occupancy of the room and and why people cannot be standing yeah um the occupant load is based on historical data on the averages of time it takes people to get out of of a building an emergency it's based on the exit width how many people can be in here what's in the room um that sign is so wrong back there everybody looks at that number it's wrong because that number includes this being completely empty no chairs no Podium no fixed seating nothing so that number is wrong so what we have to do is make sure that we have enough room for people to get out if there's an emergency and to do that we have a calculation based on NPA National Fire Protection standard and in here we can have 54 people so what we did is we put 54 chairs in here that way we know if you're in a seat we meet the occupant load and same thing with out there we put I think 52 seats out there or 50 seats out there plus a couple extra ones in the foure area by the front door to give us some more overflow so the reason why we have the occupant load is because historically there have been bad situations that were really horrible out comes when people could not get out because of fire or some type of emergency does that answer the question yes yes it does so that would mean that people would not be able to stand or to sit on the floor am I correct correct because now they're they're blocking the egress that also means we can't go out there and stand either that that is at high occupy right now we need people to go outside the we're actually all here to do the same thing let's hear some dialogue logical Dialogue on how we're going to remedy this tragedy that and sir no one is doubting the intention what we're just trying to do is to be able to establish a safe environment to conduct the meeting environment is very very safe safe from a fire emergency standpoint so we have appropriate Ingress and egress I'm sure this building pass code we're just followed the National Fire Protection Agency rules and regulations have been adopted by the state is they were looked at every three years we're just following what's out there and that's the Florida statute that we had to [Music] follow let's just cancel we can sit here and argue all but going forward can we either fig the meeting becausee I agree sir we will definitely take a look at figuring out how to conduct and if we have to do something on the and if we have to do something on the fifth floor we'll see about making those arrangements for that because we do need to anticipate and be able to accommod larger than going to have a lot of work and a lot of hard work and we'll all get through it together thank you mayor I appreciate that all right uh chuck would you cover uh the substantial damages sure if I could mayor um and what I would like to do is include in with that in the city manager report so I'd like to get the report and then go into the substantial damage piece okay I wanted to just provide an update to the community and to the the commission that in public works the city is working or excuse me they are working on a commercial debris hauling contract that will be bought brought before the commission on the 7th of November bascule bridge is still not fully operational on Commercial power Public Works will be running tests in the coming weeks to move the bridge off of the generator power over and fire and EMS temporary fire station is fully functional in operation we have firefighters sleeping there 247 the administrative staff is operating in the fly bridge room on the fifth floor of this building and will continue to manage Logistics and resource allocation for the web or excuse me for the fire department and also for um incident command Emergency Operations deputy chief Brennan and chief bars are working rotating schedules to ensure we have staff presence set days a week for EOC Ops and fire department management Chief bars is also working with an Florida Department of Emergency Management lison to provide options to replace the destroyed Public Safety station over in the police department we are still having assistance from outside agencies from around the state to assist with postor activities in Park and Recreation debris removal is ongoing at all facilities and Parks we've opened the tennis courts 9 and 10 at Treasure Bay for tennis lessons but it's on a limited basis the aisle of Palms in roselli park are open for use and repairs to Turf at roselli Park playground began October 28th Park and Rick is also obtaining quotes invoices and mainten and maintenance for facilities damaged during the Hurricanes the city clerk's office asks that we pass on and remind individuals that we have a change of polling location as our polling location was the Treasure Island community center which has been affected by the damage and the accessibility issues from the storms to ensure the safety of the voters and to maintain Integrity of the electoral process a new polling location has been established that place is the temple bethl for the general election that will be next Tuesday November 5th the address is 400 Pasadena Avenue South and the polling hours are from 7:00 am. until 7 p.m. the city will be hosting a FEMA Town Hall tomorrow in this building building from 5:00 to 7:30 on the fifth floor with representatives from FEMA the county and that would be via hagri Consulting the their recovery Division and also our Community Development Department due to fire code restrictions attendant will be limited to the first 152 attendees the doors will open at 4:30 p.m. for those unable to attend in person the town hall will be broadcast live on Facebook accessible to all even for individuals with without a Facebook account to ensure a smooth and timely meeting attendees will be asked to submit their questions onto an index card that will be provided to them upon their arrival this will allow us to maximize a limited time and cover as many questions as possible for the community yesterday the city put in a mission for the Florida Department of Transportation to pick up debris and clean up the right of way areas along Gulf Boulevard in the city limits this mission was Exempted excuse me accepted and assigned so now to what was being discussed from substantial damage there has been a lot of discussion recently about items called option one and option two to ensure I get this correctly what I would like to do is to read directly from the substantial improvements substantial damage Desk Reference guide or the FEMA pamphlet 758 communities have choices about how to handle when making substantial damage determinations when many buildings have been damage damaged by a significant event one option is that they can proactively inspect buildings soon after the event and use available information to estimate repair costs and Market values those data can then be used to develop substantial damage determinations in advance of owners submitting applications with more detail or the second option is the community excuse me the city can notify owners of the requirement to get permits and then to wait for property owners to apply for permits and make substantial damage determinations at that time following their normal permit procedures the first option offers a number of benefits that should make it easier to administer substantial Improvement Subs substantial damage requirements one benefit is to provide Property Owners with information about the requirement to bring buildings into compliance before they get very far along with their plans to repair another benefit is that owners that have Federal flood insurance policies will be more quickly to receive the community substantial damage determination and they need that in order to submit a claim for ICC coverage to their adjuster the second option May pose more of a challenge to the community because many people begin repairs without getting permits in addition by the time the owners apply for permits they may have hired design professionals to develop plans for repairs and improvements that do not take into consideration the requirement to bring substantial Improvement or substantial damage buildings into compliance those are the options from FEMA that are available to our community unfortunately there's been some other verbiage that has been portrayed as options that the city has where the city can have a second option where they can immediately start issuing permits and that is not accurate fortunately what our staff has been doing is listening to the community and the community has said what they would like is to be issued permits as soon as possible so we're listening to the community and today the state deployed assets to start doing substantial damage assessments they've done over a 100 structures within the city and we have called for a second and third team to be deployed they're going to be working on a daily basis to do those substantial damage assessments right now we have also received more than 400 and I think it's approaching 450 permits from applicants so what we're doing at the same time that I'm saying this is that we are doing a portion of number one and a portion of number two what we're doing is doing substantial damage assessments while taking in the permits because we realize the community wants to get the permits issued as soon as possible what I would like to also pass on to individuals is that we're working this as fast as we can and as we receive the substantial damage assessment information from the inspectors they have to implement and input that information into the substantial damage estimator and what that estimator does is it provides an individual final substantial determination excuse me substantial damage determination for the property owner and it'll show in reference to the 50% rule where they stand below or above the 50% FEMA guideline for substantial damage determination with that and once that's completed permits will be issued this is a lot of information and individuals may not entirely agree with the process so what I also want to pass on is that there is a reevaluation ation process so individuals who do not agree with their assessment or the result of their assessment can petition and and just through a normal process have a re-evaluation done with submitting documentation to support that request that concludes my report yes so what I'd like to do here is open this up so that we can have a discussion um I know that Arden has probably a lot to say and and uh and I'd like to hear but Bob you first so let's go uh on the uh assessment and I take it the reference you made there was to the property appraisers assessment how how would an individual those who have had private assessments done which are certainly more than the County's assessment um how do you enter that into the when the individual applies for the permit they could provide that information for their private appraisal okay okay they should provide that information correct okay yes thank you yes I did hear and folks if whoever's going to be there tomorrow night you'll probably hear some of what what's being said but uh Mike Tweety who is the uh the pel's County property appraiser uh basically does say that you know if if you're uh if you're doing your assessment uh you're looking at everything and it looks as though it's going to be hyp always get that private appraisal uh you don't necessarily have to do it up front because if you if you see that you're you're good you're not over the 50% you're in 35% level or or whatever it is uh you're good to go and you don't have to spend that extra money but if you find that uh that it's running you're running a little hot uh please do the private appraisal even Mike tweet has said that uh every time that they do one uh on the private appraisal it is more than what you're going to see on the county records so that that you would need to do yep go ahead D just if you haven't looked into the private appraisal approach uh just yet I I talked to a couple of people on Sunset Beach have already hired a private appraiser and just for your information for comparison purposes the going rate seems to be about $350 to $400 for that private appraisal just you know so if you get something significantly higher uh you've got something to compare it to so anyway that on that particular subject but I do have a question for the city manager which I doubt that you're going to know the answer to because you weren't here at the time and neither were I but after Hurricane Adia in August of last year and the December 16th storm which of the two options did the city uh handle how how they handled substantial damage claims and those two scenarios recent scenarios commissioner I'm not aware of how that was handled at that time but I would ask if director yunan is available if she could come in and speak to that okay thank you I while we're waiting on that I'll if it's okay I'll I'll proceed with the other another question is the as you read those two options to us one of them the second one deed that you could the city could go ahead and issue permits and not have to wait for the phys for a physical inspection is am I interpreting that second alternative correctly no that is not true um it's it is not to be interpreted that way there has to be a substantial damage assessment completed before a permit can be issued right but not I'm talk I'm trying to differentiate between a substantial damage assessment and a substantial damage uh what was the term used determination inspection so and inspection is a component of the assessment so there's a substantial damage assessment that's done and that's one of the pieces of information along with value of the property value of the structure fair market value um and other components that are entered into the substantial damage estimator tool which provides the rating having to do with the FEMA 50% value of the structure and whether it's considered substantially damaged or not okay so it's it's the city's interpretation that either the options require a physical inspection of the house before permits are issued it is required to do a a substantial damage assessment correct requires a physical inspection of both options require physical there there may be there may be please please there may be individuals who would not like their facility or excuse me their structure or building to be inspected so individuals of course have the right to refuse the inspection to be done but there are other methods and means of information that have been provided from the county and the state that can be used in lie of the inspection I'm not I'm not sure how to respond to that other than like I said I don't think I've seen anything at this stage and and I know you and I had this discussion earlier today it would be helpful uh some of the responses you're hearing from the crowd is where does it say that uh I think we do need to get some evidence that FEMA uh requires a a permit that if you read what reread what you had read to us it says that uh and that second option that that all the city has to do is notify owners of the requirement to get permits which is pretty easy and then wait for the owners to apply for permits make substantial ual damage determinations which which it doesn't say anything about an inspection but the inspection is a component of the determination and it's and then follow their normal permit reviews which don't require an inspection to begin with so anyway it's there there's a lot of ambiguity here it is and it's very confusing commissioner okay intermingled in there is the nfip excuse me National flood insurance program requirements which are intermingled for that you know and where we are we are in a flood plane in the entire city is in a flood plane and we we're in a FL when we're in a flood plane and we participate in the nfip program which gives reduced insurance rates flood insurance rates to individuals also has impacts on mortgages right I'm not suggesting that we don't follow fem guidelines I'm just suggesting that we make sure we get an accurate interpretation of that second option is all is all I'm okay noted thank you I think they're asking you to re is that okay with you oh yeah absolutely I I just know it's your meeting that's all oh got it the second item would be they can notify owners of the requirement to get permits and then wait for the property owners to apply for permits and make substantial damage determinations at that time time following their normal permit review procedures we have a lawyer this is for Myers anle follow mayor could we hear from Katherine yunan uh in in response to that earlier question and then maybe we can open it up for public discussion after that at or after commissioner top has thank you I'm sorry I was on time delay so I don't know what the question was that's okay I'll I'll repeat it uh the question was after Hurricane Adalia in August of last year in the December 16th storm uh a number of homes in Treasure Island were flooded and could have been substantially damaged which of the two approaches that are under discussion did the city use at that particular time so the guidance we're looking at is when we have a very large number of damage structures which we did not have after idalia didn't have sorry yeah if we could just let her finish the whole answer yes I think she was go ahead cther so there are two sets of guidance one's for when you have massive damage like we've had where um of the roughly 2200 structures that went through initial damage assessment we had over 1,600 in Helen and 400 in Milton um I don't know if those numbers overlap we don't have that data yet but we know that it's a substantial number of the structure in Treasure Island so the guidance is slightly different in idealia we were able to do it on a one by one by one basis so that would have been what they are talking about in option two option two okay okay thank but the Preamble sentence in that description says when making substantial damage determinations and a substantial damage determination as defined has an in inection I want to clarify please please thank you a substantial damage determination includes an inspection that inspection is not required to happen as we you just mentioned if the inspector goes to the house and no one wants them to come in they don't need to come in we have data from damage assessments which are initial wind shield and measured Heights of like water lines on the wall in the case of Helen in the case of Milton you would see a roof damage shingle damage wind other kinds of wind damage so it's a visual assessment from the outside of the house so we have that data we also have surveyed high water line data we have tidle data we have a lot of data that tells us approximately how much water was in a house we know there's exceptions we've met people who put up flood dams and they you know mitigated the amount of water in their homes so people have very unique situations but so it's an initial substantial damage determination which is made typically after an inspection but does not require an inspection okay all right Katherine thank you the only other question while you here I'll I'll go ahead and ask and that's the city of Fort Meers and I think a lot of us have seen this document the city of Fort Meers in their Q&A was it was quite extensive it was like nine pages long but one of them was uh if a resident had a limited damage to firewall trim cabinets could they proceed with work without a permit and the City of Fort Meyers response to that question was if your scope of work is limited to only drywall or non on nonf firewalls trim cabinets paint work and finished flooring and no electric plumbing or structural work is required a building permit and corresponding inspections uh to ensure compliance with Florida building code is not required is is that uh I I guess a question I'm asking did this and you may or may not know the answer to this but the city of Fort Meyers make that exception following hurricane in or was that always their their position that they that uh uh permits weren't required for those items I'm not familiar with that so I can't speak to why they made that determination but I can tell you that our flood plane regulations say that you must have a permit for all work in the flood flood zone which is as we just discussed the entire city okay okay thank you for your answers I think we see if the other Commissioners hey kather if if you would please okay so so um Fort Meers went ahead and did that purportedly yes um do you have any insights as to FEMA's acceptance uh of that position I know that and I don't have a comp comprehensive list of the cities that were um had trouble with their flood insurance program because of what they did post hurricane we've done some lessons learned from Cape Coral we've done some other webinars I personally not familiar with Fort Meers and what happened there okay from a technical standpoint could conceivably the city of Treasure Island follow the lead of Fort Meyers not under our current code not under our current code requires a permit okay yeah that's a good question can we change the code and if so how long would it take to change a code a long time if you vote on it nobody votes on it no this is this is in our Land Development regulations and requires a certain process of going through the LPA and coming back to the commission um to two hearings advertised public hearings and so um um guessing at best case if we had emergency meetings of everybody a month well additionally depending on what the change is if it's to the flood plane management then it has to go to the state and the only other thing is and I don't know the answer to this question but um for the city of Treasure Island it's Unique and that it's all in the flood plane I don't know with the city of Fort Meyers if they have area that isn't in the flood plane and is in the flood plane but that would might breed different regulations um the other thing is I believe because I was I read that paper right before we started the meeting there's a second sentence in that paragraph that talks about the nfip requirements and doing a substantial damage requirement so that's that so that was all I was saying so they were speaking in one sentence as to building permits and the other as into permitting for nfip right okay also I'm not quite sure we can make retroactive code change to the code that was in effect at the time that's more of a legal question okay all right thank you Catherine provision I can tell you that it's in our flood plane ordinance and I will come back with the uh section of the code so everybody's here tonight and one of the things that I filled my phone up with uh you know everything that said and I understand it complet completely cuz I probably would have called every 15 or 20 minutes you know if it wasn't my own phone but uh we we want to get you know we we want to get everybody back into their homes we want to do everything that we can as long as we're doing it legally and that we're not damaging anything and in for mortgages or any other you know the the water uh Insurance the flood insurance and everything else so um if if we were to take a vote and I'm just this is kind of just off the the record well it's on the record because it's being but anyhow uh if you were going to do one or two if that was an option which I don't believe it is anymore but if it was an option what would you vote for would you vote to it issue the permits earlier and without I get it that it this is kind of just what I'm saying is that we had this is the first time we've discussed any of this uh going forward and there really isn't a one and a two there is it says option one and two but it basically is under the exact same language uh as it's going forward but I think that we all agree that we need to get people back in houses we need to get the the uh the work done before we have any big rainstorms and everything else we need to start moving forward and to do that as as quickly as we can and and and like I said whatever that takes as long as it's legal and we're following the rules and that's what we're looking for now tomorrow night we're going to have FEMA here we're also going to have a consultant that handled Lee County uh Lee County is the Fort Meers area uh and and what they did with the city and how they interfaced with the city and FEMA so I think tomorrow is going to be a very important evening it's aund what' you say 140 folks that are going to be there opportunity to be there approximately yes um and this you know you're going to have an opportunity to ask the FEMA Representatives as well as to ask the uh the Consultants um you know because there's a lot of things to uh that they've done on behalf of the residents and the cities so um like I said I think that we all would like to move as quickly as possible and I I don't want anything to to stop that um I know that uh Katherine we are starting to to move forward now with uh permits being issued and uh some of the uh the investigations the that that are being done as well yes that is correct we do have the assessments going on as I mentioned earlier they did they're in the is of Palms right now they've concluded over a 100 I think it's about 104 to 110 that were done today okay and and we're going to have more folks on the ground tomorrow we're anticipating getting more folks we don't have a final date when they will be here we do have missions in the missions have been approved but we haven't been committed to resources and big question that I've been asked is do we know when we would be able to have all of those completed at this point it would be hard to place an actual time frame on that you know if you use an average of doing a 100 structures a day and there's I think we had 2200 structures that were classified as major damage so that would take 22 days right there by itself but that does not include all of the commercial structures that are in those are residential structures okay so I would say probably you know 22 days at an absolute minimum and maybe up to 60 days at a maximum but I would say that depends upon the number of inspectors if we get double the inspectors in a few more days and they're working through the weekend it will go much quicker we'll make sure that the information that we get is provided to the commission and to the public in our daily updates okay excuse me mayor oh sorry I just wanted to provide an answer there was a question that a resident put out and Katherine said she would get back on that and that's section 66 104.1 that requires permits required within our flood plane management chapter so I just wanted to provide that to the public great thank you mayor doctor the the only other question I would ask is city is is why do you why do we think that FEMA has laid out two different options when we basically are interpreting them to be identical we meaning this the city we're taking it that be mean there's no distinction between the two no there is actually a distinction between the two and if if you go back to what I was trying to explain option what I would call option one has you do substantial damage assessment first then individuals apply for permits and the final determination is provided with the permit option number two has individuals submitting permits substantial damage assessments are done and then a final determination so it's really in option one the priority is to do the substantial damage assessment first and in number two the priority is for individuals to be able to submit permits and what we're doing is doing both we're taking the permits in and we're doing the substantial damage assessments at the same time we're not doing one and then the next we're running them concurrently okay because we're using speed as a factor all right thank you yes so you're taking permit applications in that is correct not permits Point Blank correct it we're taking per permit application okay um so the second part of that is uh you get a permanent application in in both scenarios option one option two correct yes you would okay just out just in a different order okay yeah different order but before that permit is issued you must have a substantial damage assessment done correct so you can't get around it it's just a question that which comes first or second correct that's what it is which does come first you know Fort Meyers and in speaking with their staff the reason they had what you would call option two where they were taking permits first is because they could clear their roads entirely across the city for almost 90 days they did not have access now I know we didn't have access to the community here for a number of days you know we had to bring in cut and toss teams to begin with we brought in search and rescue to go through all the structures in the facility across the city and that takes time and we couldn't allow access plus the sheriff wouldn't allow access to the community you know we had a very much smaller period of time where we did not have access compared to Fort Meers they did not have complete access access to their entire city until almost 90 days after the event I I'm sure I have more than one final question but this is my final question for now is for somebody who who's who's says I realize my damage is more than 50% I'm ready to move on I'm ready to to demolish my house and move on can they get a permit to demolish their house now or do they have to go through this process if I could defer that to uh director yunan so the guidance we have right now is that we still need to do the substantial damage determination but we have prioritized those um five structures that have applied for a complete demo so you have a number identified right now we have five that have asked I mean if they've agreed they're they're doing exactly what FEA want said they're tearing their house down and rebuilding I don't know why we couldn't let them proceed but but let's let's uh let's ask the FEMA uh person tomorrow some of these questions we were at the meeting last night have anything to do that they provide you guys with guidance on what to do okay so I don't understand why it's the whole back okay we're at that meeting last night the problem you have is no one trusts the city because of the staff El just every out of that's your problem is there only one option or the highway only one option and that's to build up if you're over % that's that's the very first problem that needs to be I I think we're everybody's of their owned make their own decision for their own property and there's there's a lot more than just build up to how you can make this area safer from and so haven't heard one comment on the ability of the construction industry how they can make houses on any level water type simple procedure a lot less expensive than this 50% Lage AOL of L to L people out of their homes you know or the highway that's the only thing that FEA is offering us that's against our individual freedoms people need to stand up okay do your government keep them in line day after dayro into your fre know this where that's why for the benefit for the benefit of excuse me for the benefit of people that are not in this room that are outside or watching this uh live stream I think we need to go through the normal process of having people come and make their comment so other people can hear them I think that uh de have commissioner I have a couple questions first of all what year was that FEMA or um FEMA rules put into place because I know it's not been anything recent I believe it was in the 1970s okay so secondly is I want to know what kind of Provisions that we can have to enforce condominium associations that are protecting their residents to get the move on so those people can move back into their homes as well and there's some condominium associations condos that have ground dwellings and what are we doing to help those people get back in or what can we do to help them get home um I'm not sure I understand the question commission we have people that live on ground level now correct and I know we have a thing about moving people up where does FEMA sit with helping those people out and what's the requirements for their rebuild um I'm not aware of any separate programs for Condominiums they would fall under the same jurisdiction from FEMA and the national flood insurance program and the requirements that are laid out there okay thank you I wanted to have that clear because I wasn't sure I'd had people ask me about it okay we're going to uh wrap this up uh we're going to move on uh we do not have any proclamations recognitions certificates of appreciation uh next we will come to public comments for non-agenda items and of course this would be a non-agenda item uh can I first have uh Carrie arbach Carrie oh my goodness Beach fought back hi there um I'm Carrie arbach from Treasure Island adopta Beach and as Monty Python says and Now for Something Completely Different um I'm the founder of Treasure Island adopted Beach and I'd like to go on record to describe the cleanup efforts since hurricane Helen truck on Thursday September 26th on Saturday and Sunday September 28th and 29th I work side by side with Stacy Bo and Jessica Zamora at the Emergency Operations Center to develop a plan for deploying volunteers on Sunset Beach our goal was clear to clear debris so the city could start sand replacement on Sunset Beach as quickly as possible on Monday September 30th and Tuesday October 1st the city transported over 320 volunteers to Sunset Beach where they worked tirelessly for hours to clear the area with the Island open only to Residents we were granted special access to assist once the bridges were reopened we continued beach cleanups with keep panel's beautiful holding two additional cleanups on October 3rd and October 5th however we had to then pause our efforts to Hurricane Milton we resume Beach cleanups on October 13th 16th and 19th covering the island in a grid pattern from Treasure Island North to Len South in total in less than 3 weeks we had 1427 volunteers dedicating over 2800 hours and removing an estimated 42,000 pounds of debris nothing about these cleanups was normal the dedication of the city staff was 247 and the collaborative efforts were extraordinary many local hotels and businesses offered their parking lots since City Lots were damaged special thanks go to krabbies on the past the Chamber of Commerce residents in South Beach South Vista or Sunset Vistas Ocean Club Voyager Island in and Dan mcnut owner of Florida parking company for allowing us to use their Lots while their businesses remain closed we plan to continue random cleanups whenever possible and we resume our regular second Saturday cleanups as well Jesus uh please keep an eye on Treasure Island adopted Beach and keep panel's beautiful social media Pages for updates volunteers are always needed I want to give a special shout out to a few of the many who have supported our adopted Beach efforts Stacy Bo Jessica Zamora the entire city staff of the city of Treasure Island former mayor Payne the Commissioners city manager my favorite Chiefs bars and Barkley along with the women and men at the police and fire department ments Jason bezel our public information officer and the countless volunteers and Beach ambassadors we still and always will have work to do on the beach the Stress and Anxiety we've all felt with back-to-back hurricanes has been intense to say the least I am in I am immensely proud of this city and the dedication of its employees to the residents witnessing a piece of the action plan they put into place is quite quite literally a work of ours thank you very much thank you Carrie Karen Barnett is Karen outside yeah there is a whether it's social media whether it's your comments here or just talking to your neighbors just remember that kindness will get you much further we have got to pull together I know our political on been here since 2012 my gel and I retired Navy uh proud of the community thanks for the police uh I think you guys are pulling 48 hour shifts and uh you guys are so a good job of keeping our property Safe Keep L looters out of here uh three quick comments appreciate chance talk um good job on debris removal I think across the city pretty impressive I saw Fort Meers I also work at mcdill I saw what they went through uh you guys have done a good job so I appreciate that I got a recommendation though um could the city look at getting some street sweepers in here to pick up this toxic drywall and drywall screw and glass uh and they probably got to make 10 runs a day or whatever get that street clean clean up is pretty toxic so if you guys take that on take a look at that appreciate that and for the whole Community you have to do my street first you can do anybody's question that came out of St Pete the other night this is coming from my contractor uh I'm also interested in lifting my house and try to make it more resilient I think St Pete Beach the facts I got I hope that they're true they said an arbitrary Max height of 9 feet but that didn't seem to make sense uh it depends on the just height of your structure and where you are in the flood zone I'm 11t per the female map and I'd have to go up you know a substantial amount to get above that so uh the way St Pete Beach did it didn't make sense to any of us that were thinking about this and my brother's also doing the same thing on Palm so maybe tomorrow night's the right night for that but at some point you guys are going to have to make a decision about what's the max height you're going to let people lift up their houses right does it make sense okay so anyway that's a question and maybe tomorrow night tonight but at some point if you guys would address it and then hey the last comment um you know just talk about the uh 50% rule so I've done two models here uh with Treasure Island on my place and uh in each case the permitting process was smooth the city was efficient no complaints I I never had a substantial damage inspection my contractor did a FEMA estimate that was submitted with the permit uh my house had an appraisal you know I was under the 50% Rule and we went forward and did the repairs and and the improvements to our property we did that twice so I'm a little confused about this substantial damage inspection and I think a lot of people are are the other thing isn't it a bit arbitrary somebody's going to figure out what the property value is Mike twit is going to publish that I already got my letter I think yall do too but then somebody's going to come in and estimate how much the damages are yeah and then that determines substantial damage right that seems somewhat arbitrary to me why why not let the contractor do what they did for me a few years ago if the rules have been in place since 1970 they were certainly in place when I did my remodels in 2016 2017 2018 and that would speed things up immensely if the contractor says here's the budget for the repair Mike Twitty's got your letter if you guys are under 50% rock and roll you go right anyway recommendation for you [Applause] guys Sherry sour sounds a lot like option I didn't think you were allow to Clap That the old mayor CLA I clap thank you hi I'm Sheri sour I live on 8th Street East and now mayor doctor very happy to have you as our mayor had you run against mayor pain former pain the last election I would have voted for you um I know you're a man of integrity because I've had the opportunity to sit down at many of our civic association dinners and talk with you and I look forward to your leadership and that is what we need is strong leadership from our mayor and our vice mayor and our commissioners as I mentioned before for we need a hero I spent the bulk of my career as a civilian supporting us Special Operations Command I've worked with every type of elite special operator in this country I've seen very very good leaders and I've seen very very bad leaders and I believe that we have a group here that can be very very good leaders we need a hero the rules were that were put out by the Civic voices of Treasure Island were for Fort Meers Beach not Fort Meyers two different animals I spent a lot of time on Fort Meers Beach um structures that I stayed in no longer exist after Hurricane Ian if that document which the vice mayor read from earlier is from Fort Meers Beach why don't we have a conference call with that leadership and find out how they did it for their Community because I'm quite certain they all fall within a flood plane as does Santa Bell Island and Captiva Island so let's learn from them use them and their success in working with FEMA to take their lessons learn and their example and put that forward to FEMA and try to get people back in their homes and I think they would welcome a conference call because because if I remember correctly we sent a contingent down after Hurricane Ian to tour Fort Meers Beach and santaa Island and talk to them and I think that would be a good way forward um the last thing I want to say is that I am very very concerned to see top level leaders on our city staff that are not residents they are putting forward recommendations and policies that have no impact on them and their residency I would like to propose that you take into consideration doing the necessary steps modifying any necessary documents needed to make it a forthcoming requirement for anyone taking a director or co-director job in this city to sign as part of an initial several month Prov AR period that within say 6 to 12 months they will move and become a resident on Treasure Island I know from working I know from working with the federal government as a civilian that I had as a senior civilian to sign um agreements that would state that after so many years in a certain location I would move to another location to groom us to be better rounded and better supporting the Department of Defense I think something similar for the city should be considered and I look forward to commenting at a workshop or any other Forum moving forward should the uh Commissioners and the mayor wish to take this under consideration please step forward and help us get back in our homes my home has been my husband's family for 54 years we never even came close to getting flooded before we are ready to move forward a lot of the work we'll do ourselves so who is some Outsider to tell us what it's going to cost for us when we have discount cabinets lined up discount floorings lined up with certified contractors and we're going to do a lot of the work ourselves how do they know that we are not going to be able to stay under 50% and I will be getting inpr appraisal State Certified uh report either tomorrow or Thursday that we will submit with our permits thank you very much for the opportunity to speak thank you bu Buzzy Barnett Chris clar there he is Chris clar suppos to be um thank you for giving me opportunity to speak I I want to Echo what Sherry says I I do thank you for what you guys do I do hope we're on a better path than we were previously heck at least we're allowed to clap in the meetings now so we're making some uh progress but um I I kind of find it unbelievable that I'm here to beg my city to repair my home that is not substantially damaged and is going to cost less than half of my 50% less than 50% of my 50% to put back together um so I'm here to implore you to look at the FEMA guidelines and start discussing permits based on what many of City are referring to as option two as I mentioned before the problem you have is I don't think anyone trusts the city based on the Elevate TI debacle that the staff got us involved in over the last couple years so No One Believes people here when they say oh there's there is no option one or no option two No One Believes that it may be true I am not 100% sure I don't believe that it is but no one no one believes you and that's a problem that was created by the city staff so how do I understand option one and option two option one don't issue any permits for who knows how long two months three months six months we don't know until FEMA comes in and expects it to see if there's substantial damage I know for a fact that I do not have substantial damage and I'm going to talk about that in a minute option two is what the gentleman that was here two two or so before me was issue permits based on a bid a contractor's bid and look at the 50% guidelines you know he said he's had it done a couple times there's no reason why we can't be doing that why is the city you know incessantly wanting to go with option one I believe it's because of you know the city staff and the failed fantasy vanity project of of of elevate TI we're trying to still hold on to that and and that's a big problem very big problem let's talk about substantial damage the only time I will mention his name was former mayor pay in his resignation letter said that you know he had to resign because his home was beyond repair and so was almost everyone else in the city's home that is complete Malarkey not almost every single home in this in this city is is damaged Beyond repair that's what he wants to make people believe and that's the last I'm going to mention his name but you know I it's funny because I had a conversation with my my Fe my flood insurance National flood insurance adjuster yesterday and I called him to ask him about some questions about filling out my contents form and he helped me you know answer those questions and at the end of the conversation he said to me Chris what's going on I I I went to a bunch of homes in your neighborhood and these are people are telling me that you can't get permits I said you're absolutely right that that's what's happening and I explained to him you know the city staff and the lev8 ti debacle and he said you know Chris there's very little homes with substantial damage in your neighborhood he said you know I went to Fort Meyers I I inspected homes where the roof blew off and half of the interior walls were down and you know the electrical panel was laying out in the street and whole parts of the house were missing that's substantial damage he said you had an he called an up and down flood water came into my house 28 inches pretty slowly and then by six o'clock in the morning it was out and my wife and I were already taking stuff out you know my house is not substantially damaged and and and it's crazy that we're pushing this and so I'm G to I want to go into my specific situation I'm sure a lot of people here have the same situation I live on 8 Street in Isa Palms I have a two and 1 half story called a three-story house first floor is all living area dining room living room kitchen office two bedrooms my wife and I have a a master bedroom on the second floor in a bathroom and then we have a little Crow's Nest with a bar and a couch and a TV up upstairs so since the flood we've been living in the home both my air conditioners work um my water heater works we live on our second floor in third floor we have some furniture down on the concrete now on the first floor but my house is not substantially damaged um my roof I was hoping to get a new roof out of this but I can't I had I had two adjusters come out and they said Chris your roof is absolutely perfect I don't have a leak I don't have any problems so my 50% number my house is assessed at 690,000 my 50% number is I have a estimate from a contractor I've used in the past that's a very reputable contractor here to put my house back the way it was for $130,000 $31,000 that's less than half of the 342 so you tell me why do have to wait for a FEMA inspection and why won't you help me get back into my we need to leave TI debacle behind and we need to put people back in their homes thank you wow that's like following Ronald Reagan or somebody I'm buzzy Barnett live at 2011 and my wife spoke earlier and she is a saint I know she does a lot of volunteer work for the city and uh and I know it's appreciated I'm not going to get into big detail we were we've had that house in our family since the 70s uh never had a drop of water in it so I was sitting up in attic when the water came in I told my wife I can't believe we didn't move the cars you know my son had two shops but anyway long story short we got six inches or so of water in the house we they came out right away we cut 2et of sheetrock we're ready to go back and build I mean just like these gentleman I don't even have I don't even have a tenth of what the total value is so but it now sounds like I'm going have to wait several months we're living in a house air conditioners work hot water Furniture steel couch TVs everything in there still working we're living in there the dog loves it he can go through the walls but anyway I think we do all need to just you know one let's give these guys a chance to come up with a good plan I I agree with that but let's get the the the folks that aren't in their homes I feel for you uh I I'm lucky enough that I'm in my home even though it's got a few feet of sheetrock missing two feet to be exact let's see if we can't expedite some of those permits that for people that had very M minimal damage and get them on in their houses and let us go ahead and put the two feet of sheetrock and some paint and I'm back like I was before the storm thank you gentlemen and thanks for what you're doing thank [Applause] you py mountain mountain let's move uh Rick Maan math oh Rick RI okay you're right thank you no thank you did your agenda item okay let yeah let's wait on those so we can do those so Scott copelan is at uh all um I live on uh First Street East with my wife Sabrina and I think we're all here for the same reason first is we just want to get back in our homes we want to start building we don't want to wait 30 days it's five weeks out already we're in this for five weeks already and nobody could build I have people coming into my house I'm putting up moldings on the on the floor because I don't really have that much damage and they're telling me I'm not allowed to do it you know there's a there's a tip line saying that you know right on your neighbors like what is that I mean come on you know I mean does anybody want to r on anybody here your homes it's We the People all we want to do is get back in our homes don't tell us we have to wait 30 days 60 days 90 days for FEMA to come out we want to get it done it's it's it's simple it's it's very simple if if we could change the code let's change the code if we have to vote on it we the people let's vote on changing the code that's what we have to do to get these people back in their homes don't chase us off the island because we're not going we're not quitters okay and that's all I have to say get us back in our homes we're five weeks into this already and we can't even we can't even put it we can't do anything doesn't make sense all these other place clearw Beach badira why is are the rules different for there like I I don't get it why are they building already they have permits they're building they get people are back in their homes look at these bus people own businesses here there's going to be no tourism here at all no is going to come here all these businesses they're going to dry up that's what's going to happen nobody's we're going to miss this season all these businesses they can't afford to miss this they need it they need to carry through the slow season okay get us back at our homes that's all we ask thank you thank you Andrew vasi how do you pronounce it vasy vasy thank you thanks uh good evening uh commissioner doctor now mayor doctor congratulations everyone else tonight um I'm here asking for permits now and this is simply a matter of doing the math to make this happen okay it's been 33 days since the hurricane nothing is holding this up but the officials in this room okay now I don't come and say that lightly I've been doing uh airport development for 39 years I sit across the table from public agencies all the time the Port Authority of New York and New Jersey massport Pick Your most difficult administrative bureaucracy out there I've never seen anything like this okay now I had I went and I'm I'd love to know from staff who's talked to congresswoman Luna to get the information because I went and talked to congresswoman Luna okay her office went to the Congressional research service which is essentially the world's biggest library and said with one simple question where's the FEMA mandate that you have to have an inspection before you issue a permit and you know what the answer is there isn't one that's right okay there isn't one she talked to the to the CRS she talked to two um FEMA Congressional aison you know what the answer was there is no mandate so you're getting bad information from somebody here somebody who has an agenda or else it doesn't understand how to research and obtain facts I don't know if it's a staff issue or what it is but you can do permits now and as the gentleman explained before it's a matter of doing the math you announced tonight go ahead and submit your permits you as the city are the one who makes the determination of the substantial damage not an inspector with an iPad using a depth damage function curve which is on page 85 of the FEMA manual because we do our research okay and determines that oh we got 33 inches of water so I look on the curve and it says it's 32% structure damage 133% on your furnishings and now you got a $65,000 estimate when my contractor would come in and certify and sign the affidavit that requires me and the contractor to sign it which is your own darn form the of the affidavit for the permit and I've got to have some guy with an iPad coming in and telling me what my damage is and you guys are okay with this after 33 days it takes 33 days for staff to come up with the bad information that we can't do this this should be from the time you get up in the morning and put your socks on until the time you take your socks off and go to bed at night you should be advocating for the residents and the way you do that is you say hey I'm being held up apparently by FEMA how do I fix that I'm going to call the congresswoman because they were laid on the federal level I'm going to get the information and I'm going to come to my residents and I'm going to give them the permits I as the government will interface with FEMA I'll make the case I'll take the arrows for FEMA not this 33 days later we're waiting on permits to get back into our home homes my house was destroyed I'm not here because I'm trying to get a permit for myself I can't I won't get one I'm out on the end the wave action crushed my house and turned everything upside down it pushed the beds through the walls and everything else but you all can do something you should be advocating for the resident our mayor last mayor isn't here because of this and he puts out a flowery release that oh you know my house got this and all we all know what happened we everybody reads what's going on on social media we fought a TI we fought his referendum to add more debt we fought the assessment scheme that you came up with your City attorney and she came in with a partner and gave us a 56 page PowerPoint on assessments oh this is just I Capri we're gonna we're going to underground the wires no you're not you're trying to assess us because you couldn't referend us on the debt we fought in the mobility um narrowing the seats and we we fought Elevate TI to kill it and then immediately you guys have a meeting outside and somebody wants to bring it back okay we're not bringing Lev TI back it's dead okay these environmental justice Warriors that are on staff need to go Tyler leaving is the start of the clearing cleaning out of the house here and we want you have the ability to do this I do not want to hear that it's a FEMA restriction because that is bad information that is wrong information I will get on the phone with any of you and the chief of staff of congresswoman Luna and we will sort this out on the telephone this is completely wrong in front of you guys time and time again what he's saying is the truth the essence of the problem is what's going on Chuck with your staff you can make this happen today if you want they can can make this happen now all they have to do is have the courage to do it these are the same people that told you that it was going to take eight months to take a word out of the code so we could have fill dirt and you're going to put it back on them to make to make a solution to this problem this is not we don't want the permits today we want them two weeks ago and there are people that are living out of suitcases and they son's home or wherever and we're not getting anything done now I wasn't going to mention his name either but I tell you what I had I couldn't come here the last couple weeks because I had I had other things to do my house was destroyed I had to take care of some things it's not substantially damaged just like the other people had talked about I I I've already cleaned it up I'm ready to go I need some permits so I can put it back together but I can't get them and that's not acceptable with the mayor wouldn't even let us talk like we're talking here tonight I commend you for that because we Wen allowed to exercise our first amendment rights of speech Jennifer we weren't allowed and you took an oath and that's not a that's not right you got to let these people talk you got to get them back in their homes you got to give them some permits so they can build they're eager to get back in their homes they have the ability to do it they have the money to do it they have the courage to do it now what we need is courage from all of you guys you need to look at him look at him and tell him to direct his staff and the two that push the levati are behind this y'all know this we can talk about the living Shoreline later about what a the botle that's been you got the bids in they're too high again and guess what the lower bidder was a million dollars just like we Island I don't have the long history with this uh city as you guys do but uh I was at the meeting yesterday at FEMA did and there's going to be a FEMA Town Hall here tomorrow and my notes from that meeting and it was towards the end of the meeting I got a chance to really speak individually with the F representatives and frankly it's damning speak the city of Treasure Island you'll need to speak into the mic frankly it's damning to the city of Treasure Island uh to look at my notes they point out that the 50% rule falls under the flood plane management code of the Federal Regulations it's 44 CFR 60.3 the reason why all flood uh insurance at least in the flood plane which is where we're at is um backed by the nfip to be eligible for nfip insurance the local community Treasure Island agrees to adopt a minimum flood plane requirement of that Federal certifi certif that Federal rule the one gentleman was saying why why do they have a say over it the reason why the federal has a say over us is because we want low flood insurance so the city is doing the right thing by signing the agreement so we can get nfip insurance for all of us but the requirement is that we must add a minimum to the federal uh uh guidelines however the federal gu there is no such thing as a as a FEMA inspector it falls entirely upon the city of Treasure Island to enforce at a minimum the federal Rule and the City of Treasure Island has no clue about what the city of Treasure Island can make any rule they can make it more stringent they can make it a 48% rule they can do whatever they want as long as they hit the minimum but they have not provided any information to our community lacasta Bravo many of you folks were it was wonderful to hear that you have relatively little damage lacasta Bravo has 108 units 27 entranceways six buildings three of which are practically totaled and the other two we have uh and we have no guidance on any of it every one of the 54 ground floor units is flooded from Helen 35 of the remaining 46 top story units were destroyed by Milton so what do we do so far all the city has done is come and put red stickers up and demand that all electricity put it be put off that's it that's the only contact the city has given us so it's your responsibility not femas to take care of the community so just give us some guidance get people out there Jim Earl uh jiml live 7:30 1119 thank you for letting me speak uh maybe there's a plan here tonight a little earlier we said that it would be 22 days as much as 6 months in order to get the inspectors in true Mr Anderson Chuck you said it would take 22 days plus to get the inspectors for substantial damage inspection what I was saying is that if there was 2200 majorly damaged and then we did a 100 a day it would take 22 days right right and those people are physically going out and visiting buildings yes sir and the more there are the more the buildings they get they can get to and so on and so forth however earlier in the meeting I heard the City attorney stand up and say that if in the event that the owner refuses to have the inspector enter the property there are alternative methods to determine the damage is that also a true statement actually I think I was the one who had mentioned that yeah that the attorney confirmed I believe that all right and if if we can marry those two concepts together instead of waiting for physical inspections how about we drop back to the let's go on the paperwork and use those alternative methods and instead of doing 100 a day we could do 100 an hour just looking at those homes that fall you could issue the permit or issue the exception or it needs to be inspected in other words go by those that do not fall into the 50% category and get it done more quickly so my suggestion is in order the city I think is you guys are in a rock and a hard place you got FEMA on one side and you got angry residents on the other I've and I totally get it so what I'm suggesting is that if in order to get people back into their homes why not use the computers that will generate the reports that say these are okay these are questionable and these are no goes all right the questionable ones we can assign the inspectors to the ones that are okay issue the permits get them going so that's my suggestion how does that sound [Applause] response to that they're not required Y is there a caty Jackson is it Kathy Jackson oh okay I can see that hi I'm here with my sister who's on Isa palm and I just I had a couple I had a couple questions clarification until you do change everything this substantial damage which um assessment which is being done not by FEMA it's being done by either the county or your the sa your the leadership here so that just to make that clear they made that so clear yesterday right when they come in to do it and you said they did a hundred homes on a of Palms so when do we find out the result who notifies Us and how long does that take so that we have an idea so thank you thank you Greg Smith can you answer that uh not at this point not congratulations mayor uh doctor uh couple things uh Greg Smith uh District three um I think there's a lot of people that don't agree with the interpretation of option one and two I think it's nice that we read that but uh we've been through the FEMA documents we probably r as much as Chuck has and there's nothing nothing in there that says substantial damage and normal operating procedures for permits are the same thing there's no there's no inspection that's tied to your normal operating procedures I think the question that needs to be answered is what are the normal permit review procedures for Treasure Island no one seems to ask that the question about the earlier hurricanes the answer was we use normal permit operating procedures we didn't call it option two then but I can tell you the reason there's two options is because they're opposite you don't have options if the things are the same we we've been through it we cannot find maybe you can show us where it says that you have to have an inspection under option two not not that it's part of the substantial damage or somebody thinks it is there's nothing specific in those Rags this is about as simple as anything I've read They're different and and there's it's just it's crazy that we're sitting here with all these people and you know I'm not I don't have a dog in the hunt here but all these people that can get back in their homes if you get them get them let get them a permit let them come in with the c calculation give it to the uh you know building people let them figure out if it's above below the 35% or 50% if it's above it hey you got a problem we don't we don't need people running around with iPads you know applying Fe FEMA formulas that may or may not make any sense sense but let's back up a second how we got into this mess because I feel like we're cleaning up a mess here that started on October the 19th when our former mayor took off on a tangent with nobody involved and decided to do option one he took off with option one he committed to getting these inspectors in we we called him out we said hey how about option two no one knew anything about option two well then then we learned about option two then the the mayor says well it's really not a good option we've got we've got text from him telling us it wasn't a good option because he's already hired the inspectors so then once we move from that it's like well now we've already got the inspector so option one and option two are the same thing that's where we are now and and it's it just doesn't make any sense and we've we've been doing this now since the 19th we've been dancing around trying to figure out what option one and option two are it it's so simple you pick a lane and get one of them and you know everybody you guys took off you guys didn't because you got you got circumvented the city staff the city staff and mayor Payne took off on option one we've got all the documentation and now you're trying to you know you're trying to figure it out you're trying to decide what's what and what's happening is we've now wasted 12 Days 12 days and nothing nothing's happened in 12 days because the city's trying to decide whether or not one and two are the same or they're a little different or we got to have inspection and then it says substantial damage so that means that's that equates to an you know that means inspection it doesn't doesn't say inspection an option to but because it says you need some kind of a substantial damage determination it's got to be an inspection although it says use normal operating procedures we're literally just tied up in knots and it and it's frankly it's embarrassing to the residents here that actually want to get back in their houses and it's not you know there's a few here but there's a heck of a lot more that aren't here we got had probably 50 locked outside tonight and and you know look I I got to be honest with you the last three years the city set the lowest bar possible and they managed to trip over the lowest bar possible most of the time the expectations coming in here were not high but you managed to trip over the low bar again I mean here we are trying to Define we're making stuff up but I mean we literally this is the most straightforward thing I've ever seen and we're trying to say well this word means that it's got to be an inspection because of damage and show us just show us if it's there show us that's all we're asking for thank you Tim mcer good evening um I'll be very brief because I could not speak as eloquently as some of my neighbors have done on 8 Street already especially Sherry and Chris back there but it's my understanding and I hope I'm wrong that if we pull a a homeowner permit we cannot sell our house for one year is that correct that you're speaking about where you're not going to have a contractor but the homeowner themselves are going to do it yes that's what you're asking about so in Florida statute um there's a provision um that provides that contractors should do certain you know work that General Contractors should do they will allow homeowners of I believe it's single family and two family um homes to pull permits but they have to sign an affidavit the affidavit is is identified or the notice is identified in Florida statute and there is provision in there that says that you agree that you will not sell your home for a year or lease yes because the problem is most of us have suffered a million dollars worth of losses and so the second question would be how would that be enforced I mean what what we want and Chris said it more more alely than anyone could say is my house is very much like Chris I need to put drywall up I need to put some doors up some baseboard up and move back into my house but if I can't sell my house for a year that's just putting more financial burden on me that that just doesn't seem right we're not talking about major structural damage we're talking about putting some drywall up baseboards and doors and and moving on so is that going to be is there there's no exception to that I can't sell my house for one year there's no exception to that that's in Florida statute there isn't an exception identified in that statute no okay well thank you it's a presumption there's always you can always re a presumption if you're going to speak uh please fill out a sheet keep saying that's not true that if I could please I was asked specifically whether or not there was an exception I'm not aware of an exception in there what I said was this was the language of the affidavit that the homeowner is require or the notice the homeowner is required to sign that is accurate and that is what is in the statute that they intend to sell it it's not itet please doesn't answer emails she blows people yeah visor haa was I even close figurea um I live in Dolphin Drive um I've been a residence since 2018 in this beautiful city we enjoy every moment I have two little kids a six-year-old and a three-year-old uh we've been homeless since Helen we're trying to get back and the city is stopping us from doing that and if you guys you you have to have some answers for us and I would like to know from the city like how many homes how many people have been displaced from from the city currently and how many of those homes have children under 18 I hope you guys have these numbers and if you don't shame on you for not having it because we're wasting time with City people going spying around neighborhoods so they can call enforcement to stop order permits but we're not going to talk to residents on how are they doing what help they need do they need a place to stay what are we going to do about these people and how long it's going to take for this you have a assumption that this might the inspection might happen in about 22 days or maybe 30 days from that day uh 60 days and then from that day once the inspection is done we need to wait for for somebody to review it and then give us an answer so we're looking at three months two months three months we it's we already been one month here homeless we can't take it anymore so if you guys are not on our side you should resign if you don't know the job if you don't know what to do in these situations we live in Florida since I've lived here I came from completely a different country third world country uh and this has been the best best place to live but we live all of us live in Florida you guys are running a city that it's on the coast and you have not been prepared for a hurricane and not knowing the rules of what to do and now you're learning you're you're trying to adopt the things and and learn and figure out a way that's not how the way you you should run the city I truly believe that you're not capable on of doing your job so as you Miss Jennifer Cohen uh I would like to have a question also uh Elevate TI has been a big thing for you guys has the city uh applied for grants for mitigation as the city applied for grants for mitigation from FEMA can somebody answer that I'm sorry sir your question talking has the city applied comments has the city applied for mitigation Hazard mitigation from FEMA government grants for people that going to have structural damage FEMA accepts application from cities to apply for that have you guys done that we're work we're in the work working group with the county to apply for those grants you're on a working yeah you should have done that way the day this started uh we have how many permits a day they going to be able to be processed also we need to know that very soon how many permits this city can proc not just process process and and issue permits so people can start working I will I would I would love to have an answer for that but sir I think you're addressing the commission here when you come to the podium I think you're addressing the mayor and the Commissioners okay and I think that they're taking your public comments that you're providing thank you thank you by the [Music] way Harvey mayor may I mayor I I don't know if I'm uh violating any kind of procedure here but I would like to say something uh there's some very excellent comments and suggestions being made here and I appreciate them and I've written a lot of them down but please let's not get make this thing personal we've got a lot of people on the city staff that have been working their butts off to to to improve all of our lives uh these people have been affected by the hurricane just as we have they've lost their homes uh let's let let be respectful here of the people that are on that are working for us to help us get through this so we don't need to your suggestions and comments have been good but let's let's avoid this these personal attacks please my name's hary Casper I live on Isa Capri I came in this morning to pull a permit for a new building and was told that I can't do that either my building's not even doesn't even have 50% damage but I don't want to go through this again I just want to build up I've already got a drawing that fits City regulation and they're like oh that that section's not even open so we can't give you a permit so I want to build a brand new building and I can't get a permit so I just want to let you guys know that too so let's get that rolling also thank you okay we can now move on we do have a couple of others but they are for agenda items all right uh commissioner reports yes lot of good discussion what are we going to do next if you're taking public and it should be from the mic because there are people who are viewing this and it won't be able to be heard they asked if if you had come up and speak into the mic it's it's it's really not a question it's just a kind of a more of a question than a comment I guess but a lot of good discussion here a lot of people were feeling a lot of pain but I mean what are we going to do next you know I mean I I guess that's what people would kind of like to hear um I mean I asked to get some procedural stuff from Chuck but that's not going to you know I mean that's not going to make the difference to a lot of these people so I'd like to kind of hear what you know I'd kind of like hear what's going on I'd like to I'd like to go back to option two and get people moving mayor I again I correctly if I'm out of order here but but again I thought there were a lot of good suggestions here in particular the I the suggestions uh that the city staff maybe triage the permits the ones that have nothing to do with substantial damage the what the gentleman just mentioned he's applied to build a new home that's got nothing to do with FEMA got nothing to do with anything why can't we give him a permit so anyway if we triage these permits again into categories that there's no way this house was damaged anywhere near the 50% rule let's go ahead and get give those people permits there's no reason to hold them up there are quite there are one where they definitely where the house has collapsed and it's definitely 100% no doubt that that's been uh going to exceed the 50% rule so you you go through the normal channels the inspections and everything else and then there's that group The questionable ones that may or may not be the 50% but let's not hold up the ones that clearly are under 50% and and let's not stop permits or people want to demolish their house they're doing exactly what FEMA wants let them purce with it let's not shut down all permitting as we go through this process thank you commissioner dicki okay um I think that uh Greg you had to asked a question and uh I think that commissioner dicki is correct that we need to uh evaluate and we we need to make sure EXP especially uh when uh Andrew uh addressed us as well you know why aren't we doing uh demolition permits why aren't we doing so um I think that what we'll do is we'll have a a conversation starting with with Chuck and uh and pull pull these answers together for you that'd be great but we're well connected with Luna right now so we could we can get we can get answers to these questions so I mean I think we just need start moving forward and not not get hung up in this what's this what's that does that mean this does that mean we can get the answers yeah I agree we we clearly can't slow down we we need to get people back in their homes I mean that that's sincere we need to get people back in homes yes uh John um it's been an interesting uh listing session here from up up here and as has been said the Great a lot of very good comments um I'm going to um speak my mind and I would admonish those who choose to berate City staff or others it serves no purpose it accomplishes nothing matter of fact it pisses me off so uh just uh in the future as you're proceeding through these comments please keep that in mind not that I make a difference but I'm just telling you where my head is second second thing is um where do we go from here uh and the only place we can go is forward obviously how do we get there personally I am very interested in the meeting tomorrow evening with the FEMA person and I would like to ask hey you're shaking your head why would it be okay if I explain it to you in a minute okay um I would like to hear what the FEMA people have to say I think a good discussion deserves listening to both sides um at least that's the way I was taught so I'm going to listen to that person I'm going to listen to the questions that are asked uh same as we've done this evening and I'm going to formulate my opinion after that um if there's another way to do that without Contracting contacting FEMA or listening to FEMA uh let me know thank you can I add something to that too I would like to see representative Luna come and address our community personally because I'm sure a lot of our people here have voted for this lady and we'd like to see what representative Luna actually says to our residents face to face I'll set it up please do thank you and then you notice the meeting absolutely I'd like to answer commission's question please ex excuse me uh mayor doctor there was a Gent gentleman that actually wanted to speak also in public comments he can go first good evening Bob okay so tomorrow is a is the feema road show uh they had one last week in St Petersburg um you have the um you have some of your staff and then you have a representative from Hagerty Insurance right hegerty has a PowerPoint they've been walking around I've viewed it and so you you you look at this and you one of the first filters you know I run through is is any of this self-serving you know who who's got the dog in the fight like for me as far as getting permits go I'm out of my house I'm in my third AA BNB but I think you should be issuing permits tomorrow because female allows it so so the idea there there are two camps and we call them option one option two whatever you want to call them but there's this this sort of well FEMA says this and they got the guys the iPads and they'll come out and do that and so that is a that can be explained further in these Road shows if you if you go to the the FEMA handbooks if you go to the FEMA training manual where the uh depth damage function chart comes out of that they use to rough estimate these and and you look at how they do that it's sort of the easier path in a way because FEMA does two things and and this city gets audited by female on their permits every year coastal cities do so I'm working up in New Haven Connecticut we have the we're we're we're designing and building the first Airport terminal that had to be raised n and a half feet in the air if you can imagine doing that because of FEMA and Coastal flood plane all these kinds of things and so there are ways you work with it and there ways that that you can go the other way and so when I spoke earlier about talking with congresswoman Luna and and um the assistance she's provided and the resources they have to provide that that service um it speaks to whether FEMA mandates something or not and what the one thing you won't hear tomorrow at this presentation you won't hear that the inspections are mandated what what is what is factual is that your government en in this case the city of Treasure Island is the one who makes the determination on the substantial damage that goes to the permit file and when FEMA comes in just as if let's say this hurricane had never happened and I came in with a permit and I said hey Bob you and I are from Indiana so let me just slide a little bit and get a bigger pool and whatever and whatever and you know I came in at about 55% but we fudged it under and you know got it in got the permit in and then FEMA comes in for an audit and and and FEMA pulls my file because I was at 45 % of of the 50% R so you know they're not going to pull the 20s they're going to pull the 45s the 40s so they pull it and they see a footfall you gave me a permit that was probably not you know quite copacetic they run the basic construction numbers because remember FEMA uses the the the the depth damage function curve is generated so we want to sit down and go hey what happens if 12,000 houses in Wilmington North Carolina flood because a hurricane hit and the capf river overflows and everything so what we do is you you take the 12,000 houses you get the value you um run the feema curve and you can get a number and so from a risk management and insurance point of view you can kind of project the value of Damages along areas and this is what actuaries do when they set insurance rates for example coming back to the audit is FEMA looks and if you if if they come in and audit Treasure Island and they found uh oh you know Andy got permit um that was a foot you know was you know was a foul because it was too much it was overstated the dollars don't add up the you didn't you failed the audit then the community gets dinged on this on this community um what's it called uh Community rating system right and then that adjusts your premiums everybody premium goes up 50 bucks a year something I mean again this is another one where where the facts you do the research in the facts the community rating system has a very minimal effect you can look at it historically and I would challenge anybody who runs the analysis on behalf of the city staff to do the analysis and go back and look historically but anyway I get I get I get ding because I fudged my permit and it went through so so that is that is part of the permitting process but there is no FEMA mandate that you do inspections and so what you won't hear tomorrow at this is you won't hear that mandate what you will hear is an insurance company with a dog in the fight talking to you about having FEMA come in and do the work for you and FEMA will come in and they'll they'll run everything why because it makes FEMA's audit easier later government doesn't have to come in and go through a bunch of permits that contractor A and B and C did the estimate and they got to then run it against the dollars per square foot and you know they have to determine whether it was legit or not if I said I did my kitchen I you know that would be it so the reason I'm shaking my head in the back of the room is I know what the outcome is I've seen the PowerPoint I know Hagerty I actually used to Ure a bunch of cars with them classic cars so I know Hagerty I've read the PowerPoint they have a dog in the fight and that's what you're going to hear tomorrow so please go and listen to what they have to say but let it stay in your head hey who's saying that there's a mandate because that's where we went to Luna with and that's what the Congressional research uh service gave us that's what the Liaisons from FEMA to Congress said there is no mandate so if somebody wants to come up and show us we're all wrong knock myself out I'll be the first one at the next meeting to stand up and say I was wrong but not Andrew we got an issue thank you um my house is going into foreclosure I was denied forbearance I can't afford to pay for my rental and pay for my mortgage I came to this country 20 years ago not speaking a lick of English I worked really hard I saved every penny for a down payment me and my wife are about to be homeless we're going to lose our investment we're going to lose everything that we ever had we had 8 Ines of water in our house our house is raised three feet and I can do the repairs and get back in my house I'm in construction management and I build brand new buildings from the ground up I buildt skyscrapers in New York City multifamilies in Los Angeles and it it seems like I could do that quicker than I can get back into my house so please please please let us do at least minor repairs I have no electricity I have no water and I don't have anywhere to live and I'm going to lose everything thank you and the final one on this subject Carlos Merl good evening Commissioners my name is Carlos Mir I'm with uh in Paradise Island and my address is 10231 uh Tarpin Drive um as the last U person uh providing public comment on uh non- agenda items uh it's appropriate I think that the topic that I'm going to talk it's going to be very brief I just want to say that you obviously everyone here is is in pain uh it's a great pain um I'm sure you Commissioners are in pain uh the city manager if he looks up from the paper he's he's reading it probably feels up feels the pain too and we all feel pain and and I just want to say that this is this these storms have been historic in nature a 100 years and most people live in Treasure Island aren't going to be remembered 10 years after they died but you Commissioners are going to be remembered 25 years from now 30 years 50 years from now now you're going to be remembered on how you handled This Disaster it's going to be a turning point for the city now we've have one mayor who's resigned I think that provides a good point for us to turn the page move forward work with the public in every way that you can reach out to the public get their opinion this is really an opportunity for you to have a fundamental impact uh on on Treasure Island on the on the citizens that live in Treasure Island and and I know you can do it and and I'm looking forward to seeing it thank you thank [Applause] you all right let's move on with commissioner reports Deb thank you um I just wish you well as our new mayor and I also wish commissioner di Dicky very well as vice mayor I think it's a very good choice since you live in Sunset and you've had really the brunt of the sand and the thank you sorry I got feedback I apologize um as we move forward I think it's great for both of us all our community um I know we're all hurting we're an island people we all work together we're a tough breed but please remember that we're all in this boat together um I found myself also as a newly homeless person and there are federal laws that are supposed to be in place to outline the processes now we've heard conflicting issues that they may be different than what we've been told by one member and I look forward to hearing what Congressman Luna has to say because I think she has some very strong input on what we can do um I'm also looking forward to our hearing the information that FEMA will provide at tomorrow's meeting we have all had damages to our home and we really are looking to get us back as quickly as possible um I'm not enjoying camping at a hotel um I have my dad with us he's 90 it's quite the challenge mom's in a facility and you know trying to get us back into our feet it's the same as what we're trying to do for you guys and there's conflicting information we'll drill down to it and I assure you that we will do that um I've also asked our city manager to possibly redirect our resources for the lift program to see if we can assist our residents that are really struggling and maybe help them to figure out some different caveats that they know as social workers to help them get the help that they desperately need um I wish mayor doctor the best and I hope we can all work together as a community and work move forward I watch Neighbors helping each other and it was as hard as it is to watch everybody lose everything it was also heart heartwarming to see people helping each other and I think if we all stick together and work together as a community we can all move forward and get ourselves back in our homes thank you commissioner minning uh I would like to ditto those commissioner to um well said but I would also like to add a little bit to that and that is to thank the city staff thank you um for what they're doing you can them you can knock them down but they're still showing up for work every day they're still doing their jobs and if you think that they're not why don't you just have them not do their jobs for a day and see how y all like that um I think they deserve a whale of credit I'm not saying that everything's right I'm not saying everything's wrong but I am saying that they are deserving uh of our thanks for what they're doing right now so I end my comments thank you commissioner dicki I I have a couple things one thing I wanted to clarify I had mentioned earlier that uh that one of the Sunset Beach residents had told me they got a private appraisal and it was at $350 I did get a text from somebody that lived in a larger house and she said her appraisal was $750 so I'm sure it has something to do with the size the square footage of the house or whatever so anyway it the range may be uh broader than than I initially had suggested uh the the number one thing in Sunset Beach and and uh District 4 is uh kki is open Ki uh opened on Saturday uh bar food or or bar only the food is not yet ready to to be available uh also for those that live in Sunset Beach Friday evening is a block party on 87th Avenue and the beach ratch will be singing there uh we'll be doing the entertainment so it'll be bring your own seats bring your own beverages but uh that might be a good thing for the residents to have that break from uh from reality for a little bit uh the number one priority facing Sunset Beach residents I think right now is very much what you heard from a lot of people today uh they they like they need these permits they need to get going they can't afford to to pay rent and to pay their mortgage uh we're going to some more people are unnecessarily going to leave their houses if we can't help them quickly and a second priority and we really haven't talked much about that but there are a lot of homes in Sunset Beach I don't know about the rest of Treasure Island that uh that even in Good Times don't are are neglected they're not kept up they're not uh uh the the owner's absentee uh after this hurricane there's a number of houses or two on the street alone that I live on that the owners are missing an action and the houses have been sitting there now for 33 days is uh getting worse and worse and worse so we as a city city commission and the city staff we need to talk about what we're going to be doing about those homes that are not getting any attention at all and is that does that create a a safety and a health hazard for uh the rest of the residents that's all I had thank you very much um I Echo uh what they have said um we need to get back into our homes we need to get the work done um and I'll tell you I'm going to do as as well as these folks everything we can do to speed it up and uh if it's a staffing issue then we can we can work with that uh whatever it is we can work with it uh we've heard a lot of good ideas tonight a lot of good thoughts um you know the one thing that uh that I've always for the 16 years I've lived here you know I come across the the bridge and uh and I'm home and and I smile and uh you know I I I'm beginning to smile again because you know the causeway and everything is beginning to look a little more normal and the neighborhoods are beginning to look a little more normal but uh I will do everything we can and as I said I'm sure the team will to do to get everybody permits and to uh expedite them and speed it up where we are today all right uh let's move on to consent agendas I'm sorry before you move on um I actually do have a report tonight oh I'm sorry I do want to go over a few things and then um after that um we should do minutes too so um since the last time we met obviously um the mayor has resigned and in the when the mayor resigns the vice mayor takes over that position and will continue to serve in that position until um the next election additionally there was now a seat vacant for district 2 so under the charter you have 30 days in which to appoint someone for district 2 and that appointment they would serve until the next election as well so just letting you know with regard to the timing on the appointment and that we need to find somebody for district 2 and then also um that those seats will be open at the next election so so the next election there will be a new there'll be a candidate for district 2 there'll be a candidate for mayor yes okay there'll be a candidate for district three and yes yes um and I don't know about the rest district one and district one and then you have okay so when when you say the next election you're saying in March March March yes W so the the vice mayor Shall Serve as the mayor until the next election um when the office is filled pursuant to 3.06 which is where the mayor has resigned and you've um ascended to being mayor um okay so but it does not run for the the term of the mayor correct and that's why I wanted to go over this tonight so that everybody was on the same page um it says that um you assume the the duties of the mayor until a successor is Al elected um and then in section 3.04 talking about in the case of resignation the vice mayor Shall Serve as the mayor until the next election when the office shall be filled um pursuant to um 3.06 so and in District Two will appoint um much like what we did with um commissioner minning is appointed for um well until the next election yeah so in your in your Charter you appoint until the next election not for the remainder of the terms okay I I'm I'm not quite okay with that I I don't know that I am either we were talking about a complete turnover of of possibility of a complete turnover the city commission which may or may not be a good thing I'm going to assume that it's not except for you well except for me yeah the then I I'm okay with no I'm just uh what I would like to suggest if there was any way possible because I had I was under the impression that uh the uh mayor uh mayor doctor would serve the rest of the term that was scheduled for uh mayor pay which would be another two and a half years and the reason I'm making this an issue is is to have uh the next election comes up in March which means what in in early November somebody's going to have to P post the paper I'm sorry early December corre by as as a deadline somebody is going to have to post uh go uh post their intent to run and and go through all the process so you're talking about four or five weeks from now and and anyways I I don't know if anything can be changed with that or if it can be discussed amongst the commission I do think asking somebody to to make a decision and be ready to run for mayor and in the next four we weeks when we're all dealing with all these other things may be may be a bit uh of a stretch for anyone at this particular time so you're ready and and well as well you know it uh I lose a year um of your of of yeah of service as well right so we need to if we could spend some more time talking about that if there's some way to work yeah cuz I was under the understanding that it would be for the rest of the mayor or election yeah that's what I thought it was too regularly scheduled Mar election yeah um okay well I'll be happy to take another look but I'm just reading straight from the charter and the charter is states that if a vacancy is a mayor commissioner the vice mayor shall assume the duties of Mayor until the successor is elected and the appointee from the District of said vice mayor so there you know you get to um appoint that district for the appointment of a um of the remaining members of that vacancy you have 30 days and the successor Shall Serve until the next regular city election at which time the elected successor um takes office yeah so yeah the elected successor which serving for the remainder of the unexpired term if any shall be elected so you the election who's elected serves the remainder of this term so we had this happen before I want to say um was it with it was ramsberger I believe that he resigned and during that time period they appointed um at that time it was commissioner Lun if memory serves um and you were in the commission at this time so that's why I keep looking at you um and he served the remainder of the term no he served until the the next election the next election was elected for the remainder of that term and then was on regular so the election would be for the remainder of the term and then you serve you're back on the regular schedule let's just take let's just take take a harder look at that so car can I read it sure I I can't sorry man correct me if I'm wrong but I think commissioner men took over for Seline and that was more than a year so that's the idea of wiping out our Council and mayor all in one election yeah no no no no no so I I think it's it would make sense but it's government so it may not make sense um to let them serve the remainder and keep us on that staggered schedule yeah okay and Ju Just so you know this is technically this isn't my choice I'm just we have Bob men the mayor yeah commissioner tot they would all be up for the remainder of those terms not that that would be now the new segment of those terms but I'll go back and double check it I just wanted you to know that that is um the provisions that I was reading from Caris Capri um per our own city code filling a vacancies a vacancy on the commission shall be filled as followed and this is under Section just for the record 3.06 vacancies forer of office filling of vacancies um it says whenever a vacancy occurs the city commission by the majority of vote of the remaining members shall choose within 30 days of successor to serve until the next regular city election after which time the elected success successor for the remainder of the unexpired term of offices if any shall be elected the mayor shall make the appointment if the commission cannot agree if the vacancy be that of a commissioner the appoint shall be a resident of the district in which the vacancy occurs if the vacancy is a mayor commissioner the vice mayor shall assume the duties of the mayor until the successor is elected and the appointee shall be from the District of the said vice mayor the temporary appointment terminates at the new election of the mayor correct not in mayor well no if you so so mayor doctor is still our mayor for the next two and a half years he will fulfill Tyler pay's position per the code in case of death resignation or removal of a mayor of the vice mayor Shall Serve as the mayor until the next election when the office shall be filled so that is in 3.04 but I'm happy to go back and take another look at it but I can tell you that with regard to the commission seat you have 30 days in which to fulfill that seat for um District 2 and then at that time that will have to run in the next election for the remainder of that term and that's how you keep the terms continuing to be staggered and we've done that before in the past so this term wouldn't be staggered though it would be it it would be on a for District Two no for the mayor regular for the mayor I I'm going to go back and and I'll take another look to make sure but I just wanted to let you know with regard to the seat you need need to have somebody within 30 days and as I read it it says that the um mayor until a successor is a you assume the duties until a successor is elected so they're looking at the temporary appointment terminating at a new election of the mayor which is in line with the 3.04 which says the mayor Shall Serve until the next election so let her do her job and so let some more time on that let me look at that but I don't think it's you'll still have two three and one right that's a bit and we'll we'll look at the mayor okay thank you um but there was one other point that I wanted to make and that was that there was a gentleman this evening that um and I don't um know who the gentleman was but he had a question or an issue with the statement that I was making with regard to um Florida statute at the time in which I was asked the question I have Florida statute in front of me but was trying to help the individual because he was asking whether or not um there was any provision with regard to the one year and so I just wanted to identify that in fact in section 489 103 of Florida statute it does provide that when you're doing your own Renovations when you're acting as your own contractor um that it the property you know should not be offered for sale or lease period that's what it says and he was referencing a presumption and that's true in an action under this part so if someone were to sue under that part and say that he should have had a contractor what they look at is within a year of um that if the structure was the builder was within a year of completion of the same then there's a presumption that the construction was undertaken for that sail or lease so I just wanted to make it clear that with regard to this the the thought behind it and what is said in the statute is that you're not going to just do the improvements and then turn around and sell it but in if somebody brings an action against it that's where the presumption that that gentleman was referencing of has it been done within a year comes into play so I just wanted to clarify that in case there was confusion because he he was alleging that I was misrepresenting the facts and I wanted to be really clear and say what the statute did I was just trying to explain briefly to the resident is there a monetary value attached to that statute so like say if you're replacing a little chunk of drywall and you pull a permit you do it yourself right is there a monetary St amount set to that statute there's a limit on the type of places that can do it so it's really only for one family and two family residents um that are not going to be offered for sale or lease um and then I think that the and I'd like to look at it without talking at the same time but I think the monetary amount is limited to those that are improving commercial buildings and that would be considered a condominium as a commercial building because now we're considered commercial for garbage collection no I so I think your commercial um with regard to the condos you were dealing with with regard to debris pickup maybe is what you were dealing with with that which one is commercial are we residential or commercial right so I will tell you that um in in general condos AR considered um like multif family versus um commercial like from a zoning standpoint and so in this statute it only references one and two family residences so I don't know that it would even be applicable to condos okay so backing up onto that yes a question on zoning that you can try if they're considered a residential then why residential multif family corre why are they considered commercial under the garbage debris side of the world okay you're not going to love this answer but it's because as I understand it and I don't have the citation in front of me okay I'm asking is that um FEMA designates it either as residential or commercial and what they lump into commercial are the multif family structures as well as what we consider traditional commercial under zoning platform for debris hauling and they move the tax assessor says that they are residential but somewhere this scha map that's a question we need to not take our foot off the gas because City's going to absorb a million dollars thank you Rick Matthew District three there is absolutely no difference between our two buildings but that little Dental chart that they have this one's residential we're commercial makes AB what's that what you County we're we're commercial by the by the dental but if you talk to the tax assessor no you're residential and we pay a 100,000 in property tax and what kills me is we maintain flood insurance and FEMA is picking up trash in front of properties that don't have flood insurance how's that work anyway not a beef with you guys I know working with FEMA Federal Government is something but we should not take our foot off the gas there's an answer to that and right now the answer is wrong we are residents we're not an apartment building we're not a hotel thank you okay so we are going to step back and we are going to uh contractor performs any request likewise the county so there's two references to the county he's not resp being responsible for in performing any request or the results there so the county is responsible is not responsible or liable for the contractor's work and performing any that's M yeah so who's responsible Count's not responsible for the contractor's work right and the contractor is Florida demem okay so are they the ultimate responsible party yeah I'll have to get back with you on that one commissioner I would assume that it would be demm because this had been vetted from the legal council okay I've got another one for you and that's in section four pay ments the fourth paragraph it obligates the city to ultimately be responsible for payment so we get the uh we're at the bottom of the list is that uh yeah is that what we want can you legally enter into this agreement you could is that the agreement that you want to enter into is a is a business question as far as whether or not the city um wants to be responsible for the services that are rendered by the contractor should um that are rendered by the contractor and where do we get those services from the county we have no control over who they send us exactly yeah that does no I mean these were I'm not Computing this so what I I would suggest if you want to discuss this further just from a procedural standpoint is pull this item from um consent then you can vote on the other two and then we can have further discussion on this because generally with consent you're just approving consent and moving on and this is an item we should discuss okay so um the are you willing to amend your motion to approve the consent agenda item as to items one and two yes and your second commissioner Toth yes that's fine okay um then for those items um if you could call for public comment okay and then any public comment for the consent agenda which is uh for Contract Services with pelis County Sheriff's Office was um the interlocal that was presented my understanding and the presentation of it is is that this is what the county and um uh was requiring in order to provide those services and was not accepting revisions so I was not involved in that negotiation but that's my understanding of the contract so the question is whether or not the city wants to accept this contract or whether or not they don't and the city manager um may be able to speak more to those negotiations in case I've misstated it anything no you didn't misstate anything and it was required in order to bring the teams down that can perform substantial damage assessments on the ground within Treasure Island I'll take the comments back if um we could remove this item from consideration address the um the items that you brought up commissioner Manning and then bring it back okay does that do anything to the inspectors of the assessors coming to Treasure Island that I don't know well I don't want delay that I mean we've already delayed enough and but I also don't want the city holding the bag correct so please advise on do we delay getting the inspectors here or do we live with it didn't you say the inspectors were getting now since since uh this was originally put on the agenda or now State uh state funded and state provided through through the county and the county contract with the state correct so I would advise that we actually pull this item off we'll contact the County okay um being that we um already have it and a copy has been provided to the county I don't think it's going to delay um we have individuals who are on the ground already performing the assessments but it may delay other teams from being deployed out that's what I'll check on tomorrow okay please let us know as soon as possible the beginning you have we had threeyear terms twoyear terms and oneyear terms so these three I believe after that point they're all three-year terms they are was to get him staggered I believe originally yes so I think um at least two of these are threee terms is that correct so if you look in your discussion and your staff memo what we have is the appointment as a recommendation by staff and by lft was that Keith Dalton would be a board director for class B so his term would be ending on August 31st 2027 okay the appointment of Leslie LE Smith as board director for Class C is a second term it's a partial term someone had resigned ending on August 31st and that would be for 2026 for the appointment of dot minor um that would also be a Class C that would be a second term another person had resigned from the board ending on August 31st 2026 so as long as that recommendation is acceptable and what you want in the resolution yes perfect so do I need to move that again or we could with my original uh motion we'll take that your motion is amended to include those three names in that order and the person um who's seconding agrees to that as well I will second that and I do the city manager um contract specifically it's amending section 12 of that agreement section 12 originally provided that there were 30 days from the date of appointment for the um employee to provide the invoices and receipts with regard to relocation and that relocation expenses would be um reimbursed up to 23,000 um obviously since the 30 days when he started there have been uh multiple events yes several storms uh two hurricanes and other issues so um this amendment is changing that 30 days to 120 days for your consideration this evening do we have a motion yes I move to approve the First Amendment of the city manager agreement Charles Anderson amending section 12 to extend the time frame for submission of moving expense invoices or receipts from 30 days to 120 days and to authorize
