stands one nation under God indivisible Justice all all right first on the agenda is open forum and by the looks of our audience nobody's here for open Forum so we'll move on to approval minutes number one oh no we really do need to add something to the agenda don't we do we not you could probably do that now if you'd like do it now okay so um Council after our work session we do need to add a number 29 onto the agenda and that would be um a motion to approve digital sign for the city of Wyoming is that correct did I st that for the addition yes correct okay all right uh so we need a motion so moved we need a second we have a second by uh member Luger all in favor I I opposed so approved the addition to the agenda all right uh number one consider approving the minutes of the regular meeting of the Wyoming Minnesota city council for December 3rd 2024 if there are no comments or questions we need a mo motion to approve so moved we have a motion to approve by member business number 23 to consider resolution 24121 137 a resolution approving a contract extension with momentum advocacy LLP as lobbyist for the city of Wyoming Mr Lynwood are you taking this one on I will mayor thank you mayor members of council um as you're aware we have been uh working with formerly uh hilden law and advocacy and they now have um morph I'll let Miss uh I'll let U Brian explain that a little more but they are momentum advocacy um in the past that we have utilized their services for uh hope with funding uh through uh the capital investment committee and through the bonding Bill the state of Minnesota for our public safety building um we did work with them last year and I think we've had um discussions with the council that we felt if there would have been a bonding Bill last year that we felt confident that we most likely would have been inclusionary um We are continuing to go through that process this year um I think that they've been really critical um as I talked about in the Mayo and in red in introducing this project to the legislature um facilitated meetings with members from the Senate and House capital investment Community um secured tours from both the Senate and um house Community capital investment committee which is a really big deal and very difficult to do and I don't think there's any way we would have secured those without them um essentially this is very similar to the scope of services that we have received in the past from them um they have not raised any of their prices through this agreement so essentially this agreement would run um through January 25 through June of 2025 um for the amount of 19,800 um we do have a rep representative tonight from momentum advocacy um I'll let you take a moment if you'd like to to speak thank you very much um I we definitely appreciate uh being able to uh work with you again in 20125 uh my name is Brian McDaniel from a momentum advocacy as Mr Lynwood said uh the hilden from hilden advocacy and law is retiring so um I will be uh one of the new principles of momentum advocacy so we're actually growing so uh the amount of people available to work on your behalf uh will be increased we are very uh excited and uh looking forward to this uh uh uh session which begins on January 14th um we think that with the divided legislature that it's going to be much harder to do a fluffier um bonding Bill uh but since what we're going for is pure infrastructure which is the point of a bonding Bill uh we feel very good uh that we will be uh one of the projects uh considered for approval you know hopefully with the the Republicans and Democrats doing their jobs and all that um but um once again we really appreciate working with you it's uh it's you know with everyone who comes up and helps that's very important um as Mr Ericson will tell you um that I'm a Chicago Bears fan so this right here is the best thing has happened to me all week so thank thank all of you very much all right we'll have questions from Cil we'll start with member Luger please I have questions okay member onad no questions member Schilling uh no questions I obviously would like to continue with this okay member Jager okay um are so you say you got detours up here the shago County Press account of those tours has Senator papis cautioning Wyoming basically don't get your hopes up the way the newspaper is written the report the account is written and and the the the account also mentions that Lindstrom has had more than one tour and has had not had any money and has not seen any money so with the recent election why are you more optimistic now than Senator papis or anybody else well for council member uh for one thing uh senator papis would say that to all projects there there are no guarantees they get you know billions and billions more in requests than they're able to uh to um satisfy so it's a lot of times not that the good projects get funded and the bad projects don't it's that they're deciding you know between very good projects um I think the uh the uh election definitely increases our chances of going forward uh under the uh dfl Trifecta you know this area is represented by Republicans uh with the taii now in the house they more than ever are going to need Republican votes and the Republicans are going to have be on an equal footing um in putting together a bonding bill so uh with Senator Karan and uh uh representative uh Rymer uh they are going to have more influence um than they would have had under uh purely dfl control and like I said with um with uh the change in um in in with the divided government they're going to be they there there's going to be a limited number of things that they're going to be able to pass infrastructure projects pure infrastructure projects is probably the only thing uh that they will be able to pass when under the um under dfl control a lot of the bonding money was converted into cash for purposes of using for nonprofit bonding and that really is not likely to be a part of the uh the uh their plan for this for 2025 okay but like you said there's a tie in the house the Senate is still under dfl control as is the governor well with bonding um council member well with bonding um it it's not just a majority thing so they will need you know they need Republican votes in the house and the Senate um which they did before for as well um but uh more what it's going to be is it's it's encouraging because um you know if you can get into the bill initially you have a way better chance of staying in the bill um so uh I was I was encouraged last year that uh uh that that things were going to go well I'm more encouraged now and uh you know because there are so many good projects it's just why it's so important to have uh um you know council members and the mayor and Mr Lynwood up at the capital uh you know uh fighting for this project along with us and um I'm I'm very encouraged I don't I don't like to I don't like to overpromise and underd deliver that's not good business PR practices and so um when we say that we are encouraged we we really are okay because uh Lakes area they've been included in a bonding bill they still haven't seen any money and now the newspaper talks about them downsizing their project I don't know how that question would pertain to the lob I'm not sure he'd know that because you're so encouraged now but this other project that's been in the queue longer that is not going anywhere had its more than one tour had it was included in a bonding Bill and has seen nothing so how are we more encouraged for our project and this one languishes Brian were you their lobbyist for the Lakes no I was not no so that might be too it depends on who you have advocating for you up at the capital correct thank you that that is what I was going to say part of it is um a little bit of uh pride and a little bit of uh um I don't know what the I'm not I'm searching for a word that I'm not finding but but it's not a linear process it's not the first projects in get the first money and then when they run out of money they run out of projects it very much matters how hard do the elected officials in the area fight um how well connected are the lobbyists uh and we're working both sides it's not just Republicans and democ it's it's Republicans and Democrats that you have to get excited about a project and um you know we are one of the bigger firms if in fact with some recent hires we might be the biggest uh firm so we have uh a lot of Firepower a lot of relationships to uh to um trade on I know that uh that uh uh representative elect ryer is on the capital investment committee which is also something that is very very helpful now you thank like Mr Lynwood and the mayor I think Mr cman onstead was doing some lobbying in DC do you lead them did are they free agents do you lead them do you SU suggest what they should be saying how much oh without without question as as much as we um love and respect uh everybody we really think that it's important that that we have a very strategic very focused um plan for who we're meeting with when we're meeting with them and what we're saying uh to them so so you're all aware of every time they've gone down to the state capital or to DC and do you supply them with their talking points or correct that we've been every time we' to the capital or we've had events either dfl or republican uh we have had the lobbyist there and they have been supplying us that information that we should have for talking points and what individuals we need to talk to and what individuals way the beb on capital investment committee um Mr Rhymer will be part of the capital investment committee and he is our representative for this area so I think that will also be helpful and um I don't want to put words in his mouth but early on he has um indicated that he would definitely be interested in our project okay so I have okay um I don't have any questions obviously because we spent a lot of time last year together um and up at the state capital I'm going to just say this had it not been for us hiring a Lobby group and your group in spe specifically because you do put us in front of the people either dfl or GOP or independent or pick a party it is um because of your group we have gotten as far as as we have we tried it without anybody am I correct Mr Lynwood the year before and we got nowhere so um I do believe that because of your um lobbyist group and it's not just you but it's Allison and it's a group of people um Amy comes to mind as well that were able to get in front of the key people that have heard us and heard our story and um we've had a lot of chance is to I would say win friends on either side right that's what I would say so I am all in favor of having you back on again um I'm excited to see what this year is going to bring um and if my um day job is watching they're also very grateful for me being able to go up there so all right uh so we need any other qu oh I didn't finish over here did I did I get everybody everybody had their questions question okay Dennis did okay so we got everybody yeah either so Council MERS uh this is also on the second next item on the agenda with the resolution site excuse me um about two years ago they came in got a final use permit um during that time they had to deal with NCA and our fuel SP they just got that finally taken care of back in for remodel and tear down super gas station in the commercial District it's also the shorel management area for the sunrise River and it also can s the drive through business stand listing the size of the building 207 number of seats inside and outside pares the lot sizes setbacks and allous surface in the Shand District that's allow to be 25% unless there's a condition use per approv at 64.1% CP is required one of the comments during the Planning Commission meeting was since they do have more parking than they need to maybe add some moreen space surf area did not that a just discussed most of the exterior existing materials of brick side gas station access Cuts parking but that's the large combed there no Dives traff um for district do not part of this area so they do not need that permit from them um we've already discussed the overlay district and the improvy surface requirements next um Landscaping utility plans they have over story over over story and under story plantings are going to need some more trees that's listed in the conditional use permit um and then also screen for structures um that like they dumpster that's also one of the conditions in the in the resolution next um so staff and Planning Commission are recommending approval with the 13 conditions listed in the resolution and in the report um the applicant next steps if is approved is to revise those final plans in accordance with those conditions and then and then PL other conditions that need to be addressed as well um Mr wck I do have one memory glitch I know that the commission also there was something else about maybe something should be changed where it needed to be changed but hadn't for a long time do you remember what that was it was towards the end I I believe he was talk I believe that's the entrance area that okay um commissioner lber was talking about so yeah had two two things one that we're you know concerned about that non-divided entrance and the other one was on the sunrise Riverside there's a large U retaining wall built with um landscape well better than landscape timbers and just wanted to make sure that the their engineer had looked at that to make sure it's still stable before okay doing any work on top of them okay perfect um I might have more questions later so um let's start with member onad have no questions okay member Luger no questions member Jagger okay back um in September of of 2022 we were G you were going to demolish the Dairy Queen and rebuild it should we have Mr Michaels would you yeah yeah yeah thank you you yeah you were going to demolish it rebuild a new one uh and remodeling was a secondary option U provided that the architectural standards were relaxed if they weren't then it would just been remodeled so what what has happened since then that we went from building a whole new Dairy Queen with multiple drive-throughs to just simply remodeling this um finances and the plan to bring in a uh a coffee partner in the future um we will be adding a large grassy area in the middle and plans to bring in a partner to share the property with oh okay and then the other question also at that same meeting we passed the cup for 57% impervious surface how did we balloon up to over 60 that I couldn't tell you they added parking I I did not review the the site plan okay and that might be an answer a question that he might be able to answer I'm not sure the resolution it was um 22- 09-73 a it was approving a cup for you guys for a 57% impervious surface so as I read the planning commission's uh report and what was in the in my packet now it sounds like 64.1% is is what it has been and so now I'm asking why did how did we go from 57% that was allowed to 64.1 um I again I believe if if there's been any influx of that it's just with the idea that we're going to bring in another partner a business partner on that on that same plat but this is not with a bringing another business partner in on the same plat this the the report says your impervious surface currently is 64.1% so what they're doing with that is is saying we're planning for 64% so that green space he was just talking about where the coffee shop will be going they're still considering that as impervious because yeah that's what you said on the on the report that's why I asked um because it just it says currently 64.1% impervious okay fine I'm just asking how did we get from a previous cup to this I we have no idea well I I I didn't count well I I guess there's that much more impervious that they added either more parking or or the so they added more stuff yes after in the last two years their new plan is different from their old plan so that's how it's it's shaked out with more impervious okay like I said what I was read in was that's what it already is so and and that's why I'm saying I think they're showing their existing conditions I may well maybe I don't know is it possible that the original plans had some land that was set aside for possible do that that could be I don't remember the dog park I'm saying it wasn't there but I just don't are right that that could very well be I I had to go back into L I apologize we basically don't know okay fine and I apologize the original plan proceeds my time with the company so this is actually the first I've heard of a dog park yeah this is the first time I've heard of a dog park there too I've been on the council for a while I've uh as far as I've know I've heard known our plan is to bring in a coffee part now okay cool uh the in the last question I noticed there were more conditions attached to this and one condition that did not make to you know did not make it in was one regarding speaker sound levels is that being addressed to [Music] elsewhere elsewhere where oh I don't know I mean in the previous in the previous site plan approval there was a condition for um uh regarding speaker the sound levels for the your outdoor speakers in the Drive-Thru it well it it's already in an ordinance requirement you I don't I would have to ask the planner that did that wrote the report why she put it as a condition oh okay because that a condition and then conditions right now number five and then seven through 13 all seem to be new conditions that were imposed in the last two years again it would be based on the the plan was presented last time and the plan was presented this time and and what they saw as being issues between the two I okay I mean I was just thinking speaker noise either you know if you have a drive-thru you got speaker noise so I was just curious why the condition didn't F come through I that I'm not sure but we do have an ordinance regarding speakers and drive-thru okay that's cool that's all I had thank you just a a quick clarification Mr wack this this is a new C it's not it's a brand new so whatever happened then it's it's this is new this is new got it okay um Mr Shilling member chilling so the only thing I saw was in the new you have a giant saw area that's eventually going to be a partner business correct if I'm reading that correct it would share the imprint yes yeah okay that was actually the only question I had otherwise I was fine so that's it I don't have any other questions okay now I got everybody right using my my train thought okay so really the only thing I'm gonna say is I'm I'm I'm happy that there's some updates but I am I will say personally that I am sad that or disappointed that the double drive-thru is not going to happen the things that were talked about earlier because that did create a um a lot of Buzz who does pay attention to um what we do here at the city so very sad that that's not going to happen disappoint I shouldn't say sad that's emotional disappointed more than anything that that's not going to happen or that that uh that business is not coming in as well whatever coffee shop business that was going to be that that isn't coming as well so um we're a growing city it's nice to have those additional amenities and so disappointment that that's not going to happen otherwise if there are no further questions further question you talk about a coffee partner and it's not going to be there now do you have an anticipated timeline I believe the minutes was saying it was a Dunkin Donuts um the yeah the Planning Commission minutes were were mentioning that do you have a timeline of when you think you can get the second the you know Duncan or whatever in there I do not have an exact timeline that I can provide to you today but we would want to utilize the the property as fast as we possibly could so all right the faster the better okay Mr resolution 24121 140 a resolution designating The Entity entirety entity what word did you mean in there of Fall Brook Avenue as no parking huh entirety entirety okay of um Fallbrook Avenue uh as no parking Mr lywood actually that is going to be Mr Reeves correct Mr Reeves oh yes yes so the there's one portion of uh Fall Brook Avenue that has parking remaining stand in right now um the remainder of the of Fall Brook to the on the east side of the road for Northbound and on the west side of the road up to the point north of the property line um there's a section that allows for parking right now and for safety and for um particularly snow events uh this is an issue for visibility for plow operators as well as the general safety of the public and ambulance operators coming in and out of the facility um including roseen Bower when they're test driving fire trucks um so uh we had some internal discussions in the department about this for the sight lines and the visibility the safety for the general public um Mark Ericson city engineer and I discussed this as well and so I brought this forward um to um enhance the no parking area from in the illustration uh to the stop sign so I think it'd be an addition of one n parking sign we uh work together with M Health Fairview on this um in advance and uh bringing this to council um for your for your for the discussion and and get your input hopefully approval okay perfect um let's start with member Shilling please um so just the red line we want to get rid of it there um that's fair viiew employees that park there correct yep I know that because my wife used to park there because it was closer than the other side of the building so I'm actually fine with it because we got a redone Road over there and there's no parking on the rest of it and there shouldn't be any there so okay um member Jager can you show me on the map where that because you reference to the north property line can you show me on the map where the north property line is the illustration yeah so the red area is the area that allows for parking current yeah I know but where's the that property line that you're showing oh that be straight this is this line here sorry is the property oh that's what I've been trying to ask to the yeah okay fine okay I've been trying to ask that for a while stood it just in the last email it made sense yeah okay so you say it's employees uh parking there generally yes generally it so it's not families or friends of er patients correct gu what smokers yep oh that's where they make them go okay but this isn't about smoking this is this is about visibility and safety for the plow operators um oh okay F so the other question is why wasn't this declared a No Parking Zone when we said everything else was no parking if it's not about smoking and it was about safety I I don't know that I was not here for that road project I think I think originally when we did the work on this it had been no parking I don't think we had any real internal discussions at the time um we knew that the duration of the road had been that we had left that for Fair View and I think Mr Ericson I don't think there was anything in regards to the um we did some Advan and cment of our our state aid on that there was anything necessary for the mot standards to change that um it wasn't until later on I think through some of the plowing operations some of the visibility on that corner with traffic pulling out of the emergency room with some of the ambulance traffic and having a conversation um Mr Reeves really started we had a conversation with the chief Bower about it uh and then also with um engineer Ericson to really um talk about how this how this would impact that area um and then I did have conversations with the um superintendent administrator of the hospital really how that would impact them and they didn't have any real strong feeling about it they said essentially that there was um some parking there but they didn't have anything they were fine we wanted to they're a good partners so we wanted to make sure that they didn't have anything where they felt um strongly that there'd be an issue if we were to make that stretch no parking to match the rest of the of the road so but we just happened we just kept it as a parking just for basically for Fair View and we now we have issues I think they were ENT I think they were identified here a little more as we went through it I like I said it wasn't brought up when we redid the road in 23 um I think it was something that Mr Reeves had brought up last year as far as had talked about a little bit last year in regards to um snow plowing how that worked when the par the traffic was there during the day and if we had have issues with winter parking on there which I think we have had some of the past I think um our previous superintendent Mr Al Jill had said that that could be problematic that area um you know I think this would be something with the change I know Fairview is going to do their best to communicate to employees that is but I think um Chief bow I think they're going to if there are issues you're going to you know really it's going to be about education to the individuals out there um you know we're not going to go there and write massive I don't want to speak for chief Boward but be writing tickets it's really good to be to inform and educate the public about the change in the the parking in that area okay all right so um member ler member onad um some of my questions already been answered I answer parking are alwaysed by smokers correct I understand that fairw has a smoking on their campus policy uh and one of the things I'm curious about is if we eliminate the parking there which I believe smokers will go out there use the car to stay warm because that's the only I don't know if Fair has a policy saying you can't smoke in your car either I'd be concerned that we'd have people that uh work in the building would be going out standing on that corner anyways to me that'd be a safety concern for those for those people because now they're standing on an icy snowy Corner that has fire trucks and ambulances going by uh I would also be concerned for anybody that's working uh on a midnight shift where it's dark and they don't have a safe place to actually go in and uh be secure they're just standing outside which would possibly be dangerous um what I would like to see is if there's I know there's other parking if it's just well we don't want to park there because we want to walk short I would go up too bad but if if there's no if there's no other parking my concern is that um where are they going to go smoke I'm not a smoker but I can empathize that will they go still stand on that corner which I would rather not have because it's unsafe not because of smoking I'd want to know K they it looks like there's a parking lot to the to the west or to the east rather Fair View Boulevard do we know if that is allowed for smoking smoke in any of the parking lots that are the whole campus is smoke yeah that's what I would imagine so if any of their parking areas are own by them there supposed to be smoke I did have I did have some conversation with the hospital administrator about that and they are a smoke free campus I think essentially the people that were utilizing that parking it was simply in the winter time to utilize their vehicles to stay warm and smoke I know that they um he stated to me there are other areas um around the building that they go off property to smoke I don't know a fair viiew I don't want to speak for them if they go around if there is an employee that's smoking in their car in the main parking lots I don't know if they're actually going around enforcing that and I don't know how you tell employee from member of public on that there are areas close to that corner as you can see the property line there um where the main doors come out you really wouldn't if a person individual wanted to get off quote unquote Fairview campus and I think that would be the northern property there you can see it's a pretty simple Crossing there where you really wouldn't have to go on the Corner near the street like I said I'm not encouraging individuals to trespass on other people's property but I think there would be opportunities for those individuals to go in areas that they said and I like I said I can't speak for Fair View if they're actually out you know policing individuals and in in cars for smoking I don't know how hard they they do that um but like I said the hospital really didn't have um any real issue with that removing that and they understood essentially that's what it had turned into was individuals who are going out and doing that there so yeah and I I don't know that this is the closest um area for the for the employees to go out to to smoke or if this is just an area where they feel like they can park and stay inside of a warm vehicle and smoke that if this when this is hopefully taken or changes then there might be a closer path for them to get to an area that's not owned by fair viiew to stand in Smoke I can't say safe for certain that it'll be this location this might just be where it was legal to park and stay warm so I you know I don't I'm not familiar enough with their facility where they can get out you know easiest yeah ha to remove any opportunity for someone to to stay warm stay safe um at least at you know any point in time before I knew that there is an alternative and at this point I don't know if you have Fair uh is willing to to provide a safe place to do something that's unsafe kind of but um I I'm not comfortable voting uh against having parking there at this point until I know and I guess we'll see when yeah okay as I um appreciate your comments and safety we need to bring this back to what this is for and it's about safety on that Road and parking on that road we as a council cannot dictate where people can smoke where they can't smoke this is all about safety I don't want people that are smokers to come here to the council and say that we are taking away one of their fundamental rights that's not what this is about it's about safety for our plow trucks it's about safety for EMS that comes through and any fires that should happen within our industrial park with their fire trucks and all that kind of stuff am I correct that that is really what this is about thank you mayor yes this is exactly what it's about so when there's Vehicles park there and a plow truck has to come around the corner you're navigating your plow to make sure you can cut the corner because you move the plow as you turn um if you're to encounter a rosenbower truck that's out on a test drive or an EMS vehicle that's trying to get to the hospital um you run into situations and it just makes it that much more narrow so yes it's totally about safety visibility for the general public our operators and and people coming and going from Fairview and they have just they have a big um liability if they're sitting somebody is sitting in their car they not pay attention they open it obviously a firet truck is huge EMS is huge all that kind of stuff so again I bring it back that it is not about the smoking it's about the safety of anybody that's parking in that spot whether you smoke or not so I have another question that your comments brought up and Brett's comments brought up so yeah that's for snow plows how about in the summer snow plowing in the summer you have fire trucks all year you're not you have fire trucks and EMS all year correct right but you don't have PL you know we we're emphasizing snow plowing but we already have a winter ordinance they can't park there anywhere in the winter is that correct I think that's one of the components that we're emphasizing but I think the other one is just the overall safety and VIs ability on that corner if you ever have tried to pull out from that emergency room area and try to look left it is you do lose visibility by those parked cars so I think it's a combination of the three I don't know if anyone um certainly I'm sure for winter operations as Mr re said that it does make plowing much more difficult but I think overall just the public safety aspect whether it's EMS whether it's a firet truck whether it's just an individual um pedestrian car pedestrian movement trying to get through that and if you have any can we do semis on that road yes the industrial park there semis it's a more Devil's Advocate question you know we talk we we can't park there in the winter so what's the impediments in the summer you're saying mostly fire trucks and em and ambulances and yeah semiu getting into the industrial park it's it's more for consistency in the sense that we're out in a snow event and uh obviously Chief power has shared about one to two officers on at a time so enforcement can be difficult and it doesn't help our operators a ton um even though the ordinance is in place if it's not adhered to and we don't have the enforcement you know somebody starts their shift I know a lot of uh Healthcare professionals will work 12-hour shifts they might start might be unaware of what the forecast is is and all of a sudden we're getting 3 in of snow and the vehicle's still there and that that's frustrating for our operators so I think just for consistency sake to be able to to make it no parking then then it's clear it's clear for the people that utilize that space currently legally um that that is not allowing that and that is one other thing we talked about with Hospital Administration that just to have it Go just leave it as winter parking and we were going to enforce it but then to have it go back and forth and have it for one way for winter and one way for summer that he was under the impression that it would prob cause more confusion for the individuals saying well I thought it was fine this time of year I thought it was in fine and just to do it straight across make it no parking and be done with it cool then you know what to then then the people expectations are clear and you know I just want to thank um Fairview and also Mr lywood and Mr Reeves this goes to show the Partnerships that we have made throughout the years with Fair you being able to go in and actually have conversations and Mr reev it is to you I think every time we have somebody new coming into a position there's new eyes and so when that happens we have a chance to make things safer and better within our city so um I really appreciate that and I appreciate the Partnerships that um we have made Mr Lynnwood um throughout the last eight years all right I will make the motion to approve resolution 24240 a resolution designating the um entirety of Fallbrook Avenue as no parking do we have a second second second by member Luger all in favor I opposed so approved number 27 to consider approval and Adoption of ordinance 20241 an ordinance amending the city of Wyoming code of ordinances chapter 12 businesses article um four is is that four is that six it's four four okay thank you conducting sales of merchandise or food products or engaging in similar uh transient Commerce from a movable place of business Mr wack oh Mr McFarland great what a fun title uh honorable mayor and uh and members of council um the city of Wyoming offers or issues a a variety of licenses within the city um from tobacco retailing to waste hauling and mobile food units um also known as food trucks um part of the process then for our mobile food trucks is that they need to show that they have been uh inspected and approved by the Minnesota Department of Health um what that means is that there's a lot of uh interactivity or interactions between myself and the licensing department and um the representatives from mdh um in recent conversations with that representative from mdh uh staff recently became aware of a change to State Statute regarding mobile food food units um as you're aware all of our licensing processes and regulations are based off of Statute it's important that we remain um within um the the confines of that that statute so the main change specifically within uh State Statute is with chapter 157 subdivision 9 one which now states that it's going to prohibit uh mobile food units from operating for more than 21 days annually at any one location um so basically if if they get a food or if they get a license and they want to operate in front of City Hall it's 21 days throughout the calendar year that's it then they're done in that location um currently our license uh for 2024 allows mobile food units to operate for periods of a week or a day a week week or a year with no uh regulation on how long they can be at any property um so that just means that now um the the city code is not essentially reflecting what the state statute shows there um so the item before you then is an amendment to chapter 12 Article 4 as you stated um to better align with the requirements of Minnesota Department of Health uh and the related State statutes specifically section 12205 which relates to terms um that's been updated section one and two no changes but a through C then changes the term that the the food truck can remain so instead of being a year um and this is reflected in the application that is attached as well um food trucks now then can operate between one of two options but essentially in no location for longer than than 21 days um so attach then um with this is the updated food truck application um and all fees that are associated this would would go through with the fee schedule in 2025 um as well as a Redlin version of the food truck ordinance 20 20241 okay Mr McFarland question on this um is it the food truck it's only when they are selling merchandise it's not if they have a truck they own it it's in their place of business their resident whatever it's only if they are actually having food going out and money collecting in correct correct so it' be the operation of the food truck only operation not standing still well whatever that par okay that's probably a better word for It Fabulous okay thank you um I'm let's see let's start with um member jerger okay so this the new statute says so I have my Gourmet Food Truck so I can park it let's say at City Hall for 21 days in the C in the whole year and then I can then can I move it to um I don't know somebody else's driveway or whatever for another 21 days and just keep moving my little food truck around so yep the State statue just says U throughout the year you can't be in any location for longer than 21 days the new application then to reflect that um dictates what kind of uh or what what you could do so there's two sections for per year we'd allow an individual to apply to say that they're going to get a year license but they won't be operating for more than 21 days total within the city in that case we don't care where you are because you'll never be anywhere longer than 21 days because you're only operating 21 or less days the other option is the perear license in which case you have it for the entire year you have to tell us every location you're going to be and you cannot be in any of those those locations longer than 21 days right but I can as long as I keep moving the food truck around I can be in the city longer than 21 days it's just 21 days in one location so long as you follow the application so you need to let us know where you're going to be um and you also need to have approval from the business owner and Supply a map of where you're going to be we also limitations on you can't be within 200t of a coffee shop an existing restaurant anything like that right so we need to know where they're going to be that's a huge component of this as well but but it's basically I could keep moving my food truck around correct so then why why do we charge for license fee a $100 less to move the food truck than we charge for keeping the food truck at one one location so the the $100 more is for if you have it for the entire year and you move it to multiple locations for 21 days so that could be you have your food truck for 365 days just in I mean I don't know what the maap numerous locations it's $100 less if you just know you're going to operate for 21 or less days within the city at any you know total locations The Way It Was Written I was just curious sure and that makes sense there's been a lot of uh questions from from staff levels well we're expecting people have questions on this okay member Luger member an dad I had question too but once I saw the fee schedule and how it was structured it totally makes sense okay member Shilling no questions all right um we need a motion to approve the adoption of ordinance 20 20241 an ordinance amending the city approved last um item on the agenda that we put on earlier is number 29 and it is a motion um for propo um for a digital sign for the city of Wyoming Mr Lynwood thank you mayor Iverson members of council um we did discuss this at our work session um just to give a little bit of background for the public record for the uh the meeting tonight um the staff with along with city council has been reviewing the potential of a a digital sign um at the Railroad Park location on the uh south side of it about equid distance between the West and East boundaries um the city has approximately $443 63 remaining in their arpa funds which we need to obligate that before the end of this year December 31st 2024 um as part of this The Economic Development Authority that was looking into way finding signs in the downtown has been interested in partnering on this and potentially um estimated up to 10,000 of their funds that they had set aside for a potential way finding sign to put towards this signage um during the council work session staff reviewed three different proposals that we received um from sign manufacturers one being from alre signage um this was a 10mm sign at approximately 61,000 they had a second revised proposal um for the same type of signage only a 15 millimeter signage for 53,000 this signage at the 15 millimeter does not provide the resolution that a 10 millimeter would that was one thing that we discussed with Council that that would be something we would be looking for within that signage um Indico signage provided a estimated sign with a cost of $4 49,942 and then lastly we received a bid from think digital at a cost of $7,450 in signage we did speak about these different signs in depth and the council did have some questions um regarding the Indigo signages they um did look at that stylistically as a sign that they um I guess did did like I was able to reach out um to uh Mr Russ Anderson of indigo signs to discuss some of the questions that Council had and I think I have some answers that I can provide you um regarding the software for it um the software is included in part of the as part of the signage we do receive full training the software is a cloud-based software so essentially it's not something we have to load up we just it's an H https site we log into it we log into our credentials there's no annual subscription there's no cost so basically when we purchase the sign we get that software and that's indefinite with the duration of the sign um that's a called Venus Suite is what they use to run that um in regards to the warranties on it the deconic sign itself has a 5-year warranty we are able to look at warranties after that um if we want to continue on with that you can buy years two years three years four years five years if we want to do that um as part as how we talk to the sign we do receive a 5G Verizon network on the signage that is inclusionary we don't pay like a monthly fee on that 5G it's as part of the sign we can link up to it from here um I don't anticipate that we would have any issues um with that that is just what they um do and lastly um a reminder that the design um on there that they made for the city of Wyoming is proprietary and their property and that is inclusionary on the sign if we look closely oh so we would not have the ability to necessarily ask another individual please copy this sign okay yes okay so in your opinion the guts of the thing is equivalent to the other two I would I would think so yes I would agree that we're receiving essentially the same it's the the doctronics versus the other one but we're going to have the same software and the same things that we would receive with the others yes I'm I'm I'm comfortable with that yes okay and uh the price of $499 that if we had a $10,000 contribution from the Eda whatever they were going to spend on the the W fairing Sign Plus the electrical work that brings us right at budget I would say that with uh that sign um 49,942 for easy math we'll say 50,000 plus we had a high-end estimate of that 2500 for the El the electrical work that need to be done we do believe that we can probably do that a little cheaper if we can uh Public Works would be so kind to work with us on trenching potentially some of that line absolutely the the $50,00 excuse me 52,500 on that so essentially the council has that contribution they did towards the sign as they feel that that not only will impact the community along with some of the things that they're hoping to accomplish with that signage in the downtown and no other City funds will be needed to accomodate this nope okay will we have say in that design I think that as far as the design I think you'll have the you pretty much have it on you know what is on the paper um you know I think that was one thing we can probably ask the council and they had um stated like we talked about utilizing similar blocks to what the bench seating was the park to match that if that's something that you're um you're comfortable with um for that for the base of it you know otherwise I think they can similarly use brick or different things that would you know hopefully be attractive as well and if we and if we do have changes on that I guess maybe that's something I ask the council are you comfortable with utilizing the brick similar to what we have or that similar brick that we have on that sitting wall or is there something else you'd want to see and if so we would probably bring that back you then back to you then for review well as long as it doesn't increase the cost sure okay well this so basically the point tonight is to get the sign approved dollars right get it approved and then we will have a little more time looking at design brick that sort of thing or does that have to be done tonight I would say that based on what they presented here that is the cost I think if you have any real dramatic design changes you take that the potential could be increases in the cost of the sign so um I don't know for sure on that but like I said I don't know know that it's that's what would happen yeah and we can certainly ask the question if Council was not in favor like I said of using a similarly Block Base for that sign to you know to build that if there was something you really felt strongly you want to see whether it was you know brick or stone or whatever that may be um that would I guess be the only but I think the design as it sits would be you know kind of the colors the you know the rendering everything else that would be that would be the expectation from the city that you're going to provide what you gave us as that rendering okay on the I guess the one they kind of Photoshopped in on the ground but it would be in that location and the other one where they really show the dimensions yeah and what the colors of it that's going to be what they what they're installing okay so um member Jer any other questions that thing is uh next door had a very long post and it was probably 30 wonderful comments about how great the tree lighting was how beautiful it is how people need to come and walk through it at night um it was just wonderful comments so I thank everybody for um their hard work and also for our all of our residents who have come out it was I can't guess how many people were there but it was one of our larger I think um events um in its eighth year so also thanks to Public Works because when you guys are putting that up it was 40 mph winds and it was like 100 below zero I'm pretty sure cuz I was out in it too and it was nasty so yeah the crew did a really great job and I've been hearing from other uh community members and actually heard from another neighboring Community uh Public Works maintenance worker that saw it and was really happy to see it so yeah the the crew did a really great job and we're proud of them for it yeah very proud of them for that so um I also attended the Joint Sewer Commission the work session and I have to give a um huge shout out to the video from the fire department I believe in all estimations it has now gone viral if I'm correct on my viral um digital marketing it is crazy I'm hearing for from other Mayors I am hearing from friends I am hearing from people I haven't heard from in forever and I think rob you were talking about 5 million views or something yeah so good job to them and anything that puts us in that positive light that people are talking about is amazing so um thank you to you for your leadership and also to the whole fire department and what they did it was funny my husband left it was funny so um other than that I wish everybody a Merry Christmas happy holidays January 7th is our next meeting and I believe we
