good evening gentlemen ladies and gentlemen good evening I'm here on behalf of some local homeowners in my area in the Indian city area who've been experiencing a real bad problem with Speeders through our street I spoke to a lady today who I got her petition's signature on who said she was run off the road by a a black vehicle one night my other neighbors said that they were ripping up the streets with the four-wheelers I myself called the Titusville police last week where we had a a sort of a little difference of opinion simply for the fact that they told me that they were unable to attend to my request because they could not chase the four-wheelers Offroad I can understand that and yet I can't understand that that because it still begs the question that we're leaving the city undefended as far as protecting it on the street that I live we have no sidewalks so that complete run of Elliott Avenue from the north end of Cleveland to the south end of Rosen where it bends and turns into Rosen Hill and turns into Knox McCrae has turned out to be a uh a a a Speedway for four-wheel vehicle off-road vehicles to begin with my understanding is Offroad vehicles are illegal on paved highways period end of question as well we we have some motorcycles that are what they call off-road motorcycles most of these vehicles have no lights I don't know if they have brakes but they have open Mufflers as well which is pretty disgusting so we have women in we have women Wheeling baby carriages during the day down Elliot Avenue and the offenders keep coming down that street because it presents a nice run there are no stop signs at all on Elliot Avenue and and I think some of the neighbors have uh s made some suggestions and I I will I will beg your Indulgence to listen to some of these suggestions as they may be helpful in solving the problem we could use a three-way stop at Forest and Elliot that might inhibit some of the problems we also could use a speed limit sign in on on that street of 25 hold up that would be the end of your three minutes but I'm going to allow you to go one more minute Council would you please one more minute wherever you're at in one minute we're going I'll be very careful we really need your help when we need your help badly if we don't have the city or the police there we're going to have a problem somebody will get killed or hurt I'm going to leave you this petition and I'm going to hope that you can solve the problem and I I thank you for your Indulgence well you didn't even use your minute but anyway um I will say having lived here since 1965 and having the woods behind me over in Imperial Estates even now and almost when you're saying it I'm I'm envisioning some of these folks that are four-wheeling right down my front Street and into the woods so I get it as a problem I can also tell you that um I have done ride alongs with the police and they have done their best and were able to stop them they don't just oh you're going in the woods we can't get you they will get them when they come out they will you know they they're very much on it and we stopped several in one night so uh we they I was riding along but that being said um I'm I'm sure that uh the chief will uh pay attention now my minute's up but uh Chief will pay attention and always does and I know that uh they're very it's a very difficult problem because we've got a lot of folks that like to ride motorcycles like they're a Motocross and I I mean I was out there today I could hear them in the back in the woods back there I don't know what they're doing as far as tearing it up but I get it and I'm not faulting them just for the record my son and granddaughter ride Motocross contests all over the state but not in the woods in the city city area so I hear you and I know the chief hears you and I know that the police are on it because I happened to be there one night when that was their focus so they're trying one more comment may I may I was really disappointed that the operations officer told me that they didn't have the time and they were busy with other matters and I felt very disappointed and I wanted to call that to your attention I know John La personally and I know he's a different individual but would you please see to with that we get something done I will I will say again I know having ridden with them they work on that it's a tough situation a lot more difficult than getting somebody off the road than getting them off the the p in the woods but yes we will certainly pay may I pass this on to you hand that to the clerk over there for me okay so just curiosity you mentioned a three-way stop you mentioned a threeway stop if we had a three-way stop at at Forest and the problem is you see it's a long R it's a long on mile run and they avoid they void the Rosen hill by going down our street and it's a straight shot and they open it up wide open so do I understand you to say a stop sign might help pardon that I understand you to say that a stop sign might help there's only one stop sign on on that uh on that area and it's on Forest it's not on Rosen it's not on Elliot okay okay thank you so next up Stan Johnson I'm speaking tonight as a professional engineer and uh the city clerk already has this why you already have this I'm I'm not giving it to you because you already got it just a few minutes ago so uh I'm going to read this to you again and you're probably getting tired of hearing it I'm getting tired of reading it so here's here's what it says is this is a u a motion that uh it's not in this form but the motion was in similar form from Tec to council to answer ask answer a question and the question was as follows it's not this is not word for word as it was sent from the Tec it says is anyone in city council going to acknowledge the sewage spill and that sewage spill was a long time beginning in September through uh parts and and then went to November because it was two big storms coming out of manholes ponding in Greenwood Street and into nine city streets as witnessed by me and LLY Thompson the person who turned off this alarm and red flashing light at the lift station on that's on Carol Avenue photos videotapes of sewage flowing out of manholes many witnesses and photographed on the front page of the floor today so this was a pretty widely uh known sewage spill that the city denies and FD denies it too so there was no signs no warnings children played in the sewage I'm here because I'm licensed by the state to protect the health safety and Welfare of the public and you guys are not doing it you guys do not listen to professional engineer you do not have a professional engineer speak for you on this because if he spoke to you on this I would do what I to report him to the board so there's not a whole lot that's keeping you guys clear and Clean from this sin and if you were to use your pink card here this is the rotary uh has the rotary four-way test on it and uh it this what you're doing uh breaks all these rules says number one is is it the truth well it's not the truth what you're doing number two is it fair to all concerned no will it build Goodwill and better friendships no uh will it be beneficial to all concerned no so you all got you guys have the upper crowd upper card because you've got the power to do anything you want to it seems like State Attorney won't do anything about it FD won't do anything about it governor's office won't do about it Stan when you talk to FDD FD what did they say they investigated it right no in other words what they I would I would contact him well no just I'm just asking you what they said they said we will get back with you so they're the Florida Department of Environmental Protection yes and they didn't all right again repeatedly and they're still doing it that's what I just sent you an email Kevin can you summarize that for me one more time uh Stan go ahead and sit down because I don't want to have a debate I don't want that pressure I just want him to go ahead and give me it real quick same thing we did last time FD was out to investigate um yeah U this was D hurricane I have a letter that Mr staler wrote to DP in response to one of Stan's emails making the the same uh complaint that he had now that there was a sewer spill and in the letter Sean indicates the response that the city had uh that was immediately investigated they found that there was no spill no discharges of sewage in this area um this letter has been provided to the Tec which I believe Stan also had was given a copy of this letter from December of 2022 which was provided to uh Miss Carolyn Hall environmental consultant who oversees sewers bills in our area thank you so who was the person Carolyn Hall car H yes youve tried to email a couple thank you I appreciate you as always doing your due Ence um I appreciate us obviously as we do um look into those things and bring in FD who Council anyone to talk about on there let me yes let me just ask this I asked Scott the other night um the road repaving is 6.8 miles yes ma'am and this week the list the roads to be paved will be out engineer I'm reading this 8A um and I'm not sure how to respond to it because it's Soul Source contract with Auto review. to conduct Plan reviews so it sounds like we're going to uh Outsource some of our uh Community develop reviews is that correct anybody answer that go ahead continue oh okay well I was hoping to get an answer on that I I'll give you my time somebody can answer it okay nobody's going to answer it well I don't I'm not sure what it's about but it it it it frightens me a little bit if we're going to Outsource this stuff uh on the other items a b c d and e is that uh these have to do with water resources and um I'm not sure how water resour sources is doing right now but but what they've done in the past is that U uh it's it's horrible dishonesty about the sewage spills and spraying women and children and babies and vehicles and so forth with with um sewage aerosol when they leave the fountains on well that's a horrible thing to do but that's what the city did uh except jool ly she called up and she said FD he said it's okay I don't know if she told him about people getting sprayed and the car is getting sprayed like my car so now so now what what last time I went to a do a sew sample of sewage spe spill is that uh uh I was arrested and taken to jail I'm I'm not the only one being harassed by the city tville police and the Water Resources I'm not the only one there's um there's people in uh fight for zero Sierra Club and uh speak up Titusville they're also harassed so I'm I'm I'm opposing some of these things because Water Resources has done some bad things and and Water Resources has has a number of of uh people who are uh know what's going on and our our other Professional Engineers and there's people who will I know that will not speak up because they're afraid they'll get fired what's going on is is uh gag orders it's automatic gag orders because they know if they say something they'll get fired just like on what I'm talking about this sewage spill I was out there when I had police officers and we had we also we also had City crew members that saw the sewage spill fact is I even on on the spill that happened in in uh 2020 after December 19th I called up City City attorney said once you come out here and I'll show you this The Spill is continuing into the river after December 19th he didn't come but said he voted thank you didn't happen thank you that's good Ahad sit down but I understand uh I saw you talking about CD and E and I thought oh good he's going to maybe going to get the idea here C cost share funding interlocal agreement off spray Lateral Repair project uh Indian River Lagoon project cost share funding um benefits for the river benefits for the environment cost share funding interlock C or excuse me D approve Amendment one to save our Indian River Lagoon project cost share funding agreement between the city of T Bard County 52,000 funding um to design the Sandpoint Park baffle box project we got more baffle boxes is in tizel and Palm Bay and Melbourne combined which is if you don't know it's a filter that keeps things out of the river it's not supposed to be there and then task force for Lift Station master plan approve the award blah blah blah uh lift station evaluations Dynamic Wastewater model development and lift station master plan these are all things to improve the river to imp improve the Lagoon and I will be glad to say that we are ahead of anybody in this County when it comes to our projects in the lagoon just thought I'd say that uh uh member Nelson move to approve reiterated what uh Mr Honeycut had presented two weeks ago at council meeting there was nothing in addition to that what was that that was the fact that the parcel of land was zoned because of the helicopter school being there and that was the purpose what and it was zoned the way it was and this is why there's a request for rezoning to get it so they can build build on that property and the helicopter school is not there anymore okay you understand that your decision on this item will be based on the evidence presented here tonight yeah say say again what you said can you understand that your decision will be based on the competent substantial evidence presented to you tonight at this meeting yes and anybody else if none at this time time I'll read ordinance number 6 2024 an ordinance of the city of tyo Florida amending ordinance number 9 2017 by amending the master plan of the plan development ped zoning District imposed on approximately 638 plus minus Acres of property located west of Gren Parkway East of Challenger Parkway State Road 407 and Interstate 95 at the Western Terminus of Willow Creek Boulevard having bouevard County partial ID number is 23 3509 001 23354 002 23350 9 Y rb10 and 23 3510 Yi WC do3 providing for severability repeal of conflicting ordinances and providing for an effective date the applicant Rodney M Honeycut PE on behalf of the owner KB Homes of Orlando Florida Incorporated is requesting to amend the Willow Creek PUD master plan on a park paral located west of Grom Parkway and east of Challenger Parkway Sr 407 in Interstate I95 at the Western Terminus of Willow Creek Boulevard the request proposes to amend the existing PD master plan by removing the proposed commercial and light industrial uses and Associated transition zone the request also proposes to add Village e as a multifam and add a recreational Lake and an additional recreational amenities on February 7th 2024 the planing and Zoning commission recommended approval of the requested change with the following conditions number one a traffic Comming design be provided for Village A and C to eliminate the long straightaways um in those subdivisions at a time of the submitt of the engineering plans vote was 51 one member was concerned with losing the Industrial and Commercial land um this is your second reading and final public hearing of ordinance number 6 2024 for the rezone application of Verona master plan Willow Creek staff is here to do a presentation for you go ahead staff good evening uh Christy Anderson senior planner um tonight the applicant is requesting to amend the Veron planned unit development master plan the request proposes to expand the the borrow pit noted on the approved master plan to create a 38 acre recreational Lake the proposed recreational amenities include a walking trail along the Lake's perimeter the lake with Lake access and three proposed benches the proposed master plan and revised open space areas have been notated within the proposed master plan um Amendment provided on page 873 of your packets and I'd just like to provide a brief history of the development and the staff's proposed conditions pertaining to traffic and open space the existing master plan was approved for the city's plan unit development procedures under the comprehensive plan amendment number one -26 in February of 2017 the current master plan has been provided on page 869 of your packets the approved development has a maximum allowable density of 1,277 residential units the master plan states that the residential units consist of single family homes and multifamily toown homes if there's a market demand the master plan includes 172 plus minus Acres of commercial and or light industrial areas a transition buffer zone and 244 plus minus Acres of open space the master plan identified four proposed residential Villages uh a transition zone that includes a 50-ft buffer between the residential Villages and the light industrial commercial areas the status of the most current development of the site has been summarized within the chart provided on page uh 830 of your packets there are active permits with St John's River Water Management District updated storm water and environmental reports and Wetland surveys have been and will continue to be provided with each phase of the development an updated traffic study will also be submitted along with each development phase to ensure adequate site access pursuant to the conditions of the original master plan approval a secondary access point shall be established prior to the development of any non-residential commercial and or industrial use if during the development of the residential uses a secondary access is warranted and as based upon a traffic study acceptable by the city no additional building permits will be issued until the access issue is resolved providing a single access point could have the potential to create a negative impact along Grom Parkway in order to enh enhance the quality of life of the residents and to reduce potential negative impacts associated with increased traffic along Willow Creek Boulevard and Grom Parkway staff recommends the following condition Willow Creek Boulevard will be a minor collector Road a minimum of two vehicular access points is required on the segment of Willow Creek Boulevard between Grom Parkway and the Connector Road as Illustrated on the master plan the second access point must be established established prior to the final PL approval of the last remaining residential subdivision single family or multif family the request proposes to increase the open space area from 224 acres to 285 Acres which is a 45% of the total gross acreage of the plan development the amendment's propos proposed open space includes all prep preserved wetlands and the preserved planted buffer tracks ponds lakes that include amenities Improvement such as Trails fountains bench boat launch areas and Etc improved amenity sites such as a clubhouse pool and recreational areas Trail Pathways with enhancements such as Pavilions benches and educational panels staff recommends the following conditions related to the open space all new Trail sh shall include a shade tree Pavilion bench educational panel and picnic table at regular intervals of 400 ft of of no less than 400t staff Al also recommends that a multi-use path to accommodate both pedestrians and B bicyclists be located parallel to will Creek Boulevard all other recreational trails should be 8T wide with a stabilized surface the conditions of approval from the 2017 master plan provided on page 861 were carried over to the amended master plan and are located in the p in the draft um rezoning ordinance beginning on page 879 new conditions of approval describe the timing of the secondary access point on Willow Creek Boulevard a schedule of recreational amenities and standards related to model homes staff has found that the master plan amendment is consistent with the city's comprehensive plan and Land Development reg regulations including Amendment procedures described in section 3-60 section 34- 62 of the code staff recommends approval of the requests to amend the master plan by removing the proposed commercial and light industrial uses in transition zones and to add Village e as multif family to and to utilize the burough pit B pit as a recreational Lake and additional recreational trails along around the burough pit in Li of recreational Trails between the villages as described in the plan development rezoning ordinance conditions described in exhibit a and Illustrated on the amended master plan in exhibit B dated January 29th 2023 and I'd be happy to take any questions that you have from staff and the applicant is here to address any questions that you have this evening as well U member Nelson chrisy I do have a question um under a recommendation is saying add additional Recreation trails around the burough pit and Li of trails between the villages and I was sry concerned because I thought if we have kids somewhere over here somewhere over here be better to have them walking the trails and going out to the roads it'd be safer right right I know that the um applicant stated that they had um issues with con connecting the Trails um because of wetland impacts okay so I think that that was the reason that they couldn't originally uh complete what was presented as a a trail connecting the entire you know development throughout um so this is their um proposed ability to work around that and still provide the recreational Trails although they are segmented one area of the development did you talk to him about maybe some traffic calming on that one road that goes that would be heaven for a kid um I I don't believe that it since the meeting because I know that the Planning and Zoning Council that was one of their concerns but I don't believe that I personally haven't had any uh correspondence in relation to that with the applicant at this time okay thanks anybody else vice mayor yes and it may have I may have misheard your question member Nelson um my on the uh with going up to approximately 1,200 or so uh homes uh is that going to increase the traffic very much on 407 well each phase of development is required to provide a traffic impact study oh each phase is correct correct so if the traffic study shows that U it's has having a negative impa impact uh what can we do at that particular Point what can be done at that particular point they they would have to figure out a way to Pro proceed um there could be additional requirements that uh traffic calming measures that could be required um is that going to be because that's a state road is that correct would that be done is 407 State ro oh sir I believe they met all the requirements with the traffic studies excuse me they have met all the requirements of the traffic studies all of the requirement at present yes sir including traffic study would it be any different based on making this change sorry I I believe it has the potential to be less of an impact um based on what being proposed uh rather than the industrial commercial component that could you know increase substantially um I think what's being requested for the amendment is uh has the potential to reduce the traffic compared to what could potentially be there all right thank you anything else from staff councel uh applicant didn't we just see you sir good evening good evening um Rodney Honeycut 3700 South Washington Avenue right here in Titusville um your your question about uh traffic analysis is each time there's a um new portion of a project submitted they have to have a uh traffic study uh accompany that and if the traffic study makes recommendations then they have to make those improvements to get their project approved anytime do a change there have to be an update on the traffic study is that correct yes so are you telling me that traffic study has been done on the request of this chain not on the request of this change they make those traffic studies at the time of the submitt to the city for approval uh for staff approval okay and that's because it may be two or three years down the road and traffic may be different so you don't do that study until you do that now initially back in 2017 there was a traffic study submitted also at that time okay so um if you haven't been out to Verona you should back in 217 there were promises made about how beautiful it would be because there's a lot of wetlands out there that's why there's so much open space in preserved areas and there's minimal impact to those areas so as I mentioned last time when you come in the entrance Road off of Gren Parkway it's a mile before you get to the first road to the right and all that's preserved on the right hand side so there's a lot of preserved areas in there um and so as we're proceeding uh they need a little help so we've asked for a master plan Amendment and um the the things we're asking for staff mentioned one is at a multif family Village and um this has become more important because the price of single family homes is rising so much that multif family town homes are a more affordable option and so that's that's one reason that they're proceeding with this also another thing we're asking for is to be able to have model homes in The Villages the uh first phase of this project was not in the Pud it was an R3 Zone I mean r1b probably single family and they're allowed to have Model Homes uh all um mul family and single family zones are allowed to have Model Homes but not in a PUD so that's why we added in the Pud so that they'll be able to have model homes and a model home is really a home that they turn into a sales office for a short period of time they have to meet all the reg they agree to meet all the regulations of a model home in a residential Zone subdivision um the other one is they want to um expand the old bar pit uh which will result in a large recreational lake with a trail around it um when when we started the project uh years ago probably 2018 um and we started to get our our first Trail to connect the villages we ran into the problem with the Water Management District about going through the wetlands and so that that um created that area that issue so we have a a wide Trail along and off the shoulder of um Willer Creek Boulevard that connects all and this this will actually provide more trails and Recreation amenities for that um the the next thing we're asking for is to remove the transition zone and the industrial commercial pointed in the back and so back in two back in the early 2000s when this project when all this land was purchased their original Vision was commercial and Industrial on Gren Parkway and then the residential portion and so there is so they platted the commercial industrial there's 20 40 acres on Grom Parkway on both sides for commercial industrial the only thing that has developed there so far has been eckers they built out there a few years ago and so now that the transition zone is no longer needed it was there because it was a helicopter training school and there were so many complaints over residential neighborhoods that they that the airport asked that we leave an area that's not residential so that those hel helicopters could go out and go west of 95 and not be over residential areas so that's why it was done the airport now no has no objection to removing that area and so therefore we'd like to recapture that to the original vision and so the residential area which includes all of this PUD and that first section that was not in it is around 660 acres and 285 Acres of that's going to be open space and preserve Wetland so it's pretty pretty neat project um there are no proposed changes in the setbacks for anything from the original PUD lot widths or maximum number of units in this in this proposed amendment and so uh staff recommended approval um with the conditions that were in the original uh uh PUD master plan um they added defining the timing of the second access point for Willer Creek Boulevard uh providing schedule of Rec of recreational amenities and standards uh related to model homes be the same as in the code and so um the U owner agrees to all those conditions and we're to say something memb St yeah just to clarify because I see Brad over there looking I the way I read this recommendation I think the way member Nelson did is they were hoping that traffic would be like would slow down so traffic calming design and when I hear traffic calming design a three-way stop kind of it's only one example there are many types of of traffic calming design so so sh do you should we leave it more open the condition being some type of traffic coming I we don't have you guys um I think the um the specific area that that they were concerned about was the village C the the straightaway yeah I think that specifically is what Rodney was referring to at every intersection of that straightway stop of the village C portion would require a three-way stop how about if I just leave it as traffic caling as uh set up by Mr huting cut and planning the planning department I leave some things open for them you get too specific that could track and it may include Village a as well not the recommendation I'm okay with that um City attorney are we okay we were kind of scattered on that little I just want to confirm with staff based on the recommendation that it' be traffic common is that enough for you to review as to whether it meets the intent of council as far as traffic calming I believe it does it and but but if we want to get something very specific you could go with what Mr Honeycut suggested which is a very specific traffic cing design sure but if you want to leave it open recommendation allows us to be I think we should leave it open yep yeah traffic which is old business this is the fy2 Community Development block grant and home home investment partnership program funding recommendations at a special meeting on 11 January 2024 city council received the neighborhood services department annual report for the 2023 CBG and home Grant programs additionally at the same meeting city council heard from agencies that responded to the Department's 2025 request for proposals the neighborhood services have completed their evaluation process of the rfps that were received and the neighborhood services director can recommend the following funding recommendations for FY 2425 contingent upon receipt of the corresponding Grant funds for public services aging matters in bavard Meals on Wheels 100% at $15,000 the Women's Center domestic violence Safe House 100% at $16,300 Bard Alzheimer's safe ride program at 100% for8 $8,400 and the neighborhood services activities a three-year community beautification and infrastructure improvements of $200,300 or the balance of the funding after Public Service allocations all funding recommendations are contingent upon the city receiving the grant funding in FY 2425 from HUD and The Bard County respectively staff recommends that you approve the Community Development block grant CBG and home Grant programs as proposed funding recommendations in the amount of $325,000 for C CBG and $140,000 for home for the inclusion of the FY 2025 annual action plan as required by Hud Terry's here to answer any questions that you may have on the CBG and home grants member stal yep um okay so considering that we were able to fund all of these at 100% I'm assuming that means that we may be anticipating enough funds to fund that and maybe more um do we have any plans in place right now for uh opening it back up or seeing if there's other nonprofits that would want to potentially apply or what does that look like I guess depending on if we get extra money is what I'm kind of getting at um we've never done that we usually um what proposals we get you know we have that 15% cap with cdbg I have a feeling that we're not going to receive much more from cdbg based upon uh the the pre- numers that came out there are more entitlement cities now so now that money is spread more over more over that so I think we'll probably be pretty steady um what we've done uh historically is anything above that 15% or the request that we receive goes into infrastructure and um neighborhood improvements thank you any other questions for I say staff I that's appropriate but anyway uh I see um agencies uh that are wanting to to work in the city of Titusville uh we've been um fortunate to have um these agencies year after year uh to serve our community so we look forward to continued Partnerships with them well thank you for what you do you are the the bridge in our city you really are um vice mayor the only thing that that bothers me is that um none of the agencies that are receiving funding operate truly operate out of Titusville that's that's that's that's my concern um well their their yeah their main office may not be in Titusville but Joe's Club is in Titusville offsite Offices here but but U the money is is you know it's required to stay in Titusville uh but uh still that we should have some agencies up here that are you know asking for this financial support uh and that way that not only does the service stay in Titus field the dollars themselves stay in tit all right that's the only problem that I have with I get that and I've certainly said that before and sometimes even in my uh education days um every time we had a presenter or there was a program that was being developed it was always based in Melbourne you know based in rockage and we certainly benefited from it and certainly I think that's our main Crux I agree with you but um at this point I think the most important thing that we can do is have our Meals on Wheels and um have our Women's Center and uh all the other things we're assisting with however that's kind of I don't call it pet peeve but that's always been something I've paid attention to as well we always seem to have the office down here is that's good we're benefiting yeah but I agree hit your button there sir no you understand totally do totally do all right I believe if I recall I have a motion in a second okay located in the Tranquility development if council is inclined to consider this request then staff will submit to council an analysis of the bond status of all infrastructure improvements cost estimates and the amount of the new Bond and review the code criteria with staff's recommendations thank you umf you have anything on this one we currently don't have a regular process to for these kind of requests so that's why this is being brought before you okay uh the petitioner is here to to answer any questions okay very good um member Cole you want to talk now or we want I just I just wanted to find out how long it would take to procure the bond if you're procure if you're changing from hold up there hold up there let's go ahead and bring up the okay the applicant or whatever we want to call it come on up and give us a little explanation summary of what we're going to look to do here tonight Gary Allen 5150 Tammy Miami Trail uh so we're here tonight because we have a bond or bonds that are currently in place with the city for approximately 10.7 million um we um that was placed before before we started construction and our the current cost to complete is less than 800,000 so um the city code was uh the way the original amount was derived was that it was 120% of our uh cost to complete and so what we're now our cost to complete is 800,000 and so we would like it to the the bond to be replaced or reduced to uh to get I guess be in line with the 120% to get out of the weeds it just seems like the common sense thing to do it it just mathematically um it just seems like you you taken Bond you don't need to keep that Bond you need to reduce the bond uh vice mayor yeah and that that's what I was going to say Mr Mayor it that uh if if we can assure that uh everything has been complied to uh to on the original Bond it was it's just you know human sense I should say that to try to bring it down to make it more you know this this is about everybody working together and for the good of all absolutely yeah that's what m Cole okay my same question as I had before how long that will it take you to make this com of fruition how long will it take you to on our side it would be a couple of days a couple of days right I talked to our bonding company before this meeting and they said that they could um you know they're familiar with the project obviously and they they've seen the site and they've seen the progress so they they're really um up to date on um exactly where we're at okay yeah that's good that's good that's good it would be the the staff would have the hardest job is is uh inquiring in and making sure everything is checked that's where the time would be uh be involved with the staff verifying everything will be in that has been completed okay sure um go ahead so uh we'd like to ask I guess if that's something that we could resolve by the next meeting or I guess what's City attorney I think that would depend on the information that's provided by to staff they're going to have to look at the cost of completion for the remaining infrastructure so at this point the applicant will have to provide to staff what is left to be constructed staff will have to look at those cost estimates I assume go with our engineer another staff to confirm the cost so we can determine what that 120% amount would be so they could secure the appropriate bond is this something that they would then need to get with staff on yes they will have to provide that information to staff like they did when they originally bonded to review the cost because staff will have to also agree with what needs to be completed still what the cost estimates are that will be provided I assume by Mr Allen his staff and his engineer we will need to concur with that amount then we can agree on what that bond amount will be the 120% of the cost of completing the project what can what can we do tonight tonight is advising staff to proceed with that get that information and and move forward yeah okay well we will do that and I can I see their desire to move forward but that would be through staff not us right staff will have to concur with those numbers right we will bring it back to you for approval of the new bond amount after staff after the discussion yes sir they will have to right agree to cost of completion amounts to finish the infrastructure and then the new Bond will be 120% of that amount to complete construction right we can and we can provide that to staff tomorrow so we obviously we keep pretty close track of what we got all right member Nelson so while we're talking about this Brad would it be good to have a procedure not in two weeks but a procedure at some point in place to deal with this kind of issue that would be helpful um one of the issues that we thought about was there could be uh very numerous requests on the same Bond or the same project over time and that is uh it does take a lot of time of Staff resources to investigate verify inspect and to work with the applicant depending on the size of the project okay um so this particular request if this is approved by you we'll go forward and and work as diligently as we can um I just can't assure that we'll be able to get it back to you at your immediate next meeting but we will certainly try because our inspectors are also inspecting various other projects at the same time so I think that'd be a great idea and you know let staff get it back to us whenever they can um but I think at some point we need to talk about some type of procedure so that these guys don't have to necessarily come to us each time sure I noted when we started you would say we don't have a process for this and so that was going to be my once we got past this to say what about a process in the future that uh would expedite this um and I you know I don't know all the ins and outs of that but I would think that uh the fact that we don't have a process or procedure to go through staff and perhaps keep it from coming to us twice that would be very handy if uh we could do that but right now let's just focus on getting this thing rolling for them remember stokel yeah that was G be my question um I guess how come what would be the reason we haven't had this happen before is it because we've never had a project this scale before with the perform performance bond this high like what why have we not run into this issue before I don't have an answer for that we've never had a project complete 100% 120% bonded this is this is the first one we've had this okay and I guess yeah into I think what mayor and member Nelson were saying um if this may be a reoccurring issue or we could see that this might happen in the future I could see us having some type of process where that's written in the initial approval by Council you know if this is met if certain criteria is met then it is adjusted appropriately um based on the remaining work that needs to be done something like that because I think we all kind of agree this makes sense like why would we have them have a bond um larger when there's not much not as much work that needs to be done so and I would imagine talking about time I I guess however long it took last time to get the bond I don't know how long that was when you guys additionally got this what the approval time was my guess would be it probably be similar because we're having to look at everything again it was a lot shorter the first time because nothing was constructed okay gotcha okay that's kind of what I was getting at okay so now you have to look and see okay excuse me uh just for clarity for the council um you know we have inspectors from the city that are out at the site on a very regular basis I don't want to say they've had over 100 you know inspections they're there all the time throughout the process checking as we're progressing so I feel like that they uh should have a good handle on uh at least the city inspectors should have a good handle on where you know the progress that we've made okay very good that's good to hear thank you mayor yeah we we had uh Council we have to be very careful that we don't turn our job over to uh someone else and and you know I believe in Expediting I uh things as best we can but staff still has a responsibility to make sure that that everything is uh up to standard according to our requirement and but if we uh if we leave that out we uh we can get our get get ourselves in a whole lot of trouble so I I understand the the expediency of the developer and wanted to get it done so he can get his get the the the the financing square away but at the same time I understand that the staff has a whole another operation that that's going on and they they don't want to stop nobody no one else's project just to get on this particular request so let us be careful not to we want to help but we don't want to take too many shortcuts uh in uh in the process and don't want to overburden the staff as well my thoughts on the matter and I'll add to my thoughts I'm not looking for any shortcuts but when the first thing we say is we don't have a process that means we got to get a process well Mr the process is there it's just got to be done you know there did you say we don't have a process for this the as far as we don't have a process for this special request to reduce a bond that this is special because we've not had this happen before so I'm just saying be prepared for in the future and doesn't mean we got to shorten anything it just means we don't have a process for it let's look into it but as far as Mr Robert's suggesting here we have a process of inspection so we do have a staff that deals that and we can verify yeah very good South Park Avenue Titusville Florida 32780 um the reason why I'm here is actually I came today here for a meeting for um a pre meeting for my uh Triplex that I'm developing on Park Avenue and upon coming here this is my third trip I came across the landscape buffer zone it's it's hard it's it's a hardship for me to build build on my property um I'm within zoning from my architect I don't know if you know Allen I got Rodney as my site development and basically what's going on is I have 10 I'm 12 foot on the left side 10 foot on the right side I'm within the 10 foot you know withd from the interior building like 35 ft in the back and I have like about 30 ft in the front and then there's about 50 ft to Park Avenue 25 to the sidewalk sidewalk to my board my property so I'm within the Realms you know of my blueprint it's paid for my land's paid for my S plan I got to pay for but this is a very hardship I'm a I'm a disabled veteran I've served in combat I'm a ranger I'm a sniper been Airborne been in three combat missions I get chemotherapy and it's my life is I have a medical condition and I'm trying to put some in place for my daughter and my brother and my father it's going to stay in one unit my brother's here and they're going to be living in one unit unit and you know the other is rent for my daughter so I'm trying to see if there's something that can help me uh waiver cuz now they're saying I have to go through a variance which I don't see how why because my building is within the density of the 5,000 ft 50% and I'm within all the zoning and I spoke to Brad many times and some of the staff and they all assured me I was within the zoning and and markk you know I spoke to them you know just to make sure everything was the architect and everything and now they say I need a sprinkler system also a fire a fire sprinkler system for three units so you know before it was a site plan you know you need to have a site plan the last time which I didn't know so I did the site plan with Rod you know and then and now they're saying I need a handicap spot parking space so we put the parking space I thought we were coming today for the meeting for the parking space space but then now you're saying oh you got a landscape buffer zone and I find like I find like that is I should say contradicting the zoning because you're saying you got 10 foot from the boundary and I bought the property in 2016 as R3 high density multif family and it was 10 foot from the building so I should be grandfathered in but they changed it to 20 foot which hard gives me a hardship where I can't build and then I'm not going to mention I feel like I was steered to go to a duplex which I don't feel that's a a solution because I don't feel that I have to jeopardize my brother and Dad's residence right in mine and go down to two units in my daughter's investment for her future right I bought it as three units and I'm building I'm providing tax dollars for the city I'm building in an area where a lot of people are not wanting to build and I'm going to develop pal meow also and I'm going to build there and I'm going to make it nice and I'm going to provide affordable rent you know housing more housing for the city all right hold up I uh certainly sense your frustration and some yeah I'm not trying to you know no no no no no I I I do I sense your frustration I'm not familiar with the that this is kind of cold to us I'm sure but this is where I want to you know give Brad a chance to say what we got going on here because I don't know so what can anybody shed light over I don't have a lot of anybody's over there right now but uh Brad you're the guy there was a meeting this afternoon with u Rodney um about submitting a site plan for a a multif family development and I believe it was a pre-application meeting is something that's required as prerequisite to any submittal or receipt of a formal engineered site plan and so it's at that time that we that person meets with the uh City staff and all the site plan reviewers to hear about what the requirements are going to be as far as the process and what the code might be and depending on what the project is being proposed what processes such as it potentially inv variances might be necessary depending on what's being proposed so I think that's what happened this afternoon um and I think uh gentleman probably heard some information that uh we're basically just going to be hurdles to have to go through so I think that's what's happening I certainly s sit down and and talk with you about more of the specifics um but I'd have to see more about the project I wasn't particularly in that particular meeting this afternoon um I did meet with him at a prior time about a few weeks ago um just to give him some general direction because he was initially trying to ask for a permit which he couldn't do based on what he was proposing he had to go through a site planine process so I did give him some general direction of what he needed to do as far as at that time um so I think it today he had the the formal pre-application meeting but it sounds like there just a lot of different hurdles in our code that he's going to have to go through in order to accomplish what he's trying to propose um there is a 20 foot landscape buffer requirement along public rights away in our code and for some small Lots yeah that may be a hardship and it might be a justification to get a variance but it is a process well clearly um and I I think that I can speak for you know planning for the most part they want to make these work I don't think there's any body up here right now that's feeling like gosh I hope this doesn't work we'd like to you know you've worked hard you know appreciate it you've certainly given your life to uh you know our country etc etc the bottom line is um I I'd like to the get you to work with Brad and the the Planning Group over there and deal with the hurdles one by one my concern it sounds like some of the hurdles maybe you weren't aware of and that's always a concern that you know you think you got something done it's like wait a minute now you got this now you got that I get that sometimes that we've had people come before us and it's like well wait we you know here's the paper you sign this is you know check check check check check I'm going to tell you that we are not those folks that can tell you where to go with that except when it does come to us we would certainly encourage and and and do what we need to do to assist but I can't speak for uh Brad but it does sound like Brad you you not your first rodeo you feel like you can sit down and let's let's move through this one step at a time the only thing I want to add is um not I'm not trying to you know come frustrated just I just had an opportunity I knew you guys were having the meeting I was eating dinner with my brother and my my thing was to come up here you know and be approved for the handicap spot for the site plan and go home to my daughter cuz she's you know I I take care of my daughter I don't have anybody else so I have to pay someone to take care of her now you know it just costing me money and I I know it's maybe not burn but I'm on a fixed income and I got a loan approved with Credit Union Community Credit Union I'm trying to you know I pulled my credit already and as time goes by I have to pull my credit again and then the interest rates keep going up my debt to income ratio so I'm trying to get this you know completed you know I'm not trying to rush anybody but it's been like seven eight months now I've had my blueprint and you know I'm like I don't have any and the direction I got today was I talked to the architect I went and met with him and he's telling me I can't change the plans um and then the word I'm getting from them is is I I can't believe someone would with say well why don't you just build a duplex there a single family home and I was like well then I can just jump off the cliff why not you know I mean it's just you know it's it's kind of like it's like you buy something it's Zone R3 high density three units you expect to get what you pay for and I you know I'm providing tax dollars to the city and I'm going to keep it I'm going to build it nice provide more rental units and I'm going to landscape it you know I'm going to beautify the area it's better than a vacant logis sitting there and you're getting 96 a year taxes we believe you on all that we certainly hope this all works out remember stoko yep um I had a question Brad with this landscape buffer um is that in addition to like a front setback so he was saying how he has Mets setback requirements you know on the sides in the back and then in the front so this 20 foot landscape buffer would that being an addition to whatever Frontage he already has set aside or is it can it be incorporated into like a 30 foot yes they they would overlap they would overlap okay so yeah I think that's what I would be curious about because if it is currently zoned R3 I feel like it should be able to fit in theory um and so as the mayor was saying like staff has to go by what our code says like that is their job but if we're if we're seeing like maybe there's a mix match or there's something that needs to be changed in our code because it's not it's contradicting each other that's the side is the problem the side the yeah that's what I was going to say what what do you feel it doesn't seem like the landscape the landscape it's not the front and the back well it you honestly it needs to be set to where it is now okay but the sides are 12T on the left and 10t on the right okay and you know I I have no problem I allow them to park the pavement equipment on my land for five months I never asked for anything you know I say that's fine if something gets stolen not responsible you can use the land all you want to pave bar to you know what I mean put the equ there and sometimes on Pomo I cut the grass for the city and they help me we we scratch each other you know we're a team you know I don't ask for anything and I try to keep things within the community when I'm hiring people I try to get everybody landscap or everybody that's within the city I go I don't go out I go I try to get here now if they're charging three times the price yeah of course I have to go somewhere I can't afford to pay three times the price but if I can get someone here to work I'm all for it so I think yeah when you have your meeting with Brad I think it will shed some light to see what can be done um we'll see how it meets the code um I will say depending if it really is a true hardship the variance process seems to be like seems to work for a lot of individuals if it's just like this because of this one particular piece and then um hopefully it will get settled then and then if there is potentially something that we that's where we could get involved when we get into a variance but outside of that you're going to need to work with Brad and Brad can give if you give me your card or you maybe already have his card but I'd like an update on on where we're sitting with this if you could um when you guys sit down and talk say here's the problem here's what we can do this is what we got to do we may need to come to council we'd like to make well you know I just cuz it was bothering me cuz I had to stay in a hotel it's $200 something dollars a night I don't know what's going on here you guys are having spring break but it's like triple the price I was like man race week bike week I don't know holid in is like $200 something dollar 250 tonight it's like staying in New York wow yeah it's expensive but I appreciate it thank you thank you you make me feel better thank you Brad thank you all right anybody else well you're with him all right uh mayor's uh Council report first that's up to you sir yeah I got normally I do but I got mayor's report we'll go Council report um basically I would just uh say for me thank you guys um I would say for me the got to go to the Indian River City Church um Gayla on Saturday night and got to um speak there and uh it's really cool some of the um I say Pastor Stewart over there Pastor Stewart Bowden he's a guy that when he looks at something he doesn't see what it is he sees what it can be and for the um to go to IRC the Kids Place most of you have heard of the kids place and say now that every year we're going to advance another grade from kindergarten next year first grade then second grade then third grade that is quite an undertaking with no new buildings just yet so I mean it really is that's that's stepping that's a leap of faith so I was very proud of them uh and I was glad to be there and uh I can go on on about other things but at this point I'm just going to say that was great I'm really trying to uh win my my the under uh member sto mayor before you get to council um you had asked that um a water conservation Proclamation yes for water conservation month of April be presented before Council and uh the next presentation meeting in April would be the 23rd of April 2024 so if you would like to make that proposal to council yeah basically I just got an email that um I feel like we've done this before I really was trying to remember when I was asked but it's a um water conservation right water it's a water conservation Proclamation for the month of April which is the national water conservation month and obviously if we do that here which we will they would like us to do that here which I think is good to get that out in front of everybody we need to have a motion and a second so moved and all those in favor say let me just say the motion is to do the proclamation for water conservation at our meeting to add an agenda item to add an agenda item so I've got a motion and a second all those in favor say yes yes oppos say no we' got it carried mayor clarification which meeting over we going to do that at um I'm I'm shown the 23rd of April as the next presentation meeting in April and then on the mayor's report he has a request for another Proclamation for Ancient Order ofans order of who it's h i b e r n i a NS um for the IR Irish American Heritage Month yeah proclamations the H order are claiming March 2024 as our Irish American okay okay yes yes yes yes yes uh can you give me that motion thank you very much M well I can so moved okay we got it so moved do I have a second second second and that one scheduled for the agenda item on the 26th of March at the 5:30 um presentation perfect perfect I remember I doing that one as well they were very very appreciative of that so we will uh all those in favor say yes yes opposed we will do the Irish and Mark appropriately okay now memb sto I just like to say water conservation Proclamation is a tongue twister if you try to say that that's what I heard just yeah I know yeah just say so moved um I don't think I have too many updates uh good to see everyone at I'm trying to think of the events that we've done the chamber installation was great um police Awards and the police Awards always one one of my favorite uh events I will say I really liked the theme this year yes um I think that was a nice touch the food was actually yes and um I just feel like I feel like sometimes I take it for granted but because we're just so used to the morale with the police department every time we're there but I really feel like we have something special going there um when we start to not to compare but to compare I just feel like it feels like a f family um just the way you can tell with people joking around with each other and the recognition and the praise and honor and I just I don't want to take it for granted so it's just nice to be reminded when we go to those events um and I'm grateful that we put them on and we invest the time money and the resources um to do that for our departments so that's all I have and let me just add to that because um I've always said when I speak about the uh police department they're they're are heroes they're the ones who run to the danger while we are prot protected from the danger um but I also lately have said over and over again a big part of their success and chief La is an example of this uh relationships and um I had a situation where I was double booked and uh I texted the police chief uh had taken my grandson to a pro wrestling night and he was so excited and I didn't know about the police Awards night until after that so I texted the chief and said I may have to leave early whatever whatever his respon was family first don't you worry about even coming I mean I couldn't you know and so then when I got there he said it again you thank me for being there and he made it very clear we're family first and for you to speak it's like a family it that's that's how he does it and it comes from the top down so I too agree and the um the event um we talked about how cool it was to to be in the Hawaiian outfits Etc and city manager and I both said no I'm not Mr get into the outfit nor is he but we did and it's like everybody did it was it was the coolest little gathering everything and just was just such a great event and uh uh you know wish I could have stayed longer but I can tell you I was there long enough to get that family feel and the happiness and fun that people were having vice mayor were you having fun oh yeah hit your button hit your button but it's been quite busy over the last couple of days uh dealing with uh uh one of and I shared this with the city manager uh last Friday not this past y this past Friday uh I went to uh a uh black history program over at the charter school over at the U Gibson Center uh at the Gibson Center and uh the all of the kids and was that was that are attending that school the fundraiser and they had all kinds of uh the kids were sited in the front of charts or you know that they made up it's kind of like that and uh he would walk up to one of the uh students and ask him tell me about this person whether it was uh uh uh Samy Davis Jr cdy portier or whomever it was and uh they wouldn't say anything to you until you dropped a a little uh token off into their little booket and and and when they when you did that I didn't have any change so I was just dropping dollar bills and I I just dropping dollar bills and then I found out you could go up to the desk and get some quarters not been tell you about that been all my dollar bill uh but uh as a u a a um a local uh uh uh uh contributor to uh the betterment of titfield I was recognized as uh an uh individual in in titles in North bouard that had made a difference uh since I've been here over the year and they did my profile and uh with the things that that I have done in my lifetime and uh uh the only part that was hard they asked me what when I was born so so they and when I put the the dollar in the yeah 1962 uh uh when I uh when I put my Dollar in it um it was it was really nice to to hear that uh someone in the community thought you were a local hero uh that was good uh our church uh Sor said my church has been putting on anniversary programs o over the last uh weekend and we that was uh uh a lot of fun and to do that a comedy show and and uh and uh had one of our local friends uh uh uh Pastor Shan come up and uh bring his church up and uh we did a church s anniversary thing that was uh that that was nice and uh it has just been a blessing uh uh weekend to to to be out in the community and to see uh what is happening within the city and that's why I said that it's so many agencies that here in Titusville needs to get the dollars that we get in from the city and those dollars can pay double back and I you understood what I was saying man totally I don't want to come across I didn't I got my whole life cuz I fought that battle for for many many many many many years always based somewhere else yeah yeah we don't get full dollars I agree and it used to be a time well I won't say that because I'm W being recorded uh it had association with being the County Seat but anyway uh it was it was a wonderful weekend and uh I agree uh I wasn't able to make the uh the chamber thing because I was at at church doing our thing and uh uh at uh uh but at the police thing and we brought that up and uh and I said to the city manager I was so pleased with the the camaraderie you know the camaraderie that uh that the city has and and I was glad to hear and get the email today that uh the heroes show up and when they off duty and and I like that you know that uh your your duty does not stop when you get get off work you're always there to uh lend your skills to make a difference and to help save a life very good that's all that's me all right member Nelson I had a wonderful weekend um there we go I forgot about this I play was here well Chuck was here and I played trivia Saturday night with a very competitive team and and there was somebody else next to us wow look so we won trivia for the Women's Club wow that's a big women Center a lot of people there um there were 300 people there yep so my my teammates who are very very competitive gave this to me and said that I should show it to Herman and let him tell sh they did say to hold on to it is that's as close as he'll ever get my my team has played and has been to this trivia thing for the last 10 years and every time I go I realize how dumb I really am we finish in the middle of the pack and she they're sitting behind us and just gloating the whole time so let me say these people are like serious five in a row um we have 2015 2016 2019 that's pretty serious 2022 last year and this year wow and you have to realize that with 300 people the number of teams are there and the questions were I don't think Richard broom could answer the questions there were some that were just amazing but the Women's Center did great I understand they made like $100,000 wonderful so that is that is just fantastic but uh yeah my teammates were like I'm sure yeah just make sure he does Rob it in Rob it in Prett wow uh Herman anything you want to say about the trophy I don't want to say anything about the trophy the trivia night was is it's always a lot of fun and it's good to be able to to participate in something that you know that's helping the women's in it I've been involved with the women Center for over 10 years I dressed up like a Cleopatra and Tina Turner also for the women Center but I last Tuesday I spoke at the daughters of American Revolution out at the air bird Museum and and the uh I gave a presentation on the Tusk Airman and I took a 20 minute presentation and turned it into an hour but we had a good time I I enjoyed uh speak people do that yeah yeah we tend to do that but but all of the different things we've had been been involved we've been as city council involved in over the past two weeks the chamber the police and you know and trivia and it it's just it's just great to be out there and to see the community and to see what the community is doing so you were going to say something to me again about that trophy no I was just going to say I saw you as clearly a Patra I don't know about the rest pictures but Herman that was scary oh that was that a patch um city manager moving on city manager they've had enough fun over there yes sir um two uh calendar events just as a reminder and it's hard to believe the school year is coming to an end but the student award ceremony is scheduled for 29 um April at 6 p.m. and it's uh scheduled to be at the Performing Art Center at High and um that's always a wonderful event to to reward their children like that I'm sorry sir can we have stews to sit on so we cans we can make arrangements to have seats there yes sir um the next event is the day after on the 30th of April this will be the results of the community survey that's underway right now and um it'll be a facilitated strategic plan review so uh those two events are on the horizon mayor um just as a reminder uh mayor Diesel and I attended the Port Canaveral second annual mayor's breakfast which was a a port U update and uh the city had an opportunity to share our goings on and uh I'll let the mayor comment if you would sir on what your observations were of that breakfast oh I I would I would say we're a pretty good tag team um basically what we were they were trying to seek out and I appreciate them doing that from the port um uh this Commander or Captain Murray Captain Captain Murray um he's an outstanding leader I appreciate him uh putting that together or his group putting that together but the cities in the area rocklet Coco Titusville Port can or Cape Canaveral Coco Beach um the most affected by the cruise industry apparently in the port um he wanted to hear what was going on in our cities and he gave a nice Port presentation first of all nice PowerPoint and the um I took some pictures uh of the the slides and you can't remember them all but that's why I take the pictures but uh the the growth of the port is just exponential it's the the number of cruise ships the number of Cruisers the number of traffic the number of parking it's incredible um but that being said we spoke um and I kind of started off by saying that when I got on Council in 200 16 we average seven projects on the board at a time at any one time and now we average about 55 that alone says so much to me you know you don't have to have a great imagination to realize that's we're growing and we're growing fast and then from there um we talked a little bit more about our growth we talked about our efforts with the in River Lagoon um and city manager you know followed up with some stats and facts and we did a little bit of the cost awareness of the difference now between a uh a ladder truck truck in the fire department versus one you know 5 years ago and then as some people pointed out the rockage of course they all agreed with us and then the rocklage city manager talked about you know they followed that up with you and you can't get them for three years and of course city manager pointed that out to us numerous times but overall it was just a great sharing of um you know the cities coming together and matter of fact Captain Murray talked about uh how great it was to see the cities all play off of each other in our discussion a little bit like a league of cities group grou gathering with a little more commonality but um otherwise it was just a great uh a great Gathering of of Mayors and city managers with the the port um supervisors and uh other than that I thought it was just a great outing yes sir and one not to belor but one other takeaway is the port's uh strategic planning is phenomenal they're taking a look at how they can adjust to the the Space Program coming in and parking vessels there um they're trying to bring federal agencies together that have shared land use which is very difficult to do and um just because the amount of space that's left at the Port that could be um developed they don't want to put all parking lots there they want to develop it to meet the needs of the community and and uh and the port itself so I thought it was a a great partnership meeting and that is such a great uh uh addition to our community uh even though like mayor said we're not affected by some of the things that the surrounding communities are absolutely but it's a great impact and just a follow on Note um the captain Murray talked about uh Ships coming from the New York area and Baltimore area and provisioning here for about six to seven hours we now have uh buses that come to Titusville to see The Space Walk of Fame and uh hopefully when we get that uh peer connecting uh portion that they'll be able to walk around Veterans Park but the other day today there's probably about 30 people on a commercial bus that came to visit our space you park so that's a good start yes sir uh next hold on one second Vice no and I just wanted to say about the port uh when I was uh first class and chief we used to bring the ship in yeah uh come in down there we used to hit bottom coming into the port better not do that anymore yeah you said now you got these humongous uh uh uh Cru yeah but you know you hit bottom and then we only had a 20 foot draft you know and then and uh you could see if you didn't know what you were doing you could churn up the mud oh boy but it's been dreaded that that Port when you said that it is changed and that was uh that was in 1978 79 uh when I was stationed here uh it has changed and made a big difference yeah same year I was born I think that's all I wanted to see on on The Ships coming in I would say and this last thing because we were both Amazed by how much of that Port is owned by the Navy the Army you know so when they're talking about their you their comprehensive plan and their expansion well this and he was showing us on on a slide this is Navy and army I didn't realize Army had anything out there you know so that was that was quite surprising yes sir the Coast Guard too um next we received news uh real good news that um we are going to receive a substantial amount of impact fees Transportation impact fees and our initial thoughts and we'll get into midye but um transportation impact fees have to be used for infrastructure um we believe that we will be able to complete all the sidewalk work on our collectors on all of our collector roads that uh many of them don't have sidewalks at all right now so more to come on that but uh very positive news today that we are going to um get a quite a bit of infrastructure uh from Transportation impact fees and last um and I know as you drive around you see so many orange cones in and around the downtown at Southside everywhere uh there's infrastructure projects going on and uh mayor and Council I just want to thank you for um letting us keep ahead of the infrastructure uh it's it's a pain for some people when a road's closed because we've got to put a pipe under the ground but um I think that the the Strategic vision of the council knowing that we are growing and we're addressing the infrastructure needs as we go and getting ahead of it I really want to thank you for that because when I walk around and see all the orange cones I just smile I mean it's like this is what we should be doing and sorry that s Point Park's got a big excavator in there it's only going to be there for a couple more days but it it's what we have to do in order to stay ahead of things so I appreciate that sir that's City attorney yes mayor council I have one item in your agenda and that is settlement of a pending litigation uh we currently have a case of Washington versus city of Titusville and case number 05 2020 CA 0447 in the Circuit Court here in Bard County that involved an an auto crash uh with the citizen U at this time the city has negotiated a settlement of that pending lawsuit and the pl has agreed to settle this claim in the amount of $125,000 and that is subject to council approval based on the history of the claim the city's current defense Council Renee Lundy and the risk manager Mark langdorf are requesting the city council to accept the terms of that negotiated settlement and allow risk management to issue settlement payment in the amount of $125,000 and authorize the execution of all necessary settlement documents and um yeah I'm sure you guys have already got that from the city attorney so with that I guess we would take a motion move to approve the settlement of the claim in Washington versus city of Titusville and authorize the defense Council city manager as or designate to execute the necessary settlement documents second I have a motion and a second all those in favor say yes yes oppos carries we good all right with that that I
