pledge heavenly father thank you for this day thank you for this opportunity to come together and serve the City of Winter Haven we ask that you be with us and help guide our decisions we ask these things in your name amen amen I pled Al to the flag of the United States of America and to the repblic for it stands one nation God indivisible liy and justice for all all right have the Commissioners had an opportunity to review the previous minutes if so we entertain a motion to approve like to make a motion to uh approve U last last week's minuts you have a second second all right we have a second all those in favor of approving the minutes say I I all oppose same sign all right minutes are approved all right I will move into a brief explanation of how the hearing is going to go cases will be read into the record uh City staff will provide a presentation Commissioners will have an opportunity to ask questions of staff um once they've had an opportunity to a ask their questions we will close the planning portion of the hearing and open the public portion of the hearing anyone from the public wishing to speak for or against a case um starting with the applicant uh may do so we ask that you limit your comments to five minutes um once everybody from the public has had an opportunity to speak we will close the public portion of the hearing and reopen the planning portion of the hearing and Commissioners will be able to ask additional questions or we will entertain a motion and a vote um see anybody who wishes to speak for or against the case if you would please stand and Jordan will swear you in no all right on to new business uh case number p-25 d01 and p-25 d02 request by Regional Real Estate Management LLC to assign neighborhood support future land use to an Annex parcel and to assign commercial Highway C3 zoning District to the same annexed parcel General location a parcel generally located south of dundy Road approximately 1,748 feet east of Overlook Drive Southeast and approximately 108 feet North of Highway 550 the area covered by this request is 0.11 plus or minus Acres right hether reuer for the record uh before you is the future land use map the subject property there is hatched in black and white uh the Parcels in white are still an unincorporated pop County this was an Annex in parcel as you can see the request is for neighborhood support which there is um adjacent across the unimproved rway to the west and also that triangular parcel there uh to the east as you look at the zoning again the request is for C3 which is the commercial Lan use that is um associated in this area with the city as well as with County um designations and uses that are also there we also have some industrial as you had more West the um R2 single family home below was permitted in the county and then annexed in so we put City designation on that to match the use on the property um but had it not been it would probably have been C3 as well as you look at the aial you can see it is undeveloped there is unimproved right away to the North and the West um and some undeveloped as well as you head to the west and then the Industrial and Commercial uses to the Northwest this is a view of the subject property looking to the east as you look to the South this is a South down the unimproved RightWay over to the West the Northwest and north um down the RightWay the petitioner is requesting the city assigned neighborhood support future land use and Commercial Highway C3 zoning District to an Annex parcel the vacant parcel is generally Loc located south of dundy Road um east of Overlook and North of Highway 550 the parcel was annexed into the City May 22nd of 2023 the petitioner intends to develop the property with a small business office for his La care business as these requests contain a smallscale future land use Amendment reviewed by the Florida Department of Commerce and other state and local agencies is not required uh staff's uh review of this request yields the following conclusions the assignment of neighborhoods support uh future land use and C3 zoning district is consistent with the property's location along an Arterial Highway Corridor and with developed uses and City destinations in the area and there is sufficient public infrastructure capacity to accommodate the maximum theoretical development under C3 therefore staff does recommend the Planning Commission recommend approval and forwarding to the city commission for final actions I stand for any questions you may have any questions from commissioners no all McDougall I live at 500 Island Way in Winter Haven uh I am one of the nearby Parcels uh it's really a question and if that's not permitted that's fine that's fine yeah go ahead um but does this have any bearing on whether the RightWay would be paved at any point upon development and through the site plan process they would have to have improved right away to lead to access to their property thank favor say I I all oppose same sign all right case is approved moving on case number p- 25-3 administrative requests to amend the capital Improvement improvements element of the comprehensive plan to update the five-year schedule of Capital Improvements and to revise Capital Improvements element policies 1.1.7 and 1.1.8 relating to the adoption of the Florida Department of transportations and P counties 2024 2025 through 2028 2029 Transportation improvements programs and the P County School boards 2024 2025 through 2028 2029 facilities work programs by reference okay um this is a pretty routine one this is kind of a housekeeping item we have to do every year um but Florida Statutes require all local governments to adopt a fiveyear schedule Capital Improvements as part of their comp plan uh this update includes fiscal years 2425 through 2829 and it is derived from the city's uh 24 25 operating budget as adopted by the city commission back on September 23rd 2024 uh also included our projects for which we're going to be looking to apply for grant funding over the next year or two that's also items we include uh the total Capital spending for the fiveyear schedule is approximately 482 million uh funding is provided from combination of general and Enterprise funds impact fees grants Bond revenues loans State and County revenue Shar sharing in private contributions uh likewise to fully implement the concurrency management system we do have to uh bring in by reference the um annual work programs for fdot p County and the P County School Board and those are likewise addressed by policies 1.1.7 1.1.8 of the Capital Improvements element uh that's all I have and I do recommend uh approval of this request any questions no all right we will close the planning portion of the hearing and open the public portion anybody from the public wishing to speak for or against this case all right seeing none we will close the public portion of the hearing and reopen
