agenda okay please state your name I'm aing um I would just like to stand and read a thank you card for everyone that assisted us with our June 8th family fund day our first annual we're hoping to make it an annual thing that will happen um year so we have a card because there were a lot of people that helped in a lot of various ways that helped us out I don't I don't even want to count the ways I would just like to read the card that says a special thank you every kindness has a part of bringing joy to someone's heart it's sometime easy to forget that there are nice people out there doing nice things for others thank you for being such special a special reminder and that's from the fic and WIS event committee so if you helped us in any way to make it possible we thank you like I said this got longer and longer but we had a great time uh I think the thing the kids talked about the most was getting squirted with the water from the fire truck because it was definitely hot so thank you thank you thank you all righty right thank you ma'am okay please state your name and residence uh Vernon Bernard um chairman of the wco uh I'm here to ask the commission and the uh City Manager on our 700% uh increase on our water bill on a meter that was donated to us uh they were supposed to been uh going to study that issue and uh I'm just here to remind them that don't forget to address that issue for us I have I have an update that I'll go over during my staff updates okay on it all right thank you thank you sir anyone else all right item three the cassen agenda these are the council meeting minutes from June 4th can I get a motion to approve I move the consent agenda can to get a second pass second all right we have a first and a second motion approved need to vote that's right sorry I need to vote on that all in favor say I I those Boos all right motion carries all right item four updates city manager Terry Bard thank you Mr President uh I'll try to be brief I do have quite a bit um just kind of give you an update if you haven't noticed the delineators for visibility been added to the uh South Main Street um so I although I have not seen them at nighttime hopefully they'll make a difference um that's one thing they could do right away some other things as you know are going to be a little more lengthy we've uh submitted our second draw from uh the bank on the John Henry park for 393,000 , 44442 so we've just completed that the Palm shop as you know we've just finalized the hazarder cleanup up there so we'll if they have not started already um we will be starting back shortly to get it done y get it gone is it gone that even better so go yeah so um as you know we're um still working on the performance contract uh you know for uh the Energy savings with AMI stuff like that as you know one of the uh key things I have there is understanding where we're at in the midyear kind of review so Stephen's going to come back from January to June to tell me where our our margins are uh before we'll move forward with that but we have still moving forward with that request and doing an RFP on that um the water rates as a gentleman talked to to give you an idea I'm handling the water rates in a three-prong process the first one was speaking to the City attorney um kirston and to make sure that at least what I wanted to do would be legal and right and so and that is um to look at the rates and the rates only and how it's structured the other is uh Florida War Water Association involved and they're asking for several things from the Steven to uh determine what we should do and they're they're difficult they're 2023 profits and losses Capital approvement plan build us for 23 for each rate class and unrestrict Utility Fund balances as current as possible and then the last thing I'll need before I can make a recommendation to the city council uh will be where we at in that January to June uh midyear Mark as far as our new rates and you know are we seeing the significant gains that we need uh and can we lower that rate or you know is this a pereral straw that breaks the chem back I do not believe it will be I believe that basically once I get those last two things answered um I'll be able to come back to you and we will be able to look at the rates steering and the cost based on changing it by resolution according to uh the ordinance but that that's going to need some more explaining so that that's where we're at on that and that'll affect also the them out there and the W AA um so the community garden and uh uh so it's coming but I need to get to the end of the June uh until I can actually come back had a meeting this week with Central Florida fiber so we are working on the second proposal um they are stating that they want to come before the city council on July 2nd and give you an update of what their plan would be like of course that's also we're going to have to go back and forth a little bit with it uh before we come on the second and then uh later on that month there'll be another plan coming before you from the city staff out uh on how a uh cink proposal would look like and then at some point we'll obviously have to make a decision on which way we want to go as you know the budget is going quite well um we are scheduled for July 9th um we have been in talks Steph with the department heads I've been in discussion with the CBA and our staff you know so they're going forward the uh the gfl contract we met uh yesterday I believe and we ironed out a few of the key issues that I have in Billing phone complaints and yard waste pickup disposal so we'll be coming back to you with a presentation on that and a recommendation which way to go um the last and final two things is the town homes development agreement we're working on that we um basically have met our side their side the attorneys um made some changes amendments redrafted a few things each side has it back I suspect they're trying to push also for the July 2nd uh to get it in front of the council so they want to move pretty quickly with it also and then also we had an emergency purchase of a pump the lift station at the Middle High School the tune of about $5,500 uh that we did and I know that was quick but a lot is going on that's my update staff please Chief rolls right Chief stle yes sir just uh letting you know that the County's budget meeting is going to be on July 16th and that's when they'll be discussing with all the fire departments July 16th Mr Benton steagle uh yes sir not not a whole lot going on at the airport um we're finishing the exterior of the new building um the porches uh front and back porches are going up right now and they're starting to uh to put the metal work on those things um now and on the inside of the building we're we're starting to do we're starting to work on finishes um just about everywhere um so tile's going to start be put in the bathrooms um flooring is going to start going on finishes are going on concrete soon so it's it's coming together we're still we're looking at a mid August move in date cool I haven't been in a couple of days but I don't think the stairs are in yet Mr Mills you have anything HR anything from you no sir thank you Mr Bishop all right anybody else in utilities Mr Donald Barber okay Council anybody got any updates or anything okay Mr Mayor yes thank you Mr President I have a couple of things first of all I'm going to hold this up for your camera also our animal shelter is full of animals and they are trying their best to get volunteers I've offered the city manager him and I have had discussions of what we can do to help with the animal situation he is working on it and going to make some determinations on what we can do the reason I'm bringing this up is this flyer says help us help them so if anybody out there in your broadcast land or in this place that cares about animals you could help by simply taking these animals going there spend an hour walking them on a leash and giving them a chance because here's the goal the goal is to get our animals adopted and you can't do that with an unsocialized animal these animals need need social contact and volunteers going out there and walking them and interacting with them gives them a better chance to be adopted so if it's in any of your hearts I thank you for it the other thing I wanted to remind everybody is that tomorrow morning at 10 o'clock is juneth which is going to be held down here in the park uh and it would be good if anybody who's interest ared would be willing to attend and show support for the event and the last thing you said that the I had some questions about an item that was going to come up about the agreement that I that you have in the council in the papers am I to assume that all of that is going to change I'm not sure what you're talking about well I'm not going to item 7B it's who who is responsible for what um and and you said that there are got some been some back and force and and things like that and and I don't want to bring it up prematurely if you're looking at that uh then I'll hold my piece but are you talking about item a yes yeah so we there have been some discussion about it yeah okay so we're going to talk about it more when it comes no we're not I I'm just pointing out I had some questions about it but if you were still negotiating the contract it would be pointless to waste people's time with discussion about something that may not be in the contract all that's all I had thank you okay I'm good all good okay all right item five new business B discussion with possible action temporary appointment for Group C council president Cox all right we have two candidates for for Group C and one of them is Meredith Martin who has been I think that's not correct Mr President yeah we only have one for that seat I think we just miss Martin is the only person for that seat just one okay sorry about that all right so I will entertain a motion I move approval for mer Martin to Bill seat C until the term is over until the until the special election it's like four for meetings or something okay a second a second any other discussion yes who could be against M&M's okay well that's a good point ww CN N I move to vote all in favor say I I all right motion carries congratulations Miss all right then then do we do a motion for El then I call for a motion for Alexia re Rio I make a motion that we approve Alexa Hannah and I'll second that you have any other comments okay is I'll entertain a vote is for elexia I don't know why I want to call you that sorry he'll get it he'll get it right I I'll coaching yep sorry just a lot going on outside of the world if you're so is there there a um motion for it okay sorry a second move to vote second you vote I'll vote yeah all in favor all in favor say I I those opposed no the motion carries congratulations congratulations our glutton for [Applause] punishment all right and on five for D if Miss [Music] Martin now you have to face The Crucible come on up Alexa Alexa get the woman a microphone yes because you're too quiet she is very quiet could you ladies both raise your right hand please and repeat after me I do solemly swear or firm that I will support protect and defend the Constitution and government of the United States and of the State of Florida that I am duly qualified to hold office under the constitution of the state and that I will well and Faithfully perform the duties of the city of Williston Council on which I am now about to enter so help me God thank you ladies congratulations [Applause] up here ladies you have chairs up here you you got to come up here and you get to fight over who gets to sit next to me all right item 5 a to discussion with possible action for guidance development agreement for Laurel Point attorney Walker Bullock good afternoon everyone uh as you said Walker Bullock here for uh lural Point Incorporated we have a I was going to do a little slideshow so the the development agreement for lural Point has been going back and forth um for quite a while now with the city staff I think we've gotten to a point now where um looking for maybe some you know hopefully approval or if not recommendations from the council to move forward um if you would quick please so the property here is um you can click like three times please uh around wind Dixie um sure most of you are familiar with it uh it's kind of in l-shape there with um access to 41 on the east side uh and access to 27 on the North side the 41 access comes out by Southwest First Avenue right there um consist of approximately 8.2 acres and then um quick again please so as you can see on the the picture on the left the city owns a right of way just south of the bull Point Property um this 50 ft wide runs parallel to the property and you can see in the picture to the right it's a little bit hard to see but there's a old Remnant right away that the city owns It's 190 ft long and 50 feet wide that bcts the The lural Point Property you see on the on the right the kind of t-shape there goes from the Windixie parking lot um down to the to the what we're calling the southern right away south of the little Point partiel all right there's a few impediments to development there uh you can put like four or five times for the city um for the developer the impediment being that the um the remnant RightWay bisects the low Point property and then for the city on the east side you can see that do requires that Southwest First Avenue directly align with its counterpart on the west side of 41 so the way that the city right of way comes out there it comes out south of Southwest First Avenue um Southwest Southwest First Avenue comes out across from lural from the current lural Point Property not the city right away um and do has ruled that that intersection has to be symmetrical and aligned um for them to for construction problem um another problem is that neither of the existing rways that the city has have any drainage rights that makes them a where they can where construction or Improvement is available um and then also the city has utility infrastructure um I know there's some sewer Ms I'm not sure what else I think the city staff may can help tell us that are on the low Point property that aren't within the city's ride of ways um they don't have easements they're just kind of stuck on on the r Point property and uh when Dixie also has expressed resistance to allowing an outlet there at the current um the current Remnant rideway where it comes into their parking lot is kind of close to the store there and they don't want uh they've expressed Us in the past they don't want uh traffic coming in and out at that point so this is kind of our the solution we came up with that we've been discussing over the years click it a couple times please and that's move the as you can see the the blue arrow kind of in the middle moving that Remnant right of way over to a new access point at wind Dixie that's going to come over next to those come out next to those retail shops over there um uh wind Dixie has expressed interest in um in allowing that intersection to occur at that that point since it's further to the east away from the store um and then also we were talking about moving the southern R of Way North a bit so it does align with Southwest First Avenue and would allow the uh that intersection to be symmetrical um and do requirements uh part of this solution is that is that lural point developers would also Grant a drainage eement along the rear line right away so that the city can avoid that problem and allow construction without without having drainage issues and it uh will place the majority of the existing in infrastructure within the rideway and then um cck it again please and then then the the developer will also Grant a public utility easement to accommodate the public some of the public utilities won't be moved out won't be put within the right away but with this solution um the the developer would Grant a easement that would allow the sewer Main and any other existing utilities to remain where they are now and and like I said wendixi has expressed interest in allowing that to come out there so uh part of this uh solution is a term we've coined the roadway joint venture here um where we um are asking the city and the developer to work together for Mutual benefit um what we're asking the city for here for this southwest First Avenue public rideway and the northern rideway to 27s for the city to provide the lime rock base for the cell developer to construct the remainder of the road um in addition to the um you know for the city this we think this would be a good investment in addition to the benefits previously discussed with clearing up the rway and clearing up the issues with the utilities um it would also you know once this development gets going it'll also generate revenue for the city through property taxes and utilities uh one other thing I want to point out in the development agreement was the drainage easement as you can see that's in this picture that's when Dixie kind of on the right side there um the developer sorry this okay the developer owns the parcel on the west on the left side of the screen but the city of Williston owns the partiel in the middle what we have labeled as the city of Williston pond so we would need to drain the water an easement from the city to drain the water across the northern part of that parcel uh to allow the to the drainage pond on the on the parcel to the West there okay so this is kind of what we would be looking at it' be a multiple phase project it's kind of a technical drawing and I pulled out of one of the Architects drawings for the first phase of the of the drawing what the first set of houses would would look like and then this is kind of a vision kind of a what we anticipating the final project to look like this was from our previous engineer he kind of did the overlay where it's a little bit easier to see what the full what the full project looks like again please as you can see there will be commercial retail space um on the North End next to 27 on the East End next to 41 the orange areas there um with residential housing in the middle um we were discussing having up to 60 compact homes looked like it may be a little bit less than that now um the homes we were talking about uh not being very large uh be more affordable that way and lower maintenance um we thought it' be good housing for retirees first-time home buyers and young families uh it would allow um essentially we' have it structured where the homeowners association would come in and provide landscape mowing all that kind of stuff it would be almost more like living in an apartment or something obviously it's not an apartment but more of that kind of a situation um with less maintenance uh as I mentioned before commercial areas we're Envision restaurants retail shops maybe some entertainment um and those areas on the North End and on the East End um also a walkable layout you see in the between the homes there there's little walkways and paths and stuff like that um we also allow the residents easy access to wind Dixie uh and then McDonald's and the retail stores there as well as um the other uh commercial buildings that come up um in little Point itself and then also uh with some of the previous staff it was a big deal having the green space so you see they put in this illustration they put little you know trees in the Retention Ponds and stuff like that hedges around the area um if that was something we thought would make it look a lot nicer like that so anyway that's it so is W Dixie are they in favor of it or not they're in favor of the changes they didn't they don't like the way the current city right away is laid out they don't they're not in favor of access there they've indicated they would be in favor of access at the other farther down farther down okay now we uh we did put in the agreement as you probably see that we're not predicating the we can't speak for when Dixie but they have in when in Prior discussions have indicated they would be more interested in Access like that and then are they what about a barrier is there something that's going to wrap around like U when Dixie's parking lot we talked about that we talked about privacy fences and shrubs I'm not sure if anything's been finalized there okay one of the developers here answer those questions Mr Boer come up here please yeah if you come up to the bu to and state your name and your residence please Ken Boer willston okay and uh appreciate this opportunity to be here tonight and I just say to you that uh since the last time that I've spoke with wend Dixie while they say they would agree to something like that they make it so astronomical that expensive that there's no way that it would work yeah and so the reality is that easements there but I can't foresee that it's ever going to attach to the wind Dixie parking lot as far as a hedge absolutely we intend to have a hedge growing along there to our benefit their benefit so on and so forth okay and then I know noticed where it said for the city to provide the lime rock for the road base yes sir uh that's what that's what we're asking um in as much as the president at least one that I can uh speak to is Kia Plantation that's been built for some time but some of the council members are still here and uh probably will remember at that time that the city provided practically all of the utilities because of the benefit that it brings to the city right and in and in fact since that time there's approximately 30 homes out there each of those homes paid a connection fee and they pay taxes and a revenue is that's generated from that uh development continues and Will from now on and so we're just simply saying to you uh dun Ellen High Springs Okala Gainesville all of these other M municipalities encourage developers to come in and do this sort of thing because they increase their revenue and the previous administration uh we were in agreement that they would put down the lime rock for the road and then then we'd do the rest of it which is substantially more than what we did in Chamilia plant but that was our agreement with them T if time has taken place and meeting deadlines with D do and Environmental Protection Agency and so on and so forth has caused a situation where we're into multiple years now of this project to get this project approved but again yes sir we're here to ask you the city to work with us to help us to make this development for the good of the community not just now but long term okay if I may can I ask Mr Bishop a question or Mr Barber whoever would like to answer when Country Lane Estates did all their roads did we provide any of the lime rock or anything no sir okay I would just point out there did did the city have a lot of sewer Ms and utilities on the Country Lane estate's property I mean the city's might have cost anyway regardless of this I think you know no sir I'd like to know what the city manager thinks so I will I will tell you this I'm sorry it's okay to talk I will tell you this that you of course we we are coming here tonight for guidance and Direction um you know this this developers agreement that that they have has in my understanding been through city attorney's office and back and forth of Mr uh Bullock's office um this is the third Administration to have looked at looked at this um it started with I guess Mr Litman started with I guess Jackie Gorman then obviously it ends up with me I I will tell you that I mean although I appreciate these other communities doing that there are some places like gachua County they don't do anything you pay the freight on at all because we've done this work too to see where we're at um the best we're told that from our providers that provide us with electric and all that kind of stuff that as City the size of us with the budget that we have we should not be in the business of providing services to developers that they simply should come in put in their development and then we will hook up to them with our um utilities water sewer whatever um I imagine the budget was quite different in 200 19 and I have looked at some of the emails and there are discussion back and forth between the parties involved in that Administration and second Administration about doing just as Mr Boer says surise supplying some lime rock um but I go back to the same thing that I always say that as you all know as a city manager you know I cannot approve anything above $10,000 I most certainly cannot approve a developers agreement um that's in the city Charter so any development or developers agreement that would have been included in this Lime Rock and said where the C was going to do it would it come in front of the past city council they would have approved it and I would be bound to do it to legal document Mr bullet buta um or Mr Walker and basically but at this point we have no we have a developers agreement in front of us that I'll be quite honest with you maybe this is what the mayor was talking about um you know it it it has not really I don't know if the utilities department set a complete thorough review of it um maybe they have are you referring to Laurel Point yes yes uh we've had a review of the utilities okay so I think only the real big issue is is that uh barring my final review and obviously presenting it to the city council the big question here is whether or not I think we should be doing it or not and I simply do agree with it about providing the ler however having said that um my job is fill the will of the council and if it's something the council chooses to do we will most certainly make it happen Mr President yes if I may Mr Bard what I was talking about in my earlier remarks was you said there were revision is this something in the back and force that was brought up that you felt that the city should not do to them or is this the first time this has been roached no we've had quite a few conversations about this between myself and Mr bulock and my staff and Mr Boyer there's been multiple conversations at my level uh me saying that this is not something that I could agree thank you very much so and I did suggest that I will in their defense to come here talk to the city council explain the situation and however if uh you take another bite at the Apple and it works out in their way I mean my job is not to be the goalkeeper for city council uh my job is to bring to you what documents that are at a certain level for approval and guidance in this case and I most certainly need guidance here on how you'd like me to proceed I can tell you I have a couple of concerns um with the road to start with the road uh the road is not only Lim Rock it's they they've asked us to cut the road pack the road responsibility put the line rock down and then turn it over to them for asphalt so it's not simp simply just give them the lime rock once they've cut the road they want us to put the base down which is me meaning build a road right um I also have some issues under the covenants on on number seven where it talks about us being a joint applicant uh on all necessary development development permits meaning going out and getting drainage permits dot permits Swift Mud permits I don't think that's our job to be a joint participant in the development um I've never seen a development agreement say that before I would also say that there are a few other issues that I have but those are the main two that I have I don't know how much a lime rock how much a road it it's essentially building a Lime Rock Road I have no idea it's a pretty long road in two directions um I don't have any idea if somebody has an estimate of what that a cost I would love to hear it uh yes ma'am we provided an estimate through a builder because the city staff doesn't have the equipment to lay down the roads so we did go out and we got a couple of quotes I believe Terry has one of those quotes to provide if requested well we I don't have it with me unfortunately it's $6,000 yeah but I want to just make sure Mr Boyer though is your now request just on the RightWay are you talking about still the whole Road well I think the exchange would be so the city's looking at like they're doing this favor for the developer but this is this is going to be public right away here not till you give it to me right but but you're talking about this you talking about just the space between the road and where the RightWay ends are we talking 15 30 feet 30 feet wide or we talking about the whole road because the quotes on on all of the road you're not just talking about the jog right you're talking about the whole Road up the whole road across that's what this says yeah this is the whole road so so there's been a lot of conversation and at one point we even talked about the city kicking in 10 gr um for it um but like I said this is not about really it is about the money and times are different today unfortunately from 2019 2024 um as y'all heard me say before you know we're looking at Capital we're looking at reserves and Utility Fund of $1.2 million that's it we should be 3 to four million we're looking at reserves in the general fund of $800,000 we should be 1.2 to 1.5 and that's the place we're trying to get to um so this money is coming out of somewhere that's going to be taken away from some Capital project um and unfortunately you know our budget just doesn't we don't support it I I I I don't how I do it because I think the figure was 70 something thousand correct me if I'm wrong Mr bullet Mr Boyer it was it was it was up there and we can look at that later but it's not just that little RightWay that you're talking about it's it's actually the whole Road and I have no problem with the realignment of the the road at the southern easement if you want to call it that and I have no issue with the access to when Dixie being moved so won't be in the middle of your development project um I think it's a a better place at the other end as well but the other things that are actually going to take money out of the city coffers in order to take away from another project I I definitely have to think about that long and heart well I understand that and but but I simply reiterate that for for the rest of forever the city will collect revenue from this devel and I I just think it's reasonable that as a city and the one that's going to get all the revenue that you help and so yeah I would ask you to kindly consider all the revenue you're going to sell the I was going to ask are you not planning on making any money on this development and only the city is we want to but we don't know that yeah it's a big risk oh I I understand that you know gonna be millions of dollars I my concern is simply that if a precedent is set then this question comes every single time with every single development and you know this may be achievable in some way shape or form moving money around but if the next one's bigger and it's not that's not does not seem fair well there was a predent set back when commit Plantation was developed and the city happily joined in then and has been collecting good Revenue ever since gas water electric and everything else that the City offers and they've made money every single month since that time and will continue to and they will with this project as well so I I understand what you're saying um related to the revenue and well what they supposedly we did prior to but what happened before has really nothing to do with what's happening today we as Mr bavard has said we have to look at our budget whether not we are at this point able to and whether it really is feasible even though we may benefit from years down the road we have to look at today where we are today R she was just mentioning a president so I'm just telling you president has been established our staff has said that that it has not so Mr Mayor yes and you could also say that a precedent has been set by the lar subdivision so precedents are no longer the issue and and the town homes developer will be written the same way and Morales is actually paying yes Morales is actually paying so precedents are not the issue yeah I mean I I wish we could be like other communities unfortunately we can't um you know our our our electrical supplier fmpa you know um was shocked in the way that we were doing business um you know it's it's we called around talked to other companies other cities and yes I understand Mr Bullock said these or Mr Boyer said those um but there lot them buta does Cost Plus 25% um and I think some of those Others May invite you to come but I don't know that they pay yeah I don't know that they put the roads in for you and I think Mr Mr Barber's got a total figure of just the one road so in the total figure that you're looking roughly well actually not even roughly you're looking at 8,632 just for phase one but the thing I'd like to bring up if if you don't mind is we're talking about a private road not a city road so if we do it for a private what we do for is a private road when they build it but they will dedicate it to the city so I do understand that point not not if it's an HOA no ma'am do what now he's they're talking about making an HOA so I don't believe it'll be a public road once you do the HOA well it could still be yeah they were going to dedicate it to the city public road yeah he was going to dedicate it to the city once it was built or at least that's what I I read here but it is not a road that the public would generally used the road is meant to service the community it's not a three Road you're exactly right yeah so to give you advantage of of of the develop to the developers advantage of this is and you know Chief you can chime in here anytime you like but even if it is public if it's not designated as private of course private roads still need to be built the same standards as public but if it's a public road and once he wills it over to us and it's built correctly we the city of will is forever responsible for that right so that is one advantage it is a named road and it will be a city street that's fine once he dedicates it to the city to digress back to the is it a city street that ends at a gated community or is it going to be is the community going to be open to the public it's this the road is not a through Road so it doesn't go into Chamilia Plantation we promised you could drive on it but you couldn't go anywhere we promised those people we would not come into their Community but I think with with with the second phase you're talking about would go all the way out 27 right it's not a dead end rad it does lo through it has two entres and ex yes come on 41 right right and if you've got commercial property on the you want to get to the commercial property on the 41 side you can go through there right because the road's on the outskirts of where the buildings are say the people using the commercial and retail space and the residents are not the public I don't really understand is this a HOA yes he said yes okay so if it's an HOA once you enter on the HOA property it's done they can they can stop you at any time and say you're no longer allowed to cut through this road because it's by the HOA and in order to change that it would have to be voted upon by the residents that live in the HOA so they can dedicate the road from 41 to wherever the HOA starts and then it stops at that point we have no Authority at all once the HOA says this is where your road ends unless they give it to us right the developer would maintain control of the ho give it us would have the ability to dedicate the indefinitely not indefinitely but long enough to dedicate dedicate the I many it would be a three Road they could come again 27 and go out 41 and as as Mr Bullock said get from one commercial property to the other and and where it comes out on 27 is it coming out in the city or on the outside of the city it's coming out next to wind Dixie yeah uh I don't think want to pass the whole property is within the city it's pass here look at this it'll show you it shows you the Retention Ponds and you can tell where the road is for the BR can I make a vote yeah Mr Bishop are we still in in the cost of the Lime Rock was is that um also figured in where they want us to make the intersection basically where the streets are across from each other yes in phase one only yes where it comes off a 41 goes back to where the proposed lift station is and it stops right there and phase two takes off from there North okay so I think one question other Chiefs got to follow up but I think the one question I have is even in Phase One the road's going to go all the way through right from 27 to 41 I guess it depends if we build it it will right he's saying no I didn't say no it depends on who build if we build it he wants the whole Road belt I'm sure but if they build it not has been that we would do phase one once we did and that includes the road and anything else and then once we completed phase one and wanted to move on to phase two then we'd move on to phase two but I I'm looking at phase one so so Chief I don't I don't know you got ask turn around so does this require a motion ma'am well it's multiple decisions yeah well and I know the chief had Mr President Chief has a question I think that's important but I don't know the answer okay so it it appears that this role will come out in the county which means we can't own it because it it appears from this map it appears that it is outside of the city limits I I don't know that I don't maybe y'all could tell us is that I understand entire property no disrespect I don't think that's ACC well looking at your map and I could go out and look at it but looking at where the road comes out on your map it looks like it's out of the city limits but I I'll be more than happy to go out there and check it appears it appears I didn't say it appears I say it is question the property that you have Mr Voyer that you were that we were looking at at one time for a hotel that's correct is that in the city limits or out of the city limits it was in the city limits and that's why it is because we changed the height restrictions for that and that would be in the city limits okay and that is the property I'm pretty sure right that's two properties to the west where the to the West okay on the left where the drainage Pond is now going to go oh well actually it's on 41 I mean it's on 27 right the one I'm talking about right see the drain the pond the the do Pond right right left right so the orange square is not in the city of limits I think that it is but I'm not positive it's probably understanding based on our surveys and everything else and that as you point out about the hotel it's in the city Li we did change the height restrictions so that you could put in a three-story Hotel absolutely I remember doing that specifically that was the exit where you're showing it now yes that was on a different property different property yes not this property food properties did see where that green it says uh approximate infiltration Pond yes that's to the that one right there right I think that's where the hotel no that's not correct that's not correct no I think it's where the orange square is I think there's some uh questions as to the Integrity this whole area coming this way and if it came down to it he could always Annex that small portion of if that was the problem but it was annexed back I think it is because we did change height restrictions and I'm pretty sure that's the pie of property yes it is you know we're coming into our have did you look yes on the zoning map West boundary tell me West North South oh the West boundary so that means it's out means it's left side on the west boundary okay gotcha the West thank you we should put one of those on the wall side wall in here side as should look at this map it would be the left side The Far Side of our property on the other side of the entrance gotcha you're tall enough to reach it Don thank you because there's a lot of things on the left side line the way up okay okay just barely but I I do remember that hotel issue so that's the only reason I know it's so I would like to just come back to this we're getting ready to come into our budget season and I don't want to commit to anything right now till we know what our what projects we have can we give them permission to do certain things I we ought to be able to there's something things in here I don't have a problem with at all but don't really cost money that I think we probably could give them permission to do and leave one or two that we weren't sure about right okay what you got I don't know I mean what do you what do you think think that would work I mean we I I don't think we have a problem with the realignment of the South right away we've got to do it theot says we have to do it MH you agree with that or am I making noise no I am I making noise over no no not at all I I think that I think my biggest my biggest concern is is that like I said being the third administration's head a chance or shot at this my Administration works very differently than the last two we we sit down in a room and we've had joint meetings with Mr Bullock Mr Boer and talked about these things but where we hammer out these differences and then when I'm happy they're happy the attorneys are happy which believe it or not that happens right we we all come back and then basically say look I think the the this is the developers agreement that we all agree on it's it's a lengthy process we've already had six years into this my recommendation would be that we go back and and we sit down and we go through the document again right and that basically I get utilities involved I get planning involved and unfortunately Laura couldn't be here tonight and that we all get on the same sheet of music um I can I can tell you that like I said I I do appreciate the guidance on the doing the lime rock I would like to have a decision on that tonight if possible is it something the city's willing to do or not willing to do and then I can take it out of the developers agreement on our end and Mr Boer can say yes I'm very happy with this we can move along um but there's always Drafting and editing and that's all I'm saying it it's been six years right no how long well it's 2024 I got emails dating back 20 2019 yeah I think we were talking about it back at that point but I don't think we made any progress it was before Co yeah how how long you think it's been Mr I think it's been four years okay it's a long time yes sir long time and no fault of his no fault at all ours but I would like to take a fresh look at this um I don't would y'all object to that no I don't have a problem with that I thought that we had done that too yeah and so but and I thought that the only thing that was holding us up was this discussion we've had tonight about the lime rock but I'm happy if you if you feel like we need to do that again then okay let's do it well the reason why I think that way sir is because I spoke to Mr Bullock the other day and actually just found out that because I was going to send you there's a standard one we work with with Kirsten and uh and our attorneys and this is not it um so I was would question him about how' we get it and I was surprised to find out that our attorney sent it to him well think technically Jackie sent okayed yeah so so you know um I think there's just been a lot of confusion on everybody's part and to me it would seem a lot easier if if maybe not starting at Ground Zero I'm not saying that but let's start go back to the document that now I know kirston has looked at um they can make their suggestions send it to me I individually and I can talk to that because that's that's the way it works the way it works today at least is that basically we get together hammer out all the problems we get the port we're all both happy and then basically we bring it in front of them and it it flies by uh with no problems whatsoever and I think that's some of the problems we're having tonight is that we really don't feel comfortable the way it it's it's here um at least I don't so I make a recommendation that we decline to um um appr approve well it's actually no I'm just making sure I'm just making no he wants a decision on the lime rock yeah I would like to help I recommend that we decline um approving The Lime Rock and that it be removed from the contract my only concern is with it is I don't want our next developer to come in and be like oh well we understand you did it for them that we want that that's we have ation from the Contra all right so we have a motion you have a motion but I don't think you have a second no do we have a second okay now we have a motion and a second all right we have a motion we got a second all in favor discuss about discuss discussion sorry may I thank you thank you am I correct I'm ask asking for information here that the lenar subdivision did not get any of this and that the Morales is actually going to give the city money to do it is that what you said earlier so lenar lenar other than their need for natural gas right right got no assistance from the city okay and the the other subdivision is actually going to pay yes sir Morales is currently outside the city yes and in order for them to get the required infrastructure they need they're going to be investing almost $9 million and this subdivision and dat it to the city this subdivision is asking the city to be responsible for numerous things and provide materials for that subdivision are those accurate yes sir thank you that's all I wanted to know can I add one more thing too yes sir um the town home as an example um they're going to have to upgrade woodfields lift station because um it can't handle the flow coming from the town home so not only are they doing their own internal lift station their own infrastructure we're requiring them to upgrade the woodfields lift station to handle that this point no sir this is the town hall Laur Laura point is putting in their own lip station a a brand new one okay but we went even further with the town homes and said because of this influx this where it dumps into is not capable hand so you're going to have to upgrade that one at your cost also I saw that okay I just want to clarification for my own understanding thank you and my only discussion is um possibly we could give a portion of it uh I don't know that we should do the labor itself because I don't think we have the manpower to do that um but if it seemed to be palatable for $10,000 and that has been something that was kicked around before I'm willing to um at least consider that but we do have a motion we do and that's part of the discussion right if I may if I may just add in there may be some more before a final decision is reached it may be more you know maybe more information the city wants to gather if the if the a unique issue with this development opposed to the others if this doesn't go through and it all gets scrapped and the developer decid decide to sell this lot that the city infrastructure would need to be removed from it and so that is a cost consideration the city May into account as well so what what city infrastructure is that like I said there sewer M they might can tell you more I don't I don't know specifically what I'll see but I know there is infrastructure I know there's a fire hydrant there's water there's electric there's sewage I guess it runs to the house that's down there it does do do y'all own that house now I noticed the people had moved out we do we own that okay that's really sounds almost like a threat no sir I don't mean not at all it certainly sounds no sir that is not meant as a threat in any way form or fashion I'll say this I love the city of Williston I love the people of Williston and I would no way at any time for any reason do anything that is intended to be a threat I will say what he's trying to say is that there are other expenses that could become involved that the city would be responsible for and that's all he's trying to say now I I heard what Miss Jones had to say and hope I would like to pursue that okay I would at least like to give it back all back to the city manager and let him work with staff and see what they come back to us with rather than throwing the whole thing out that's just what I'm saying am I correct that if they just deny this doesn't mean it can't come back uh deny right now the motion is to throw this one part out deny the road us paying for the road that's the motion that's what I heard and I don't know if that means it can't come back to me it means it's a resolution I mean it's means that you can have a new resolution you know that I do to to me it would mean if y'all vote in affirmative that I would not include that in my part of the developers agreement that would be your choice yes sir if y'all vote and affirmative you mean if the motion passes that's what you mean by that that you just would re it without that well yes I think it's like you said I think we do need to go back and sit down and have some discussions and look through the whole thing yeah um but I would definitely if your motion carries um then yeah I would not write it because that's the guidance I'm here looking for any other discussion all right see a none move to vote I make what's up all those no we got to do the vote all in favor motion di I don't think you got the vote did you yeah did a motion for a vote no say all in favor of the motion all in favor of the motion say I right the motion carries those opposed I okay just because I want it to be reconsidered and councelor Jones as I stated it cannot it can still be reconsidered except we didn't give him that direction this this vote was denied that's all it was I know but we did not give him that direction and I wanted to give him the direction it does not mean it cannot be reconsidered but you heard what he said it cannot mean I know that Mr Mayor thank you but we just gave him Direction not to include it so you can keep saying that over and over and you can keep saying what you're okay that's enough all right votes four to one motion carries so I guess I I for my part you know I'll be in contact with y'all tomorrow and so we can sit down and Hammer this thing out I know it's been a long time I certainly apologize for that on behalf of my predecessors uh but we will work quickly to resolve any issues that we have okay sounds good sir thank you thank you Mr Bullock item six public participation this is your second opportunity to address the council at this time anyone in the audience plan to come speak at the podium for 5 minutes minutes item seven announcements staff please Marshall really oh cool I've talked to rev and he's very excited about it uh and just to give an update on the participation we're getting from uh other law enforcement agencies we we have agencies that are helping helping us this year that have not helped us in the past uh and they're not sending one they're sending three four five so it's been a very good response from the law enforcement Community coming to help us with our event now saying that they've also requested that we go help them with their events which is okay with us uh we're in the process of doing M us with each with each agency and a lot of this has come from us having those uh chief chief breakfasts that I've been pushing uh so we're all trying to work together uh for the good of the cause for all of our our cities so it's it's going pretty well so we're very excited we're probably at including us the city we probably have 40 people so far we're looking to probably have 50 by the end of the week so it' be a good turnout so we should have enough manpower to have a great event all right and then all the fun and everything else out at the Horseman's Park all right anybody have anything else well so favorite time of the meeting can I get a motion to adjourn I make a motion to adjourn second second all in favor I I meeting a journ
