riverfront good evening for the record my name is Alan Haru I'm a professional civil engineer for this hearing I'm representing Olivia McCulla and Jonathan charlon who own a house at 942 drift road on the shore of the Westport River East Branch we propose a 76t long elevated walkway fixed Pier 20ft gangway and an 8 by 16t float with flat stops the record waterways license Plan Three Sheets is dated October 3rd 2024 this I've enlarged the plan view of the water license plan uh property line highlighted in yellow norly property line there's an existing comes down to the shore appear cuts across the salt marsh here this is the edge of the salt marsh highlighted in green and this is the mean high water highlighted in blue the dash blue line is the mean low water gangway in float and this is a profile view where I added a note for the mass division of marine fishies regarding the fact that we meeting their 1 and a half to one height to width ratio for the pier and um so I'll just continue on this property there's a 6t wide path um that uh runs to the shore the proposed Pier extends from this path across 44 ft of salt marsh directly to the bank of the river the width of the pier is 32 in the bottom of the stringers are 48 in minimum above the salt marsh a 1 and 1/2 to 1T height to width ratio recommended by the Mass Department of marine fisheries the deck of the pier is level so the bottom of the stringers are 5 ft above the march at the seaward end to allow lateral access in the intertial zone we propos four pilings to Anchor the float with float stops to keep the float 30 in minimum above the substrate and shellfish habitat and I as I just mentioned we added a specific note to that effect on sheet two or three on the profile sheet David pette wetland consultant performed an eelgrass survey at the property on July 14th 2024 and no Eel Grass was observed within the project area his report to the commission is dated July 29th 2024 today we reive favorable review comments from Amanda Davis environmental analyst from the mass division of marine fisheries the D issued a file number s8- 2769 and we respectfully request your approval of the plan I'll be happy to answer any questions thank you here's just got this today thank you CHR May ready Mr chairman members this is Jonathan charlin 942 drift Road noce the 10 application filed by heru engineering with Alan heru representing the report date is October 18th 2024 the file number is SE 82769 um M mastan vision and marine fisheries comments were received today with standard comments um detailed description of the work the app has filed to construct the fixed Pier gangway and Float on the east branch of the Westport River Wetland line has been reviewed and is accurate the Wetland consultant also provided an eel grass survey stating that none was observed within the Dock's proposed location the dock will be access from a path extending from the home along the north property line the fixed Pier 7 26 ft long will cross over a small portion of salt marsh the wooden ramp and the the wooden ramp uh fixed Pier will be 4 to 5 ft over the marsh the gang way will be 20 ft out to the float system equipped with float stops and set at 30 in off the bottom the public access will be under this structure as it does maintain a 5ot height the dock design meets the town of the Westport doc policy resource areas impacted by this project assault was land under the river Riverfront area recommendations the Westport Conservation Commission should approve the dock with conditions uh require float stops no float storage on the msh must maintain a 5ot height to allow access and this is for file number uh recently provided SE 82769 Mr chairman all right thank you Al you have any questions no I don't gentlemen any question so I see that there are some um you know comments or conditions in Chris's report and then there's some others in the U DMF report if we do the motion should we incorporate some these comments again regulatory agency is what DMF is are not a regulatory agency rally this is more of an informative condition so yes you don't necessarily have to read these but I incorporate these already in our boiler plates we have fuel spill requirements barge requirements so as I was mentioning to Allan the DMF is very not consistent uh in their comments one meaning they have uh three other additional ones attached to them so but this is pretty standard so yes they they go along with our approvals okay our our do policy has has all that in there yes and and the standard conditions have a lengthy um information pending okay barge construction can't ground the barge you should mention it should meet the doag yeah that would be standing conditions advisable Tracy Piva inra zero register app to determine if the resource area depicted on the plan are accurate is it yours green cards there's these the green cards one that go and EAS okay thank you we need a ruler oh well it'll come up okay good all right good good good okay for the record Jim Waltz representing John and Tracy piver um the register Avenue property although uh Chris's report said is landlocked is not landlocked uh it is on two paper roads and being landlocked by definition meaning the is surrounded by private property with no ability to create Frontage so being on two paper roads it can go before the planning board at some point for Frontage uh we're here just to establish the uh approval of the wetlands delineation uh I flagged the wetlands Chris went out and adjusted the wetlands he made changes here here and here this one he made was off the property but it shows that and this is the new What lands line and it's sh the plans that I put before you what highlighted them in in yellow just to make it a little easier for you as I said Chris adjusted the line uh I was in complete agreement with that I did see a couple areas that I missed that uh were very relevant and so uh that part is such the wetlands along conscript at Chris's remarks uh because there's all all on the property it may affect the uh we are disproving Chris said 110 to uh 109 to2 but 108 is also off the proper to so and uh Kristen sent me a copy of his report he mentions an intermittent stream which is located within the wetlands but an intermittent stream has no uh exceptional protection like a perennial stream does we are not we have no proposal before any board in this town at this time not the commission planning board or Board of Health at any point all we are requesting is the approval of wetlands line so we can decide what we are able to do we need the wetlands line for instance to determine if we can get far enough away to do a perk test if we get a passing perk test will we be able to fit in a primary system and a reserve area if we need to create Frontage and entering the wetlands we need the wetlands line to determine uh not only the how much square footage of wetlands we are Distributing but do we have an appropriate area to uh replicate it so once again all we are here for is request approval of the line as delineated by me adjusted by Chris what's that all right good Mr chairman John Piva zero register a uh this an abbreviated notice of resource area delineation the plan itself was done by riverhawk engineering Jim Walsh uh flag the wetlands report date is October 18th 2024 file number was received SE 82771 it was a site visit on October 17 2024 the work is as follows after PR to approve the resource areas located on the vacant parcel the parcel in my opinion is landlocked at this time and has no accepted Frontage the property is located between two paper streets registered to the north and conscript to the South both not constructed the Wetland area is shown on the plan the submitted materials do not include any data sheets to support the delineation I observed uh in my site visit hydric soils above the delineation have made suggested changes to that delineation the following changes uh Wetland Conservation WCC flags were placed above the current location at flag 102 104 uh that would be eliminate 103 uh flag 108 118 118 rather 116 what the flag 114 and and again just quickly I say eliminate 110 to 112 which he actually has two 112s but Jimmy understood I was saying it kind of extended into conscript where there is evidence of neighboring property owners have manipulated this Wetland area um now just quickly looking at this plan Jimmy did not make a flag change at 102 because I noticed the flag in the field was was untied and placed in a different location that didn't reflect what I had done on that day so I understand Mr Walsh is representing and trying to show those represented flag changes um I will finalize that in the end the Wetland is a BBW as Mr Walsh has indicated and there is an intermittent stream that flows and connects this Wetlands to the end of milk a and therefore making this a bvw because it has another connection to an existing Wetland system I I disagree with Mr Walsh the intermittent stream is is potentially a resource area that may be altered across so it needs to be identified so the applicant and the subsequent design knows where to put that pipe so at the present time without that area shown it also has a bank that potentially would be impacted by this project so although an intermittent stream is not a perennial stream it still has value and makes this a bvw because of that um lastly something is off with the scale on this plan absolutely I measured in the field what is shown on this plan is not what's in the field by a maximum of 25 ft in some areas so there's a fudge on the scale there's a fudge on something although the plan says it's an inch and 50 and everything appears to make it fit when you go in the field these flags are a lot closer than the distances represented on that plan gym so there is something grossly wrong with however that plan was shrunk or some again just I can't say what is wrong but there's something wrong with that plan so I'm not going to accept anything that you scaled off on that plan I would like to see a new plan drawn that represents where the flags are actually in the field represented to the setbacks of those property areas because this plan makes it look like there's a lot more Uplands representing on those properties than is actually in the field um and lastly the neighbors have provided photos of spotted salamanders on two occasions in the Spring and most recently this weekend however they showed me photos of a one in their yard area so there could be a potential breeding population there is enough pockets of water that could hold in this area uh that could allow that breeding population it's recommended that a Vernal pool review be done in early spring to determine if there is a breeding population that that comes into some more adverse concerns if there is potential work in this area um lastly this is an enforcement order issued on this property um the owner has still been doing a little bit of work um I just want the board to reiterate to the owners they're in the audience that they're not supposed to be doing any work um again between the neighboring Property Owners there was some disagreement of where the property line is that's not what my concern is the the physical bringing in of a machinery and and doing work is what my concern is so I think the owner needs to know that so I'm asking for this project to be continued to the next meeting I'd like to see a plan of of proportions that meet what is in the field and again Jim I made some physical tape measurements and we're talking flag 104 says it's um 110 ft I believe and we measured at like 85 so and then we measured flag 104 um and we came out to like 37 and supposed to be 50 on the plan so there's a big discrepancy here and that is significant in relative to what is being portrayed it's not on Mr Walsh's time uh dime because it's stamped by this PLS professional aner Bernard parate so it's up to Mr parate to correct those from riverhawk engineering so at this time Mr chairman I believe a continuance is in order uh with those concerns that those flags be represented on an accurately represented plan that's all may sure yes so uh I cannot um speak for the surveying company I never heard of them until I got a copy of this plan so I don't know the quality of their work but as far once again as far as the intermittent stream goes uh while it could be an issue down the line if uh The Proposal as such right now we are only requesting the wetlands line there's no activity proposed for the property at this time the plans are still being formulated the uh the Pirates obviously want to build a single family house there but as far as the Wetland line goes whether it's a single family house uh a 20 story 40b or a nuclear waste dump the requirement is that we start off with a Wetlands delineation uh as far as the um salamanders go that has no bearing whatsoever on the delineation because there is nothing proposed for for a project at this time and then uh uh let's see the enforcement order that Chris brought up Massachusetts state law is very specific on with lots of case law on the fact of blocking access on a paper road to the property owners down that road it is illegal under state law furthermore uh under the wetlands protection act it is of course illegal to do certain work within the 100 feet of the uh Wetlands without proper filing the pivat did not Place those Boulders that were moved they were placed by a third party they moved the boulders to be able to access their property yard waste branches leaves and Lawn debris and all was dumped there they also move that so they could access their property moving stuff that that was put there illegally should not be considered a violation of the wetlands protection act they should not be the ones who have had received an enforcement order well you Jim you know any work done on someone comes in my property and cuts trees I'm the one responsible for it regardless if I did it or not true true they doing work on their property if if I was to dig a boulder out of a swamp that would be a violation if I'm moving a boulder to the side that was D put there to prevent my access I would not consider that a violation the Bold is still there it just got moved so there's been no cutting no no no clearing nothing you saying just moving Boulders where the uh uh brush and debris was dumped that was moved and like any compost pile there was nothing underneath it so they did not cut brush the only brush that was cut in there was access lines made by the surveying crew which is allowed we went in with a small machine without disturbing anything going through between the trees dug some test holes in an Upland area just to see the water table and then refill fill them back in which is also an allowed activity but they did nothing the pivots did nothing to deserve an enforcement order on this project is the machine still there is the machine still there no the machine was there for the uh when we dug the test holes in I I think it was August and then was removed so until they file you're saying they're not going to do any more work mhm well they haven't done any since then other than the survey crew going in so what about the plan what's this what as as I said uh I scaled out the plan the plan scales out fine to me it did not look a right to me in the field but I cannot speak for the surveying company I know nothing about them whatsoever but uh I realize it's not your problem but if the plan if the the if the agent is saying the distance in the field is different than what's on the plan yeah see all I can do is disagree with them and but okay then then but that actually amounts to nothing you know exactly you know that's just all right but as far as the other stuff goes uh other than the plan um the uh uh Chris's concerns of valid farther down the line but without a project before this commission the the there's no there's no need for it at this point okay understood any questions from the table I'm just not clear as um relative to the intermittent stream whether you're saying that given the status of the site that I'm I'm sorry I was okay yeah and I'm horse I was just saying that I wanted to ask about the intermittent Stream So Right now the intermittent stream is not shown on the plan no okay and it is in within the Wetland area and at this point we have no uh project involving entering into the Wetland area okay if we were to say uh want to redeem all of register a as an example then it would be appropriate to show the um intimate stream and how it would be crossed which would be that would be an engineering plan right but at this point uh essentially what we need is to know whether Wetland line is that's approvable that tells us what square footage of Uplands we have where we can do certain things and then that would move us to the next step forward on the project yeah I guess I'm just asking um I mean accepting what what you are what you're saying and I was just thinking whether or not and maybe I'm asking Chris like in the normal course of how plans are prepared something like a potential resource area like the intermittent stream would just be placed on the plan so [Music] where and um so that's really what I'm asking both of you like how important is it like if we were going to approve this plan are are you saying that I'm going ask I guess Chris whether or not you know in his professional opinion the proper thing to do would be to incorporate the intermittent stream on the plan which does not seem to be a heavy lift if you're going back to the survey and saying while you're at it they'll neate the stream on the on on the I I think I think what what why Chris wants it on there I don't know where the stream is but let's say the stream was close to the edge and let's say it ended up did having a larger area of no activity where you couldn't have it where you couldn't do work so if they decide to not do something they sell the plan whatever they do and now that's not listed on there the next person or 10 years down the road there it's not listed on there they come in for a notice of intent and now it's just one more thing that has to be added so realizing it's not going to affect your up what your up Lins are now I don't see what the harm is of putting it on there I mean it's I mean I I mean you know it's up to you I mean this plan I'll be honest with you I'm not going to vote to accept this plan until all these figures are are um confirmed in the field that there is this distance but I don't see any reason why that that being the case my objection to uh delineating the intimate and stream and I think he just worried about the Crossing on the road absolutely right well well from again what my anticipation is in how they plan on accessing this may not be how they would like to access it my my objection to it had to do with at that point not having to go back to the surveyor so if Chris didn't raise the objection on the location of the plan the flags on the plan then it would have been an unnecessary expense on my client's part to send the survey crew back just to do an intermittent stream that had no buring on the Wetland delineation it's still a resource area though Jim under the regulations you're identifying resource areas on that property and an intermittent stream in its Bank on on my on my submission as an androide yeah it specific only for the well I did not use term resource areas I only to put down on the N rad delineate the wetlands Edge so are you calling this a BBW or calling it isolated I'm calling a bvw well you didn't even do that in the way that you determined it there's nothing on the plan that says it's a bvw it's it's on the application I checked the bvw mar and I and I also check the part about observation and how it was done y I didn't put that on the plan because I didn't draw up the plan I know you but I said you it's in the submission that goes to the state and to you so it I think it's to through the chairman I think it's a mute point you these flag have to be surveyed so you put in again the amount of intermittent stream is Flowing out of register Avenue coming this way there's not a intermittent stream in this area this is the flooding area and it slowly start the stream probably just starts its creation somewhere in register a and then meanders down into the milk a drainage soil so you basically as you said before you are approximately off the property but everything these people are proposing to do is within register so see that's where you jumping gun on us again we're not proposing anything you keep talking about a project that hasn't been formulated or submitted everything's been stated that from the owner himself so I am in that defense but we don't know at this point because at this time there is no work proposed you are correct all right that is the only way to gain access or to create Frontage with which this slot needs to do Mr CH show onent or a submission and we don't know that until we have gone before the planning board and see what we arrive with there well you need an accurate plan that represents how much Upland the area you have and I truthfully got to tell you this plan is very negligent in that department so someone fudged the distances here to make this look there's not 16 and 14,000 square ft of upls that is the the lot is 160 ft it doesn't take a lot of square footage to pick up 10,000 ft of Uplands never mind a few more here there you even stated for the record that you saw a discrepancy just by standing there in the field so it it it's that obvious Jim so again there is something wrong with that plan so before I have this board approve it I'd like it to be represented of what is physically in the field if he's got 100t between him and the flags or does he have 80 ft that you know that's a big difference on the property of this small caliber and a limited up so I think that's important if you want to argue you don't want to show the intermittent stream I I I can understand but at some point you're going to have to show it right you're going to represent a wetland delineation without the scream if the commission's having us resurvey then I will show the intermittent stream because there's no additional cost to that if the commission wasn't requiring us to resurvey it it would be an additional cost to doing an stream which at this point would not have been necessary right well I still Mr Jim and I still would argue that if this was appealed and went to the state they'd ask him to show that intimate screen that's just for the record but all right that's not for this board's decision so do you want to continue this or do you want us to vote on it what was that you would you like to continue at the hearing or would you like to us to vote on well if you're going to require the uh I can't tell what I'm require the commission wants the res survey I want to be accurate correct if he's saying it's not accurate men and even without a vote I in the corner of my eye I saw enough heads nod so uh it's up to you we we'll take the uh uh continu continuance yes four weeks enough I assum so all right as I said actually Chris could probably answer better than me because I don't know this company yeah I really don't know their status in that respect Jim so again I he's a former um you work with Rich I mean it's clear you I mean you can have the surveyor call Chris in have them talk through the plan with them because you know maybe they're well yeah I mean that that that would be our next step is to have a client call the surve have them call Chris and say what's the problem right but right uh because maybe you can talk Chris through it but as it is I don't that would just be a recommendation I'm out of the they they can me in the field and they could they they can measure it and they'll find out one way or the other it's effective or not it's correct all right so you want to forward continu we'll uh go for the uh continuance all right so you mind have people in the audience does anybody want the measurements looked a little bit off what was that I was just talking to the gentleman I saying when he when they were saying that we were working on a property that we were doing stuff we actually went there I went there to help the person next door move their stuff around we're not going to get into that tonight though no I'm just saying that that that's what he was saying like he got into it was it with the machine yes to help you to help to help him so you had in there so I'm not I'm not actually it was a tractor it was a little baby tractor little stand up one that you mow horns with that's what we did same thing everybody was doing next door mowing the lawn on the same exact grass that I was on okay so we didn't bring no machine onto any Wetland at all so I don't know why he's saying we worked on Wetlands because we never did well and it was only go 100t John I have jurisdiction and the commission has jurisdiction within 100 ft of a wetland and you've done activity whether moving Boulders or whatever you're given a cease and assist because you initiated work without coming through this commission and establishing what those resource areas are no we moved it cuz we had to go through the the pr test that's your opinion yes I mean that's what we did I I was there with a PR test person what I mean what am I I'm not lying I know but when I went there it's it's it's over with it's not it's not not worth debating tonight I mean no no I get it I'm just I just wanted to it's just been really hot on us so want to speak about all right thank you someone else want they're portraying they brought a mini excavator in there and cleared about 150 ft of register a through the woods over some Wetlands all the brush trampled it down when they went laterally across the property to dig their test pit they basically went through the woods trampled the brush they've been back there since with a mini standon excavator doing additional work and I just want to make that clear all right well Chris Chris already stated that but I appreciate your time thank you all right anybody else I got a comment about the veral cool aspect of this I'm not sure if it would be necessary to determine that on the man correct me on this if I'm wrong because there's as I dealt with this but a veripool is not in itself a resource area it would have to be part of isolated land subject if it's big enough or a bvw correct correct but there still may be a breeding breeding um possibility of breeding salamanders so there is a area that floods and then an area that flows so part of this area is not isolated because it it's the head area of this Wetland system all the yards in this neighborhood flood down to this one parcel and then this parcel receives the water and slowly meters it out down to mil and on to the other Wetlands so you are right this is not an isolated land sub to flood per se but the S Vernal pool habitat could be present in that area and we should take it in consideration if any work is going to be proposed he may not be affecting the veral pool habitat as it's within the Wetland in your determination that you issue the order of resource area delineation we can make make a note that says cuz it's not really a resource area the Vernal pool the Vernal pool could not is not a resource area no it's an additional protectable area so we could just make a notation that a spring review may be required for further work in the area and and again I'm doing that because the neighbors have provided documentation of the salamanders themselves so I explained to them that they need X number of breeding uh egg masses to make that even something that the natural heritage would consider good sir hi my name is Tom cadio I live on conerve Avenue I've lived there for 50 years I had a question on intimate stream because there is a stream that runs somewhere in the woods crosses Summer Avenue crosses that the property lines goes between my property and my next door neighbor and it floods late winter all way through the spring I mean there's always water there and and the only place it can run is across con conscript Avenue so I mean is that called an intermittent stream well intim is when it runs and sometimes doesn't run other well that's sometimes it runs and and sometimes it does run and it runs it could be conceived as that because an intimate stream you can run during Heavy Rain events or and not necessarily subsequently uh without the those rain events so it's something that conveys water from one area to the next so yes it it could be I mean from this neighborhood not to cut you off but this neighborhood is a very high water table neighborhood with with extreme water sitting at places for numerous months because of the the water table being that close to the surface so um and the numerous sub pumps that people are pumping also add to that contribution of water coming off this land yeah because that is a problem there I mean I can't cut my grass until May because of the water that just sits in the backyard correct right you know and I'm my only concern is if you're building something there where's the drainage you know what's going to stop that from my house the neighbors are on on both sides of me and even further up the road correct because we're about in the it all runs downhill from yeah so this so this this particular application is just to delineate the um the wetlands in the future if they decide to build a house and they're going to have to come and they have to discuss drainage they're gonna have to discuss runoff and all that and that would be a good time to address those issues but um this is going to be continued for four weeks where we'll when we have the plan reviewed hopefully that the plan that that Chris believes is accurate and then we can you know hopefully approve move forward with the delineation and they can move forward with their plans yeah which will be a much more detailed plan to show how they're going to get to the property what resource areas they're going to be impacting and anything else they're going to need to do so so that that's that's uh coming in resource area part's over you have no fans tonight it mind it sorry I'll take so for the record I'm davean from Schneider Dean Leone I represent Allison kulage and Thomas Baro um they've uh purchased this property in the past year um they're looking to do a Redevelopment um the first sheet I'm showing you is of the entire property is actually almost 25 acres 21 of which is uh protected conservation land uh the Box in area that I show in dark red is what's left for development uh Which is less than four acres um and what what is at the site is a an existing single family dwelling an accessory uh Barn garage type structure uh the proposal before you tonight is to uh wipe out what's there and start over more or less within the same area that they they have developed now we have a much more detailed sheet too which essentially uh it's a 20 scale drawing what you see in pink are the existing buildings uh we're on the West Ranch of the Westport River the Blue Line represents the high tide line the next Blue Line represents the 100 foot in repairing Zone and lastly the uh the second one is a 200 River bound you can see the existing conditions we have we have the house and deck uh well within the River Front boundary this house is serviced by a septic system which has a septic tank here and a leaking pit further down the hill so everything is really you know within that River Front boundary and the the pink here is the accessory building also within the roar front boundary as it exists today um I'd like to point out though although it's within the riv front boundary the gradient change from uh the normal high tide line up to where the activity is occurring is a 50 foot vertical change it's significant um so the proposal is to demolish the pink structures uh to remove the septic system components and then we're going to push everything up and away from the front boundary as much as possible the accessory building will be relocated uh we're calling it a Bolt Barn northeastly and out of the riverfront boundary you can significant Gap now between uh the 200 rear front and this structure the septic system will be replaced with a deification septic tank and leaching Field located outside of the Rear Front boundary uh the only activity relative to the septic is grading uh we have a really high seasonal High ground water no matter where you do the test bits on the site um so we have to level it up in order to meet um for for separation of groundw and lastly the house which is uh much larger than than what exists is being pulled away from the Rear Front boundary with the exception uh of of just a small portion to the West um the driveway uh as it comes in is actually going to be reconfigured U to the north um but that's all outside of your jurisdiction most of the grading activity for the house and for the new structure creating a courtyard effect is outside of your jurisdiction um we are proposing roof run off the down side of the house uh to treat treat the run off and recharge groundw and there's just some minor Landscaping Landscaping activities just west of of the site but primarily uh what you see along the west side of of of that second blue line is what's proposed within your jurisdiction uh majority of it being removal of of the two structures um we do have a Deb file number uh there were no comments and be happy to any questions is that a new driveway location it is yes so they are changing how they come into the field right yes so they're going through that little Garden area is that where they're going to come through cuz it it's kind of deceiving the way you're showing it it looks like cuz we main road is goes to your right most of the change is is on is right there so when I come down the main driveway where's the main driveway coming in if you were with your finger coming down from Main Road well it comes off off site and then Meander's in it's it's an odd yeah cuz it looks like I drive straight in and buros is right there and I take a right to go to naps right I'm told that they're going to get an address change uh because this actually uh comes off of another Street um I think I wrote what it actually is Scotch pine way maybe Scotch pine way so they're going to get a scotch Pine Way address why it's how they going to do that that's what I was told I kept it the way the assessor records are for this application Chris if you look at the road it comes off of Scotch pine and goes all the way through going to blow Scotch pine out right through their property it goes there already no they're just going to call it that so they're still going to access from Main Road correct nothing's going to change as far as the access for main Ro to get to the site okay it's just that the uh address that they have is not conducive to reality I guess I thought they're coming up with Scott Pine to get there the way they look no no I I understand you no it's just what they're doing here architecturally is changing the driveway for the the change in in the entrance of in the entrance right see you don't even show the old driver that's right here oh there it is okay I'm looking at the cart path up subdivided and preservation was the main goal so the house Footprints were very small in relation to the actual um size of the Lots so this app uh thean uh Schneider thean Leone Dave thean is here representing Allison kulage and Thomas bico at 1787 F Main Road this is a notice in 10 application report date is dated October 18th 2024 same as the site visit the applicant is filed to demolish the existing home and unattached garage and build a new single family home and a boat Bond the site is located on the West Branch of the West part River with the land sloping down to the river as Dave mentioned the work will be demolishing the existing home and disposing of that in the garage into dumpsters the new home is further away from the existing home and at its closest point will be 188 ft from mean high water the new septic system system is outside the riverfront but grading for that system extends into the riverfront area old septic will be pumped and destroyed in place uh the project will disturb 14,985 Square ft within this area most of the work is within a previously Disturbed areas and could be considered Redevelopment the work Falls within the limit of 5,000 or 10% whichever is greater in this case the extent of the work comes out to 99.1% of that area so it falls within the the allowance Theon has a strict CR established on the site to protect the remaining areas from any future activities all roof runoff is to be directed into stone dry Wells along the property and that's what I was mentioning they have a series of drainage areas that are going to be incorporated with plantings and storm water uh allowances so they really have looked at the overall footprint and trying to reestablish uh this so it does not cause any effects to the area at all um resource areas impacted this is Riverfront and 100 ft from Coastal Bank basically is what we're working within we're outside the flood zone um as Dave mentioned we're 50 ft up that slope so recommendations again the filum SE 8277 has been granted with no adverse comments recommendations westw Conservation Commission should approve to propose Redevelopment of the riverfront area with the new home and boat Bond he is already overwhelmed with the amount of stuff that he picks up um would we be open letting him come in and setting his case and would we consider paying for a yearly $50 garbage pass so that he could recycle all the stuff that he picks up is that something that we would consider I know it's a dicey thing but this is a gentleman that is I don't want to discourage through the chairman I think that's wonderful but I would say that he's probably should go to the selectman and and get their consideration I can't authorize the use of a dumpster without the highway department you know knowing but I think if the highway department knew where it was coming from that they may not have again an OB you know objection to him okay but I think if you're trying to get used through the town's landfill facility for a discounted rate or something I think that you know should be brought to the selectman and maybe with their support they could get the Board of Health to again cuz this is a very remarkable thing that he takes his time to do and going to private nonprofits instead thinking out loud here just I that's what he's doing and doing it for free should just let him go to the bring the recyclables to the to the yeah cuz I I wouldn't want to discourage him from doing it and and the fact is it would be awful to say well then stop right well we didn't ask you to even that is kind of not you know I think it would be supportive if they would and I think they would hear them out and say well maybe we can you know maybe the highway department make the highway department known
