January 27 2025 of the township Council of the township of Washington adequate notice of the meeting was given in accordance with the open public meetings act by the Township Clerk to at least two newspapers on January 21st 2025 and this meeting has been posted on the township bulletin board electronic Message Board WCTV and on the township website please notify the municipal clerk for any disability requirements necessary for attendance at township Council meetings the fire exits are located through the double doors to your right and through the door on your left please silence all cell phones if you unable to attend the council meeting in person and would like a topic to be addressed at a council meeting please send an email to the township of Washington hyphen contact all Valley and Township Clerk Susan wowski motion to open open the public comment period portion of the meeting yes second all in favor I seeing no one motion to close the public portion of the second all in favor I individual resolutions resolution number 25-1 151 resolution committee to comply with affordable housing obligations do I have a motion second discussion um if I may sure Mr Miss Bailey just to confirm we are um we are voting for The 184 units correct yes that's uh just to be clear um there the DCA issued numbers in October of the past year 2024 setting all of the municipalities obligation both in terms of uh present need or Rehabilitation and prospective need or new construction the Township's present need obligation is zero units and the perspective need or new construction obligation for the 10year period of 2025 through 2035 is 184 units however with the VAC land adjustment it will be reduced to a realistic number once that's completed yes this is the first step in compliance with the amended FHA and then the next step is to proceed with preparing an amended housing element and fair sh plan there is an expectation as the planner presented twice that there will be a vacant land adjustment reducing the number and and resulting in a realistic development potential of a number that is much less than that 182 number 184 number excuse me 184 all right so the expectation is much less much much less M as reported by the planner in yes correct but if we don't if we don't pass this resolution it causes us to be in non-compliance and the number can come back even higher well more importantly the township would lose its its zoning uh code basically would would not exist and it would lose its immunity to Affordable uh to developer um build remedy so we have to vote Yes we have to vote on this but it will be adjusted so it's not not not to be scared it's exactly okay just want CL I then I just have one question is it and this this if we vote on this it doesn't affect our standing with our sh against chair housing that's right in in this resolution there's a reservation uh um of the township to take advantage of whatever Court decisions or legislative adjustments are made based upon that litigation and the one that we're the one that we're entered into with other towns that's correct okay thank you sir roll call oh sorry um the is that the monel place that you reference here yes uh I believe it's identified by docket number in whereas Clause second page the SEC the like the second whereas Clause okay and what um once this is uh filed how long before we know uh what our realistic development is going to be June the last uh at the last meeting our planner laid out several dates within which you know the compliance is achieved the next date through February there's going to be a review of the vacant land adjustment and realistic development potential by February 28th that's the Statewide deadline uh for any challenges to affordable housing numbers by March 1st if no challenge of the Township's uh numbers uh the to the municipalities proceed with their housing element fair and share plan and preparation um and through the 31st of March if there's a challenge the program is required to resolve those by the end of March um etc etc these are all laid out I think June was the date where we'd have to oh correct uh yes June would be the date like where we'd have the new number and it' be official we would have to vote on it correct in yes yes but the process meeting up will that Y and last question is there a uh checklist of items that need to to be W weren't there a few items that needed to be done concurrently with the passage of this posing it to the website and filing it yes we've gotten more updated information on exactly what needs to be done and that is my office will be um uh has prepared and will be uploading to e courts a declaratory judgment action in which uh this um certified resolution will be attached to that uh declaratory judgment complaint and do we have to publish it on our website as well or is that not yes so we'll do that simultaneously than good any other questions ladies
