
clarifying basin mapping and dynamic modeling standards, establishing storm sewer design criteria, requiring minimum roadway to water table separation, and specifying use of a FO type two under

523
02:30:02.560 --> 02:30:18.399
drain where applicable providing for severability. Providing for conflict, providing for the correction of scrier's errors, providing for cotification, providing for an effective date. >> Thank you, Madam Clerk. Council, is there a motion

524
02:30:18.399 --> 02:30:35.040
>> move to approve ordinance first reading amending code section 12-834 drainage systems and schedule second public hearing and second reading for August 17, 2026. >> Second. >> I heard council member Fernandez, I think, beat you in there. So we have a

525
02:30:35.040 --> 02:30:50.240
motion second >> discussion of the motion. >> Um I just have one brief comment. Um good work and I see our city engineers here. Um good work. I say we constant

526
02:30:50.240 --> 02:31:06.960
constant improvement here and this is a good example. Actually these last two hearings have both involved cleaning up ordinances and better defining things. And so, um, this is not exciting stuff. I read this and I actually understood a

527
02:31:06.960 --> 02:31:23.520
little bit of it, but, um, none of this is exciting stuff, but this is really good government in action. So, thank you very much. So, all those in favor say I. >> I. >> I. Opposed? No. Nays. Motion is approved on first reading and will appear for second reading and public hearing on

528
02:31:23.520 --> 02:31:40.399
Monday, August 17th, 2026. Next item is a public hearing and first reading of an ordinance amending code sections 12-921 driveway regulations. I'll open the public hearing and our public works director Jason Warrenfield will also

529
02:31:40.399 --> 02:31:56.720
present this. Thank you mayor city council. Uh before you are the proposed amendments to section 12 921 regarding off streetet parking and driveway regulations. Again, during the review of rideway permit applications and field inspections, staff identified several

530
02:31:56.720 --> 02:32:15.280
areas where the code current code lacks sufficient detail. This has resulted in inconsistent driveway designs, inspection issues, and avoidable drainage concerns. The key code revisions for this, it sets driveway apron design standards including slope and minimum elevation

531
02:32:15.280 --> 02:32:31.760
above payment. It clarifies driveway with culde-sac allowances and how nonconformities are handled. It requires utility notifications, ADA compliance inspections, and a removal of true routes before construction. It also adds standards for pavers, site distance, and

532
02:32:31.760 --> 02:32:50.560
adopts the Hillsboro County Driveway detail. The ordinance also adopts established as mentioned there the Hillsbor County driveway detail as a reference providing contractors with proven familiar design standards. These revisions are not intend are intended to improve

533
02:32:50.560 --> 02:33:06.800
consistency, simplify the permanent process, re produce safer driveways and reduce future maintenance concerns while providing clear expectations to both homeowners and contractors. These proposed amendments have also been reviewed and approved by the Hillsboro County Planning Commission.

534
02:33:06.800 --> 02:33:24.080
Additionally, there's uh for the council, there was an error found on the financial impact statement for this agenda item prior to tonight's meeting. The ordinance listed on the financial impact statement is the amended revisions to the previous um

535
02:33:24.080 --> 02:33:40.640
amendments for 12834 and not 12921. This error will be corrected for the second reading on the financial impact statement. Staff recommends approval on the first reading and the second reading as presented. Thank you. We'll go to public comment.

536
02:33:40.640 --> 02:33:58.720
Mr. Mueller, is the impact statement correction and single reading at the second reading? Is that legally adequate? >> Never run into this. Um >> well, you'll tell us if it's not by second reading. Yes, I certainly will.

537
02:33:58.720 --> 02:34:15.359
Um I I I think we can move forward with first reading and making sure it's corrected by second reading. >> Okay. Are there members of the public who wish to comment on this item? >> Council member questions. Council member Kravitz, I know you have one at least.

538
02:34:15.359 --> 02:34:31.439
>> I did. I a couple. Um All right. I I'll start with the So this is going to capture all driveway work. No dimminimous like I know that I mentioned the $7,500 exemption state of Florida. Um I'm just imagining a situation where

539
02:34:31.439 --> 02:34:48.399
you know someone wants to just patch up their driveway or do a little extra work there and even it out or whatnot and then they have to go and get a permit and all these other requirements. Is that is that the intention? >> So this sets the standards for what they're going to do. The land the land use and the land um land use changes

540
02:34:48.399 --> 02:35:04.640
will still have to go through the permitting department and through community development. So this just allows for the development standards so that we can simplify the the driveway areas where it's being applied. >> Okay. So this is this is not um this is

541
02:35:04.640 --> 02:35:19.920
going to govern construction standards for the work that's being done. This is not going to create a requirement to get a permit. >> No. So the permits are still going to be required because the work still has to be it still has to be inspected and all the land use still has to run through

542
02:35:19.920 --> 02:35:36.479
community development. So, this is just standards for proposed and and um replacements and it also adds for, you know, it includes our PA waiverss, it includes line of sight issues, it just brings us up to the current guidelines that we're that we should be following.

543
02:35:36.479 --> 02:35:53.200
>> Okay. So, um maybe I'm going a little too far in my own head. So, if it's a a new driveway or a replacement, that means you're taking the old driveway completely out and putting a new one in. It doesn't mean that you're fixing one that exists already. So there would be it would it would

544
02:35:53.200 --> 02:36:10.160
depend on what quantity of the work is going to be done. So if you're saying patch of crack and there's not going to be a land there's there's not a change in the area of coverage there. Um if you're replacing a concrete driveway with pavers then yes this will fall under that scenario.

545
02:36:10.160 --> 02:36:25.520
>> Okay but what if what if I mean classic situation like let's say you've got a cracked slab. So you remove that slab and you pour it new right where where it is. So and it's not the whole driveway. >> It would fall under this. >> Okay. And so now now they're like

546
02:36:25.520 --> 02:36:40.240
excavating their driveway and taking the tree roots out and all that. I mean >> correct. Yes. And we've had those recently where there's been a small inconsistency in the driveway elevation creating a trip hazard on the public rightway side. So in that work, it required them to remove more of their

547
02:36:40.240 --> 02:36:56.960
driveway, remove the tree roots, and get things to be compliant. >> Kind of like shooting at mosquitoes with pistols here a little bit, but >> a little bit, but it's also it it's it's easier and not easier. It's um it's better for us to enforce a common

548
02:36:56.960 --> 02:37:11.120
practice rather than be individualized for each property. >> Sure, I get that. um this this like six inch depth below the um sub substrate um for the root removal. Was that

549
02:37:11.120 --> 02:37:30.319
discussed at all with the um arborist? >> From my knowledge, I would have to I would have to confirm that and I can do that for the second reading. Just make sure that the arborist is aware of that. Um, but I will tell you that engineering and the streets department, we often have conversations with the arborist on impacts to trees when we're doing

550
02:37:30.319 --> 02:37:45.680
driveways and sidewalks. >> Okay. >> So, for this particular purpose, I can get you that make sure that's clarified on the second reading. >> I can see a scenario where you're basically killing a tree if it's near the driveway, let's say, and then you chop off half of its roots and then it's not going to last.

551
02:37:45.680 --> 02:38:02.880
Um, also last question, there's a exemption in our current code for driveway work under 100 square feet. Um, does this impact that exemption? >> So, that's where I was saying if they if if they're replacing a large portion of

552
02:38:02.880 --> 02:38:19.120
it, that's where this is not a replacement for that. That exemption is still there. This is clarifying the standards for design and the and the significant rehab replacement work. >> Okay. But coming back to the example that you were just discussing with me um where I said let's say that there's a

553
02:38:19.120 --> 02:38:35.920
small cracked slab they replace it. You said in that scenario where where you were involved they did have to do all these new rules but was that more than 100 ft then? Oh okay. Okay. Just making sure. Yep. >> Okay. >> All right. As long as that exemption stays and I'd like to see it move up a little bit. I'm fine with this. But I

554
02:38:35.920 --> 02:38:51.040
think otherwise this is way too much because people have problems with their driveways all the time. making it impossible to fix them is going to be the opposite of what we want. Yeah, >> for sure. And yeah, I completely understand. >> Yeah. All right, that's all my questions. Thank you.

555
02:38:51.040 --> 02:39:07.200
>> I just wanted to confirm the business impact estimate. Uh we can move forward on first reading. It'll just need to be done before second the public hearing and second reading. I'll say we're good. >> Thank you, Council Member Schist. Vice Mayor questions. Council member Fernandez.

556
02:39:07.200 --> 02:39:22.960
>> No. >> Okay. If there are no further questions, I will close the hearing and ask the clerk to read the title of the ordinance. >> An ordinance of the city of Temple Terrace, Florida, amending section 12-921

557
02:39:22.960 --> 02:39:40.479
of the city code of ordinances providing for clarification of standards for off- streetet parking and driveway requirements, revising the text regarding different elements of the installation of driveways. More specifically providing clarification

558
02:39:40.479 --> 02:39:56.319
regarding securing block pavers, sight distance, reducing impacts from tree roots, sidewalk slopes, and the protection of utilities, adopting the Hillsboro County typical detail drawing as a reference, providing for

559
02:39:56.319 --> 02:40:12.479
severability, providing for conflict, providing for the correction of scribers errors, providing for codification, providing for anal Excuse me. An effective date. >> Thank you, Madam Clerk. Council, is

560
02:40:12.479 --> 02:40:28.399
there a motion? >> Yes. Move to approve on first reading of an ordinance amending code section 12-921, driveways regulations uh also modifying the business impact statement uh for the second reading on

561
02:40:28.399 --> 02:40:44.640
August 17th. >> Second. >> Motion to second. Discussion of the motion. If not, all those in favor say I. >> I. >> I. Opposed. No nazs. Ordinance is adopted on first reading and will appear for second reading and public hearing on

562
02:40:44.640 --> 02:41:01.680
Monday, August the 17th, 2026. Next, we have a resolution accepting modification number one to hazard mitigation grant agreements for fire stations one and two uh wind retrofit project. to our fire chief, Ian Kemp,

563
02:41:01.680 --> 02:41:18.560
who has been waiting patiently, is here to explain. >> Good evening, Mayor Council. Ian Kemp, your fire chief. Um, stand before you with a resolution accepting a modification um to our current hazards uh mitigation grant agreement for fire station one and

564
02:41:18.560 --> 02:41:36.080
fire station 2 wind retrofit projects. In May of 2023, the city entered in a hazardous mitigation grant program agreements with the Florida Division of Emergency Management for Wind Retrofit Improvements at Fire Station One and Fire Station 2. The agreements were

565
02:41:36.080 --> 02:41:52.880
accepted by the city council through resolutions number 84-23 and 85-23. Since the time, the city has completed significant wind mitigation improvements at both fire stations, including roof, door, and window hardening design and

566
02:41:52.880 --> 02:42:09.600
strengthen the buildings against future hurricane events. During the implementation of the projects, it became evident that the replacing of the existing appar apparatus doors was necessary to fully harden each facility and bring the entire building envelope

567
02:42:09.600 --> 02:42:25.520
into the compliance with current mitigation standards. The city subsequently requested additional hazard mitigation grant program funding from the Florida Division of Emergency Management to expand this project scope to include installation of such

568
02:42:25.520 --> 02:42:45.600
hurricane rated apparatus bay doors at both fire stations. The modification increases the federal funding for fire station 1 from $251,71728 to $589,24710. And for fire station number two from

569
02:42:45.600 --> 02:43:10.080
224,35 to.84 84 to $515,637 for a combined increase of $628,830 and 98. This modification grant agreement also provides 100% federal funding subreient management costs of

570
02:43:10.080 --> 02:43:35.680
$32,735.95 for fire station number one and $28,646.50 for fire station 2. The city's required non-federal match increases from $52,894.79 to $122,764.90 reflecting the expanded scope of the

571
02:43:35.680 --> 02:43:51.920
work to include replacement of the apparatus bay doors. Uh the federal grant funding will be appropriated from the grants fund um with the crowd local with the required local match funded through the budget adjustment from the community investment

572
02:43:51.920 --> 02:44:07.840
tax reserve account. That's all I have. >> Thank you, Chief. Uh are there members of the public who wish to comment on this item? >> Council member questions to start at this end. Council member Fernandez. So

573
02:44:07.840 --> 02:44:24.240
originally uh we had a grant award from the federal government and the required match. Um has the cost of the work increased? Is that part of why we were able to secure

574
02:44:24.240 --> 02:44:39.520
a higher grant? Like the cost of the materials and >> Yeah. What happened was um when we when I was looking at hardening facilities um we looked at the the doors and the

575
02:44:39.520 --> 02:44:54.880
windows and we needed to do have some extra straps for the for the um the roof. So we had some contractors come in um went out to bid. We received that once we had an architect come by um and

576
02:44:54.880 --> 02:45:10.000
it was actually he was looking at the EOC we're getting ready to build and we're showed him the projects and and everything we were just about complete with fire station one and fire station 2. He looked at our bay doors and said, "Hey, this these bay doors are not hurricane rated." Well, we thought they

577
02:45:10.000 --> 02:45:25.600
were because they were replaced when I first started working here. We replaced them about 20 years ago. Um so I had no idea nor was it caught by anybody else. and he said, "No, these are not hurricane rated. This is your weakest point. You you've done all this work, but now you have these bay doors that

578
02:45:25.600 --> 02:45:41.680
aren't going to accept uh the, you know, wind over probably about 120 mph." So, you know, I I talked to um uh the the the grant the person I was granted uh our grant uh mitigation person. I said,

579
02:45:41.680 --> 02:45:56.479
"Hey, you know, this is what do you think we should She said, "Well, a lot of times we'll just extend this and we could probably give you more money because we really want to make sure that when we we we throw this money at you that we we secure the whole project and that your your whole facility is

580
02:45:56.479 --> 02:46:14.160
strong." So, we we we we got estimates on about approximately what it would cost us and then we asked for that amount and they agreed and they said, "Okay, we'll go ahead and give you this extra money." Um, and uh so that's where we are today.

581
02:46:14.160 --> 02:46:28.960
Thank you. >> Yes, ma'am. >> Sure. So, with these improvements to the bay doors, do you have any idea what category uh our buildings would be rated? >> I think we're we're hoping it should be at about a four.

582
02:46:28.960 --> 02:46:44.560
>> Okay. Is there some uh in engineering or something that u we could have done? So, we know that. >> Um I think there is. Um, you know, the one of the problems is they're older they're older buildings, but we we do believe that what this is what the

583
02:46:44.560 --> 02:47:00.960
advantage of this is is is our our firefighters should be able to at most storms unless it's kind of a hurricane Andrew type storm should be able to stay in the fire stations at both fire stations um before, during, and after. right now on a big storm they would have

584
02:47:00.960 --> 02:47:16.240
to run over to Temple Toish Elementary and that Harden facility because that's really the only Harden facility around. Um so really after this is done um I think the city's just done over the last two years of an unbelievable job with

585
02:47:16.240 --> 02:47:32.240
getting um the facility on White Way a hardened facility. We're going to have a hardened facility for dispatch police and and and fire dispatch um as well as a brand new EOC. And now both of the two fire stations should be hardened close

586
02:47:32.240 --> 02:47:49.040
to the the same uh standard as those two buildings. >> That's super. Thank you. >> Yes, sir. >> I had a question but it was answer you answered the question with the how come we had to do this. So that was >> Councilman Kravitz. Any questions? No. Okay. Okay. If there are no further

587
02:47:49.040 --> 02:48:05.279
questions, is there a motion? Move to approve the resolution accepting modification number one to hazard mitigation grant agreements for fire station number one and number two wind retrofit projects. >> Second

588
02:48:05.279 --> 02:48:21.439
>> motion second discussion of the motion. All those in favor say I. >> I opposed. No nays. Thank you chief. Next um first council business item is the scheduling of two public hearings to adopt the millillage and budget

589
02:48:21.439 --> 02:48:39.439
ordinances. I see our finance directors here for questions but they've asked me to to uh present this. So, uh, due to the following trim hearing requirements, the city council will need to schedule two special meetings to adopt the millage

590
02:48:39.439 --> 02:48:56.640
rate and budget ordinances to, and this is some legal language that I have to read. To adopt the millage rate and budget, taxing authorities must hold two public hearings. The first or tenative hearing and a final hearing. Scheduling taxing authorities may hold

591
02:48:56.640 --> 02:49:14.080
trim hearings Monday through Friday after 5:00 p.m. and anytime on Saturday, but never on Sunday. The BOCC cannot schedule its hearing on days scheduled for the school board. The school board has first priority of hearing dates. The

592
02:49:14.080 --> 02:49:30.000
BOCC has second choice. No other taxing authority in the county can use the BOCC's and the school board schedule hearing dates for its public hearings. The only exceptions are multicounty and water management districts, which we are

593
02:49:30.000 --> 02:49:45.279
neither. It is recommended that the city council schedule the public hearings and ordinance readings for the millillage rate and budget in the council chambers at 5:05 p.m. on the following dates. September 3rd, the public hearing and

594
02:49:45.279 --> 02:50:02.319
first reading. September 17th, the public hearing and second reading. And also on September 17th to consider resolutions addressing potential rate increases to utility funds. And so we need a motion and a vote to that effect.

595
02:50:02.319 --> 02:50:18.479
I I don't think you have that language. >> You do have it. Okay. I have it here if somebody wants to make that motion. I move to approve the schedule of public hearings and ordinance readings for the millage rate and the budget and council chambers at 5:05 p.m. on the following

596
02:50:18.479 --> 02:50:34.560
dates. September 3rd, public hearing and first reading SL approval. On September 17th, public hearing and second reading/doption and also in September 17th, resolutions addressing potential rate increases for utility funds.

597
02:50:34.560 --> 02:50:49.359
>> Second. >> It's almost as if you knew that was coming. Oh, I hear that motion discuss. Is there discussion of the motion? >> I I just want to make sure that everybody knows that the start time for

598
02:50:49.359 --> 02:51:08.720
those two days is 5:05 p.m. for both days. >> Okay. All those in favor say I. >> I. I. Opposed. >> No nays. We have some meeting scheduled. Thank you. Any other carryover council business? >> I do. Yes, Council Member Fernandez,

599
02:51:08.720 --> 02:51:24.720
>> I have two items. So, um it's I've had some questions in the public about the planning commission survey that was recently conducted and then the me the meeting that we had that the planning commission hosted. Um, and they put some

600
02:51:24.720 --> 02:51:40.720
information out and there's just a little bit of confusion about where that information is coming from, the purpose of that plan. And it's not a it was not a city initiative. It was it

601
02:51:40.720 --> 02:51:56.640
was organized and implemented by the planning commission. Um, but can you just city manager describe a little bit about the purpose of that planning commission endeavor?

602
02:51:56.640 --> 02:52:14.479
>> Actually, if you'd allow me to probably ask Mr. Pauly to come up because he's most familiar with that pro project. >> Just just so that people understand what the purpose was. >> Well, hello again, Greg Pauly, Community

603
02:52:14.479 --> 02:52:31.760
Development. Um very good question and I understand how um some people within the community have been confused about this. Um as you know we are uh well along into a process of uh amending

604
02:52:31.760 --> 02:52:48.560
our comprehensive plan and the first phase of that process is community outreach. the meeting that you I believe you're referring to plus the additional meetings that were also we had another meeting at the same location and then we've had uh additional meetings at city

605
02:52:48.560 --> 02:53:04.000
events. These are all meetings that are driven by the consultant that was retained by the planning commission uh to collect data to help develop the vision statements uh the vision statement I'm sorry for the overall

606
02:53:04.000 --> 02:53:18.880
update. So if you think about it, if you think about taking the big project and parsing it into smaller bites, what they've done is they've taken that first section, they they've worked with uh the

607
02:53:18.880 --> 02:53:34.640
consultant to do numerous community engagements, online engagements, surveys, etc., etc., etc., to gather as much information as they can for to establish the vision statement. And then what you will see

608
02:53:34.640 --> 02:53:51.359
coming out of that is you will see the goals and objectives structured in a way once they've crafted everything and we haven't met uh we usually meet every Friday. Um last Friday we did not meet so I don't have an update on that but

609
02:53:51.359 --> 02:54:07.760
the planning commission representative will be in the office with me tomorrow so I'll be able to maybe uh get an update at that time. Um, but what you're going to see is you're going to see them take that information and use that to formulate uh the uh the building steps moving forward.

610
02:54:07.760 --> 02:54:25.279
>> Okay. And then there there's a question in the public about how the city uses this comprehensive plan in our normal operations. >> Absolutely. That is an excellent question. I I wish more people uh

611
02:54:25.279 --> 02:54:41.200
understood that. Um, in the simplest terms in community development, uh, and the comprehensive plan touches just about every department in the city, but it especially touches community development, public safety,

612
02:54:41.200 --> 02:54:56.960
public works, um, some of your more forward- facing uh, public departments. It's kind of like the uh, the overriding um, umbrella of guide guidelines moving forward. Everything that we do, that's

613
02:54:56.960 --> 02:55:11.760
why everything you see us bring before you at this podium that touches land development goes to the planning commission. Because what when you hear us come here and say it's been approved by the planning commission, what that truly means is that the planning

614
02:55:11.760 --> 02:55:27.120
commission has gotten with their own staff reviewed whatever the item is that we're bringing before them to see if it supports and is com in compliance with the comprehensive plan. So from a holistic picture that comprehensive plan

615
02:55:27.120 --> 02:55:43.600
is our Bible. We go by that. We literally have to to speak on it and go by it every single day because everything we do under land development, everything we do that we touch to help promote uh community development, land

616
02:55:43.600 --> 02:55:59.359
development, anything that touches any of that has to comply and has to support that comprehensive plan. >> Okay. Um hopefully that will answer some of their questions that they've asked. And I just have one other item. >> Thank you. Um, so this has to do with

617
02:55:59.359 --> 02:56:15.760
the proposed bond referendum and and the question is, um, that's come up that I want to make sure that we get the information out is that if the if that referendum were to pass and we issued a

618
02:56:15.760 --> 02:56:33.359
bond to build the public safety complex, um, that project would follow our normal project operation. as in we would we would put that out for a bid. We would engage somebody uh we would put a bid out to

619
02:56:33.359 --> 02:56:48.240
engage somebody's design and maybe design and build or whatever, but it wouldn't be um we don't have a contractor or or a developer that we've awarded anything to.

620
02:56:48.240 --> 02:57:05.120
>> That's that's correct. So we have um a contract for design purposes, conceptual design that was done by um um be is it PBK? Thank you. Um but we go for this next phase. We haven't decided at this point. Obviously, we want to see the

621
02:57:05.120 --> 02:57:21.760
results of August 18th, but I believe we've made a decision whether it's going to be a design build or or or a design um um se I can't think of the terminology right now, but a traditional design process where you'd have a separate architectural firm design and then you'd

622
02:57:21.760 --> 02:57:37.439
have a a contractor bid on a design bid build, excuse me. Um we haven't made that determination, but yes, we're going to follow all the appropriate process. This is a pretty large project. So, we wanted to make sure that everything would be done in accordance with our purchasing manual and all the applicable rules. >> Okay. Cuz there was just some con that

623
02:57:37.439 --> 02:57:52.880
the concerns that were expressed were that um how do we know the construction cost? Have we done the bid process? And I just wanted people to understand that that's the project is not at that point.

624
02:57:52.880 --> 02:58:10.080
So for the construction costs what we as part of PBK's uh scope what they went out they went out to four different estimators um in the construction industry and asked them basically provided them with the specifications generally speaking that they had at that conceptual point and asked them for uh

625
02:58:10.080 --> 02:58:25.439
what they would cost this project out. So that's where we got that and then they took basically a cross-section of those costs and came up with the the number that we've been using uh in terms of what's on the on the bond. Obviously, we as we've told the community, the number was about uh 43 to 44 million and

626
02:58:25.439 --> 02:58:42.000
we're saying not to exceed 50 because of potential inflation that could happen before we get to construction. >> Thank you. >> You're welcome. >> Any other council business? Carry over council business. Council member Kravitz business. Yeah. Um question for the city

627
02:58:42.000 --> 02:58:59.279
manager. Where are we at on the um interim PAS filtering solution? We were soliciting bids, I think. not necessarily soliciting bids. The as I as I mentioned before at the workshop, the last budget workshop. So what staff is doing, public works staff is there

628
02:58:59.279 --> 02:59:14.640
finalizing everything for the August 11th budget workshop for the water and wastewater fund. We plan to bring you a comprehensive analysis that includes basically a spreadsheet to compare the different alternatives for you to to consider that include interim solutions as well. So that that's where they're

629
02:59:14.640 --> 02:59:31.200
working. So that'll be part of that August 11th budget workshop. >> Thank you. Other council business, new business, board reports. Any new business? I have one quick thing. Um, I'd like to

630
02:59:31.200 --> 02:59:47.840
remind the public that the uh ballot that we've just been talking about for the public safety, the general obligation bond is on the ballot for August 18th. Obviously, there's a lot of other important things on that ballot as well, but here in Tumble Terrace, that

631
02:59:47.840 --> 03:00:04.880
one's exceedingly important to us. And I would u encourage everybody who is eligible to vote to please vote. Early voting has started. I also want to read the ballot language to you, and there's a reason why I'm doing this, so bear with me. Um, this is from the official

632
03:00:04.880 --> 03:00:20.160
ballot from Supervisor of Elections. It says general obligation bond referendum for Temple Terrace public safety complex with police and fire stations. Shelled the city of Temple Terrace issue general obligation bonds in one or more

633
03:00:20.160 --> 03:00:36.560
series not exceeding 50 thou $50 million bearing interest not exceeding the maximum legal rate maturing not more than 30 years from the issuance date of each series. pledging the city's full faith, credit, and unlimited ad valorum

634
03:00:36.560 --> 03:00:54.560
taxing power to finance the construction and equipping of a public safety complex, including a new police station, a new fire station, and related facilities. And there are two options, yes or no. The reason I'm reading that is because there are numerous

635
03:00:54.560 --> 03:01:09.200
disinformation campaigns out there. I was at the fitness center today. I know I don't look like that, but I was. And there was a person in the fitness center, and in the hour that that person was there,

636
03:01:09.200 --> 03:01:24.960
they told no less than four people that this ballot initiative had on there that the city wanted to make the city all section 8 housing and that all of your housing values are going to go down because this is what the ballot is to

637
03:01:24.960 --> 03:01:41.439
make section 8 housing in the city. Now, I know they told at least four people that because four of those people knew who I was and told me. So, I didn't get a whole lot of working out done today because I was setting the record straight on this. And so, make no

638
03:01:41.439 --> 03:01:57.760
mistake, I am not trying to sway you or encourage you to vote one way or the other. You vote your conscience as residents of the city. That's why it's on the ballot. And I won't hold it against anybody however they vote. But please vote. And equally as important is

639
03:01:57.760 --> 03:02:14.399
please don't spread disinformation about stuff if you don't like it. Go tell your neighbors don't vote for it. That's fair. That's that's the form of government we have. But don't go make stuff up and lie to them about what's in there to try to get people not to vote

640
03:02:14.399 --> 03:02:30.560
for stuff. That's not democracy. That's I don't know what it is. I got words for it that I can't say up here. But anyway, that's the ballot language. Please vote. However you vote is how you vote. But I I don't listen to anybody wants this.

641
03:02:30.560 --> 03:02:47.439
I'll get it to you. Any you call anybody in this room and we'll get you the ballot language if you don't already have it. Okay. Thank you. Any other new I'm off the rant now by the Any other new business or board reports? Okay. City manager.

642
03:02:47.439 --> 03:03:03.359
Thank you, Mr. Mayor, members of council. In your backup this evening, you have three sets of reports for the fiscal year 26 third quarter. Uh you have the council's fiscal year priorities, city's departmental goal, budget goals, uh and then the ARP for project updates. I'm happy to answer any

643
03:03:03.359 --> 03:03:19.840
questions you might have about those documents. >> Any questions for Mr. Beu? >> I just have one comment. >> Yes. Um, and this is just for the viewing public is that anything that is in our agenda packet is part of what you are able to see if you go on to the city

644
03:03:19.840 --> 03:03:37.359
of Temple Terrace website or the agenda packet that we get that we see is accessible by everybody. So any of the reports that are mentioned here um if you want to look at them, they're in that agenda packet. That's it. >> Okay. Anything else? And Mr. B, anything

645
03:03:37.359 --> 03:03:53.520
else? Go ahead. >> Oh, did I miss? Okay. City attorney. >> Nothing. >> Council, anything else? Council member Kravitz, >> just asked the city attorney a brief question. Uh, I think it was May and then later again in June, I asked for any information about all the

646
03:03:53.520 --> 03:04:09.439
outstanding litigation that the city has. What I received, as far as I could remember, was a list of cases with no further details. I was wondering if any progress has been made in providing actual information about the cases that were on that list. I am available if you want to come talk to me about those

647
03:04:09.439 --> 03:04:28.080
cases. >> I would like information in writing. >> Let me um let me check and make sure that doing so is not adverse to any of the city's interests. And if so, I will go ahead and provide more detail. >> All I'm want all I'm asking for is maybe

648
03:04:28.080 --> 03:04:43.920
one or two sentences describing the general contents of these individual cases, of which there were many, and what their current status is. You don't have to go into anything privileged. Two sentence summaries is fully sufficient. This is a civil case between A and B. The amount in dispute is blah blah blah.

649
03:04:43.920 --> 03:05:01.680
This is where it is in the litigation. This is the anticipated outcome. >> I will uh take a look and and try and provide that information if I feel it isn't adverse to the city. >> Thank you. And for the record, I do think it's completely reasonable for me to ask for those things in writing. So, I appreciate the invitation to come have

650
03:05:01.680 --> 03:05:19.319
a chat, but I'd rather have a document that I can refer to at my leisure because it's complicated and there were a lot of cases. So, thank you for doing that. I appreciate it. That's all. I yield. Anything else to come before the council? And we will stand adjourned.

651
03:05:47.600 --> 03:06:00.600
Hey, hey, hey.
