uh January 16 2025 this is the formally advised that is required by General Law chapter 38 sections 18- 25 in pursuant of chapter 20 of the acts of 2021 act relative to extending certain covid-19 measures adopted during the state of emergency signed into a law on June 16th 2021 as extended by chapter 2 of the acts of 2023 the amth Conservation Commission will hold a public meeting at the date and time noted above the public is welcome to attend either in person or via the alternative Public Access provided above and this is the Yarmouth Conservation Commission meeting for Thursday January 16th 2025 uh before we get into our first order of business I did just want to uh acknowledge the passing of Gary Ellis uh Gary was a longterm conservation commissioner here on on this board and he served admirably in that position and then went on to uh chair the uh CPC committee and so uh coner a has lost a real friend with with Gary and so is the town he's done he's just done a lot of work for the town uh so again our sympathies to Gary's family uh moving on then with our first order of business which is a request for determination of applicability uh slooh palmier 88 pine cone Drive uh for proposed raise and replace of a single family dwelling with new septic system and land subject to Coastal storm flood that be you okay so come on up here and get situated and then um when you're ready to go just state your name for the record and then briefly describe the project and what you'd like to do J thank [Applause] you okay for the record my name is Mike Pento with JC engineering put this over there and yep so this project um involves the uh tear down and rebuild of an existing uh single family home on a 9,277 SQ foot lot um what we're proposing to do is uh like I said tear down the home and put up a new home now we are located only within land subject Coast Stone Flowage Zone AE elevation 11 there are no Wetlands within 100 ft of the property so under existing conditions we have a single family home that's uh if you can see it on the plan it's it's actually at a slight angle to the property so the homeowner wishes to take that home and uh you know raise it and now reconfigure a new house that's more parallel to the uh to the property as part of the project we're also going to be uh replacing the existing septic system and put in a new Title 5 system we'll put in a uh a perious driveway and also the uh some Associated utilities like a new water line and a gas line there will be some uh minor gray changes on the property so that we can um you know have enough uh pitch uh for drainage away from the home and also keep the same drainage pattern which would be uh running um storm water from the Westerly direction to the easterly direction and the size of the Swale the depth of the Swale won't be any more than about 8 to n in it's just a matter of uh conveying the the storm water um you know away from the property um I we think it's a good project uh there is no like I said Wetlands within 100 feet and we're just simply here in front of the commission to seek approval for the construction of the home within the Zone a elevation 11 I do want to note to that the proposed house won't have a basement they'll simply have a crawl space and that crawl space floor elevation at one side of the building will match the exterior grade of the U of the property as required by FEMA so with that I would uh take any questions okay thank you uh questions from the Commissioners uh the two trees in the front of the house are they going to stay good question I had a conversation with the homeowner about that and he would like to save those two trees as well as the tree in the backyard next to the shed that one obviously is is not in the area of the proposed work so that shouldn't be a problem however he did caveat his answer by saying that that 20inch tree that's located in the vicinity of the septic system may have to come down depending if the contractor can maneuver around it to install the septic system in the driveway we did go uh we did submit this plan to the Board of Health as well the agent he's already made his review and has preliminarily approved it but obviously the last step is to go through concom and seek your approval so that the um the installer the contractor can start the work okay that's all I have okay anybody reconstruction and expansion of Pier ramp and Float system replacement bulkhead with sloped Stone revetment within land sub to Coastal storm Flowage Coastal Bank salt marsh land under the ocean land containing shellfish and the buffer zones to a salt marsh and Coastal Bank uh we have a request from the uh applicant consultant asking for for a continuance to February 20th 2025 do I have a motion to that effect so moved second all those in favor I opposed carries unanimously uh next order of business is a continued notice of intent for s83 d2452 Wayne tarz Alexander for alexand nof two Buttercup Lane proposed construction of a dock within land subject to Coastal storm Flowage a Coastal Bank salt marsh and land under a water body again uh applicant is requesting a continuance to February 20th 2025 uh and just to note that this is the third and fin final continuance uh requested um under our regulations so uh we will be seeing this or we'll be seeing this on February 20th um is there a motion to continue to February 20th yeah I'll do that okay is second second all those in favor I I opposed car janly you note under 22 Buttercup uh next order of business is a continued storm water permit application for sw220 24-2 uh Imad zahan 228 Route 28 proposed Redevelopment into a mixed use building and we are done with this one it has met uh all of the review peer review uh compliance issues that were outstanding uh and everybody's on the same page it is administratively complete correct yes all right um unless there's any further discussion from the board would somebody business is approval of meeting minutes I am going to table uh the minutes for December 6 2024 I'll table that will that will be tabled till February 20th uh 2025 uh would somebody like to make a delay the process a bit so we're going to still have our meeting I took it off the agenda because it'll be more of a preliminary meeting because they've asked us to wait um until later in February to have our official meeting so this is morning meeting so this is for the Open Space Team of the madis utilization committee the one was the 21 our our team consists of the Conservation Commission the open space committee and lri from the water department um to talk to discuss open space and conservation use um options and mostly regulatory restrictions and um things we might want to incorporate into the madis utilization process so our board is a little different in the fact we're not going to have grandio plans because open space and conservation is more maintain conserve restore um so it's a little going to look a little different from the other committees but I want to have ideas for um components we want to include in other projects where they can fit areas we want to maintain and restore wherever possible and those strict regulatory boundaries that can't be crossed with the project so we're still going to meet on the zoom on 20 on the 22nd and yeah unless you hear otherwise from me um it'll more be a really short preliminary planning meeting okay anything else we also got um some conditional um a positive review from the cedc tour tourism res Revenue uh public improvements fund I put in a request for more um for a small amount of money about $3,000 for signage for conservation areas um where we have dumping and cutting issues um so we got um a good outlook on that I I'm not sure when they're voting on that officially um but they seem to be um in favor of the project and also for for interpretive signage at chasebrook Park um and some of the benches that go along with that project good reviews that's all I've got okay anybody else I was just um I was looking at one of the things on my that came through my email yth highlights and events page and they didn't have our uh Conservation Commission listed for tonight yeah we've there have been some issues with the c town calendar um our our meeting should be up there um no wonder that's why we don't
