beginning these would be only for micro licenses um as you can see in the notes the owner or 50 or more than 50% of the owners have to be a resident of tonfly or neighboring municipality all the uh knocking around details does the council want to move forward with figuring out a way to approve this whatever the details if Dan just finish I know spoke with other members of the oh as in the chief chief of police I talked to him last night uh when this first came around he was uh a little nervous about how it would be handled he said let the other towns deal with it uh he saw throughout the county uh Rell Park and fortly zero issues he's all he's all good and has no concerns that their security plans are Top Notch they just have to be Lauren question how does it work if it's a micro license do we still get the percentage yes the tax part is at the end of this memo it is 2% for the manufacturer 1% for wholesaler 2% for retail and to put that into perspective roell Park made over a million dollars last year of one store that's a full that's a full retail store but uh two micro at 2,000 lb per month ju just to keep in mind though the the roell park stor is on Route 17 and it's a massive it's a massive operation it's a massive operation so you know some questions council members might want to consider is just how many people you want to come to a store to to make that type of money because yes that that's it's a huge it could be a huge impact even the Fort Lee store is also full is full a lot of the time so those are questions for yourself when I was on the first version of this committee when it first rolled out and the chief had his concerns the feedback I got from residents was not a large appetite for cannabis retail that is what I heard um so uh I'm not you know like I said with the amount of traffic that it that I've seen it attract in some places you know it's not my top issue I would be more open to you you know the manufacturing or wholesale perhaps but retail I have some concerns but you know that's just feedback I've gotten also from other uh members of the community how about this how about we just go around the table and everyone just kind of say what their particular view is um before we start getting into details to have a sense of the direction we want to go to start uh go ahead I think the most important thing again I jul and I were on the first time I put a lot of value on the chief at the time the chief said it wasn't something that he wanted to kind of go first on um the fact that Chief's supportive of it now I feel better about it um you know obviously we have to look and we could be particular about the size and where it is you know in Fort Lee that's like 800 trillion Acres of space that's a huge building like there's real that's a full-on license correct nothing like that would ever happen in ten ofly also for Le is right by the bridge I bet there's just a lot of traffic there I think and I would ask and want ours to be a bit more Mom Mom and Pop yeah that's why you know there's a couple I did speak to there a couple uh folks that have been interested in it a couple years ago and then recently these are more residents you know I like I'm pretty I read from the stuff that you Wendy did you know we're looking for people that live around our area so the whole concept B I'm certainly open to it but again this is just the beginning we would need to see the other picture but this is the beginning I think it's the nature it makes a lot of sense one of the things that got me in these conversations was if we don't the next to it's a rare opportunity to generate occy places knows number people Lauren would sure so I have not seen huge successes in the small towns of cannabis so far um it is a nimi not in my backyard situation where initially when this rolled out everyone said well let the next town do it and then we'll see um right now our local residents I know are going to the next town um but I don't see the next I mean unless you're going to do these Mega stores I don't really see it generating the type of Revenue that tly might want our residents have other sources I mean I know most of my friends sorry they're going in New York City to the city dispensaries and coming home with it they're not wanting to buy it in their local backyard I will say that some of the stores downtown are not necessarily abiding by the age restrictions and there's concerns that the chief had raised last time around about the access to the underage stuff in the local in our to yeah we don't have we don't have it legally we don't have it legally right so that's a whole separate right right corre black the black market will always exist don't don't worry about that completely agree but I'm saying one of when I was on police commission one of the concerns was you know how do we regulate underage use and local use and walking from you know the teenss on the weekends or it's kind of crazy they're ubering to the stores or to the places getting things and then going back to wherever they're hanging out um I'm not against cannabis I'm all for actually cannabis Strangely I actually do this advocacy on the state level I work with a lot of cannabis Advocates um to create a scheme but the scheme has to be right for us to open up our town to it I do have a lot of hesitations the micro micr licensing is interesting but again I still need the police to be able to regulate I need us to be able to control so I I'm not seeing a ton of that in place still the doubles are the details to you correct okay okay all right Jamie so I'm for it I it's legal just like is legal we my experience is in these stores are nicer than any liquor store that I've ever been in I think security wise it has more security than any um any place that I've ever been in and um I think some Revenue better than giving Revenue to another town and I know that our residents are going to the town next door they're not all going into the city they are going to um dispensaries close by and I'd rather that money be used to you know go back to the residents of the town so to me it's it's it's a no for me Julie uh yeah no so I mean uh just a quick question is does Bergenfield or tck getting it or not t is T is getting uh what's that question is T getting one is your question yeah is T getting one t is on the angle L Leia border but yes they are getting one um so yeah no I mean I I understand that the majority of the council wants to pursue uh the questioning of this you know I'm just saying that I studied it in its first I generation I'm I'm not uh all in I'm just going to tell you from the start so I'd have to be convinced eventually but that's where I am right now so Dan is it safe to assume you're in favor of this concept yes yes you are all right so what would be the next step to to help clarify details the council pick the right details can I ask one more question yeah just on the zoning um I just want to make sure we weren't zoning originally next to or close to schools and church and religious centers it specifically has to be away from that yes but B1 will be um and I actually think this that zone will disqualify that area if you're 200t from a school or a relig the definition of that will disqual the same as liquor it will disqualify most of B1 okay I mean that's really whatting okay area has to be far away like M carel and Mount Carmel there the zoning the that restriction itself will disqualify a lot of the downtown so so Dave and Gabby how do well obviously all the details have to be gotten into off site how do you get suggestions from Council Members what do you think I think you have a three person committee right correct so I would I would reference it back to them and what we need to do is is to have the Govern body authoriz r or direct to ordinance for introduction so it sounds to me like what you probably want to do is have this committee work with Wendy to develop that and then bring the draft ordinance back for it to be considered and move forward from that I think it needs to go to planning board as well for the master plan review board after after we okay right all right so that's what I'm going to ask for I need to get a consensus from the council to have um Wendy and Gabby put a draft ordinance together to return back to the council and they're short-term rentals um so this issue has been raised over the issue of airb Airbnb and ten fly yes so um this draft was prepared back um after the December meeting so it's limited to regulate rentals of 30 days or less um so we're just looking here for your feedback um if it's too much at 30 days um we can choose to regulate shorter terms such as seven or 14 um but if you allow us your thoughts on this we can move forward to the next steps this is what we already yes coun yeah she's just asking right the council's free to change its mind I do have a question just I'm going to throw out there uh about the permitted uses okay 101 13-3 talks about member of a housekeeping unit and then house guest it kind of doesn't or Does it include you know families and nannies and household help and I'm renting my house for week you know I might be okay with paying penalty build it build it into the price it's a thousand a day oh a day oh sorry yeah the following sentences each day of such violation shall be new never mind the the World Cup the World Cup yeah come on World Cup just put it into the house price it's about the it's about when we enforce it too right so so enforcement so enforcement is going to be an issue of People residents are going to have to report it to the burrow because the police department and the building department is not going to know unless we're told exactly and uh social media posts are not going to help that's not that's not going to be reporting do we want to make any exceptions for large events like the World Cup we don't have to make an exception if we're not if we're not enforcing it at a certain time well also if someone's right the World Cup World C last how long month weeks so you rent it for five weeks instead of four and you're legal or 31 days 32 depending on the month could be Rel Mass tax supp specifically to the to like a hotel tax almost a shortterm occy tax run around 12% CH about or years it's real and so we would like people1 days you play S Rentals but the town makes a lot of we consider there is is that are we being shortsighted in that and I agree we're not a vacation town we are a resent town but just to put that out there in the event that there were exceptions the event we people apply to an exception exception to carry tax that we can should be an exception but it's been a meaningful to those their thank you thank you the mayor is scheduled to marry us on the 15th yeah so uh um so Christina has been a resident of tenly for over a decade and just this past year we bought a home together and I can't tell you where in tanly um and it was great for a couple of months until our neighbor moved out directly across the street and we thought another family was moving in Christina has a 16-year-old and a 13-year-old and there was a we thought a young uh a family with a young girl was moving in great turned out it wasn't the case and it's an Airbnb it's list it's actively listed every day right now now for about $400 a night and it's pretty consistently rented uh at least one night a weekend if not both and most of the time it's fine like you know there's it's a nice thought that people think that our street is someplace to vacation or to get away from wherever they live you know every day so I appreciate that but with it you know they're obviously transient and that's a little bit of a you know just stressing security concern at least 50% Christina estimates 75% of the time the plates are out of state doesn't mean they're bad people but it just kind of elevates my concern a little bit and beyond that um it's usually a group and there are parking issues so my understanding that is you know there's already a law prohibiting overnight parking there's you know five or 10 cars on the Street on the weekends which is a particular Challenge on our culdesac with us getting in and out but that's you know specific to this location um the garbage is not tended to routinely so it just sits at the top of the driveway because the owner doesn't get there but you know once a week or whatever it is so it's you know unsightly it's unkempt it's security issues and uh we're just you know distressed about the whole thing so thank you for taking up the issue and hopefully we can vote against it thank you thanks uh Omar is there anyone online who would like to speak on this um the restaurant owners would save money while the streets are cleaner and we reduce plastic pollution and uh this just simply requires customers of takeout food to ask for the plastic utensils instead of them automatically being put in your bag have we talked to any of the restaurants at all so we I didn't talk to them but I know that tenly already does this they do and tenly Diner they do an upcharge when you they'll say do you want the utensils and if you say yes then they charge you um so I don't I don't think this is going to be just have um so I don't think this will be a hard sell but um it's kind of a win-win they don't I don't they're not looking to to pay more to to give a lot of plastic utensils but to to your point Mr Mayor I as liais on with the Board of Health um I was actually speaking to council president Michaels about this that uh I'm always communicating with Ruby who does the the inspections the restaurants so if the council decides to pass this I I would also have her help me with that communication of that law cuz she's there anyway for the restaurants and and say Hey you know you don't need to give the utensils unless asked congratulations again see you Jam's been a part of obviously SLE is a key the key part for us coming is we're using it more and the town's using it Jamie's been a key part of it yes she's beened she was out at the at the field the day that we you don't play like the turf grass that's never a softball field I personally would because I'm a softball coach but that's going to interfere with our commitments under the grant for I'd for some of this yeah so we or I think you havec Dr I spoke about this so there's two things one um actually the LI is eager we we disced they're line that they want to as we continue to invest they want to sort of co-invest with us um I don't know about this particular one and the speed of which we're trying to do this um again $1,000 so um I just don't know if they're kicking off March is there yeah kick off we're trying to get this work done by the end of March so we don't so I think that's when they're going to do start some of the fundraising I can to because I spoke to them about it is whether they come in personal or they read a memo for the council what their plans are and how we feel comfortable about their plans to to help us with the the fundraising and one about some other unencumbered areas we talking about so that was the thing that I don't know David if there's other places like budget wise that could be used that have not been incumber we could use for this it's the beginning of the year so I know it's harder than usually the end of the year but we can take a look at that the reason I said talked to Adam about this I have some concerns that it I know automatically I say okay open space but we start you know 14,000 here or 20,000 here you know we we always have rather large projects in open State um so that that was my concern so that we could I think is very disingenuous of our Council we have open space to be used to maintain did I ask to pay twice did did I do that it's not that I'm saying twice I'm saying if you now they've paid their taxes we've put it into open space to ask the little Le board to now collect from our residents again for the 145 I think is a problem and I don't think we should be ask keep keep something one thing here about the little Le field Lauren might be Lauren okay one at a time Lauren I I do think this is important to mention about the Little League fields Mr yeah so the little league is there option in their offer to help fund raise amongst donors to contribute to this field that's understand I was part of that right so it's not taxpayer money per se because if it's donors writing a check of their own free will it's kind of a different level thing that's something to pay for this if there wasn't another source the background here is that this is an amazing thing that we did last year the school who's owned the field said they don't want to pay a dollar we've done some amazing things and the school again was recognizing that the town collects open space for wreck and hoping that we would use it in this project the town collects open space we can also pay for your salaries but that's probably not how open space is I mean we use open space on a pretty regularly consistent basis for a very nice project this is a very good just because you have the money you have to plan for how to spend you can't just chip away you know I really feel very strongly and one of the things I'm going to continue to say this year is that we are foring our open space rather than using it for our community you're supposed to needs to be applied I haven't been here the last year but yes as needed as required under the open space law so good and this is a perfect project but so let me get to my second comment and that is um if if we are questioning the use of turf or is that so far down the line that I can't even question it now because I'd hate to have a storm water Budget on Turf if Turf is still going to be discussed well it's already down the road for the turf at the infield I mean the beautiful thing about Turf is you get so much more use out of the field and I I'm not clear why softball can't be played on its Earth field it doesn't it's a s it's it's a I just don't there's no that uh we wouldn't have that that facility available until at least the end of February um which is Fast Forward because the original concept from C was that it wouldn't be available at all for this winter season so yes yeah they the they put the concrete walls in they need to cure for a period of time so that curing time isn't quite so you'll see activity quite rapidly in the next couple weeks counc Michel Julie yes so um thank you for interest in the skip the stuff ordinance that was one of the agenda items for environmental commission and um for the Grove Street Park uh the Green Team uh was wanting to know about how to a lot the ADA Compliant flower beds so um just to let everyone know that the Grove Street Park which was funded by open space uh has the ADA Compliant flower beds and those are kind of up next for people who are differently able to be be able to uh reserve for those flower beds so the Green Team wanted to know how many flower beds there will be and if we could get that answer by kindergan so that they can make their process of how to um divy those up divvy up those lots the specifications are in the plans so I can get those specifications for you the number I believe is U it's either four or six but off the top of my head but I'll get you the number four or six but are those like um I guess it would be the specification then they would say to me they would say okay then that makes me four are they four by eight or and and so they the goal is under the spec to be at least uh 18 in off the ground no more than 30 and that will be ADA Compliant yes no that's fantastic so they they just want I told them because you said that we should be ready for some sort of unveiling in February so I them kind like a rib um I would probably say more like April you wouldn't want these cedar flower beds out there yet ask uh it's not stall they've been yeah theyve walking forward the issue is the concrete it's not the time of the year to pour concrete all the underground piping is in all that coming out of the ground ground work has been done I did have a meeting today with uh Andy hippol and with kindan and Mike Cassidy uh so Andy is going to be giving me a memo for the council uh prior to the next Council thank you so okay so that was just what their their feedback was they want to uh have the number so they can get that ready for how to divvy up the plot so they're ready to go okay and um yeah we're excited about it thank you d uh TC had awards ceremony brunch yesterday not yesterday suay Sunday um the new elected officials or their officers have
