burough of Wildwood Crest in the county of Cape May New Jersey into a single issue of General bonds aggregating 16 mil 820,000 in principal amount motion uh second it has been moved and seconded that the forgoing resolution be adopted roll call Mr shiff yes Mr Franco yes Mr Caba yes next is determining the form and other details of 16, 820,000 General bonds of 2024 of the B of Wildwood Crest in the county of K May New Jersey and providing for their sale motion second it has been moved and seconded that the forgoing resolution be adopted roll call Mr Schiff yes Mr Franco yes Mr Caba yes next is authorizing the tax collector to extend the third quarter 2024 grace period motion second it has been moved and seconded that the forgoing resolution be adopted roll call Mr Schiff yes Mr Franco yes Mr cabara yes NEX is authorizing Award of the minimum reserve price auction 6406 cvw Avenue Wildwood Crest New Jersey Lots one two and three in Block 4601 to the winning bidder motion second it is been moved and seconded that the foregoing resolution be adopted roll call Mr Schiff yes Mr Franco yes Mr Caba yes next is authorizing Amendment to the 2024 Municipal budget to account for additional funding from the New Jersey small cities Community Development block grant 2024 ADA compliance for bathrooms motion second it has been moved in seconded that the forgoing resolution be adopted roll call Mr Schiff yes Mr Franco yes Mr Caba yes next is authorizing abatement of fee to big-time vending for loss of revenues in 2023 and 2024 in the amount of 3200 resulting from loss of concession areas due to construction activities motion I have a quick question about this is this something that we received do we have proof that he lost this receipts from the previous year from 2022 I'm assuming I wouldn't have that yeah I just have the email that I forwarded to the governing body that's what he lost so we just basically going off of his word well he had three machines that were um centrally located by the beach P all I can't tell you the amount of money he lost but I was hoping we had some a better idea but I understand that he lost money I'm sure he did I just he could came up came up with $110,000 and we would have to agree to that so I would move the I would move the tablet till I get a receipt from that but um so that's just my my thoughts on that okay so so we have uh a motion did we get a second we didn't get a second we need a second to actually have a discussion so can I get a second first on that okay yes okay now you can um what would you like to do okay so we have a request to table from Mr Franco I just want to make sure I understand the request is the request is to get um information from the vendor showing that I thought this this this lease isn't it a flat amount yes right so um so he has he has a flat dollar amount do the burrow so his request to for this is is based on the machines that he had at the beach Patrol headquarters because there was no electric there he wasn't able to operate those machines in 200 23 and also here in 2024 we can help that situation out we run uh one power line out from the nesus center the back I think it' be easily done to uh restore electric to those machines we just never really had a an ask for it I mean that is that is the biggest h i mean that's definitely sure where it's at I guess I guess my question would be is we know 2023 is passed 24 has not passed so perhaps in in the spirit of of the of the tabling maybe we maybe we could have a discussion with the vendor maybe we could address 2023 first and then we can address 2024 once we know how long the beach Patrol building because that that building is coming closer to being completed in August hopefully maybe but we'll see um there's an easier solve to it is that we already have power to nth their their machines are resting right against the building so we put a receptacle in from the nzv to the outside uh vending machines he could operate okay I don't yeah I don't know how I don't know how much uh Power those there machines if they're 110 or I they're 110 they not they they don't draw that's what they were plugged into before when they were up on the beach Patrol uh building something to look at okay all right so we're going to we'll we'll table it for for now um I do think 2223 but I I think there needs to be a discussion with the vendor first so let's let's have that conversation with the vendor and then maybe maybe we can address 2023 before we so it's not 2024 is not mixed in so he does owe an amount that he was waiting to hear back from this for his contract for this year so you want him to pay that full amount and then we worry about abatements yes I think that's the better way to have it but if you don't mind I would like to like to set up a meeting with with him on just to kind of talk through 2023 and then and then if there's a public works can look at you know getting the electric for those machines uh somehow for him to be able to operate this year very good right so we'll table that yep okay and lastly is authorizing approval of change order number five Beach Patrol headquarters renovations to reflect additional work for floor transition into the locker room on second floor knee wall on second floor added Fire Stop above existing block wall electric to exterior signs and electric to overhead door at the not to exceed sum of $1,186 65 all motion I I can't I can't second this yet I I just found out about this five minutes before I walked in so apparently this was added last night so I I can't second this yeah so let me I'll I'll well can we get a second get a second to discuss it second by Mr Franco all right so uh discussion uh so I'm I I am aware I was actually on the on a conference call with engine ering uh and the contractor and I did press pretty hard on the necessity of the change orders the bottom line is is that there is there is work that has been done in order to keep the building moving forward uh in terms of the in terms of its progress um they had asked for these change orders to be taken care of there's been some confusion with respect to um oversight of the project and involved and and changing the plans and so forth we we cleared that all up um there is funding in place for it uh uh for for the change orders I don't anticipate any more uh after this other than an electrical one uh Mark as we discussed this morning and I believe there's a there's one other very minor one that's coming but all of that said um the contractor is expecting a payment on that the buau uh is obligated to to pay that in order to keep the project moving forward I don't want to hold up the project anymore that we we asked we got into the nuts and bolts of all these so uh I'm I'm personally comfortable with it and I don't do I like the fact as change ERS know but in trying to get the building done I think we need to move forward with it uh and I just want to put put it out there that I'm only aware of one more change or coming for electric and one more coming for I forget what the other one some very small minor concrete work that's in dispute but yes it's is that that uh threshold going in and out of the one room the look yeah yeah so anyway so we have a motion a second yes um I I'm did you just call for a vot I'm doing that right now as long as you're finished yes I'm done roll call Mr shiff yes Mr Franco no and Mr Caba yes okay okay bills and the only reason TR is I was not notified of any of this information so I I've been asked to be I asked numerous times to be put on these these uh these emails and and these conversations but yet I've been ignored so this is another prime example of me being ignored on these emails so um that's my reason for saying no on T desk I have no knowledge about this until like I said five minutes before walking in here Bill excuse me motion that all bills properly authorized as submitted be paid I'll second it it's been moved in second that all bills properly authorized as submitted be paid roll call Mr Schiff yes Mr Franco yes Mr cabara yes motion that all reports received from the court administrator Chief Financial Officer tax collector chief of police supervisor for the recreation department construction official emergency services coordinator for the EMS and wild request Volunteer Fire Company chief for the month ending May 31st 2024 be accepted as presented I'll second it it has been moved and seconded that all reports received from the Court Administrator Chief Financial Officer tax collector chief of police supervisor for the recreation department construction official emergency services coordinator for the EMS and the Wildwood Crest Volunteer Fire Company chief for the month ending May 31st 2024 be accepted as presented roll call Mr shiff yes Mr Franco yes Mr Caba yes motion at all minutes from commission's meeting dated May 22nd 2024 and June 5th 2024 be approved as presented second it it's been moved and seconded that all minut from the commission meetings dat May 22nd and June 5th 2024 be approved as presented roll call Mr shiff yes Mr Franco yes Mr cabara yes thanks CH sure okay uh moving on to correspondant uh we had a request uh from uh Madison Madison Resorts wallwood Crest uh for the bur to consider in the future um allowing some sort of Licensing agreement or a bid process to allow for uh hotels to potentially um have a space on the beach to have uh chairs and umbrellas that can be brought out for their guest uh Happy my understanding is that they're happy to pay a fee for that um there's some work with cfra that would need to be done uh to make that happen I think for next year Connie can can you kind of review yeah um anytime we put a temporary structure on the beach we do need a seasonal um uh permit to do so it's an IP so we do um this year Mark's office went out and they surveyed the beaches and we have all of our um equipment that needs to be on the beaches all of our storage sheds and our beach boxes and things like that located on a map which shows the D and we have to do that annually where we are going to place our temporary structures and then there needs to be a plan for the removal of those structures within 24 hours if there's an impending storm so there's an agreement that we have to do on a yearly basis but we also have a 5year permit it's five years of f standing corrected on the on the IP yeah on the IP um which is our temporary structure so we would have to do a modification to the current permit to allow it or wait till the this one is expired and then do a new permit but each year anything that we put on the beach we do have to map out anything that we're adding would have to be a modification to that permit structures so this so under old business we had uh for a discussion has been actually been on there for I think probably about a year now or so concession agreement hotels owning beach chairs I think that kind of that kind of all tieing together similar type all right so it's already been it's kind of on the uh under old business um I see Madison here do you have any anything for the governing body that you would like to consider for the governing body to consider speak sure just need your name sir Dan Alisia Madison Resort W CR so yeah currently today our team members we have about seven full-time team members that are lugging down uh Beach shares and umbrell we set them up every single morning we break them down at the end of the day and bring them back our goal would be to do what we've done in other Resort towns is to have a shed on the beach that we could lock up um at the end of the night and then store them this is not for uh retail we wouldn't be selling them to other patrons it's literally just for our guests that are in the hotel and it's been very very successful so we're very familiar with uh the cafer plans that have to be submitted we've we do this uh every single year in Kate May um it's an amazing amenity and in fact it's it's what's really helping the resort um separate and and really uh be an amazing property for our guests so um I think it's something that I'm glad every we're here talking about and considering right now as I said setting it up every single day it's actually a request of the team and the uh the employees that are there so thank you okay U Got anybody any questions you're doing a real nice job there too it looks good thank you uh the only thing I want to ask is the placement of the box I have no problem putting that box like against the bulkhead so you could secure your chairs and your umbrellas the plac it out on the beach may be further discussions that we need to have so I didn't know what your intent was I I think that our intent would be just like there's currently sheds that are out there for the beach rentals um that to have one that's just dedicated for the guests of the property that they can go there and then one of our team members would go out and and set up their chairs it would make a lot of sense and if you look at the property you have the boardwalk that's there you have the beach share current rental place to the left we would go to the right um so I don't think it's in competition with anybody because the guest is already they're not paying for it it's it's just an Amed that's added um currently on the in front of the bulkhead I'm assuming that's what you were talking about there's there's like pods that are currently there um it's it's okay it's just uh I will tell you it's probably the literally the nicest view right to the ocean and uh so it would be uh again open I'm open to any suggestion anything to help to make it feel better once we get this building done those pods won't be there I'm super excited yeah I thought you like that part of it it was also nice to see the Lifeguard swimming in the pool this morning to help them out so that was pretty good they yeah we we have a we have a real good crew they're amazing so thank you I just want to know the only other thing I would think of so in terms of uh going out to bid and so forth and I guess from there's would have to be I guess we'd have to determine how many of these licensers you want to go out or is it on a per per request basis but there are some of the details that we'll have to figure it out cuz if to make it fair if every if every Hotel you're wanted to box out out on the beach that'd be Overkill so I I think it's it has to be limited in some fashion maybe it's based on room size and services in a I don't know how we how we get to that but there's just a little bit more details that Mr gunas is going to have to dive into and make a recommendation to the governing body but I do I do think that the service is nice and I will compliment Madison for a job well done that what used to be a dilapidated isore nothing there is now a major Hub in W Crest because of your efforts and the beach Patrol building and and everything that we've done there in in those Municipal Parks so congratulations to everybody but thank you time to ra the next level while I guess is than everybody all right all right um correspondence uh Chief Lloyd is absent Captain you have a report for us this evening evening everyone governing body uh for the month of May 2024 uh the police department responded to 276 calls for service that included 216 criminal investigations um we did see a slight uptick in disturbance calls uh domestic disputes and narcotics violations um in those investigations from this time period over last year service calls we responded to 433 the officers uh handled 672 traffic related offenses uh including 414 motor vehicle stops they conducted 387 property checks and 532 training hours uh we also had 22 uh total arrests um all adult arrests with two of those being DWI um a good significant portion of those arrests actually uh come from our narcotics canine Officer as well um he has been responsible or assisted in in quite a few number of those and he's doing a great job uh working with the other officers um and taking a lot of dangerous things off the street um obviously the summer is upon us now um so we have ramped up enforcement and education in terms of uh pedestrian safety we do have a campaign that will be getting started uh and we were approved for uh grant funding for that as well for July and August so you'll see officers out there um uh promoting pedestrian safety um we've also uh started uh ebike enforcement and E scooter enforcement and we've also added some additional information to our website for that and the low speed vehicles um if anybody was looking for information on on that just to keep everybody safe as we move into the summer season um that is all that I have for my report unless anybody has any questions we just need your name for the record um for the month of May it's it's actually pretty much on part slightly higher than last year um but that doesn't Compass Memorial Day weekend as well too and um you know that's pretty typical for that kind of and were these people residents of this can you find out how many nonr people in terms of the arrests Orr I don't have that information in front of me um it would be available um so if you wanted to shoot me an email or something like that I could I could try and look into that for you I mean just High I think it is you got to remember so we go from a small town of you know 3 4,000 year around residents to you know pretty much overnight we have over 100,000 people in town so I'm going to assume that a lot of that was people that don't actually live here I think it's just the nature of having a lot of people that come to our resort area so with an increased number of people that comes an increased number of call volume uh services and things that people um you know 100,000 people in any town you know that generally generates you know a significant number of calls for service so but not off not off par for for what we typically see um for this time of year this is when we start ramping up It generally does get busier for for everybody every and and that's that's not unique to the police department I think every every Department in the burough sees an uptick in in services and I mean that's just the nature of you know we live in a town where you know we have a lot of people that come to visit us and with that comes you know just additional services that are needed to to keep the count running I wasn't aware we're moving down here full [Music] soon inter live in a so I will say for for me the way I've always to me Wild Crest is like The Best of Both Worlds right in the summer time you get that that kind of influx of of different people different um viewpoints and and everybody comes from different areas and everybody gets here and they enjoy the the beautiful town that we have and then you take a step back in in the off months and it becomes a very small community where everybody kind of knows everybody we call Everybody by first name um It's the Best of Both Worlds for me it's it's something that's actually given me a very enjoyable and long career um so I mean that if you take anything away from that that's pretty much how I view it yeah I me W and everybody knowbody and always to and I've been there since 198 love it it's a great place I I couldn't have asked for anywhere better to be all right any other questions for Captain Gover anybody thanks Captain thanks Captain thank you all right moving on supervisor and OEM coordinator Mr KPS hello everybody Guardian body let's start with uh the EMS uh we had 103 calls for service that include uh 27 transports four refusal treatments uh three public assists 48 uh standbys and 13 uh Medicals or cancellations in that uh mut given uh we went to Wild 8 North wild once and lower Township which comprises of of Diamond Beach area primarily uh too uh we also uh have moved forward with our file of life it's been a huge success thanks to the wellness Expo and and Laura and Nick for putting that on uh that was a huge and and a positive thing uh we go and speak with AARP uh like I was telling the commissioner they'll probably induct me into that too so um and then uh we are meeting with uh Kim from the Rex Center her group at the kns of Columbus the ladies kns of Columbus uh organization they want information on it so we can come to the EMS building uh it's it's you know a neat program uh I didn't want to get too much into it because I figured it's a summer day and everybody want to get out and uh last thing I have on the EMS side I want to thank mayor Cabrera our sign is installed uh for his efforts and making that happen uh it looks good the information will get out there and then uh you know it it goes with the Aesthetics of the uh town so earings uniform which looks very nice except for Greenery around it yeah we're working on that yeah pots that right the thanks Bill and then I have uh for the Fireside and uh on behalf of Chief Cortez uh 47 calls for service for the Volunteer Fire Company two uh fires include building fires cooking fires rubbish and mulge fires uh two uh EMS and elevator assist elevator entrapments and medical assist seven hazardous conditions uh primarily mostly gas leaks is what we see and uh 36 uh unintentional uh inci unintentional alarm activations and that is my report for us and chief Cortez thank you sir any anybody has any questions comments okay thank you thank any questions or concerns you can call the beach Patrol at 609 522 3825 thank you all right any questions good thank you sir all right moving on administrator's report thank you um the beach bunp out project from Rambler and North is now complete and Mark's office is working on the punch list item so if there are things that need to be repaired fixed or missing we will take care of at that time the crest Arch Pavilion is also complete with the exception of just a few items that have been added one would be a railing at the step which is out back um once the punch list item is completed by Mark you will see some trees being replaced and things like that that don't survive but outside of that the project is complete Herford Inlet to kateem May Inlet Beach and dune construction um Del Blasian Associates has completed the beach survey which is necessary for the easements um that is something that we were um tasked to do in our state agreement that is complete now the work is ongoing the paperwork aspect of it um and then we once this um once he finishes that sends us an invoice we would get reimbursed from DCA um through HUD for that work so D is going to expedite that so we get that money before the end of the year so it'll be an offset New Jersey Avenue uh Mark de blaso tayor Design Group the County engineer Bob church and his um professional Paul Cino from tnm Associates continue to meet periodically with us to continue planning for the necessary infrastructure improvements in advance of the County's project um which will be a road diet on New Jersey Avenue they are going to decrease that to one lane this project will be bid out as one project inclusive of the Wildwood Crest improvements and then we would pay the county for those improvements that project is expected to commence with our sewer infrastructure work in early 20125 and it will continue through 2026 that will be at least a 2-year project it involves Federal State and County money as well as Municipal money the sunset Lake State Channel dredging phase two of the greater uh Channel dredging in our area is going to commence next year commissioner Franco and I will be meeting with Scott Douglas and his team from the division of Maritime resources uh tomorrow on phase two to get updated on permitting and acquisition I don't have anything to report on cfer applications Mark is going to report on the Bayside Pump Station uh project which will be ongoing very shortly and while the crest um our Washington Avenue flood mitigation project we are still awaiting word from FEMA on an application we submitted it was an FMA Grant um that was based on a study that was done prior on flood mitigation in that area so as soon as we hear do expect sometime late June maybe early July to hear um on our application whether we were successful uh fiscal year 2023 we did receive a grant for our bathroom construction here in the municipal building a meeting was held on Monday to review preliminary plans for that project the um bathrooms on the first and second floor will be reconstructed to make them handicap accessible we expect to authorize bidding at our July four 24th meeting with construction to take place this fall as uh previously reported we did receive 342,000 roughly for that project uh KC County local Road Safety plan there is an ongoing project with Kate M County where they are uh working on pedestrian safety and prevention of pedestrian deaths with Motor Vehicles so there was a workshop um at the C County Technical School on June 4th from 5:00 to 7:00 it was open to all stakehold holders at that time the giraff plan was announced it is on the website for that um for the ls lsrp if you need that website information I can get that for you as a side note the burrow is also working on our own plan with colar engineering we did apply for a Federal grant it's called Safe Streets for all um to fund the planning of safety enhancements in the areas of concern within the burrow that are not being addressed by the county in their fiveyear plan that application is due in August and it's it's well underway and that's all I have thank you constant got anybody questions for Connie yes she she excuse me excuse me you're going to have to come up to the podium please like a celebrity stand there um I just have a question about the safe streets so when you talk about that where I live um on 100 block of West of Syria and then the next street up is where Brandon's is and that's the Pancake House there's a light there people cut down our street all the time to beat that light are we talking about that kind of safety Street like that because in general it's about right angle crashes and it's about pedestrians being hit by cars basically that's the easiest I can explain it um they either there we will be looking on our own at mostly Park Boulevard because there's a lot of cut through there getting across town to the other side on a lot of speeding issues it's a very wide Road um we're also going to be looking at the beach front areas where people Traverse to the beach constantly um and there'll be a lot of suggestions made by Colliers such as like the strength thing that you see like it looks like a ladder onto that with reflective striping on the beach that's called Continental striping they'll probably make some suggestions as to some flashing signs that can be activated by pushing a button where you could cross they're very expensive they're like $220,000 but they're going to make a lot of suggestions on how we could improve Traffic Safety we can definitely have them take a look at different areas of concern so if you want to email that area and the concerns that you've seen or or I already oh okay I did um I just we can we can defin we're very concerned because we sit on our porch all day and watch people fly down the street and it's just getting progressively worse and when I ask people to slow down you get the finger you get the fu you get the yeah so and I'm like please you know like I have you know I have little nephews and nieces that come down the shore God forbid one of them should run in the street okay so we can definitely take a look just keep in mind this is a study so this this grant it can be up to $200,000 it's a Federal grant but it's a study so it's not going to involve a lot of improvements it may involve a few as a test you can do that towards this grant but it's not going to be physical things that you're going to see done it's going to be a study that shows hey you have problems in this area and here's how you can fix them and then the money comes later when we apply for another Grant but the study has to come first so that's what this grant is the Safe Streets okay Grant they can sit on my porch all day long every day day we will let them know to take a look at that area serious no honestly you're more than welcome to sit yeah no I can't but I will let them know that that's an area of concern brought up there are Engineers we'll definitely add that to the L some concerns that they can look at take that I'll pass sure yeah you have offed for my house Trayvon he sees it all the time he can't believe that I said for years we have complained about this I'll pass it on so we keep an ex ey thank you okay moving on Mr engineer markio thank you so we've uh had several projects be completed recently in time for the summer season uh the following projects are completed in the punch and close out phases are and there's five of them the Reconstruction of Orchid Road the Park Boulevard sanitary sewer emergency replacement Crest Arts Pavilion Beach Street end Public Access Improvement phase three in the 2024 Road resurfacing project all those projects are substantially complete like I said we're in uh punch list and closeout mode and they were done on time for the summer season the Bayside bulkhead replacement and flood mitigation project is complete we are in answering questions uh emails that are coming in from residents that have received some of the noticing we are wrapping up our design plans and we're going to be ready to go out to bid in July assuming that we have funds available to do that right okay so very close I think we're going to be looking for a motion or resolution to bid at the first or second meeting in July in terms of Grant applications our office successfully submit the Grant application for the Reconstruction of Stockton Road to the NJ doot Municipal aid program uh just to remind the Commissioners we appli for that same road to the NJ doot Local transportation project fund we're um what we're trying to do here is we're actually doubling down on both programs to try to get uh funding from both to get a double hit on that roadway and hopefully we'll hear something in the affirmative uh later in the fall this year that's my report okay than Mar thanks Mark any public comment on that hearing none we'll go to public comment you want to make a comment please come up to the podium we don't need your address just need your name start with anybody here in the audience John L Haw I just have a question about things that have happened and and what the real answer is um lived down here for 15 years part of a homeowners association that covers two blocks and we had somebody new come in to BU build a house and there was an easement so there water lines ran through our property no problem I let the Builder go in and dig up by the street because that's where the water meters are in front of my particular thing we had some issues when they didn't fix it long story short couple months go by didn't want to go to the police so I got the town involved and within two days they helped me Mr Allen very nice guy they they told the Builder you have to fix it right I tried for three months couldn't get it done couple months later they then go over to one of our other units and start digging in front of the house by the street again and they tell us that's not your property we can do whatever we want because we got to fix it but I'm responsible for that property even though it's part of the grass right by the street and the sidewalk called the town they said look that's that's a you have to call the cops if they run your property I didn't want to call the cops but I call the cops to build a base B Al told me to go scratch so we let that go everything's fine and I think it's okay they told me that's a civil matter that when it's the sidewalk and the grass by the street it's a civil matter you can't file a complaint with the police for someone trans trespassing on your property sounded weird to me but okay if that's the law That's the Law Sergeant Webb who was a great guy the police officer spoke to the Builder and the owner and said if you're going to go on his property for any reason even in the front by the meters you have to let them know in advance fine six months later I'm down in um Washington DC my cameras go off and there they are digging out in front of my house again they're already six feet in the ground because all I see is the top of the guy's head nobody asked me about anything so needless to say I wasn't happy so it got even worse because about an hour later the cameras go off again now they're cutting my sidewalk in half just drilling the sidewalk never asked me never gave me heads up so I call Sergeant Webb on a cell phone and I said really is this allowable he said I'll get back to you next day I got a call back he said it's a civil matter you have to file a civil complaint so my question is someone comes in goes on my property digs up the lawn cuts my sidewalk in half now granted they only they cut half of it and they did replace the concrete but it looks like crap and it's not the way it was when they cut it and they didn't ask me in advance I would have told them yes because I'm not I'm not a jerk the guy needs help he needs help but you you're already told by the police that you have to let us know and then you come in and you cut my side walk don't ask don't tell and then you just leave I want to know what what are my my rights in that situation I don't think it's fair that I would have to go get a lawyer to Sue this guy for ruining my sidewalk it looks like crap so I don't mean to bother everybody with a personal issue but it's been bothering me because it started last June and then when this guy just cuts my lawn after we've been through everything MH I I hope you can understand and hear it in my voice that it's really aggravating and upsetting so I'd just like to know what are are my options what it's it's already over I'm not looking to sue anybody I never was but I don't think it's fair that I have to eat this because that's technically not my property so I'm just looking to see what what really is the law right okay so I have to tell you of all the years I've been sitting up here I've never heard of a situation like this in all my years here so I'm going to have to I'm going to have to bring in the hard big guns here to help us with help us with that one did did I catch it correctly beginning is this a homeowners association it's a it's a three unit townhouse but it has a homeowners association So you you're so there's three of us that that we have a board and I'm the one who handles all the problems and then there's a property behind you I'm the secretary and the treasurer and there's property I guess behind you or next to you that I since what happened was I called the owner after three months and said look I don't want to call the cops I'm trying to be a good neighbor can you please do me a favor and have have this guy fix my driveway because he dug up the driveway the first day and then three months he ghosted me never came back and it needed stones and dirt just to get it up to where it was he said I'll call you Monday I still haven't heard from him that was September 7th because the builder then told him that I lied to him about 50 times and call the cops on him 10 times which I let let me let me just clarify something right out of the gate neither the the Commissioners or myself are going to nor would it be appropriate for us to give you any type of legal advice okay you you you have various remedies available to you in in the courts through the legal system you are a private property owner if someone has damaged your property you can have claims that you can make against them there apparently I glean that someone has easement rights across your property someplace somewhere there's an easement agreement uh which gives you further rights it gives them rights all of those things need to be hashed out in in a court of law uh so there's really nothing we could do here it's not on your property or rather the condo association property within the lot area uh but it may be your property that's out front your sidewalk your drive apron that type of thing so you have property rights in these things but if you want to enforce them I have to Ian you may not like the answer that if you want to protect your property interest and enforce your right looking for fairness you you you need to exercise that through through the court so I could go tomorrow and cut your sidewalk we're not going to engage in that hypothetical right so no I can I go and cut his sidewalk CU I okay you're you're getting mad at me or you're giving a hard time I'm not I understand your frustration I'm trying to give you some like that that's what you need to do I know you don't want know I have to go get a lawyer now and then pay to do something for a guy who ruined if I go to sell the property now that okay I appreciate your time I'll be glad to talk with you after the meeting some enough all right thank you okay want to talk to me now I don't want to talk to you later hi I'm Barnard junis um I was here last week for the planning meeting because I heard from multiple sources that you guys at your last commissioner's meeting had made a decision on the parking lot at Wisteria and New Jersey that you were going to go ahead forward and gravel it um we were questioning at that point and I was told Point Blank that that wasn't the timer place to ask the question so I'm asking now is this the timer place that I can ask a question in regards to that parking lot sure was that your qu I can answer that so so there was discussion at the last meeting as to whether or not the burrow needed to anticipation if there was a parking problem on New Jersey Avenue to temporarily gravel it to allow for the parking there however since that meet since that meeting two to three weeks ago um we did meet on site we the the the police myself engineering and we decided that as right now that that's not necessary there's there's some work um that we can do on New Jersey Avenue to to clearly identify uh the parking spaces and even potentially changing some areas for time limits and so forth so that ordinance is under review between our solicitor and the police department and the administration so that's uh that's where that stands right now so right now it didn't make sense to invest the dollars to do that without doing the full-fledged parking lot was it would be a waste of money so we decided to table it until such time it we had it re rears his head again uh maybe when the county comes in and does the roadway okay so to continue with that question um can we set up a meeting with you because I I did engage with you a little bit on Facebook to ask you some questions because a lot of people here who are on that street we don't really want the parking lot I mean we're going to be honest with you but we have other options and we would like to meet with you to talk about sure we can why don't we do we can do that offline I have no problem in meeting and going over the pl after the meeting and come over to come over to cabar Commons we already named it for you oh I don't know trust me I I don't want anything named after no if you want to come over I mean seriously we can meet on the grass and all of us grab our launch not after this thing I actually have somewhere to go no but seriously we want to get together with you because cheese but I'm you know there's a lot of people I sent you yesterday I don't know if you got my video with the birds that tree we don't want the tree cut down because that tree has been around Ray's been around how many years 100 years Ray and that tree's been there for every 1910 that's when my house was built 10 and that tree's been there remember hold on just so so we somebody has the floor so we can't we can't like go ahe answer questions so we would like to meet with you obviously because um one of my neighbors said to me today like technically there's really there's a millions of parking spots like 10 months out of the year it's the two months that it gets crazy you know so is there really a need for that um there's a lot of people you know the tree there there's a lot of birds that migrate through that tree every year I mean it's been around a long time it's beautiful I think the video with the birds on the top yeah we're H we're not even that far yet right now we're just uh we're focused on we don't even really had the find I think I may have sent some somebody emailed me and I think I sent the uh the concept design and it was as a result of some of the meetings that we had with revising which way the the traffic would flow but not all Mysteria at all like what Nicole was saying about the speed bumps like we I mean if you just everything off in New Jersey would work better because Mysteria you really have to come experience what we see every day people flying down people not caring people just they pull into our Lots like because there's a bunch of us here from my building they'll pull into our lot make a urn like turn around and go the opposite way and go the wrong way up the street like they're not even paying attention people are I call the vacation drug we all know what it is when they're here they are oblivious you know all all rules are left over on the other side of the bridge when they come the island and it's just someone really needs to come and like just come hang out with us we don't care come see we see every day it's bad you know somebody put up a children at Place lineup you know well that worked a little bit but they went faster so as of right now the lot stand exactly the way that it is so there's no nothing temporary need to be know our Focus right now is what can we do on New Jersey Avenue and even on on the the parking spaces directly in front of the commercial uh properties between sweetb and Cardinal Road so that's that's that's step number one step number two as as as Connie mentioned in her administrator's report as we work closely with the county we're we're we're we're we're still in the concept stage right now as to the design of of New Jersey Avenue there may or may not be a need for a parking a we're just not sure yet the burrow if there is preo we purchased those lot we had a good opportunity to purchase those lots in and looking forward in anticipation of the of the Redevelopment and the business zone so we had a good opportunity the burrow could opt to sell those we could turn them into Green Space we could do parking we could do a lot of things with that park there no Doll part they all use it anyway I'm just saying they're all no that trust me we we get a lot of those we get a lot of requests for that and then so can there just before any votes are made can there be transparency to all of us because we just I mean honestly we sent you a letter back in 2021 with all those signatures from there was over 200 signatures on it and we got no response you know we were kind of like hey can at least give us something yeah I think I think you probably is probably it's because the projects it's still it's still two years away yeah so we you have my word that we'll have a me meeting and we'll discuss the plans of New Jersey Avenue and the lot I just need to have additional we just we're not there yet so I just there's too many other things right now we're in the summer we're just trying to get businesses to be able to operate trying to make sure parking spaces are properly being utilized and enforced and and utilized and enforced my next question yes the gray truck because I heard you were looking at the great truck the great truck yes so so so and Captain please correct me from R but I did raise that question to our good captain in the back when we were there um so we do get a lot of complaints it is a street legal vehicle uh to our knowledge it is permitted to be on the street um but it can't be considered to be abandoned it does have to be moved periodically so inoperable isn't that in the code inoperable I've read that in the code somewhere it says if if it's inoperable it can't be there that truck isn't operable Kathy even said to him he said that was it was her his livelihood she said well maybe you should use it every day it's your livelihood it's I me he really must be broke because he doesn't use it so he's using it as literally a he doesn't want to part pay for storage off island or pay for storage somewhere else yeah yeah yeah and and everybody just like we've heard it's 48 Hours he has to move it we've heard it's 7 uh 2 hours he has to move it um I Heard the last time when I walked out of the meeting last week uh they told me oh we're working on it we're going to hit them with a big fine still sitting there and I know you know he was there all winter moved over to Barry's buns and I know Barry buns and all those guys all complained about him and he moved right back and it hasn't moved again I mean I can literally show you video from my front door I haven't measured to see how far he goes back and for he hasn't moved it so where is it getting enforced and that's where I just want to ask that question because it is the most frustrating thing because I I say to myself what do I have to do go out and buy like a a fleet of U-Haul trucks parking one the Avenue and I can just leave them there the whole time you guys won't ticket me Captain respond go ahead is registered um it is operable he is able to move it around um and that meets the needs of of the statute there's unfortunately there is no time limit um we did look into that there I know that there was some discussion over there um but as long as the so the vehicle cannot be deemed abandoned by State Statute so if he is going back to it he's properly registering it he does have the ability to move it um if he goes and get his battery then it's not but it is operable that car can move which which puts and I understand but that puts in terms of what we can do and enforce from the police department if the vehicle if it's if it's properly registered it's properly parked in the legal parking space then that vehicle has a right to be there I understand that it's it might not be an ideal location for it but unfortunately and we've had many many discussions with with the vehicle owner um and in some instances he does you know move it to be a good neighbor um but we're also in a situation too where every time we go and talk to him and ask him if he can I I don't have the ability to tell him to move why do he parking his driveway do you see how big his driveway is I I can't answer that I mean I mean that's I I understand that but I mean unfor he's not violating anything by having the car parked there and the police department has listened to the concerns of you know different areas wherever that vehicle is we have had you know plenty of conversations with him there's a good number of times that he's I'll be a good neighbor I'll move it and try and find can you again because we're tired of looking at it I'm telling you every single one of us are tired of looking at it I mean I park it in front of one of your guys houses and see if you like it you won't like it you'll be the first ones to get it towed away you know what I'm saying it's just at that point where from from the police department St you know I can't force him to to do that we can ask him to to move it and to you know to his concern too he's said listen if my car is legally parked and and allowed to be there getting repeated requests from me to move it right that's frustrated for him as well so it puts the police department in a catch 22 where you know I understand your concerns but he has concerns as well I'm not violating anything why you keep asking me to move my car so how do you get the code changed to to clarify inoperable I mean if he's sitting there for a long periods of time I mean there's got to be how does that happen uh so that would be something our solicitor would would take under advisement and and review our current ordinance to see work in in conjunction with Public Safety and our Police Department to make if you talk to some of our elderly people they struggle to see you know when they're at like when they're walking when they're just trying to pull out of spots and stuff it people are pulling out of the the Mexican restaurant you you really struggle to see what's coming down New Jersey Avenue with that truck there I'm just it is a safety concern it's more than a safety concern but it's an eyesore it's safety concern but it's just how does somebody get away with that I mean if I did if I put my camper out there it would have been probably pulled away and towed away like the next week you know what I mean like it's just really frustrating for all of us so oh yeah the 20- minute parking signs is that getting enforced because which ones I'm sorry which the on most of that whole area go ahead you go ahead yeah he's he still is Young he's still young a rookie when I worked on the beach Patrol anyway uh that whole area is 20 minute parking why don't you put 20 minute parking right in that section uh you're talking about where the where the the box truck currently is yeah so I as I mentioned we're so that it's all in front of your shop it's all down the other side of New Jersey and coming this way yeah EX for that one block those two blocks as I mentioned when bernardette was speaking it is being reviewed uh on so Mark's office is actually schematically laying out the spaces that would need again that's a county roadway so we need to make sure that whatever we want to do here locally that the county is okay with what we want to do on the on the on the county roadway so engineering is going to lay it all out then uh the the police department and Ron will review the spaces which ones are 20 which ones may be two hours which ones may be no time limit at all and be able to identify that sort you have you have w l that has employees that Park on New Jersey Avenue then you have Brandon's pay account business they're they patrons you have professional offices like where where my offic is and the other ones are then you have takeout businesses are in and out and we have we have the gym and the wellness studio and and the uh and ocean Outfitters that are all you know longer than an hour type services so we got to find that happy ground we're trying to create a business district where parking is was right up now on New Jersey Avenue and and there's areas in between the the median right now quick quick review if you like it may work with not having to have additional parking needed if if if the parking parameters are where we need to be so we just need a little bit of time to do all that but in the short term you know I I think Captain correct me wrong the answer is is just keep is keep calling the is keep calling the the the police department and you can do what whatever we can do when the time comes terms of the 20 minut no no no in terms of the issue with the truck the truck the large box truck and I know that I know that we're going to review that in terms of the term inoperable or anything else I think that's between uh police and and solicor gun we can certainly we can certainly be a conduit um for that but unfortunately again he's not violating anything so you know for on you know to take the the other side of the coins when the police are are constantly going out there and asking him to move you know there's frustration now on his end as well I'm not violating any any ordinances or or any state statutes why do I need to move my car correct so we could certainly try you know continue to be the conduit but I mean we have to be cognizant of both both sides right and where he's parked now I mean it's on it's on the corner so it it could hurt a sight triangle so that's that's something that's a hazard for people trying to cross the street there maybe we can put a no truck parking sign up there yeah so yeah there's thank you I come up with one with respect to the uh business district I've been kind of reading through it over a number of years since we attended your proposal back when Co he had in a parking lot back there yep it looks like things have changed quite a bit in terms of the original plan I know the parking lots changed at was theod yeah that changed no longer a restroom in there right we a lot a lot a lot of that changed as a result of those meetings we heard we heard the concerns right so so you did pay attention in part to the petition that was sent absolutely yes yeah clearly uh but we would like to say that there shouldn't be any exit or entrance on theor road yeah what we see is as Nicole pointed out we see people loop loop loop loop around basically from wisteria and they go around sweep and they just keep coming around and around and around and they're looking for places to park and an entrance and an exit on Wisteria Road would just exasperate that to no end and we lose another parking place on this theor road right and that's and that's something we can we'll dive into some of that when we meet maybe after the summer like it's not won't be during the summer but let's let's let's grand plan still in that area from the old railroad station area from sweet ryer down to Esther I saw the schematic you still talking about having uh housing on top of the offices so there's yeah so the so the the zone as designated by the planning board and the Redevelopment zone is is actually Heather to Coline right so in the in the local land use law uh this was set I'm going to say back in mid 2000s commercial on the bottom and residential up top is the requirement unless um a a variance to not have residential or not have commercial in the bottom would be brought to the planning board well the schematic still there is that indicating that you know fact going to tear everything down and rebuil no no no that's that's completely up to the individual Property Owners that's of Interest so what kind of businesses do you expect to be in there having my experience down here there hasn't been real round businesses that are survived in since the early 60s right so the re so the Redevelopment zone is focusing uh retail food and beverage um personal care services such as the wellness studio and the gym and so forth um it's good we're eventually the plan would be is uh there's a master plan so hopefully folks can get to it via bicycle VI uh um uh foot traffic and so forth I think I think the anchor business like and I I'll just give an example I think one of the things that you're seeing now there's there's going to be some future development because I'm aware that there's going to be some some properties demolished with new commercial going in on the bottom and residential up top the Getty station is one of them the what station the Getty station project uh the Getty station the one where there's nothing there right beside the happy ice cream as an example so that one is going to be uh that was a golf gas station Coopers yes coers that's Getty yeah like what I say Getty yeah yeah I'm sorry yeah so um and then uh Remax the Remax building as well so there's G going to be commercial so there's there's activity uh activity happening in the background in anticipation of of the of the district coming um listen I think I think we all agree what's there now is doesn't look good it needs to be it needs an infusion of life and and beautification uh I think the gym is is is something that we'll we have will bring some traffic to the area with people moving in there and and you already have five stores there now that are that are there two or year round three three your seasonal so we're hoping we're going to try it uh and see see if it goes but you know I I think that um I think with all the things that the planners and are professionals and the planning board are working on right now I think I think uh it'll happen eventually but um at the at the end of the today what's there now the roadway and even the condition of the sidewalks and the all that has to change it just looks bad so I did see the list of businesses that you encourage yeah but I also show the list of no yeah there's a dry cleaners and linen Services Etc well how's that Bo up Bood for Stokes is there Wildwood linen if you will so so the re the Redevelopment Zone you're talking about yeah so that's a that's a that's a uh existing non-conforming business right so so some if that business goes away for example or the building they can't put the same business back right how you going to get rid of them yeah uh listen I'm I Pro I'm not I I know that we're we've been working with them since since even before Co hit to try to find a location and it's been a challenge uh and I I don't want to get into too much of the details only because there's some ongoing things that that we're experiencing and working through right now but um but I'm not going to say we disagree but it's I think I think it's safe to say that the area there uh even Through The Eyes of our planning professionals it's it's not a good industrial it's not a good spot for an industrial business and they drew groundwater out of there for 50 or 60 years and there's a lot of substance in that area because of of it yeah and that's so I know we're I know that's being clean I know that there that's been worked on by the state it's very close to being 100% remediated if not already they're not taking groundw anymore are they I don't think so notw okay that's all I have for now thank you anybody else L more hi I'm sorry I'm late I had a dental appointment I would have liked to have been here at the beginning I'm Ray's wife Stacy and I was wondering if I might make a suggestion for the green belt for now maybe some benches and picnic tables is that a possibility you're talking about one the Wier live yes okay your trucks park there aw lot oh not not they Park they Park do they really oh absolutely I question you like yeah because I I will because I'll take care of it tomorrow all right one get out of here go ahead I'm sorry that's that's all I had to say just you know perhaps we could have some benches and picnic tables uh on the property on that green belt on cab Commons yeah yeah Cabrera Commons thank you you know that's going to sticko ice oh it's funny I'm glad to see they open I didn't know if they were going to open or not they finally did anybody else public comment yes sir yeah I just want to go on record I live on 100 block of West Mysteria Ryan movy mul V uh just on record as being president and uh would like to be informed if there is a meeting uh after tonight's meeting in the fall we're looking in the fall Bernard I'm I'm assuming you're going to be the uh the spokesperson and the coordinator on your end so you want emails email email our phones better because sometime like Facebook is hard to like it's like it's all my phone blows up so better by email thank anybody else public comment any on the conference line have any public comment I do mayor Dave mcams couple of items if I could um I was very happy to hear you say that multiple hotels with boxes on the oceans side of the Dune would be problematic um you know I've ask the pack how many of the beach boxes are we going to put out um I certainly would think that a beach front full of boxes for the hotels would be problematic secondly that then begs the question of what kind of parameters does the resort have for the umbrellas and the chairs that they're putting out for their guests I don't happen to live on Rambler but if I did they're taking up all the prime spot ocean fronts and once again if you take it to its extreme I've got a whole bunch of Hotel umbrellas taking up that en entire ocean front up and down on the island so what of any parameters do they have when it comes to how many umbrellas they can put out and how much of that Prime spots they can take so so my understanding is uh that when their when their gas wants to go down to the to the beach they have uh maintenance help that will uh take that will escort them or take it to you know take it down for them but there's nothing nothing being reserved or blocked out on the beach like large like large areas or anything say I walk by I should expect to see people under every umbrella well uh I'm not only put them out whenas for to put out as opposed to their staff showing up in the morning putting them all out that well in theory yes unless they went for yeah unless they went say back to the hotel or for a walk or or do something else but in theory I think yeah I think the point is is that I'm going to Fig I'll find out but my guess is that the staff is putting them all out first thing in the morning that would be my guess because if that was me if I was St that's what I would do because I'm sure I got other things to do other than put umbrellas and chairs out for people but we'll see so what once again they can just put it anywhere they want but I'm asking if you they have any limits as to where they can put their umbrellas and chairs where they can put them no it just it would be just like if they brought their own chairs and umbrellas or they rented them from Beach they could they can it anywhere anywhere y you and I can take a run on the beach at 8:00 or at 9:00 we'll see how many umbrellas are already out some more if if you're going to run with me I'm gonna take you up on that okay I'll leave you I'll leave it at that but certainly I can see that you know if this is one Resort offering that has an amenity to their guests it won't be long for the other hotels to feel compelled to do the same thing that would be my fear um we'll and we'll leave it at that um one other item I'm assuming we're going to have another after all business another public comment section no actually this is the this is the uh this is the last one this is the only okay all right okay then I got go ahead clearly we're gonna have to have public meetings on the New Jersey business district that I'm assuming they're going to kick up here shortly since that work begins in 18 months is that fair statement two two less than two years cor that's correct okay so my point is at what point in time come back to the community with what the burrow wants to do with all the islands and the traffic cing and all that stuff that was part par to the conversations three years or four years ago now yeah so the so the county yeah so the county has a portion of that so they're they're they're in charge of the New Jersey Avenue Road diet medians line striping and all that good stuff the Burrow's portion of that is in those six blocks of the of the downtown The revitalization Zone um is what that area will what that will look like and how it affects you know parking for specifically in between where the medians are for instance understood but my point is at some point Tom you're going to come back to the community say this is what our plan yes yeah so there so it's again there's a lot of people a lot of different organizations and professionals and entities involved so it's yeah the answer is yes okay third third item be real quick I heard a band playing at the Apollo week ago Saturday so about 11 o' what is the noise ordinance I know in North Wildwood outdoor bands got to get shut down at what is the noise ordinance in the car in the in the crest it's 11 11 11 it's 11 o'cl okay first first time ever okay and they shut down promptly at 11: and that was uh about to see if it becomes a recurring item or was just the one off and then lastly uh the last time I was there in person I asked about dogs on the beach we said we're going to get it back on Old business I don't see it have you made any decisions on dogs on the beach yeah yeah so it we were it was been recommended not to not to encourage or allow for that at this time okay the rationale for that was uh I think safety perception of dogs doing their business on the beach um just policing of it policing of it enforcement there's there's been a a couple different points okay so the other the other communities on the island don't have those concerns because they allow dogs on the beach morning and evening that's in certain areas I'm sorry commissioner Chef all diamond Beach and all North Wildwood I'm not aware of that I know Wildwood has a specific area on the beach for dogs the dog part that is St yep okay so the answer is no dog on the beach at this time that's correct okay but what at what point time do we take it up again uh I mean the concern how how the concerns the Commissioners rais never go away so it's a it's a it's a no it's a hard no it'll always be well no that could change I mean if if if if there's different people sitting up on the dice right now they may feel differently and they we have other department heads and the public may change and they may change things things differently as well so I I only say at this time because I can't predict what happens in the future so so but right now right now know unless there's a you know a big public push to to H I don't see it happening there because as as much as there the public that wants it there's a lot that do not want it and the crest has been you know they they it's been this far you know um with without dogs on the beach you know if it ain't broke don't fix kind of approach and again the enforcement is the biggest thing okay thank you all right one more com fortunately I spent a lot of time growing up here and wandering the marches and the beach and it led me to a profession where I basically concentrated in sedimentology mostly in sandon so I know a little bit about sandon and this beach is growing about 37 Feet a year I think Stockton did that study in four years took me two days with satellite images and old aerial photographs back to 1913 when they installed the two Jetties in the Kate May Inlet and when my parents grandparents bought this place and when my uncles and my father worked in Wildwood Beach patol Wildwood Crest Beach Patrol first the beach started at cvw Avenue and when I was a young guy it started at Atlantic Avenue then they added ocean and added nomain tore all the dunes down built those lovely motels and change the whole culture and why we crust and I see the beach just keep growing and growing and growing I'm sure Bobby Clary can testify to that uh where the old Admiral Motel was it's now the whatever new resort at high tides I used to dive off that bulkhead and you can see now that beach is what 250 yard wide from there Bobby 250 300 y wide but what's no most noticeable is keep raking the beach and not allowing the dunes to grow out and what I see at the end of my street and what I see in front of my street is that every time there's a blow off the ocean we get a lot of sand on our street never saw that before got such a wide flat area it's lifting that sand up and it's coming down as far as we are going into the bay and exasperating the filling up of sunset Lake and plus the inter Coos the Waterway so there has to be something done in order to Abate that sand from migrating on Shore so I consider your engineers swe bar has there's so they're all on every time every time there's a blow and we have a rain you can see the whole outline of our cars all around the street from Sand you can feel it and it's fine sand and it's loaded with Heavies it's coming from down the street that's a so the long term is in a 100 years you might not have a bay yeah well so you're right about that the uh and speaking of the dredging where are they going to take the dredge spoils they're purchasing land C they're attempting to do that now which is why going to be that way on sure that's up to the do do is in charge of drudging the state channels so they are currently working on an acquisition not all of it can go into a CDF because it is a lot of sand a lot of sediment I should say some of it may go to Jarvis sound some may go for environmental restoration that is all being worked on right now and perhaps we will get some updates tomorrow but they do have a plan it's a multifaceted plan results from the pump on program outside Ocean City where they're pumping an in to yes I worked in Middle Township when we did the thin layer spraying Marsh um at the um at the um Wetlands Institute the unfortunate part about that it's it's a great thing for the environment and it's a lovely thing to do is you really can't get rid of a lot of the the material The Dredge material because it it goes for You' have to have a lot of acreage to do it so it really doesn't get you what you need when you have large quantities like we do um some of it will be used for environmental um you know Restorations but a big majority of what they're going to take in our project which is phase two will go to a CDF and that CDF will be owned by the do and the remainder of the area where the CDF is will be taken over by fish and wildlife that's the plan right now will the dredging of sunset leak to the entire Lake it will only be the state's channel the state will only pay for the state Channel I noticed when I was a kid we sailed out of the yacht club and you can't do that or there's a Keels at the bot yeah we have been looking at the idea of drudging the lake unfortunately not all of the lake is in West a lot of it is in lower Township um so it's a complicated uh process but we have them talking about it we've been working on it we've been engaging lower Township but right now the plan for the dot and for the state at the state's expense solely not on the Wild Crest residence is to plan to dredge the state Channel and they are going to relocate the state's Channel which will be of great benefit to the taxpayers so with respect to the uh beach run again uh why aren't you allowing Dooms to grow further out well because the uh this the Army Corps and D are working on on that on oh that's a foolish exercise anybody that studied sedimentology knows that's a St stupid thing to do you better talk to the state I can't think of any project in the United States as a core of engineers haven't screwed up from the Mississippi all over the United States everything they touch goes like this yeah so so the answer is is this is is that project supposedly is we're being advised is going to happen within two years so we're just kind of waiting to see they're still working on some of the details all that so well there'll be an attempt if they put that long Dune up an attempt for a land grab that they'll try to make a wildlife refuge behind that Dunes uh I didn't hear that I did not not aware of that okay just ask you but but there but I know there there is but there is there is there is law there is new law that just came out with respect to the endangered species yeah yes you seen that bumper sticker all right anybody else public comment I'm sorry we we have one in one in person at the podium and I'll come to the conference call right after my name is Jo in reference to the proposal to add a structure which is really basically a shed on the beach to store beach stuff the issue was is it going to turn into quote unquote reserve seating because and actually that hotel is I was just walking around yesterday over the weekend it is a plus but what the first thing that I thought of well the maloha which eventually will get built and the reges and all the other hotels are going to say well can we have a shed there and then what happens is you're going to walk down the beach and there's going to be 20 or 30 Chase lounges which pretty much that's what they're putting at there's Chase lounges so it's going to turn into somewhat reserve seating for the for the hotel and that's technically it's public space it's not private space so and you guys picked right up on it you realize that if you approve one guy to do it it could turn into and when we talk about structure it's going to turn into an 8 by8 uh Texture 111 shed on the beach so then if I was the Regis or the maloha or any of the other ones I would say well that is a great amenity uh so we just got to be careful that it doesn't turn into what in essence will be reserved seating and I would pretty much bet that in the morning they bring the chase l is out and they're sitting there so the rest of the people the day Trippers and the seasonal people are going to be looking for spots and there's going to be 20 or 30 Chase lounges that appears to be a private area so you guys were right on it I just think it through the the hotel is great and and it looks beautiful and I'm so glad to see that it got restored uh but we just don't want this is a public beach that people from all over the area come to use and we want to make sure that we don't end up looking like we have you know private areas so thank you very much thanks out for your patience with everything you got it conference line you had a you had a public comment yeah hi my name is Chris I can you hear me okay yes yeah good so I just wanted to voice my opinion regarding an interpretation of ordinance 85-69 that apparently prohibits the use of artificial turf in the burough Wild Crest so by way of background I live on St Road the last 10 years the only um I the home stone or concrete separate houses on the corner of Pacific or C and actually one of C has 100% burnt out weeds and dirt um over the last 10 years I probably spent over $2,000 annually on SE charges and $1,000 to maintain the only patches being gra on block and actually I finally given up duing the ever increasing cost to maintain the property and keep with the heat the water and everything else so while walking the% AR on their lawn a double because at first I thought it was real is not yesterday froms or 80s it's high quality realistic and life I thought this was a great e friendly option since that would sa thousands of thousands of gallons of permeable no longer requires landscap which elate noise solution CO2 emission and blowers and all the of so after my installation compl last week ice to stop construction notice on my door Friday that ASCO which is not is prohibited and Zoning need I went to the Bur Hall on Monday June 17 to construction zoning and asked what the issue was I was told that 859 AR I said it did not say that they said a legal interpretation so I called Clarity he told me that since his office told me that the ordinance not specifically allow AR it is therefore prohibited I that's incorrect interpretation there is no specific ordinance or rule AR Turf by not saying that Turf is allowed does not result in that should be prohibited this is to nail the reading of the ordinance to coate other materials that are prohibited for example other material from referencing re Bears Etc if the bur intent toit it stated that it was prohibited to interpret otherwise incorrect interpretation additionally 85% of address the backyard according from the there should be a 30% minimum planting and mtion or grass and be no more than 20% maximum for Stone cover m definition of Ming in section 8511 it says that quot a layer of wood chips stra plastic or other materials placed on the surface of soil around Plant to retain moisture to prevent from growing to hold the soil place and a plant grow definition PL other material [Music] surf at a minimum should toal purp do conversely the burar 59 only allow the FR yard landscape it should be consistent and defition to include the tur it cannot have it both B being one interpretation of the the's purpose the sections are ACC with each other describ to the bur's interpretation and finally if the burrow intends to rule against the turf it should not discriminate and afford all code violation front yard landscape incl 100 Stone the front yard landscape but code is very specific very specific only 20% lock it is crystal clear and not sub to interpretation a much bigger issue okay so uh so the issue was on the artificial I I that was that was a if you it sounded like you were reading from a from a statement if you don't mind emailing that to to our clerk so we can have all your comments uh summarized in in our meeting minutes that would be great um and then uh any action necessary by the buau Andor the planning board will we we can you know send that to the uh through the through the proper channels but as of right now um our our interpretation from our solicitor is what is what the bur's position is until such time as that respective ordinance gets revision revised is there is there any is there any anything in the agenda or anything that future in terms of when you might be visit that ordinance there they they're at the at this time there is not so so what's my what's my course of action I already have and what's the course of AC yard I'm just confused no so so the so once if as far as code violation if you receive the code violation what what that code violation is that that is still an active violation and you need to adhere to to doing that however if you you have a request that um until such time as the buau can can can dive into the details a little further um and you can certainly request and abeyance at least for a period of time until we can have a chance to take a look at it but right as of right now you have an active uh uh violation so I thought I thought sure my course of action my course of action to do what it first of all send your send your state send your send send your comments to to our Clerk and if there's anything else you want the B to consider you can certainly make that request as well through our Clerk and then she will forward it to the powers to be so to speak and then we will we will take any appropriate action but if there's something in there specifically you're asking the bir to do I just I threw out an example if you're looking for the burrow to to u to to hold off for 30 days or whatever the case may be we will look at that based on whatever you're sending to us in terms of you know the the reasons why you you're asking us to do that yeah the issue the issue of artificial turff has it's actually it's a land use ordinance right correct me if I'm wrong mayor I was going that's not well it is my interpretation of yours but principally it's the interpretation by the planning board who did look at this issue I I believe they considered it several times they fairly recently amended that ordinance they didn't touch that provision so that's there interpretation and it's been their interpretation according to them for a very long period of time that the uh artificial turf is is prohibited did did you hear that I did I don't think know that the public knows that people I mean other folks who to have AR what about this issue on the stone too I just don't get it I just I'm just a little bit confused in terms of you don't out surf my FR doesn't say that um picking and choos okay yeah I don't I don't I'm not familiar with all the the pro the properties that you're referencing and so forth so if you're if there's issues like that you're raising their attention again you bring that to bring that to our attention doz and dozens of that's that's a fact we know that stone stone stone is Right stone is considered permeable mayor you'd have to know the history of each and every property to know when that was put in if it was pre this ordinance or another ordinance 20% maximum for stone in the front yard landcap it's very crystal clear so you can't you can't say you can't deny me tur if you don't deny people's St that's ridiculous yeah again I'm not familiar with all the land so you're you're asking me to comment I'm asking you to send whatever you have that you want the borrow to to review formally send that to our clerk I'm making that request of you again because I can't sit here and understand the properties that you're referring to and the history of every property without us having the opportunity to dive into the details so so I appreciate you calling in bringing it to our attention I'm just asking you now um as we close this conversation to send the information to our Clerk and then we'll follow it up accordingly and and I'm just asking for a fair interpretation and apply fairly amongst all presidents of of the of the bur as well so I will do that because I just think it's like I said I say it again the the ordance is crystal clear with regard to Stone and we all know that there's a lot and lots and lot in the front yard that are not conforming yeah you and and if you're going to if you're going to just you know not allow my turf because it looks a heck a lot better than the stone does and is permeable St per the tur is per there's no reason why it should not be allowed right I'm saving I'm saving thousands and thousands of G everything else right okay so you're going to send that information to our Clerk and then then we'll respond accordingly thank you okay anybody else public comments before we wrap up the meeting anybody in the audience anybody on the call any public comment that's it okay entertain oh we got commissioner comment I have none I have none either mayor I'm fine good all right entertain a motion to adjourn motion second all fav hi
