video recorded up to and until the closed session portion of the meeting and it will be available on our Township website I hereby direct this announcement be made part of the minutes of this meeting was a cool weekend uh was a very busy week and actually a busy month and coming weeks with installation dinners for all of our local fire and rescue groups s Corson and I attended tuo fires event it was very pleasant it was a great night lots of shot got everybody takes Jabs at the dinner table uh at tuo fire but it was it was fun and then this past Saturday we attended the EMT dinner which was down at Avalon at the linkx another wonderful evening something interesting is statistic from that night our EMTs respond to over 800 calls per year in this past year between two and three people a day being transported to the hospital um so I found that number to be sounding and testament to the hard work that they're doing every day making us look good up here each week also like to mention uh we received a letter of resignation from uh the chief of our EMTs uh Chief Coker and I would like us to do something at the next meeting to recognize her and uh her time served here that's all I have this evening thanks thanks welcome Sam you um really uh it's been talking pickle ball that's been you know the first month of my time here me and my good friend Ryan uh which is nice when it's been so cold uh dreaming of times of simpler times playing pickle ball um other than that nothing really just really getting working with Larry Cole to get our calendar figured out for our event planning uh and that's that's really all I've been up to right thanks sir well I want to thank uh everything that Public Works uh does and continues to do um I met with them on theh 17th of January just get you know touch Bas with Craig and his uh group there and they have sure sure do have a long list ahead of them they have the heater uh taking care of at the baseball concession stand that's going to have to happen uh they've started uh to resume the leaf pickup I know that you know Snow's kind of been a hindrance to that and then I just told Craig we're going to have to uh start thinking about putting up the green lights for the uh Eagles Victory and then go burgs Tyler uh yeah Saturday we had our Raby clinic at Shore vets uh in two hours we vaccinated 94 animals 83 dogs and 11 cats were vaccinated and 30 Upper Township doll licenses were issued and uh I stopped by there myself and people were comeing and go left and right and uh have another clinic next month on the 22nd 1 to three Saturday same place um I do have one thing at our planning board meeting which Sam and I were at um we had a young lady come up and ask us about the flight path in Upper Township and where it was it's been a subject that was ongoing for I guess it it died a slow death approximately two years ago so I reach out the County planning to find out where it was at and uh basically it died because nobody had already pursued it so there seemed to be I think there was nine miles in Upper Township on the bike pass there seemed to be couple controversial areas but the whole thing was not controversial but there's a couple controversial areas I would like to bring County Planning in one night if we can one evening for one of our meetings and have them present the bike path to us and also to concerned residents um for both sides of it we don't want to have a public debate on it or just an information thing and then we can make a decision do we want to pursue the bike path do we not want to pursue the bike path if we want to pursue it do we put together a Citizens group to governed by two of us which I'm talking to Samer he'd be interested in doing it and a makeup of people from our community who are opposed to it or in favor of it and whatever just to a small group of six eight people and try to come up hey let's do this portion because there's no controversy involved let's skip this portion and try to figure out the solution and there's a I think we could do it and work together as a community and pull this off so I'm going to ask Ryan if you could reach out the County Planning try to get something set up where we can get them to come into our meeting and uh we'll advertise it as such and let everybody know so I don't want to out you young lady to supported but she is here tonight and I told her we would follow up and obviously she's interested in being on the committee if we do a committee form of it if we don't we don't but if she we do she definitely wants to be on it and she's Pro it and there's people that are against it and I would ask them to be on it too because there's got to be a balance and I think as a community we can all work together and come up with an equitable solution so that's all I have at this time um very long Gary do you have anything question I do uh your honor um it's a nice footnote that you handed on community right so my want to introduce my wife is in the audience and the same courtesy that we give the deputy mayor's wife when he sits or she sits in the audience with her kids I'd like the meeting to remain civil right so we're all community and John um you know my wife worked with your uncle and Zach and Sam I don't know if you knew but my wife babysitted me these kids in North so we're all tied in together so I get a little statement I going to read I will always willing to walk away from position but I will not allow myself to be drummed out through lies manaction embarrassment and political sabotage the great work done by all will not be hidden and the guilty will be exposed over the past three years I have done what numerous and prior administrators and personel officers had failed to do Barb I also want to introduce you to my wife as well because if you were crusade to put me in jail was correct you would have would take me away from that woman but that's in the complaint right under my direction I brought conclusion to those multiple costly and long drawn out lawsuits together with the workforce we rebuilt relationships teams and a working environment with growth and w ages clear policy and ground rules that were all equable no more verbal policy or on written rules we brought a 5-year contract together with the Union this barting union now has stability and support there is now peace of mind and the willingness to trust and to talk it out knowing that this administrator is always willing to sit down and work it out no legal actions no costly perk hearings I brought efficiency I reduced the operating economy of Township through career policy realistic approaches and a unique set of skills what I've seen in the last 45 days is very troubling a play of no transparency odd deals Shady meetings sneaky conversations well when the bow is broke the cradle will fall and as a cop I always say we got to know we got to go with what we do know so let's look at the actors what we do know is one of the first actions of this board was to hire Mr blay and his firm Weinberg and Donia Blay's firm is the GOP president chair of the GOP controlling tens of thousands of dollars in GOP money the same GOP that has given tens and thousands of dollars in money to the campaign of Zach and Sam they voted on this after a closed session meeting and that the Zeal for failure of transparency they left the name of the firm off the agenda no reason was given for the hire Mr blay who I know personally is a true Soldier a very good attorney I work with him at the city of wild when I'm as mayor and commissioner Mr Blan says he can fire anybody if you have the time and money you're smiling I know you do right it's one of your famous lines it's quite a bumper sticker for an attorney they couldn't have hired a better guy but the board hires him after the township currently is already paying labor councel so $177,000 for Mr bl's firm $177,000 to the existing labor Council why did they hire him only the board knows perhaps it was to fill campaign promise the lack of transparency doesn't end there we find that the newly appointed solicitor was Palumbo's campaign transer Mr Amon Houser's name appears on most if not every form when questioned for a written opinion he advised that he investigated himself and unsurprisingly his review found no issues with his an his actions apparently they were all perfectly legal even more questionable Mr Aman Hower was part of the Lise firm that firm manages the joint Insurance Fund the township required to join and financially contribute to committee man Casio I didn't know that you were going to fill the unti unexpired term when I called out the possible conflicts relating to the pay to playay and the ethical relationships of your father the zoning board chair and now that same conflict extends to the zoning board which that same engineer has been appointed I understand that Mr Corson received that letter but failed to bring it to the board's attention as of today I've still not received any question or answer to those relationships on face value where is the Township's one and only true voice of transparency Barb you out there to save us Barb is where is the Quest for transparency after all there were no proposals no requests for qualifications no applications no resumés no interviews no exhausted search to find the best and the brightest of any of these hired professionals but yet you call for a criminal investigation of Nate where are the Deep probing questions that you that seek the answer to these payto playay conflict and ethical issues don't these facts warrant your call for the same criminal investigations the same type of criminal investigations you call for against me no questioning of the quick Pro perhaps all you need is to contribute or to be a fan of the campaign sadly Barber's in the tank a supporter of the Palumbo and willing to turn a blind eye when it doesn't fit her Personal Agenda Barb thought she can say and do anything without immunity sadly you're wrong the Township's one voice of transparency has laryngitis she failed to post on her Facebook that she's named in a defamation lawsuit and so is Zach and Sam a lawsuit was filed before the C were seated and gentlemen is my belief that you're Now using public funds for private personal game using public funds to retaliate against me using unlawful actions as listed in 18 and 19 on the agenda for blowing the whistle I'm just an employee but to be victimized by Flatout lies and now to be pushed out of my job with some bad Faith cover story I will let that happen let this meeting be the first that comes up on the internet to form public opinion regardless of whether you exaggerated you lie or you were just told to do it we're going to get to the bottom of it but you created a false stain and tarnish on my reputation and I know in my heart and in my facts I have Clean Hands these type of allegations prevent people from getting jobs and carry with one for an eternity and apologies to appreciated and warranted but now I seek the truth and unfortunately there's no way you three or any others can put the toothpaste back in the tube you can't fix the arm you did there are complex legal rules and principles that can be used to determine whether a termination or firing due to reduction force or layoff plan is being used to cover up and otherwise discriminatory or unlawful termination and whether a who has been fired as a result of the layoff downsizing reduction Force has a basis for those legal claims I will use these rules and principles to bring out the truth and light I plac on the record that you three Zach Sam and Tyler are ethically prohibited in voting on any action that involves me but of course you five don't care because you're using taxpayer money and the attorney gets paid either way it is my duty to assist in the campaign's promise of transparency of openness truth and life if these actions are taken under the guise of economy and efficiency then tonight we will have that discussion it's why I asked for it an open session we're going to educate the public on the cost of employee actions and the savings of layoffs and how they will benefit the efficiency and the economy of taxpayers is my hope that the committee will be leading the way to financial benefits of efficiency and economy by taking no salary in 2025 and returning the salary paid over the past month it equates to about $75,000 Zach you were asked for your position in these matters you talking engineering uh first project athletic courts um so we I sent final plan revisions to committee for review um goal is to have the scope of the project finalized uh once that's finalized then I'll get updated quotes from our contractors and then go into construction assuming we fall under our put aside budget for the project um next one reconstruction of plam Avenue I was sent for committee review um I participating two weeks to go to do for review before eventually going out to bid uh in March or April so it just need any feedback within two weeks before the next agenda from party state of New Jersey Upper Township block 456 L1 13 and block 476 L 29 I speak to agenda items number seven number 18 and number 19 after careful review of Upper Township articles May 2022 through 2024 certainly the public has Grave concerns for the well of the Upper Township tax base transparency and administrator Gary dear Out Gary after 2.9 years he been through what I believe Barb lirry stated Herald June 1st 2022 as critical elements in the hiring practices recommended by the state and best practices paragraph 5 lines one and two she cited a 28 page document paragraph 3 line one paragraph 6 line 13 through three reads resident urged fellow residents to get involved and hold the committee accountable as to what is going on behind the scenes with the hiring I would like to thank BB ly for her in um I am here to give Gary dearo a vote of confidence he has brought so much peace joy and laughter to town hall always a smile a kind word a song a silly joke he brought to fruition millions of dollars in Grants cleaned up new numerous labor brush buyers pending for years at a real savings to taxpayers of upper Gary is about truth holding a person up and helping educate one in the process to get them where they need to be in my considered opinion he raised employee morale to where it is a taxpayer pleasure to handle Township issues to control costs and improveed processes at my request he presented at the Upper Township senior center to meet resident taxpayers hear their concerns view the program and the facility Gary was instrumental in resolving a year-long heat air conditioning problem whereas there was an underlying 2.5 year legal drafting issue between Kate May County and Upper Township over property deed site concerns and clean up he supported me with Kate May County Commissioner over site and services long overdue Friday January 24th 2025 live Gary shared with me a paper um from his inservice that day as he was aware my recent attendance January 16 2025 Upper Township planning board meeting and my interest in the last master plan done in 2005 long overdue supposed to be done every 10 years um incidentally it has been estimated by King Barnes solicitor to cost over $100,000 do I am vly opposed to number 19 spending thousands of dollars taxpayer dollars with fany Don Hue whereas the expenditure by New Jersey state law needs to go to the 10year and pass due Upper Township master plan document in process also I oppose number 21 don't use my taxpayer dollars to pay blay and Donnie Hill item number seven Tiffany Tiffany did nothing productive in my opinion since 205 to move the master plan it is my request the township reach out to CME I understand they have planners that could help with this master plan um I have uh I think seven enclosures here um they all refer to um my talk tonight um I'm not sure how you want me to put them in you can give them to our court she can make a part of the record thank you Natalie thank you all right thank you is there anyone else who like to comment on the upcoming agenda items 1 through 14 then there's another comment after no this is the whole agenda just want to this is all the you're right the entirety so anyone that wants to comment on anything the entirety of the agenda up to number 21 so one through 20 should comment during this speak on the absolute yes y John grub Route 50 tuo um following up on Mr dearo what's happening Mr Maro I'd like to say I've dealt with Mr dearo several times and uh he knows what he's doing I don't think there's enough knowledge sitting on the board right now to cover his position of what he does full disclosure Mr me and Mr dearo we didn't really see eye to eye a couple occasions couple different things but he knows some stuff and he knows what he's doing and he has been a a benefit to the Township in saying that in Mr dear's comments he brought up Tyler and Palumbo and and a Curtis regarding the position they're holding us of right now when Mr panc Co vacated his seat and the the county committee brought in three names to put names in to fill that se my name was put on as one of them Tyler and then Mrs nce in that meeting and this I'm concerned now because of the the comments that were made that the improprieties of how this all went down Curtis was there at the meeting Mr plumba Mr plumbo was at the meeting as well and knowing there's a conflict now and knowing that they knew that there was a conflict it's a greater concern because during this meeting we were supposed to present our reasons to why we should be elected or voted into that seat and hold that seat for the period of the remaining year once we did the were supposed to be a vote County County committee people sat down how to vote I don't know if anybody knows on how this whole process goes but the county committee members that are president of the meeting they get together they send us in another room and they do a vote supposed to be a paper vote ballad vote something along those lines but the three of us were sent out of the room we were brought back and told Mr kashio was the one who they felt was most likely the best candidate for the position we were given no vot results no discussion anyway whatsoever of how this all went down it was basically like okay well this is how it is that's always to we were never even when asked what what was the final vote count what was the county refused to give us any kind of answer and now I'm concerned of how this has all been back doored and played and and put into a position where it's benefiting the township committee that the members that are involved in if this is alleged inci that Mr dearo brought up and I'm concerned if this is how this is this committee is going to run things that's all I have to say right now thank youin there's people that haven't spoke yet is there anyone else like to address T commit want to see all right real quick Natalie you already had your time Township meeting that night but well I'm talking about the night that you took the vote all Miss that's an action of a of a committee that's not this body that sits in front of you you're talking about v i I understand but you're talking about issues with the Republican County committee or the M was the Township District it's the Township's Municipal committee right that's that's what you're speaking about it's a different body than that districts with two chair each and there were 20 people out of the 30 and were you there I was not there aren't you aren't you Comm I am I was not pres I was not there yeah yeah but you're you're talking about something has nothing to do with the five members of this governing body that sitting in front of you that's completely separate and apart from this well that that I find and it's also the same committee that everybody that's ever set up here has gone through with the same process and the same bylaws I doubt very much if you went through what say because there is going to be released as long as we can cover those blackout dates for that area which I'm sure people know some people in the room know what it is but and I believe at least a few members of the historic preservation Society are already aware of those dates they're own correspondents and I don't see there being a conflict because of what's happening there can I have a motion earlier this is a Personnel matter often discussed in Clos session Mr dearo was provided with a right notice and requested this be done in Open Session which is why we are doing it now in the presence of the public so uh just understanding that this is still a matter related to Personnel to discussion is something you typically have in closed but we're doing it here in front of the public at the request of of Mr dear I want to further put on the records under NSA 4 a922 that the gentlemen are both conflicted out personal interest your language uh relative to the state and to the local and it says that uh you have to give an opinion and so even if your opinion becomes oral then it's required that you we provided moralize that advice in writing and shall be provided to the attorney's counsel or commission as have legal opinions have been provided to each of the committee members related to this matter what is that it's it's legal advice that I gave to my clients theing it to you yes the opinion that they receive is they can vote on it yes we just need to again it's gon to come out that's why we're having having it right right they've been provided with legal opinions from Council all right and they're allowed to and they're allowed to vote they're going to vote as they can make that determination but they've been provided with an opinion as to whether or not they can vote is now up to each of them as to whether they're going to proceed forward understood good and that is memorialized right that's yes yes that's been provided for them yeah it's not Memorial Mr you're asking me right all I owe you nothing sir I owe you chap I owe my client no no your client's not there the client your client is the entity you don't represent indidual myice I'm not giving you any other motion there's a there's a motion now in a second for removal are there any other motions from any of the five of you that sit up in this body all right so I hear none that said if you're going to entertain such a motion and vote on it there are a few things that you should be aware of related to your requirements the Township's requirements should you move forward with a vote in the affirmative the first of which the municipal code of Upper Township as well as state statutes creates the position of administrator there's ALS also State Statute that um discusses what is required to terminate the role of an administrator and what the requirements are in terms of payouts should you act to do so that is governed by NJ sa 40a 9138 what that says is that an administrator can be removed without cause by 2third vter of the governing body which has there's five of you up here you can figure out mathematically what that means in the event that you do choose to terminate Mr demaro there's two ways that that can play out be done immediately and if you do so immediately you have to pay him out three months worth of his salary moving forward any anything unpaid up to today's date as well as three months into the future has to be paid out based on determination conversely you can also have him stay in the position for another 3 months and have it take effect as of the 91st day essentially after that third month so you can do it one of two different ways so it's up to you as the governing body as to whether determination to move forward is immediate or if it takes place within three months now that will determine how it's going to be paid out uh based on your decision so you should know that um and I I just want to make that clear before you guys do entertain a tonight I think the motion was effective immediately and like just like we did last Administration removed Scott Morgan was effective immediately and there was a pay okay so knowing that questions if any of this is true you know it's a bad look where is the moral base Wheeling I note I was denied public input octo or um Upper Township committee meeting January 13 2025 Tiffany Tiffany she gets around executive session I have some certificates but till you are done I imagine I will have more my tax dollars help pay all your salaries I am an interested party in the state of New to add I think that you have to ask relative to what these things cost so every action has a reaction so the township is playing with $84,000 of personnel salary approximately 35,000 of ba salary so the economy and efficiency should be explained to the savings as well as the necessity to the township on how it's going to work right and so these these lasting consequences financially yeah that's also the tax collector for Upper Township I have to say how disappointed I am in the decisions that have been made tonight since Gary's been here he's been done a fantastic job he's fixed every problem that we had every project that was asked of him he moved along and I can't say enough about what he's done for the township and I'm just very very disappointed um my question is what is the plan for the um Personnel officer then do we do we have a plan or is that something that has to be drawn up personal matter I'm going to advise board not to discuss in public at this point in time okay will will the plan the will that be available to the public once the plan is drawn off yes okay do we know how long that's going to take to draw off that plan we we don't okay will it affect other employees do we know no I don't know okay well again um you know I can't say enough about Gary's work product um he's the greatest administrator that we've had he's a great manager and I'm just targeting right now summer fall 2025 okay uh the other question I have is uh as I spoke earlier I mentioned earlier I had worked with Mr dearo in the past and working with Mr dearo we were coming up with a solution to the parking problem at the community center and we're in the process of of laying out plans and putting things together and things along that line uh proposals were coming for the township and everything else regarding the use of my property that being said since the process started almost eight months ago your attorney that was working on it is no longer here Mr mono now Mr dearo is no longer here you guys have any knowledge of the situation have any knowledge of the discussion whatsoever to the point we've got so far I've heard some of it Mr amuser has heard some of it he's required to file from I don't think go ahead we're going to continue the discussion we're going to I'm sure Mr uh Ryan's been involved with it engineering which led to my next question was going to be so who am I to be in contact with now to continue the process of where we left off since everybody that was involved other than the engineer is I believe could probably go Joanne the clerk's office and Ryan we're past Joanne's office we were in the process well she proposals of of you disseminate the information that Joanne and Ryan and Joanne can pass it on to whoever needs to say so and and now this is my other concern based on this how many other projects are you unaware of that you don't know the facts of them now that you've removed this administrator the townships attorney and everybody else involved in everything are you guys going know any knowledge of or have knowledge of and be able to handle in your time up there you've removed everybody that has any knowledge of anything there's always going to be ongoing projects wheels of government are designed to move slow for a reason that's so people can become aware and I mean there was a project that the last Administration let languish and that was the bike P so is are we going to get 100% no we're going to thrive to so the problem that we have just just one problem is that this is going to drag out longer and cause a safety issue for even longer throughout this process now well I don't know no I don't agree with that oh don't it's not it's not going to language no okay all right that's all I
