official minutes reflect that this is the re rescheduled regular council meeting of July 24th 2024 adequate notice of this rescheduled regular council meeting has been provided by publishing a notice in the ASB Park Press and Star Ledger on Monday July 22nd 2024 notice was also posted on the town hall bulletin board for such notices on the Township's website and filed with the Township Clerk pursuant to a resolution adopted by the township Council on Tuesday January 1st 2024 councilman Sosi here and I don't like this meeting councilman lamb here councilman ion here councilman quinlisk here Council vice president OU here council president Coleman here councilman lman here item number five is to adopt the meeting minutes from July 15 2024 move the minutes a motion was made by councilman Lan uh to move the minutes from the July 15 2024 meeting second by councilman lman uh councilman lamb yes councilman lman yes councilman seosi why are you reading the agenda shouldn't the council president be reading the agenda that hasn't happened no at one meeting okay no all right yeah your vote Yes oh um councilman Iverson yes councilman Quinn Lisk uh yeah just the last two meetings have been you reading theenda but Council vice president or tool yes councilman lman yes and council president Coleman yes uh item six is honoring resolutions and presentations this evening we have uh Proclamation honoring the members of The Americans with Disabilities Act these members are committed to ensuring that the Tom rer citizens fully benefit from the laws enacted by the Ada mandate will take a motion to move the honoring resolutions and presentations make a motion second at this time I'd like to motion was made I'm sorry all in favor hi this time I like to ask um the chair of the Ada committee Joe Coco please come into the well and the rest of the council members to meet us down there please also if um if Terry is here come on up Terry and also Doug please [Music] you are there okay um last month this country um recognized the Ada um which was went into law several years ago Tom river is very fortunate to have its own committee that addresses that law chair of that committee is gentleman to my left that's Joe coko and he has a couple of his people here I'm going to have him interest them and then also to State the mission of the committee which is formed by the mayor and also what their work is at this particular time again it was last month but we're recognizing them today Joe thank you I'm taller than I thought basically simply putting it the uh mission of of the committee is to look out for the residents of Tom's River the Ada U residents uh those in need um those that have any concerns any questions um they find somewhere there's a barrier that's that's they can't get into a building or whatever it might be um they come come to us and you know we'll work to help them out plus we're also providing information literature whatever it is to help them along um Le the the past year you know we've done a few things we've got a couple of veterans that had come to us uh really they were just just discharged disabled veterans and uh they didn't know where to go you know what to do at that that point um so we helped them along also we're also responsible for the building here for the employees and all of the folks that come through the building here to again assure that this this building is you know ada8 cap ada8 capable excuse me so um I'm just going to introduce to have Scott Ireland with me today's and and Doug rer and again the uh you know the committee meets monthly we have a portion of the website Tom over website gives the information out and um it's just it's something that it's real you know it's real the people are real they're all volunteers and they're out there to really do what we can for for those folks um unfortunately I'm learning more and more about them since my surgeries uh and one day I hope you know to get rid of this but um you know I I can empathize for the folks in need so again thank you for listening thank you for the the recognition of the group anything anyone does need if you know of anyone we're here and we're more than happy to help with them thank you Joe on behalf of the mayor and the council would like to give you this Proclamation which states your mission statement it also lists all the members of your committee and uh we hope that you'll post this in an obvious place and be very proud of it because we're proud of your committee all right thank you you're welcome thank [Applause] you come on over guys the entire committee is very [Applause] two good super for [Music] [Music] [Music] item seven is a resolution of the township uh Council of the township of Toms River County of ocean state of New Jersey authorizing the ex the execution of a shared services agreement for the purposes of reopening the Toms River Animal Shelter under the management and control of the Ocean County uh Board of Health Mr President Mr quinley uh I believe this resolution and resolution number eight in reversed order it's I believe wrong to vote on the second step when you haven't clarified the first step we haven't resolved the first issue and the first issue being ordinance 8 the repeal of the leasing of the animal shelter to the county uh and since we missed the deadline to uh act on this I believe it has to go to public referendum so it's impossible for us to avoid I mean to vote on a shared service agreement which none of us have seen anything on without dealing with the referendum first move seven okay it's a legal thing I assume right am I correct on this um I don't believe that it's an issue to vote on a resolution to enter into a shared services agreement the two don't really have anything to do with one another well except for they're both about the animal shelter and you're putting the the horse before the cart on this one because we have not resolved the issue but we're going to move on to the next step of the issue think that's the right way to do this the the the council can vote on the the resolution to authorize the shared services agreement there was also an issue with whether or not the lease even had be done by resolution to begin with it it doesn't matter it's on the agenda it it does matter I think there's a there's a motion to move the resolution is there a second make a motion to table this indefinitely I'll second it okay motion there's a motion to table table would supersede a motion to advance this there's a there's a motion to table the resolution uh by uh councilman quinis second by councilman ion uh councilman quinlisk please table councilman Iverson table councilman Sosi table councilman lamb to table it or not well a motion to table would would say you don't want to reopen it is that what you that's your stance you want you want to keep it closed I want to keep the animal shelter open as it was I vote no to table uh Council uh vice president OU no council president Coleman no councilman lman I'm going to vote no as well because I think that this has already been worked over so much that it's it's just silly to keep fighting amongst each other like this there's a legal course of action has to happen if it was legal the attorneys would advise us it was I'm pretty sure that's not happen no that's it we would have been advised that's four votes to three to not table it there's a motion uh by councilman lamb to approve the resolution second by councilwoman Council vice president OU councilman lamb yes reading ordinance of the township uh Council Township Toms River Ocean County New Jersey repealing ordinance number 48224 of the Township Code of the township of Toms River titled quote authorizing the mayor to execute in the Township Clerk to attest to a lease agreement between the township of Tom's River and the Ocean County Board of Health uh authorizing the leasing of certain Municipal property pursuant to njsa 4A 12-1 14b this is a first reading um so we'll take a a vote or I'm sorry we'll take a motion m m Mr President again I have to I have to raise an objection here we can't really there's already supposed to be a legal course that this is supposed to take and this is not it okay um how how many years of Municipal experence we have a motion and it's been seconded please call for the vote it wasn't just call for the vote please just just for the record this wasn't just my opinion this was also uh Council McGuckin's opinion who drafted the shared services agreement I'll have you know I know we I know drafted the original okay all right there's a um motion to uh approve the ordinance by Council vice president otou um who second it I did and second by councilman contract other than he's not making any money so was it his idea to pull out or you guys because he's not making any money the vendor it was his idea he got up took all his stuff and left so he's done it's on him yes y okay and then well oh we need to vote we need to vote on current's De contract that's a question that Finance would have to answer but I believe although this I'm not 100% sure I believe that they are not current with their rent but but I don't believe that was we did not terminate the agreement they walked off correct okay thank you okay we'll take a motion on G motion G uh answer that Cassie is not here but I I believe it's one card and it's in the care of three individuals everything I'm sure as you know an awful lot of things cannot be purchased anymore via invoice software things like that uh so we're we're kind of we kind of need some sort of electronic payment method so I believe it's the business administrator the purchasing agent and the CFO that would all have to uh do that and it's actually better in some ways than petty cash in that everything is documented as to what's being purchased is there a limit on that uh I don't know I don't know I I think it's more like an ATM card and less like a credit card so there's no limit I think it just we would set up a line item in the in our budget it would be funded and then should there be a need for envelopes let's say uh you wouldn't have to wait several weeks to get the envelopes or pull from petty cash somebody would be able to purchase it with the procurement CT and I guess that will show up on the bill list correct yes and and you're a councilman you're entitled to any and all records at all times right thank you there is a motion to approve um consent the jite consent agenda item H um the mayor had an opportunity I don't mind jumping in I actually um made the church wait a I actually apologize to Father Scott today we I wanted to go see personally where this was going to be uh it's in St Joe's Cemetery it's behind an existing um melum so they're building another m uh the entire area is um has cover from trees you can't see any houses anywhere uh so basically they're adding another Mausoleum directly in back of an existing Mausoleum uh but I the Council uh the planning board I believe it was remanded to the council although we had not done that in the past uh the new planner believed that uh there's a state law that requires a vter council so this would be the first time the council has actually approved one of these prior to the planning board had to come here first presumably because residents uh would not be happy if you built the bonum next to their home right so uh I wanted to personally check it out I went down to St Joe's Cemetery with the site plan and um it's it's right behind an existing Mausoleum and you can't see a single house it's more it's closer to Hooper than anything else so uh I'm recommending that you vote in favor of this you know it's it's up to the council obviously okay have a motion to approve I'll make the motion I'll second a motion Lan uh a motion was made by um councilman lman and second by councilman nerson to approve uh item t on the uh consent agenda councilman lman yes councilman ion yes councilman seosi it would have been nice to know uh how many vaults and the size and everything well this still has to go before the planning board just to be clear okay all right I'm aware okay so I I vote yes thank you councilman lamb yes councilman Quinn if father Scott says he needs this then I vote Yes Council vice president UL yes council president Coleman yes Okay resolution X discussion yeah X that was me um Steve I apologize in advance it's not a personal insult um but from what your resume shows you have absolutely no municipal clerk experience you're going to step into a the eighth largest municipality in the State trying to do a job that's sadly going to be way above your your your experience level at this point uh I don't see any resolution about having a uh uh shared service agreement with with another town for a clerk uh to act act as our acting uh Municipal uh clerk uh so I'm going to have to say no to this particular resolution and I hope that some of you others will uh see a little deeper into this and vote no as well may I may I just jump in briefly here for a second council president go ahead so um Mr Hansel has a bachelor's degree and a m master's degree our last clerk I believe most of you believe he did a fine job an excellent job um he came into that position from uh the Department of Public Works uh he did not have a clerk certificate either I believe most clerks uh work in the position for approximately a year while they take the courses Stephen's incredibly organized intelligent hardworking man who I think is going to do an excellent job we also recently hired a fantastic Deputy clerk as well uh she's going to be going through the cour work and uh the township is going to pay for that and that's how it's traditionally been done here I don't think we ever had a clerk uh in recent history that had their certification when they got here it's usually something earned in the position again when when Mr Krug did come in we had an acting clerk from another town under assured service agreement because I think you have to have an acting clerk no you do not have to have you have to you have to make him the acting clerk today and when you make him the acting clerk he won't get a three-year term he'll get a one-year term and he'll have time to complete the coursework and you'll have an opportunity to evaluate his performance but I can assure you he's a brilliant hardworking man and uh I think he's going to do an excellent job he's been chairing the planning board here for the last eight months and has done a job excellent job doing that and uh at the planning board they don't have a clerk and much of that is directed by the planning board chair it's why we asked him it's why he's uh he applied and we think he's going to do terrific so uh you know I I respectfully request that you reconsider your vote and and give Mr Hensel a shot I think he's going to do a fine job May interject I'm sorry um I've been working with Steve and I will tell you that I'm very impressed with how quickly he's caught on to some of the things actually even sometimes educating me but um I think also he'll do an excellent job he's very motivated he wants to do his best for the township and i would support his hiring and if I may council president just to set the record straight the statute that's cited in the on the agenda in the resolution authorizes a Township for up to up to potentially three years but the first year you don't need to get uh approval from the DCA uh it authorizes to hire a municipal clerk who doesn't have their RMC and I believe he's going to be enrolled in in courses shortly on that which is what we've done in the past correct any other discussion okay I like to call for a vote I make a motion second motion to to approve okay uh motion was made by Council vice president president otou to approve uh resolution uh X on the consent agenda second by councilman lamb uh Council vice president OU yes councilman lamb I think the closest we have to Mr Hensel with education will probably Mr mutter who's a lawyer as an attorney myself I know I value education but Mr Hensel is a uh again a educated man he's grew up in Tom he knows the town he's going to do a fine job so I vote Yes uh councilman Sosi abstain councilman nerson I vote Yes councilman quinis no uh council president Coleman yes councilman Lin yes resolution y discussion uh resolution why pursuant uh guard safe fireworks uh I understand that uh uh we this is a a weird surprise because when we approved the concert series down at the Shelter Cove I don't believe there was any mention of fireworks I understand at the last concert we actually had fireworks without consent or approval from the uh Council uh therefore I'm going to vote no on this as well council president may I just jump in for a second yes mayor so all this does is authorize us to get the permits um as far as the the planning of fireworks um we have been stating since we got in that we wanted to see fireworks in Tomas river that we thought it'd be great for the public and uh a nice family activity we over budgeted for the concert series by I don't even know I think I think the the folks in the administration did a great job they got all those concerts for like $35,000 so there is a that was Six concerts I think that's what you budgeted for no we budgeted significantly higher than that I think we budgeted over $150,000 for that so there's um there's a tremendous amount of money left over each firework show I believe was about $5,000 the last one was attended by over I believe over 600 some people say a th000 i i buy the 600 number and uh there were about 50 boats uh watching so it's a nice family activity for residents residents pay a lot of taxes it's nice to give them something for their tax money besides garbage pickup and policing yeah Jimmy you should really come down there we uh I was there at the last one actually tonight's canceled right tonight's yes popon the weather Monday night will be uh and it's excellent I tell you what's well attended uh we have fireman down there there I got obviously helping out so you should come down Jim cuz I saw again George came down there and a few of us Peter was down there please come down and um it's an excellent well attended in event uh if I may real quick uh we had a cancel the last meeting because we didn't have a quorum but we just heard that two out of the seven council meeting were at the fireworks show so we would have had a qu like sounds a little questionable to me [Applause] was I don't I don't believe it was canceled for a quorum I believe it was no no no I believe it was cancel wanted to go to the wanted to attend the event which you didn't attend but you need a majority right there was a there was concern that there were going to be four uh missing four folks who couldn't attend one or two were traveling so um anyway can we is there a motion motion please second okay uh motion was made by councilman lamb to approve uh item y on the consent agenda second by councilman lman councilman lamb yeah again I just want to invite the public to come down it's an excellent uh excellent spot The Summer's been great down there the last couple shows are excellent the enjoyed it there was better than 600 people there and it was well attended even by the boats that were parked outside wait watching the fireworks so yes I vote Yes councilman sosy abstain again councilman ion yes yes Council MC Quinn L uh I don't remember on any campaign literature anybody saying we want more fireworks in Tom's River although it's a great way to entertain and distract uh I think we have far greater things to do I've never had anybody ask me can we please have fireworks can we please have a cont series we're wasting taxpayers money so that the mayor and Mr lamb can feel good I think it's a silly thing to do not to mention that I believe they even usurped our Authority as a council by uh having the the fire Bureau sign off on this thing ahead of this coming to a vote so I say no council vice president no tool I say yes uh Council uh council president Coleman yes you already voted you already voted yeah okay okay uh next moving to the reports you have a motion to approve the reports make the motion a second motion a motion was made by uh councilman lman second by councilman nion to approve the reports councilman lman yes councilman Iverson yes councilman seosi we did really yeah we voted on the balance right before we even got into any discussion David okay um next uh approval of the bills do I have to call these things out that what happens with the bills don't have a problem with the bills there's things on here question do you have a should have gotone the email indic conflict it's things that are on the bill list that I don't believe should or that need explanation okay so I I want to call out bill number 2483 963 uh and it was for the fireworks and it's a $6,600 per show uh he's going to have four of them so it's going to cost taxpayers an additional $2,600 uh $ 26,300 for these uh these fireworks not to mention any police overtime the and if the fire department I believe they do charge and anything else that is required including an EMS uh on standby um and then I also want to call out bill number 24- 04106 uh for trumpia reimb it was for trumpia was a company and it was reimbursing John solanis for uh two payments of $645 the best I can figure out from that is it was a email I mean sorry text message blast advertising the concert series and fireworks it's a little bit odd uh and then the last thing is Bill number 2403 889 for Shore Media Marketing three payments of $3600 for a total of 9,600 I'm sorry 9,165 I have no idea who sh media and marketing is and why we're paying them to do something which I don't even know what that is other than that I I vote Yes to the rest of the bills okay we'll take a motion to approve the bills make a motion we have a motion we have a motion second second a motion has been made by comments I could make a lot of comments wait pull your mic and you probably wouldn't want to hear them but I'm going to reiterate something that I've said before and I don't know who heard it who didn't number one when we ran before we even put our names on a ticket we sat down and we decided on a platform to run on that platform was no new taxes lower costs stop the building provide conservation which I think we are trying to do I don't know who else decided to go a different way and I don't really care I'm carrying my part of the platform it's what I believe in so you can sit down there and you can laugh and you can call me a yes man or any other man you want but I am going forward with the plan that was laid out and it was to help the people in this Township with taxes and costs and we're living in a world right now where cost are very high inflation has taken over you all know what it is to go to a grocery store your dollar don't stretch that far anymore don't buy much but we're trying to keep the cost down so that that dollar goes a little bit further for you and with that I seed the floor thank you Council MOSI yeah I was actually going to say no comment tonight for the first time Dave Dave could you pull your microphone up towards you please thank you and uh but now I have to address uh some things uh actually the budget did go up here in the town I I can't recall 1 million6 1 million n but the the budget actually went up and the the previous regime as you always refer to uh uh was here during the shut down Co and inflation and they got through it they saved the downtown the bit what few businesses that we have left and they were able to buy over 100 acres or maybe a little bit more of real open space okay so uh stop beating up the the previous uh uh regime Administration um can I answer that a minute you raised the taxes and you raised the taxes on years 9% a half raise the tax on the most vulnerable population in this town the seniors um that's let's not interrupt let's not get into that interrupting thing Dave you've got the floor I would like Dave to finish before we interrupt okay thank you so on tonight's agenda with uh with building uh I M and Q is it um and P are all major and minor subdivisions so uh I don't understand that part and and I don't know how many uh lawsuits there are out in the wind but it's it's my guess that this town is being sued there's got to be dozens and dozens of lawsuits coming our way and um and this has never happened before and only time will tell so uh needless to say I I'm not happy sitting up up here and uh and and this last letter that I I got today from um the township here uh that the uh highrise development uh 12 story it's only six story uh has been stopped and and it was on it was given away for $1 but they don't mention that it was $400,000 a year in property taxes that would be coming in escalating uh every couple years is that 30 year deferment in tax let's not interrupt folks folks no interruptions let him finish and then you may comment afterwards Mr council president thank you thank you Dave come on let's show respect okay U mayor did you said you you waving your hand did you want to com I just wanted to the only thing I would like to point out I know Council councilman Sosi pointed some to some um resolutions regarding performance guarantees every one of those developments were approved uh under the prior Administration some of them under his guidance at the planning board uh there is one development in there that is residential and that one was approved uh during during 2023 during the hill Administration um so just to answer that for you Dave uh and as far as the taxes on the downtown Towers is concerned uh there was no such Revenue I believe at full occupancy with all those apartments uh it would be then around $380,000 a year but if you took a $60 billion building and you used the regular tax rate on it you would find that that that they were you know that 60 billion it's a $60 billion project Dave 60 60 million excuse me $60 million project 60 million 60 million so if you were to take the $60 million and you were to multiply it times the tax rate you would find that that would be very very much higher many times $380,000 so I just wanted to clarify that for you since you decided to speak on the matter but I I'll finish my during closing comments I'd just like an opportunity to speak let everybody else the count it's the council's comment time thank thank you councilman nerson I've been uh working with the just believe group and uh I was made aware that their keys were taken away from them and I was just asked to find out if if there it was any what was going on with that no one's keys were taken away but the warming shelter uh closes in March it's it's as far as keys are concerned I don't know it's possible that keys that they needed different keys for the radio club hang on there's a radio club in there they have to be able to access it so I don't know if something happened with keys but I'll I'll look into it but as far as they still be able to use it as a warming shelter this winter in the fall uh I believe their contract is up and we'd have to discuss the matter so okay anything else that's it councilman Lin this uh this Administration decided that they were not going to allow the building the high-rise buildings downtown I was 100% behind that when I came in and agreed to sit here uh that's been accomplished now there's not going to be that highrise there and I think it does save the Integrity of the river so we can see it now we don't have to worry about it being blind uh we voted on the shelter the shelter was something that I agreed with it's been a complaint for the past four years five years that I've heard it and there was a lot of issues with it we decided to just not do that anymore let the county administrate it they know what they're doing they handle it better than we did and over the course of the years many managers have tried to straighten that out and couldn't do it so you pull a plug and you make it go away so it's not something that the township fails on and also cutting the taxes we were we're going to get a flat budget I don't believe the budget went up any higher than what it normally would have and we did not increase taxes on anybody there was no pulling from the reserves to make the tax base it was done with cutting all the overhead that we could and still be a reasonable Township uh yes I did vote for all that and yes I will vote for that nobody told me to vote for it it was my agreement when I first got on this board to do the things that I said I was going to do and stay in line with what we plan planned on doing in the beginning so yes I did vote for all these things and I'm not unhappy about it and nobody told me to vote for that Council say uh thank you Mr President Mr lman Lynn even Dave with all due respect please do some fact finding on there because our things are a little jumbled or confused in there if I remember the budget correctly uh there was a we borrowed 3 something million dollars more from our Reserve and our budget was on top of that another $1.6 million uh higher than the budget was the uh from the prior year so just double check all that uh Miss otou we're not saving tax money if we're spending money on fireworks and concert series to entertain people so they have no idea what goes on in these [Applause] meetings but just please I mean I don't I don't profess to be an expert on all of these things or have a perfect memory on all these issues but go back and check what Mr Lin said and uh and what Mrs tool says or even Tom and Dave or even myself uh and get the facts straight um because it does get confuted over diluted over time um couple months ago when this whole crazy boots on the ground CSO um argument came up I said what kind of fool would let a $400,000 Grant go away for a mutual service agreement with an ambulance with a with Island Heights for for initial uh csos I figured out which fool that is because that same fool just let a $5.6 million build grant that we got from the federal government in the state for improving our flooding problems down town and adding a circle to help relieve some of the congestion downtown a grant that's been in work for years and that this Administration allowed to lapse so he can spite somebody else it's crazy how he's hurting everybody else uh so he can try and claim some sort of Victory on it the um the the other part of that is not only did he lose that Grant we'll never going to get that back being a Republican uh town in a uh in a Democrat State um is that it's going to cost us at least $800,000 to pay back the part of it that we had to we had to put forth forward on this thing so that was a pretty pretty foolish thing I cannot understand why what don't even answer me please what kind of logic would you you would use trying to do that um I already spoke about the fireworks it's crazy um and then talked about Lynn again with the you know saving taxes this guy's put out more PR at thex taxpayers expense than anybody else uh we just got another letter in the mail today talking about how he killed the two 12-story buildings there's never been two 12-story buildings so I'm really happy he accomplished killing nothing um he also mentions uh you know uh improprieties or something uh with Silverton csos he campaigned not campaigned he touted we need more boots on the ground and he lied to you he lied to all of you and you don't know it he lied to you it had nothing to do with putting more csos on the ground because at the same time his goal was to eliminate uh Silverton EMS a a service that didn't cost the taxpayers anywhere near what it cost to have uh paid staff doing it so as he's talking about saving taxpayer money by cutting some of the public things he's raising our taxes uh or the cost of our CSO program at the expense of a of a of a nonprofit agency that was doing it for pittens a company that has been here for 60 years providing the service to this community it was not about boots on the ground or getting an ambulance on the island yes maybe we're going to get an ambulance on the island whether we need it or not but it had nothing to do with it so he lied to you same fool thank you councilman lamb just want to say that um last meeting the vote for the open space at the Boat Works was a excellent Victory because open space for I guess the majority of us on here is it means something it means something that we need more access to that Bayfront it means something Jim where when you voted not to that last meeting it just shows that you really want development downtown you want a North Jersey developer to come down here and build skyscrapers you know 260 300 apartments and that's not what the voters want the voters of Tom's River want open space they want access to the Bayfront and that's what we delivered last meeting and you're not happy about it but the voters chose a new I don't know David what word you use there regime I guess you a new a new they wanted a new group of elected officials that gave them more open space more access to the bay and that's what we're going to deliver I'm not going to answer any of those other items because I don't even know where you're going with any of them I don't you don't really make any sense every meeting it keep getting more and more uh a drift we would say I guess but um we're going to keep the fight up for more open space and more access to that bay and I think that's what the voters want thank you council president if if I may council president I believe you're on I would like to announced that my Administration recently terminated the high-rise development project downtown at the site of the Old Red Roof Inn we began taking legal action against the developer of the tower projects in early May capid dagia proper properties the developer of the towers did not have their permits in place by the contractual deadlines this was not the first time that the developer missed those deadlines they also missed all their deadlines last year under the hill Administration mayor Hill could have pulled out of the deal then but Mo extended all of their deadlines by one year when the developer failed to meet the extended deadlines again this year my Administration put them into default over the last 90 days the developer has not once reached out to explain how they plan to cure that default on July 1st the developer also failed to demonstrate that they had acquired the necessary financing for the project so we notified them that that they had defaulted on that obligation as well the developer responded to the township stating that they had not gotten their financing and would not be able to do so within the contractual time frame so we exercised the Township's right to kill the deal as per the [Music] as per the contract the property that Mill gave away for just $1 will revert back to the Township in 60 days as to the downtown Loop public relations and Silverton EMS the downtown Loop Grant was a grant that was going to be used to put in all of the infrastructure necessary to implement the down Town Redevelopment plan a plan that allows you to build up to 150 ft that's 12 stories gym um residents of Tom's River are not interested in seeing Tom's River become a city so shortly I'm going to ask this Council to support changing that Redevelopment plan uh and eliminating 12 story Z zoning as far as public relations Jim uh the prior Administration had three public information officers that cost us in excess of a half a million dollars and they had also contracted with another entity for $60,000 a year uh we had budgeted under $100,000 for public information which is what pays for the letters and some of the Flyers we had sent out oneth oneth of a budget that you voted for uh under the prior Administration except rather than people sitting around and posting twice a month on Facebook and collecting $100,000 a year we're actually sending information to the residents to keep them informed uh as to Silverton EMS uh I've been pretty clear with the press and with the public it's been referred to the Ocean County prosecutor's office um Financial abnormalities uh that we looked into and saw uh we were advised by legal council that it should be referred there and we cannot comment anymore and I believe uh legal council would would probably advise you of the same uh that's all I have for this evening thank you council president thank you mayor um I just president I just have one followup question to the mayor please is um just just so who's working on the property now with the bulkheading the bulkheading uh was started after they were notified I I can only speculate I rather I won't speculate as to why that was started after all of this occurred but I do believe there's a separate uh a separate permit for bulkheading and excuse me Dave let me just finish there's a separate permit for bulkheading and of course I'm sure you know being on the planning board as long as you have been that um projects these developers have contracts with other entities and you know they may have to follow through with that contract despite us pulling out uh they may have obligations to whoever it was that they hired to do the bulkheading but again I'd be speculating um so I'm not I'm not going to do that but I'll just offer that I just want to say I think it's going to get ugly uh they're probably going to want their money back and then what money would that be Dave for the bulkheading well I I'll leave that to legal legal counsel to uh advise you can have a public answer or he could send you something okay fair enough and thank you for answering my question I I appreciate it and um I I just think it's going to cost a town lots of money in legal fees only time will tell fair enough if you for answering well as far as legal fees and and any costs associated with this I would just like to say that if you think about 300 apartments and $220,000 a year for public education what the cost on the taxpayer would be would far exceed to $380,000 a year at full occupancy and that's not including Municipal services so this was a very nice deal for the developer but not a very nice deal for Tomer taxpayers and they are the ones who missed their obligations and then they were extended by a year and they missed them again and after being put in default no one reached out to the town to say hey here's how we're going to get back on track so that's their contractual obligations and they missed their financing deadline and never reached out to say hey we're going to miss our deadline they just never sent the material uh and they've already stated that they don't have financing and don't see financing coming their way in the near future so um I've been advised by legal counsel that we're uh in a very strong position legally and and and that's all I have all right thank you thank you only time will tell true um I just want to say one thing about the EMS Services um I've had phone calls and my number got my own personal cell phone number got posted on a site without my permission and I consider that to be pretty darn low when they could have posted the Township phone number that I'm assigned to so that that was kind of bothersome the other thing is if anybody thinks that I'm going to put myself and my wife who has serious medical problems in Jeopardy for emergency services you are so wrong I would never support anything where I felt like both Betty and I would be put in Jeopardy and I just want to make that perfectly clear thank you council president I would also like to remind everyone that we have doubled more than doubled the number of ambulances the township has on the road um since we've gotten into office and we've nearly doubled the number of personnel we hired 18 additional EMTs I've been advised that the township has had never had a faster response rate and police chief little and EMS supervisor Kevin Monahan have also advised the administration uh that they believe these recent increases that I have implemented will uh will that we will have no interruptions in emergency medical services and that we are uh doing better than we ever have been before public comments remember state your name and your residence please for the record my name is it on it's on my name is Brian I'm B2 Consulting Group uh three months ago B2 Consultant Group in man Alin three months ago I came in front of this Council and provided another option for the animal shelter that organization was going to be offering animal animal shelter operations animal control services and a community C program those were services that can to be provided to the town what was not a made aware is the additional services that were going to be provided to the residents at no additional cost to the town those Services included a lowcost vaccine clinic lowcost microchip low lowcost spay and neuter educational seminars General pet supplies at a discounted rate a lowincome Pet Pantry Lost Pet recovery and emergency temporary boarding to this point I have spoken with Mr quinlisk Mr nerson and Mr Sosi and I appreciate those conversations I did speak with Mr lomman at the end of the last council meeting and I do appreciate that we did have a decent conversation regarding that uh the rest of the members and I I did spoke speak with Mr Coleman a little bit and that was it so unfortunately the information that you guys got was bare minimum it's unfortunate that the town is deciding to not look at the other options that are available to you guys outside of the county now for the more pressing matter as I said during my first council meeting that I attended here I am an expert in animal en tile for at New Jersey with regards to animal welfare and animal cruelty law currently the information I have from I believe it was a May council meeting that a Academy was tabled and not approved by the council the information that I have with regards to that is a Academy is actively working within the township and providing animal control services the issue with that is with 4191 1516b which is a state statute it's in violation of state law only the governing body has the authority to appoint an author authorized a individual to act as an animal control officer within any municipality in the state of New Jersey I have all the supporting bills from a Academy with Services provided I have police reports where a Academy responded out to and I will happily email them to every one of the council members for that information the other information that I have is the now I get I know you can't answer me so I'm going to just say it and I'm going to provide the ansers because I already know them Mr Coleman the requirement for legal council within a municipality is to convis and is to advise and consent on legal matters within the state unfortunately legal has provided the municipality with inappropriate answers time up you can get back in line and get two two more minutes thank [Music] you yes ma'am hi good afternoon I'm Jennifer how uh 22 Admiral Avenue um just two things one is I um hope you're all having a nice summer um I am coming on behalf of the students of tsserver schools um I sit on the board but I'm just speaking for myself we just had um the state send us um information that the budget we turned down um they overthrew our decision to raise taxes so we are moving forward as a Township um to you know go against the state we've done everything we can our business business administrator won another award just last week of how well he runs our budget for the schools and then they constantly turn around and tell us we'll find the money to cut so it's frustrating obviously we know there's politics involved in everything and unfortunately there's politics involved even with students so on behalf of um my own children who still attend Tom over schools and all the students in the community of TOMS over I cannot speak for the other sending districts but um I'm asking that the council um you know you jump on board with us in some sort of way uh for our students and contact uh the governor's office or state legislators and help us fight um a fight for our children our kids um we think we can't cut anything else from them if uh I've been working in other districts just as a substitute but when I see what other districts have that our kids don't it's kind of sad and I think our teachers do a phenomenal job to work with what they have our coaches 50% of our coaches in our district are volunteers so we wouldn't even be able to have a lot of the things that we have if it wasn't for the dedicated um teachers in our community so I would um ask um you uh president Coleman if you could reach out maybe speak to your counsel at some point and maybe just write a letter to the governor or something that would um you know stick up for our students and our teachers and our staff um we do a good job um in our district we win Awards we've had kids go to Ivy League schools division one schools um we have our orchestras and bands win win so many awards across the state and that's with we are the lowest spending District per people in the state and we do so much with with what little we have and I don't think a town of so many I don't think we should be treated like that so um just on behalf of the students of Toms River my own own personal I have four left in school still um the difference between what my youngest is experiencing and my oldest who graduated in 2018 it's so different because of the funding cuts and it's just not fair for these kids to have to have less than other kids when nothing has changed um I always say that kids don't have a political affiliation but unfortunately they get treated like they do they don't know if they're a Republican or a Democrat or an independent or a Libertarian or whatever green party um they're just kids and they just want to have the best opportunities possible thank you so much like to make a comment I would like to respond just one second councilman Lin I I agree I wish Jennifer had stuck around a minute uh I've raised five children in this town everywhere from 43 to twins that are 22 uh very successful adult education children's education I have uh two Engineers a lawyer and one just graduated Magnum Ki from one of the toughest colleges in North Carolina they got a very good basis here this unfortunately is a republican town in a democratically controlled State and the Abbott districts is where all the money is going it's paying for the Abbot districts to get really good services and really waste a lot of money because they can't get the kids to go to school there anyway it's a terrible terrible thing what they've done to the thas river school system at Board of Education and we have no control over any of that I would do anything that could possibly be done as a council person sign any document that we could send to the state I just believe in my heart of hearts it's going to do zero because this is not something that they're interested in thank you I think that um mayor I think that we could look into uh getting involved with some letter coming from the council to the state yes we also uh could look into some doing something unique that I have discussed before with Mr salonis and with legal counsel which would be uh going forward instead of these pilot programs that pay nothing to the school and everything to the township perhaps we should uh do commercial pilots for commercial type businesses and have the pilot go the complete other way where all of the money goes to the school system to try to balance out uh all of those Pilots were done uh from 2012 forward I believe it was like 1,400 units that's part of the school district's problem they lost a tremendous amount of funding we we created all these new complexes and they don't pay any school taxes uh so perhaps we can uh reverse that uh when when folks are looking to let's say Revitalize some of these strip malls maybe we can offer them incentives where all of the tax dollars would go to the school district thank you yes sir good evening Paul Williams Broad Street I probably should have brought this up before but it occurred to me today can't hear you Paul excuse me it occurred to me today um I remembered today that um the public comment portion is not required by any state law to be conducted at this point in the meeting the state law only required I think Mr uh Council can agree with me on this the state law only requires that some portion of the meeting shall be set aside for public comment and this occurs to me because I'm looking at the agenda as I've looked at it in the past and there's items on there particularly items that happen to all of a sudden fall under consent agenda and there's no public comment allowed anymore there's information that the public would like to have an offer to the council before you vote on things not after because at this point any information that we might have to offer you maybe Enlighten you maybe encourage you to sway away from a decision that's kind of been suggested to you it's too late you've ruled you've decided on a resolution without any input from the public and often times we can't email you before because the agenda isn't posted finalized until like maybe the day of maybe an hour before the meeting so the public you this council is not allowing for the public to engage with you and make comments never mind the questions but the comments you're not getting that information from the public you're ruling like a ruling class and you're not hearing from the public and conveniently the rules have changed during during this body from allowing the public to have certain items in the consent consent agenda pulled for public comment you no longer allow that and it's just peculiar to me is like why does this Council and with this mayor and his business administrator not want to hear from the public now maybe I'm wrong and maybe council president you thought that that's the way it has to be I think Mr Pascarella can inform you that it doesn't have to be that way you can do two things one you can revert back to allowing items on a consent agenda to be pulled for public comment and you can also change the public comment portion from the end after you've decided on something to before early on in a meeting once we've had an opportunity to look at the agenda maybe sometimes once we walk into this room and if it's posted when it should be posted then we can get it and maybe shoot you an email maybe a phone call before the meeting but you're not getting any input from us about things that matter to us we come up here now at this point and it's nothing but a bitching session because it doesn't matter you've made your decisions that's just my were my principal at The Vocational School um don't rub it in you and I got to be honest sir I'm very disappointed you were an excellent excellent educator uh you motivated all of us but when I come to these Town Council meetings and see this show that's going on it's disappointing to see it is not the person I know that you are to let this run around for example Council woman ool or vice Council vice president to talk down to the voters like you were doing before you work for us and it's disappointing and I'm going to be honest ma'am the whole platform of stopping overdevelopment I live in Tom's river right down route nine I come down in the past year since this Administration has taken over there's four new buildings going up on Route 9 it is getting overcrowded down there the traffic is ridiculous to get here it takes you 25 minutes and what used to be a 5 minute ride there overdevelopment has not stopped it has not stopped at all and we want to talk about saving money go to the go to the snug Harbor pool I was there a week ago and there were kids crying because they couldn't pay a daily admission to get in you have to charge the parents what is it 50 bucks now and then they have to get guest passed what are you talking about saving money for with these families they're paying more now than ever and I have to add one thing also you know tomus had four El directly elected administrations mayor bruss mayor kellaher mayor Hill and Dan rodri and under those first three administrations I have never seen a disrespect that this one shows to the public you can't even comment on the Facebook anymore we can't address our government on the Facebook are you kidding me like something is wrong here and we are telling you that is something that this is not right and you ignore us over and over again so honestly council president president as I said you were an amazing educator you were Fierce you always got your students in line with all due respect sir get your Council in afternoon meeting how do you choose that time for working individuals in Tom's River for people who maybe maybe it would have been a nice day they would have been the beach I mean 3:30 in the afternoon I I think that's like really again I'm not going to you know I'll just say one thing what's I'm just saying one thing I know it's not going to be real popular but honestly I was trying to give the community a chance to go to the concert and all to the fireworks maybe I was wrong and I will tell you right now I will think feel hard about ever doing it again we greatly appreciate that CU I think again and you know we've heard a lot tonight there's business to be done by this Council it's usually done once a month now you know fireworks concerts music all that stuff is great but there's business in this town eth largest municipality in the state to put a meeting in the afternoon when people can't make it because they work for a living and to go to a concert I think that's really you know poor taste to the members of this of the the council the the employees as well as the uh so I want to go back to you guys voted on two things tonight and uh you know I I think you were showing a great deal of disrespect to the residents of Tom's River on April 24th this Council had the final reading of the ordinance for the animal shelter it was approved on May 15th the petition with over 3,079 signatures was submitted to the clerk he verified that on June 26th based upon new New Jersey Law title 40 69 A-1 185 to 196 the council had 20 days to act 20 days that's July 16th didn't happen the petitioners reached out to have a meeting we got a response back that was inappropriate then we responded a we after July 16th to council mcgucken two emails asking what is going on no response based upon state law that ordinance goes to a referendum if there's no election within 90 days 40 days after June 26th that would have been Monday no more than 60 days so passing a repeal at this point in time you missed the deadline it's too late on top of that okay and I'm gonna I'm going to try to remember it when the Ocean County Health Department met about this ordinance okay they said two things one they said Tom's River needs an animal shelter the second thing they said was if the residents of Tom's River were successful with the ordinance they would not touch the animal shelter so I don't know what this shared service agreement you voted on tonight I don't know what's going on behind the scenes but I think that needs to be Revisited and this should have been done before you guys voted tonight you need to reconsider thank you [Applause] yes sir good evening Kevin gagan Tom zver New Jersey afternoon council president and Council I'm here to discuss Silverton EMS on Monday July 22nd mayor Rodrick ordered Chief little r to letter to fire district one business administrator Brian Cabell to stop dispatching Silverton EMS immediately he ordered the chief to do it because he's too much of a coward to do it himself no reason was given after the overwhelming negative public backlash mayor Rodrick had to create a story to try and control the narrative to suit himself he produces a statement legal has advised him there are Financial irregularities that may be criminal and it will be turned over to the Ocean County prosecutor's office I demand to know and the public has a right to know what are these Financial irregularities you as elected officials are responsible and liable for your actions and liess accusations I would like to point out the crafty wording Dan uses I would it would be akin to me stating someone told me you're a serial killer so I referred it to the prosecutor's office investigate doesn't mean that it's actually being investigated and leaves out leaves him the out to blame somebody else that somebody told him that simply stating it it does not make it true and certainly it's no less livess EMS problems are not unique to Tom's River it's a problem throughout the state and even Nationwide it would be une easy to ask why I did not fix it during the four years that I sit on the council and I'm going to tell you why each time a suggestion was made pointing out the flaws and issues or to improve the services of emms I was cautioned by our then legal due to their CSO Union filing constant ethics complaints threats of DCA complaints conflict of interest so unfortunately I just had to watch the train derail and that's where we're at today the train has derailed after the Republican party in June of 2023 the following Saturday June 10th at 8 A.M I met mayor-elect then Dam rodri at Silverton diner with another councilman it was an attempt to extend an olive branch it was clear to us then that Dan's Vision was to just destroy our town at that meeting he had asked me to come to work for him to run the EMS program as he knew it was a problem and it continues to be today and at Silverton we were successful he even asked if Silverton would cover the Barrier Island for quarter of a million dollars I told him give that money to Trio they can cover it I also informed that I had no intention of seeking any public employment even offered me a Township car a benefit with which he's infatuated with had I accepted his offer of employment I surely would have quickly become an addition to the ever growing list of people leaving their jobs as they watch this dumpster fire grow it's also become quite clear during this meeting that DPW would soon be in his crosshairs pay attention he'll soon be looking to eliminate jobs and privatize their service then mayor elect Rodrick was given several other suggestions on what he could do simply without increasing the cost of this program however the toxic culture of the township EMS program began many years ago when a certain councilman forced his niece and nephew to be hired they started the trend of workers comp claims and it still exists today it's a well-known fact that with prior to hiring the new people 16 full-time EMTs they lose they've lost more hours in one year than all of DPW and the police department combined 16 people your time ticking Ellen Davis 2325 hopson's Boulevard Tom's River excuse me I'm here regarding The Snug Harbor pool the Tom River Pool was bought with Green Acres Grand and has to follow the rules as stated on page 93 and 94 of their rules you must have a daily pass available without the need to have a season pass or the need to be accompanied by a season pass holder I spoke with compliance manager Kevin Applegate from Green Acres and this needs to be corrected immediately if not I was instructed to call him and they will open up an investigation into this matter the pool also has not to have comparable pricing to other pools according to the rules $30 for a non-resident up to $15 from seven for a resident I as a senior can't even afford to take my grandchildren there a couple of times a week it's ridiculous and I think all this is to deter uh non-residents from using the pool another complaint was from The Snug Snug Harbor residents that it was getting rowdy at the pool so for the Oprah act I obtained all of the police records to the pool there were six in the past four years for any kind of rouesse so that tells me it has nothing to do with the pool and I think this is just a way of Snug Harbor getting back their pool and eliminating residents and non-residents from using the pool maybe that's why your concession stand wasn't making any money because I've D driven to the pool a couple of times it's empty ma'am excuse me for interrupting could you step a little closer to the microphone because thank you very much I couldn't even get in pool I didn't even know that you changed the rules you put you stated all the the cost of the pool and then when I go to use it it was changed to having a season pass so I had to turn myself around with my granddaughter and go back home I'm a taxpayer I'm a resident and I I have the right to use that pool without a season pass I have a copy to all of you of the rules not rules rules rules I also have comparison of pools and prices that you have to be in comparing right I also thank I need an answer as far as the the daily passes with the rules ma'am please speak into the microphone please I need an answer as far as the grant money that you have to have a daily pass you can have a season pass but you must have a daily pass yes because anyone in the state of New Jersey can use that pool under the state's Administrative Code there's no requirement Snug Harbor Grant it's on there I spoke to the compliance manager look at the rules and we we looked into the admin the state's Administrative Code prior to implementing these new policies look at the paper because I I just spoke to them sure but I have the administrative law code book in my office so well they work ma'am excuse me you're ma'am your time there's a lot of issues with broken glass um a lot of there's a lot of issues so that was made uh last about a year and a half ago but you know what we'll revisit it we'll look at it right cuz she had given you not that that's what I'm up here for given you the O the reason I want to answer ma'am could you wait and because we need the reason why I'm up here is not a big deal that's okay I'm just saying we because we need your name and address before you speak my name is Beth I actually I live in Bayville uh Beth Bush I live in bville um I was listening to the fireworks thing about the budget yes and just out of curiosity in Berkeley Township they do a mayor golf outing and that's what pays for our concerts fireworks it's not out of the township taxes so I see a lot of people are upset about spending 5,000 this day 5,000 that day 5,000 this day we do it twice a year with the fireworks every other week There's a concert but that's all paid for through the mayor's golf outing it's not paid through taxes now I heard the budget was $150,000 for these concerts up to possibly spent 35,000 I was just curious if that's something you guys would consider doing a fundraiser to pay for these because it seems like a lot of taxpayers are getting upset by the dollar amounts that they're spending on the fireworks to have doing a fundraiser which is would take away from the taxpayers having to pay and fund for this and use that money elsewhere whether it be the shelter that everybody's complaining about or fixing a road that you don't have the money for a budget it's somewhere else instead of it being but so that was just a thought maybe it's something to do with a mayor golf outing knock stuff out have a good time um and use that towards your moving Night concerts at the park it's not a bad idea would you like to organize it I I would have no problem with doing that I it's legal I don't think it's Tom River but I'm sure there's several Council who could or other people we we did Mr shik used to organize it all the time and they did it every other week we have them at vets Park we over in South seai Park and it's not taxpayers money it's all done through the fireworks at the beginning of the year the fireworks at the end are all paid through the mayor's golf outing well I just say one thing let us look into it okay is that fair I just noticed a lot of people are and I would be upset too with $150,000 for a firework or 35,000 what you've spent now um let us let us let us look into it okay I wrote it down let us look into it okay yeah because every year they had the is vastly lacking accountability and transparency I was here in the winter time at the meeting the public meeting talking on the floor right here and I was lied to point blank in front of an entire room full of people now I want to show my friends that our Administration is a bunch of liars I need to I need proof because the township hid all of the council meetings that I was at from YouTube they're hidden I've never I've been coming to these Township meetings through three different administrations and I've never seen a lack of transparency or accountability so bad and and all the time you you guys are hiding things from from residents you're you're holding meetings at time you held you guys held meetings Zoom meetings you hold you held Zoom meetings for Council meetings yeah yeah yeah and and now you're moving it to in the middle of the day when people are working it's very dishonorable call that meeting was interrupted and we had to reschedule that meeting and that's the only meeting talking I only have five minutes go ahead um three minutes yeah you told me Point Blank mayor Roderick that you were not closing the animal shelter cuz I said to you you're going to you're closing oh we're not closing the animal shelter that's not true that was a point blank lie to my face I do not appreciate being lied to okay second of all the cost of things are going up you said the food at the store is is going up uh if if the price of things goes up 10% you can't just cut 10% of the township Services you can't cut EMS cut police cut the the cut the uh animal control if prices go up the township has to adjust for that you can't you can't keep the the budget flat if the cost of goods goes up 10% you're going to have to cut 10% of the township services and a lot of people live here because it's a good town because of all the services we have and a a lot of people are losing losing trust in all of you guys and I'm I'm I'm speaking for a lot of people when I say this the the lack of accountability hiding things hiding videos claiming you want to keep the budget flat but you're spending $150,000 on on bands and fireworks but you're but you're cutting EMS where where's the nearest EMS station now I live in Silverton I'm close to Holiday C City Silverton where's the nearest EMS station now sir your time is up you can get back in line if you wish [Applause] uh uh Julie Adamec 69 Cedar Grove Road in Tom's River um the uh potential fin uh potential criminal Financial irregularities that um are uh being uh are being misdirected towards the Silverton first aid and I actually think that they uh are should they apply to this uh new Township Administration that came into uh office in January the town uh Administration is exhibiting weird behavior and it's a situation rape for fraud and Corruption and some of the there's a lot of telltale signs of potential criminal Financial irregularities going on in this building um not the it's uh there for example circumventing the $44,000 ru rule um and a prime example is hiring a Academy even though that was tabled by the the uh the council uh uh uh PR you're using that as a loophole to avoid Council and public oversight um you've just as the past resident said you're reducing public transparency uh the public comment session has been reduced to 3 minutes uh you're repeatedly changing the meetings it's like a moving Target when is the meeting going to be what day of the week what time of the day you're not posting the videos of the council meetings for almost 6 months the website was out of date for almost six months we still have Mr salonis listed as the acting Chief Financial Officer when I look today at the website uh that uh that is uh that to me is bizarre there's no secretary listed for the mayor um I believe there must be somebody uh taking uh his phone calls uh you're throwing residents out of the meeting but yet the mayor has been allowed for months to be able to do T temper tantrum rant and he stays in the meeting um all of this seems to me very very weird and very very unusual none of the meetings I ever attended in years past were conducted like this there's not even any it doesn't even appear to be any executive meetings between the mayor and the council prior and the council members are coming in cold maybe getting the agenda an hour or two before being asked to vote on issues they know nothing about and instead of being acting e ethically and uh tabling these issues they know nothing about they just go right ahead and vote for it not even knowing what the heck is going on and then they find out later that uh an attorney is hired to represent the town that actually represented the mayor in a private matter but they didn't know because they didn't know what was going on uh then [Applause] you Mr Coleman how are you fine Chris uh Chris Raymond 111 fla Street uh Tom River New Jersey I'm actually one of the petitioners I came late because I have a job I actually had to take vacation time cuz some of us do have to work I'm sure you understand that Mr Coleman where are we at that with the petition that we had certified by the former clerk Mr Krug can you tell me that can anybody tell me the ordinance for the animal shelter yeah the ordinance was repealed about an hour ago so that what is that mean first V was repealed what what does that mean sir I'm asking you so we're not going to follow the petition of 4,000 plus people is that right the petition was to repeal the ordinance there' be no reason to right you petition are we going to keep the animal shelter open under Tom's River can you answer that question Mr Coleman actually I should be directing my question to what we're going to get into we're going to get into an agreement with the county to continue to run the shelter if people would like to do that so you're not going to follow what 4,000 people ask you to do well actually it wasn't 4,000 people but that's not the point the ordinance only dealt with leasing the shelter to the county okay the there's no ability of the public to prevent the county from running the shelter everything that the mayor said here about the shelter uh staying open that was just never true is that right Mr no is that true sir it is stay open I I think that I think that's the big dichotomy here and the Ridiculousness of this is that I'm not you petitioned well you asked a question you can have your 3 minutes back when I'm done you petitioned this Council to repeal a lease we repealed the lease we stated that we were going to hand this over to the county and it would not be closed your petition forced the closure until we gave it over to the county now we just gave it to the county we just gave it to the county and it will reopen you can absolutely have your time but I I can have have if you want to answer questions do you want the question answered so your petition was against the lease we repealed that lease we just passed the shared services agreement for the county to run it this is who's running the County shelter or the township who's running the shelter shouldn't matter it should be about the animals and and we're already paying you sir came up here upset about tax dollars not going to the schools and yet you want the town to spend a million dollars a year to keep to cover to run a shelter that the county is willing to run for free right so so so the question is here is who's going to run the shelter and who's going to open the shelter and the answer is the county is going to run it for and I know there were people here that were workers that were upset [Music] s sir remove her from the meeting remove her from the meeting so so I know there were there were very passionate people about this issue but when you really think about it it's really about who's running it and not whether it's opened or closed because it's going to be opened it probably would have the renovations would have probably been done already but your petition actually put a stop to that so you may us to repeal the ordinance we repeal the ordinance oh all right all right so like I said you you're worried about the schools we shouldn't be wasting tax dollars for redundancies especially given that we were not doing a good job running it and I've expressed that opinion I've explained to the public in letters which is why this room has dwindled there's a handful of people here associated with the animal shelter there a handful of people who come here tied in with the previous Club mayy excuse me just one second if you're going to yell out we're going to start picking people up one by one said I've said enough I've said all I've had to say this this small group associated with the old club and the animal shelter don't represent the People of Toms River they represent the small group which was evident in the last election all right Chris finish your Mr colan I I Mr Mr Rodrick seems to think that I'm consumed with Mr Hill I have no ties to Mr Hill I would not waste one minute coming to a council meeting and watch Mr salanus laugh and shake his head if you didn't cut the police if you didn't cut silver EMS if you lied about the animal shelter what's going to be next the fire service is going to be cut this is our town I'm gonna because I don't want to be cut off here we St Joseph's had a a pastor probably about eight nine years ago I won't give you his name but he tried to hurt our parish and what did we do about it we went and spoke to the bishop ship and I reminded the pastor then and I'm going to remind everybody up here whether whether I support you or not that you guys are just here for a certain amount of time we are here for the Long Haul so whatever you're doing it's not going to survive and and M Mrs otou or if it's Miss otou excuse me you should be most worried about what's going on and I bring your name up because by this decision which I don't think is actually factual about anything about $1 missing by Mr gag first aid Squad it's not his Squad he oversees it by that Squad not being in service we are down three ambulances 247 6 cmts so I can assure you that when people don't get help that officer and that officer will be on scene longer because we don't have first aid and my last comment would be to the gentleman who's asking where the nearest rig is coming from it might be Tri barel it won't be Island Heights but it might be pleasant PLS it might be downtown but I can assure you silveron EMS being cut off is a bad decision you've already hurt this town enough Mr Coleman I'll leave you with this the gentleman that said you were a good principal I know you were my father knew you you can do better than this and don't let these people railroad you and don't let them talk down to you because this is our town and long after you you're not up here anymore we're going to be here my kids we're not leaving this town so he can disrespect me all he once but this is our town it's not anybody's Town up here I can assure you that good afternoon I'm Liz Doric I live on Pheasant Lane here in Tums River and I just have a comment to make and it's about the Silverton EMS situation the it's very vague with the letter I got today from you Mr rodri um you know and I understand that with legal matters you can't divulge too much but my concern is is that perhaps it was premature to stop dispatching Silverton EMS based on the possibility of financial wrongdoing if if it was a situation where they were not doing a good job in saving lives and you were saving lives by stopping a service that saves lives maybe then you could have stopped dispatching them but I feel like you all acted like the judge the jur and the Executioner when it came to Silverton EMS services and I just wanted to mention that because the fact of the matter is they do save lives they are the boots on the ground and I think that it might have been premature and if in the big investigation that the prosecutor's office is going to be doing they find that they did something criminally wrong financially then so be it but right now I feel like it was a premature decision ision to stop life-saving Services based on a well they might be doing this and I just wanted to mention that and I do want to thank you all for your time and I also want to thank you all for mayor and vote in his favor regardless of how insulting his actions are towards you two legally certified petitions presented to you and he overturned both on his own without your input shame on you for allowing this to Mr Coleman who month after who I didn't know you were going to get picked on so much today but to Mr Coleman who month after month asks the mayor who no one really wants to hear from to address our concerns is obvious to all of us that he is the only one who could address the issues because most of you have not been presented have not been presented with any of the information shame on you some of you will accuse me of quote being a mohill hack that is angry her man got the major boot this was posted on a Township Page by a Pio the township pay on the township payroll this character is who the mayor thought would be a good replacement for the most decent lady in the township Jillian the one who ran the page with class Grace and dig it Mo Hill hack this guy couldn't spit shy Mo Hill's shoes MO is a true gentleman with honesty Integrity morals and values that respects each and every one of the citizens of this township am I angry no I'm furious and heartbroken I'm talking that this mayor has single-handedly destroyed the family hopes and dreams of over 70 families some by wrongful termination and others for to walk away from a corrupt government because they had too much Integrity to stay here not to mention the 30 additional EMTs that were laid off because of his abrupt closing of Silverton EMS families trying to put their children through college families with small children now have no health benefits and worse over a 100 people let go in this economy my goal is that this entire world will hear the stories even after he has either recalled or forced removed from the office and expose this evil monster with no heart and soul for who he really is we all deserve that so after all your lawsuits are settled in your favor we will you Den the governing body of the municipality shall within three years of the effective date appoint a certified Animal control officer not the administrator not the mayor the governing body for the other statutes I have named previously we have an animal control officer you have one you also have a Academy who I've indicated who I will show you the documents later are acting without the authority of the council is that accurate No it's not so they're billing you guys for services that are not there the police department is having them respond out for services that they never went no that's always that's always been the case it's we were told that's always been the case it's not we were over a thousand over a thousand call my time what they do they do this folks let's let this gentleman finish and then you can comment Sergeant what I do want to say and I've addressed my comment to the chief is under the special order that you guys have to conduct animal control services that you guys are not trained or know what you're doing I appreciate you for you guys to actually do those services that you guys shouldn't be responsible for having to do so please pass that that Praise on to the other officers that are in your charge it's unfortunate that your officers have to do the services that they were not hired to do they were not trained to do and it's because this Township decided to terminate three acos that are trained and certified by the state to conduct those Services as I have said the other three Council meetings you guys can reach out to whenever you want when Mr mcluen I believe is the other attorney is when he gets back from vacation I will reach out to him as as I've been told he is the primary attorney for the town and I'll also be referring oul councilman lman and you talked about you wouldn't be here and you wouldn't be supporting the decisions if you didn't believe in them and I keep thinking about the fact that when it came to the police department it didn't end up it didn't end up with your vote when it came to the animal shelter it was shut without your vote council president Coleman you talked about you and your wife you would never make a decision to jeopardize your family you would never make a decision that would jeopardize the people of Tom's River and you didn't make that decision you didn't shut down Silverton EMS it was shut down by the mayor I think it's already been discussed tonight about how it's Loosey Goosey or whatever probable is but it jeopardizes the health and the safety and the welfare of Tom's River and you did not get a say I think you should be pretty pissed off about that because you run this town you run these meetings you are the council I was going to ask a question but I'll just throw it out there you know look at the Township Code your responsibilities as council president as Council vice president as Council people you have responsibilities and the mayor has responsibilities and if you read his responsibilities it says based upon your approval so when things happen behind your back you should be pissed you shouldn't just say I support what happens here because you should have a say of what happens couple other things I wanted to talk about the build Grant completely misrepresented okay that bill Grant was not for redevelopment issues it is to raise the elevation of downtown to improve the elevation and the and to improve the fact that we have a flooding problem it was to change traffic flow in conjunction with the county and the state all came together we got some ridiculous millions of dollars with a Democratic mayor and a Democratic president I don't know how that happened but now we just threw it away it had nothing to do with development the the Ocean County planning board approval of the capid daglia property clearly states in there okay that you have to figure out what to do because the bill Grant is now gone it doesn't say you can't do your building because the bill Grant's gone it basically says you have to look and make sure that you protect flooding and modifications of things but it had one had nothing to do with the other the county was smart enough to say it's now gone you need to make sure you handle it when you do your development um there were some questions about I think uh councilman lamb talked about open space last meeting I'm not coming back have a good night thank you Phil appreciate that Kevin gagan round two and I'm prepared to go three and four if needed okay uh I was speaking about the workers comp issues one of those employees happen to be out at least nine years nine years out of the 18 years he was employed only because he was related to a prior counsilman they're currently being paid disability Township health benefits and me another one you have a current CSO that's bragging how he's going to be going out on disability um in January 2024 them retiring Captain Mike Miller uh had made some uh comments regarding silver EMS and uh I won't get into under his ineffective leadership most people are happy he's gone what did he say Kevin what did he say interrupting my time or reset the clock um again uh not knowing EMS and how it works um whatnot so every policy decision he made without the chief's knowledge was reversed the let me be clear this is strictly political retaliation against me and only me by doing this you're not attacking me you're attacking the whole Community I cannot and will not not apologize that Silverton EMS is run more efficiently than the township program the mayor is using tax dollars to settle political vindictiveness and attacking a political opponent and putting the lives of Silverton residents at risk at a recent meeting you guys awarded a contract to an EMS billing company that billing company their bid was actually $110,000 more than the prior than the lower B uh billing company I don't even want to get into that I knew I knew mayor Rodrick was uh lying not because his lips were moving moving but when he mentioned that he spoke to mayors of other towns one of them being Lacy Township and and the mayor you know Lacy uses them the mayor of lacy wouldn't know because Lacy Township first state and lenoa harbor first state operate just like Silverton does or triar or Jackson so we knew uh we knew uh the mayor was lying again shocker um last year o OWN Oprah requests show that that program lost 1.3 million 1.3 million it was running in the red unbelievably there is no State stat statute that a Township is required to provide EMS and that's what brings us to a lot of this frustration today I think at this point the township should just privatize it regarding the concern over a wait for an EMS response I empathetically State no one no one has ever waited 30 minutes for an ambulance I do understand that when someone calls 911 it feels like an eternity waiting for that help to arrive rather than relying on the disinformation being spread I'd welcome you to review the actual records to reveal the truth in closing I also find the timing of the mayor's actions highly suspect recently I filed a complaint with Medicare over fraudulent billing practices undertaken by the township and their a failure to correct them as part of my complaint I indicated and I had serious concerns about retaliation shortly after my fears became reality as sils was removed from service rest assured I followed up with my complaint as this has now become a federal whistleblower action I'm I'm I'm I'm I'm happy to see that the clerk is I'm happy to see that the clerk is still here when he was walking over there I thought he already walked out already time your time is that's fine I'll be handing the clerk a Tor notice uh filing a law [Applause] let's let this let's let young lady speak Ellen Davis 2325 hopson's Boulevard according to the uh the D Green Acres Program rules on page 93 yearly seasonal monthly weekly daily single ma'am again you got to get closer to the microphone okay yearly seasonal monthly weekly daily single use or hourly however if the local government unit or nonprofit establishes yearly seasonal monthly and or weekly fee it shall also establish a daily single fee for the pool so I would like to know what rule you have that's the same provision that I was referring to we have a daily fee but I no it has to be ma'am microphone come on without a season pass you have to allow a daily pass because it's open to everyone in the state of New Jersey that they will be calling you okay that provision doesn't state that but they were in contact with us a couple of months ago the rules unless you want to pay the money back now another question I have is why are you not allowing a daily pass I would like to enjoy the pool a lot of seniors have been on social media that they haven't been going to the pool because they can't afford they don't go enough to pay for the pass why can't you have at least residents have daily pass there is a daily there is a daily pass and there's a season pass pass holder and I think the season pass is $75 for the entire year $75 for a senior for the entire year so um again expensive did you want me to answer this or not if you don't want me to answer it I won't yes I do you don't have to be derogatory okay um the this entire room was filled twice while Justin and I or councilman lamb and I were on this council with residents in the neighborhood uh upset that when uh we would see um for example rip tides or when flies were really bad that the the entire neighborhood was filled they complained about uh all kinds of things occurring in the cars they talked about people using drugs breaking bottles blasting music they complained about all these things at this meeting two separate occasions nothing was done we raised the rates and tried to push toward a season Model season pass model so that people who go to the pool have ownership in the pool and they feel like they're they that it's and they take some responsibility for for for their behavior we if if folks want to go someplace for the day and there are rip currents they can visit um I don't know the water park but people should not have to have their entire neighborhood filled uh every time there's a ripped current or the fers are bad and they shouldn't have to deal with people having relations in the car or doing drugs or breaking bottles or drinking in the parking lot and we responded we responded we responded to those residents and um and we pushed toward what other towns do also which most towns do which is we're pushing toward a season pass model there is a day rate there's a day rate if you want to go for the day come with it but you have to come with a season pass holder yes it has to be a daily pass without a season pass holder why we don't believe that that's legally the case that's the rules I will have okay well they can they can notice us if they believe that but I I stand by the residents of the community and the presidents of the community pay the cost so taxpayers pay the cost taxpayers of Tom's River pay the cost for that pool yes and we all would like to use it you can use it not without without a season pass buy the $75 season passed everyone else did well I can't afford it and I shouldn't have to how many times a year did you go to the pool before maybe go three or four or six times depending when my family comes down other than that I don't go down to the pool but do you have do you have a pool question no I do not okay do you have proof of all those calls because through the Oprah act as as councilman lamb said many of the complaints did not get documented that's their problem if there's no no it's not their problem we're responding to the resident I want to answer you too I'd like to maybe sit down with you and said you know there's always when you make any type of change there's going to be people that feel underserved or people that again we're trying to solve a problem if you think that we might have underserved other residents including yourself absolutely well I'll tell you what why don't you stay after the meeting I'll meet with you because I could tell you that I can certainly meet meet you at the pool and we could discuss maybe a better plan going forward that you would work for you and work for others I'm not saying we're not closing you off here I can tell you though that well I'm not I'm I'm going to answer you a year and a half ago we had a lot of problems we had these we had this council chambers filled with residents that live within a square mile that were saying there was a lot of issues well well can I finish can I finish okay that's okay well they came to the meetings there was no open request needed they just came to the meeting and said look we have a real problem well let me tell you what we had we had a council meeting meetings with several residents that were very upset dozens of residents they're actually forming like an action committee like yourself that wanted answers and I think we did have some cooperation for even those we didn't get along with that said we'll make some changes and we did make those changes but again if you're not happy with them I'd certainly meet with you and try to work something out going forward doubled the price and plus you know if there's no record of a police call then it didn't happen well you say that but when they come to Council meetings and say we we have we have real problems down there and let me finish Jim here sorry is anybody from out of The Snug Harbor area complaining or is it just a snug it's their neighborhood they live there they live familiar with the area obviously where the pool is and the transport when that when the PO when the pool was sold yeah the township bought it with the grant money I would assume that the town knew the ramifications and the residents knew the ramifications if you have the uh the the the fireworks and you have a couple Browdy people are you going to close it are you going to make it only to Residents with a I don't know firework pass well no let me just keep it let's just keep it to what we're talking about let's keep it to I can I interrupt Council lamb said he would meet with you at the meeting to discuss it okay H all right Mr I'll make it work for you I'll see you after the meeting I'm sorry Jim go ahead Mr call real quick I I appreciate your concern about the fees and it sounds like it is out outrageous but I do want to point out point out that councilman lamb just said that a couple of residents came to these meetings complained about a situation and he improved it but they've ignored everything else that everybody else coming to the council meetings has asked for change on and they're not improving just poting that out go ahead I'm sure you got something smart no Jim us you're you're a drift again but I'm I'm one of talk about is quality life issues are serious and we we take that seriously here but again if you feel like you're underservice by it I want to make sure we make it right all right can we get back on target here to accomplish the great things that we've been able to accomplish on top of that I'm hoping to come back here and be able to thank this Council and you mayor for allowing us to continue that operation now what we do at just believe is we take the homeless population that's here and we serve them we help them we bring them in from the cold we feed them we plug them into resources we have uh peer Recovery Specialists that are on staff I am one of them uh certified with the state of New Jersey we help get these people into detoxes and rehabs if needed uh we provide transportation to 12-step meetings whatever Avenues are possible to help their lives outside of here right and and to help them continue their growth now the shelter gives us a chance to get them plugg in the resources affordable housing uh whatever may be available to them Social Services you know we transport them there back and forth on top of that it also improves the quality of life of those individuals and Tom's River as a whole especially down here at downtown Tom's River where a lot of them like to congregate because of the library and whatnot so when we get more of them off the street it improves the quality of life for the residents here and those as well and I'm just hoping that we can continue doing that uh out of the building that we're operating now uh with your full support uh so thank you for allowing me to share mayor rodri I have a question Dan I have a question the uh that particular portion of the town that you said that they ran out of a contract contract lapsed I believe we were advised by legal council that their contract only went until 20 19 to 2020 correct I on that that is that is correct and it was a resolution it was more of a license through resolution but no one shut anything down because right now it's not winter so it's just something that has to be renewed again they have to we do have to start preparation excuse me I don't um this is not your public this is not your public time but but you want to speak go ahead but if you want I council president I had a question to the mayor is that something that's going to be re looked at again with another we're we're we're looking at it but they have to meet with us and we have to discuss okay so it's a procedural thing if you come in and and talk to him then we'll discuss the locks were definitely changed had very few incidents if any at all um currently right now we have probably about 100 100 plus people living in the woods what are those people going to do in the winter they're going to freeze to death I mean they're already dealing with 100 degree temperatures now um we have all of our equipment in there uh 5 years ago specifically Terence turnbach got the temperature rais from 32 to 35 and that hasn't made has made a big difference um we're open more nights than other count towns and counties um Tom you've been partnered with us I delivered I have your food in the car right now delivering it after this meeting um so over the last two years again so we deal with a lot of different people coming from mental health issues to drug addiction to um just just Financial issues and we've been able to help a lot of those people we've done probably I think it was 167 people in the Riverwood Park facility last year um we have facilities um restaurants that provide food every single night um every night we're open that come there this town would be losing a big who do you call you call Paul because I've been in the room with him when you call him when there's homeless people around here you quote Paul I've heard them answer the phone and you tell us hey come down and take care of this issue but now you're taking a resource or potentially taking a resource away from us I think I think you misheard what we said which was you you guys were supposed to have moved your stuff out of there in March we had a key issue that we needed to get keys to the radio club who you folks were supposed to move out of there to make room for it's it's not a permanent shelter it's a warming shelter that is supposed to be opened only until March so I am not sure why you're in there right now with or how you know that we don't currently have the same key but you guys are supposed to be done in March we are we don't operate out of that okay so then what are you talking about you just said you tried to get in there the other day no I didn't say I tried to get I said we know the locks were changed all you have to do all you have to so how would you know the locks come in and visit with the mayor he'll he'll talk to you about it and make the arrangements that's all nobody's pushed you out it there you finished in March so when you go back to talk to the mayor they'll come though there are a lot of seniors that the only opportunity they get out uh out of their house is to go to that Senior Center sometimes they get transported there and that's their opportunity to get that little newspaper they find out stuff not only about town hall but about other things that are going on in the state and uh in the town that might be recreational or whatever so you're doing a disservice to a lot of of residents including seniors um the stated mission of Tom's River apparently now has become uh that of a family destination although repeatedly we're Town told there's no money in town we still have money for non-essential fireworks concerts movies uh we get an extra uh skating instructor hockey instructor but we get rid of our animal shelter which I think is uh of use to more residents than having an extra skating or hockey instructor um the uh closure of the Silverton first AE uh that's a ruse uh that about the financial irregularities and the closure let's just think about it for a minute this is the same town that had Raco with a$ 6 million embezzlement and the schools were not closed down your time is up folks um it's uh 12 minutes before 6 I am going to people that probably live in Tom's River because with conversations that I was having with neighbors we were thinking we were going to get a letter for a variance so I did so I I looked up the zoning to find out that maybe for in the 40s when my house was built in the late 30s my house was on a 40 wide lot and I have another lot and another lot okay and then it became 60 wide lot so in 2015 and I don't know if this had anything to do with Sandy you know because so many properties were destroyed and let's put up three Place houses as Oppo four houses as opposed to two houses that were there or whatever but the town went from 60 wide to 40 wide again and instead of 5et between a property line and the structure it went down to four feet well no that's I don't I don't want to interrupt you but I because I just built over there and you're my neighbor um we're close enough right you Lily yeah you know the the combined set back was always 12 minimum uh four you know so had 48 you know you could do an eight but the minimum is always a four and then really I don't look at it with 40 wide versus 60 wide we always look at it like 6,000 square feet because you're deep there you know you're usually 150 deep how deep are you over there 120 a little short so you're like 4 I mean the math but about 48 right so what you're seeing is that you're seeing some people that are looking at the opportunity to build over there there's not much um land that you can build 40 wide is 40 wide 4 wide and you know my my poor neighbors that live across I'm going to have to look at this and my my neighbors that live right across the street from me they're on the corner um like they're gonna the point being is it's tight it no it needs to go back to what it used to be 40 wide lot all the people that are moving into Tom's River or into these neighborhoods where there's 40 wide Lots coming from Elizabeth or wherever they were coming from think they're in the country still ma' I got to cut you I get it I get it I really need to turn this to five minutes I'll talk to you not that I even share so you you you would like to see the zoning change is that is that your point no all these people are subdividing their properties now or the Grandma's died off and the kids don't want the property anymore so their s kids sell the house and then they put four houses on what where one house was I
